In this paper I argue that textualism is far less attractive as a theory of written law than some of its modern proponents think. For it is not usually sensible to expect the grammatical meaning of a provision to determine its appropriate legal meaning. This study examined the relationship between psychopathy and two components of empathy including a cognitive component (e.g., perspective-taking ability) and an affective component (e.g., compassion) in a community sample. The Psychopathic Personality Inventory Short Form was used to assess psychopathy and several psychological measures were used to test empathy including the Interpersonal Reactivity Index, the Diagnostic Analysis of Nonverbal Accuracy-2, and the Test of Self Conscious Affect -3. Across instruments, psychopathy (as a unitary construct) appeared to be negligibly correlated with (...) perspective-taking scales and negatively correlated with the affective components of empathy. Findings indicated that the emotional deficits were noted most prominently for the behavioral component of psychopathy. Results also showed that higher psychopathy scores in community participants were linked to higher levels of antisocial conduct. (shrink)

I shall argue that you can substantially refute the most persuasive variety of solipsism by taking its most plausible version seriously, and then showing that it is not rational to hold, once one understands the nature of actualist metaphysical commitments.1 In the first section, I argue that the only viable form of solipsism involves de dicto self-reference. In the second, I argue that this position involves a claim of contingent identity, for which some actual worlds are those where solipsism is (...) not the case. What is a fake artwork? This is seldom asked in aesthetics even though judging an artwork as excellent or original implicitly posits criteria for fraudulent or dubious artworks as well. This article presents Nelson Goodman’s proposal of how we are to understand fakes. It will criticize his predominantly cognitive approach for failure of incorporating a sense of aesthetic value, thereby leaving the possibility of artworks which are fakes but nevertheless originals unexplained. This paper reviews the central points and presents some recent developments of the epistemic approach to paraconsistency in terms of the preservation of evidence. Two formal systems are surveyed, the basic logic of evidence (BLE) and the logic of evidence and truth (LET J ), designed to deal, respectively, with evidence and with evidence and truth. While BLE is equivalent to Nelson’s logic N4, it has been conceived for a different purpose. Adequate valuation semantics that provide decidability are given (...) for both BLE and LET J . The meanings of the connectives of BLE and LET J , from the point of view of preservation of evidence, is explained with the aid of an inferential semantics. A formalization of the notion of evidence for BLE as proposed by M. Fitting is also reviewed here. As a novel result, the paper shows that LET J is semantically characterized through the so-called Fidel structures. Some opportunities for further research are also discussed. (shrink)

Nelson's Proof of the Impossibility of the Theory of Knowledge -/- In addressing the possibility of a theory of knowledge, Leonard Nelson noted the contradiction of an epistemological criterion that one would require in order to differentiate between valid and invalid knowledge. Nelson concluded that the inconsistency of such a criterion proves the impossibility of the theory of knowledge. -/- Had the epistemological criterion had a perception, then it would presume to adjudicate on its own truth (thus (...) epistemological circular argument). However, if one were to assume that the criterion is not knowledge, one would then have to justify how this is a criterion for truth - yet this would only be possible when it may be considered as an object of knowledge. One would equally have had to predetermine the criterion in order to determine the truth of this knowledge, thereby providing another circular argument. Ostensibly, every criterion of truth fails at its very own test since it cannot guarantee its own truth, just as Munchausen, contrary to his assertion, could not draw himself out of the swamp by tugging on a tuft of his own hair. -/- Nelson proposed a solution of the epistemological problem (the question of the differentiation between valid and invalid knowledge), that based on Jakob Friedrich Fries' differentiation between proof and deduction. Proof, according to Nelson (in reference to Fries), can be defined as derivation of truth from one statement from another statement. Thus, from the truth in the statement that "all men are mortal", one is then able to say that "Socrates is a man" and thence extrapolate from the truth of the statement that "Socrates is mortal." If knowledge were to be considered somewhat judgmental (in a statement), then an attempt at proof (i.e. recourse to previous judgments) would inevitably lead to an infinite regression in justification, since each judgment would necessitate a further justification from another judgment. Every attempt to prove an epistemological criterion is thus also confronted by this regression in justification. -/- Nelson's attempt at a solution rests on the assumption of the existence of an immediate knowledge as a justification of the truth (mediate) of knowledge. Nelson considers immediate knowledge to be non-judgmental knowledge. These include intuitions (e. g. seeing-the-red-roof) and also philosophical knowledge that pre-exists in his opinion before a judgmental reflexion (immediate) in our reason (e. g. the principle of causality). -/- Proof of the truth of mediate knowledge can be effected by showing its compliance with attendant immediate knowledge (rational truth = correspondence of mediate knowledge with their immediate knowledge). Nelson considered this as a resolution of the circular epistemological argument. In regard to philosophical knowledge, Nelson sees these as subject to deduction and not proof. Dadurch erhielt er Anregungen, die von Anfang an seine philosophischen Ansätze beeinflussten. Inspiriert von der Kant-Fries’schen Philosophie und der Axiomatik der Mathematik, konzipierte Nelson seine Philosophie als exakte Wissenschaft. Wie Kant und Fries betrachtete Nelson die Suche nach den allgemeinen Prinzipien der Naturwissenschaften als Hauptaufgabe der Naturphilosophie. Ergebnis dieser kritischen Analyse ist ein System von metaphysischen Grundsätzen (...) der Naturwissenschaft. Nelson übernimmt Kants Lehre von den Grundsätzen des reinen Verstandes. Keine empirisch gefundene Gesetzmäßigkeit könne diesen Grundsätzen widersprechen. Für die Gesetze der Newton’schen Mechanik hätten, so meint Nelson, Kant und Fries diesen Nachweis erbracht. Deshalb formulierte Nelson das sogenannte Postulat der Mechanistik, gemäß dem alle Naturerscheinungen auf mechanische Vorgänge zurückgeführt werden können. Das starre Festhalten an diesem Postulat veranlasste ihn zur Ablehnung bedeutsamer physikalischer Konzeptionen (z. B. des auf der Elektrodynamik basierenden Relativitätsprinzips, des Nahwirkungskonzepts und des Atommodells). Das „Relativitätsprinzip der Elektrodynamik“ lehnte er mit dem Argument ab, es verhindere die Anwendung der dritten Analogie der Erfahrung, da es den Verzicht auf den Begriff der Gleichzeitigkeit von Naturerscheinungen erzwinge. Eine kritische Nelson-Rezeption muss der Historizität etlicher Thesen Nelsons Rechnung tragen, aber zugleich die Bedeutsamkeit von Kernaussagen Nelson’scher Naturphilosophie im Hinblick auf die modernen Naturwissenschaften untersuchen. Das ist auch die Zielrichtung des vorliegenden Beitrages. Der erste Teil beleuchtet Nelsons wissenschaftliches Umfeld. Daoism and Environmental Philosophy explores ethics and the philosophy of nature in the Daodejing, the Zhuangzi, and related texts to elucidate their potential significance in our contemporary environmental crisis. Psychiatry has witnessed a new wave of approaches to clinical phenotyping and the study of psychopathology, including the National Institute of Mental Health’s Research Domain Criteria, clinical staging, network approaches, the Hierarchical Taxonomy of Psychopathology, and the general psychopathology factor, as well as a revival of interest in phenomenological psychopathology. The question naturally emerges as to what the relationship between these new approaches is – are they mutually exclusive, competing approaches, or can they be integrated in some way and used (...) to enrich each other? In this opinion piece, we propose a possible integration between clinical staging and phenomenological psychopathology. Domains identified in phenomenological psychopathology, such as selfhood, embodiment, affectivity, etc., can be overlaid on clinical stages in order to enrich and deepen the phenotypes captured in clinical staging (‘high resolution’ clinical phenotypes). This approach may be useful both ideographically and nomothetically, in that it could complement diagnosis, enrich clinical formulation, and inform treatment of individual patients, as well as help guide aetiological, prediction, and treatment research. The overlaying of phenomenological domains on clinical stages may require that these domains are reformulated in dimensional rather than categorial terms. This integrative project requires assessment tools, some of which are already available, that are sensitive and thorough enough to pick up on the range of relevant psychopathology. The proposed approach offers opportunities for mutual enrichment: clinical staging may be enriched by introducing greater depth to phenotypes; phenomenological psychopathology may be enriched by introducing stages of severity and disorder progression to phenomenological analysis. This contribution unfolds an existential-ontological response to the question of sexual difference in the context of Heidegger’s formally indicative concept of “Dasein.” The question of Dasein’s “neutrality” concerns how formal indication formalizes, empties, and neutralizes the givenness of factical human existence. Ostensibly “given” biological and anthropological facts, such as sexual difference, are interpreted from an emptied and neutralized perspective that appears abstract and fictional to Heidegger’s critics. How, then, is the “neutrality” of formalizing emptying related to the “facticity” of in (...) each case factically existing as a sexual and gendered being? The answer lies in Heidegger’s elucidation of the existential-ontological structure of Dasein: Dasein is always relationally instituted in its factical entangled life through “being-with.” The sexual difference of human existence is not merely biologically or anthropologically given, but disclosed and enacted according to one’s relations with others, the environment, and oneself. The formally indicating concept “Dasein” indicates, accordingly, the concrete diversity and plurality of individuated sexual and gendered ways of being. (shrink)

There at least three ways of thinking about rationality: instrumental, substantive, and intentional. By far, the instrumental account is most influential. This essay proposes that intentional rationality can provide substantive accounts with room to breathe, and in a way that is facially distinct from instrumental accounts. I suggest that the intentionality of a judgment is made up of what it is about and the orientation through which it is judged, while irrationality is the subversion of a strict supporting connection between (...) the judgment and its corresponding set of coordinated attitudes (reasons). It follows that irrational intentionality is made up of episodic states where a judgment is subverted because of a misalignment between what it is about and the way the judge is oriented towards its contents. Four examples of irrational intentionality are considered: passivity towards ends, constitutive ignorance towards facts, delirious paranoia towards objects, and a disjunctive orientation towards categorizations. The contribution examines Goodman’s conception of philosophy, in particular his remark that his project can be understood as a «critique of worldmaking». It is argued that, despite dealing with epistemological questions, the general theory of symbols and worldmaking does not answer them. Rather, it can be conceived as a practical conception comparable to Kant’s critique of reason or to Wittgenstein’s critique of language games, i. e. , as a philosophy of world orientation. It is claimed that Goodman himself could not (...) articulate this dimension of his position appropriately as he kept using the language of epistemology. Prudential hedonism is a school of thought in the philosophy of welfare that says that only pleasure is good for us in itself and only pain is bad for us in itself. This dissertation concerns an especially austere form of prudential hedonism: basic prudential hedonism (BPH). BPH claims that all pleasure is good for us in itself, and all pain is bad for us in itself, without exception; that all pleasures feel fundamentally alike, as do all pains; and that the (...) amount of welfare in a person’s life can (in principle) be calculated just by adding up the amount of pleasure it contains and subtracting the amount of pain. The dissertation presents a positive argument for the claim that pleasures and pains are defined by common phenomenal properties, defends BPH against a battery of objections, and outlines an argument for accepting BPH on the grounds that it is simpler than competing views. What did Heidegger learn and fail to learn from Laozi and Zhuangzi? This book reconstructs Heidegger's philosophy through its engagement with Daoist and Asian philosophy and offers a Daoist transformation of Heidegger on things, nothingness, and freedom.

In Fact, Fiction and Forecast, Nelson Goodman claims that the problem of justifying induction is not something over and above the problem of describing valid induction. Such claim, besides suggesting his commitment to the collapse of the distinction between the context of description and the context of justification, seems to open the possibility that the new riddle of induction could be addressed empirically. Discoveries about psychological preferences for projecting certain classes of objects could function as a criterion for determining (...) which predicates are after all projectible. In this paper, I argue that Goodman's claim must be construed within his project for constructional definitions, which is methodologically oriented by reflective equilibrium. The description of inductive practice is committed to the articulation of the extension of the class selected by the predicate ‘valid induction’. The mutual adjustment between theoretical considerations and inductive practice involved in the proposal of a definition of ‘valid induction’ must preserve that practice as much as possible, there is no way to get rid of entrenchment. Empirical discoveries about the psychological mechanism that underlies projections may help that adjustment but they cannot substitute the role played by the entrenchment of predicates. (shrink)

This paper focuses on how building human potentialities in education can enhance learning competencies in students for the development of the self and the society. Human potential refers to a possibility human beings are capable of achieving. Montessori believes that the traditional system of education directs students to learn through memorization and recitation techniques and does not lay much emphasis on helping students to bring out their maximum potential. What goal can we attribute to education today? Our focus shall be (...) to answer the questions, what are the favorable conditions under which education can help to build human potentialities? Is Montessori’s view essential in enhancing creativity and building the necessary competencies of the learners in our society today? Education is a natural process carried out by the human individual. It is not what the teacher gives and is not acquired by listening to words but by experiences upon the environment. Montessori opts that education should help the learners develop confidence in their emerging abilities and offer them the opportunity to gain independence in daily tasks. The pedagogic significance of this work serves as a guide for the educational system in Africa and Cameroon in particular. It serves as a guide for curriculum developers and policy makers to bring out programs that will enhance the building of individual competencies for eventual development. Central to this chapter is a basic philosophical concept of the nature of modern science which exists amongst positivists, like Auguste Comte, who rejects as illegitimate all that cannot be directly observed in the investigation and study of any subject. Our daily experience of the nature of science continues to give us reasons to unlearn what can be considered as prejudices and errors in our conception of the nature of science. Consequently, the question "what is the nature of modern science?" (...) still perplexes us, and the answers we provide to this question often reveal how distorted our vision of history and thought has become over the years. This chapter shall, via the method of critical analysis in philosophy pass through Comte's three stages of arriving at the truth. This approach rejects as non-scientific all that cannot be directly observed in the investigation and study of any subject against Whitehead's approach in which he tries to make a “dispassionate consideration of the nature of things, antecedently to any special investigation into their details”. This is a standpoint Whitehead terms “metaphysical.” This explains why he developed a comprehensive metaphysical system for the understanding of science, society, and self as found in his major texts. In this light, science cannot be done without taking metaphysics into account. (shrink)

The purpose of this essay is to look at whether Aquinas teaches in De veritate [DV], q. 1, a. 4, that truth is a form inherent in things. I take up this investigation because I am examining Lawrence Dewan's account of Aquinas's teaching on truth.1 On Dewan's account, a significant development occurs in Aquinas's teaching as regards truth as it is found in things. Before the Summa theologiae [ST], Aquinas thought that in addition to truth being in the intellect, it (...) was also in things. In ST, most explicitly in I, q. 16, a. 6, Aquinas no longer thinks that it is in things, but only in the mind. When Dewan says that before the ST truth is "in things" and in the ST it is not "in things," in both cases, by "in things," Dewan means "as a form inherent in things." The behavior/structure methodological dichotomy as locus of scientific inquiry is closely related to the issue of modeling and theory change in scientific explanation. Given that the traditional tension between structure and behavior in scientific modeling is likely here to stay, considering the relevant precedents in the history of ideas could help us better understand this theoretical struggle. This better understanding might open up unforeseen possibilities and new instantiations, particularly in what concerns the proposed technological modification of the human condition. The (...) sequential structure of this paper is twofold. The contribution of three philosophers better known in the humanities than in the study of science proper are laid out. The key theoretical notions interweaving the whole narrative are those of mechanization, constructability and simulation. They shall provide the conceptual bridge between these classical thinkers and the following section. Here, a panoramic view of three significant experimental approaches in contemporary scientific research is displayed, suggesting that their undisclosed ontological premises have deep roots in the Western tradition of the humanities. This ontological lock between core humanist ideals and late research in biology and nanoscience is ultimately suggested as responsible for pervasively altering what is canonically understood as “human”. Humes Anmerkungen zu diesem Thema scheinen mir eine reichhaltige Mischung aus Einsichten und Irrtümern zu enthalten. Mein Ziel in diesem Aufsatz besteht darin, diese entgegengesetzten Elemente seiner Diskussion zu entwirren.

Against the separation of metaphysics and science advocated for by Plato and his followers and against the rejection of metaphysics in favour of science the Logical Positivists, this work argues that 'a new link' between metaphysics and science is all the more necessary for man to better understand nature. This is precisely what Whitehead's process metaphysics purports to do. But why is 'a new link' necessary It is necessary because Aristotle and his followers already established a link 'an old link' (...) by making metaphysics the foundation of all the sciences. Yet, Aristotelian metaphysics is a substance based metaphysics while Whitehead's metaphysics takes process and especially the category of relation seriously. Whitehead's Process metaphysics prioritizes process over permanence, becoming over being, relation over substance. Why does Whitehead have such preference for process metaphysics over classical metaphysics The answer, as shall be shown in this paper, lies in science with the demise of Newtonian science and the rise of Einsteinian science based on the theory of relativity. In an era when the concept of depassement de la metaphysique has become such a dominant feature of modern and postmodern thought, it is therefore our point of interest to find out why Whitehead who situates himself within this period takes up metaphysics as the foundation of his philosophizing Why does Whitehead embark on reconciling science and metaphysics when all his contemporaries are dissociating themselves from the former These questions will be the main concern of my research in this paper. Markets sit in places and knowledge produced in these places also constitute the very foundation of markets’ viability and market actors’ performative competitive edge. However, not all markets are created equal primarily in the context of their importance in the global economy. Thus conceived, we imagine a world economy or markets populated by people in front of wide computer screens making sense of financial algorithms and derivatives. In a way, here, we see a market that is run by codified knowledge, (...) or scientific knowledge that transcends boundaries. But what about a conception of market that recognizes the production of knowledge in the periphery, and this instance, fish markets, where place-based knowledge marks the contours of engagement of fishmongers to their wider world and yet, concomitantly, also underscores their attachment to place? In this article, in an ethnographic study of four fish markets in a small coastal town in southern Philippine, fishmongers engage with market processes via their production and deployment of vernacular knowledge which is performed in the form of public specialized knowledge, tacit knowledge and network knowledge. In these forms of vernacular knowledge, we become cognizant of the complexities of market processes even in places that are relegated to the margins, where knowledge plays a crucial role in sensing the world and making it lived and real. With increased visibility of trans people comes increased philosophical interest in gendered language. This chapter aims to look at the research on gendered language in analytic philosophy of language so far, which has focused on two concerns: (1) determining how to define gender terms like ‘man’ and ‘woman’ such that they are trans inclusive and (2) if, or to what extent, we should use gendered language at all. We argue that the literature has focused too heavily on how gendered language (...) can harm trans people, and has not considered how trans people use gendered language to create meaning and joy for ourselves. Pulling from the literature in sociolinguistics, we look at examples of how trans people use language to make their lives better by gaining recognition, playing with gendered language, finding joy in gendered language, and taking control of definitional power, concluding that debates about gendered language need to consider not only how such language harms trans people but also how trans people use it for our own liberation. Based on Maldonado-Torres’s formulation of the term, we conceive the decolonial turn as a form of liberating and decolonising reason beyond the liberal and Enlightened emancipation of rationality, and beyond the more radical Euro-critiques that have failed to consistently challenge the legacies of Eurocentrism and white male heteronormativity (often Eurocentric critiques of Eurocentrism). We complement Maldonado-Torres’s account of the decolonial turn in philosophy, theory and critique by providing an analysis of the trajectories of academic philosophy and clarifying the relevance of (...) decolonising philosophy and of the decolonial turn for current efforts in transforming philosophy in face of the challenges of social movements such as the Third World Liberation Front and Black Lives Matter in the United States, and Rhodes Must Fall in South Africa and England. After a brief analysis of the trajectory and current status of philosophy as a discipline in the modern Western research university, we provide examples of the decolonial turn and of decolonising philosophy in three areas: the engagement with (1) Asian and (2) Latin American philosophies, and (3) debates in the philosophy of race and gender. Um argumento esquecido em um verdadeiro arsenal de guerra que Espinosa se dedicou a reunir contra o que considerava um dos maiores, senão o maior, empecilho para que os homens alcançassem a verdadeira felicidade, a saber, o falso conceito que possuem da liberdade humana quando a tomam por uma liberdade de arbítrio, contrária a toda e qualquer necessidade. Argumento forjado, certamente, com boa dose de ironia e ânimo polemista contra um objetor que se diz defensor do cartesianismo, e, portanto, em (...) certa medida contra Descartes. Apresentar um argumento que envolva a referência a situações oníricas contra a concepção cartesiana de liberdade como poder dos contrários é, certamente, pretender fazer o feitiço virar contra o feiticeiro. No entanto, para além desse encanto particular e quase anedótico, creio que esse argumento contribui com um bom ponto à inesgotável discussão sobre a natureza da liberdade, debate caro às inquietações filosóficas do nosso querido amigo. Ponto para cuja elucidação espero poder contar com sua ajuda, pois, como se poderá ver na sequência, minha compreensão do argumento é ainda bastante preliminar. Duas traduções porque as cartas onde esse argumento muito provavelmente surgiu pela primeira vez não contam ainda, até onde eu saiba, com uma tradução para a língua portuguesa que permita um acesso mais fácil ao pensamento do filósofo. Shedding light on the political power and oppressive potential of language, theories of illocutionary silencing and discursive injustice show how gender, class and race can shape the pragmatics of speech, limiting in some circumstances the speaker’s ability to do things with her words. This article takes a close look at discursive injustice in trials for gender-based violence in connection with the phenomenon of misogyny. It argues that in the courtroom the testimony of the complainant is sometimes silenced by a sexist (...) ideology used in service of misogynistic ends. In particular, it argues that sexist social meanings can sometimes be enacted by the judge and accommodated by prosecutors, figuring as a component of the score in the language game of the trial and thus 1) determining what counts as sexual violence and 2) preventing complainants from making the moves they intend to make.
