Two of the most important ideas in the philosophy of law are the “Coase Theorem” and the “Prisoner’s Dilemma.” In this paper, the authors explore the relation between these two influential models through a creative thought-experiment. Specifically, the paper presents a pure Coasean version of the Prisoner’s Dilemma, one in which property rights are well-defined and transactions costs are zero (i.e. the prisoners are allowed to openly communicate and bargain with each other), in order to test the truth value of (...) the Coase Theorem. In addition, the paper explores what effect (a) uncertainty, (b) exponential discounting, (c) and elasticity have on the behavior of the prisoners in the Coasean version of the dilemma. Lastly, the paper considers the role of the prosecutor (and third-parties generally) in the Prisoner’s Dilemma and closes with some parting thoughts about the complexity of the dilemma. The authors then conclude by identifying the conditions under which the Prisoner’s Dilemma refutes the Coase Theorem. (shrink)

From our perspective, we believe that it is necessary to abandon the idea that all those who suffer from SI or SA are mentally ill, which causes them to be stigmatized and subjected to psychiatric treatment, when what they need is a different vision of life as well as adaptive strategies to employ a new philosophy. Public policies should consider implementing programs that reinforce cognitive flexibility in addition to character strengths.

The aim of this paper is to explore the peculiar case of infectious logics, a group of systems obtained generalizing the semantic behavior characteristic of the -fragment of the logics of nonsense, such as the ones due to Bochvar and Halldén, among others. Here, we extend these logics with classical negations, and we furthermore show that some of these extended systems can be properly regarded as logics of formal inconsistency and logics of formal undeterminedness.

I present a novel position vis-à-vis the views in the Latin American philosophy literature regarding whether subjects more aptly use "Hispanic" or "Latinx" to refer to Hispanic- or-Latinx people. To this end, I will argue (C) the term "Afro-Latinx" is more apt than "Hispanic" or "Latinx" in a significant number of cases. This conclusion is based on three premises. The first premise (P1) is that use of "Afro-Latinx" provides subjects with understanding of how certain events depend on anti-Black racism, US (...) society's racially unjust structure and US colonial policy. The second premise (P2) is that that neither the term "Hispanic" nor the term "Latinx" provide subjects with this understanding of how certain events depend on anti-Black racism, US society's racially unjust structure and US colonial policy. The third premise (P3) is that the term "Afro-Latinx" provides subjects with more understanding of these events than the terms, "Hispanic" and "Latinx.” I present three cases which feature the experiences of Afro-Dominican people. The 1992 murder of Dominican man Kiko García by New York Police officer O’Keefe is first case. The second case is the Washington Heights Uprising that ensued Kiko García’ murder. An instance where a nightclub bouncer in the Dominican Republic denies a Dominican women entry because of her hair texture composes the third case. (shrink)

After a critical examination of several attempts to characterize the Analytic tradition in philosophy, in the book here discussed Hanjo Glock goes on to contend that Analytic Philosophy is “a tradition that is held together both by ties of influence and by a family of partially overlapping features”. Here I question the need to appeal to a “family resemblance” component, arguing instead (in part by drawing on related attempts to characterize art, art genres and art schools) for a genealogical characterization. Nonetheless, I point out that the difference between these two views might end being merely terminological, for, properly understood, a genealogical characterization will have to mention a “family of partially overlapping features” in describing the origins of Analytic Philosophy and the lines of influence among analytic philosophers. Transference theorists propose to explain causation in terms of the transference of a physical element. I argue, in two steps, that this is not possible. First, I show that available accounts of ‘transference’ ultimately convey that transference -and, consequently, causation- is the (non-relational) identity over time of the transferred element (a universal, a trope, or even an absolute substance). But, second, I try to defend, it is conceptually impossible that causation is (non-relational) identity.

The article has two aims: (a) to show how the notion of self proposed by Zahavi allows to underlie different aspects of personal identity; (b) to provide some elements that strengthen and complement the arguments of the Danish philosopher. First, I begin with a phenomenological analysis of the acts. Second, I study the identity and the various levels of the self that underlie it. Finally, I present some elements to constitute a metaphysics of the human person as a complement to (...) Zahavi’s phenomenology, considering the philosophy of mind as a framework for reflection. We study whether it is possible to generalise Seidenfeld et al.’s representation result for coherent choice functions in terms of sets of probability/utility pairs when we let go of Archimedeanity. We show that the convexity property is necessary but not sufficient for a choice function to be an infimum of a class of lexicographic ones. For the special case of two-dimensional option spaces, we determine the necessary and sufficient conditions by weakening the Archimedean axiom.

This paper tries to address the ethical question of Nazism from the point of view of social relations. That implies linking the fulfilment of the fascist ideology with its economic conditions. In this sense, the main proposal is to highlight that, crimes such as those committed by the Nazi regime, are not only possible based on a monstrous bureaucratic formation but also from a permissive dynamic of production and exchange. However, the relative autonomy that we can claim over the ideological (...) factor of the phenomenon faces severe limits. In the "National-socialist" case, those limits are the declining demand, the increase in government debt and the inhibition of the productive investment of capital. It is as if Evil incarnated only at the cost of eroding its conditions of possibility. (shrink)

This paper expounds a symbolic interactionist theory of consciousness as an emergent phenomenon. It relates Michael Arbib's theory of the origin of language and Erving Goffman's frame analysis, especially as it bears on our understanding of the subject and of personal experience. Reflexivity and fictional mimesis are shown to be inherent to the origin of language and to the continuing emergent creativity of human communicative action. The emergent aspect of consciousness is also dealt with from the perspective of a narrative (...) theory of subjective experience and of human temporality which can usefully complement and relate Arbib's and Goffman's views. Mostramos cómo se afirma en ella la incapacidad del sujeto para conocer y querer el bien, manifiesto en la ley natural. Esta incapacidad es compensada con los mandatos bíblicos, para los que Calvino justificará una positivación jurídica en los Estados cristianos. Schiffer has given an argument against supervaluationist accounts of vagueness, based on reports of vague contents. Suppose that Al tells Bob ‘Ben was there’, pointing to a certain place, and later Bob says, ‘Al said that Ben was there’, pointing in the same direction. According to supervaluationist semantics, Schiffer contends, both Al’s and Bob’s utterances of ‘there’ indeterminately refer to myriad precise regions of space; Al’s utterance is true just in case Ben was in any of those precisely bounded regions (...) of space, and Bob’s is true just in case Al said of each of them that it is where Ben was. However, while the supervaluationist truth-conditions for Al’s utterance might be satisfied, those for Bob’s cannot; for Al didn’t say, of any of those precisely delimited regions of space, that it is where Ben was. In an earlier version of the material presented here (García-Carpintero 2000) I replied to Schiffer’s argument that supervaluationism has an independently well-motivated defense. The response is essentially based on the point that the occurrence of ‘there’ in Bob’s utterance (and of ‘tall’ in Wright’s argument) occurs in indirect discourse, and supervaluationists may allow that it shifts its referent there. Schiffer’s reply to this response shows that it was not made sufficiently clearly. In this paper I will try to improve on that score. In his more recent reply, Schiffer (2000b, 325) dismisses a proposal like the one I will make, mainly because it “undermines … a leading virtue of supervaluationism … its implication that vagueness is … not a feature of the world.” I will argue that my reply does not undermine the fundamental contentions of the supervaluationist account. The post-Marxist stance against class politics unearths significant political demands often neglected by Marxism. However, in Ernesto Laclau and Chantal Mouffe’s approach, this step forward is followed by two steps back. They deny that class struggle against capitalist exploitation has any political significance for the masses or any essential link with the socialist-democratic project. But they do so at the cost of misrepresenting Marxian theory and underestimating the global phenomenon of labour exploitation. This faux pas is due to two misconceptions (...) at the core of the Laclau-Mouffean critique: an ambiguity in the use they make of the economic concept of surplus, and an incorrect identification of working-class and productive workers. With Laclau and Mouffe, I share the firm conviction in the necessity of a post-Marxian theory. Nevertheless, post-Marxism will be just as robust as our Marxist bedrocks. (shrink)

I defend a Deferred Ostension view of quotation, on which quotation-marks are the linguistic bearers of reference, functioning like a demonstrative; the quoted material merely plays the role of a demonstratum. On this view, the quoted material works like Nunberg’s indexes in his account of deferred ostensión in general. The referent is obtained through some contextually suggested relation; in the default case the relation will be … instantiates the linguistic type __, but there are other possibilities. In this way, the (...) deferred ostension view deals with a problem I pointed out for the identity proposal in my earlier work, that we do not merely refer with quotations to expression-types, but also to other entities related in some way to the relevant token we use: features exhibited by the token distinct from those constituting its linguistic type, features exhibited by other tokens of the same type but not by the one actually used (as when, by using a graphic token, we refer to its phonetic type), or even other related tokens (see the examples on p. 261 of García-Carpintero 1994). Nationalism seems a persistent ideology in academia as much as in politics; despite the fact that it has been shown that nationalism is deeply unjust for minorities. A case for national identity is often invoked to supplement liberalism regarding the inner difficulties that liberal theories have to explain their membership, assure stability and produce endorsement. So, it seems that national identity may also be required for justice. While this controversy continues, I argue that a different approach is available. We can (...) define a conception of legitimacy independently from a conception of justice, and then ask what legitimacy requires from our national allegiances. If everything goes well, much of the controversy from justice disappears as we find that the case for cultural nationalism may be illegitimate for liberal democracies. (shrink)

I argue racial injustice undermines the reliability of news source reports in the information domain of racial injustice. I argue that this in turn undermines subjects’ doxastic justification in inferences they base on these news sources in the racial injustice information domain. I explain that racial injustice does this undermining through the effect of racial prejudice on news organizations’ members and the effect of society's racially unjust structure on non-dominant racial group-controlled news sources.

In this article I examine the compatibility of a leading trope bundle theory of substance, so-called Nuclear Theory, with trope theory more generally. Peter Simons (1994) originally proposed Nuclear Theory (NT), and continues to develop (1998, 2000) and maintain (2002/03) the view. Recently, building on Simons’s theory, Markku Keinänen (2011) has proposed what he calls the Strong Nuclear Theory (SNT). Although the latter is supposed to shore up some of NT’s weaknesses, it continues to maintain NT’s central tenet, the premise (...) that tropes are variously existentially interdependent. I argue that the central tenet of NT frustrates several important aims of trope theory. If my arguments go through, they also implicate SNT. Because of this, I largely set aside other aspects of NT and SNT and focus on their shared central tenet. (shrink)

I argue that Bartolomé de las Casas and Juan Ginés de Sepúlveda differed in their conclusions regarding the status of Indigenous persons at least partly because las Casas had significant, yet incomplete, understanding of Indigenous persons, culture and societies and Sepúlveda had mere knowledge of them. To this end, I show that the epistemic state of understanding explains why Las Casas properly concluded that Indigenous persons deserve the same moral status afforded to Europeans. The search for equalitarism in the political levellers of each century.

Some recent researches in experimental philosophy have posed a problem for philosophers’ appeal to intuition (hereinafter referred to as PAI); the aim of this paper is to offer an answer to this challenge. The thesis against PAI implies that, given some experimental results, intuition does not seem to be a reliable epistemic source, and —more importantly— given the actual state of knowledge about its operation, we do not have sufficient resources to mitigate its errors and thus establish its reliability. That (...) is why PAI is hopeless. Throughout this paper I will defend my own conception of PAI, which I have called the Deliberative Conception, and consequently, I will defend intersubjective agreement as a means to mitigate PAI errors, offering empirical evidence from recent studies on the Argumentative Theory of Reason that favor the conception I defend here. Finally, I will reply to some objections that might arise against the Deliberative Conception, which will lead me to discuss some metaphilosophical issues that are significantly relevant for the future of the dispute about the appeal to intuition. In Charles Mills’ essay, “White Ignorance,” and his trail-blazing monograph, The Racial Contract, he developed a view of how Whiteness or anti-Black-Indigenous-and-Latinx racism causes individuals to hold false beliefs or lack beliefs about racial injustice in particular and the world in general. I will defend a novel exegetical claim that Mills’ view is part of a more general view regarding how racial injustice can affect a subject’s epistemic standing such as whether they are justified in a belief and whether their (...) degree of confidence in the belief is rational given their evidence. Then, in light of this novel exegetical claim, I show how this interpretation of Mills’ view that racial injustice causes ignorance relates to how epistemically justified philosophers and social scientists are in the views that dominate their respective scholarly literature. This paper delves into the character concept as applied to reproduction. Our argument is that the prevailing functional-adaptationist perspective falls short in explaining the evolution of reproductive traits, and we propose an alternative organismal-relational approach that incorporates the developmental and interactive aspects of reproduction. To begin, we define the functional individuation of reproductive traits as evolutionary strategies aimed at enhancing fitness, and we demonstrate how this perspective influences the classification of reproductive characters and modes, the comprehension of shared traits as (...) resulting from conflicts of evolutionary interest between individuals, and the explanation of reproductive diversity. After outlining the shortcomings of this framework, we introduce an organismal-relational approach grounded in evolutionary developmental studies of reproduction. This view provides a revised classification for reproductive characters and modes and offers a new understanding of interorganismal traits that takes into account their inherently relational nature. Lastly, we present the research agenda that emerges from this approach, which addresses the core explanatory gaps left by the adaptationist perspective, including the explanation of reproductive homologies and homoplasies, the developmental constraints associated with the evolution of reproductive modes, and the evolvability of reproductive characters. As touch remains commonly defined by the closeness it physically implies and it rhetorically evokes, the mere notion of distant touch and of distal haptic perception seems peculiar. But Aristotle’s perspective, which I wish to take as a point of departure, is firm: we perceive the objects of touch, the hot and the cold, the hard and the soft, the curved and the sharp, through other things: δι' ἑτέρων. In this article, I would like to explore this ἕτερος by showing (...) how the otherness of perception always implies an intermediary, a middle point (μέσος), i.e. an other not so other, an other that is able to translate the much more distant otherness of the perceived object. To explore these forgotten layers of alterity that fall into what we commonly conceive of as the impalpable emptiness of distance, I propose to study the idea of distant touch from the perspective of phenomenological aesthetics. In order to do so, I will first examine some aspects of the Husserlian account of perception and will then focus on the phenomenology of distant touch in Alejandra Costamagna’s novel El Sistema del Tacto [The System of Touch] (2018).
