In this paper I argue that, in addition to having an obligation to resist the oppression of others, people have an obligation to themselves to resist their own oppression. This obligation to oneself, I argue, is grounded in a Kantian duty of self-respect.

The extended mind hypothesis (EMH) has been a major focus of debate since its publication in 1998, prompting interest from proponents and exponents alike. At the heart of the paper is the aim of understanding mental phenomena, specifically, what constitutes a mental state. To fully understand EMH it is crucial to appreciate the distinction between our mental states. Firstly, we have mental states that derive from our experiences, these are considered conscious states. They contain feelings or emotions, for example, falling (...) in love, having a pain or being moved by a piece of music. This type of mental state has the feature of phenomenology, a particular character or quality, for example, there is something it is like to see a red apple. Secondly, there are non-conscious mental states that occur without our knowledge of them or indeed we perform actions without consciously thinking about it. These types of mental states possess intentionality meaning that they are about something, for example, I believe that Oswald shot Kennedy or that I am scared of the dark. It is with this clear distinction between conscious and unconscious mental states defined that we can begin to understand the argument presented by Clark and Chalmers. (shrink)

Recently, there has been a concerted effort to shift bioethics’ traditional focus from clinical and research settings to more robustly engage with issues of justice and health equity. This broader bioethics agenda seeks to embed health related issues in wider institutional and cultural contexts and to help develop fair policies. In this paper, we argue that bioethicists who ascribe to the broader bioethics’ agenda could gain valuable insights from the interdisciplinary field of environmental justice and transportation justice, in particular. We (...) then proceed to demonstrate the importance of adopting an intersectional approach to transportation and health. The paper concludes with the argument that intersectional gender inequality is of particular importance when studying both health equity and the unequal distribution of burdens associated with transportation systems in local contexts. This essay is meant to be the beginning of a robust conversation concerning health equity, transportation justice, and intersectional distributions of both benefits and burdens. (shrink)

A growing literature has recognized the importance of mental simulation (e.g., imagining alternatives to reality) in sparking creativity. In this chapter, we examine how counterfactual thinking, or imagining alternatives to past outcomes, affects group creativity. We explore these effects by articulating a model that considers the influence of counterfactual thinking on both the cognitive and social processes known to impact group creative performance. With this framework, we aim to stimulate research on group creativity from a counterfactual perspective.

This study investigates the significant relationship between procrastination and academic burnout among first-year college students. Employing correlational design and standardized tests, the statistical analysis reveals that the r coefficient of 0.33 indicates a low positive correlation between the variables. The p-value of 0.00, which is less than 0.05, leads to the decision to reject the null hypothesis. Hence, a significant relationship exists between procrastination and academic burnout among college students.

With the increasing degrees A.I.s and machines are applied across different social contexts, the need for implementing ethics in A.I.s is pressing. In this paper, we argue for a pluralist hybrid model for the implementation of moral A.I.s. We first survey current approaches to moral A.I.s and their inherent limitations. Then we propose the pluralist hybrid approach and show how these limitations of moral A.I.s can be partly alleviated by the pluralist hybrid approach. The core ethical decision-making capacity of an (...) A.I. based on the pluralist hybrid approach consists of two systems. The first is a deterministic algorithm system that incorporates different moral rules for making explicit moral decisions. The second is a machine learning system that calculates the value of the variables required by the application of moral principles. The pluralist hybrid system is better than the existing proposals as (i) it better addresses the moral disagreement problem of the top-down approach by including different moral principles, while (ii) it reduces the opacity of ethical decision-making compared with a bottom-up system by implementing explicit moral principles for moral decision making. We critically review qualitative research studies conducted from 2000 to 2012 exploring Western mothers’ breastfeeding experiences. We used the search criteria “breastfeeding,” “qualitative,” and “experiences” to retrieve 74 qualitative research studies, which were reduced to 28 when the terms “existential’’ and “research’’ were applied. We found that the impact of technology and the pervasive worldwide marketing of infant formula devalued breastfeeding mothers’ narratives in a number of ways. Women’s bodies were viewed as machine-like objects and the breast was seen as (...) a disembodied object. Dominated by technological narrative, women’s bodies were considered unpredictable and hormonal, needing to be managed by health care professionals. This means the disseminating breastfeeding discourse needs to be reinterpreted for practical use. We found that some of the researchers utilized narrative informed by phenomenological philosophy that appears to edge closer to understanding mothers’ experiences in a more profound way than nonphenomenological research. However, we need to be mindful of the transparency of terms in replacing one form of technological narrative with another. (shrink)

This paper considers why obtaining and sustaining a good sexual life tends to be so challenging and why the temptation to settle for a bad one can be so alluring. We engage these questions by cultivating ideas found in the traditions of feminist philosophy and the philosophy of sex and love in dialogue with the works of two unlikely, canonical bedfellows—Immanuel Kant and Hannah Arendt. We propose that some sources of these challenges and temptations are patterned and manifold in that (...) they involve trying to transform, develop, integrate certain unruly emotional structures in oneself, including together with others. Other equally patterned and unruly sources track inherited oppressive or oppressed behaviors and feelings that make emotionally healthy, morally responsible realizations of sexual ways and being more difficult for all parties involved. In contrast to these patterned challenges, some difficulties that face us stem from the fact that humans are genuinely different from one another and evolving—individually, jointly, and collectively—in their sexual needs and wants. This paper is an attempt to identify certain consonances between contemporary liberalism and classical pragmatism. I identify four of the most trenchant criticisms of classical liberalism presented by pragmatist figures such as James, Peirce, Dewey, Addams, and Hocking: that liberalism overemphasizes negative liberty, that it is overly individualistic, that its pluralism is suspect, that it is overly abstract. I then argue that these deficits of liberalism in its historical incarnations are being addressed by contemporary liberals. Contemporary liberals, I show, have (...) taken on board a surprising number of classical pragmatist insights and have responded to a surprising number of classical pragmatist criticisms. I thus argue that both contemporary pragmatism and contemporary liberalism have much to gain by joining forces. (shrink)

: In this essay, I consider the question of whether women have an obligation to confront men who sexually harass them. A reluctance to be guilty of blaming the victims of harassment, coupled with other normative considerations that tell in favor of the unfairness of this sort of obligation, might make us think that women never have an obligation to confront their harassers. But I argue that women do have this obligation, and it is not overridden by many of the (...) considerations that can override other obligations to confront wrongdoers. (shrink)

In this paper I consider the possibility that failing to fulfill the Kantian obligation to protect one’s rational nature might actually vitiate future instances of this obligation. I respond to this dilemma by defending a novel interpretation of Kant’s views on the relation between the value we have and the respect we are owed. I argue, contra the received view among Kant scholars, that the feature in virtue of which someone has unconditional and incomparable value is not the same feature (...) in virtue of which she is owed the respect that constrains how she may be treated. So, even though someone who fails to attempt to protect her rational nature fails to respect herself in the right way, and even though this moral failing does make her lose a certain kind of value, her obligations to respect herself do not go away. The Situationist International (1957-1972) was a small group of communist revolutionaries, originally organised out of the West European artistic avant-garde of the 1950s. The focus of my thesis is to explain how the Situationist International (SI) became a group able to exert a considerable influence on the ultra-left criticism that emerged during and in the wake of the May movement in France in 1968. My wager is that the pivotal period of the group is to be found between 1960 and (...) 1963, a period marked by the split of 1962. Often this is described as the transition of the group from being more concerned with art to being more concerned with politics, but as I will argue this definitional shorthand elides the significance of the Situationist critique of art, philosophy and politics. The two axes of my thesis are as follows. First, that the significant minority in the group which carried out the break of 1962, identified a homology between the earlier Situationist critique of art — embodied in the Situationist ‘hypothesis of the construction of situations’ — and Marx’s critique and supersession of the radical milieu of philosophy from which he emerged in the mid- 1840s. This homology was summarised in the expression of the Situationist project as the ‘supersession of art’ (dépassement de l’art). Secondly, this homology was practically embodied in the resolution of the debates over the role of art in the elaboration of the Situationist hypothesis, which had been ongoing since 1957. However, it was the SI’s encounter with the ultra-left group Socialisme ou Barbarie that would prove decisive. Via Guy Debord’s membership, the group was exposed to both the idea of a more general revolutionary criticism, but also ultimately what was identified as the insufficiently criticised ‘political militancy’ of this group. Indeed, in the ‘political alienation’ found in Socialisme ou Barbarie, a further homology was established between the alienation of the political and artistic avant-gardes. This identity would prove crucial to the further elaboration of the concept of ‘spectacle’. By way of an examination of the peculiar and enigmatic ‘Hamburg Theses’ of 1961, and the relationship between these ‘Theses’ and the Situationist criticism of art and politics worked out over the first five years of the group, I will argue that the break in 1962 should be conceived as one against politics as much as art (rather than just the latter, as it is more often represented). Additionally, I will outline how the SI, through the paradoxical reassertion of their artistic origins, attempted to synthesise their criticism of art with the recovery of the work of Marx beyond its mutilation as Marxism. Indeed, it was the synthesis of these critiques that enabled the considerable development of the concept of ‘spectacle’, opening the way to the unique influence the SI exerted in the re-emergence of a revolutionary movement at the end of the 1960s. The objective of this article is to compare and contrast the influential notion of natural and property rights created by John Locke in his "Second Treatise on Government" (1689) to the posterior notion of abstract right expressed by Georg Wilhelm Friedrich Hegel in his "Elements of the Philosophy of Right". Said analysis is particularly pertinent given the complexity of Hegel’s political philosophy, and, perhaps more importantly, seeing as Hegel’s abstract right was (allegedly and in part) intended to point out the (...) shortcomings of Locke’s theory of natural and property rights, in order to further the human understanding of the world. More specifically, this article will examine the two rights theories in terms of their respective amounts of emphasis on individualism, or lack thereof. It will reveal three areas in which Lockean rights are more geared towards the primacy of the individual than Hegelian rights: (1) in their respective understandings of what it means to be a person, (2) in their conduciveness to individual wellbeing through the obligations each theory entails, and (3) in the extent of the rights themselves in relation to the state. This paper explores relationships between environment and education after the Covid-19 pandemic through the lens of philosophy of education in a new key developed by Michael Peters and the Philosophy of Education Society of Australasia. The paper is collectively written by 15 authors who responded to the question: Who remembers Greta Thunberg? Their answers are classified into four main themes and corresponding sections. The first section, ‘As we bake the earth, let's try and bake it from scratch’, gathers wider philosophical (...) considerations about the intersection between environment, education, and the pandemic. The second section, ‘Bump in the road or a catalyst for structural change?’, looks more closely into issues pertaining to education. The third section, ‘If you choose to fail us, we will never forgive you’, focuses to Greta Thunberg’s messages and their responses. The last section, ‘Towards a new normal’, explores future scenarios and develops recommendations for critical emancipatory action. The concluding part brings these insights together, showing that resulting synergy between the answers offers much more then the sum of articles’ parts. With its ethos of collectivity, interconnectedness, and solidarity, philosophy of education in a new key is a crucial tool for development of post-pandemic education. (shrink)

Benchmarking automated theorem proving (ATP) systems using standardized problem sets is a well-established method for measuring their performance. However, the availability of such libraries for non-classical logics is very limited. In this work we propose a library for benchmarking Girard's (propositional) intuitionistic linear logic. For a quick bootstrapping of the collection of problems, and for discussing the selection of relevant problems and understanding their meaning as linear logic theorems, we use translations of the collection of Kleene's intuitionistic theorems in the (...) traditional monograph "Introduction to Metamathematics". We analyze four different translations of intuitionistic logic into linear logic and compare their proofs using a linear logic based prover with focusing. In order to enhance the set of problems in our library, we apply the three provability-preserving translations to the propositional benchmarks in the ILTP Library. Finally, we generate a comprehensive set of reachability problems for Petri nets and encode such problems as linear logic sequents, thus enlarging our collection of problems. (shrink)

The theme this year is "Towards an Open Ontology Repository". This communiqué represents the joint position of those who were engaged in the year's summit discourse on an Open Ontology Repository (OOR) and of those who endorse below. In this discussion, we have agreed that an "ontology repository is a facility where (...) ontologies and related information artifacts can be stored, retrieved and managed." -/- We believe in the promise of semantic technologies based on logic, databases and the Semantic Web, a Web of exposed data and of interpretations of that data (i.e., of semantics), using common standards. Such technologies enable distinguishable, computable, reusable, and sharable meaning of Web and other artifacts, including data, documents, and services. We also believe that making that vision a reality requires additional supporting resources and these resources should be open, extensible, and provide common services over the ontologies. (shrink)

Pressure and influences on school leaders as school policy makers during COVID-19 have made the task of interpreting, translating and implementing guidance more a complex and essential operation. School leaders need to prioritise and balance ever-changing government policy advice, against limitations of school buildings, the welfare of students and staff as well as the needs of the communities their schools serve. By surveying and interviewing headteachers, senior leaders and governors, this paper identifies the inputs school leaders have had to react (...) and respond to when creating policy in the context of COVID-19. The paper addresses the nature of, and factors affecting, pressures school leaders feel in authoring policy. The considerable challenges school-based policy makers face in implementing social distancing policy are non-trivial and increase tension to what is already highly stressful work. The report draws on data collected from a randomised, stratified sample of primary and secondary school leaders from across England in early June 2020, during the time of social distancing and school closure for most students. Findings suggest quality, quantity and frequency of top-down communication have contributed to school leader stress, while horizontal communication and collaboration between school leaders and across school communities helped to support leaders during rapid change. We recommend government and the education sector address communication, collaboration and change, to harness the challenges and opportunities identified by school leaders during the COVID-19 pandemic. In this paper I will examine the relationship between constitutionalism and democracy as the alleged tensions between them appear in diagnoses about the crisis of liberal democracy. The issue is approached through the arguments of the German jurist Martin Kriele, who holds the thesis that there can be no sovereign in the constitutional State. I will begin by explaining this thesis as well as the justification offered by Kriele. According to him, the guarantee of rights and freedoms is only possible (...) within the framework of the constitutional State. Hence, he advances a second related thesis, that democracy can only be developed in the constitutional State, that is, as constitutional democracy. However, this second thesis seems in contradiction with the first if the democratic principle implies popular sovereignty. To resolve this apparent antinomy, I will distinguish with Kriele two rival conceptions of democracy in order to point out the danger of misinterpreting the meaning of constitutional democracy. -/- En este trabajo examino la relación entre constitucionalismo y democracia, puesto que las supuestas tensiones entre ambos aparecen en los diagnósticos sobre la crisis de la democracia liberal. La cuestión se aborda a través de los argumentos del jurista alemán Martin Kriele, quien defiende la tesis de que no puede haber soberano en el Estado constitucional. Empezaré por explicar dicha tesis así como la justificación de ella que ofrece Kriele, para quien la garantía de los derechos y libertades sólo es posible en el marco del Estado constitucional. De ahí que avance una segunda tesis relacionada, cuando sostiene que la democracia sólo puede desarrollarse en dicho Estado constitucional, esto es, como democracia constitucional. Sin embargo, esta segunda tesis parece contradictoria con la primera si identificamos el principio democrático con la soberanía popular. Para resolver esa aparente antinomia, se distinguiré con Kriele dos concepciones rivales de la democracia, a fin de señalar el peligro de malinterpretar el sentido de la democracia constitucional. The central role of gestural language in Buddhism is widely acknowledged, as in the story of the Buddha pointing at the moon, the point being the student’s seeing beyond the finger to its gesture. Gesture’s role in dance is similarly central, as noted by scholars in the emerging interdisciplinary field of dance studies. Unsurprisingly, then, the intersection of these two fields is well-populated, including the formal gestures Buddhism inherited from classical Indian dance, and the masked dance of the Mani Rimdu (...) Festival. In this investigation, I will articulate a new Buddhist philosophy of gestural language, based on a new conception of emptiness that I locate in the work of contemporary U.S. choreographer Deborah Hay, as influenced by Nāgārjuna and Zen. And this, finally, suggests that contemporary Western philosophy should incorporate this compassion as a normative dimension to its own theorizing and practice. (shrink)

The review cites the “Open Society” twice in its title—and is clearly pro-Popperian—but then fails to mention the fourteen-point list, and surrounding discussion, that explicitly compares Popper’s critical rationalism with anarcho-libertarianism (strong similarities) and liberal democracy (strong dissimilarities); EfL, pp.135-142. If the review had engaged more closely with the arguments of EfL and been more informed by the relevant social scientific literature, then it would probably have found the anarcho-libertarian case to be far more robust and realistic than such a (...) cursory dismissal can hope to refute. La memética constituye un enfoque sobre la evolución cultural que se ha encontrado en el foco de la discusión y recolectado críticas de diverso tipo en las últimas décadas. El propósito de nuestro trabajo consiste en indagar si, más allá de las críticas y defensas existentes, puede considerarse que existe actualmente algún programa de investigación que pueda caracterizarse adecuadamente como memético. Nos centraremos, específicamente, en el ámbito del estudio de la evolución cultural de los cantos de aves, pues allí algunos (...) autores han utilizado la palabra «meme» para referirse a los ítems culturales bajo estudio. Sin embargo, no todos utilizan la palabra, pues, probablemente por su carácter controversial, ha caído en desuso. Eso implica que para cumplir con el objetivo de nuestro trabajo no pueda apelarse a análisis bibliométricos. Por este motivo elucidaremos los diferentes sentidos en los que puede caracterizarse a la memética. Nuestro objetivo es defender que en el área de cantos de aves se pueden encontrar investigaciones que responden a la perspectiva memética en todos los sentidos señalados. Esta entrevista se hizo a uno de los miembros de la Academia Hondureña de la Lengua, Víctor Manuel Ramos. Entre los aportes que el académico expresó, fue su contribución a la comunidad intelectual a través de estudios lingüísticos y literarios. En concreto, estos se apreciaron en el Diccionario de las Lenguas de Honduras; Literatura y su producción literaria de índole infantil. Para que ello fuera posible, el entrevistado comentó cómo fue su proceso de formación, el cual fue un tanto complejo, (...) ya que tuvo que descartar algunas filiaciones y presuntas voliciones, tales como las que pretendía hallar desde la Medicina. Finalmente, lo que se concluye de esta conversación es el logro que se puede conseguir para la sociedad después de que uno se prepara concienzudamente, sin obviar el aprendizaje que se deriva de la experiencia personal. La doctrina establecida por la Corte Suprema de Justicia de la Argentina en relación a los crímenes de lesa humanidad cometidos durante la última dictadura militar, expresamente declaraba la obligación del Estado de investigar y juzgar a los responsables de su comisión. La Corte no sólo caracterizó dichos delitos, sino que también estableció que no eran susceptibles de amnistía, indulto, ni prescripción. Pero, en el año 2017 dictó el fallo “Muiña” donde, por voto mayoritario, decidió otorgarle el beneficio del “2 (...) por 1” a un condenado por dichos delitos. La consecuencia fue su inmediata libertad por el vencimiento de la condena. La respuesta de la sociedad fue clara. Con diversas manifestaciones, la sociedad civil, las instituciones y las personalidades públicas se declararon en contra de la sentencia. Más aún, del voto de los mismos jueces se observan expresiones que denotan un gran pesar a la hora de tomar la decisión. Más precisamente, sostenían estar ante un dilema. En este trabajo, lejos de realizar un análisis de la interpretación jurídica que se efectuó en la sentencia, se propone trabajar sobre el concepto de dilema y la posibilidad de aplicación en el presente caso. La finalidad concreta es indagar si se está ante un dilema y en su caso si los jueces utilizan este concepto como un arma argumentativa para lograr adhesión o compasión de la opinión pública. En este sentido, se comenzará relatando el marco jurídico del fallo, donde se describirá la historia judicial de Muiña y los argumentos dados por el voto mayoritario y el minoritario de la Corte. Luego, se realizará un análisis del concepto de dilema, para reconstruirlo sobre la base de dos grandes posturas: Una lógica conceptual y otra fenomenológica. Posteriormente, se realizará un examen de la dimensión institucional del derecho y la moralidad judicial, para - finalmente - poder intentar responder si se está efectivamente ante un dilema. The paper seeks to show how the world of everyday human cognition might be treated as an object of ontological investigation in its own right. The paper is influenced by work on affordances and prototypicality of psychologists such as Gibson and Rosch, by work on cognitive universals of the anthropologist Robin Horton, and by work of Patrick Hayes and others on ‘naive’ or ‘qualitative physics’. It defends a thesis to the effect that there is, at the heart of common sense, (...) a theoretical core of true propositions pertaining to mesoscopic objects, and that the latter are to be understood as relating mereologically to the objects studied by physical science. Hay doble pulsión en el centro de la discusión del razonamiento deductivo. Una conduce aparentemente a la abstracción y dominios arbitrarios, mientras que la otra conduce a la concreción y la dependencia del contenido. El objetivo de esta investigación es diseñar, aplicar y validar un instrumento de evaluación que nos permita corroborar si el razonamiento deductivo maneja reglas lógicas o contenidos. La muestra de estudio se compuso de 80 participantes (edad 18-77 años). El test consta de 60 ítems categorizados en: (...) formalidad, integrabilidad, complejidad y modalidad. Los resultados ponen de manifiesto la fiabilidad del test de razonamiento deductivo con un alpha de Cronbach. 775 y con un índice de validación. 850 para el índice de inteligencia no verbal (INV) del RIAS. Cómo conclusión inferimos que el razonador deductivo no dispone de un cuerpo preciso de reglas generales deductivas, sino que usa colecciones de reglas heurísticas cada vez menos abstractas. Definiciones de epistemología hay muchas, al igual que clases y estilos. Sin embargo, más allá de esta diversidad, es necesario contar con una definición básica que guíe nuestra comprensión del tema. Dos serán las preguntas que nos ayuden a ello en este artículo: a) ¿qué es la epistemología? y b) ¿para qué le sirve al científico?

Hay dos supuestos sobre el valor epistémico que guían las discusiones más recientes sobre éste. El primero es que hay algo bueno con respecto a la creencia verdadera. El segundo supuesto es que es posible que dos creencias difieran en su valor incluso si ambas creencias son igualmente correctas. El veritista tiene fácil explicar el primer supuesto, pero tiene más difícil explicar el segundo. Para explicarlo, el veritista tiene que mostrar que las creencias verdaderas pueden diferir en su valor porque (...) encarnan diferentes valores de bienes derivativos. El veritista tiene que proporcionarnos una historia de cómo es posible que pares de creencias verdaderas difieran en su valor epistémico no-instrumental. La forma más prometedora que una explicación de este tipo puede tomar, en mi opinión, apela al trabajo de Sosa (2007) sobre el valor epistémico y la naturaleza del conocimiento. Según la postura de Sosa, el conocimiento es un tipo de logro, un tipo de éxito que es atribuible al sujeto y a sus habilidades. Estos logros, nos sugiere, son más valiosos que un caso de éxito atribuible a la suerte y que no constituye un logro. Presentaré algunas dificultades potenciales para su postura y consideraré si tiene los recursos para lidiar con ellas. Voy a delinear los detalles de una postura alternativa que evade estas dificultades. Tal postura retiene el análisis del conocimiento de Sosa, pero requiere que revisemos algunas propuestas veritistas sobre el valor epistémico. La postura revisada nos proporciona algunas herramientas que serán útiles al tratar de ofrecer una teoría de la creencia racional o diestra. (shrink)

Muy pronto uno de nosotros se destacó por su capacidad creadora y su curiosidad filosófica: era Juan Larreta. Es así que, a pesar de haber iniciado tarde su formación, descolló como filósofo de mérito tanto en la Argentina como en el exterior. Presidente de la Sociedad Argentina de Análisis (...) Filosófico (SADAF) durante dos períodos, obtuvo el Diploma al M érito en Filosofía de la Fundación Konex en el 2006 y fue nombrado miembro honorario de la Sociedad Española de Filosofía Analítica (SEFA) en 2010. Organizó seminarios y dictó conferencias en centros de estudios filosóficos y en universidades argentinas y extranjeras, en cuyas publicaciones escribió numerosos artículos de singular valía, todos ellos caracterizados por su originalidad, su irreverente desafío al sentido común y sus ingeniosos experimentos mentales (thought experiments). “Hay momentos en la vida en los que la cuestión de saber si se puede pensar distinto de como se piensa o percibir distinto de como se ve es indispensable para seguir contemplando o reflexionando” (Foucault, 2003, p. 8). Esta declaración foucaultiana es la que impulsa la voluntad genealógica que presenta este ensayo, así como su pretensión proyectiva para pensar hoy la educación. El momento filosófico crítico consiste en volver sobre las prácticas que día a día llevamos a cabo y (...) configuran nuestras vidas y nuestras instituciones. Este es necesario para realimentar y reorientar la savia de las instituciones, y especialmente la savia de nuestras instituciones académicas, suelo en el cual se teje la sustancia ética que posteriormente dará lugar a la articulación social. Si se aplica el elemento crítico que la actividad filosófica supone a la experiencia de la educación, entendiendo por ella la correlación dentro de una cultura entre campos de saber, tipos de normatividad y formas de subjetividad, podemos preguntarnos: qué es la educación y qué función desempeña hoy con respecto al ejercicio mismo del pensamiento en un contexto atravesado por las nuevas tecnologías y la IA. Hay quienes sostienen que las producciones diseñadas conforman un género discursivo. Pero, ¿es realmente así? ¿Reamente todas las producciones diseñadas conforman un género discursivo o más bien se adaptan a diversos géneros pre-existentes, y en constante modificación?

Hay una profundidad en la letra, entre las letras, que solo la lectura es capaz de enunciar. Enunciación que evoca la pregunta por la violencia de la palabra misma, su ambición de significar. La letra, en cambio, es un acontecer sutil. No hay escritor ni lector que pueda estrecharla, reducirla, asfixiar su siempre prosódica pulsión. Hay otros signos que la letra codicia -dice Jabes- signos borrados que el gesto reproduce en lo que nombra. El presente trabajo pretende interrogar la tradición (...) de la interpretación jurídica occidental emprendiendo la tarea de una restauración: la de la lectura midrashica como modo otro de interpretación. Como advierte Legendre, el armazón lógico de nuestros sistemas jurídicos sostenido sobre un derecho romano canónico como su representación histórica se instituyó sobre la marca de un silencio: la represión de cualquier sistema de interpretación disonante, juzgados como contrarios a la Razón por la tradición del derecho romano cristianizado. ¿Cómo leer esta censura? Vào ngày 19/4/2024 vừa qua, Tuyên bố New York về Ý thức của Động vật đã được công bố tại một hội nghị "Khoa học Mới nổi về Ý thức của Động vật" được tổ chức tại Đại học New York. Tuyên bố New York là một nỗ lực để thể hiện sự đồng thuận của giới khoa học về sự tồn tại trải nghiệm ý thức ở tất cả các loài có xương sống (bao gồm tất cả các loài (...) bò sát, lưỡng cư và cá) và nhiều loài không xương sống (bao gồm, ít nhất là, các loài mực ống, giáp xác mười chân và côn trùng). Về mặt khoa học, Tuyên bố New York là một bước tiến bộ lớn cho nhân loại, nhưng nó cũng sẽ khiến cho nhiều người có ý thức hơn về các thách thức đạo đức liên quan đến động vật có trải nghiệm ý thức. Bài viết này sẽ bàn về các cách tiếp cận triết học đối với vấn đề đạo đức của việc giết các sinh vật có tri giác để từ đó chỉ ra nan đề đạo đức đang hiện hữu trong xã hội loài người: Để duy trì sự tồn tại của con người, loài được xem là có đạo đức, thì chúng ta lại vi phạm đạo đức của chính chúng ta, là sát sinh các loài có giá trị nội tại, ý thức, hay tri giác khác. Nan đề đạo đức này đã tồn tại trong xã hội loài người từ rất lâu trước đây. Nhiều giải pháp đã được đề xuất và ứng dụng vào thực tế nhầm giải quyết nan đề này, như cách tiếp cận bất bạo lực và ăn chay của Phật giáo, việc áp dụng luật Hồi giáo và các nghi lễ thiêng liêng đối với động vật trong Hồi giáo, các phòng trào đòi quyền cho động vật và thực hiện tuyệt chủng tự nguyện ở các nước phương Tây, hay chế biến thịt sử dụng tế bào động vật. Tuy nhiên, dù cách nào đi nữa thì hiện nay chúng ta vẫn chưa thể hoàn toàn giải quyết được nan đề đạo đức, đó là các sinh vật có tri giác vẫn tiếp tục bị giết vì sự sinh tồn của con người. Chúng tôi cho rằng giải pháp khả thi nhất hiện nay đó là thay đổi văn hóa tiêu dùng thực phẩm ở hiện tại, xây dựng các giá trị văn hóa thặng dư sinh thái, và thúc đẩy các giải pháp hòa bình. Conceptual engineers have made hay over the differences of their metaphilosophy from those of conceptual analysts. In this article, I argue that the differences are not as great as conceptual engineers have, perhaps rhetorically, made them seem. That is, conceptual analysts asking ‘What is X?’ questions can do much the same work that conceptual engineers can do with ‘What is X for?’ questions, at least if conceptual analysts self-understand their activity as a revisionary enterprise. I show this with a study (...) of Russell's metaphilosophy, which was just such a revisionary conception of conceptual analysis. (shrink)

Nadie sabe lo que quiere la Justicia porque la justicia no se deja escribir. Cuando digo escribir, digo instituir. La Justicia no se deja instituir. Con ello debe lidiar la actividad judicial, con el límite mismo, con la propia imposibilidad. Límite que exhibe oculto que hay algo allí que no hace cuerpo. Que hay algo que el orden de lo simbólico no logra apresar. Legendre decía: en occidente, instituir es escribir. Instituir a los hombres es ante todo, escribirlos, inscribirlos, ¿marcar (...) sus cuerpos? Kafka lo sabía bien. La democracia enfrenta también un desafío similar: asumir que el signo de lo ilimitado la acompaña en el regazo mismo que la dialéctica de la modernidad le ofrece. Los escritores, señala Milner, han descripto lo ilimitado para condenar sus consecuencias y sustraerse a ellas, como el caso de Rousseau, o para constatarlas y combatirlas mediante estrategias de inversión, de Baudelaire a Brecht.Arrasar con la diferencia es no soportar el límite, aquello que hace borde, aquello que no se deja decir. En otras palabras no aceptar la falta en el lenguaje. El presente trabajo pretende mostrar que es, precisamente, el punto de cruce que constituye el límite mismo, el lugar que aloja un encuentro posible entre justicia y democratización. El límite, lejos de clausurar, posibilita aquel enlace, lo augura. Es a nivel del lenguaje que esta relación requiere ser situada. Democratizar la lengua supone horizontalizarla, en otras palabras, abogar por la apertura y circulación del sentido. Son las teorías críticas del derecho las que aportan las herramientas necesarias para pensar esta articulación. Como señala Cárcova, es en el campo del sentido en donde el derecho adquiere su especificidad y produce los efectos que le son propios. Profundizar la democracia desde el campo jurídico exige, ante todo, democratizar al derecho mismo. (shrink)

¿Qué relación hay entre derecho y lenguaje? Y ¿entre lenguaje y ley? ¿Cómo se inicia la serie de la juridicidad? ¿Qué la posibilita? Una característica hace de lo humano algo aparte de lo vivo: la palabra. El presente trabajo pretende recorrer parte de esta huella, intentando repensar allí la centralidad del lenguaje en la estructuración misma de la juridicidad. Volverse al lenguaje es, en definitiva –como señala P. Sneh– un gesto político.
