Although the principle of fair subject selection is a widely recognized requirement of ethical clinical research, it often yields conflicting imperatives, thus raising major ethical dilemmas regarding participant selection. In this paper, we diagnose the source of this problem, arguing that the principle of fair subject selection is best understood as a bundle of four distinct sub-principles, each with normative force and each yielding distinct imperatives: (1) fair inclusion; (2) fair burden sharing; (3) fair opportunity; and (4) fair distribution of (...) third-party risks. We first map out these distinct sub-principles, and then identify the ways in which they yield conflicting imperatives for the design of inclusion and exclusion criteria, and the recruitment of participants. We then offer guidance for how decision makers should navigate these conflicting imperatives to ensure that participants are selected fairly. (shrink)

It is widely held that every person is a person essentially, where being a person is having special mental properties such as intelligence and self-consciousness. It follows that nothing can acquire or lose these properties. The paper argues that this rules out all familiar psychological-continuity views of personal identity over time. It also faces grave difficulties in accounting for the mental powers of human beings who are not intelligent and self-conscious, such as foetuses and those with dementia.

[OPEN ACCESS TARGET ARTICLE WITH COMMENTARIES AND RESPONSE] We develop a new model of how human agency-detection capacities and other socio-cognitive biases are involved in forming religious beliefs. Crucially, we distinguish general religious beliefs (such as *God exists*) from personal religious beliefs that directly refer to the agent holding the belief or to her peripersonal time and space (such as *God appeared to _me_ last night*). On our model, people acquire general religious beliefs mostly from their surrounding culture; however, people (...) use agency-intuitions and other low-level experiences to form personal religious beliefs. We call our model the Interactive Religious Experience Model (IREM). IREM inverts received versions of Hyperactive Agency-Detection Device Theory (HADD Theory): instead of saying that agency-intuitions are major causes of religious belief in general, IREM says that general belief in supernatural agents causes people to seek situations that trigger agency-intuitions and other experiences, since these enable one to form personal beliefs about those agents. In addition to developing this model, we (1) present empirical and conceptual difficulties with received versions of HADD Theory, (2) explain how IREM incorporates philosophical work on indexical belief, (3) relate IREM to existing anthropological and psychological research, and (4) propose future empirical research programs based on IREM. Charlotte Witt's finely crafted book offers an original and powerful account of social role normativity––the normativity of norms associated with social ro.

Charlotte Witt covers a remarkable amount of ground in this concise and elegantly written book. Coming in at under 150 pages, she artfully weaves together Aristotle’s theory of functions with contemporary work on cultural transmission and apprenticeship, ideas about self-creation with theories of aspiration and transformative experience, and reflections on the relationships among social norms and games with thoughts about social roles and the nature of hierarchy. At the heart of it is an elaboration and defense of a thoroughly (...) externalist account of social normativity. Witt takes skilled experts, especially artisans like chefs and carpenters, as paradigm cases for theorizing about social normativity. She uses them to argue that the ultimate source of many normative obligations is found not in the acquiescence, attitudes, or any other features internal to those on whom those obligations fall. Rather, the demands are rooted in the world itself, and flow from specific circumstances, especially from the constraints those circumstances impose on different actors in virtue of the tasks they need to perform. The result is a view that depicts social normativity not just as external to individuals but also unavoidably role specific; what is right for a chef is not necessarily right for a carpenter, and what makes for a good nurse might make for a poor drill sergeant. Witt’s presentation of this package of ideas is both careful and austere, and it makes for a wonderfully thought provoking read. Social Goodness: On the Ontology of Social Norms will reward the careful attention of anyone interested in social ontology, especially the metaphysical foundations of normativity, the nature of social norms, and the relationship between social roles and the self. We argue that work on norms provides a way to move beyond debates between proponents of individualist and structuralist approaches to bias, oppression, and injustice. We briefly map out the geography of that debate before presenting Charlotte Witt’s view, showing how her position, and the normative ascriptivism at its heart, seamlessly connects individuals to the social reality they inhabit. We then describe recent empirical work on the psychology of norms and locate the notions of informal institutions and soft structures (...) with respect to it. Finally, we argue that the empirical resources enrich Witt’s ascriptivism, and that the resulting picture shows theorists need not, indeed should not, choose between either the individualist or structuralist camp. I argue that nonresident aliens, in places that are clearly not U.S. territory, should benefit from constitutional rights. This is a matter of mutuality of obligation. The U.S. claims the authority to hold all people accountable for respecting certain laws, such as the law of war as defined in the Military Commissions Act. Accordingly, it must accord them basic legal rights in return. At the same time, I argue, contra Benjamin Wittes, that this would not lead to absurdly opening the (...) courthouse doors, nor does it require abandoning principle to keep the flood of litigation reasonably contained. Not all harms inflicted by the U.S. government can give rise to a lawsuit, and that the distinction between those who should have a right to sue and those who should not can be drawn in a principled way. In de jaren vijftig raakte Michel Foucault gefascineerd door de fenomenologische psychologie. Vanaf de jaren zestig echter presenteert hij zichzelf als een ‘structuralist’ die slechts anonieme talige en architectonische structuren wil analyseren en die met nadruk wil afzien van elke interesse in de mens als individu of als subject. De psycholoog in hemzelf wordt als het ware hartstochtelijk verdrongen. Toch is er ook in het geval van Foucault sprake van een onvermijdelijke terugkeer van het verdrongene. Een belangrijk symptoom hiervan (...) vormt zijn opvallend ambivalente houding jegens de psychoanalyse. In zijn werk tekent zich een levenslange polemiek af met Freud, soms expliciet, doorgaans impliciet. Ondanks onmiskenbare sporen van latente bewondering en fascinatie blijft wantrouwen domineren. Steen des aanstoots vormen Freuds Drei Abhandlungen zur Sexualtheorie uit 1905. Volgens Foucault spreekt hieruit een medicalisering van de seksualiteit, die zich uit in medicaliserende technieken zoals het oprakelen en uitspreken van verlangens en de classificatie van ‘normale’ en ‘perverse’ vormen van seksualiteit. A comprehensible model is proposed aimed at an analysis of the reasons for theory change in science. According to the model the origins of scientific revolutions lie not in a clash of fundamental theories with facts, but of “old” fundamental theories with each other, leading to contradictions that can only be eliminated in a more general theory. The model is illustrated with reference to physics in the early 20th century, the three “old” theories in this case being Maxwellian electrodynamics, statistical (...) mechanics and thermodynamics. Modern example, referring to general relativity and quantum field theory fusion, is highlighted. Die Philosophie Ludwig Wittgensteins eignet sich in besonderer Weise als Diskus-sionsforum aktueller philosophischer Fragen. Dabei sei nicht nur an den mittlerweile in sprach- und sozialwissenschaftlichen Belangen ausgiebig zitierten Witt-genstein der Philosophischen Untersuchungen gedacht, sondern auch an jenen des Tractatus logico-philosophicus (Traktat), wo – was zu zeigen ist – eine Theorie der Sprache als selbstreferentielles System grundgelegt wird, die z.T Züge des sog. Radikalen Konstruktivismus aufweist und (mit Blick auf die Philosophischen Un-tersuchungen) das postmoderne Problembewußtsein der „Heterogenität der Sprachspiele“ ankündigt. (...) Der Traktat zeigt, daß das „Projekt der Moderne“, Sprache und Wirklichkeit durch Rekurs auf ein universales Sprachsystem zu legitimieren, scheitert, von innen her scheitern muß Als unterstellt universales ist dieses Sprachsystem gegen äußere Einwände immun, es hätte die Allmacht zu definieren, was sinn- und wertvoll ist. Es verwickelt sich jedoch in interne Widersprüche, wenn es dies tut, d.h. wenn es das eigene System als universales zu explizieren und legitimieren versucht. In this essay, I look at two negative portrayals of egoism. I summarize in detail the superb All About Eve—which won six Academy Awards, including Best Picture. The movie is about the rise of a ruthlessly ambitious actress, and how she treats her main competitor. Eve Harrington worms her way into top theatrical actress Margo Channing’s inner circle by pretending to be an admirer, but she is really a schemer who wants to eclipse Margo’s star in the theater universe. However, (...) Eve runs into trouble when she attempts to manipulate tart-tongued theater critic, Addison de Witt. The movie portrays the New York theater industry as being full of narcissists. I then review the classic film noir The Third Man (1949), rated by the prestigious British Film Institute as the greatest film of the 20th century. The film centers around a charismatic, handsome criminal mastermind Harry Lime living in bombed-out post-War Vienna. Lime is a man of no conscience or empathy—a true psychopath. He cripples children by selling hospitals adulterated penicillin. But we (the audience) still feel sympathy for him. I end the piece by explaining the psychological mechanisms at work that give rise to our paradoxical sympathy. (shrink)

The topic I address in this paper is whether the independence of Church and State brought about by the Lutheran Reformation tantamounted to the secularisation of the latter. Taking into account two recent essays by Harold Berman and John Witte on the Lutheran contribution to the Western legal tradition, I argue that Luther’s criticism of the catholic doctrine of Papal power came hand in hand with a theologization of the foundations of the authority of the State, which is difficult to (...) deem «secular».
