  1. Does the Prisoner's Dilemma Refute the Coase Theorem?Enrique Guerra-Pujol & Orlando I. Martinez-Garcia - 2015 - The John Marshall Law School Law Review (Chicago) 47 (4):1289-1318.
Two of the most important ideas in the philosophy of law are the “Coase Theorem” and the “Prisoner’s Dilemma.” In this paper, the authors explore the relation between these two influential models through a creative thought-experiment. Specifically, the paper presents a pure Coasean version of the Prisoner’s Dilemma, one in which property rights are well-defined and transactions costs are zero (i.e. the prisoners are allowed to openly communicate and bargain with each other), in order to test the truth value of (...)

From our perspective, we believe that it is necessary to abandon the idea that all those who suffer from SI or SA are mentally ill, which causes them to be stigmatized and subjected to psychiatric treatment, when what they need is a different vision of life as well as adaptive strategies to employ a new philosophy. Public policies should consider implementing programs that reinforce cognitive flexibility in addition to character strengths.

The aim of this paper is to explore the peculiar case of infectious logics, a group of systems obtained generalizing the semantic behavior characteristic of the -fragment of the logics of nonsense, such as the ones due to Bochvar and Halldén, among others. Here, we extend these logics with classical negations, and we furthermore show that some of these extended systems can be properly regarded as logics of formal inconsistency and logics of formal undeterminedness.

I present a novel position vis-à-vis the views in the Latin American philosophy literature regarding whether subjects more aptly use "Hispanic" or "Latinx" to refer to Hispanic- or-Latinx people. To this end, I will argue (C) the term "Afro-Latinx" is more apt than "Hispanic" or "Latinx" in a significant number of cases. This conclusion is based on three premises. The first premise (P1) is that use of "Afro-Latinx" provides subjects with understanding of how certain events depend on anti-Black racism, US (...)

After a critical examination of several attempts to characterize the Analytic tradition in philosophy, in the book here discussed Hanjo Glock goes on to contend that Analytic Philosophy is “a tradition that is held together both by ties of influence and by a family of partially overlapping features”. Here I question the need to appeal to a “family resemblance” component, arguing instead (in part by drawing on related attempts to characterize art, art genres and art schools) for a genealogical characterization. Transference theorists propose to explain causation in terms of the transference of a physical element. I argue, in two steps, that this is not possible. First, I show that available accounts of ‘transference’ ultimately convey that transference -and, consequently, causation- is the (non-relational) identity over time of the transferred element (a universal, a trope, or even an absolute substance). But, second, I try to defend, it is conceptually impossible that causation is (non-relational) identity.

We study whether it is possible to generalise Seidenfeld et al.’s representation result for coherent choice functions in terms of sets of probability/utility pairs when we let go of Archimedeanity. We show that the convexity property is necessary but not sufficient for a choice function to be an infimum of a class of lexicographic ones. For the special case of two-dimensional option spaces, we determine the necessary and sufficient conditions by weakening the Archimedean axiom.

This paper tries to address the ethical question of Nazism from the point of view of social relations. That implies linking the fulfilment of the fascist ideology with its economic conditions. In this sense, the main proposal is to highlight that, crimes such as those committed by the Nazi regime, are not only possible based on a monstrous bureaucratic formation but also from a permissive dynamic of production and exchange. However, the relative autonomy that we can claim over the ideological (...)

This paper expounds a symbolic interactionist theory of consciousness as an emergent phenomenon. It relates Michael Arbib's theory of the origin of language and Erving Goffman's frame analysis, especially as it bears on our understanding of the subject and of personal experience. Reflexivity and fictional mimesis are shown to be inherent to the origin of language and to the continuing emergent creativity of human communicative action. The emergent aspect of consciousness is also dealt with from the perspective of a narrative (...)

Schiffer has given an argument against supervaluationist accounts of vagueness, based on reports of vague contents. Suppose that Al tells Bob ‘Ben was there’, pointing to a certain place, and later Bob says, ‘Al said that Ben was there’, pointing in the same direction. According to supervaluationist semantics, Schiffer contends, both Al’s and Bob’s utterances of ‘there’ indeterminately refer to myriad precise regions of space; Al’s utterance is true just in case Ben was in any of those precisely bounded regions (...)

The post-Marxist stance against class politics unearths significant political demands often neglected by Marxism. However, in Ernesto Laclau and Chantal Mouffe’s approach, this step forward is followed by two steps back. They deny that class struggle against capitalist exploitation has any political significance for the masses or any essential link with the socialist-democratic project. But they do so at the cost of misrepresenting Marxian theory and underestimating the global phenomenon of labour exploitation. This faux pas is due to two misconceptions (...)

Nationalism seems a persistent ideology in academia as much as in politics; despite the fact that it has been shown that nationalism is deeply unjust for minorities. A case for national identity is often invoked to supplement liberalism regarding the inner difficulties that liberal theories have to explain their membership, assure stability and produce endorsement. So, it seems that national identity may also be required for justice. While this controversy continues, I argue that a different approach is available. We can (...)

Peter Simons (1994) originally proposed Nuclear Theory (NT), and continues to develop (1998, 2000) and maintain (2002/03) the view. Recently, building on Simons’s theory, Markku Keinänen (2011) has proposed what he calls the Strong Nuclear Theory (SNT). Although the latter is supposed to shore up some of NT’s weaknesses, it continues to maintain NT’s central tenet, the premise (...)

Some recent researches in experimental philosophy have posed a problem for philosophers’ appeal to intuition (hereinafter referred to as PAI); the aim of this paper is to offer an answer to this challenge. The thesis against PAI implies that, given some experimental results, intuition does not seem to be a reliable epistemic source, and —more importantly— given the actual state of knowledge about its operation, we do not have sufficient resources to mitigate its errors and thus establish its reliability. That (...)

Our argument is that the prevailing functional-adaptationist perspective falls short in explaining the evolution of reproductive traits, and we propose an alternative organismal-relational approach that incorporates the developmental and interactive aspects of reproduction. To begin, we define the functional individuation of reproductive traits as evolutionary strategies aimed at enhancing fitness, and we demonstrate how this perspective influences the classification of reproductive characters and modes, the comprehension of shared traits as (...)
