The movement of people from one country to another in search of greener pasture, peaceful settlement and so on, has become very rampant in the world today. These same reasons have triggered internal migrations as well. Lives have been lost in the bid to circumvent immigration laws of countries by immigrants. The current spate of wars, political crises, natural disasters and hunger has led to increase in illegal migration in the world. Nigeria is not left out. We hear of boundary (...) clashes and insurgencies, which have resulted in illegal emigration to other countries basically in search of job opportunities and better living conditions. Nigerians have severally been repatriated from foreign lands. Recently, over five thousand Nigerians were repatriated from Libya. Nigeria has also played host to migrants from neighbouring countries, and has experienced internal migration in several parts of the country. The frequently asked questions are: “what role can religion play in curbing the spate of illegal migration and refugee crises in Cross River State, Nigeria? The research discovered that religion can be a veritable partner to government in resolving this ever-increasing menace that has become an embarrassment to the state and nation. This work adopted qualitative or explorative research method. It employed the content analysis approach in examining available printed materials on the subject matter. In view of its peculiarity, oral interviews were conducted on specific groups and individuals. This work proposes the involvement of religious organisations in preaching and teaching on the dangers of illegal migration, the provision of vocational training for our teaming youth population to reduce emigration, and the provision of counselling and resettlement programmes for the repatriated and those in refugee camps across the country. The work also encourages the government to evolve modalities to curb the spate of violence and bloodshed that has fuelled refugee crises in Cross River State and Nigeria in general. (shrink)

This paper examined the contentious issues in the relationship between religion and culture. This relationship appeared to have been cordial and crucial for the corporate existence and development of the society. Although religion and culture are closely knit, there are issues of contention between them. However, these are two concepts or phenomena that exist together for the good of the society. In discovering the issues, the researcher adopted the literary method of study and examined the subject from that perspective. This (...) paper revealed that there is culture in religion as there is religion in culture. These two elements of society (religion and culture) play different roles to keep the society functional. Notably too, religion give meaning to culture. However, the major findings suggest the checking of the excesses of culture over religion to help develop a peaceful and socially conducive atmosphere for the people. Evil is the opposite of good. This phenomenon has unleashed serious threat to human existence. The problem is that it is difficult to understand and even to deal with. Evil is a subject that hasdefied solution politically, socially or religiously. This paper examined the issue of the origin,effect and ways of dealing with evil for a better society. The research adopted the historical andliterary methods of research. Various views are examined. Findings affirmed that God createdevil as well as good. The research identified bloodshed, corruption, demonic activities, human trafficking, child abuseand child dumping/abuse and many others as social vices associated with evil. Reconciling the existence of a perfectly good God with the reality of evil in the world seems to be an impossible - or rather an unimaginable endeavour for some scholars. J. L. Mackie, for instance, maintains a logical incompatibility thesis, stating that three of the essential attributes of God, namely: omnipotence, omniscience and omnibenevolence can not be consistently upheld like the theists maintain, in the face of the reality of evil and human suffering in the world. Scholars like William Rowe, (...) David Hume and J. S. Mill also contend that every instance or trace of evil and suffering in the actual human world makes the existence of the creator of the world who is also perfectly good at best, probable. However, some scholars have attempted to explain the compatibility of the existence of a perfectly good God with the reality of evil in the world. This very endeavour is known in philosophy of religion and theology as theodicy. There are four traditional types of theodicy: The Augustinian tradition, the Irananaean tradition, the Hickian Soul making tradition and process theodicy. Using the methods of analysis and critical argumentation, we attempt a critical re-evaluation of these theodicies in this paper. Our critical investigation reveals that these theodicies inhere some weaknesses which render them insufficient in the rationalisation of the compatibility of the existence of a perfectly good God with the reality of evil in the world. Genealogies in philosophy can be tricky and even a little dangerous. Lines of influence and inheritance run much more linearly on paper than in reality. I am often reminded of Robert Frost's "Mending Walls" and the attention that must be paid to what is being walled in and what is being walled out. In other words, William James and Emmanuel Levinas are not natural conversation partners. I have always read James as a fellow traveler of Edmund Husserl, and placed (...) both in a line of thought that might share Franz Brentano and Wilhelm Dilthey as forebears. In this genealogy, Levinas appears with an asterisk, or after one. Maurice Natanson described Husserlian phenomenology as an elderly grandparent who comes down to dinner just a little bit too early, making everyone uncomfortable. Seating Levinas next to James brings to mind some similar scene. What basic premises or positions do James and Levinas share? Is Levinas a Jamesian pragmatist? Is he a radical empiricist? Does James offer an ethics that parallels or even complements Levinas's rigorous ethical phenomenology? (shrink)

In this paper I offer a comparative evaluation of two types of “fundamental hope”, drawn from the writing of Rebecca Solnit and Rowan Williams respectively. Arguments can be found in both, I argue, for the foundations of a dispositional existential hope. Examining and comparing the differences between these accounts, I focus on the consequences implied for hope’s freedom and stability. I focus specifically on how these two accounts differ in their claims about the relationship between hope and necessity. I (...) argue that both Solnit and Williams base their claims for warranted fundamental hope on a sense of how reality is structured, taking this structure to provide grounds for a basic existential orientation that absolute despair is never the final word. For Solnit this structure is one of unpredictability; for Williams it is one of excess. While this investigation finds both accounts of fundamental hope to be plausible and insightful, I argue that Williams’s account is ultimately more satisfying on the grounds that it offers a realistic way of thinking about a hope necessitated by what it is responsive to, and more substantial in responding to what is necessary. Ayalon Eidelstein’s Openness and Faith focuses on the centrality of the idea of openness, or open-mindedness, to the educational sphere. The first half presents the challenges in modern ‘divided-consciousness’ and its consequences of egoism, materialism, and hedonism on the one hand, and religious fanatism on the other. Eidelstein’s main audience is the Israeli secular public, to which he proposes an educational and philosophical middle-way rooted in sincere human and inter-human openness. This openness is inspired by the idea of disinterestedness that (...) Kant articulates in his Critique of Judgment. Eidelstein refers to additional authors, including Franz Rosenzweig and Emmanuel Levinas, to conceptualize the idea of open-mindedness. In the second half of the book, he engages classical American Pragmatism, specifically that of William James, in order to establish the possibility for, and the validity of, a humane open-mindedness. Pragmatism thus paves the way for accepting beliefs that may otherwise be excluded as superstitions and accords them a legitimate and productive role in the life of a modern individual. The difficulty, however, lies in Eidelstein’s employment of Kantian disinterestedness, for it is in fact seriously dissonant with the worthy pragmatic educational purposes that Eidelstein elaborates in the second half of his book. Pragmatism is opposed to disinterestedness in that it stresses the entanglement of fact and value, viewing interests as playing a necessary and productive part in moral motivation and action, while Kantian deontology eliminates consequentialism from the moral scope. While for pragmatists (for example John Dewey’s Democracy and Education) the human creature is holistically conceived, as made of flesh and blood and not only as ‘spirit’, Kant maintained the dualistic Cartesian tradition. This tension calls for a rigorous address. Since Eidelstein’s book is making an important claim about the place open-mindedness has within the Judaism, it must be noted that the disinterestedness of a presumed human ‘self’ is also not easily compatible with the dominant voices in normative Jewish tradition. The Bible does not deal to a large extent with the ‘self’ or with mental intentions, and its conception of the human is not categorically different in the Talmudic corpus. On the contrary, the rabbis frequently endorse pragmatic and ‘external’ reasons, as the motivational basis for action. The kind of purism associated with disinterestedness (as in Mishnah Avot 5:18-19) is barely represented in rabbinic thought. Openness and Faith: In Search of Cultural Education Here and Now is nevertheless an important contribution to the intellectual discourse over the individual and public virtues. In our ever-more segregated and fenced-off world, there is an urgency to delineating the virtue of openness, hoping that Ecclesiastes is right in contending that “No person has power over the spirit [רוח] to retain it” (8:8). But to make Eidelstein’s point about openness in the second half of his book educationally viable, there a need for a pragmatic refinement of the philosophical anthropology in its first half. One way or the other, Openness and Faith is praiseworthy for its articulateness and depth, which invites its readers to an open-minded conversation about the concept of openness. (shrink)

It is true now that man lives in a world of conflict. Conflict is an ever-present process in human relations. Conflict situations indeed appear frequently in daily, public and private life. Conflict may occur within and among families, groups, communities or nations; and they may be fuelled by ethnic, racial, religious, or economic differences, or may arise from differences in ideologies, values and beliefs. Conflict may be on a small or large scale. Conflict charge the people with tensions, threats, fears, (...) anxieties and uncertainties. What makes a society ideal is the extent to which the conflicting interests and needs in a society are constructively managed so that violence does not threaten its continued existence. Since it is obvious that conflicts in any given society is inevitable, management and resolution of conflict is the very essence of talking about conflict. This is what this work is set to achieve and to offer suggestions on how to manage and resolve conflict thereby reducing its negative and destructive effects. Spirituality connotes praxis informed by religious or faith convictions. This can transform the individual and society at large. Christian spirituality is centered on how a person’s relationship with the God of Jesus Christ informs and directs one’s approach to existence and engagement with the world. The ecosystem concerns humanity and relationship with it is invariably influenced by faith or religious informed praxis. The reality of climate change is convincing many people that humankind’s common homeland needs to be treated with care (...) and respect if created beings are to have a congenial habitat now and in the future. This article avers that Christian spirituality can contribute to eco-friendly behavior through re-formation of the behavior of people and emboldening their goodwill as regards the responsibility of all towards the care of the earth. Finally, this research proffers a three-fold model of eco-spirituality - scriptural, selfcontrol, and sacramental approaches to the earth – as a contribution towards stemming the tide of ecological assaults on creation. This book focuses on discussions of metaphysics and epistemology in early modern India found in the works of the South Indian philosopher Vyāsatīrtha (1460–1539). Vyāsatīrtha was pivotal to the ascendancy of the Mādhva tradition to intellectual and political influence in the Vijayanagara Empire. -/- This book is primarily a philosophical reconstruction based on original translations of relevant parts of Vyāsatīrtha’s Sanskrit philosophical text, the “Nectar of Logic” (Nyāyāmr̥ta). Vyāsatīrtha wrote the Nyāyāmr̥ta as a vindication of his tradition’s theistic world view (...) against the Advaita tradition of Vedānta. In the centuries after it was written, the Nyāyāmr̥ta came to dominate philosophical discussions among Vedānta traditions in India. -/- The Advaitins argued for an anti-realist stance about the empirical world, according to which the world of our experience is simply an illusion that can be dispelled by a deep study of the Upaniṣads. This book reconstructs the parts of the Nyāyāmr̥ta where Vyāsatīrtha argues in favor of the reality of the world against the Advaitins. Philosophically, it focuses on the concept of existence in Vyāsatīrtha’s metaphysics, and on his arguments about knowledge and the philosophy of perception. (shrink)

In contemporary Nigerian society, the evolving trends in Christian religious culture suggest that neoliberal (social) mind-set is influencing certain practices in many Churches. The objective of this paper is to examine how the above-mentioned contemporary culture influences current religious landscape. Awarding rights to rivers, forests, and other environmental entities (EEs) is a new and increasingly popular approach to environmental protection. The distinctive feature of such rights of nature (RoN) legislation is that direct duties are owed to the EEs. This paper presents a novel rebuttal of the strongest argument against RoN: the no interest argument. The crux of this argument is that because EEs are not sentient, they cannot possess the kinds of interests necessary to ground direct duties. Therefore, they (...) cannot be legitimate rights-bearers. After considering and rejecting standard responses to this argument, the paper challenges its fundamental assumption: that rights-correlative duties must be grounded in the interests of the rights-bearer. The paper then presents the RoN critic with a dilemma. The critic must either accept that EEs are legitimate rights-bearers, or delegitimise many well-established rights-bearers along with EEs. Emmanuel Chiwetalu Ossai and Lloyd Strickland argue that the African philosophy of ubuntu, with its emphasis on community, interconnectedness, and practical application of ethical principles, offers a compelling alternative.

I argue that a general feature of human psychology provides strong reason to modify or reject anti-reductionism about the epistemology of testimony. Because of the work of what I call “the background” (which is a collection of all of an individual's synthetizations, summarizations, memories of experiences, beliefs, etc.) we cannot help but form testimonial beliefs on the basis of a testifier's say so along with additional evidence, concepts, beliefs, and so on. Given that we arrive at testimonial beliefs through the (...) work of the background, to be justified in holding a testimonial belief, we must not only have a rational speaker's say so, but we must also form such beliefs in a right way. If this is right, then, contrary to typical anti-reductionism, justified testimonial beliefs require more than just a trustworthy testifier's say so – another requirement is that they are formed in a right way. One way in which bioethicists can benefit the medical community is by clarifying the concept of disorder. Since insurance companies refer to the DSM for whether a patient should receive assistance, one must consider the consequences of one’s concept of disorder for who should be provided with care. I offer a refinement of Jerome Wakefield’s hybrid concept of disorder, the harmful dysfunction analysis. I criticize both the factual component and the value component of Wakefield’s account and suggest how they might (...) be improved. I propose that the factual component should be statistical variation analyzed in multilevel and chronological compilations of physiological data. I propose that the value component should prioritize the individual’s authority regarding the experience of suffering from a physiological condition. My account preserves the insight of using a factual and a value component while avoiding the problems that Wakefield’s original account faces. (shrink)

Contemporary Nigerian society is in its doldrums as regards the culture of violence and distrust among peoples from various ethnic groups that make-up this nation. To an extent, religio-political reasons are fueling this culture of violence and distrust. The thrust of this paper is that: Christian military chaplains are stakeholders as promoters of peace and mutual co-existence in Nigeria with regard to controlling the culture of violence and disunity. The core of this thesis remains Jesus’ convictions concerning non-resistance to the (...) evil one as documented in the Sermon on the Mount, Matthew 5: 38-42, and His life as the Peace-Builder. Therefore, contemporary Nigerian context calls for Christian military chaplains to be more conscious that being messengers of peace and promoters of peaceful coexistence in our country, they have ethical responsibility to build bridges to harmony. Since Christ (God) is love, the chaplains should rediscover the poetics of testimony as a principle for building and reconstructing paths that lead to mutual co-existence in view of encouraging the reign of justice, unity, and peace in Nigeria. The sense of form that provides the modern poet with a unique experience of the literary object has been crucial to various attempts to compare poetry to other cultural activities. In maintaining similar conceptions of the relationship between poetry and painting, Arthur Rimbaud and W. C. Williams establish a common basis for interpreting their creative work. And yet their poetry is more crucially concerned with the sudden emergence of visible "worlds" containing verbal objects that integrate a new kind of (...) literary text. This paper discusses the emergence of "aesthetic worlds" in the work of both poets and then examines how a common concern with Baroque form unites them in the phenomenological task of overcoming Cartesian dualism. A key consequence of globalisation is the integrative approach to reality whereby emphasis is placed on interdependence. Religion being an expression of human culture is equally affected by this cultural revolution. The main objective of this paper is to examine how religious affiliation, among Christians, influences attitudes towards the application of psychological sciences to the assuagement of human suffering. The sociological theory of structural functionalism was deployed to explain attitudinal appraisal. Ethnographic methodology, through quantitative analysis of administered questionnaire, was also (...) used. Traditional Yorùbá culture admits the hegemonic locus that humans rank above all else on the planet. The outlook received decisive ratification several millennia ago in one of the Odùs of their Ifá Corpus. Specifically, in Odù Ògúndá Otura, one of the numerous chapters of the Ifá Corpus, Ọ̀rúnmìlà, the founder and primordial deity of Ifá discloses his authorization, the use of non-human animals for sacrifice and other human ends interminably. In this study, we engage the Ifá chapter that upholds this (...) outlook. We riposte that the age long supercilious perspective among the Yorùbá that humans rank higher and over non-human animals, as documented in the said Odù is no longer tenable on biological and moral-legal grounds. If the biological and moral-legal thrusts are not invalid, what framework is plausible when the interest(s) of non-human animals clash with the interest(s) of Ifá tradition and Yorùbá culture? On what basis will it be appropriate to jettison the interest(s) of the one for the interest(s) of the other? In the light of these posers, we employ Kai Horsthemke’s ethical individualism as the suitable groundwork that considers the interest of animals recommended for sacrifice in Ifá obeisance. (shrink)

I argue that, if doxastic involuntarism is true, then we should reconceive what are traditionally called reasons for belief. The truth of doxastic involuntarism would rule out a certain understanding of reasons for belief according to which they are reasons to form, alter, or relinquish beliefs. Thus, reconceiving reasons for belief would require reconceiving doxastic obligations. I argue that, in fact, a reconception of reasons for belief warrants abandoning the notion of doxastic obligations, understood as obligations to perform acts of (...) belief formation, alteration, or relinquishment. Instead, the only sorts of obligations we would have that concern our doxastic states would be aretaic or practical. (shrink)

The main objective of this work is to uncover, expose and write on the teachings of Jesus Christ which are philosophical. Certain areas of philosophy inherent in Christ teachings are in the areas of Social Philosophy viz: Leadership Philosophy, Philosophy of Peace and Conflict Resolution, Ethics and Virtue Ethics and Law. Newman remains an ecumenical figure held in high esteem by Roman Catholics and Anglicans. His ecumenical hermeneutics is observable in Tract No. 90. This Tract is a re-reading of the Thirty-nine Articles of Religion ratified in 1571 as the fundamentals of the Anglican faith. This tract is the product of the Oxford Movement that returned to the Antiquity in view of resolving the Anglican faith crises epitomized by erastianism. This return to the Fathers of the Church had a lot of (...) implications for the Anglican faith. Influenced by Antiquity, Newman rediscovered the common grounds between the Anglican faith and the church Catholic that inheres in the Roman Church. Thus, Tract No. 90 demonstrated that more things united the Nineteenth Anglicans and the Roman Catholics than what separated them. (shrink)

Religion constitutes an important element in every society as regards coping with the demands as well as vicissitudes of life. Mental health issues are becoming a recurrent decimal in societies overwhelmed by stress and other social factors. This paper examines how the presence of religious beliefs affects how some Christians respond to cases that have to do mental health. At the same time, it surveys how a near absence of religious attitude, that is, clinical medicine approach to mental health issues (...) betters the state of those suffering from these psychopathologies. This work sees participatory partnership approach as an effective means of correcting unhealthy biases that prevent a better understanding of mental health care. Sociological theory of structural functionalism will be used in assessing how religion can reinvent itself in areas that are associated with mental health. Ethnographic methodology through quantitative analysis of administered questionnaire is used as a research tool for this research. Three persons were also interviewed. The research findings show that religion is a crucial agent of socialization that can change how religious beliefs impact on mental health and there is need for medical professionals to collaborate with pastoral agents. This essay explains Donald Hoffman's Interface Theory of Perception using The Biological Framework for a Mathematical Universe proposed by Ronald Williams. According to Hoffman, what we perceive is more like a “desktop interface with icons representing complex underlying processes, rather than a direct window into the true nature of the world." The theory of a biological framework for a mathematical universes suggests that these complex underlying processes of “the desktop interface with icons” contain correspondences to biological systems. For example, (...) “the desktop icons” of the ocean’s arctic currents and the melting and freezing of Antartica contain “complex underlying processes” which mirror the processes of a circulatory system and beating heart. While indeed we do interpret reality from a superficial perspective as Hoffman suggests, our cognitive abilities are enhanced enough to recognize correspondences to these patterns pertaining to these biological systems which reveal the true nature of the world/universe/reality and thus highlight our evolved perceptual systems which can enable us how to recognize these patterns and organize ourselves to them in order to best survive it. Another example of a “desktop icon” is human society—the order and properties of human society contain “complex underlying processes” that are analogous to the order and properties of cellular society—thus “socioeconomic problems” can be understood through cellular economic problems. Moreover, the solution to the cellular economic problem is the solution to the socioeconomic problem. (shrink)

This paper explores the evolution of consciousness and subjectivity through a biological framework for understanding the universe. It posits that functional patterns in biological systems mirror cosmic mathematical principles, defining our objective reality. Similar to wave and Fibonacci patterns in different physical phenomena, biological patterns are intrinsic to all things and can be quantified using Dedre Gentner’s approach to analogy. For example, Earth’s ocean currents and the melting and freezing of Antarctica resemble the circulatory system and heart, while the production (...) of music from instruments is analogous to ribosomal protein synthesis. Shelves, tables, and chairs function like cytosol by holding objects in space, and a coffee cup mirrors red blood cell distribution. These analogies reveal a universal order rooted in biology’s functional patterns, essential for shaping the emergence and evolution of life. The paper traces the development of consciousness from its rudimentary cellular states to complex human cognition, highlighting the role of biologically-patterned environments in driving evolutionary changes. Organisms that recognized and organized according to these patterns evolved as “pattern recognition engines” crucial for survival—thus, Life (survival) being the primary measure of consciousness. Humans advanced this capacity, gaining cognitive freedom by insulating themselves from environmental constraints, but faced increased subjectivity complexity. Consciousness, while inherently subjective and necessary for cognitive development, evolves in humans to understand objective reality and its biological nature, so to understand and navigate complexities of subjectivity. Ultimately, the paper asserts consciousness is the ability to recognize and adhere to life-sustaining patterns and principles. Successful adherence deems them worthy of continued existence, while failure leads to demise. Parallels with historical concepts like Atman and Brahman in Hinduism suggest ancient recognition of the correspondence between human and universal patterns. This ancient understanding, coupled with modern scientific evidence, reveals the interconnectedness and intrinsic biological nature of reality. (shrink)

The objective of this case study concentrated on examining the learning gap, going through some components of the transformation process, and coming up with some ways for aiding students who were experiencing lost learning. A qualitative research design was utilized by the researchers to understand and solve the cases related to Mathematics learning difficulties. Creswell (2008) asserts that qualitative research can be used to discover and comprehend the significance that certain people or groups assign to social or human issues. The (...) researchers used purposive sampling to determine 15 student participants to understand the cases of learning loss and prescribe better interventions to the students. To solve the problems associated with loss of learning experienced by the learners after remote learning, a case study will be utilized as the strategy of inquiry since it fits the situation that is to focus the said key cases, discuss some transforming process, and develop interventions. After analyzing the interviews, researchers identified three common themes across the three cases which serve to clarify the learners' experiences after the post-remote learning: the learners' learning experiences during remote learning, factors that caused learning loss in Mathematics, and learners' coping strategies. The internet has made the world more linked than ever before. While taking advantage of this online transition, cybercriminals target flaws in online systems, networks, and infrastructure. Businesses, government organizations, people, and communities all across the world, particularly in African countries, are all severely impacted on an economic and social level. Many African countries focused more on developing secure electricity and internet networks; yet, cybersecurity usually receives less attention than it should. One of Africa's major issues is the lack of (...) adequate digital security infrastructure, which has harmed businesses, governmental institutions, and individual communities more than it has helped. The majority of African countries operate without cybersecurity measures in place to combat cyberattacks. Only a few examples of today's cyber risks include digital extortion, business email intrusion, data breaches, online fraud, ransomware, and phishing, and new types of cybercrime are always developing. Due to the advent of new technology, cybercriminals have become more organized and quicker in their attacks and alliance creation. To maintain a secure digital environment for all internet users, this study focused on the challenges, solutions, and need for African countries to improve their online safety by tackling cybercrime, online fraud, and cybersecurity concerns. The objective of this study is to offer practical and long-term answers to the problems posed by cybercrime, with a continuing emphasis on enhancing online safety. It will assess the effectiveness of cutting-edge cybersecurity measures, legislative frameworks, and cross-border cooperative efforts, as well as potential areas for improvement. Additionally, the study will examine cutting-edge methods like blockchain technology, machine learning, and other cutting-edge methods that could improve our using digital defences to stop cybercrime. In the constitution of contemporary image theory, Ludwig Wittgenstein’s philosophy has undoubtedly become a major conceptual reference. Rather than trying to establish what Wittgenstein’s own image theory could possibly look like, this paper would like to critically assess some of the advantages as well as some of the quandaries that arise when using Wittgenstein’s concept of ‘seeing-as’ for addressing the plural realities of images. While putting into evidence the tensions that come into play when applying what was initially a theory (...) of the gaze to a theory of the image, the paper shall subsequently discuss three modes of iconic vision: the propositional seeing-as, the projective seeing-in and the medial seeing-with. Ezumezu, a prototype African logic, developed by Jonathan Chimakonam as a framework which mediates thought, theory and method in the African place, is according to him, extendable and applicable in places non-African too. This seems to underscore the universal character of the logic. I interrogate, in this piece, the logic to see if it truly mediates thought, theory and method in Yorùbá ontology on the one hand, and process ontology on the other hand. Through critical analysis, I discern that each (...) of these thought systems operate beyond the principles of classical logic and this is one of the factors that have vitiated their appreciation and comprehension. Upon critical reflection, however, these thought systems seem to follow the principles of Ezumezu logic hence my aim – to disclose how the logic undergirds theory and method for each of those systems. Under the UDHR, all persons have the right to "seek and to enjoy . . . asylum from persecution." From this designation as fundamental followed codification of the right in the 1951 Convention relating to the Status of Refugees and the 1967 Protocol Relating (collectively 'the Convention'), the "centrepiece" of treaties and customary norms that make up international refugee law. It defines and regulates the status and rights of refugees; its purpose is to safeguard the basic rights of persons "outside (...) their country of origin," who have fled due to a legitimate fear of persecution. Fundamentally, it guarantees that asylees and refugees enjoy rights without discrimination; without penalization for illegal territorial entry; and, without expulsion or return to "territories where . . . life or freedom would be threatened on account of . . . race, religion, nationality, membership of a particular social group or political opinion," —or 'non-refoulement'. What follows is background on development of the principle of non-refoulement, evasive US Asylum Cooperative Agreements ('ACAs') and implementing legislation, and the resulting erosion to the right to asylum. For Rousseau, humankind is in a perpetual state of decay—decadency from an earlier, natural, primitive, and perfect state. For Rousseau, the natural man, or man in the state of beast, was of an era where humankind was unencumbered by that which is now entirely associated with society—that is, “. . . establishment of laws and of the right of property . . . the institution of magistracy . . . and the conversion of legitimate into arbitrary power.” For Kant, humankind (...) is in its natural state. For Kant, nature brings about conditions that continually develop and refine humankind’s dispositions, purposefully setting about societies in order to facilitate a foundation within all civilized society, whereby all of humankind’s goals may be achieved. All matters have their place—placed there by nature, as though with purpose. For Kant, nature intended for humankind to employ reason, to acquiesce to coercion for social cohesion, and to strive to build a society that is ever-increasingly progressing towards perfection. Nature uses humankind’s dispositions, including ‘antagonistic’ behavior to gradually bring about a, “perfectly just civil constitution.” Humankind’s highest goal yet to be achieved is for that just civil constitution to emerge from trial and error (in the form of wars, revolutions, secessions, abdications), over time, ultimately providing for development of other dispositions within a perfect society. This chapter is a substantially expanded version of (and so substantially supersedes) “Words Fail Me. (Stanley Cavell’s Life Out of Music)” that appeared in Inheriting Stanley Cavell: Memories, Dreams, Reflections (Bloomsbury, 2020). It offers to read Cavell’s claim that “philosophy, of a certain ambition, tends perpetually to intersect the autobiographical.” Its guiding thought is that a life that finds a home in philosophy from out of its devotion to music (as is true of, among others, Rousseau, Nietzsche, and Wittgenstein, all (...) philosophers Cavell wrote about and cared about) will take on a certain character. In Cavell’s case, his distinctive orientation in philosophy—call this his lifelong coming to terms with his abandoning a life in music—is guided in part by (1) an interest in those moments in experience where words seem to run out, or veer toward nonsense, leaving in their wake touchstones of ecstasy; and (2) an interest in the education of the senses, without which interest we risk their starvation. These twin claims are illustrated through an interweaving of remarks and reminiscences of Cavell on music that culminate in a reading of his last published pieces devoted to music, primarily “Impressions of Revolution.”. This paper investigates how Edward Pusey, a nineteenth century Anglican clergy and scholar responded to Edward Manning’s claim that the Church of England is not an authentic church. This led the former to write his Eirenicon, as an intellectual justification and a response to apostolicity and catholicity of the Anglican faith. Eirenicon is an example in rigorous dialogue on religious faith claims. The ecumenical rapprochement suggested by Pusey is very insightful: emphasis on the elements that unites Roman Catholics and Anglicans (...) as rooted in traditions of the Apostolic Church. After more than 152 years, this work seeks for the relevance of Pusey’s Eirenicon in contemporary Roman Catholic–Anglican faith relationship. (shrink)

The present study examines how online instruction during the COVID pandemic impacted learning and performs a partial replication of a study by Hahn et al. (2012), which compared students’ testing outcomes of the Major Field Test in Business (MFTB) and the Comprehensive Business Exam (CBE). Our results find that online instruction during the 2020-2021 pandemic isolation period had no significant impact on pre- and post-COVID testing outcomes for either exam. It was further found that the question set employed by the (...) CBE exam appears to have changed from the pre- to the post-COVID testing timeframes, making this exam questionable for assurance of learning purposes when compared to prior year results. (shrink)

Husserl’s early picture of explanation in the sciences has never been completely provided. This lack represents an oversight, which we here redress. In contrast to currently accepted interpretations, we demonstrate that Husserl does not adhere to the much maligned deductive-nomological (DN) model of scientific explanation. Instead, via a close reading of early Husserlian texts, we reveal that he presents a unificationist account of scientific explanation. By doing so, we disclose that Husserl’s philosophy of scientific explanation is no mere anachronism. It (...) is, instead, tenable and relevant. We discuss how Husserl and other contemporary thinkers draw theoretical inspiration from the same source—namely, Bernard Bolzano. Husserl’s theory of scientific explanation shares a common language and discusses the same themes as, for example, Phillip Kitcher and Kit Fine. To advance our novel reading, we discuss Husserl’s investigations of grounding, inter-lawful explanation, intra-mathematical explanation, and scientific unification. (shrink)

In By Way of Obstacles, Emmanuel Falque revisits the major themes of his work--finitude, the body, and the call for philosophers and theologians to "cross the Rubicon" by entering into dialogue--in light of objections that have been offered. In so doing, he offers a pathway through a work that will offer valuable insights both to newcomers to his thought and to those who are already familiar with it. For it is only after one has carved out one's pathway that (...) one may see more clearly where one has been and where one might be going. Here readers will discover the profound relation between Falque's emphasis on the human experience of the world and his desire for philosophy and Christian theology to enter into conversation. For only by speaking within the human horizon of finitude can Christianity be credible for human beings, and it is because Christian theology teaches that God entered into our finitude that it can also teach us something of what it is to be human. Contemporary phenomenology, Falque warns, over-privileges an encounter with the infinite that cannot be originary. Calling us back to finitude, he calls us to a deeper understanding of our humanity. An essential property of a thing tells us about the real definition of that thing. In this dissertation, I argue that a real definition states conditions on the identity of things and explains how they differ from other individuals or members of other kinds. I then apply this account to show that some essential properties are discovered by science. I also argue contrary to reductionist accounts of essence and show that several of Kit Fine's applications of the notion of essence (...) to ontological dependence and to the reduction of modality, are spurious. Finally, I argue that the real definition of each human person accounts for their personal identity over time. (shrink)

The article explores the striking coincidences in Heidegger's and Blanchot's account of the image as death mask. The analysis of the respective theories of the image brings forth two radically divergent conceptions of thinking as "laying patent" (Heidegger) and of thinking as "laying bare" (Blanchot).

The problem of global warming and its implications on the continuous existence of the world are alarming. Hence, the phenomenon has attracted a lot of responses from different people including scholars, journalists and religious leaders. While researches on possible solutions to the menace of global warming continue, the contribution of this paper is that a combination of traditional African attitude to nature and Christian theology of environment can be used as a model for the control of global warming. Important elements (...) in the two traditions include the idea of relationship between God, human and nature and the eschatological views of the two traditions. The paper concludes that the combination of these views will help to check human attitude to nature and unbridled craze for material wealth which are the major causes of global warming. (shrink)

CLE aims and clients’ needs conflict where students’ interests are put beyond clients’ needs. Students have interests in gaining employment, impressing instructors and supervisors, and experiencing the active application of law. Where the clients’ service-needs are subordinated to students’ interests, the relationship between the two—the ‘tension’—is tilted in a manner in which the clients are disserved through the fulfilment of students’ interests. This may be exacerbated by faulty institutional cultures where clinical faculty are treated differently, or as less accomplished or (...) ‘worthwhile’ than their ‘traditional’ counterparts. This also emphasizes that it is the clinical law faculty who may exacerbate or assuage the tension, as it is for clinical faculty to assure that clients’ needs are met on ethical grounds,20 and to equate the practice of law with excellence before students. Neutral Theory is controversial in ecology. Ecologists and philosophers have diagnosed the source of the controversy as: its false assumption that individuals in different species within the same trophic level are ecologically equivalent, its conflict with Competition Theory and the adaptation of species, its role as a null hypothesis, and as a Lakatosian research programme. In this paper, I show why we should instead understand the conflict at the level of research programs which involve more than theory. The Neutralist and (...) Competitionist research programs borrow and construct theories, models, and experiments for various aims and given their home ecological systems. I present a holistic and pragmatic view of the controversy that foregrounds the interrelation between many kinds of practices and decisions in ecological research. (shrink)

Intergovernmental relation is an interaction among different levels of government. Intergovernmental relation is often times conflict-ridden, and the extent of the conflict depends on how they are managed by the actor operating at the government levels. This study examines conflict management in intergovernmental relation in Nigeria. The content analysis method would be used. This will be carried out by analyzing data obtained from extant literature on the subject matter. This paper found that intergovernmental conflicts mainly borders on tax jurisdiction and (...) revenue allocation. Other areas of conflict were found to include domination by the centre of other units, as well as, parallel and vertical misunderstanding among units on administrative, legal, social and economic matters. It was suggested that levels of government should introduce such method as discussion, integration, good management of communication in other to attain a peaceful intergovernmental relations regime. Like elsewhere in Nigeria and Africa, the imposition of colonial rule on Batombuland and the incursion of western ideas produced profound socio-cultural, economic and political changes in the Batombu society. However, unlike several Nigerian and African peoples whose histories have received extensive scholarly attention, the history of the Batombu has attracted very little scholarly attention. Thus virtually neglected, the Batombu occupies a mere footnote position in the extant historiography of Nigeria. This is the gap this article seeks to fill. It (...) examines the impact of colonialism and western civilisation on Batombu’s political, social, economic and cultural institutions and concludes that as profound and far-reaching as these changes were some important aspects of the indigenous institutions and traditional practices of the people survived.
