Dugundji proved in 1940 that most parts of standard modal systems cannot be characterized by a single finite deterministic matrix. In the eighties, Ivlev proposed a semantics of four-valued non-deterministic matrices (which he called quasi-matrices), in order to characterize a hierarchy of weak modal logics without the necessitation rule. In a previous paper, we extended some systems of Ivlev’s hierarchy, also proposing weaker six-valued systems in which the (T) axiom was replaced by the deontic (D) axiom. In this paper, we (...) propose even weaker systems, by eliminating both axioms, which are characterized by eight-valued non-deterministic matrices. In addition, we prove completeness for those new systems. It is natural to ask if a characterization by finite ordinary (deterministic) logical matrices would be possible for all those Ivlev-like systems. The current and the next issues of “Spazio Filosofico”, both devoted to Festival (Festival I and II respectively), are dedicated to Ugo Perone on the occasion of his 70th birthday. Perone’s friends and colleagues have chosen to celebrate his birthday in a philosophical way, namely, with a reflection on the concept of festival/holiday [festa] and its meaning for us today. Thrifty spirits might object that a journal issue is like a gift – one is enough. Are these not times of (...) economic crisis? There is no real festival, however, without a Zugabe: without an addition, an encore, or a supplement. Hence, two issues, both devoted to a single concept. The choice of the theme has not been accidental – the concept of “festival/holiday” plays in fact an important role in Perone’s thought. In an essay that is often quoted in various contributions to the two issues, Perone understands the pair of concepts “ultimate/penultimate,” which has been discussed by Dietrich Bonhoeffer, in terms of “holidays/everydayness.” For Bonhoeffer, God is present not where human abilities fail but rather “at the center of the village.” Likewise, for Perone, the square, which is the “symbol for the holiday time,” is the center of town. This paper investigates how the female political movement occurred between 1945 and 1955 in Argentina, specifically within the Feminist Peronist Party. In this paper, the specific objectives are: first, to provide a brief overview of the history of Latin America, placing a focus on the geopolitical context of the region; and second, to briefly present the situation from the perspective of Peronism, including its theoretical, political, economic, and social characteristics. Next, the research focuses on the female movements led by Eva (...) Perón, analyzed using sources from Díaz (2005) and Olguin (2013). The last part points out some criticisms of the Argentine scenario of the time and the social justice movements undertaken by the Peronist Party. Moreover, the theoretical framework includes texts from Barros (2016) and Perrig (2015). For the construction of the idea of Conservative-Progres sivism, the theoretical guiding thread that guides our research is the texts of Barry (2007, 2008, 2011a, 2011b, 2011c). Focus is given especially to those centred on the develop ment of female political movements that consolidated the participation of women in the Ar gentine democratic process and the creation and expansion of the Feminist Peronist Party, ensuring certain political advances for women through what was known as Social Justice. In 1988, J. Ivlev proposed some (non-normal) modal systems which are semantically characterized by four-valued non-deterministic matrices in the sense of A. Avron and I. Lev. Swap structures are multialgebras (a.k.a. hyperalgebras) of a special kind, which were introduced in 2016 by W. Carnielli and M. Coniglio in order to give a non-deterministic semantical account for several paraconsistent logics known as logics of formal inconsistency, which are not algebraizable by means of the standard techniques. Each swap structure induces naturally a (...) non-deterministic matrix. The aim of this paper is to obtain a swap structures semantics for some Ivlev-like modal systems proposed in 2015 by M. Coniglio, L. Fariñas del Cerro and N. Peron. Completeness results will be stated by means of the notion of Lindenbaum–Tarski swap structures, which constitute a natural generalization to multialgebras of the concept of Lindenbaum–Tarski algebras. This essay is about the relationship between the notions of practical reason, the will, and choice in Kant’s practical philosophy. Although Kant explicitly identifies practical reason and the will, many interpreters argue that he cannot really mean it on the grounds that unless they are distinct, irrational and, especially, immoral action is impossible. Other readers affirm his identification but distinguish the will from choice on the same basis. We argue that proper attention to Kant’s conception of practical reason as a (...) capacity reveals that these distinctions are neither textually grounded nor philosophically necessary. His moral psychology concerns a single capacity, practical reason, which is the will, and whose actualities in this or that individual fall under the title of choice. Practical reason is the will and choice because it is the rational faculty of desire: a rational being’s capacity to be, by means of her representations, the cause of the actuality of their objects. This, we argue, is entailed by his conception of rational action: action not just in accordance with, but in and through the representation of, principles. The possibility of irrational action is explained not by a distinction between capacities but by the finitude, and thereby the fallibility, of human reason. (shrink)

What is it to know someone? Epistemologists rarely take up this question, though recent developments make such inquiry possible and desirable. This paper advances an account of how such interpersonal knowledge goes beyond mere propositional and qualitative knowledge about someone, giving a central place to second-personal treatment. It examines what such knowledge requires, and what makes it distinctive within epistemology as well as socially. It assesses its theoretic value for several issues in moral psychology, epistemic injustice, and philosophy of mind. (...) This correspondence piece responds to commentaries on the authors' survey of U.S. bioethicists. The authors address two key questions: the definition of a bioethicist and how bioethics should evolve. León and Zahavi (2023) have made a compelling case for the necessity of philosophy — and not only neuroscience — for investigating consciousness. In particular, they argue that any theory of consciousness cannot avoid philosophical enquiry and thus only can choose between good or bad philosophy. Also, the topics of self-consciousness and selfhood are highlighted as problems of consciousness sui generis next to the mind–body problem. I will try to elucidate a bit more the specific approaches to consciousness that philosophy (...) and neuroscience take and thus elaborate why the philosophy and the neuroscience of consciousness are complimentary rather than mutually exclusive. An account of what sort of causal integration is necessary for an agent to exercise agency is offered in support of a soft-line response to Derk Pereboom’s four-case argument against source-compatibilism. I argue that, in cases of manipulation, the manipulative activity affects the identity of the causal process of which it is a part. Specifically, I argue that causal processes involving direct manipulation fail to count as exercises of intentional agency because they involve heteromesial causal deviance. In contrast, standard deterministic (...) causal processes do not involve heteromesial causal deviance and are agency-preserving. The upshot is that there is a relevant difference between a causal process involving direct manipulation by another agent and a deterministic causal process that involves no such intervention. If this is right, then Pereboom’s four-case argument does not pose a threat to source-compatibilist theories of free will and moral responsibility. (shrink)

Silence sometimes constitutes moral complicity. We see this when protestors take to the streets against racial injustice. Think of signs with the words: “Silence is complicity.” We see this in instances of sexual harassment, when we learn that many knew and said nothing. We see this in cases of wrongdoing within a company or organization, when it becomes clear that many were aware of the negligent or criminal activity and stayed silent. In cases like this we consider agents morally complicit (...) in virtue of their silence. Flagrant injustices cry out for action, and sometimes remaining silent amounts to complicity in those injustices. What philosophy owes us is an account of how it could be that silence constitutes complicity. In this paper I argue that one possibility is an account grounded in problematic deliberative contribution. The core idea of “deliberative complicity,” as I call it, is that agents have moral duties concerning the moral deliberation of other agents, and failures in these duties can amount to moral complicity. For example, an agent aware that a colleague is sexually harassing his students has a deliberative obligation to report the misconduct, and their silence in failing to report constitutes a failure to fulfill their deliberative obligation, a failure that grounds their moral complicity in the harassment. If my argument is successful, it provides a distinctive reason to prefer a deliberative account of moral complicity: it can capture cases of silent complicity that other views of moral complicity cannot. And further, by turning our attention toward our interpersonal deliberative obligations, a deliberative account of complicity can incorporate helpful resources from recent work in social epistemology and speech act theory as we set out to determine when and why silence amounts to complicity. Eugenic thinking involves distinguishing between sorts or kinds of people in terms of the perceived desirable or undesirable traits that those people are likely to transmit to future generations. While eugenics itself is often thought of as an ideology that generated a social movement of global influence from roughly 1900 to 1945, eugenic thinking both pre-dates this period and continues to inform a range of contemporary debates and social policies, including those concerning prenatal screening, transhumanism, population control, and disability. Various (...) sciences, including the then-nascent sciences of psychology and psychiatry, played important roles in early twentieth-century eugenics, and their legacy is reflected in contemporary eugenic thinking and policies. Understanding the history of eugenics and the role of these early sciences of cognition in that history is useful in reflecting further on ongoing forms of eugenic thinking to which the contemporary cognitive sciences are relevant. Two approaches to prehistoric numeracy are analyzed and compared. The first uses traditional archaeological methods and criteria to examine and characterize marks on prehistoric artifacts for the purpose of assessing whether they were notations. The second uses a theoretical framework in which cognition is extended—meaning that material forms are a component of the mind—in order to understand the role of counting devices in numerical cognition. Each answers a different question: The traditional approach is concerned with understanding the intent and meaning (...) of artifactual marks, while the extended approach focuses on how material forms contribute to numerical realization, explication, and elaboration. Efforts by governments, firms, and patients to deliver pioneering drugs for critical health needs face a challenge of diminishing efficiency in developing those medicines. While multi-sectoral collaborations involving firms, researchers, patients, and policymakers are widely recognized as crucial for countering this decline, existing incentives to engage in drug development predominantly target drug manufacturers and thereby do little to stimulate collaborative innovation. In this mini review, we consider the unexplored potential within pharmaceutical regulations to create novel incentives to encourage a diverse (...) set of actors from the public and private spheres to engage in the kind of collaborative knowledge exchange requisite for fostering enhanced innovation in early drug development. We suggest that the emerging field of the conservation humanities can play a valuable role in biodiversity protection in Papua New Guinea (PNG), where most land remains under collective customary clan ownership. As a first step to mobilising this scholarly field in PNG and to support capacity development for PNG humanities academics, we conducted a landscape review of PNG humanities teaching and research relating to biodiversity conservation and customary land rights. We conducted a systematic literature review, a PNG teaching programme (...) review, and a series of online workshops between the authors (10 PNG-based, 7 UK-based). We found a small but notable amount of PNG research and teaching focused on biodiversity conservation or customary land rights. This included explicit discussion of these topics in 8 of 156 PNG-authored humanities texts published 2010-2020 and related teaching content in the curricula of several different humanities-based programmes. We discuss current barriers to PNG academic development. The growth of fully fledged in-country conservation humanities will require a joint collaborative effort by PNG researchers, who are best placed to carry out such work, and researchers from abroad who can access resources to support the process. In this paper we motivate the ‘principles of trust’, chance-credence principles that are strictly stronger than the New Principle yet strictly weaker than the Principal Principle, and argue, by proving some limitative results, that the principles of trust conflict with Humean Supervenience.

Potter propuso una bioética global, en la cual el medio ambiente debía ser también protagonista. Una de las tareas fundamentales de la bioética, desde sus orígenes, es devolverle al ejercicio de la medicina el componente humano que los desarrollos biotecnológicos amenazan con erosionar. La bioética debe servir también para reconciliar al ser humano consigo (...) mismo, con los demás y con el medio ambiente del que forma parte, pues lo interviene y modifica con un saldo negativo para la naturaleza. Otro cometido principal de la bioética consiste en contribuir al reconocimiento del valor de la vida humana y fortalecer una cultura de la vida, frente a los desafíos que plantean los conflictos armados e intereses economicistas. Para alcanzar estos objetivos, es indispensable contar con un adecuado respaldo biojurídico, del que son especialmente garantes los cuerpos legislativos, quienes tienen una precisa y clara responsabilidad para legislar en conformidad con la Constitución Política de los Estados. Es crucial que las nuevas generaciones adquieran, desde tempranas edades, conceptos, hábitos y actitudes que garanticen una sabiduría de vida reflejada en la cotidianidad. Esta sabiduría debe articular bienes, virtudes y normas que garanticen la convivencia humana y la consolidación de sociedades justas, solidarias y verdaderamente libres. (shrink)

I argue that God lacks the standing to blame or punish people for their sin if theological determinism is true, and that this is so even if sinners deserve both blame and punishment for sins God determines them to commit (and thus even if theological determinism is compatible with human free will and moral responsibility). Despite their purported demographic and institutional decline, White evangelical voters were instrumental in the election of Donald Trump in 2016, and even more so in his 2020 loss. The story of Trump’s electoral successes among Christian voters in the last two elections is in large part the story of religious nationalism—and White Christian nationalism in particular—because Trump personifies the convergence of nationalism-infused forms of messianism and apocalypticism intrinsic to White evangelicalism, which culminate in QAnon cultic ideology. However, these same ethnoreligious/nationalist (...) patterns and logics extend much further back than Trump’s insurgent candidacy. This chapter traces the recurring, resurgent patterns of “zombie nationalism” among White evangelical Christians in the United States over the last half century that emerged in response to periods of significant societal change and certain recurring sociopolitical issues. In particular, alongside established elective affinities around ethnicity (whiteness) and religion (Christianity), this chapter makes the case for incorporating gender and sexual politics as key factors in the articulation and legitimation of religious nationalism in the United States. White Christian nationalism tends to reemerge as a salient political force during periods of rapid social change and diversification, driven by racialized religious grievances symptomatic of Nietzsche’s concept of ressentiment, or the paradoxical internalization and reprojection of a person’s or group’s perceived endangerment, victimhood, and/or suffering, in order to gain power. Drawing on examples of marriage equality and reproductive rights, this chapter demonstrates how an understanding of sexual politics is key to both apprehending and breaking the cyclical reanimation of White Christian nationalism. Escaping the nihilistic impulses driving these cycles will require White evangelicals to develop new hermeneutical tools capable of transforming the exclusionary patterns of racism, ethnocentrism, heteronormativity, and patriarchy that fuel the engine of ressentiment animating zombie nationalism. Abstract: In this study, we explore the challenge of identifying and preventing diseases in apple trees, which is a popular activity but can be difficult due to the susceptibility of these trees to various diseases. To address this challenge, we propose the use of Convolutional Neural Networks, which have proven effective in automatically detecting plant diseases. To validate our approach, we use images of apple leaves, including Apple Rot Leaves, Leaf Blotch, Healthy Leaves, and Scab Leaves collected from Kaggle which (...) is part from the Plant Village dataset. We generate a comprehensive training dataset using techniques such as image filtering, compression, and generation. Our model achieves impressive accuracy scores for all classes, with an overall accuracy of 99.93% on a dataset of 10,000 labeled images . (shrink)

The first purpose of this series of articles is to introduce case studies on how current AI models can be used in the development of a possible theory of quantum gravity, their limitations, and the role the researcher has in steering the development in the right direction, even highlighting the errors, weaknesses and strengths of the whole process. The second is to introduce the new Presentist Fragmentalist ontology as a framework and use it for developing theories of quantum gravity and (...) speculate on achieving a TOE. We emphasize it is necessary for the researcher to check everything in these articles for themselves. While there are many good ideas in this series of papers, the AI is known to make even arithmetic and algebraic mistakes. To select just five apparently good ideas, there is a causal interaction tensor Cαβγδ(F1, F2) that encodes the causal relationship and the strength of the (possibly non-local) interaction between two fragments of reality (formed by each quantum system). There is a quantitative prediction for a testable table-top experiment. There is an explanation of how spacetime emerges from the fragments and their interactions. There is an explicit account of the double-slit experiment. And there is an explanation how this theory accommodates dark matter and dark energy simultaneously. We explore ideas, equations they lead to, concrete calculations, and give corrections along the way. While these are generally morally right within this framework they must be checked by the researcher. Given this caveat, we believe we have made significant progress with the PF interpretation in developing a theory of quantum gravity and pointing out a possible path to a TOE. (shrink)

Objective We reviewed human–robot interaction (HRI) participatory design (PD) research with older adults. The goal was to identify methods used, determine their value for design of robots with older adults, and provide guidance for best practices. Background Assistive robots may promote aging-in-place and quality of life for older adults. However, the robots must be designed to meet older adults’ specific needs and preferences. PD and other user-centered methods may be used to engage older adults in the robot development process to (...) accommodate their needs and preferences and to assure usability of emergent assistive robots. Method This targeted review of HRI PD studies with older adults draws on a detailed review of 26 articles. Our assessment focused on the HRI methods and their utility for use with older adults who have a range of needs and capabilities. Results Our review highlighted the importance of using mixed methods and including multiple stakeholders throughout the design process. These approaches can encourage mutual learning (to improve design by developers and to increase acceptance by users). We identified key phases used in HRI PD workshops (e.g., initial interview phase, series of focus groups phase, and presentation phase). These approaches can provide inspiration for future efforts. Conclusion HRI PD strategies can support designers in developing assistive robots that meet older adults’ needs, capabilities, and preferences to promote acceptance. More HRI research is needed to understand potential implications for aging-in-place. PD methods provide a promising approach. (shrink)

Multiple states are at risk of becoming uninhabitable due to climate change, forcing their populations to flee. While the 1951 Refugee Convention provides the gold standard of international protection, it is only applied to a limited subset of people fleeing their countries, those who suffer persecution, which most people fleeing climate change cannot establish. While many journalists and non-lawyers freely use the term “climate refugees,” governments, and courts, as well as UNHCR and many refugee experts, have excluded most climate refugees (...) from the Convention as a matter of legal interpretation. In our 2015 paper, “Unable to Return in the 1951 Refugee Convention: Stateless Refugees and Climate Change”, we sought to reopen the debate on “climate refugees” by arguing that some climate refugees qualify under the 1951 Convention as it is currently written (even if they are not persecuted): those who are stateless and are unable to return to their country of origin because climate change has rendered it uninhabitable. Our interpretation, however, has been rejected by Goodwin-Gill and McAdam (2021) and by Foster and Lambert (2019), which explicitly responds to our paper. Here, we address and respond to their arguments, and develop a new supplementary one, drawing on the principle of systemic integration, as enshrined in Article 31(3)(c) of the Vienna Convention on the Law of Treaties. The spread of misinformation and fake news raises important problems for our society and for our democracy. From the January 6 attack on the U.S. Capitol to vaccine hesitancy, from suppressing voter turnout to peddling conspiracy theories, we know that these problems are real and need to be taken seriously. While misinformation is not a new problem for democracy, it can spread more quickly and easily because of new media’s design and popularity. Given these problems, it is encouraging that some (...) technology companies are taking steps to reduce the spread of misinformation and fake news on the platforms they manage. Despite this seemingly positive development, some scholars have criticized some interventions designed to combat the spread of misinformation and fake news as paternalistic. For example, a 2019 Facebook intervention called Click-Gap aimed to reduce the amount of low-quality content (including fake news and misinformation) that users see on their NewsFeed. Click-Gap has been criticized as an instance of epistemic paternalism because it was adopted (1) with the goal of improving the epistemic status of its users and (2) irrespective of what the company believed the wishes of its users to be. If interventions like Click-Gap are problematic because paternalistic, those of us interested in the ethics of technology would face a dilemma—either endorse technology companies treating their users paternalistically or endorse their failing to act to combat the spread of misinformation and fake news on their platforms. Both options seem to me to be problematic. While paternalism may sometimes be permissible, I think we should be very hesitant to endorse a paternalistic relationship between technology companies and their users. The relationship does not seem to bear the right sort of structure to one in which paternalism might be appropriate, if it ever is. The second option seems, if anything worse: surely technology companies should not stand by and change nothing about their platforms despite the spread of misinformation and fake news in those spaces. In this paper, I argue that Click-Gap and interventions like it are not paternalistic, contrary to the conclusion of other scholars. Further, I will argue that the focus on paternalism itself is actually a red herring here. While not just any intervention or strategy that purports to reduce fake news and misinformation is permissible, we should want technology companies to take user well-being seriously and be able to take that well-being as a direct reason for action. Their doing so is not paternalistic nor even morally problematic, and it should not be criticized as such. (shrink)

This article studies the political dimension of friendship in Robert Guédiguian’s cinema, delving into the crucial role that conversation plays in this relationship, and taking Stanley Cavell’s thought as a main reference. Aristotle’s concept of civic friendship, along with its contemporary readings, and Cavell’s notion of conversation provide a theoretical frame for the analysis of three recent feature films directed by Guédiguian that present a strong thematic and narrative unity (and have barely received attention in previous scholarship): Les Neiges du (...) Kilimandjaro/The Snows of Kilimanjaro (2011), La Villa/The House by the Sea (2017) and Gloria Mundi (2019). Based on, but going beyond, Cavell’s moral theorisation of the filmic portrayal of human relationships, the analysis of these films has identified four milestones in the transformative process—both personal and political—that stems from conversation with friends: conformity, confrontation, acknowledgement and renewed community. In all three films, this process of change is not only presented as a progressive discovery of one’s own voice, but also as a progressive unmasking: both are necessary prerequisites for welcoming foreigners in need of acknowledgement and, consequently, for the renewal of community. Justo antes de la pandemia por COVID-19, la Organización Mundial de la Salud definió unas prioridades de trabajo para la década 2020-2030. Un grupo interdisciplinario de profesionales de la salud reflexiona sobre estas prioridades, determinando unas categorías de análisis y, desde una perspectiva bioética, analiza cada una de ellas, ve su pertinencia, algunos eventos causales, las implicaciones que pueden tener si no son enfrentadas adecuadamente y hace sugerencias sobre la forma de llevarlas a cabo. En esta primera entrega se analiza (...) el primer grupo de prioridades estratégicas: “poblaciones más sanas”. En las conclusiones se destaca la conveniencia de acometer cada una de ellas de una manera colaborativa, gubernamental y privada; de reestructurar el sector salud con base en estas prioridades, aprovechando la experiencia obtenida en la lucha contra el COVID-19. Scholars interested in the characterology presupposed by constitutional government have occasionally turned to Plato’s Laws, one of the earliest and most penetrating treatments of the subject. Even so, interpreters have neglected a vital tension that the Laws presents as coeval with lawfulness itself. Through a close reading of the dialogue’s opening passages, I argue that the rule of law for Plato is implicated in a certain paradox: it both prohibits and requires the imitation of god. Law cannot safely originate with (...) human beings; yet human beings must involve themselves nonetheless in laying law down. Trustworthy lawgivers must revere the gods while at the same time emulating them, must somehow make law themselves while regarding that very task as beyond their ken. Although the political psychology of lawfulness would therefore seem incoherent, I conclude by surveying reasons for thinking this inference unwarranted. (shrink)

Advances in genetic screening, liquid biopsies, and biomarkers are also examined, showcasing their potential in identifying high-risk individuals and enabling personalized treatment plans. This article analyzes how populism is conceptualized and studied in International Relations (IR) and argues that it should be seen as a political logic instead of a political ideology. It does so by demonstrating that ‘populist foreign policy’ looks radically different when analyzing the populist left, refuting the possibility of any distinctly ‘populist’ foreign policy positions. We argue that large parts of IR scholarship practice a form of concept-stretching that undermines the quality of analysis as well as the ability to (...) make meaningful policy recommendations. Using the empirical case studies of Bernie Sanders in the United States and Podemos in Spain, the article demonstrates that populism does not translate into any shared ideological positions but is a way of formulating and performing – in these cases – leftist politics through which political actors can interpellate and mobilize different societal groups and demands behind their political projects. In particular, the analysis debunks common assumptions about populism’s alleged effects on foreign policy and dangers to pluralist democracy and shows that “populism” neither necessarily opposes multilateralism, migration and global public good provision nor formulates an authoritarian claim to power. This study aimed to assess the effectiveness of remedial instruction in improving the numeracy skills of Grade 7 students at Malbug National High School during the school year 2023-2024. Adopting a quasi-experimental research design, the research focused on Grade 7 students at Malbug National High School, Cawayan East District, Masbate Province Division, Philippines, identified as non-numerates, employing pre-tests and post-tests as essential research tools. The independent variable was the remedial instruction in numeracy, while the dependent variable was students' numeracy performance (...) measured through pre-tests and post-tests. Before the intervention, the pre-test numeracy performance exhibited a varied distribution of students across different score ranges. A majority fell into the "Needs Major Support" category, emphasizing the necessity for targeted interventions. The post-test results, however, revealed a remarkable improvement, with 87.88% of initially non-numerate students achieving scores in the "Transforming" range. A thorough statistical examination validated a notable disparity in the scores obtained before and after the instructional intervention, substantiating the favorable influence of remedial instruction. The calculated t-value of 19.594, exceeding the critical t-value, led to rejecting the null hypothesis. In conclusion, the study emphasizes the need for tailored interventions based on the initial deficiency in numeracy skills. The post-test results underscored the success of remedial instruction in fostering substantial growth. The study recommends sustaining the remedial program, implementing periodic assessments, providing teacher training, involving parents in students' development, allocating adequate resources, and further research in other schools to strengthen findings. The relationship between law and coercion has always been a highly controversial topic in contemporary legal philosophy. After an initial phase in which there was a strong consensus on its essential importance for law, an apparent consensus on the exact opposite has emerged in the last decades. In recent years, however, several important publications have reignited the debate. They criticise the latter position and argue strongly in favour of considering coercion as a necessary or relevant property of law, as well (...) as propose new ways to approach the debate and conceive the relevant question. -/- The aim of this chapter is to contribute to the revitalised debate by arguing for the importance of coercion both for the existence of law and for the function(s) of law. I will argue that if law is seen as a tool or artefact, the fulfilment of its function(s) depends both on its existence and on its possession of a certain property that enables the achievement of that end. I will then show how coercion can be understood as necessary for the existence of law by analysing two main arguments for coercion-dependent existence: that coercion is motivationally necessary to ensure conformity to law, and that it is necessary to ensure the existence of a community. Finally, even if this argument fails, I will show that coercion can nevertheless be understood as the particular property that law has to fulfil its function(s). I will argue that this is the case for most of the possible functions of law, especially those related to behaviour-guidance and coordination-solving. -/- I will proceed as follows. In section 2, I will address some useful definitions of coercion and law and offer some insights into the view of law as an artefact and the functions ascribed to it. In section 3, I will set out some general theoretical positions on the relationship between coercion and law that will help to frame the content of the arguments that follow in the next section. In section 4, I will analyse the role and significance of coercion for the existence of legal systems (4.1) and for the function of legal systems (4.2). En la actualidad hay un renacer del interés académico por la amistad que se aborda desde múltiples disciplinas, tales como la Sociología (Spencer & Pahl, 2006), la Psicología (Hojjat & Moyer, 2017), la educación (Kristjánsson, 2022), la Política (Digeser, 2016) o las Relaciones Internacionales (Koschut & Oelsner, 2014). En filosofía, la amistad es un tema clásico que se ha abordado con interés variable en distintos momentos de la historia: para griegos y romanos fue relevante a nivel personal y político (Aristóteles, (...) 1994); los pre-modernos la concibieron como un vínculo fundamental para la estabilidad política y la administración de la justicia (Smith & Devere, 2010) y en la Ilustración siguió considerándose un vínculo valioso. A partir del siglo XIX se oscurece su papel social (Laín Entralgo, 1986) y solo a finales del XX se retoma su valor en el ámbito social, más allá del personal (Derrida, 1998). A pesar de esa atención renovada a la amistad, las investigaciones desde la antropología filosófica o la metafísica son hoy menos frecuentes que otras como las que se hacen desde la ética o la filosofía política, por lo que es relevante prestarle atención desde esta perspectiva que es la elegida en este capítulo. El objetivo es repensar la amistad en Leonardo Polo desde su antropología trascendental partiendo de una confluencia interesante entre este filósofo y Agamben: la apertura ontológica al plano existencial (trascendental, en terminología poliana). Argumentaré cómo, en continuidad con la antropología trascendental y prosiguiendo el pensamiento de Polo, la amistad puede incluirse de alguna forma en el ámbito trascendental, puede ser un “amor personal” que, como tal, radica en la persona, muestra a la persona y la hace crecer. De acuerdo con eso, la estructura del capítulo es la siguiente: explicaremos la confluencia metafísica entre ambos filósofos y el papel de la amistad en la apertura al ámbito existencial (epígrafe 2); seguiremos con los elementos de la antropología trascendental que permiten proseguir pensando la amistad (epígrafe 3); estudiaremos el amar personal y la posibilidad de los “amores personales” (epígrafe 4) y finalmente abordaremos la amistad como amor personal. En este libro se profundiza en las emociones desde una perspectiva bioética. La dimensión subjetiva del ser humano a partir del siglo XX volvió a vincularse tanto a la filosofía como a la psicología, aunque sin beneficiarse de una fundamentación teórica donde estuvieran presentes la teoría, la epistemología y la práctica. Algunos autores se han acercado a la afectividad humana definiéndola como un "laberinto", donde es muy difícil orientarse y con facilidad extraviarse; allí priman la confusión, el enredo, el desconcierto (...) y la complicación como pautas habituales. Otros sencillamente evitan el tema por adjetivarlo como "espinoso", ya que sus aristas llevan a que su asimilación sea complicada. Sin embargo, tal vez priman los abordajes superficiales o frívolos, donde la trivialidad y la futilidad ahogan la legítima y necesaria comprensión que de esta dimensión debería tener cualquier ser humano, con una mínima y básica vocación de relacionabilidad. Una aproximación bioética, desde una perspectiva antropológica adecuada, aquella que sigue a una filosofía realista, lleva a distinguir distintos niveles en la dimensión afectiva: desde los sentimientos hasta las pasiones, pasando por las emociones o pasiones sensibles. Es decir, hay una presencia de esa dimensión desde el acto de ser personal (intimidad del ser humano), pasando por sus facultades superiores (inteligencia, voluntad y corazón), hasta las manifestaciones sensibles, que comprometen tanto el cuerpo como la psiquis de la persona humana. La vida afectiva en el ser humano es una parte importante de la persona que puede considerarse como intermedia entre la dimensión sensible e intelectual y la intimidad personal; allí concurren y se mezclan elementos sensitivos y cognitivos, pero se trata de una dimensión distinta tanto de la sensibilidad como de la razón, de los actos humanos y de los hábitos cognoscitivos. La irrupción de la inteligencia artificial, la consecución de los objetivos de inclusión, igualdad o de sostenibilidad económica, plantean en las sociedades occidentales diferentes alternativas de actuación educativa. Este nuevo entorno que habitamos ha provocado también una evolución en los desafíos éticos que se presentan en el mundo de la educación caracterizados por la complejidad de su resolución y por la pluralidad de escenarios y protagonistas involucrados en los mismos. Cuestiones referentes a ¿cómo posicionar al profesor ante la posibilidad del (...) aprendizaje y evaluación automatizada?, ¿cómo implementar el principio de no discriminación educativa en un aula en la que conviven alumnos con diferentes capacidades, habilidades e intereses?, ¿cómo replantear nuevos hábitos de vida en pro de la sostenibilidad planetaria?, ¿cómo integrar la enseñanza de los valores constitucionales del siglo XX con el progreso moral de la sociedad del siglo XXI? constituyen la hipótesis de partida. Se afirma por tanto, que la educación debe abrirse a otras cuestiones, relativamente novedosas y de origen tecnológico, político o económico, que trascienden ese horizonte e impactan directamente en ella, concretamente desde el punto de vista de la ética educativa. Se establece una análisis de los desafíos actuales y su prospectiva en el campo de la ética de la educación y se establecen tres nuevas categorías en el campo de estudio: triaje, digitalización y nuevos actores. In the United States “restorative justice” typically refers to small-scale measures that divert alleged wrongdoers from a standard path through the criminal justice system by funneling them into alternative justice programs. These aim not to punish the offender, but to constructively address the harm that wrongdoing may have caused to individuals or to the community, engaging with the wrongdoer to come to a response that might heal and repair the harm. -/- Yet restorative justice initiatives generally fail to challenge and (...) transform the racist system of mass incarceration. This book argues that these initiatives have the potential to do so, but that we need to better understand what restorative justice is, and how it should be implemented. It claims that restorative justice can achieve its desired effect only insofar as it provides a mode of association between people that is, at its core, moral and spiritual. The book explores the ways in which restorative justice ethics and practices exhibit moral and spiritual dynamics, and what difference such “lived religious” dynamics can make for purposes of transforming structural violence. -/- Looking to Chicago’s restorative justice network as a model for developing these transformational and sustainable social changes, the volume showcases real-life examples of the kinds of practices and initiatives needed to shift the entrenched dynamics that fuel the prison-industrial complex across the United States. The book argues that restorative justice has the capacity to transform systemic injustices inscribed in U.S. mass incarceration in ways that mediate the "prison reform" vs "prison abolition" dichotomy. The ideas that law is (or can be regarded as) a legal system, and that law evolves over time in adaptation to its context, are two of the most widely shared and presupposed ideas in contemporary legal theory. However, even if much interest has been dedicated in legal theory and legal dogmatics to the evolution of specific legal concepts or institutions, as well as legal norms in particular, not so much attention has been dedicated to the evolution of legal systems (...) in themselves. In this chapter, I will try to offer an overview of the evolution of the concept of legal system and critically analyse whether an evolutionary theory of legal systems - i.e., a theory about the evolution of legal systems - can be reconstructed and laid down for the analysis both of the past, the present, and the future of legal systems. This paper introduces non-referential terms into language as used in the Calculus of Qualia (CQ). It is possible to write “blackness” to refer to the experience of the subjective, internal quale of blackness. It is possible to write █ as another word for “blackness,” another referential term. But that is not its meaning in CQ. In CQ the word “blackness” is used as usual, as a symbol that refers to something other than itself. But █ is the immediate subjective experience (...) (quale) that arises in the reader’s mind. “Blackness” refers to the color or quale. But █ in no way refers, _not even to itself_, it is strictly non-referential. It’s presentation instantiates it. This is no some trivial definitional trick but is a paradigm shift. Examples, traps, and concequences for theories of truth and meaning are briefly explored. (shrink)

This commentary responds to the article “What Is the Aim of Pediatric ‘Gender‐Affirming’ Care?,” by Moti Gorin, in the same issue of the journal. Gender‐affirming care is often treated as exceptional and subject to heightened scrutiny. This exceptionalization results in its being held to stricter evidentiary standards than other forms of medical interventions are. But values and value judgments are inextricable from the practice of evidence‐based medicine. For gender‐affirming care, values shape what counts as “strong” evidence, whether the legitimacy of (...) transgender identity is assumed versus treated as something to be investigated, how to characterize the testimonial accounts of trans and gender‐nonconforming patients, and more. We argue that these kinds of questions are part of the practice of medicine, not exceptional to transgender people and gender‐affirming care. However, litigation of evidence for gender‐affirming care in state and national policy underscores the moral urgency of thinking carefully about what values ought to guide evidence. (shrink)

In this paper, I explore the question of agency in spontaneous action via a phenomenology of musical improvisation, drawing on fieldwork conducted with large con- temporary improvising ensembles. I argue that musical improvisation is a form of ‘participatory sense-making’ in which musical decisions unfold via a feedback pro- cess with the evolving musical situation itself. I describe how musicians’ technical expertise is developed alongside a responsive expertise, and how these capacities complicate the sense in which habitual action can be viewed (...) as pre-conscious or ‘automatic.’ Nevertheless, I shall argue that the self-awareness required for expert improvisation does not amount to highly reflective deliberation, arguing instead that the practice of musical improvisation involves an exercise of practical rationality, akin to what Aristotle called phronēsis. Musical decisions – as an expressive form of sense-making – are guided by feelings of ‘rightness’ that are experienced directly and intuitively, responding to the norms and reasons that are embedded in the instruments, sounds, and practices of a particular (sub)culture. O Agreste de Pernambuco é conhecido como a bacia leiteira do estado, por possuir não apenas um efetivo bovino leiteiro significativo, mas por apresentar características edafoclimáticas que tornaram possível o desenvolvimento da atividade leiteira. Entretanto, uma vez que possui um clima Semiárido, o cruzamento de raças taurinas com zebuínas é de suma importância, logo, um dos métodos de cruzamento mais abrangente e expressivo no estado é acasalar touro holandês PO com vacas Gir, obtendo F1 ½ HG, que são acasaladas com (...) touro holandês PO, obtendo-se F2 ¾ H + ¼ G, que são os animais de maior efetivo na região. Esse tipo de cruzamento foi essencial para manter o gado produtivo em situações de escassez alimentar e enfrentamento de secas, uma das características inerentes da região. Mesmo com um gado cruzado com bons índices zootécnicos, muitas propriedades não realizam um manejo de administração básica do rebanho como, por exemplo, uma escrituração zootécnica, tampouco um controle leiteiro para descarte de vacas com baixa produção, repetidoras de estro, secas, vazias etc. Essa escassez de informações do rebanho configura a região da bacia leiteira como uma região em que as vacas possuem potencial leiteiro, mas que não são totalmente aproveitadas no que tange seu potencial genético. Desta forma, buscou-se avaliar o manejo nutricional de 15 propriedades leiteiras da região fazendo um balanço do impacto da alimentação do rebanho sobre os índices de produção e reprodução das vacas no sistema de produção e como, através da alimentação, tais índices zootécnicos poderiam ser melhorados através de medidas de manejo básicas na propriedade. -/- REFERÊNCIAS BIBLIOGRÁFICAS AIRES, P. In this short informal note we consider four Gedankenexperiments that show A-theories of time are compelling and can be leveraged to give a Presentist Fragmentalist realist interpretation of quantum mechanics. Each of these four involve roles for manifest time, relativistic time, and quantum mechanical time. The point is to give simple everyday situations where a new point of view leads to the consistency of all three. This is the MO of the early Einstein.
