What is the relation between a reason and an action when the reason explains the action by giving the agent's reason for doing what he did? We may call such explanations rationalizations, and say that the reason rationalizes the action. In this paper I want to defend the ancient - and common-sense - position that rationalization is a species of ordinary causal explanation. Robert Kane provides a critical overview of debates about free will of the past half century, relating this recent inquiry to the broader history of the free will issue and to vital currents of twentieth century thought. Kane also defends a traditional libertarian or incompatibilist view of free will, employing arguments that are both new to philosophy and that respond to contemporary developments in physics and biology, neuro science, and the cognitive and behavioral sciences.

This comprehensive study offers a balanced assessment of libertarian accounts of free will. Bringing to bear recent work on action, causation, and causal explanation, Clarke defends a type of event-causal view from popular objections concerning rationality and diminished control. He subtly explores the extent to which event-causal accounts can secure the things for the sake of which we value free will, judging their success here to be limited. Clarke then sets out a highly original agent-causal account, one that integrates agent (...) causation and nondeterministic event causation. He defends this view from a number of objections but argues that we should find the substance causation required by any agent-causal account to be impossible. Clarke concludes that if a broad thesis of incompatibilism is correct--one on which both free will and moral responsibility are incompatible with determinism--then no libertarian account is entirely adequate. Saul Smilansky presents an original new approach to the problem of free will, which lies at the heart of morality and self-understanding. He maintains that the key to the problem is the role played by illusion. Smilansky boldly claims that we could not live adequately with a complete awareness of the truth about human freedom and that illusion lies at the center of the human condition.

The thesis of this article is that there has never been any ground for the controversy between the doctrine of free will and determinism, that it is based upon a misapprehension, that the two assertions are entirely consistent, that one of them strictly implies the other, that they have been opposed only because of our natural want of the analytical imagination. In so saying I do not tamper with the meaning of either phrase. That would be unpardonable. I mean free (...) will in the natural and usual sense, in the fullest, the most absolute sense in which for the purposes of the personal and moral life the term is ever employed. I mean it as implying responsibility, merit and demerit, guilt and desert. I mean it as implying, after an act has been performed, that one " could have done otherwise " than one did. I mean it as conveying these things also, not in any subtly modified sense but in exactly the sense in which we conceive them in life and in law and in ethics. These two doctrines have been opposed because we have not realised that free will can be analysed without being destroyed, and that determinism is merely a feature of the analysis of it. And if we are tempted to take refuge in the thought of an "ultimate ", an "innermost" liberty that eludes the analysis, then we have implied a deterministic basis and constitution for this liberty as well. For such a basis and constitution lie in the idea of liberty. -/- The thesis is not, like that of Green or Bradley, that the contending opinions are reconciled if we adopt a certain metaphysic of the ego, as that it is timeless, and identifies itself with a desire by a " timeless act". This is to say that the two are irreconcilable, as they are popularly supposed to be, except by a theory that delivers us from the conflict by taking us out of time. Our view on the contrary is that from the natural and temporal point of view itself there never was any need of a reconciliation but only of a comprehension of the meaning of terms. (The metaphysical nature of the self and its identity through time is a problem for all who confront memory, anticipation, etc.; it has no peculiar difficulties arising from the present problem.) -/- I am not maintaining that determinism is true; only that it is true insofar as we have free will. That we are free in willing is, broadly speaking, a fact of experience. That broad fact is more assured than any philosophical analysis. It is therefore surer than the deterministic analysis of it, entirely adequate as that in the end appears to be. But it is not here affirmed that there are no small exceptions, no slight undetermined swervings, no ingredient of absolute chance. All that is here said is that such absence of determination, if and so far as it exists, is no gain to freedom, but sheer loss of it; no advantage to the moral life, but blank subtraction from it. -- When I speak below of "the indeterminist" I mean the libertarian indeterminist, that is, him who believes in free will and holds that it involves indetermination. This paper has two parts. In the first part, I concede an error in an argument I have given for the incompatibility of free will and determinism. I go on to show how to modify my argument so as to avoid this error, and conclude that the thesis that free will and determinism are compatible continues to be—to say the least—implausible. But if free will is incompatible with determinism, we are faced with a mystery, for free will undeniably exists, and (...) it also seems to be incompatible with indeterminism. In the second part of this paper, I will defend the conclusion that the concept of agent causation is of no use to the philosopher who wants to maintain that free will and indeterminism are compatible. I conclude that free will remains a mystery---that is, that free will undeniably exists and that there is a strong and unanswered prima facie case for its impossibility. (shrink)

This chapter defends a history-sensitive compatibilist view of free action and moral responsibility against various criticisms by compatibilists. It constructs a new argument for incompatibilism that makes vivid a problem that luck poses for compatibilism: the zygote argument. It is argued that the zygote argument is much more powerful than more familiar arguments for incompatibilism, and that, even so, compatibilism may survive the attack.

In a recent paper I argued that agent causation theorists should be compatibilists. In this paper, I argue that compatibilists should be agent causation theorists. I consider six of the main problems facing compatibilism: (i) the powerful intuition that one can't be responsible for actions that were somehow determined before one was born; (ii) Peter van Inwagen's modal argument, involving the inference rule (β); (iii) the objection to compatibilism that is based on claiming that the ability to do otherwise is (...) a necessary condition for freedom; (iv) "manipulation arguments," involving cases in which an agent is manipulated by some powerful being into doing something that he or she would not normally do, but in such a way that the compatibilist's favorite conditions for a free action are satisfied; (v) the problem of constitutive luck; and (vi) the claim that it is not fair to blame someone for an action if that person was determined by forces outside of his or her control to perform that action. And in the case of each of these problems, I argue that the compatibilist has a much more plausible response to that problem if she endorses the theory of agent causation than she does otherwise. One of the proposed solutions to the problem that has received a great deal of attention is the Theory of Agent Causation. While the theory has enjoyed its share of advocates, and perhaps more than its share of critics, the theory’s advocates and critics have always agreed on one thing: the Theory of Agent Causation is an incompatibilist theory. That is, both believers and nonbelievers in the theory have taken it for granted that the most plausible version of the Theory of Agent Causation is one according to which freedom and determinism are incompatible. In fact, so entrenched is this assumption that no one on either side of the debate has ever questioned it. Here I examine the charge that the indeterminism required by event-causal accounts is at best superfluous; if free will is incompatible with determinism, then, it is said, no event-causal libertarian account adequately characterizes free will. The distinction between broad incompatibilism and merely narrow incompatibilism is brought to bear. If the latter thesis is correct, then an event-causal account can secure all that is needed for free will. However, if broad incompatibilism is correct, then no event-causal account is adequate, though such (...) views can still secure some things of value that cannot exist given determinism, such as distinctive types of difference-making and attributability, and the truth of the presumption of open alternatives that we commonly make while deliberating. Is it ever possible for people to act freely and intentionally against their better judgement? Is it ever possible to act in opposition to one's strongest desire? If either of these questions are answered in the negative, the common-sense distinctions between recklessness, weakness of will and compulsion collapse. This would threaten our ordinary notion of self-control and undermine our practice of holding each other responsible for moral failure. So a clear and plausible account of how weakness of will and self-control (...) are possible is of great practical significance. Taking the problem of weakness of will as her starting point, Jeanette Kennett builds an admirably comprehensive and integrated account of moral agency which gives a central place to the capacity for self-control. Her account of the exercise and limits of self-control vindicates the common-sense distinction between weakness of will and compulsion and so underwrites our ordinary allocations of moral responsibility. She addresses with clarity and insight a range of important topics in moral psychology, such as the nature of valuing and desiring, conceptions of virtue, moral conflict, and the varieties of recklessness (here characterised as culpable bad judgement) — and does so in terms which make their relations to each other and to the challenges of real life obvious. My topic lies on conceptual terrain that is quite familiar to philosophers. For others, a bit of background may be in order. In light of what has filtered down from quantum mechanics, few philosophers today believe that the universe is causally deterministic. That is, to use Peter van Inwagen's succinct definition of “determinism,” few philosophers believe that “there is at any instant exactly one physically possible future.” Even so, partly for obvious historical reasons, philosophers continue to argue about whether free (...) will and moral responsibility are compatible with determinism. Compatibilists argue for compatibility, and incompatibilists argue against it. Some incompatibilists maintain that free will and moral responsibility are illusions. But most are libertarians, libertarianism being the conjunction of incompatibilism and the thesis that at least some human beings are possessed of free will and moral responsibility. (shrink)

In what follows, I shall presuppose the ecumenical core of the causal powers metaphysics. The argument of this paper concerns what may appear at first to be a wholly unrelated matter, the metaphysics of free will. However, an adequate account of freedom requires, in my judgment, a notion of a distinctive variety of causal power, one which tradition dubs ‘agent-causal power’. I will first develop this notion and clarify its relationship to other notions. It it tempting to think that if an outcome had some probability of not occurring, then we cannot explain why that outcome in fact occurred. Despite this intuition, most philosophers of science have come to admit the possibility of indeterministic explanation. Yet some of them continue to hold that if an outcome was not determined, it cannot be explained why that outcome rather than some other occurred. I argue that this is an untenable compromise: if indeterministic explanation is possible, then (...) indeterministic contrastive explanation is possible too. A crucial question for libertarians about free will and moral responsibility concerns how their accounts secure more control than compatibilism. This problem is particularly exasperating for event-causal libertarianism, as it seems that the only difference between these accounts and compatibilism is that the former require indeterminism. But how can indeterminism, a mere negative condition, enhance control? This worry has led many to conclude that the only viable form of libertarianism is agent-causal libertarianism. In this paper I show that this conclusion (...) is premature. I explain how event-causal libertarianism secures more control than compatibilism by offering a novel argument for incompatibilism. Part of the reason my solution has gone unnoticed is that it is often mistakenly assumed that an agent's control is wholly exhausted by the agent's powers and abilities. I argue, however, that control is constituted not just by what we have the ability to do, but also by what we have the opportunity to do. And it is by furnishing agents with new opportunities that event-causal libertarianism secures enhanced control. In order to defend this claim, I provide an analysis of opportunities and construct a novel incompatibilist argument to show that the opportunity to do otherwise is incompatible with determinism. A familiar feature of our moral responsibility practices are pleas: considerations, such as “That was an accident”, or “I didn’t know what else to do”, that attempt to get agents accused of wrongdoing off the hook. But why do these pleas have the normative force they do in fact have? Why does physical constraint excuse one from responsibility, while forgetfulness or laziness does not? I begin by laying out R. Jay Wallace’s (Responsibility and the moral sentiments, 1994 ) theory of (...) the normative force of excuses and exemptions. For each category of plea, Wallace offers a single governing moral principle that explains their normative force. The principle he identifies as governing excuses is the Principle of No Blameworthiness without Fault: an agent is blameworthy only if he has done something wrong. The principle he identifies as governing exemptions is the Principle of Reasonableness: an agent is morally accountable only if he is normatively competent. I argue that Wallace’s theory of exemptions is sound, but that his account of the normative force of excuses is problematic, in that it fails to explain the full range of excuses we offer in our practices, especially the excuses of addiction and extreme stress. I then develop a novel account of the normative force of excuses, which employs what I call the “Principle of Reasonable Opportunity,” that can explain the full range of excuses we offer and that is deeply unified with Wallace’s theory of the normative force of exemptions. An important implication of the theory I develop is that moral responsibility requires free will. (shrink)

Nearly all defences of the agent-causal theory of free will portray the theory as a distinctively libertarian one — a theory that only libertarians have reason to accept. According to what I call ‘the standard argument for the agent-causal theory of free will’, the reason to embrace agent-causal libertarianism is that libertarians can solve the problem of enhanced control only if they furnish agents with the agent-causal power. In this way it is assumed that there is only reason to accept (...) the agent-causal theory if there is reason to accept libertarianism. I aim to refute this claim. I will argue that the reasons we have for endorsing the agent-causal theory of free will are nonpartisan. The real reason for going agent-causal has nothing to do with determinism or indeterminism, but rather with avoiding reductionism about agency and the self. As we will see, if there is reason for libertarians to accept the agent-causal theory, there is just as much reason for compatibilists to accept it. It is in this sense that I contend that if anyone should be an agent-causalist, then everyone should be an agent-causalist. (shrink)

The Theory of Agent Causation has always been formulated as an incompatibilist view, but I think that this has been a mistake. The aim of this paper is to argue that, contrary to what agent causation theorists and their opponents have always believed, the most plausible version of the Theory of Agent Causation is actually a compatibilist version of that theory. I formulate the traditional version of the Theory of Agent Causation, and consider a series of objections to it and (...) related views. With each objection comes a corresponding revision of the theory that is motivated by that objection, and with each revision the theory becomes increasingly compatibilistic until, finally, we arrive at a completely compatibilistic version of the Theory of Agent Causation, which I take to be the most plausible version of that theory. I assess Robert Kane's view that global Frankfurt-type cases don't show that freedom to do otherwise is never required for moral responsibility. I first adumbrate Kane's indeterminist account of free will.This will help us grasp Kane's notion of ultimate responsibility, and his claim that in a global Frankfurt-type case, the counterfactual intervener could not control all of the relevant agent's actions in the Frankfurt manner, and some of those actions would be such that the agent could have done otherwise. Appealing (...) to considerations of responsibility and luck, I then show that the global cases survive Kane's objections. (shrink)

Key elements of Randolph Clarke's libertarian account of freedom that requires both agent-causation and non-deterministic event-causation in the production of free action is assessed with an eye toward determining whether agent-causal accounts can accommodate the truth of judgments of moral obligation.

The aim of the paper is to prove the consistency of libertarianism. We examine the example of Jane, who deliberates at length over whether to vacation in Colorado (C) or Hawaii (H), weighing the costs and benefits, consulting travel brochures, etc. Underlying phenomenological deliberation is an indeterministic neural process in which nonactual motor neural states n(C) and n(H) corresponding to alternatives C and H remain physically possible up until the moment of decision. The neurophysiological probabilities pr(n(C)) and pr(n(H)) evolve continuously (...) according to the different weights Jane's judgement attaches to C and H at different times during the deliberation. The overall process is indeterministic, since Jane's exact judgemental weighting would vary slightly were the process to be repeated from the same initial conditions. The weighting is however rational, and entirely under Jane's control. This controlled, rational, indeterministic process shows that libertarianism is a consistent philosophical thesis. (shrink)
