Algunas de las preguntas fundamentales de la filosofía del arte son: 1) ¿Qué es una obra de arte?, 2) ¿Qué es Arte?, 3) ¿Qué es el arte? Responderlas es determinar el sentido del arte. Este tipo de preguntas están planteadas bajo la fórmula ¿Qué es X?, es decir, preguntas en las cuales en lo simple esta lo complejo, preguntas en donde lo simple no quiere decir que sean sencillas; son preguntas que traen dentro de si su naturaleza y carácter metafísico-ontológico-gnoseológico, (...) y hasta axiológico. In this paper, we outline a comprehensive approach to composed analogies based on the theory of conceptual spaces. Our algorithmic model understands analogy as a search procedure and builds upon the idea that analogical similarity depends on a conceptual phenomena called ‘dimensional salience.’ We distinguish between category-based, property-based, event-based, and part-whole analogies, and propose computationally-oriented methods for explicating them in terms of conceptual spaces.

El presenta trabajo describe y caracteriza de manera breve y concisa lo que podría ser una ontología del arte. En la primera sección se presentan las dificultades actuales, así como las nociones y preguntas principales de la ontología. En la sección segunda, se bosquejan las definiciones y caracterizaciones actuales de la ontología, se hace especial hincapié, en la ontología aplicada. En la tercera, cuarta y quinta sección se caracteriza y configura lo que podría ser una ontología del arte, se evidencian (...) sus limitaciones así́ como sus perspectivas y trazabilidad para hacer viable dicha ontología; adicionalmente se abordan los aportes del realismo anglosajón a la cuestión. El propósito de esta caracterización es hacer evidente que es plausible dar un tratamiento integral al problema de la realidad y su configuración y desarrollo en los mundos regionales, como, el mundo del arte. Category-based induction is an inferential mechanism that uses knowledge of conceptual relations in order to estimate how likely is for a property to be projected from one category to another. During the last decades, psychologists have identified several features of this mechanism, and they have proposed different formal models of it. In this article; we propose a new mathematical model for category-based induction based on distances on conceptual spaces. We show how this model can predict most of the properties of (...) this kind of reasoning while providing a solid theoretical foundation for it. We also show that it subsumes some of the previous models proposed in the literature and that it generates new predictions. (shrink)

Aristotle, in his Metaphysics, not only tries to establish a relationship that is direct, coherent, inter-operational and "precise" between this science, its name as a science, and its object of study, but also begins an indignation that tries to set a science — materially adequate and formally correct — to study τὸ ὂν ᾗ ὂν. In order to complete this task, Aristotle does an in-focus strategy that consists on the diffusion of τὸ ὄν in its categories, that allows Aristotle the (...) possibility of formulate a science ἐπιστήμη to study τὸ ὂν ᾗ ὂν at the same time that supports the diffusion of τὸ ὄν in the "different categories or supreme genres" of τὸ ὄν. Due to this argumentation, Aristotle distinguishes the ἐπιστήμη σοφία of any other type of knowledge: the former is fundamentally an enquiry "about the first causes (πρῶτα αἴτια) and the principles (ἀρχὰς)". With this conception in mind, Aristotle was able to characterize several related forms of the ἐπιστήμη σοφία which, as a whole, eventually allow him to establish a science of the principles and causes "maximally universal and referred to…everything real", and in consequence, to "that that is, as long as something is". In this work, I will try to reconstruct such arguments, and offer some observations and conjectures referred to these notions that plausibly incline the scale in favor of an ontological reading of Aristotle’s Metaphysics, in order to contribute to clarify the confusion that exists between the aim of the discipline with the justification to establish the existence of its own object. [ES] En recientes décadas se ha observado un renovado interés por algunos de los temas clásicos de la ontología, desde áreas de conocimiento externas a la filosofía, sin embargo, este renacimiento ontológico ha «estimulado» una multiplicidad y diversidad de teorías y concepciones «ontológicas» que ha dado como consecuencia una proliferación de «ontologías» y de interminables batallas para determinar qué tipo de «entidades» estudian sus respectivos «dominios», que a su vez se consideran autónomos e independientes entre sí, inclusive de la propia (...) ontología. En este sentido, el propósito de este trabajo es caracterizar y representar de manera adecuada estas «ontologías», dentro del marco general del debate acerca de la naturaleza de la ontología. Es así que, en la primera sección haré un diagnostico de la ontología contemporánea; en la segunda proporcionaré algunas definiciones y caracterizaciones de las principales concepciones, en especial de las denominadas «ontologías aplicadas»; y en la tercera analizaré sí estas concepciones pueden ser consideradas diversos tipos de ontología o simplemente son diversos niveles de ontología. El marco de la discusión no se centrará en confrontar todas estas nociones, sino en describirlas y analizarlas para ofrecer un enfoque sobre el estado actual de la ontología y sus problemas. [EN] In recent decades there has been a renewed interest in some of the classic themes of ontology, from areas of knowledge external to philosophy; however, this ontological revival has «stimulated» a multiplicity and diversity of «ontological» theories and concepts that has resulted in a proliferation of «ontologies» and endless battles to determine what kind of «entities» study their respective «domains», which in turn are considered autonomous and independent, even of ontology itself. In this sense, the purpose of this work is to adequately characterize and represent these «ontologies», within the general framework of the debate about the nature of ontology. Thus, in the first section I will make a diagnosis of contemporary ontology; in the second I will provide some definitions and characterizations of the main concepts, especially the so-called «applied ontologies»; and in the third I will analyze whether these concepts can be considered different types of ontology or simply are different levels of ontology. The framework of the discussion will not center on confronting all these notions, but to describe and analyze them to provide a focus on the current state of ontology and its problems. (shrink)

Generic statements play a crucial role in concept learning, communication and education. Despite many efforts, the semantics of generics remain a controversial issue, as they do not seem to fit our standard theories of meaning. In this article, we attempt to shed light on this problem by focusing on how these sentences function in reasoning. Drawing on a distinction between property and diagnostic generics, we defend three theses: First, property generics are not about facts but express relations between concepts. Second, (...) generics play an important role in everyday reasoning by interacting with our expectations about the world. Third, diagnostic generics emphasise properties that separate the category in the generics from other categories in the same contrast class. We use the theory of conceptual spaces to advance measures of typicality and diagnosticity capable of modelling different aspects of generics and apply them to the modifier effect and the inverse conjunction fallacy. Lo anterior, de una u otra manera ha dificultado el conocimiento objetivo de su obra. Es por (...) este motivo, que en este breve trabajo, me propongo presentar en forma esquemática una apostilla sobre su vida y su obra —y no una biografía completa—, que nos permita sentar las bases histórico-filosóficas para una primera aproximación a algunas de sus preocupaciones filosóficas. Esta aproximación se completa, en la parte final del trabajo, con una breve relación bibliográfica de algunos estudios introductorios a su vida y obra. [EN] Nicolai Hartmann is one of the most significant philosophers in contemporary philosophy; however, today is little known by our philosophical world, possibly because the splendor of his philosophy coincided with the nascent linguistic turn and the heyday of existentialism, which, as is known, absorbed much of the attention and philosophical work of the time. This, in one way or another has hindered the objective knowledge of his work. It is for this reason that in this short paper, I intend to present in schematic form a commentary on his life and his work —and not a full biography—, that allows us to lay the historical and philosophical foundations for a first approach to some of its philosophical concerns. El proceso de aprehensión de lo cognoscible, en la filosofía contemporánea, ha sido tratado desde diversas perspectivas, entre ellas la fenomenológica y la analítica. Cada una de estas perspectivas aportan unos presupuestos filosóficos y procesos metodológicos que nos proporcionan marcos de trabajo para indagar en las vías de aprehensión del conocimiento; sin embargo, empleadas por separado son insuficientes y limitadas. En absoluto se trata de procurar un método universal, sino de integrar e indagar sobre diversos presupuestos, procesos, patrones y estructuras (...) para avanzar en la indagación de la aprehensión del conocimiento. En este sentido, en la primera parte, abordaremos la necesidad de tener reglas (definitorias y estratégicas) para ser parte y avanzar en cualquier «juego», en especial el del conocimiento. En la segunda y tercera, describiremos los «métodos» desarrollados por José Ferrater Mora (operaciones filosóficas) y Nicolai Hartmann (pensar sistemático), los que pueden ser un punto de partida, vías a considerar en este proceso. This article presents a reconstruction of the scientific policies established in Ecuador in the years between 1979 and 2007. The purpose is double: on the one hand, it seeks to understand the process of institutionalization of the System of Science and Technology, on the other hand analysing the achievements of three scientific policies established during this period. Hence, the reconstruction is split into three stages: from 1979 to 1994 when the first scientific policy was in place; from 1994 to 2004 (...) the second policy; and between 2005 and 2007 the third policy. To obtain the objective, some of the most relevant normative aspects during each stage are reviewed, as well as institutional statistical records related to Science and Technology. (shrink)

La noción de mundos posibles, sostiene que nuestro mundo es un mundo entre otros, un subconjunto de todas las cosas que existen. Esto implica aceptar que existen mundos estructuralmente equivalentes con sus propios lenguajes [formales], que entre sí no tienen ningún estatuto privilegiado, p.e., el mundo y lenguaje del arte o el mundo y lenguaje de la física; no obstante, la idea de aceptar otros mundos equivalentes como mundos posibles epistémica y ontológicamente legítimos para acceder y expresar lo cognoscible del (...) mundo no goza de gran aceptación. En este sentido, de entre las múltiples dimensiones de la noción de mundos posibles anotada, su dimensión lógica, es una de las más extendidas, ésta se entiende como un posible estado de cosas o un posible curso de eventos. Empero, esta concepción es la más restrictiva de la noción de mundos posibles, no sólo porque dicha noción transmuta en una especie de «técnica predictiva» que nos permite analizar y visualizar posibles escenarios de un estado de cosas o un curso de eventos, sino porque fundamentalmente, la noción de mundos posibles pierde gran parte de su potencia conceptual. Hablar de proposiciones como conjuntos de mundos posibles, no es un error, pero es limitar innecesariamente el alcance y campo de acción de la noción de mundos posibles. Si entendemos dicha noción en la versión primaría de Lewis [«Nuestro mundo actual es sólo un mundo entre otros»], sería plausible recuperar, entre otras, las dimensiones ontológica y epistémica de la noción de mundos posibles, y por ende la posibilidad objetiva de indagar en formas alternativas y legitimas de acceder y expresar lo cognoscible del mundo; en este sentido, en este trabajo me propongo: (1) retomar la noción primaria de mundos posibles de Lewis, para analizar y explicitar brevemente sus limitaciones, virtudes y requerimientos; (2) examinar las condiciones de posibilidad de un mundo; y, (3) sugerir los lineamientos epistémicos que deberían considerarse y explicitarse cuando se habla de y desde un mundo posible a la hora de expresar un enunciado. Sobre esta base, apoyado en la crítica al rol de la teoría en (...) estética de Morris Weitz, intentaré evidenciar las dificultades de lo que se ha dado en llamar la teoría institucional del arte al momento definir lo que es el arte. En la parte final del trabajo, presentaré algunas sugerencias que podrían tomarse en consideración al momento de abordar la relación entre el mundo del arte y la ontología del mundo del arte. [EN] In this paper, I will offer a succinct reconstruction of the arguments about the meaning of the notion of the world of art, as well as its implications in the ontology of art. First, I will outline the basic principles of Danto's notion of the art world, and from these principles I will outline its influence on George Dickie's institutional theory of art. On this basis, supported by Morris Weitz's critique to the role of the theory of aesthetics, I will try to highlight the difficulties of what has been called the institutional theory of art at the moment of defining what art is. These thirteen paragraphs portray epistemology as the study, not directly of knowing as a human action (which could be considered the object also of anthropology) but as the study of the mode of being of the object in the subject and, in this sense, of intentional being. Moreover, intentional being is not understood as the being of the cognitional species or representation, which is real and subjective, but as the being of the known, as the presence of the known to (...) the knower (obviously, through the species but a being not reduced to the subjective being of the species): this kind of being is the proper object of epistemology. Other considerations regarding the distinction between metaphysics and epistemology take place as well. As regards the method, this essay attempts to apply Aquinas’ four steps of scientific reasoning to epistemology, in the following fashion and order: 1- Solution of the problem of the universals by recourse to the theory of the agent intellect (resolutio secundum rem); 2- Definition of knowledge as intentional possession of being (res. sec. rationem); 3- Judgment of value regarding the different instances of human knowledge or critique of knowledge (compositio secundum rem) and 4- Reinterpretation (in the light of the previous path) of common notions of epistemology, such as truth, certainty, evidence, and error (comp. sec. rationem). Over the past few decades, cognitive science has identified several forms of reasoning that make essential use of conceptual knowledge. Despite significant theoretical and empirical progress, there is still no unified framework for understanding how concepts are used in reasoning. This paper argues that the theory of conceptual spaces is capable of filling this gap. Our strategy is to demonstrate how various inference mechanisms which clearly rely on conceptual information—including similarity, typicality, and diagnosticity-based reasoning—can be modeled using principles derived from (...) conceptual spaces. Our first topic analyzes the role of expectations in inductive reasoning and their relation to the structure of our concepts. We examine the relationship between using generic expressions in natural language and common-sense reasoning as a second topic. We propose that the strength of a generic can be described by distances between properties and prototypes in conceptual spaces. Our third topic is category-based induction. We demonstrate that the theory of conceptual spaces can serve as a comprehensive model for this type of reasoning. The final topic is analogy. We review some proposals in this area, present a taxonomy of analogical relations, and show how to model them in terms of distances in conceptual spaces. We also briefly discuss the implications of the model for reasoning with concepts in artificial systems. (shrink)

Endogenous Cushing syndrome (CS) results from hypercortisolemia caused by excess adrenocorticotropic hormone production in a pituitary adenoma or ectopic tumor, or by an adrenal tumor that directly produces excess cortisol. The diagnosis can usually be ascertained with a reasonable degree of certainty based on clinical and laboratory findings of hypercortisolism. There are patients, however, in whom the production of excess cortisol exhibits a cyclic or intermittent pattern, and, as a result, the clinical symptoms may be quite complex and varied. In (...) these patients the hypothalamic- pituitary-adrenal axis may be normal between cycles, and dexamethasone suppression testing may produce a paradoxical response. In the present article, the authors provide a definition of cyclic Cushing syndrome, review the causes and its potential pathophysiological mechanisms, and discuss the treatment options based on a review of the available literature. In the natural and social sciences, it is common to use toy models—extremely simple and highly idealized representations—to understand complex phenomena. Some of the simple surrogate models used to understand opaque machine learning (ML) models, such as rule lists and sparse decision trees, bear some resemblance to scientific toy models. They allow non-experts to understand how an opaque ML model works globally via a much simpler model that highlights the most relevant features of the input space and their effect on (...) the output. The obvious difference is that the common target of a toy and a full-scale model in the sciences is some phenomenon in the world, while the target of a surrogate model is another model. This essential difference makes toy surrogate models (TSMs) a new object of study for theories of understanding, one that is not easily accommodated under current analyses. This paper provides an account of what it means to understand an opaque ML model globally with the aid of such simple models. (shrink)

In this paper I argue that the search for explainable models and interpretable decisions in AI must be reformulated in terms of the broader project of offering a pragmatic and naturalistic account of understanding in AI. Intuitively, the purpose of providing an explanation of a model or a decision is to make it understandable to its stakeholders. But without a previous grasp of what it means to say that an agent understands a model or a decision, the explanatory strategies will (...) lack a well-defined goal. Aside from providing a clearer objective for XAI, focusing on understanding also allows us to relax the factivity condition on explanation, which is impossible to fulfill in many machine learning models, and to focus instead on the pragmatic conditions that determine the best fit between a model and the methods and devices deployed to understand it. After an examination of the different types of understanding discussed in the philosophical and psychological literature, I conclude that interpretative or approximation models not only provide the best way to achieve the objectual understanding of a machine learning model, but are also a necessary condition to achieve post hoc interpretability. This conclusion is partly based on the shortcomings of the purely functionalist approach to post hoc interpretability that seems to be predominant in most recent literature. (shrink)

: New genetic technologies continue to emerge that allow us to control the genetic endowment of future children. Increasingly the claim is made that it is morally "irresponsible" for parents to fail to use such technologies when they know their possible children are at risk for a serious genetic disorder. We believe such charges are often unwarranted. Our goal in this article is to offer a careful conceptual analysis of the language of irresponsibility in an effort to encourage more care (...) in its use. Two of our more important sub-claims are: A fair judgment of genetic irresponsibility necessarily requires a thick background description of the specific reproductive choice; and there is no necessary connection between an act's being morally wrong and its being irresponsible. Many word forms in natural language are polysemous, but only some of them allow for co-predication, that is, they allow for simultaneous predications selecting for two different meanings or senses of a nominal in a sentence. In this paper, we try to explain (i) why some groups of senses allow co-predication and others do not, and (ii) how we interpret co-predicative sentences. The paper focuses on those groups of senses that allow co-predication in an especially robust and stable way. We (...) argue, using these cases, but focusing particularly on the multiply polysemous word ‘school’, that the senses involved in co-predication form especially robust activation packages, which allow hearers and readers to access all the different senses in interpretation. This paper presents a new reconstruction of Wittgenstein’s famous (and controversial) rule-following arguments. Two are the novel features offered by our reconstruction. In the first place, we propose a shift of the central focus of the discussion, from the general semantics and the philosophy of mind to the philosophy of mathematics and the rejection of the notion of a function. The second new feature is positive: we argue that Wittgenstein offers us a new alternative notion of a rule (to replace (...) the rejected functions), a notion reminiscent of Category Theory’s notion of a morphism. Por medio de un contraste con el pensamiento heideggeriano, el estudio desarrolla la concepción gadameriana de la alteridad, el lugar que ocupa este tema en la propuesta hermenéutica de Verdad y Método y la reformulación que ello supone de la manera como Heidegger concibe la aperturidad de la existencia humana y el acontecimiento mismo del ser. Se concluye mostrando la oposición que se da entre ambos autores en la manera de considerar el modo de ser del lenguaje y el acontecimiento del ser que en éste tiene lugar. [/] -/- In permanent contrast with Heidegger’s thought, this study develops Gadamer’s conception of otherness, its place in the hermeneutic project of Truth and Method and the reformulation that all this entails of human existence disclosedness and the event of being itself. Work starts raising Gadamer’s critique to the ontological [42] recognition of the others by Heidegger; it shows then the opposition between the “being-towards-death” and “being-for-history”, and the relevance of practical life and the idea of dialogue as a model of understanding in Gadamer’s philosophy. This article discusses some of Chateaubriand’s views on the connections between the ideas of formalization and infinity, as presented in chapters 19 and 20 of Logical Forms. We basically agree with his criticisms of the standard construal of these connections, a view we named “formal proofs as ultimate provings”, but we suggest an alternative way of picturing that connection based on some ideas of the late Wittgenstein.

Testimony about the future dangerousness of a person has become a central staple of many judicial processes. In settings such as bail, sentencing, and parole decisions, in rulings about the civil confinement of the mentally ill, and in custody decisions in a context of domestic violence, the assessment of a person’s propensity towards physical or sexual violence is regarded as a deciding factor. These assessments can be based on two forms of expert testimony: actuarial or clinical. The purpose of this (...) paper is to examine the scientific and epistemological basis of both methods of prediction or risk assessment. My analysis will reveal that this kind of expert testimony is scientifically baseless. The problems I will discuss will generate a dilemma for factfinders: on the one hand, given the weak predictive abilities of the branches of science involved, they should not admit expert clinical or actuarial testimony as evidence; on the other hand, there is a very strong tradition and a vast jurisprudence that supports the continued use of this kind of expert testimony. It is a clear case of the not so uncommon conflict between science and legal tradition. (shrink)

This paper deals with the recent Swedish proposals of a Intuitionistic notion of Truth, by Dag Prawitz and Per Martin-Löf.

The present study aims at understanding how Ethica Nicomachea V.6 relates to its preceding chapters, V.1-5. On the one hand, the interpreter wonders for what purpose Aristotle introduces a topic named ‘the civic just’ (to politikon dikaion) in V.6, since V.1-5 treats extensively of matters of justice in the city. On the other hand, the same text posits that there is a certain ‘just without qualification’ (to haplōs dikaion), which may or may not be the civic just itself; compared to (...) the just without qualification, other forms of just are so by similitude (kath’homoiteta). In attempting to clear the confusion around those two points, the present study proposes the following: (1) the civic just is the just without qualification insofar as it is the primordial form of the just, in which only humans who are cumulatively free, equals and self-sufficient have a share; (2) the description of the civic just recapitulates several aspects of the discussions of justice in V.1-5 – the laws, the kinds of equality, rule, the legal suit - because the civic just encompasses all the forms of just (dikaion) related to the virtues of universal justice (V.1) and partial justice (V.2-5); (3) the expression to politikon dikaion is introduced in V.6 in order to contrast everything treated in V.1-5 with the domestic just, to oikonomikon dikaion, mentioned for the first time in V.6; (4) the forms of the domestic just are just only by similitude with the civic just because justice loses density outside the civic sphere, a situation which can be explained by the shortcomings Aristotle ascribes to women, children and slaves in EN V.6 (lack either of freedom or equality or yet self-sufficiency) as well as in Politica I (varying degrees of defective deliberation and virtue). Proponents of the duty to vote (DTV) argue that in normal circumstances, citizens have the moral duty to vote in political elections. Discussions about DTV analyze _what_ the duty is, _who_ has this duty, _when_ they have it, and _why_ they have it. Missing are answers to the Specification Question: to _which_ elections does DTV apply? A dilemma arises for some supporters of DTV—in this paper, I focus on Julia Maskivker’s work—because either answer is problematic. First, I argue that it (...) is implausible that DTV applies to _all_ elections because this makes the duty too costly for the voter. Second, I argue that there are no good reasons why under normal circumstances DTV applies only to _some_ elections. I consider objections but conclude that the dilemma is successful and therefore the case for DTV is incomplete. (shrink)

There is a growing awareness that there are many subtle forms of exclusion and partiality that affect the correct workings of a judicial system. The concept of epistemic injustice, introduced by the philosopher Miranda Fricker, is a useful conceptual tool to understand forms of judicial partiality that often go undetected. In this paper, we present Fricker’s original theory and some of the applications of the concept of epistemic injustice in legal processes. In particular, we want to show that the seed (...) planted by Fricker has flourished into a rich field of study in which the concept is used to analyze many different phenomena in law, not always following the original characterization provided by her. This has led to a distinction between what we will call the narrow version of the concept, which is closer to Fricker’s original account, and the wider version of epistemic injustice, which is a more controversial notion because it is always on the verge of morphing into other well-known concepts like sexism, racial discrimination, oppression, silencing, and gaslighting. We will show that the value of the narrow version is mostly theoretical, and that in order to use the concept of epistemic injustice one must adopt a more liberal understanding of it. (shrink)

The objective of this article is to try to elucidate Wittgenstein’s ex-travagant thesis that each and every mathematical advancement involves some “semantical mutation”, i.e., some alteration of the very meanings of the terms involved. To do that we will argue in favor of the idea of a “modal incompati-bility” between the concepts involved, as they were prior to the advancement, and what they become after the new result was obtained. In this paper I defend the idea that there is a sense in which it is meaningful and useful to talk about objective understanding, and that to characterize that notion it is necessary to formulate an account of explanation that makes reference to the beliefs and epistemic goals of the participants in a cognitive enterprise. Using the framework for belief revision developed by Isaac Levi, I analyze the conditions that information must fulfill to be both potentially explanatory and epistemically valuable (...) to an inquiring agent and to a scientific community. To be potentially explanatory, the information must state the relations of probabilistic relevance that the explanans bares to the explanandum. But a potential explanation con only be a bona fide explanation if it becomes part of inquiry, that is, if an agent or a group of agents can see any value in it for their cognitive purposes. I provide a way to evaluate the epistemic value of a potential explanation as a function of its credibility and its informational content. (shrink)

In this book chapter, we study the preventive rule, raised in Ley 1333 de 2009, and the way that environmental law has been building its own rules; escaping from the administrative law and creating their own dogmatic, necessary to achieve its independence as a legal autonomous area. We also see that is possible to see how the preventive rule was designed out of the general theory of administrative act, because it has characteristics that make it unique in the Colombian legal (...) system. -/- En este capítulo se estudia la figura de la 'facultad a prevención' contenida en la Ley 1333 de 2009, para analizar la forma en la que el derecho ambiental ha venido construyendo una dogmática y reglas propias, escapando de la tradición del derecho administrativo, así como creando la dogmática propia necesaria para lograr su independencia y consolidación como un área autónoma de la disciplina jurídica. Al respecto, en este ejercicio de reflexión es posible ver cómo la figura aparte de estar diseñada por fuera de la teoría general del acto administrativo, también posee particularidades que la hacen única dentro del ordenamiento jurídico colombiano. El presente estudio ofrece una interpretación de naturaleza ontológica a uno de los fenómenos más divulgados recientemente por los medios informativos de comunicación: la displicencia de los sujetos al seguimiento de normas sociales. El trabajo se centra, especialmente, en los casos en los que se asume que la indiferencia a las normas tiene como causa la condición del privilegiado social. Argumenta que la inobservancia a las normas, más que ser un asunto de desigualdad social, es la sintomatología de importantes hendiduras (...) en la ontología de la realidad social. Así, tres partes conforman este trabajo. En la primera se describen algunos casos que, desde los medios de comunicación, se presentan como representativos en la inobservancia a las normas sociales, especialmente, aquellos que son interpretados como un asunto de abuso de privilegio social. En la segunda parte, a partir de algunos trabajos de John Austin, Ulises Moulines y Gottlob Frege, se presenta una concepción de normas sociales, y su valor para la construcción de la ontología social. En la tercera parte, desde la propuesta del filósofo John Searle, se describen algunos rasgos esenciales de la ontología de la realidad social. Se concluye que el no seguimiento de las normas sociales socava los modos de existencia de la realidad social, y que los casos interpretados por los medios de comunicación como asunto de desigualdad social, requieren una interpretación que tenga en cuenta la estructura de la realidad social. Philosophy can be regarded as a type of conceptual research subjected to the usual standards of rationality. However, there seems to be no objective and accepted criteria for evaluating and comparing philosophical theories. From a heuristic- and erotetic-based approach, philosophy is here considered a set of second-order reflections that are presupposed by more specific theories; and evaluated by their informativeness, adequateness, cogency, generality, novelty, and presuppositional nature. As a practice, one can proceed upwards (from problems to presuppositions) or downwards (from (...) presuppositions as meaning conditions for assertions under question). But as a product, a philosophical theory is to be assessed as how it helps foster knowledge and assists in learning, posing, and solving new queries. (shrink)

Los sesgos cognitivos afectan negativamente la toma de decisiones en todas las esferas de la vida, incluyendo las decisiones de los jueces. La imposibilidad de eliminarlos por completo de la práctica del derecho, o incluso de controlar sus efectos, contrasta con el anhelo de que las decisiones judiciales sean el resultado exclusivo de un razonamiento lógico-jurídico correcto. Frente el efecto sistemático, recalcitrante y porfiado de los sesgos cognitivos, una posible estrategia para disminuir su efecto es enfocarse, no en modificar el (...) comportamiento de los agentes judiciales, sino en moldear su entorno para que los sesgos tengan menos oportunidades de aparecer. En particular, es más provechoso concentrar los esfuerzos en identificar aquellas reglas procesales que faciliten o limiten el efecto de los sesgos. En este ensayo propongo un diálogo fructífero entre el derecho y la psicología que puede llevar a mejorar la calidad de los sistemas judiciales. La propuesta está basada en la creación de guías de práctica judicial que puedan servir de base para la creación de protocolos procesales que limiten en la medida de lo razonable sus efectos negativos y conduzcan a mejores decisiones judiciales.
