The U.S. Supreme Court's majority opinion in Vacco v. Quill assumes that the principle of double effect explains the permissibility of hastening death in the context of ordinary palliative care and in extraordinary cases in which painkilling drugs have failed to relieve especially intractable suffering and terminal sedation has been adopted as a last resort. The traditional doctrine of double effect, understood as providing a prohibition on instrumental harming as opposed to incidental harming or harming asa side effect, must be (...) distinguished from other ways in which the claim that a result is notintended might be offered as part of ajustification for it. Although double effectmight appropriately be invoked as a constrainton ordinary palliative care, it is not clearthat it can be coherently extended to justifysuch practices as terminal sedation. First, I briefly characterize Dretske’s particular naturalization project, emphasizing his naturalistic reconstruction of the notion of representation. Second, I note some apparent similarities between his notion of representation and Husserl’s notion of intentionality, but I find even more important differences. Whereas Husserl takes intentionality to be an intrinsic, phenomenological feature of thought and experience, Dretske advocates an “externalist” account of mental representation. Third, I consider Dretske’s treatment of qualia, because he takes it to show that his representational account of mind (...) succeeds in naturalizing even the “subjective” features of experience. I claim that Dretske's argument for his account of qualia turns on an ambiguous characterization of qualia. I conclude that he succeeds in naturalizing qualia only if qualia are understood as nonphenomenological features of experience and that he therefore has less to say than he thinks about the subjective life of beings such as us. I experience the world as comprising not only pluralities of individual persons but also interpersonal communal unities – groups, teams, societies, cultures, etc. The world, as experienced or "constituted", is a social world, a “spiritual” world. How are these social communities experienced as communities and distinguished from one another? What does it mean to be a “community”? And how do I constitute myself as a member of some communities but not of others? Moreover, the world of experience is not constituted (...) by me alone, nor am I myself the final arbiter of what is true or false about it, of what is good or bad about it, etc. Constitution is an intersubjective achievement: “we” – I with others – constitute the world. Thus, the world is not only constituted as including interpersonal communal unities, but it is also constituted by these communities: groups, teams, societies, cultures, etc. are themselves "we-subjects”, Husserl says, communally constituting the world of their common engagement. But what is communal, as opposed to individual, constitution and how is it achieved? And what sense is to be made of the notion of plural, collective, "we-subjects", communally constituting a common world? (shrink)

This dissertation aims to analyze, clarify, and reconstruct the concept of class consciousness by developing a dialectical account of political agency at work in the concept. I defend a dialectical account of agency, that includes both the way in which individuals come together to form groups, but also the capacity of a collective to transform social conditions. I argue that this account of political agency is necessary in order to understand the possibility of social transformation or change. I trace the (...) development of the relationship between consciousness and agency in the early tradition of Western Marxism, focusing primarily on the account of class consciousness given by Georg Lukács in History and Class Consciousness. Against his account of the world historical agency of a unified proletariat, however, I defend Theodor Adorno’s insistence on nonidentity, and the importance of unreconciled groups in capitalist society. In order to understand these groups, such as the vanguard, party, or proletariat, we must understand the way in which individuals form groups, as well as their inherent collectivity. -/- My account of the political agency at work in the concept of class consciousness is broadly speaking pluralist. I argue that a multiplicity of methodologies is needed in order to arrive at a complete picture of the concept. I defend an account of class consciousness that is neither reductive nor deflationary with respect to other dimensions of social domination. This class forward approach seeks to build intersectional political coalitions in order to undertake revolutionary action. Successful revolutionary social transformation is never guaranteed in advance; however, the concept of class consciousness, reconstructed through the lens of political agency, offers conceptual resources to address the problems of today, for the sake of a better tomorrow. In recent years, a number of moral philosophers have held both that there are particular moral truths, and also that there are no general moral principles which explain these particular moral truths--either because there simply are no moral principles, or because moral principles are themselves explained by or derived from particular moral truths rather than vice versa. Often this combination of doctrines is held by philosophers interested in reviving an Aristotelean approach..

In this paper, I shed light on Kant’s notion of Erkenntnis or cognition by focusing on texts pertaining to Kant’s thoughts on logic. Although a passage from Kant’s Logik is widely referred to for understanding Kant’s conception of Erkenntnis, this work was not penned by Kant himself but rather compiled by Benjamin Jäsche. So, it is imperative to determine its fidelity to Kant’s thought. I compare the passage with other sources, including Reflexionen and students’ lecture notes. I argue that several (...) of the text’s peculiarities stem from Jäsche rather than Kant, but that nevertheless Jäsche largely got Kant's view right, with two major exceptions. First, Jäsche’s text fails to reproduce Kant’s key thesis that kennen and verstehen are jointly sufficient for Erkenntnis. Second, Jäsche’s text gives the false impression that Kant holds that animals have consciousness. (shrink)

The topic of this paper is the general thesis that the death of the human organism is what constitutes the death of a person. All admit that when the death of a human organism occurs, in some form or another, this normally does result in the death of a person. But, some maintain, organismic death is not the same thing as personal death. Why? Because, they maintain, despite the fact that persons are associated with a human organism (‘their organism’), they (...) are not identical with their organism, and so they can, at least in principle and perhaps in actuality, die before or after their organism dies. The thesis described above I shall call ‘the two-deaths thesis’ in virtue of the fact that its proponents believe that there are two kinds of death, viz. organismic death and personal death. The opposing thesis, according to which the death of a human organism does constitute the death of a person, I call the ‘one death thesis’. After giving some background remarks in section 2 of this paper, in section 3 I argue that, if we take linguistic usage seriously, neither the two-deaths thesis nor the one-death thesis is true. I argue, rather, that so far as linguistic usage goes it is indeterminate which of them is true. In section 4 I go further and argue that if one accepts a widely held metaphysical view, viz. that the world itself partially determines reference and the extensions of our concepts, then it is plausible that the one-death thesis is true despite the facts about linguistic usage. I argue that Kant’s primary epistemological concern in the Critique of Pure Reason’s transcendental deduction is empirical cognition. I show how empirical cognition is best understood as “rational sensory discrimination”: the capacity to discriminate sensory objects through the use of concepts and with a sensitivity to the normativity of reasons. My dissertation focuses on Kant’s starting assumption of the transcendental deduction, which I argue to be the thesis that we have empirical cognition. I then show how Kant’s own subjective deduction (...) fleshes out his conception of empirical cognition and is intertwined with key steps in the transcendental deduction’s arguments that the categories have objective validity and that we have synthetic a priori cognition. This article presents formal correspondences between the ontological and logical structures of Deleuze’s theory of sense-events in the Logic of Sense as a “post-Cantorian orientation of thought” (Livingston 2012), grappling with an essential incompleteness or inconsistency at the heart of both Being and thought, one which Deleuze champions positively under the equation Ungrounding = Becoming. Through it, Deleuze’s sometimes slippery use of the concept of singularity (and its relation to the virtual) is elaborated, elucidating a post-Cantorian metaphysics of events, distinct (...) from and preceding Badiou’s, that concretely defines the role of the singular in Deleuze’s early major works. With the recent renewed interest in AI, the field has made substantial advancements, particularly in generative systems. Increased computational power and the availability of very large datasets has enabled systems such as ChatGPT to effectively replicate aspects of human social interactions, such as verbal communication, thus bringing about profound changes in society. In this paper, we explain that the arrival of generative AI systems marks a shift from ‘interacting through’ to ‘interacting with’ technologies and calls for a reconceptualization of socio-technical (...) systems as we currently understand them. We dub this new generation of socio-technical systems synthetic to signal the increased interactions between human and artificial agents, and, in the footsteps of philosophers of information, we cash out agency in terms of ‘poiêsis’. I argue here that the existence of hermeneutical injustice as a pervasive feature of our collective linguistic and conceptual resources undermines the originalist task at two levels: one procedural, one substantive. First, large portions of society were (and continue to be) systematically excluded from the process of meaning creation when the Constitution and its Amendments were adopted, so originalism relies on enforcement of a meaning that was generated through an undemocratic process. Second, the original meaning of some words in those (...) texts may be substantively objectionable as a result because they fail to capture the relevant experiences of affected people at the time even if they accurately capture the conceptual understanding of reasonable people at the time, and this substantive failing may infect the text’s democratic legitimacy. To the extent that it can be overcome, overcoming this epistemic problem will require originalists to take seriously the insights of critical theory, understood in this Note as a normative inquiry into the historical context of the language and meaning of statutory text. Because originalists are already committed to a nominally descriptive inquiry into this context, and because this nominally descriptive inquiry masks the inherently normative aspects of the hermeneutical landscape, the switch to an explicitly normative inquiry may prove quite painless. Trent Dougherty argues (contra Jonathan Matheson) that when taking into consideration the probabilities involving skeptical theism (ST) and gratuitous evils, an agent may reasonably affirm both ST and that gratuitous evils exist. In other words, Dougherty thinks that assigning a greater than .5 probability to ST is insufficient to defeat the commonsense problem of evil. I argue that Dougherty’s response assumes, incorrectly, that ST functions solely as an evidential defeater, and that, when understood as a closure of inquiry defeater, ST (...) may still defeat reasonable belief in gratuitous evils, even in the face of strong evidence that gratuitous evils exist. Contemporary analytic theological discussions of atonement do not attend extensively to questions of how narrative might relate to the atoning work of Christ. Liberation theologians, on the other hand, utilize narrative in their scholarly method regularly and often employ it when discussing atonement or reconciliation. This essay argues that analytic theologians should consider the notion of narrative (and narrative identity) as a mechanism of atonement in the broad sense of the term introduced when William Tyndale coined ‘atonement’ to translate 2 (...) Corinthians 5. I then offer some psychological grounds for thinking that reframing one’s self-narrative in terms of a transcendent narrative is often conducive to human flourishing, and I consider the work of James H. Cone as an instance of such transcendent narrative reframing at work. (shrink)

This article engages with debates concerning the moral worth of human beings with profound intellectual and multiple disabilities (PIMDs). Some argue that those with such disabilities are morally less valuable than so-called normal human beings, whereas others argue that all human beings have equal moral value and so each group of humans ought to be treated with equal concern. We will argue in favor of a reconciliatory view that takes points from opposing camps in the debates about the moral worth (...) of humans with PIMDs. The view in question, roughly, is this: most humans with PIMDs are persons in the morally significant sense and so deserve equal moral consideration to so-called normal human beings. Some humans with PIMD may not, however, be persons, but nevertheless deserve equal moral consideration to persons because they stand in a special relation to persons. (shrink)

This essay presents a heterodox reading of the issue of solipsism in Wittgenstein’s Tractatus Logico-Philosophicus, out of which the whole of the TLP can be re-read. Inspired by, though not dependent on, the themes of virtuality and singularity found in Deleuze’s ‘transcendental empiricism’, Wittgenstein’s concept of ‘logical space’ is here complexly related to the paradoxes of the ‘metaphysical subject’ and ‘solipsism,’ within which the strictures of sense are defined, and through which the logico-pictorial scaffolding of the TLP precipitates its own (...) systematic dissolution. Functional diversity holds the promise of understanding ecosystems in ways unattainable by taxonomic diversity studies. Underlying this promise is the intuition that investigating the diversity of what organisms actually do—i.e. their functional traits—within ecosystems will generate more reliable insights into the ways these ecosystems behave, compared to considering only species diversity. But this promise also rests on several conceptual and methodological—i.e. epistemic—assumptions that cut across various theories and domains of ecology. These assumptions should be clearly addressed, notably for the sake (...) of an effective comparison and integration across domains, and for assessing whether or not to use functional diversity approaches for developing ecological management strategies. The objective of this contribution is to identify and critically analyze the most salient of these assumptions. To this aim, we provide an “epistemic roadmap” that pinpoints these assumptions along a set of historical, conceptual, empirical, theoretical, and normative dimensions. (shrink)

In response to its current crisis, scholars call for the revitalisation of democracy through democratic innovations. While they make ample use of life metaphors describing democracy as a living organism, no comprehensive understanding of ‘life’ has been established within democratic theory. The Black Lives Matter (BLM) movement articulates the urgency of refocusing on life and its meaning through radical democratic practice. This article employs a grounded theory approach, enriched with participatory methods, to develop a radical democratic concept of life in (...) conversation with BLM. It conceptualises life as the existence of a perspective that constantly transforms through its fundamental interconnectedness. Building on this concept, the article outlines four principles of a living democracy that go beyond the revitalisation discourse. A living democracy (1) safeguards the existence of all humans and nonhumans, (2) nurtures a diversity of perspectives, (3) fosters social and planetary connectivity, and (4) enables self- and collective transformation. Host-microbiome interactions (HMIs) are critical for the modulation of biological processes and are associated with several diseases, and extensive HMI studies have generated large amounts of data. We propose that the logical representation of the knowledge derived from these data and the standardized representation of experimental variables and processes can foster integration of data and reproducibility of experiments and thereby further HMI knowledge discovery. A community-based Ontology of Host-Microbiome Interactions (OHMI) was developed following the OBO Foundry principles. OHMI leverages established (...) ontologies to create logically structured representations of microbiomes, microbial taxonomy, host species, host anatomical entities, and HMIs under different conditions and associated study protocols and types of data analysis and experimental results. We propose a domain-level ontology of plays for the facilitation of play-based collaborative autonomy among unmanned and manned-unmanned aircraft teams in the Army’s Unmanned Aircraft System (UAS) mission domain. We define a play as a type of plan that prescribes some pattern of intentional acts that are intended to reliably result in some goal in some competitive context, and which specifies one or more roles that are realized by those prescribed intentional acts. Applied ontologies have been used more and more frequently to enhance systems engineering. In this paper, we argue that adopting principles of ontological realism can increase the benefits that ontologies have already been shown to provide to the systems engineering process. Moreover, adopting Basic Formal Ontology (BFO), an ISO standard for top-level ontologies from which more domain specific ontologies are constructed, can lead to benefits in four distinct areas of systems engineering: (1) interoperability, (2) standardization, (3) testing, and (4) data (...) exploitation. Reaping these benefits in a model-based systems engineering (MBSE) context requires utilizing an ontology’s vocabulary when modeling systems and entities within those systems. If the chosen ontology abides by the principles of ontological realism, a semantic standard capable of uniting distinct domains, using BFO as a hub, can be leveraged to promote greater interoperability among systems. As interoperability and standardization increase, so does the ability to collect data during the testing and implementation of systems. These data can then be reasoned over by computational reasoners using the logical axioms within the ontology. This, in turn, generates new data that would have been impossible or too inefficient to generate without the aid of computational reasoners. (shrink)

Alisadyr McIntyre, the contemporary moral philosopher is also known as a philosopher of politics due to his criticisms of modernism. He is after reviving the Aristotelian virtue-centered ethics, and, for some reasons, has adopted the religious account of ethics of virtue proposed by Aquinas.In his book, In Search of Virtue, after a historical study of moral virtues during the period of Homerian Greece and after it, he finally presents an account of the nature of virtue which he believes is (...) more substantial and valid than those presented previously. This paper, after reviewing virtue-centered ethics in brief and presenting an account of it which is acceptable to McIntyre, clarifies the nature of virtue from his viewpoint. In his “Critical Response,” William Curtis presents three main criticisms against my position elaborated in “In Defense of Nonliberal Nationalism.” First, he alleges that my conception of national membership is “voluntarist” and ultimately liberal. Second, he claims that my position on nonliberal democracy is “quintessentially liberal.” Third, he charges that my account of nonliberal nationalism would allow the oppression of minorities. The first charge is based on Curtis’s misreading of my article. The second charge is interesting and worthy (...) of consideration in itself. Yet Curtis fails to advance a clear argument to support it. The third charge has been dealt with in my original article, but I shall restate it here to meet Curtis’s objection. Although I shall address all three, the focus will be on the second, as I believe that it poses the strongest challenge to my position. In responding to these charges, I shall provide necessary clarification and elaboration and thereby strengthen the critiques, as Curtis’s own arguments are often unclear or non-existent. (shrink)

Science fiction has served the film industry like a dreamy stepchild. It gets only scant accolades from its master but must do heavy lifting: that is, make money. While science-fiction films often emphasize spectacle and action, they also inspire philosophical contemplation. Why? Science fiction, dating back to Shelley and Verne, came into existence speculating about humanity's social and physical worlds. Many books and articles over the past several years discuss the philosophical issues that films raise. One fairly new school of (...) thought, "posthumanism," explicitly deriving from postmodernism, with touches of critical theory, has seized on science-fiction movies as support for its theorizing. This volume and its 42 authors from film theory, science and technology studies, literary criticism, media studies, and philosophy, offer an array of posthumanist scholarship. (shrink)

In the article I discuss functionalist interpretations of Husserlian phenomenology. The first one was coined in the discussion between Hubert Dreyfus and Ronald McIntyre. They argue that Husserl’s phenomenology shares similarities with computational functionalism, and the key similarity is between the concept of noema and the concept of mental representation. I show the weaknesses of that reading and argue that there is another available functionalist reading of Husserlian phenomenology. I propose to shift perspective and approach the relation between phenomenology (...) and functionalism from a methodological perspective, specifically taking into account the functionalist explanatory strategy called functional analysis. I discuss the notion of function in Husserl’s works and Husserl’s idea of functional phenomenology. The key argument I develop is that in functional phenomenology we can find an explanatory strategy which is analogous to the strategy of functional decomposition used in functional analysis. I conclude that the proposed functionalist reading of phenomenology opens a new approach to the integration of phenomenology with cognitive sciences. (shrink)

I’ve argued that those who endorse the argument from divine hiddenness must give up all pure de jure objections to theism, and this means that endorsing the argument is costly for atheists. Benjamin Curtis claims that this isn’t a significant cost for atheists. I show that—contrary to Curtis—there is a significant cost, and spell out why this is so. Furthermore, I show that my argument functions as a new argument for affirming reformed epistemology—the view that if theism is (...) true, belief in God is probably rational. (shrink)

The debates on the scientificity of social sciences in general, and sociology in particular, are recurring. From the original methodenstreitat the end the 19th Century to the contemporary controversy on the legitimacy of “regional epistemologies”, a same set of interrogations reappears. Are social sciences really scientific? And if so, are they sciences like other sciences? How should we conceive “research programs” Lakatos (1978) or “research traditions” for Laudan (1977) able to produce advancement of knowledge in the field of social and (...) human phenomena? Is the progress of knowledge in social sciences similar to the one generally observed in natural sciences? Is it possible to evaluate the relative merits of each one of these research programs? -/- These debates are important vectors of social and intellectual polarization. The historical divide between the positivist and the hermeneutics poles precedes the structure of the contemporary debate around the epistemic space of social sciences, It is not only a question of renewing the opposition between a monist view of sciences (e.g. McIntyre, 1996) and a dualistic one (e.g. Geertz, 1973) or even a trialist view of sciences (e.g. Lepenies, 1985). It is also a question of asserting dichotomies transformed into framework (including when it is a question of exceeding them): nature-culture, nomothetic-idiographic, models-narrative, structure-history, cause-reason, explanation-comprehension. -/- In this short introduction, we provide, in section 2, a first overview of this epistemological debate in social science. Section 3 proposes a different standpoint on the same questions, by introducing both ontological and methodological aspects in this basic epistemological debate. Namely, following (Hollis, 1994) oppositions of the explanation - understanding, causes - meaning, etc., types discussed in the firsts ection are comparatively examined together with oppositions of the structure - action, holism - individualism types. This allows us to discus show multi-agent design, by integrating various dimensions and standpoints in the same framework (Phan, Amblard, 2007, Chapters 1, 5, 14) can help us to shift these boundaries, and to bypass these oppositions. As model building and ontology design are at the core of this process (Phan, Amblard, 2007, Chapter 12), Section4 discusses various issues of the art of modelling, starting both from economists’ and sociologists’ current standpoints. The paper argues for the view advocated by Yolton that Locke's ideas are best viewed as intentional contents. Drawing on Smith and McIntyre's distincition between object- and content-theories of intentionality I seek it show that it belongs to the second category. The argument relies mainly on the analysis of Locke's discussion of meaning, the reality and adequacy of ideas and real essence.

I will review the argument from complexity of the phenomena represented by Hayek (1967) that asserts that the human phenomena are, in some way, inherently complex, thus, that the laws in social sciences are not available in principle; and by Scriven (1956), who asserts a more elaborate version of the argument from complexity, given space for the possibility that the complexity is not intrinsic to the social phenomena, but that they are constitutive to the level of description that we are (...) interested in. Against both, following McIntyre (1993) I will hold that they would be, by one hand, idealizing the scientific practice and, by the other hand, not being able to explain the social phenomena to the level that we are interested in because they end up by eliminating it. Then, in a second part, I will expose the role of explanation in historical materialism (from an analytical marxist perspective) trying to conciliate the functionalism exposed by Cohen (2001) and the methodological pluralism of Little (1991). Historical materialism, by modifying the conception of the constitution of society (substituting the methodological individualism for a structural analysis with a primacy of the socio-economical social relations) allows us even to lay the necessary foundations for identifying, in a non-abstract nor idealized way, the rational agency of individuals that constitute the social classes. This proves an advantage over methodological individualism in that it does not eliminates the phenomena that are being explained. (shrink)

INTRODUÇÃO A técnica da inseminação artificial tornou possível aumentar o impacto na descendência de touros geneticamente superiores em termos de produção láctea das filhas. Com a transferência de embriões é possível aumentar o impacto da fêmea sobre (...) a população das filhas. A transferência de embriões data de 1890, ano em que Heape obteve o nascimento de coelhos transferindo ovócitos fecundados de uma fêmea para outra. A partir de 1930, é repetida uma série de experiências para desenvolver a técnica e aplicá-la em ovinos, caprinos (1934) e bovinos (1951) como espécies mais idôneas para a reprodução. A Inglaterra e os Estados Unidos estabeleceram as bases para o comércio de embriões durante os anos sessenta e setenta. De forma resumida, a transferência de embriões implica na estimulação da produção de ovócitos mediante a aplicação de hormônios: cerca de 6-8 dias após a cobrição dessas fêmeas ou da sua inseminação artificial, os óvulos fertilizados são extraídos dos órgãos genitais da fêmea doadora por perfusão ou lavagem com soluções biológicas controladas e testadas, originando-se uma deposição dos gametas fecundados nas fêmeas receptoras que serão encarregadas de levar adiante a gestação e o parto sem influência sobre as produções do novo indivíduo. 2. MANEJO DAS FÊMEAS DOADORAS É relativamente fácil obter um embrião, uma vez que pode origina-se a partir do cio natural das vacas cíclicas. No entanto, a fim de otimizar a técnica, o normal é «superovular» a fêmea doadora e obter um número superior de gametas fecundadas após cada lavagem ou perfusão das genitais. A maioria das fêmeas doadoras são tratadas com gonadotrofinas (PMSG) ou com hormônios estimuladores da foliculogênese (FSH). Estes hormônios invertem a atresia normal de folículos permitindo uma maturação, que em condições normais não se realizaria. O mecanismo exato do funcionamento destas hormonas não é totalmente claro. A superovulação multiplica por um fator de 10 o número de ovócitos recuperados no caso das vacas, ovelhas e cabras, mas apenas por um fator 2 ou 3 no caso das porcas. Existe um acordo geral sobre a utilização das gonadotrofinas; a PMSG deve ser aplicada durante a transição da fase luteica para a folicular, ou seja, no 16º dia do ciclo. As doses de gonadotrofinas variam entre 1500 e 3000 UI em bovinos, aumentando a resposta e a variabilidade individual com o aumento da dose. A resposta ao tratamento varia de acordo em função de diversos fatores. Neste contexto, merecem especial atenção a espécie, a raça, a época e a conformação corporal do animal, bem como o lote de fabricação da preparação hormonal (quadro 7.1). Estudos demonstram que, nos bovinos, as raças de corte respondem melhor ao tratamento do que as raças leiteiras. O FSH também é utilizado para superovulação em várias espécies. Nos ovinos, injetam-se 2 mg desta hormona 12 horas antes da retirada das esponjas, aplicando-se mais três injeções, com um intervalo de 12 horas, até 24 horas após a retirada das esponjas, o que corresponde a um total de 8 mg de FSH injetados por tratamento e animal. Às vezes, e dependendo do país, existem dificuldades para a obtenção desse hormônio em condições de pureza adequada para que o tratamento proporcione o resultado esperado. Nas vacas dadoras devem ter passado mais de 50 dias após o último parto: também ser animais cíclicos, encontrar-se num nível nutricional elevado e em aumento, sem deficiências especificas alimentares. Existe uma indicação de suplementação das fêmeas doadoras com minerais essenciais antes do tratamento. 3. OBTENÇÃO DE EMBRIÕES Uma vez as fêmeas doadoras inseminadas, entre o sexto e o oitavo dia, procede-se a coleta dos embriões. Para isso, atualmente se utilizam cateteres de obtenção transcervical (tipo Foley, Rusch. etc.) munidos de uma bola insuflável na sua extremidade que permite criar um compartimento estanque na parte distal do córneo uterino e proceder ao arrasto dos embriões ali localizados. Para obter esta «lavagem» utiliza-se uma solução aquosa tamponada: o meio mais frequentemente utilizado é o tampão fosfato salino (PBS: pH = 7; PO = 280 - 290 mOsm/kg) suplementado com antibióticos e proteínas. Depois de recuperado o meio de lavagem, os embriões devem ser isolados do volume total, avaliados segundo critérios do Manual da Sociedade Internacional de Transferência de Embriões de acordo com seu estado de desenvolvimento. Código numérico para determinar o grau de desenvolvimento embrionário: N° 1: ovócito não fertilizado ou embrião de uma célula (1 dia). N° 2: Identifica embriões com 2 a 16 células (2-4 dias). N° 3: Identifica mórulas adiantadas (5-6 dias). N° 4: Identifica mórulas compactas de 6 dias de idade. N° 5: blastocisto adiantado (7 dias). N° 6: blastocisto (7-8 dias). N° 7: blastocisto expandido (8-9 dias). N° 8: blastocisto eclodido (9 dias) a partir do nono ou décimo dia o blastocisto já está fora da zona pelúcida. Além da classificação por estado de desenvolvimento, a referida Sociedade Internacional estabeleceu uma categorização dos embriões com base na qualidade dos mesmos. Assim os denomina: 1: excelente; 2: bom; 3: regular; 4: degenerado. Segundo as investigações de diversos autores especialistas no tema não devem ser transferidos embriões que não tenham sido classificados como excelentes ou bons. A obtenção dos embriões pode ser realizada em uma clínica, em unidades móveis especializadas, ou na própria fazenda. Em todo o caso, a doadora não deve apresentar quaisquer sintomas clínicos de doença, sendo esta responsabilidade direta do veterinário. O rebanho de onde provém a doadora deve estar livre de medidas cautelares sanitárias. Os técnicos devem estar adequadamente limpos e preparados para esta atuação, em um lugar tranquilo e que permita a colocação de equipamentos e material em condições limpas e seguras. 4. TÉCNICAS DE TRANSFERÊNCIA DE EMBRIÕES Recomenda-se que os embriões sejam transferidos o mais rápido possível depois da recuperação. A fêmea receptora deve apresentar um ambiente uterino o mais semelhante possível ao da fêmea doadora. Isto quer dizer que a receptora também será mantida num sistema de sincronização para que coincida o mais possível o estágio de desenvolvimento embrionário com seu correspondente estado uterino. A margem de assincronia para evitar efeitos indesejáveis é de ± 24 horas. Os métodos hormonais de sincronização são análogos aos das doadoras. As técnicas para a deposição dos embriões no seu novo habitat podem ser igualmente cirúrgicas e não cirúrgicas, mas devido aos problemas do uso de anestésicos em técnicas cirúrgicas, as transferências foram direcionadas para modelos não-cirúrgicos ou transcervicais. Este método é baseado na utilização do colo uterino de forma análoga como é realizada na inseminação artificial. Devido às relações entre o embrião e o ovário, as porcentagens de fertilidade são aumentadas ao serem depositadas no corno ipsilateral no ovário que se encontra ativo. A utilização desta técnica implica na obtenção de mais fêmeas gestantes. O uso de novilhas como fêmeas receptoras aumenta também a taxa de gestações a partir de uma maior facilidade de manejo, uniformidade na resposta hormonal e um custo mais baixo. O fator humano ou habilidade do técnico que realiza esta técnica também constitui um fator que influencia decisivamente no êxito da transferência, encontrando-se variações de 20 a 60% devidas a este fator. 5. CONTROLES SANITÁRIOS Com a utilização da inseminação artificial, verificou-se que, embora as tecnologias reprodutivas colaborativas fossem mais avançadas em termos de técnicas destinadas a aumentar a produtividade individual, da mesma forma, podem constituir um perigo de contaminação e de dispersão de doenças estrangeiras para o grupo ou rebanho para onde são transferidos os novos genes. Neste contexto, a transferência embrionária (TE) deve realizar-se tendo em conta os riscos que pode implicar uma manipulação inadequada. Uma vez mais, a Sociedade Internacional (IETS) na Reunião Regional da OIE (Oficina Internacional de Epizootias) estabeleceu as normas em 1985 para que a TE pudesse ser utilizada como meio para controle de doenças na pecuária. Para que a utilização da TE se realize sem risco para a saúde, é necessário ter em conta um certo número de regras e condições específicas que evitem os riscos de contaminação. O embrião está separado do meio externo por três barreiras de proteção: o corpo da mãe, o útero por si só e a terceira, e mais importante, pela zona pelúcida, a qual nos animais domésticos tem demonstrado ser totalmente impermeável a qualquer elemento patogênico, desde que fique intacta. Portanto, o risco de contaminação dos embriões pode vir por duas vias diferentes: a) Fatores extrínsecos - por invasão dos agentes patogênicos na cavidade uterina principalmente. Isto está relacionado com o estado sanitário médio do país, região ou rebanho de origem. b) Fatores intrínsecos - Segundo Thibier podemos considerar diferentes fontes potenciais de contaminação, que segundo o risco sanitário se classificam nas seguintes ordens: 1° Zigoto. 2° Penetração. 3° Absorção. 4° Armazenamento. 5° Exame. 6° Transferência. Os esforços para que os embriões se tornem livres de contaminação devem ser semelhantes aos que são efetuados com os animais vivos e com as doses seminais. O momento mais perigoso encontra-se entre a coleta das células fecundadas e a sua deposição, após seu exame, no trato reprodutivo da receptora. As condições em que o referido processo deve ser realizado encontram-se detalhadas no manual da Sociedade Internacional de Transferência de Embriões (IETS). 6. REGRAS DA IETS A transferência de embriões é a via mais segura para a troca de genes. No entanto, os técnicos devem esforçar-se por manter todas as regras e normas sanitárias para que a coleta e a manipulação dos embriões se realizem sob condições de absoluta garantia higiênica e sanitária. A transferência embrionária implica, pela primeira vez na história da medicina veterinária, que a vigilância sanitária não se aplica estritamente ao animal, uma vez que, na sua fase "in vitro", está inteiramente sob o controle do técnico. Por conseguinte, não haverá futuro para este tipo de biotecnologia se, paralelamente, não houver um elevado nível de garantia de que não «servirá» para não disseminar ou difundir doenças. As conclusões da Sociedade Internacional de Transferência de Embriões (IETS) na sua reunião anual de 14 de Janeiro de 1992 estabelecem, tendo em conta a revisão efetuada em 1991 pela Subdireção de Investigação e pelo Comitê de Importação e Exportação, uma classificação das doenças. Esta classificação corresponde às seguintes categorias: Categoria 1 - Doenças ou agentes de doenças para as quais foram recolhidas provas suficientes para afirmar que o risco de transmissão é negligenciável, desde que os embriões sejam corretamente manipulados entre a coleta e a transferência: a) Leucose bovina enzoótica. b) Febre aftosa (bovinos). c) Língua azul (bovinos). d) Brucelose bovina. e) Rintraqueíte infecciosa bovina. f) Doença de Aujeszky. Categoria 2 - Doenças para as quais foram recolhidas provas substanciais que indicam que o risco de transmissão é insignificante, desde que os embriões sejam corretamente manipulados entre a coleta e a transferência, mas para as quais é necessário verificar os dados existentes através de novas transferências: a) Peste suína clássica. Categoria 3 - Doenças ou agentes de doenças para as quais os resultados preliminares indicam que o risco de transmissão é insignificante, desde que os embriões sejam corretamente manipulados, entre a coleta e a transferência, mas para os quais essas verificações preliminares devem ser corroboradas por dados experimentais complementares "in vitro" e "in vivo": a) Peste bovina. b) Diarreia viral bovina. c) Língua azul (ovinos). d) Febre aftosa (suínos, ovelhas e cabras). e) Campylobacter fetus (ovinos). f) Doença vesicular do porco. g) Peste suína africana. h) Prurido lombar (ovinos). i) Haemophilus somnus. Categoria 4 - Doenças ou agentes de doenças que foram ou são objeto de trabalhos preliminares: a) Vírus Akabane (bovino). b) Estomatite vesicular (bovinos e suínos). c) Chlamydia psittaci (bovinos e suínos). d) Ureaplasma/micoplasmose (bovinos e caprinos). e) Maedi-visna (ovino). f) Adenomatosa pulmonar (ovino). g) Prurido lombar (caprinos). h) Língua azul (caprinos). i) Artrite e encefalite caprina. j) Parvovírus (suíno). k) Enterovírus (bovinos e suínos). I) Leptospirose (suíno). m) Herpesvírus 4 dos bovinos. n) Mycobacterium paratuberculose (bovinos). o) brucelose ovina. p) Doença de Border (ovinos). q) Vírus parainfluenza 3 (bovinos). r) Agente da encefalopatia espongiforme bovina. É interessante salientar que apenas seis doenças estão incluídas na categoria 1 (a mais segura). Isso não significa que as outras doenças tenham um risco maior, apenas indica que o risco de transmissão das doenças da categoria 1 é irrelevante, estatisticamente falando. É importante assinalar que as doenças mais importantes dos bovinos se situam na categoria 1. Isto significa que a incidência do embrião patogênico nos bovinos parece ser perfeitamente controlável, desde que sejam adotadas metodologias adequadas. Isto serve também como linha de defesa adicional para que o técnico centre sua atenção e cuidados entre a fase de obtenção e a de transferência. 7. SITUAÇÃO ATUAL DA TRANSFERÊNCIA DE EMBRIÕES ANIMAIS NO BRASIL O Brasil é um dos grandes responsáveis mundiais pela implantação da tecnologia na reprodução animal, sendo assim, o país conseguiu inserir-se no mercado internacional como um dos maiores produtores de embriões in vivo e in vitro. Nas últimas duas décadas, especialmente entre os anos de 1997 e 2017 o país passou por importantes transformações nesse segmento, dentre essas transformações vale destacar a posição relativa do Brasil no contexto mundial. O Brasil passou de referência regional, nos anos 1990, para se tornar o maior produtor mundial de embriões entre os anos 2012 e 2013, sendo líder no uso e na produção de embriões in vitro. Os primeiros registros da TE produzidos in vivo no Brasil datam da década de 1980, e uma década depois o país já tornara-se referência e detinha um mercado consolidado de produção e TE na espécie bovina. Não obstante, no ano de 1997 o país ainda era referência apenas no contexto regional, detendo 68,3% dos embriões transferidos na América Latina, esse percentual corresponde a 24.085 embriões de um total de 35.254 produzidos na América Latina. Esse percentual regional representa apenas 6,6% de toda a produção mundial de embriões in vivo, que produziu, em 1997, 360.656 embriões in vivo. Nos últimos anos, o mercado de embriões, principalmente o bovino, teve retração moderada de -2,5% ao ano entre 2003 e 2018, porém essa retração contrasta com o ligeiro crescimento observado a partir dos anos 2000 conforme figura 1: Figura 1: Produção de embriões bovinos no Brasil no período 1996-2018, total e por tecnologia adotada (in vivo[IVD] ou in vitro [IVP]). Em 2018, o mercado de embriões bovinos manteve-se inalterado se compararmos com os três anos anteriores, houve reduções nós segmentos de corte, leite e no total comparado ao ano de 2017. Em 2014, a produção de embriões para melhoramento do gado leiteiro teve seu ápice, porém de lá para cá esse mercado manteve-se estagnado como demonstra a tabela 2. Tabela 2: Produção de embriões bovinos no Brasil em 2018, estratificada por segmento e por tecnologia adotada (in vivo ou in vitro). 7.1 Crise, economia e mercado de embriões A indústria de embriões reflete, em maior ou menor grau, o momento da economia brasileira. Apesar do segmento agropecuário ser um setor em constante crescimento no país, ao qual, sem dúvidas, em meio a inúmeras crises mantém-se em constante crescimento. Porém vale ressaltar que esse mercado é emergente e está refletido em paralelo com os bens produzidos pelo país, como demonstra a figura 2. Figura 2: Produção de embriões bovinos e variação no produto interno bruto (PIB) no Brasil, no período 1996-2018. Cada vez mais o setor agropecuário do Brasil investe em novas tecnologias que maximizem o mercado e que melhore a produção dos animais seja no segmento corte ou leite. Segundo a OCDE, 1997, essa indústria da produção de embriões é um conjunto de novas técnicas e processos, frutos do desenvolvimento técnico-científico, que chega ao mercado e - o mais importante - o transforma. Logo, todas essas técnicas e biotecnologias visam, além da alta produção e do lucro, o melhoramento e a suplementação alimentícia da população mundial que está em crescente avanço. A evolução da tecnologia embrionária no país, seja para o melhoramento dos equinos para os esportes como as vaquejadas, hipismo, corridas, etc., onde são investidos tempo, dedicação e dinheiro para formar um novo animal que apresente força, conformação, conversão alimentar e que custa milhões, em muitos casos, não só dos equinos, mas também dos caprinos, ovinos, suínos e até mesmo os bovinos onde o mercado da TE é mais presente e aquecida, venceu os estigmas do “modismo” e o chamado “elitismo”, porém deve enfrentar novos desafios, em especial num contexto de forte concentração do mercado de genética e de concorrência globalizada. Mesmo com todos esses avanços e retrocessos, essa relativização dos números demonstra que um percentual bastante reduzido das fêmeas bovinas que estão em idade reprodutiva é utilizado para a técnica da transferência de embriões, e que o mercado brasileiro ainda tem um grande potencial de crescimento no setor de produção in vivo e in vitro. 8. RESUMO E PRIMEIRAS CONCLUSÕES Ao longo deste trabalho pretendi realizar uma revisão sumária sobre um tema de grande importância presente, e sobretudo futura; referir-me à transferência embrionária. Atualmente, esta técnica atingiu um grau notável de penetração, a nível prático, no gado leiteiro. No entanto, num futuro mais ou menos longínquo, não temos dúvidas quanto a esta técnica, pelas vantagens indubitáveis que apresenta a nível de avanço genético, que será aplicada em outras espécies úteis ao homem. Na minha exposição, tentei dar especial ênfase a dois aspectos: as técnicas de transferência, incluindo as normas IETS e os controles sanitários a serem efetuados. Summary This paper examines contemporary virtue ethics and the claim that Christian ethics is a virtue ethic. Three central theses are identified as being central to virtue ethics: a priority thesis, a perfectionist thesis and a communitarian thesis. It is argued that defences of the priority thesis—it best addresses the moral crisis in our society, it does justice to historical consciousness and it remedies the incompleteness in deontic ethics—are unconvincing. It is argued that virtue and moral perfection are best understood (...) in terms of psychologically appropriate dispositions to act in accordance with moral principles. It is further argued that the communitarian thesis raises relativist difficulties and fails to do justice to the universal elements of morality. Each of these arguments is developed philosophically and the implications for Christian ethics are explored. In light of the theory of virtue sketched in the paper it is concluded that the independence thesis, upon which virtue ethics rests, is untenable and that an examination of the structure of the universal moral principles underlying the Christian faith remains the proper subject matter for Christian ethics. Abstract: In Vacco v. Quill, 521 U.S. 793 (1997), the Supreme Court for the first time in American case law explicitly applied the principle of double effect to reject an equal protection claim to physician-assisted suicide. Double effect, traced historically to Thomas Aquinas, proposes that under certain circumstances it is permissible unintentionally to cause foreseen evil effects that would not be permissible to cause intentionally. The court rejected the constitutional claim on the basis of a distinction marked out by the (...) principle, i.e., between directly intending the death of a terminally ill patient as opposed to merely foreseeing that death as a consequence of medical treatment. The Court held that the distinction comports with fundamental legal principles of causation and intent. Id. at 802. -/- Critics allege that the principle itself is intrinsically flawed and that, in any event, its employment in Vacco is without legal precedent. I argue in response to contemporary objections that double effect is a valid principle of ethical reflection (Part II); claims to the contrary notwithstanding, double effect analysis is a pervasive, albeit generally unacknowledged principle employed regularly in American case law (Part III); and drawing on the preceding two sections, Vacco's application of the principle of double effect is appropriate (Part IV). -/- My conclusion is that [o]peration of some form of the principle, by whatever name, is inevitable. In an imperfect world where duties and interests collide, the possibility of choices of action foreseen to have both good and evil consequences cannot be avoided. In rare circumstances, ethics and the law require that a person refrain from acting altogether. More often, however, they provide that a determination of whether an actor may pursue a good effect although knowing it will or may unintentionally cause an harmful effect requires a more complex analysis - a double effect analysis. -/- Keywords: Equal protection, double effect, intention, physician-assisted suicide, Constitutional Law, Bioethics.
