Se lleva a cabo un planteamiento del estatus de la naturaleza en el ordenamiento jurídico como sujeto y objeto de derechos. Para lograr este objetivo, los autores se valen de una metodología inductiva a partir de un análisis descriptivo desde la doctrina, jurisprudencia y normas primarias. Con ello, se busca, en primer lugar, responder a la cuestión de si es posible o no que un ordenamiento jurídico contemple derechos de la naturaleza; en segundo lugar, se pretende evidenciar cómo el reconocimiento (...) de derechos sobre la naturaleza por parte de la jurisprudencia en Colombia cuenta con presupuestos comunes pese a que aún no se contemplan reglas claras sobre la asignación de derechos a la naturaleza. Al final, se realiza un llamado de atención para comprender esta figura más como un instrumento que el Estado debe utilizar a favor de la naturaleza, que como un decálogo de derechos. (shrink)

METRITE -/- O transtorno caracterizado pela inflamação do útero, devido a causas sépticas ou assépticas que atuam sobre ele, denomina-se genericamente como metrite. As metrites são afecções de grande importância, tanto pela frequência como pela gravidade. As metrites podem ser divididas segundo seu caráter anatômico, como mucosa (catarral), purulenta, hemorrágica, crupal, (...) pútrida e flegmonosa e segundo seu curso, em agudas e crônicas (FRAZER, 2005; GORDON, 1996). Estão associadas às doenças do puerpério. Quando a inflamação é limitada à mucosa é chamada de endometrite; e se ademais interessa a camada muscular denomina-se metrite ou miometrite; se afeta o revestimento peritoneal, perimetrite ou metroperitonite; e se a inflamação se estende ao paramétrio, ou seja, ao tecido conjuntivo pélvico e ligamentos, chama-se parametrite (FÖLDI, et al. 2006). A metrite ocorre em consequência de diversos acidentes que resultam de partos distócicos, após retenção fetal ou secundinas seguidas de putrefação, por arrancamento brutal dos cotilédones; por injeções uterinas irritantes; após o prolapso uterino; tudo o que favorece o desenvolvimento microbiano. Em fêmeas que se inseminam artificialmente sob condições sépticas ou de pobre destreza se produz endometrite seguida com infecundidade passageira, isto se produz como consequência das erosões produzidas pela pistola de inseminação, desassossego geral no procedimento ou por levar o sêmen a maior temperatura que a devida e em lugar inadequado. Algumas situações de origem nutricional se associam em maior ou menor grau com a incidência de metrite, em especial processos de retenção de placenta ou involução uterina de origem nutricional podem levar, de forma indireta, a incidência de metrite. 3.1 Relação energia e proteína Uma das situações de origem nutricional associada à metrite é o excesso de proteína crua na dieta. As vacas necessitam de um adequado fornecimento de proteína. No afã de suprir as necessidades nutricionais e evitar as limitações de aminoácidos, cai-se no erro de fornecer excessos de proteína, trazendo como consequência uma diminuição da eficiência reprodutiva, devido à relação dos altos níveis de proteína na dieta com a falha reprodutiva específica. Um excesso de proteína resulta num aumento da produção de amoníaco e, como consequência, numa maior síntese de ureia pelo fígado (BACH, 2000). Consequentemente, existe um aumento do nível de ureia no sangue, no útero e no muco vaginal. A nível uterino, a ureia parece ter um efeito sobre a função hormonal e depressora da proteção imunitária. O mecanismo específico baseia-se na toxicidade direta da ureia, na perda do balanço energético e na concentração de diaminas de ácido carbônico que favorecem a ampla difusão da ureia em todo o endométrio. O fornecimento de fontes alternativas de nitrogênio na alimentação dos animais vêm ganhando espaço no debate entre os especialista e a ureia é uma dessas fontes. Ela é conhecida como uma fonte de nitrogênio não-proteico (NNP), porém não se destaca tanto pelos inúmeros fatores negativos como a baixa aceitabilidade dos animais ou aos índices de intoxicação pela mesma. O rúmen necessita de um teor de 1% de nitrogênio para manter os mecanismos fisiológicos e a população microbiana, sendo assim, o produtor deve estar atento ao fornecimento desse mineral para seus animais. Especialistas apontam a fórmula de 30 g de ureia por dia para animais de 100 kg, e que essa quantidade nunca pode exceder os 200 g por animal por dia. Esses dados só podem ser postos em prática se as forrageiras existentes na propriedade não conseguirem suprir a exigência de 1% de nitrogênio no animal. Uma fonte vegetal de ótima qualidade e abundante em meios nutricionais e fonte extra de renda é a cana-de-açúcar. Ao nível hormonal a presença de ureia impede a manutenção do gradiente de pH (induzido pela progesterona) que existe entre as células apicais e basais da parede uterina (MARÍN & CÁRDENAS, 1999). Assim, a progesterona não consegue manter o gradiente de pH e aumenta a secreção de PGF2α, que afeta negativamente tanto a sobrevivência como o desenvolvimento embrionário. A nível imunológico, ocorre um efeito negativo devido à elevada concentração de amônio e ureia no sangue, o que diminui a atividade dos linfócitos e impede a defesa celular contra os agentes nocivos provocadores da metrite infecciosa, favorecendo o desenvolvimento microbiano. Para determinar a quantidade e a qualidade da nutrição proteica do animal são utilizados indicadores como a concentração de ureia no sangue e no leite. As proteínas, em geral, possuem inúmeras funções, dentre elas componentes estruturais, funções enzimáticas, funções hormonais, recepção de estímulos hormonais e armazenamento de informações genéticas. Na nutrição animal, as proteínas são divididas entre bruta (PB) e metabolizável (PM), ainda outras, mas o enfoque são essas. Os animais necessitam de níveis distintos de proteínas em suas respectivas fases de vida. Para elucidar melhor, tomemos como exemplo uma vaca nelore de 420 kg no final da gestação necessita, em média, de 389 g/dia de proteína metabolizável e, em média de 581 g/dia de proteína bruta. Os alimentos de origem vegetal (forrageiras) fornecem muito bem e eficazmente teores aceitáveis de proteínas, porém como o elemento mais presente é a fibra, faz-se necessário a suplementação nos animais, e um meio de suprir as necessidades dos mesmo, é optando por farelos de soja que possuem mais de 60% de proteína em sua composição, ou outras fontes alternativas como as farinhas de origem animal como a de sangue, por exemplo. A deficiência de fibra crua desencadeia principalmente uma deficiência de energia no ruminante; pois a partir da fibra formam-se os ácidos graxos voláteis (AGV) que constituem até 60% das fontes energéticas para estes animais. Devido à síntese reduzida de AGV, é muito baixa a concentração destes, são absorvidos pela corrente sanguínea e o animal entra em estado de déficit de precursores glicogênios. Como o consumo de alimento no pós-parto está reduzido, e não há a suficiente disposição de energia (deficiência de AGV principalmente ácido acético, devido a deficiência em fibra crua), o organismo realiza uma mobilização de ácidos graxos para a compensação energética. Os ácidos graxos são levados até acetil-CoA, este é convertido pelo fígado em corpos cetônicos que são utilizados em baixa concentração por alguns tecidos periféricos (cérebro) como fonte de energia, pois os excessos de corpos cetônicos produzem toxicidade. Os excessos de acetil-CoA no fígado podem sofrer condensação e converterem-se em β-hidroxi-β-metil-glutaril-CoA que serve como fonte de mevalonato (precursor do colesterol formado em excesso). Os excessos provocam fígado graxo que gera danos hepáticos, isso deprime a síntese de ácidos graxos para a formação do colesterol que se encontra diretamente implicado na síntese de estrogênios. Após o parto uma deficiência de estrogênio provoca de forma subsequente atonia uterina, retenção de placenta, endometrite puerperal e finalmente metrite. 3.2 Vitaminas Outra causa nutricional que incide na manifestação de metrite, é a vitamina A, que faz parte do grupo de vitaminas lipossolúveis e tem relevância especial na função reprodutiva. Esta exerce sua ação sobre a integridade estrutural e funcional das células epiteliais do organismo animal, atua sobre o crescimento, a reprodução e o desenvolvimento embrionário; mas seu papel principal é atuar como protetora dos epitélios, incluindo o endométrio. Além disso, tem um efeito estabilizador sobre várias membranas celulares e atua regulando a permeabilidade da membrana. A vitamina A, atua como estimuladora dos epitélios da mucosa tubária, uterina e vaginal, aumentando sua resistência contra os agentes infecciosos que produzem problemas que finalizam em metrite, também é necessária para as alterações histológicas que ocorrem na mucosa durante as diferentes fases do ciclo estral. Uma deficiência de vitamina A, pode causar morte embrionária, aborto, bezerros fracos ao nascimento e de forma subsequente uma retenção de placenta, (BACH, 2000) devido a não regulação da filtração de líquidos e gases através das membranas fetais; também dificulta a fecundação, devido à geração de uma atresia ovariana e à degeneração do epitélio germinal. Além disso, são produzidos edemas que ocasionam bezerros mortos ou prematuros (natimortos), o que provoca uma posterior retenção de placenta. Estas retenções provocam metaplasia queratinizam-te, dos epitélios da mucosa uterina-vaginal, o que provoca o aparecimento de metrite. Também, uma deficiência de outras vitaminas provocam o aparecimento de pequenas hemorragias, inchaço vulvar e degeneração epitelial das mucosas, em geral, isto provoca uma endometrite que posteriormente torna-se em metrite devido ao que se afeta a submucosa e a camada muscular do útero. Em relação ao pós-parto precoce, a capacidade de consumo de alimentos (forragem) é limitada, o que conduz, principalmente, a uma deficiência de fibras cruas na ruminação do animal, que conduzirá, em algumas circunstâncias, à predisposição para o desenvolvimento de metrite. Atentos a essas intempéries, o produtor deve estar atento aos requerimento exigidos pelos animais de vitaminas para que possam manter seu funcionamento normal e longe de quaisquer problema ou agente infeccioso ou patógeno. Para que se consiga suprir todas essas quantidades requeridas dos animais, em especial, das vacas gestantes para que não venha a ocorrer a incidência de metrite ou outro transtorno reprodutivo, o criador poderá optar pela injeção direta de complexos vitamínicos e minerais mediante os inúmeros fármacos da indústria farmacêutica animal, ou poderá suprir essas necessidades fisiológicas mediante o fornecimento de rações com teores adequados de vitaminas, ou ainda por intermédio de alimentos volumosos que além das vitaminas necessárias fornecem também as fibras. As forrageiras, leguminosas e gramíneas fornecem minerais, fibras e vitaminas; dentre elas as espécies tifton (capim) apresenta cerca de 34,8% de vitamina A, o capim-tanzânia apresenta 24% e a alfafa 23,4%. The following paper focuses on analyzing the different occurrences of a significant and symbolic image. In this case the image taken into consideration is the photograph in which the statue of Saddam Hussein in Firdos Square, Baghdad, is being taken down. This picture was taken in 2003, during the Iraqi war, and it shows Americans and Iraqis working together to take this symbol of Saddam’s dictatorship down. For years this image has been considered representative of the end of the war (...) and the victory of the U.S.A. over the terroristic threat. In fact, after the image started circulating, newspapers and TV news nearly stopped covering the topic because it seemed to be less urgent. We now know that hardship and violence were far from over and in the last ten years several online articles started talking about what happened after what we thought was the end. This paper’s aim is to put together as many articles as possible to see how this image has been portrayed in more recent years, in different western countries, in different cultural and social contexts. Pragmatist philosopher John Dewey famously stated that man is a creature of habit, and not of reason or instinct. In this paper, I will assess Dewey’s explication of the habituated self and the potential it holds for radical transformative processes. In particular, I will examine the process of coming to feminist consciousness, and will show that a feminist-pragmatist reading of change can accommodate a view of the self as responsible agent. Following the elucidation of the changing self, I will appraise (...) key pragmatist concepts of inquiry, such as doubt and self-reflexivity, with regard to their treatment of deep-seated internalisations of oppressive norms and the initiation of change. Ultimately, I will argue that a feminist-pragmatist understanding of transformation is conducive not only to the project of personal transformation, but also to social and political change more generally. These thirteen paragraphs portray epistemology as the study, not directly of knowing as a human action (which could be considered the object also of anthropology) but as the study of the mode of being of the object in the subject and, in this sense, of intentional being. Moreover, intentional being is not understood as the being of the cognitional species or representation, which is real and subjective, but as the being of the known, as the presence of the known to (...) the knower (obviously, through the species but a being not reduced to the subjective being of the species): this kind of being is the proper object of epistemology. Other considerations regarding the distinction between metaphysics and epistemology take place as well. As regards the method, this essay attempts to apply Aquinas’ four steps of scientific reasoning to epistemology, in the following fashion and order: 1- Solution of the problem of the universals by recourse to the theory of the agent intellect (resolutio secundum rem); 2- Definition of knowledge as intentional possession of being (res. sec. rationem); 3- Judgment of value regarding the different instances of human knowledge or critique of knowledge (compositio secundum rem) and 4- Reinterpretation (in the light of the previous path) of common notions of epistemology, such as truth, certainty, evidence, and error (comp. sec. rationem). Heidegger ringt in der Abhandlung und dem Vortrag Der Begriff der Zeit 1924 mit einer Unterscheidung zwischen der uneigentlichen und der eigentlichen Seinsweise, auf die die Seinscharaktere hin ausgelegt werden und auf die sich die Ausarbeitung der hermeneutischen Situation für eine Ontologie des Daseins zuspitzt. Während die uneigentliche Seinsweise darin ausführlich charakterisiert wird, beschränkt sich die positive Ausführung der eigentlichen Seinsweise auf einige wenige Ausdrücke und Sätze. Hierbei fasst Heidegger die Eigentlichkeit als ‚Wahl‘ und als ein ‚Wie‘. Dieses ‚Wie‘ schließt (...) er im Vortrag explizit an das Grundprinzip von Kants Ethik an, während er sich in der Abhandlung von Kants Personbegriff abgrenzt. Dieser Beitrag geht vor dem Hintergrund Kants der Frage nach einer positiven Bestimmung der eigentlichen Seinsweise über die Abgrenzung zur Uneigentlichkeit hinaus in Heideggers Abhandlung und Vortrag Der Begriff der Zeit nach. In this paper I argue that the search for explainable models and interpretable decisions in AI must be reformulated in terms of the broader project of offering a pragmatic and naturalistic account of understanding in AI. Intuitively, the purpose of providing an explanation of a model or a decision is to make it understandable to its stakeholders. But without a previous grasp of what it means to say that an agent understands a model or a decision, the explanatory strategies will (...) lack a well-defined goal. Aside from providing a clearer objective for XAI, focusing on understanding also allows us to relax the factivity condition on explanation, which is impossible to fulfill in many machine learning models, and to focus instead on the pragmatic conditions that determine the best fit between a model and the methods and devices deployed to understand it. After an examination of the different types of understanding discussed in the philosophical and psychological literature, I conclude that interpretative or approximation models not only provide the best way to achieve the objectual understanding of a machine learning model, but are also a necessary condition to achieve post hoc interpretability. This conclusion is partly based on the shortcomings of the purely functionalist approach to post hoc interpretability that seems to be predominant in most recent literature. (shrink)

In his 1925/26 lecture Logic: The Question of Truth Heidegger turns to an interpretation of the Critique of Pure Reason in order to elucidate his own understanding of time. The largely overlooked lecture series, I argue, is at the root of Heidegger’s exposition of the concept of time and its relationship with human existence (Dasein). Although Heidegger claims that Kant’s concept of time is confined to that of ‘world-time,’ Heidegger develops the first exposition of his understanding of time as ur-temporality (...) via critical analysis of the Critique of Pure Reason. The investigation reveals the conceptual context behind the relationship between time and Dasein, which develops out of Heidegger’s first in-depth interpretation of the Critique of Pure Reason. Many word forms in natural language are polysemous, but only some of them allow for co-predication, that is, they allow for simultaneous predications selecting for two different meanings or senses of a nominal in a sentence. In this paper, we try to explain (i) why some groups of senses allow co-predication and others do not, and (ii) how we interpret co-predicative sentences. The paper focuses on those groups of senses that allow co-predication in an especially robust and stable way. We (...) argue, using these cases, but focusing particularly on the multiply polysemous word ‘school’, that the senses involved in co-predication form especially robust activation packages, which allow hearers and readers to access all the different senses in interpretation. El ensayo presenta el esbozo de una teoría de la explicación basada en el modelo duda-creencia de investigación propuesto por Peirce y desarrollado por Isaac Levi. Inicialmente se caracteriza una noción de explicación que hace referencia a las creencias y fines epistémicos de los miembros de una comunidad científica. Posteriormente se demuestra que la inclusión de los aspectos pragmáticos de la explicación en la teoría no sólo no conduce al relativismo, sino que es necesaria para poder dar cuenta de la (...) relación entre las nociones de explicación y comprensión. The first part of this paper investigates the purpose, methodological approach, and fundamental thesis of Du Châtelet’s theory of simple beings. The paper shows that ‘simple beings’ in Du Châtelet is a theory concerned with the understanding of extended bodies. The second part of the paper shows that her theory of simple beings, while it has important roots in both Leibniz and Wolff, is remarkably different from theirs. Thus, contrary to a common thread in the literature, Du Châtelet’s theory of (...) simple beings does not commit her to an ontology that can be equated with that of Leibniz or Wolff. Instead, her theory of simple beings is faculty-centred and draws a fundamental and novel distinction between the phenomenal realm of the senses and ‘real’ substances, which can only be grasped through the understanding. In group discussions of any kind there tends to be an up and down in the level of deliberation. To capture this dynamic we coined the concept of Deliberative Transformative Moments (DTM). In deeply divided societies deliberation is particularly important in order to arrive at peace and stability, but deliberation is also very difficult to be attained. Therefore, we wanted to learn about the conditions that in group discussions across the deep divisions of such societies help deliberation. We organized such (...) group discussions between ex-guerrillas and ex-paramilitaries in Colombia, Serbs and Bosnjaks in Srebrenica, and poor residents and local police officers in the favelas (slums) of Brazil. We could identify factors that help to transform discussions from low to high deliberation and risk transformations in the opposite direction. We could also identify factors that help to keep a discussion at a high level of deliberation, and, in a next step, we could determine to what extent long sequences of deliberation had a positive impact on the outcomes of the discussions. Finally, we show how our research results can have a long term effect if it is used in schools of such deeply divided societies. (shrink)

Testimony about the future dangerousness of a person has become a central staple of many judicial processes. In settings such as bail, sentencing, and parole decisions, in rulings about the civil confinement of the mentally ill, and in custody decisions in a context of domestic violence, the assessment of a person’s propensity towards physical or sexual violence is regarded as a deciding factor. These assessments can be based on two forms of expert testimony: actuarial or clinical. The purpose of this (...) paper is to examine the scientific and epistemological basis of both methods of prediction or risk assessment. My analysis will reveal that this kind of expert testimony is scientifically baseless. The problems I will discuss will generate a dilemma for factfinders: on the one hand, given the weak predictive abilities of the branches of science involved, they should not admit expert clinical or actuarial testimony as evidence; on the other hand, there is a very strong tradition and a vast jurisprudence that supports the continued use of this kind of expert testimony. It is a clear case of the not so uncommon conflict between science and legal tradition. (shrink)

This article discusses some of Chateaubriand’s views on the connections between the ideas of formalization and infinity, as presented in chapters 19 and 20 of Logical Forms. We basically agree with his criticisms of the standard construal of these connections, a view we named “formal proofs as ultimate provings”, but we suggest an alternative way of picturing that connection based on some ideas of the late Wittgenstein.

The present study aims at understanding how Ethica Nicomachea V.6 relates to its preceding chapters, V.1-5. On the one hand, the interpreter wonders for what purpose Aristotle introduces a topic named ‘the civic just’ (to politikon dikaion) in V.6, since V.1-5 treats extensively of matters of justice in the city. On the other hand, the same text posits that there is a certain ‘just without qualification’ (to haplōs dikaion), which may or may not be the civic just itself; compared to (...) the just without qualification, other forms of just are so by similitude (kath’homoiteta). In attempting to clear the confusion around those two points, the present study proposes the following: (1) the civic just is the just without qualification insofar as it is the primordial form of the just, in which only humans who are cumulatively free, equals and self-sufficient have a share; (2) the description of the civic just recapitulates several aspects of the discussions of justice in V.1-5 – the laws, the kinds of equality, rule, the legal suit - because the civic just encompasses all the forms of just (dikaion) related to the virtues of universal justice (V.1) and partial justice (V.2-5); (3) the expression to politikon dikaion is introduced in V.6 in order to contrast everything treated in V.1-5 with the domestic just, to oikonomikon dikaion, mentioned for the first time in V.6; (4) the forms of the domestic just are just only by similitude with the civic just because justice loses density outside the civic sphere, a situation which can be explained by the shortcomings Aristotle ascribes to women, children and slaves in EN V.6 (lack either of freedom or equality or yet self-sufficiency) as well as in Politica I (varying degrees of defective deliberation and virtue). Proponents of the duty to vote (DTV) argue that in normal circumstances, citizens have the moral duty to vote in political elections. Discussions about DTV analyze _what_ the duty is, _who_ has this duty, _when_ they have it, and _why_ they have it. Missing are answers to the Specification Question: to _which_ elections does DTV apply? A dilemma arises for some supporters of DTV—in this paper, I focus on Julia Maskivker’s work—because either answer is problematic. First, I argue that it (...) is implausible that DTV applies to _all_ elections because this makes the duty too costly for the voter. Second, I argue that there are no good reasons why under normal circumstances DTV applies only to _some_ elections. In this book chapter, we study the preventive rule, raised in Ley 1333 de 2009, and the way that environmental law has been building its own rules; escaping from the administrative law and creating their own dogmatic, necessary to achieve its independence as a legal autonomous area. Philosophy can be regarded as a type of conceptual research subjected to the usual standards of rationality. However, there seems to be no objective and accepted criteria for evaluating and comparing philosophical theories. From a heuristic- and erotetic-based approach, philosophy is here considered a set of second-order reflections that are presupposed by more specific theories; and evaluated by their informativeness, adequateness, cogency, generality, novelty, and presuppositional nature. As a practice, one can proceed upwards (from problems to presuppositions) or downwards (from (...) presuppositions as meaning conditions for assertions under question). But as a product, a philosophical theory is to be assessed as how it helps foster knowledge and assists in learning, posing, and solving new queries. (shrink)

The objective of this article is to try to elucidate Wittgenstein’s ex-travagant thesis that each and every mathematical advancement involves some “semantical mutation”, i.e., some alteration of the very meanings of the terms involved. To do that we will argue in favor of the idea of a “modal incompati-bility” between the concepts involved, as they were prior to the advancement, and what they become after the new result was obtained. Why I thought it useful to offer an explanation of Hegel’s doctrine on the Incarnation was so that the reader may be empowered to identify Hegel’s influence in modern accounts of this mystery. Even if, in my view, Hegel’s interpretation of revealed religion differs greatly from Catholic Doctrine, it is not surprising to find the presence of some of his concepts in modern theology. In truth, what matters is not the theologian’s self-identification as Hegelian or as non-Hegelian, but whether or (...) not the theologian adopts Hegel’s concepts. This paper offers an explanation of the internal dynamism of Hegelian concepts and their relation to Christian doctrine in Hegel’s Phenomenology of Spirit. This research may help to show in what way it is possible to explain Christian religious doctrine with a philosophy other than the Thomistic one and how, at least in Hegel’s case, religious doctrine is changed and reduced to an erroneous philosophical content. Also, an attempt is made to show the internal “coherence” of this Hegelian re-reading of Christianity so that theologians may become more cautious about accepting an explanation of Christian doctrine simply because the Christian language is preserved in that explanation. Abstract In The Descent of Man (1879), Charles Darwin proposed a speculative evolutionary explanation of extended benevolence—a human sympathetic capacity that extends to all nations, races, and even to all sentient beings. This essay draws on twenty-first century social science to show that Darwin’s explanation is correct in its broad outlines. Extended benevolence is manifested in institutions such as legal human rights and democracy, in behaviors such as social movements for human rights and the protection of nonhuman animals, and in (...) normative attitudes such as emancipative values and a commitment to promote the rights or welfare of animals. These phenomena can be substantially explained by cultural evolutionary forces that trace back to three components of what Darwin called the human “moral sense”: (1) sympathy, (2) our disposition to follow community rules or norms, and (3) our capacity to make normative judgments. Extended benevolence likely emerged with “workarounds,” including political ideologies, that established an inclusive sympathetic concern for sentient life. It likely became as widespread as it is now due to recently arisen socio-economic conditions that have created more opportunities for people to have contact with and take the perspective of a broader cross-section of humanity, as well as other species. The objective of this paper will be to present a critical evaluation of the so-called “standard conception of a proof”. According to this conception, a text could only be called a “demonstration of a certain mathematical proposition” if we could find a completely formalized version of that demonstration, its “corresponding formal proof”. We will compare these ideas with the treatment of the same topic within two markedly different contexts, that of contemporary Swedish intuitionism and that of modern software engineering. Cada día es más evidente que existen muchas formas sutiles de exclusión y parcialidad que afectan el correcto funcionamiento de los sistemas jurídicos. El concepto de injusticia epistémica, introducido por la filósofa Miranda Fricker, ofrece una herramienta conceptual útil para comprender estas formas de exclusión y parcialidad judicial que a menudo pasan desapercibidas. En este artículo presentamos la teoría original de Fricker y algunas de las aplicaciones del concepto de injusticia epistémica en los procesos jurídicos. En particular, queremos demostrar que (...) la semilla sembrada por Fricker ha generado un floreciente campo de estudio en el cual el concepto se utiliza para analizar muchos fenómenos diferentes en el ámbito jurídico, no siempre siguiendo la caracterización original proporcionada por ella. Esto ha llevado a una distinción entre lo que llamaremos la versión estrecha del concepto, que se acerca a la descripción original de Fricker, y la versión más amplia de injusticia epistémica, que es una noción más controvertida porque existe el riesgo de que se confunda con otros conceptos más conocidos como el sexismo, la discriminación racial, la opresión, el silenciamiento y el gaslighting. Mostraremos que el valor de la versión estrecha es principalmente teórico y que para utilizar el concepto de injusticia epistémica se debe adoptar una comprensión más liberal del mismo. (shrink)

There is a growing awareness that there are many subtle forms of exclusion and partiality that affect the correct workings of a judicial system. The concept of epistemic injustice, introduced by the philosopher Miranda Fricker, is a useful conceptual tool to understand forms of judicial partiality that often go undetected. In this paper, we present Fricker’s original theory and some of the applications of the concept of epistemic injustice in legal processes. In particular, we want to show that the seed (...) planted by Fricker has flourished into a rich field of study in which the concept is used to analyze many different phenomena in law, not always following the original characterization provided by her. This has led to a distinction between what we will call the narrow version of the concept, which is closer to Fricker’s original account, and the wider version of epistemic injustice, which is a more controversial notion because it is always on the verge of morphing into other well-known concepts like sexism, racial discrimination, oppression, silencing, and gaslighting. We will show that the value of the narrow version is mostly theoretical, and that in order to use the concept of epistemic injustice one must adopt a more liberal understanding of it. (shrink)

From the local level to international politics, deliberation helps to increase mutual understanding and trust, in order to arrive at political decisions of high epistemic value and legitimacy. This book gives deliberation a dynamic dimension, analysing how levels of deliberation rise and fall in group discussions, and introducing the concept of 'deliberative transformative moments' and how they can be applied to deeply divided societies, where deliberation is most needed but also most difficult to work. Discussions between ex-guerrillas and ex-paramilitaries in (...) Colombia, Serbs and Bosnjaks in Bosnia-Herzegovina, and police officers and locals in Brazilian favelas are used as case studies, with participants addressing how peace can be attained in their countries. Allowing access to the records and transcripts of the discussions opens an opportunity for practitioners of conflict resolution to apply this research to their work in trouble spots of the world, creating a link between the theory and practice of deliberation. Bioethicists appearing in the media have been accused of "shooting from the hip" (Rachels, 1991). The criticism is sometimes justified. We identify some reasons our interactions with the press can have bad results and suggest remedies. In particular we describe a target (fostering better public dialogue), obstacles to hitting the target (such as intrinsic and accidental defects in our knowledge) and suggest some practical ways to surmont those obstacles (including seeking out ways to write or speak at length, rather than (...) in sound bites). We make use of our own research into the way journalists quote bioethicists. We end by suggesting that the profession as a whole look into this question more fully. (shrink)

: New genetic technologies continue to emerge that allow us to control the genetic endowment of future children. Increasingly the claim is made that it is morally "irresponsible" for parents to fail to use such technologies when they know their possible children are at risk for a serious genetic disorder. We believe such charges are often unwarranted. Our goal in this article is to offer a careful conceptual analysis of the language of irresponsibility in an effort to encourage more care (...) in its use. Two of our more important sub-claims are: A fair judgment of genetic irresponsibility necessarily requires a thick background description of the specific reproductive choice; and there is no necessary connection between an act's being morally wrong and its being irresponsible. the following paper focuses on the phenomenon of “that girl” narrative, a recent social media trend that portrays in a very esthetically pleasing and conventional way what it means to be a successful female in today’s world. “That girl” is usually a traditionally pretty, white, skinny girl, who lives the picture-perfect life, striking to be her most efficient, productive and healthy self and who encourages others to feel the same kind of empowerment. Besides offering some tips and tricks on how (...) to live “that girl” lifestyle, the creators of such content seem to be mostly devoted to painting an ideal image: it looks like they are more concerned about how the content looks esthetically rather than conveying a positive and empowering message. The paper takes into account some significant images, taken from a leading Instagram profile in this field, and analyses them in a semiotic context, to see what the conveyed message is, what kind of ideology is here portrayed and how this plays in today’s society. Our purpose is to defend the possibility of “perceptualism,” that is to say, the position maintaining that the intelligible content of consciousness is given in perception and not posited by the activity of the subject. Assisted by the insights of Cornelio Fabro, this defense contrasts perceptualism with Bernard Lonergan’s “critical realism”. Some Molinists claim that a perfectly good God would actualize a world that is salvifically optimal, that is, a world in which the balance between the saved and damned is optimal and cannot be improved upon without undesirable consequences. I argue that given some plausible principles of rationality, alongside the assumptions Molinists already accept, God’s perfect rationality necessarily would lead him to actualize a salvifically optimal world; I call this position “Optimistic Molinism.” I then consider objections and offer replies, concluding (...) that Optimistic Molinism is undefeated and merits further exploration. This paper is an attempt to clarify, from a Thomistic point of view, the nature and method of metaphysics. I argue that metaphysics' object is created being, not God, even if God enters metaphysics as efficient cause of metaphysic's object. Also, that metaphysics is a science, insofar as a particular kind of coherent reasoning process, going from the many to understand a certain oneness, and then from that oneness to reinterpret the many. Moreover, that, in this particular process of reasoning, (...) doctrinal topics must follow a certain order. Thus, in particular, I argue that the distinction between essence and act of being in every creature cannot be argued before arguing the existence of God. I touch upon the notion of separation in metaphysics and I compare Aquinas' notion of resolution with Fabro's notion. (shrink)

In the natural and social sciences, it is common to use toy models—extremely simple and highly idealized representations—to understand complex phenomena. Some of the simple surrogate models used to understand opaque machine learning (ML) models, such as rule lists and sparse decision trees, bear some resemblance to scientific toy models. They allow non-experts to understand how an opaque ML model works globally via a much simpler model that highlights the most relevant features of the input space and their effect on (...) the output. The obvious difference is that the common target of a toy and a full-scale model in the sciences is some phenomenon in the world, while the target of a surrogate model is another model. This essential difference makes toy surrogate models (TSMs) a new object of study for theories of understanding, one that is not easily accommodated under current analyses. This paper provides an account of what it means to understand an opaque ML model globally with the aid of such simple models. (shrink)

Los sesgos cognitivos afectan negativamente la toma de decisiones en todas las esferas de la vida, incluyendo las decisiones de los jueces. La imposibilidad de eliminarlos por completo de la práctica del derecho, o incluso de controlar sus efectos, contrasta con el anhelo de que las decisiones judiciales sean el resultado exclusivo de un razonamiento lógico-jurídico correcto. Frente el efecto sistemático, recalcitrante y porfiado de los sesgos cognitivos, una posible estrategia para disminuir su efecto es enfocarse, no en modificar el (...) comportamiento de los agentes judiciales, sino en moldear su entorno para que los sesgos tengan menos oportunidades de aparecer. En particular, es más provechoso concentrar los esfuerzos en identificar aquellas reglas procesales que faciliten o limiten el efecto de los sesgos. En este ensayo propongo un diálogo fructífero entre el derecho y la psicología que puede llevar a mejorar la calidad de los sistemas judiciales. La propuesta está basada en la creación de guías de práctica judicial que puedan servir de base para la creación de protocolos procesales que limiten en la medida de lo razonable sus efectos negativos y conduzcan a mejores decisiones judiciales. I investigate Du Châtelet's contribution to the concept of time and position the relevance and content of that contribution between Leibniz and Kant. I argue that Du Châtelet advances Leibniz's concept of time by explaining how we form the idea of time in our mind and how time as an ideal being relates to succession in real beings. I show that Du Châtelet, differently to Kant, recognizes the dependency of time in its constitution on succession in "real things" and that (...) her concept of time is in this respect superior to Kant's. With a detailed investigation into Du Châtelet's notion of time in its own right and without prematurely "fitting" it into a defined debate between her contemporaries, I am aiming to reveal her original contribution to an understanding of time. I locate her concept of time in a context that is explicitly philosophical in terms of an investigation into how the idea of time is formed and constituted rather than a physical debate on the nature of time as a phenomenon relating to the movement of bodies. Many theists conceive of God as a perfect being, i.e., as that than which none greater is metaphysically possible. On this grand view of God, it seems plausible to think that such a supreme and maximally great being would not be subject to luck of any sort. Given the divine perfections, God is completely insulated from luck. However, I argue that the opposite is true: precisely because God is perfect, he is subject to a kind of luck called constitutive luck. (...) In this paper, first I provide an analysis of luck and then explain the concept of constitutive luck. I proceed to defend constitutive luck from charges of incoherence and examine a different approach to make sense of this luck. Furthermore, I distinguish between two kinds of constitutive luck and argue that even if God isn’t subject to one kind, evading the second kind is unsuccessful. I offer two ways that God is constitutively lucky and reach a surprising conclusion: a perfect being is the luckiest of all possible beings. (shrink)

Current work in language models (LMs) helps us speed up or even skip thinking by accelerating and automating cognitive work. But can LMs help us with critical thinking -- thinking in deeper, more reflective ways which challenge assumptions, clarify ideas, and engineer new concepts? We treat philosophy as a case study in critical thinking, and interview 21 professional philosophers about how they engage in critical thinking and on their experiences with LMs. We find that philosophers do not find LMs to (...) be useful because they lack a sense of selfhood (memory, beliefs, consistency) and initiative (curiosity, proactivity). We propose the selfhood-initiative model for critical thinking tools to characterize this gap. Using the model, we formulate three roles LMs could play as critical thinking tools: the Interlocutor, the Monitor, and the Respondent. We hope that our work inspires LM researchers to further develop LMs as critical thinking tools and philosophers and other 'critical thinkers' to imagine intellectually substantive uses of LMs. (shrink)

El desarrollo de las artes visuales durante el siglo XX desdibujó la frontera entre aquellos objetos y artefactos que llamamos obras de arte, y aquéllos que no son merecedores de ese título. Arthur Danto ha propuesto una teoría estética a la luz de la cual sería posible volver a definir los límites del arte. En este ensayo examino dos de los aspectos más problemáticos de la teoría: la importancia excesiva que Danto le otorga al concepto de mímesis y su concepción (...) teleológica de la historia del arte. Si atenuamos el papel de estos dos elementos, la teoría pierde gran parte de su poder explicativo. En las últimas dos secciones del ensayo arguyo que el mundo del arte al que Danto atribuye un papel central en el problema de la demarcación debe él mismo ser considerado un subproducto de las condiciones que determinan la naturaleza del arte en general. Deliberative Transformative Moments (DTM) is a new concept that serves as an amendment to the DQI. With this new concept it is easier to get at the quick give-and-take of discussions of small groups of ordinary citizens. As an illustration, we apply the concept to discussions about the peace process among Colombian ex-combatants, ex-guerrillas and ex-paramilitaries. Specifically, we show how personal stories can transform a discussion from a low to a high level of deliberation and how they can have the (...) opposite effect. To increase the level of deliberation in the general population, we recommend that good illustrations of DTM’s should be part of the school programs from an early age on, so that children learn how to discuss with others who have different opinions and values. In the present work, we will analyze the concept of intuition mainly in relation to the epistemological and the metaphysical theses of Schopenhauerian theory. In the first section, we will discuss the central axes of Schopenhauer’s metaphysical system, especially regarding the concept of will (Wille) and the relationship that this entails with his theory of knowledge. Then, we will examine the difference that the German philosopher establishes between representative —or mediated— rational knowledge and direct —or immediate— intuitive knowledge. Likewise, we (...) will trace at first the theses and the fundamental problems of the dualism of representation and we will furtherly establish the problem of the intuition of one’s own body. Finally, we will consider the scope and the limits of intuition, as well as its different variants: mainly aesthetic intuition and its culmination in mystical intuition. (shrink)

According to Molinism, logically prior to his creative decree, God knows via middle knowledge the truth value of the counterfactuals or conditionals of creaturely freedom (CFs) and thus what any possible person would do in any given circumstance. Critics of Molinism have pointed out that the Molinist God gets lucky that the CFs allow him to actualize either a world of his liking or even a good-enough world at all. In this paper, I advance and strengthen the popular critique in (...) two ways. First, I specify the kind of luck to which God is subject, which is circumstantial moral luck. Second, and more importantly, I argue that exposure to this luck is problematic because something external to God and beyond his control determines the degree of praiseworthiness he deserves in relevant possible worlds. My main contention is that divine subjection to circumstantial moral luck raises the theoretical costs of Molinism. (shrink)
