In this paper, we present and defend an analysis of harm that we call the Negative Influence on Well-Being Account (NIWA). We argue that NIWA has a number of significant advantages compared to its two main rivals, the Counterfactual Comparative Account (CCA) and the Causal Account (CA), and that it also helps explain why those views go wrong. In addition, we defend NIWA against a class of likely objections, and consider its implications for several questions about harm and its role (...) in normative theorizing. (shrink)

I argue that extant accounts of harm all fail to account for important desiderata, and that we should therefore jettison the concept when doing moral philosophy.

In this paper, I construct and defend an account of harm, specifically, all-things-considered overall harm. I start with a simple comparative account, on which an event harms a person provided that she would have been better off had it not occurred. The most significant problems for this account are overdetermination and preemption cases. However, a counterfactual comparative approach of some sort is needed to make sense of harm, or so I argue. I offer a counterfactual comparative theory that accounts nicely (...) for such cases, by taking claims about harm to be, potentially, irreducibly plural. In some cases, there are some events such that they are harmful, even if no one of them is such that it is harmful. I try to work out the details. (shrink)

A popular view of harming is the causal account (CA), on which harming is causing harm. CA has several attractive features. In particular, it appears well equipped to deal with the most important problems for its main competitor, the counterfactual comparative account (CCA). However, we argue that, despite its advantages, CA is ultimately an unacceptable theory of harming. Indeed, while CA avoids several counterexamples to CCA, it is vulnerable to close variants of some of the problems that beset CCA.

Given that a person's death is bad for her,whenis it bad? I defendsubsequentism, the view that things that are bad in the relevant way are bad after they occur. Some have objected to this view on the grounds that it requires us to compare the amount of well-being the victim would have enjoyed, had she not died, with the amount she receives while dead; however, we cannot assign any level of well-being, not even zero, to a dead person. In the (...) population ethics literature, many philosophers have argued along similar lines that bringing someone into existence can neither harm nor benefit her. Working within the comparative framework (on which harms make us worse off), I respond by proposing a good sense in which we can say that dead people, and actual people at alternatives in which they do not exist, have a well-being level of zero. In recent years, philosophers have proposed a variety of accounts of the nature of harm. In this paper, I consider several of these accounts and argue that they are unsuccessful. I then make a modest case for a different view.

In several jurisdictions, irremediable suffering from a medical condition is a legal requirement for access to assisted dying. According to the expressivist objection, allowing assisted dying for a specific group of persons, such as those with irremediable medical conditions, expresses the judgment that their lives are not worth living. While the expressivist objection has often been used to argue that assisted dying should not be legalised, I show that there is an alternative solution available to its proponents. An autonomy-based approach (...) to assisted suicide regards the provision of assisted suicide (but not euthanasia) as justified when it is autonomously requested by a person, irrespective of whether this is in her best interests. Such an approach has been put forward by a recent judgment of the German Federal Constitutional Court, which understands assisted suicide as an expression of the person’s right to a self-determined death. It does not allow for beneficence-based restrictions regarding the person’s suffering or medical diagnosis and therefore avoids the expressivist objection. I argue that on an autonomy-based approach, assisted suicide should not be understood as a medical procedure but rather as the person’s autonomous action. (shrink)

In this article I defend innocuousism– a weak form of Epicureanism about the putative badness of death. I argue that if we assume both mental statism about wellbeing and that death is an experiential blank, it follows that death is not bad for the one who dies. I defend innocuousism against the deprivation account of the badness of death. I argue that something is extrinsically bad if and only if it leads to states that are intrinsically bad. The technical possibilities of biomedicine open up the opportunity to intervene in ageing itself with the aim of mitigating, reducing or eliminating it. However, before undertaking these changes or rejecting them outright, it is necessary to ask ourselves if what would be lost by doing so really has much value. This article will analyse the desirability of ageing from an individual point of view, without circumscribing this question to the desirability or undesirability of death. First, we will present the three (...) most widely used arguments to reject biomedical interventions against ageing. We will argue that only the last of these arguments provides a consistent answer to the question of the desirability of ageing. Second, we will show that the third argument falls prey to a conceptual confusion that we will call the paradox of ageing: although ageing entails negative health effects, it leads to a life stage with valuable goods. Both valuations, one positive and the other negative, refer to two different dimensions of ageing: the chronological and the biological. We will defend that, by not adequately distinguishing these two types of ageing, it does not become apparent that all the valuable goods exclusive to ageing derive only from its chronological dimension. Third, we will argue that, if we just conceive ageing biologically, it is undesirable. We will elaborate on the two kinds of undesirable effects biological ageing has: direct and indirect. Finally, we will respond to potential objections by adducing that these are insufficient to weaken our argument. (shrink)

BackgroundThe state of the world is one with scarce medical resources where longevity is not equally distributed. Given such facts, setting priorities in health entails making difficult yet unavoidable decisions about which lives to save. The business of saving lives works on the assumption that longevity is valuable and that an early death is worse than a late death. There is a vast literature on health priorities and badness of death, separately. Surprisingly, there has been little cross-fertilisation between the academic (...) fields of priority setting and badness of death. Our aim is to connect philosophical discussions on the badness of death to contemporary debates in health priorities.DiscussionTwo questions regarding death are especially relevant to health priorities. The first question is why death is bad. Death is clearly bad for others, such as family, friends and society. Many philosophers also argue that death can be bad for those who die. This distinction is important for health priorities, because it concerns our fundamental reasons for saving lives. The second question is, ‘When is the worst time to die?’ A premature death is commonly considered worse than a late death. Thus, the number of good life years lost seems to matter to the badness of death. Concerning young individuals, some think the death of infants is worse than the death of adolescents, while others have contrary intuitions. Our claim is that to prioritise between age groups, we must consider the question of when it is worst to die.ConclusionsDeprivationism provides a more plausible approach to health priorities than Epicureanism. If Deprivationism is accepted, we will have a firmer basis for claiming that individuals, in addition to having a health loss caused by morbidity, will have a loss of good life years due to mortality. Additionally, Deprivationism highlights the importance of age and values for health priorities. Regarding age, both variants of Deprivationism imply that stillbirths are included in the Global Burden of Disease. Finally, we suggest that the Time-Relative Interest Account may serve as an alternative to the discounting and age weighting previously applied in the Global Burden of Disease. (shrink)

I defend a theory of the way in which death is a harm to the person who dies that fits into a larger, unified account of harm ; and includes an account of the time of death's harmfulness, one that avoids the implications that death is a timeless harm and that people have levels of welfare at times at which they do not exist.

Most philosophers in the death literature believe that death can be bad for the person who dies. The most popular view of death’s badness—namely, deprivationism—holds that death is bad for the person who dies because, and to the extent that, it deprives them of the net good that they would have accrued, had their actual death not occurred. Deprivationists thus face the challenge of locating the time that death is bad for a person. This is known as the Timing Problem, (...) which is thought to be one of the biggest challenges facing views holding that death can be bad for the person who dies. Every possible answer to this question has been defended in the literature, yet each answer can seemingly be shown to be subject to compelling objections. In this paper, I argue that the force of the Timing Problem is illusory. Specifically, I argue that the problem, as formulated in the literature, is underspecified. Any adequately precise form of the question ‘When is death bad for the person who dies?’ is one to which there is a clear, decisive, and unproblematic answer. (shrink)

On a view most secularists accept, the deceased individual goes out of existence. How, then, can death be a bad thing for, or harm, the deceased? I consider the doctrine of subsequentism, according to which the bad thing for the deceased, or the harm of death to the deceased, takes place after he or she has died. The main puzzle for this view is to explain how we can predicate a property at a time (such as having a misfortune or (...) being harmed) to an individual who does not exist at that time. This is the Problem of Predication. I consider alternative attempts to solve this puzzle, including one suggested by Ben Bradley, and I argue that they do not succeed. I go on to provide a new way of addressing the Problem of Predication and thus defending subsequentism against this specific threat, contrasting my approach with others currently on offer. (shrink)

According to standard comparativist views, death is bad insofar as it deprives someone of goods she would otherwise have had. In The Ethics of Killing, Jeff McMahan argues against such views and in favor of a gradualist account according to which how bad it is to die is a function of both the future goods of which the decedent is deprived and her cognitive development when she dies. Comparativists and gradualists therefore disagree about how bad it is to die at (...) different ages. In this paper I examine two prominent criticisms of gradualism and show that both misconstrue McMahan. I develop a related criticism that seems to show that a gradualist cannot coherently relate morbidity and mortality. This criticism also fails, but has an instructive implication for how policy-makers setting priorities for health care investments should regard choices between life-saving interventions and interventions against non-fatal diseases in the very young. Desire satisfaction theories of well-being and deprivationism about the badness of death face similar problems: desire satisfaction theories have trouble locating the time when the satisfaction of a future or past-directed desire benefits a person; deprivationism has trouble locating a time when death is bad for a person. I argue that desire satisfaction theorists and deprivation theorists can address their respective timing problems by accepting fusionism, the view that some events benefit or harm individuals only at fusions of moments in (...) time. Fusionism improves on existing solutions to the timing problem for deprivationism because it locates death’s badness at the same time as both the victim of death and death itself, and it accounts for all of the ways that death is bad for a person. Fusionism improves on existing solutions to the problem of temporally locating the benefit of future and past-directed desires because it respects several attractive principles, including the view that the intrinsic value of a time for someone is determined solely by states of affairs that obtain at that time and the view that intrinsically beneficial events benefit a person when they occur. I propose an analysis of harm in terms of causation: harm is when a subject is caused to be worse off. The pay-off from this lies in the details. In particular, importing influential recent work from the causation literature yields a contrastive-counterfactual account. This enables us to incorporate harm's multiple senses into a unified scheme, and to provide that scheme with theoretical ballast. It also enables us to respond effectively to previous criticisms of counterfactual accounts, as well as to sharpen (...) criticisms of rival views. (shrink)

The harm thesis says that death may harm the individual who dies. The posthumous harm thesis says that posthumous events may harm those who die. Epicurus rejects both theses, claiming that there is no subject who is harmed, no clear harm which is received, and no clear time when any harm is received. Feldman rescues the harm thesis with solutions to Epicurus' three puzzles based on his own version of the deprivation account of harm. But many critics, among them Lamont, (...) Grey, Feit and Bradley, have rejected Feldman's solution to the timing puzzle, offering their own solutions in its place. I discuss these solutions to the timing puzzle, and defend the view that while we are alive we may incur harm for which death and posthumous events are responsible. (shrink)

First, what constitutes a person's death? It is clear enough that people die when their lives end, but less clear what constitutes the ending of a person's life.

Most people think it is wrong to take organs from the dead if the potential donors had previously expressed a wish not to donate. Yet people respond differently to a thought experiment that seems analogous in terms of moral relevance to taking organs without consent. We argue that our reaction to the thought experiment is most representative of our deepest moral convictions. We realize not everyone will be convinced by the conclusions we draw from our thought experiment. Therefore, we point (...) out that the state ignores consent in performing mandatory autopsies in some cases. If readers are willing to give up the permissibility of mandatory autopsies, we then offer some metaphysical arguments against posthumous harm. Drawing upon claims about bodies ceasing to exist at death and Epicurean-inspired arguments against posthumous interests, we make a case for an organ conscription policy which respects fundamental liberal principles of autonomy, bodily integrity, and property. According to the Timing Argument, death is not bad for the individual who dies, because there is no time at which it could be bad for her. Defenders of the badness of death have objected to this influential argument, typically by arguing that there are times at which death is bad for its victim. Despite widespread support for the claim that death can harm the one who dies, debate continues over how to rescue this harm thesis (HT) from Epicurus’s challenge. Disagreements focus on two of the three issues that any defense of HT must resolve: the subject of death’s harm and the timing of its injury. About the nature of death’s harm, however, a consensus has emerged around the view that death harms a subject (when it does) by depriving her of the goods (...) life would’ve afforded had she continued living. This deprivation view of death’s harm (DV) derives some of its credibility from the general deprivation theory of which it is an instance: mortal harm is subject to the same kind of analysis plausibly given of other non-mortal harms. Furthermore, note that the weak formulation of HT—asserting only that death can inflict harm, not that it always or necessarily does—accommodates the intuition that instances of rational suicide and justifiable euthanasia present cases in which death fails to harm. DV is equipped to explain how in these cases the harms involved in continued existence outweigh the goods of which death deprives the subject. I agree that suicide can be rational and that euthanasia can be justifiable. Likewise I accept both HT and DV as far as they go. But they do not go far enough. Specifically, I argue here that death harms even those who die as a result of rational suicide or justifiable euthanasia; that death’s harm is neither undifferentiated nor wholly contingent, but multifaceted and partly necessary; that the necessary part of death’s harm is distinctive, inflicting a peculiar restriction on the autonomy of one who dies; and, regarding the timing and subject issues, that this restriction harm is inflicted on the antemortem subject prior to her death. In recent attempts to define ‘harm’, the most promising approach has often been thought to be the counterfactual comparative account of harm. Nevertheless, this account faces serious difficulties. Moreover, it has been argued that ‘harm’ cannot be defined without reference to a substantive theory of well-being, which is itself a fraught issue. This has led to the call for the concept to simply be dropped from the moral lexicon altogether. I reject this call, arguing that the non-comparative approach to defining (...) harm has not been sufficiently explored. I then develop such an account that avoids the difficulties faced by comparative accounts whilst not presupposing a substantive theory of well-being. I conclude that this definition renders a concept of harm that can be meaningfully employed in our moral discourse. (shrink)

Epicurus argued that the good life is the pleasurable life. He also argued that ‘death is nothing to us’. These claims appear in tension. For if pleasure is good, then it seems that death is bad when it deprives us of deeply enjoyable time alive. Here, I offer an Epicurean view of pleasure and the complete life which dissolves this tension. This view is, I contend, more appealing than critics of Epicureanism have allowed, in part because it assigns higher value (...) to pleasures that we produce by exercising our rational capacities and by establishing control over our lives. In this paper I revisit a dispute between Mikel Burley and Robin Le Poidevin about whether or not the B-theory of time can give its adherents any reason to be less afraid of death. In ‘Should a B-theoretic atheist fear death?’, Burley argues that even on Le Poidevin’s understanding of the B-theory, atheists shouldn’t be comforted. His reason is that the prevalent B-theoretic account of our attitudes towards the past and future precludes treating our fear of death as unwarranted. I (...) examine his argument and provide a tentative defense of Le Poidevin. I claim that while Burley rightly spots a tension with a non-revisionary approach to our ordinary emotional life, he doesn’t isolate the source of that tension. The real question is how to understand Le Poidevin’s idea that on the B-theory, we and our lives are ‘eternally real’. I then suggest that there is a view of time that does justice to Le Poidevin’s remarks, albeit a strange one. The view takes temporal relations to be quasi-spatial and temporal entities to exist in a totum simul. (shrink)

In this paper I argue that the growing block theory of time has rather surprising, and hitherto unexplored, explanatory benefits when it comes to certain enduring philosophical puzzles concerning death. In particular, I claim the growing block theorist has readily available and convincing answers to the following questions: Why is it an evil to be dead but not an evil to be not yet born? How can death be an evil for the dead if they no longer exist to suffer (...) it? When is death an evil for the one who dies? The ability to give such answers is a significant, but by no means decisive, advantage for the growing block view of time. (shrink)

What determines the degree to which some event harms a subject? According to the counterfactual comparative account, an event is harmful for a subject to the extent that she would have been overall better off if it had not occurred. Unlike the causation based account, this view nicely accounts for deprivational harms, including the harm of death, and for cases in which events constitute a harm rather than causing it. However, I argue, it ultimately fails, since not every intrinsically bad (...) state that is counterfactually dependent on an event contributes to its degree of harm. So while the causation based account is too restrictive, the counterfactual comparative view is not restrictive enough. In light of this, I suggest an alternative, explanation based account of overall harm, according to which the degree to which some event is harmful for a subject is determined by the degree to which (crudely) the states explained by it are overall more intrinsically bad than intrinsically good for her. A popular view about why death is bad for the one who dies is that death deprives its subject of the good things in life. This is the “deprivation account” of the evil of death. There is another view about death that seems incompatible with the deprivation account: the view that a person’s death is less bad if she has lived a good life. In The Ethics of Killing, Jeff McMahan argues that a deprivation account should discount the evil of (...) death for previous gains in life. Philosophers have said less than is needed about the nature of premature death, and about the badness or otherwise of that death for the one who dies. In this paper, premature death’s nature is clarified in Epicurean terms. And an accompanying argument denies that we need to think of such a death as bad in itself for the one who dies. Premature death’s nature is conceived of as a death that arrives before ataraxia does. (Ataraxia’s nature is also clarified. It (...) is a pervasive inner peace that is a kind of purity and completeness in how one is living.) Whatever harm we might attribute to a premature death is better attributed to a life’s being lived at that time without ataraxia. The paper ends by explaining how its Epicurean account, more so than comparativist or narrativist accounts, could allow a person to know that her death will not be premature. (shrink)

Epicurus argued that death can be neither good nor bad because it involves neither pleasure nor pain. This paper focuses on the deprivation account as a response to this Hedonist Argument. Proponents of the deprivation account hold that Epicurus’s argument fails even if death involves no painful or pleasurable experiences and even if the hedonist ethical system, which holds that pleasure and pain are all that matter ethically, is accepted. I discuss four objections that have been raised against the deprivation (...) account and argue that this response to Epicurus’s argument is successful once it has been sufficiently clarified. The issue of whether biological and psychological properties associated with disability can be harmful, beneficial, or neutral brings up an important philosophical question about how we evaluate disability, and disability’s impact on well-being. The debate is usually characterized as between those who argue disability is intrinsically harmful, and disability rights advocates who argue that disability is just another way of being different, in part, because disability can also provide important benefits. I argue that this debate is a false one, as (...) neither view can capture the more complicated relationship between disability and well-being. I argue that many disabilities are best understood as a kind of pro-tanto extrinsic harm that is characterized in counterfactual terms. In the dispute between presentism and eternalism, the affective dimensions of the debate have been somewhat neglected. Contemporary philosophers of time have not tried to relate these ontological positions with two of the most discussed maxims in the history of ethics – “live in the present” vs. “look at your life under the aspect of the eternity” (sub specie aeternitatis)– that since the Hellenistic times have been regarded as strictly connected with them. Consequently, I raise the question of whether the (...) endorsement of one of these two ontological views can make a practical difference in the way we should live. -/- . (shrink)

When pregnant persons do not behave in the way deemed optimal for their fetus, they are often framed as doing harm. This framing acts as a justificatory bypass for defenses of widespread expectations of pregnant persons, allowing such defenses to avoid substantial questions about special obligations in pregnancy. Our main claim is that this justificatory bypass is unwarranted: in many cases either the pregnant person does not count as doing harm or substantive questions about special obligations cannot be avoided. Lately there has been increased attention to the philosophical issues that death raises, but the focus remains individualistic. Death is philosophically puzzling. Death is thought to be bad for the individual who dies, but there is no one there to experience death as a harm. In this paper I argue that the harm of death is a social harm. Of course, social relationships are fundamentally changed when any member of a social group dies. Death is harmful for those left behind. (...) The problem is not just that social relations are harmed by the loss of a loved one. The very meaning and value of our lives and projects are shaped by social relations. By recognizing death as a social harm that many animals, human and nonhuman, experience, we may be better prepared for the work of mourning. (shrink)

Most people believe that death is bad for the one who dies. Much attention has been paid to the Epicurean puzzle about death that the rests on a tension between that belief and another—that death is the end of one’s existence. But there is nearby puzzle about death that philosophers have largely left untouched. This puzzle rests on a tension between the belief that death is bad for the one who dies and the belief that that death is not the (...) end of one’s existence. Many philosophers have responded to the Epicurean puzzle with the deprivation account of the badness of death, which seeks to make sense of the badness of death given that there is no life after death. Marquis’ future-like-ours argument against the morality of abortion assumes animalism—a family of theories according to which we are animals. Such an assumption is theoretically useful for various reasons, e.g., because it provides the theoretical underpinning for a reply to the contraception-abstinence objection. However, the connection between the future-like-ours argument and one popular version of animalism can prove lethal to the former, or so I argue in this paper.

This essay offers a reading of a difficult passage in the first book of Lucretius' "De Rerum Natura" in which the poet first explains the Epicurean account of time and then responds to a worry about the status of the past (1.459-82). It identifies two possible readings of the passage, one of which is compatible with the claim that the Epicureans were presentists about the past. Other evidence, particularly from Cicero "De Fato", suggests that the Epicureans maintained that all true (...) assertions must have a contemporaneous truth-maker and that no contingent future-tensed assertions are true. It appears, however, that they did not assert a symmetrical view of past-tensed assertions. There is no compelling reason, therefore, to think that the Epicureans were presentists about the past. In this chapter I outline some metaphysical views about time, and about persistence, and discuss how they can help us clarify our thinking about life and death.

This thesis in an invistigation into the concept of "harm" and its moral relevance. A common view is that an analysis of harm should include a counterfactual condition: an act harms a person iff it makes that person worse off. A common objection to the moral relevance of harm, thus understood, is the non-identity problem. -/- This thesis criticises the counterfactual condition, argues for an alternative analysis and that harm plays two important normative roles. -/- The main ground for rejecting (...) the counterfactual condition is that it has unacceptable consequences in cases of overdetermination and pre-emption. Several modifications to the condition are considered but all fail to solve this problem. -/- According to the alternative analysis to do harm is to perform an act which is responsible for the obtaining of a state of affairs which makes a person’s life go worse. It is argued that should be understood in terms of counterfactual dependence. This claim is defended against counterexamples based on redundant causation. An analysis of is also provided using the notion of a well-being function. It is argued that by introducing this notion it is possible to analyse contributive value without making use of counterfactual comparisons and to solve the non-identity problem. -/- Regarding the normative importance of harm, a popular intuition is that there is an asymmetry in our obligations to future people: that a person would have a life worth living were she to exist is not a reason in favour of creating that person while that a person would have a life not worth living is a reason against creating that person. It is argued that the asymmetry can be classified as a moral option grounded in autonomy. Central to this defence is the suggestion that harm is relevant to understanding autonomy. Autonomy involves partly the freedom to pursue one’s own aims as long as one does no harm. (shrink)

In a recent article in this journal, Eli Pitcovski puts forward a novel, explanation-based account of harm. We seek to show that Pitcovski’s account, and his arguments in favor of it, can be substantially improved. However, we also argue that, even thus improved, the account faces a dilemma. The dilemma concerns the question of what it takes for an event, E, to explain why a state, P, does not obtain. Does this require that P would have obtained if E had (...) not occurred? Pitcovski’s theory faces problems no matter how one answers that question. (shrink)

The one who dies is deprived of goods that this person would have enjoyed if he or she had continued living, according to the popular “deprivation account of harm.” The person who dies “prematurely” is generally thought to suffer the most harm from death. However, the concept of a premature death is unclear, as will be shown. I will evaluate various definitions of a premature death and will argue that the existing definitions are too ambiguous and unreliable to serve as (...) the basis for estimating the degree of harm from death. If Epicurean arguments for the harmlessness of death are successful, then they also successfully undermine a common justification for physician-assisted suicide, euthanasia, and the termination of hopeless pregnancies that I call the ‘Mercy Intuition', according to which, by ending the life of a suffering loved one for whom there is little to no chance of recovery, one is relieving that person of her suffering, and thus providing a great benefit to her. For, if death is not a harm to the (...) person who dies, then it cannot be a benefit to her either, even in cases of intense and prolonged suffering. Along these lines, in this paper, I defend the claim that death cannot provide a benefit to those who are suffering. I begin by highlighting the Epicurean foundations of the argument, focusing on three main Epicurean arguments for the harmlessness of death and their no-benefit analogues. I then move on to explore several important limitations of the argument, which make available a number of strategies for avoiding its conclusion. Along the way, I respond to each of these avoidance strategies. I conclude that even granting several of its limitations, the argument still poses a serious challenge to the Mercy Intuition. I suggest a way in which metaphysics might cure us of our desire for immortality. Supposing that time is composed of instants, or even that time could be composed of instants, leads to the conclusion that there is nothing good that immortality offers, nothing we might reasonably want, that is in principle unavailable to a mere mortal. My argument proceeds in three stages. First, I suggest a necessary condition for a feature to ground the desirability of a life or a (...) portion thereof. Second, after distinguishing between three different features that could plausibly be meant by ’immortality’, I argue that if time could be composed of instants, only one of those features satisfies the necessary condition, and it evidently fails to ground the desirability of a life. Third, I argue that no feature that entails any of the three features grounds the desirability of a life either. I conclude with reflections on what this means for our longing for immortality. This thesis takes up a rights-based perspective to discuss a number of issues related to the problem of permissible harm. It appeals to a person’s capacity to shape her life in accordance with her own ideas of the good to explain why her death can be bad for her, and why each of us should have primary say over what may be done to her. The thesis begins with an investigation of the badness of death for the person who dies. (...) If death is bad for us, this helps explain the wrongness of killing. The thesis defends the deprivation account—i.e. the idea that death is bad for us when and because it deprives us of good life—against two Epicurean challenges. It adds that death is also bad when and because it thwarts our agency. Next, the thesis deals with the logic of our moral rights to non-interference. It proposes a conception of rights according to which the stringency of our rights derives from and is justified by the rational aspect of our human nature. It argues that this conception of moral rights solves the paradox of deontology. While our rights to non-interference are stringent, they are not absolute. The thesis considers two possible exceptions to the general rule that it is impermissible to harm an innocent person against her consent. First, using an actual case from WWII, it investigates the circumstances under which a government may expose some parts of its population to an increased risk of harm in order to decrease the risk to others. Second, it considers the permissibility of self-defence against an innocent threat. It argues that the potential victim of an innocent threat has a justice-based reason to treat her own interests as on a par with those of the threat. (shrink)
