Considerando la disciplina degli effetti civili del matrimonio canonico, improntata a diversi “sistemi matrimoniali”, il volume ripercorre le vicende politiche e culturali che hanno segnato la storia dei rapporti tra le autorità statali e le autorità ecclesiastiche, lungo un periodo che copre circa due secoli, dal Code civil napoleonico del 1804 ai Codici degli Stati preunitari, dal Codice civile del 1865 del Regno d’Italia ai Patti Lateranensi stipulati dal regime fascista nel 1929, dalla discussione nell’Assemblea costituente nell’Italia repubblicana alle vicende (...) politiche degli anni Cinquanta e Sessanta, sino ai negoziati bilaterali che portarono all’Accordo di Villa Madama, ratificato il 25 marzo 1985. Esaminando le innovazioni formali e sostanziali introdotte nella riforma del matrimonio concordatario, si evidenziano le questioni che continuano a essere oggetto di controversie dottrinali e di sentenze delle corti di giustizia, volte a colmare le lacune e contraddizioni dell’attuale normativa matrimoniale. Jürgen Habermas ha dedicato più di trent’anni dei suoi studi alle scienze sociali al fine di definire, attraverso la ricostruzione delle tradizioni di pensiero in esse presenti, un quadro teorico di riferimento che orienti i programmi della ricerca storico-sociale. Al pari dei grandi classici del pensiero sociologico, egli ha cercato di affrontare i “problemi della società nel suo insieme” esplicitando gli assunti, i metodi e gli obiettivi della teoria sociale come presupposto indispensabile per un’indagine che ampli i confini disciplinari della (...) sociologia, da un lato, alla riflessione filosofica, dall’altro alla ricerca storiografica. Nel lungo itinerario della sua formazione scientifica questo programma rappresenta il filo conduttore nell’analisi dei “sistemi culturali”, dei “sistemi sociali”, dei “sistemi della personalità” e, soprattutto, nella “teoria dell’evoluzione sociale”, dalla ricostruzione delle condizioni necessarie alla genesi antropologica delle forme socio-culturali di vita – l’“ominizzazione” – sino all’esame della logica e della dinamica di sviluppo delle “formazioni sociali” che egli suddivide in primitive, tradizionali, moderne e contemporanee. Nella Postfazione all’edizione italiana di Profili politico-filosofici (2000), una raccolta che contiene scritti di quarantacinque anni di studi (1953-1998), Leonardo Ceppa sottolinea i due aspetti essenziali dell’opera di Habermas: “la coerenza teorica” e il “carattere assimilatorio”. Habermas non è un pensatore “rivoluzionario” ma un “riformista” che, ricorrendo a un’immagine ingegneristica, all’isolamento del “pensiero che scava fossati” preferisce “costruire ponti” tra i campi del sapere. Questa ricerca si segnala per il tentativo di recepire criticamente le acquisizioni specialistiche delle scienze sociali e della filosofia finalizzando questa tensione apprenditiva alla costruzione di un quadro generale. Nato dai nostri colloqui seminariali, di cui mantiene la forma dialogica dei “turni di parola”, il presente volume focalizza lo sguardo sulle società contemporanee – ripercorrendone la struttura, le sfide presenti e gli scenari futuri – e sulla funzione sociale della sociologia. Ne scaturisce un’indagine di fenomeni fondamentali per comprendere le trasformazioni della modernità: la modernizzazione, il capitalismo organizzato, lo stato sociale, la democrazia politica, la diversità culturale, l’opinione pubblica nell’epoca dei media, la globalizzazione, la crisi ecologica, le disuguaglianze mondiali, i conflitti nazionalistici, il terrorismo islamico, la secolarizzazione, l’ingegneria genetica, l’integrazione europea e la politica mondiale. Nel riordinare i temi sociologici da lui proposti abbiamo cercato di sistemare l’analisi delle società contemporanee a un livello che non si accomodi sul piano dei commenti troppo facili che gli intellettuali, i politici e la gente comune amano fare sull’attualità e che, mantenendo una visione d’insieme sull’opera, chiarisca il testo e i suoi punti ciechi. Il volume si propone come uno strumento di lavoro che accompagni a una lettura critica. Sullo sfondo rimane la domanda se Habermas riesca davvero a conseguire, nei suoi itinerari attraverso la “storia delle idee”, la coerenza logica e la profondità d’indagine necessarie a “sistematizzare” le ricerche delle scienze sociali. Alcune perplessità avvalorate dal confronto con i testi e con la letteratura critica ci hanno suggerito di riservare ai problemi metodologici uno studio specifico che chiarisca il concetto di “scienza ricostruttiva” e ne illustri le applicazioni nell’ambito delle teorie della riproduzione culturale, della socializzazione e dell’evoluzione delle formazioni sociali – uno studio le cui linee sono solo anticipate nell’Introduzione. Il programma di ricerca e la sua recezione critica, relativamente agli assunti della teoria dell’evoluzione sociale. Riprendendo una felice espressione di Karl Popper, ci auguriamo di aver raggiunto la chiarezza argomentativa e la semplicità linguistica dovuta al lettore, confidando nella “cooperazione amichevole-ostile di molti scienziati”. Nel presente articolo sono illustrati i concetti che distinguono la sociologia di Pierre Bourdieu – campo, capitale, habitus, interesse, azione – indicando il nesso tra la costruzione di definizioni astratte, più frequenti negli scritti degli anni ’70, e la pratica di ricerca da cui quei concetti derivano e in cui trovano applicazione. Il sociologo francese ha costruito, infatti, un sistema di concetti interconnessi con cui descrive le componenti e i processi di riproduzione fon-damentali del mondo sociale e indirizza le ricerche (...) empiriche su ambiti d’analisi particolari. D’altra parte, egli ha mostrato una resistenza a presentarlo criticando le operazioni “scolastiche” di sistematizzazione che, secondo il sociologo, “normalizzano” l’opera ai fini accademici dell’insegnamento e intellettuali della divulgazione facendo perdere la complessità del lavoro in cui i concetti sono impiegati. Egli ritiene, infatti, che non si possa comprendere l’opera – l’opus operatum – se non si restituisce al “fare” della ricerca sugli oggetti – modus operandi. (shrink)

Après avoir introduit la notion d’espace public dans le contexte de la « théorie générale de la société » avec laquelle Habermas a entrepris une reconstruction de l’évolution des systèmes sociaux et, aussi, de la naissance de la sphère publique au cœur des sociétés bourgeoises et des changements à travers et au-delà des sociétés de masse, cet article se propose d’élaborer un cadre analytique du modèle habermasien de la sphère politique publique, décrivant aujourd’hui sa structure et ses fonctions spécifiques, par (...) rapport à la société civile et au système politique (fonctions de «caisse de résonance », « filtre », « contrôle » et « pression de rationalisation »). Dans un effort pour clarifier le «sens critique» d’un modèle de recherche « normatif » dans son contenu, mais suffisamment « réaliste », Habermas remonte à deux questions essentielles pour des sciences de la communication: a) l’indépendance des médias de masse; et b) les leur effets sur l’auditoire. Ce passage permet de mettre en évidence la « structure » et la « qualité » de la discussion publique. (shrink)

Nel primo paragrafo sarà esaminato l’impianto normativo che regola le pubbliche amministrazioni, riformato dalle l. n. 142 e n. 241 del 1990, dal D.Lgs. 29/1993, dalle “leggi Bassanini” e dalla legge-quadro 150/2000, sia riguardo al diritto di accesso nei confronti dell’attività dell’amministrazione, sia in merito al radicamento di criteri di efficacia, efficienza ed economicità delle policies sia agli strumenti con cui gli Enti locali e cittadini possono comunicare. Gli anni ‘90 segnano l’inizio di un processo volto alla riorganizzazione delle PA (...) a partire dalla centralità della comunicazione istituzionale ma anche della concezione del “diritto all’informazione” nelle tre accezioni di diritto “di informare, “di informarsi” e “essere informati”. La Levi ha ben sottolineato “la rapidità inusuale nella storia nazionale” di tale riforma e la centralità assunta in essa dalle dimensioni dell’informazione, della comunicazione e della partecipazione: "In sintesi, si può ritenere legittimo concludere che le riforme del decennio 1990-2000 abbiano segnato il passaggio dal segreto alla trasparenza e dall’unilateralità alla partecipazione. Le politiche di modernizzazione in tema di comunicazione pubblica e di maggiore trasparenza dell’attività dell’amministrazione si sono mosse verso una più marcata tutela dei diritti dei cittadini e verso l’accentuazione del risultato dell’azione amministrativa" (2004, p. 16). Grandi ha ribadito che tale evoluzione costituisce nella cultura politica dello stato di diritto una «sorta di pre-condizione dell’emergere dei nuovi diritti di cittadinanza, intesi quale partecipazione consapevole e informata al processo decisionale pubblico» (Grandi 20022, 13). Nel secondo paragrafo verranno descritte gli ambiti di applicazione, le finalità, gli obiettivi e le strutture della comunicazione istituzionale disciplinate dalla legge n. 150/2000 e dai conseguenti regolamenti attuativi: il Portavoce, l’Ufficio stampa, l’Ufficio per le relazioni al pubblico. Come vedremo, si tratta di una normativa che rappresenta un punto di arrivo e un punto di partenza, in quanto, da un lato, se chiude il decennio delle riforme amministrative, d’altro lato, problematizza compiutamente per la prima volta il rapporto di comunicazione tra PA e cittadini e pone in evidenza tutte le difficoltà nell’implementare le norme nella realtà. Agli elementi critici della comunicazione istituzionale sono riservate le considerazioni conclusive: dal reclutamento e formazione del personale, al coordinamento delle strutture, dal persistere di mentalità burocratiche e autoreferenziale alla carenza di risorse. Il problema delle dotazioni organiche e finanziarie, in particolare, è molto sentito dalle amministrazioni di dimensioni più piccole, le quali spesso ricorrono alla “esternalizzazione” di attività degli uffici di comunicazione, non solo per la produzione editoriale, le campagne pubblicitarie e i servizi di gestione degli eventi, ma anche per il sito internet e i compiti di informazione più tradizionali. In tale situazione, la comunicazione istituzionale, pur dichiarata come strategica, rischia di rimanere un momento residuale dell’azione pubblica sia in termini di processo sia in termini di contenuto, slegata dagli obiettivi dell’organizzazione. Nella Premessa al "Discorso filosofico della modernità" (1985) Habermas scrive, in maniera enfatica, che il tema, ricco di sfaccettature, della “modernità come progetto in-compiuto” segna l’inizio la sua riflessione e dagli anni ’80 “non gli ha dato più pace”. In effetti, la “modernità” si presenta come un “oggetto d’analisi obbligato” anche solo dal punto di vista del necessario auto-chiarimento disciplinare. È con la formazione delle società moderne che si differenziano come “forme del sapere specialistico”, la scienza politica, l’economia politica, l’antropologia (...) culturale e la sociologia. Ed è, ancora, dalla prospettiva della “riflessione filosofica” che si avvia dal tardo secolo XVIII una rinnovata consapevolezza intellettuale intorno alla coscienza storica del tempo moderno, ai principi costitutivi del “nuovo mondo” e alle “cesure” rispetto alla cultura passata. Non si deve, però, ridurre il concetto di modernità alla visione filosofica del mondo. Anche questa prospettiva – peraltro presente negli scritti di Habermas –, deve essere ricondotta all’interno del programma di ricerca della “teoria dell’evoluzione sociale”, considerando assieme i processi di “razionalizzazione culturale” del mondo vitale e la “differenziazione” di nuovi “principi di organizzazione sociale” rispetto a quelli con cui si erano riprodotte le formazioni tradizionali. Il merito dei suoi studi, una volta ricondotti a unità, è di seguire la trasformazione delle sfere culturali di valore alla luce dei problemi che coinvolgono la riproduzione delle strutture sociali e delle forme di vita tradizionali, mediando le esigenze della teorizzazione astratta e le vicende della storia con-creta. In tal senso, egli segue la tradizione di ricerca dei classici del pensiero sociale, da Comte sino alla scuola di Parsons, attraverso Marx, Durkheim e Weber. Dopo aver esposto in che cosa consiste, secondo il nostro Autore, il “razionalismo occidentale”, qui, ci limitiamo a fornire un indice ragionato dei temi con cui Habermas ha ricostruito il concetto “formazione sociale moderna” attraverso l'analisi degli “albori della modernità”, delle “società capitalistico-liberali” e delle “società contemporanee”. Per meglio comprendere la rilevanza della posta in gioco – le condizioni effettive di democratizzazione delle nostre democrazie – è opportuno svolgere alcune considerazioni sul problema generale della legittimità del potere politico, che possiamo ricapitolare in tre punti: ciò che viene reputato legittimo (l’oggetto), 2. chi decide della legittimità (il soggetto) e 3. il criterio che la definisce (l’argomento) . A seconda delle risposte ne discendono diverse visioni della politica. Nel ricostruire il tema introdurremo dei concetti fondamentali – politica, potere, (...) effettività, legittimità, legalità, giustizia, libertà, etc. – e ci avvarremo del contributo di alcuni autori che Norberto Bobbio identificava come “classici”, non secondariamente, per la capacità di elaborare delle categorie generali di cui non si possa fare a meno per interpretare la realtà storico-sociale, anche quella differente dal contesto di genesi e d’uso della loro opera (I). Da ultimo, in maniera assai provvisoria, dovremo chiarire la prospettiva storico-evolutiva, di matrice habermasiana, che orienta l’analisi di Ampola sui modelli di legittimazione degli odierni stati democratici di diritto. Le diverse giustificazioni del potere politico possono essere non solo esaminate e comparate dal punto di vista dei concetti fondamentali e della logica argomentativa e neppure solo documentate storiograficamente nelle loro forme compiute o distorte di istituzionalizzazione. Sullo sfondo della riflessione sulla democratizzazione c’è l’assunto che la costellazione dei problemi si collochi nel quadro di uno sviluppo normativo discontinuo delle società umane di cui la teoria dell’evoluzione sociale può ricostruire la logica e la dinamica (II). I rapporti annuali su Gli italiani e lo stato, coordinati da Ilvo Diamanti, continuano a rilevare che i cittadini sono impegnati negli associazionismi ma disincantati dalla politica. Con le tipiche differenze nelle diverse aree del paese e a seconda del livello istituzionale, accanto alla sfiducia verso le istituzioni pubbliche c’è una propensione alla partecipazione. Come mostrano la diffusione delle primarie e le esperienze di democrazia partecipativa che si moltiplicano a livello locale, si riscontra, infatti, una disponibilità a sperimentare forme di (...) coinvolgimento differenti rispetto alla militanza politica che possono costituire un utile complemento della democrazia rappresentativa e degli strumenti di democrazia diretta. La partecipazione non solo richiede la possibilità legale di votare ma anche un contesto sociale che induca effettivamente il popolo a votare e ad esprimere i propri punti di vista elevando il livello di informazione e il confronto su argomenti alternativi, cercando di evitare nelle controversie pubbliche le valutazioni puramente opportunistiche o emotive. L’interesse qui si rivolge verso il “sondaggio deliberativo” di James S. Fishkin, una procedura molto diversa dal sondaggio d’opinione poiché rovescia la logica demoscopica. Le persone sondate dagli istituti di ricerca a volte non hanno indicazioni adeguate sul tema; altrettanto spesso non ci hanno riflettuto e non hanno confrontato le proprie preferenze, scelte o credenze con gli argomenti in contrasto in una libera e approfondita discussione. Renato Mannheimer, presidente dell’Istituto per gli studi sulla pubblica opinione (Ispo) è d’accordo con l’affermazione secondo cui le persone rispondono anche su ciò che non conoscono e, a suo parere, il problema si fa ancora più evidente a ridosso delle elezioni. Oggi, a suo avviso, la maggior parte della gente vota non per vera convinzione, ma sulla base di impressioni acquisite dalla TV durante le ultime settimane prima del voto. I sondaggi deliberativi, invece, sono diretti a migliorare la qualità del confronto pubblico, attraverso una procedura articolata che favorisce l’informazione,la riflessione e il dibattito, a partire, ovvio, dall’idea di creare un rapporto diverso tra i sondaggi e l’opinione pubblica intenso come misurazione di come muta l’opinione dopo che le persone hanno avuto l’opportunità di diventare più competenti e di confrontare in un dialogo aperto le loro idee. Nonostante alcune riserve di ordine metodologico e taluni rischi di strumentalizzazione politica, l’esame dei sondaggi deliberativi risveglia una viva ammirazione per uno studioso riuscito a riversare la passione civile e l'impegno politico in una pratica democratica concreta alla quale ha dedicato, quasi interamente, molti anni del suo lavoro. Rimane, certo, uno strumento insufficiente a rianimare e risollevare il momento deliberativo nelle democrazie contemporanee, ma nessuno può negare che indichi a tutti la direzione giusta. (shrink)

Negli ultimi decenni i sociologi ed economisti hanno sottolineato come il mondo del consumo sia sempre più caratterizzato dalle componenti culturali, sociali ed emotive. La marca cessa di essere semplice depositaria di benefit tangibili e performance oggettive ed estende il dominio all’area dei valori, delle relazioni e dei sentimenti. Adattandosi ai cambiamenti comunicativi il marketing si è arricchito di nuove strategie che la letteratura identifica con il temine “non convenzionali”: il market environment, il market niche, la client relationship, le competences (...) of the customer, il guerrilla marketing e le subjective experiences dei consumatori. E tra queste particolare rilievo ha assunto il “marketing esperienziale” finaliz-zato a coinvolgere la clientela offrendogli un’esperienza memorabile della marca. Il marketing include, certo, le tradizionali campagne pubblicitarie, le promozioni, le sponsorizzazioni, ma anche l’attrazione dei clienti negli ambienti dell’impresa, mettendo in mostra i luoghi, gli attori e i mezzi della produzione. Da questo punto di vista, i musei aziendali sono un medium straordinario che crea o consolida il rapporto tra l’impresa e il pubblico ma anche il legami interni e quelli con il territorio. L’analyse des juristes médiévaux nous montre comment la manipulation des contradictions déontiques prima facie est associée, dans l’argumentation interprétative, à la théorie de la légitimité de la hiérarchie normative, entendue non seulement comme instrument politique mais aussi et essentiellement comme un instrument de rationalité au sein d’une science juridique orientée vers une théologie politique. La notion de droit naturel telle qu’elle apparaît dans certains documents emblématiques dont le Decretum de Gratien du XIIe s., ne peut être réduite au modèle intellectualiste (...) aristotélo-thomiste du XIIIe s. Il y a plusieurs façons de penser le droit naturel dans le monde médiéval chrétien et latin ; elles se maintiennent sur plusieurs siècles et l’une d’elles au moins a des points de contacts et de désaccord avec les traditions juives et musulmanes. Ces courants de pensée qui s’écartent du modèle intellectualiste aristotélo-thomiste peuvent être regroupés au sein d’une famille (au sens wittgensteinien) de modèles volontaristes : les contradictions déontiques peuvent être plus fortes que des contradictions prima facie, elles peuvent être d’authentiques contradictions renvoyant à un nouvel acte de volonté comme la seule façon d’éliminer la contradiction déontique. We propose a nonmonotonic Description Logic of typicality able to account for the phenomenon of the combination of prototypical concepts. The proposed logic relies on the logic of typicality ALC + TR, whose semantics is based on the notion of rational closure, as well as on the distributed semantics of probabilistic Description Logics, and is equipped with a cognitive heuristic used by humans for concept composition. We first extend the logic of typicality ALC + TR by typicality inclusions of the (...) form p :: T(C) v D, whose intuitive meaning is that “we believe with degree p about the fact that typical Cs are Ds”. As in the distributed semantics, we define different scenarios containing only some typicality inclusions, each one having a suitable probability. We then exploit such scenarios in order to ascribe typical properties to a concept C obtained as the combination of two prototypical concepts. We also show that reasoning in the proposed Description Logic is EXPTIME-complete as for the underlying standard Description Logic ALC. (shrink)

Translation of Aristotle's Posterior Analytics I into Portuguese, with a few notes, experimental glossary and introduction. The translation, which was made at 2003/4, was preliminary and its publication was intended to provide a didactic tool for courses as well as a provisional resource in research seminars. It needs some revision. I am currently working (slowly...) on the revision of the translation and a new revised one will surely appear at some point.

In Posterior Analytics 71b9 12, we find Aristotle’s definition of scientific knowledge. The definiens is taken to have only two informative parts: scientific knowledge must be knowledge of the cause and its object must be necessary. However, there is also a contrast between the definiendum and a sophistic way of knowing, which is marked by the expression “kata sumbebekos”. Not much attention has been paid to this contrast. In this paper, I discuss Aristotle’s definition paying due attention to this contrast (...) and to the way it interacts with the two conditions presented in the definiens. I claim that the “necessity” condition ammounts to explanatory appropriateness of the cause. (shrink)

In this article, we apply the literature on the ethics of choice-architecture (nudges) to the realm of virtual reality (VR) to point out ethical problems with using VR for empathy-based nudging. Specifically, we argue that VR simulations aiming to enhance empathic understanding of others via perspective-taking will almost always be unethical to develop or deploy. We argue that VR-based empathy enhancement not only faces traditional ethical concerns about nudge (autonomy, welfare, transparency), but also a variant of the semantic variance problem (...) that arises for intersectional perspective-taking. VR empathy simulations deceive and manipulate their users about their experiences. Despite their often laudable goals, such simulations confront significant ethical challenges. In light of these goals and challenges, we conclude by proposing that VR designers shift from designing simulations aimed at producing empathic perspective-taking to designing simulations aimed at generating sympathy. These simulations, we claim, can avoid the most serious ethical issues associated with VR nudges, semantic variance, and intersectionality. (shrink)

In this paper, we develop an impure somatic theory of emotion, according to which emotions are constituted by the integration of bodily perceptions with representations of external objects, events, or states of affairs. We put forward our theory by contrasting it with Prinz's pure somatic theory, according to which emotions are entirely constituted by bodily perceptions. After illustrating Prinz's theory and discussing the evidence in its favor, we show that it is beset by serious problems—i.e., it gets the neural correlates (...) of emotion wrong, it isn't able to distinguish emotions from bodily perceptions that aren't emotions, it cannot account for emotions being directed towards particular objects, and it mischaracterizes emotion phenomenology. We argue that our theory accounts for the empirical evidence considered by Prinz and solves the problems faced by his theory. I discuss what Aristotle means when he say that scientific demonstration must proceed from necessary principles. I argue that, for Aristotle, scientific demonstration should not be reduced to sound deduction with necessary premises. Scientific demonstration ultimately depends on the fully appropriate explanatory factor for a given explanandum. This explanatory factor is what makes the explanandum what it is. Consequently, this factor is also unique. When Aristotle says that demonstration must proceed from necessary principles, he means that each demonstration requires the (...) principle that is the necessary one for the fully appropriate explanation of its explanandum. This picture also provides a key to understand Aristotle's thesis that scientific explanation depends on essences: it is the essence of the attribute to be explained that should be stated as the fully appropriate explanatory factor. Experiences like pains, pleasures, and emotions have affective phenomenal character: they feel pleasant or unpleasant. Imperativism proposes to explain affective phenomenal character by appeal to imperative content, a kind of intentional content that directs rather than describes. We argue that imperativism is on the right track, but has been developed in the wrong way. There are two varieties of imperativism on the market: first-order and higher-order. We show that neither is successful, and offer in their place a new theory: reflexive (...) imperativism. Our proposal is that an experience P feels pleasant in virtue of being constituted by a Command with reflexive imperative content, while an experience U feels unpleasant in virtue of being constituted by a Command with reflexive imperative content : More of P!Less of U! Analyzing geometric properties of high-dimensional loss functions, such as local curvature and the existence of other optima around a certain point in loss space, can help provide a better understanding of the interplay between neural network structure, implementation attributes, and learning performance. In this work, we combine concepts from high-dimensional probability and differential geometry to study how curvature properties in lower-dimensional loss representations depend on those in the original loss space. We show that saddle points in the original space are (...) rarely correctly identified as such in expected lower-dimensional representations if random projections are used. The principal curvature in the expected lower-dimensional representation is proportional to the mean curvature in the original loss space. Hence, the mean curvature in the original loss space determines if saddle points appear, on average, as either minima, maxima, or almost flat regions. We use the connection between expected curvature in random projections and mean curvature in the original space (i.e., the normalized Hessian trace) to compute Hutchinson-type trace estimates without calculating Hessian-vector products as in the original Hutchinson method. Because random projections are not suitable to correctly identify saddle information, we propose to study projections along dominant Hessian directions that are associated with the largest and smallest principal curvatures. We connect our findings to the ongoing debate on loss landscape flatness and generalizability. Finally, for different common image classifiers and a function approximator, we show and compare random and Hessian projections of loss landscapes with up to about 7×10^6 parameters. (shrink)

Aristotle contrasts episteme and doxa through the key notions of universal and necessary. These notions have played a central role in Aristotle’s characterization of scientific knowledge in the previous chapters of APo. They are not spelled out in APo I.33, but work as a sort of reminder that packs an adequate characterization of scientific knowledge and thereby gives a highly specified context for Aristotle’s contrast between episteme and doxa. I will try to show that this context introduces a contrast in (...) terms of explanatory claims: on the one hand, episteme covers those claims which capture explanatory connections that are universal and necessary and thereby deliver scientific understanding; on the other hand, doxa covers the explanatory attempts that fail at doing so. I examine Aristotle’s definition of scientific knowledge in Posterior Analytics 71b 9-12 and try to understand how it relates to the sophistical way of knowing and to "kata sumbebekos knowledge". I claim that scientific knowledge of p requires knowing p by its appropriate cause, and that this appropriate cause is a universal (katholou) in the restricted sense Aristotle proposes in 73b 26-27 ff., i.e., an attribute coextensive with the subject (an extensional feature) and predicated of the subject in itself (an (...) intensional feature). Kata sumbebekos knowledge, on the other hand, can occur even when the predicate of a conclusion is coextensive with its subject and is proved by a convertible meson which is not the most appropriate from an explanatory standpoint. In popular culture psychopaths are inaccurately portrayed as serial killers or homicidal maniacs. Most real-world psychopaths are neither killers nor maniacs. Psychologists currently understand psychopathy as an affective disorder that leads to repeated criminal and antisocial behavior. Counter to this prevailing view, I claim that psychopathy is not necessarily linked with criminal behavior. Successful psychopaths, an intriguing new category of psychopathic agent, support this conception of psychopathy. I then consider reactive attitude theories of moral responsibility. Within this tradition, psychopaths are (...) thought to be blameless as a result of their pronounced affective deficits. Psychopaths are considered morally blind because they lack the moral emotions that make us sensitive to moral reasons. I argue that, even if they are morally blind, psychopaths remain open to forms of blame stemming from non-moral reactive attitudes. These reactive attitudes remain appropriate because psychopaths can express hateful, disgusting, or contemptible non-moral values in their judgments. (shrink)

I discuss the exact meaning of the thesis according to which the object of scientific knowledge is necessary. The thesis is expressed by Aristotle in the Posterior Analytics, in his definition of scientific knowledge. The traditional interpretation understands this definition as depending on two parallel and independent requirements, the causality requirement and the necessity requirement. Against this interpretation, I try to show, through the examination of several passages that refer to the definition of scientific knowledge, that the necessity requirement specifies (...) more exactly the causality requirement: what cannot be otherwise is the explanatory relation between the explanandum and the cause by which it is what it is. I discuss the methodological passage in the begin- ning of Ethica Eudemia I.6 (1216b26-35), which has received attention in connection with Aristotle’s notion of dialectic and his methodology in Ethics. My central focus is not to discuss whether Aristotle is prescribing and using what has been called the method of endoxa. I will focus on how this passage coheres with the remaining parts of the same chapter, which also are advancing methodological remarks. My claim is that the meth- od of (...) Ethica Eudemia I.6 is in agreement with many features of Aristotle’s theory of explanation as presented in the Posterior Analytics: Aristotle’s main concern is a warning against misuses of explanatory arguments. This paper examines Aristotle’s notion of priority with the specific aim of capturing the sort of priority that characterizes the primacy of substances in his metaphysics. I reject the traditional interpretation, which understands the ontological priority of substances in terms of independent existence. But there are rather two sorts of priority: the ontological priority of substances should be understood in terms of completeness, whereas the ontological priority of “substances-of-something” (the essences) is a causal-explanatory priority. Furthermore, an important piece of Aristotle’s (...) argument against Platonism is that these two sorts of priority – namely, the completeness priority and the causal-explanatory priority – should be kept distinct. This paper discusses some issues concerning the definition of moral virtue in Nicomachean Ethics 1106b 36- 1107a 2. It is reasonable to expect from a definition the complete enumeration of the relevant features of its definiendum, but the definition of moral virtue seems to fail in doing this task. One might be tempted to infer that this definition is intended by Aristotle as a mere preliminary account that should be replaced by a more precise one. The context of the argument (...) Aristotle develops in Book II of his NE give us some help. I argue that the definition of moral virtue, once considered in the light of its context, is far from being an incomplete and provisional account: it rather introduces coherently the same notion of moral virtue that Aristotle employs in other texts (as in Nicomachean Ethics VI 13). My main proposal is that the way in which "hexis" is understood in the context of previous chapters allows Aristotle to encode in it the notion of an ability to do the right things regularly. Thus, moral virtue is a "hexis prohairetike etc.", but the ability to do the right things regularly is already encoded in the occurrence of "hexis" in the definiens account of moral virtue, as if Aristotle meant "hexis [praktike] prohairetike". This is an introductory handbook for some of the main themes around the notion of predication in Aristotle. It does not aim at being exhaustive, but only sketches some important lines about the subject; it contains an introductory essay, besides the translation (into Portuguese) and commentary of basic texts (such as Posterior Analytics I-22, Categories 1-5, Interpretation 1-6 etc.).

This paper discusses the contrast between scientific knowledge and opinion as it is presented by Aristotle in Posterior Analytics A.33. Aristotle's contrast is formulated in terms of understanding or not understanding some "necessary items". I claim that the contrast can only be understood in terms of explanatory relevance. The "necessary items" are middle terms (or explanatory factors) that are necessary for the fully appropriate explanation. This approach gives a coherent interpretation of each step in the chapter.

Joint attention customarily refers to the coordinated focus of attention between two or more individuals on a common object or event, where it is mutually “open” to all attenders that they are so engaged. We identify two broad approaches to analyse joint attention, one in terms of cognitive notions like common knowledge and common awareness, and one according to which joint attention is fundamentally a primitive phenomenon of sensory experience. John Campbell’s relational theory is a prominent representative of the latter (...) approach, and the main focus of this paper. We argue that Campbell’s theory is problematic for a variety of reasons, through which runs a common thread: most of the problems that the theory is faced with arise from the relational view of perception that he endorses, and, more generally, they suggest that perceptual experience is not sufficient for an analysis of joint attention. Affective experiences such as pains, pleasures, and emotions have affective phenomenology: they feel pleasant. This type of phenomenology has a loopy regulatory profile: it often motivates us to act a certain way, and these actions typically end up regulating our affective experiences back. For example, the pleasure you get by tasting your morning coffee motivates you to drink more of it, and this in turn results in you obtaining another pleasant gustatory experience. In this article, we argue that reflexive imperativism (...) is the only intentionalist account of affective phenomenology—probably, the only account at all—that is able to make sense of its loopy regulatory profile. I discuss in this paper the six requirements Aristotle advances at Posterior Analytics A-2, 71b20-33, for the premisses of a scientific demonstration. I argue that the six requirements give no support for an intepretation in terms of “axiomatization”. Quite on the contrary, the six requirements can be consistently understood in a very different picture, according to which the most basic feature of a scientific demonstration is to explain a given proposition by its appropriate cause.

I discuss Aristotle's treatment of essence and definition in Metaphysics VII.4. I argue that it is coherent and perfectly in accord with its broader context. His discussion in VII.4 offers, on the one hand, minimal criteria for what counts as definition and essence for whatever kind of object, but also, on the other hand, stronger criteria for a primary sort of definition and essence—and thereby it serves the interest of book VII in pointing to the explanatory power of the essence (...) of composite substances. We aim to generate a dilemma for virtual reality-based research that we motivate through an extended case study of Judith Thomson’s (1985) Bridge variant of the trolley problem. Though the problem we generate applies more broadly than the Bridge problem, we believe it makes a good exemplar of the kind of case we believe is problematic. First, we argue that simulations of these thought experiments run into a practicality horn that makes it practically impossible to produce them. These problems revolve (...) around concepts that we call “perspectival fidelity”and “context realism.” Moral dilemmas that include features present in the Bridge variant will, as a result, be practically impossible to simulate. We also argue that, should we be wrong about the practical impossibility of creating a VR simulation of Bridge, such a simulation must face an ethical horn which renders these simulations ethically impermissible to develop or use. For these reasons, we argue that it is virtually impossible to simulate the bridge problem (and other thought experiments with similar features) both practically and ethically in VR. (shrink)

This book discusses Aristotle’s notions of essence and substance as they are developed in Metaphysics ZH. I examine Aristotle's argument at length and defends an unorthodox interpretation according to which his motivation is to provide an answer against a conflation between criteria for existential priority (delivering substances as primary beings) and criteria for explanatory priority (delivering essences as primary principles).

This paper explores some aspects of Aristotle’s notion of subject for predications. I examine the argument Aristotle develops in Posterior Analytics I.22, 83a1-14. I argue that the notion advanced by Aristotle in that argument is different from the one found in his Categories, although they are far from being incompatible with each other. I also add some philological considerations to justify the Portuguese translation of “hypokeimenon” as “algo subjacente” (“underlying thing”) instead of “sujeito” (“subject”).

In this paper, we assess the impact of extended reality technologies as they relate to sexual forms of harassment. We begin with a brief history of the nature of sexual harassment itself. We then offer an account of extended reality technologies focusing specifically on psychological and hardware elements most likely to comprise what has been referred to as “the metaverse”. Although different forms of virtual spaces exist (i.e., private, semi-private, and public), we focus on public social metaverse spaces. We do (...) this to better explain how the concept of sexual harassment must be adjusted to such spaces and how approaches aimed at mitigating harassment must be sensitive to the type of metaverse spaces users utilize. We then offer a typology of sexual harassment for the metaverse focusing on three distinct forms of sexual harassment: (1) invariant (2) mixed variance or modified and (3) unique or metaverse specific. Although existing normative and legal frameworks may function well with respect to the first and, possibly, second forms of harassment, we argue such frameworks will not helpfully address metaverse-specific harassment. Ultimately, the changing nature of privately owned public spaces (POPS) which metaverses are likely to represent pose distinct ethical and regulatory challenges. (shrink)

I discuss the notion of education or educatedness (paideia) involved in the ‘educated human being’ (pepaideumenos), which Aristotle presents at the beginning of his Parts of Animals and a few other passages. The competence of educated human beings makes them able to evaluate some aspects of the explanations in a given domain without having a determinate knowledge about the specific subject-matter in that domain. I examine how such a competence is possible and how it is related to other critical abilities (...) which Aristotle usually ascribes to the science of being qua being. Discuto a noção de educação ou cultura (paideia) envolvida na figura do ser humano cultivado (pepaideumenos), que Aristóteles apresenta no início do tratado As Partes dos Animais e em algumas outras passagens. A competência do ser humano cultivado o habilita a avaliar certo aspecto das explicações propostas em um dado domínio, sem requerer dele um conhecimento determinado sobre o assunto específico do mesmo domínio. Examino de que modo essa competência é possível e como ela se articula a outras habilidades críticas que Aristóteles geralmente associa à ciência do ser enquanto ser. (shrink)

Evaluativism (Carruthers 2018) and reflexive imperativism (Barlassina and Hayward 2019) agree that valence—the (un)pleasantness of experiences—is a natural kind shared across all affective states. But they disagree about what valence is. For evaluativism, an experience is pleasant/unpleasant in virtue of representing its worldly object as good/bad; for reflexive imperativism, an experience is pleasant/unpleasant in virtue of commanding its subject to get more/less of itself. I argue that reflexive imperativism is superior to evaluativism according to Carruthers’s own standards. He maintains that (...) a theory of valence should account for its phenomenology and role in imagination-based decision-making. I show that it is reflexive imperativism, rather than evaluativism, that fits this explanatory bill. (shrink)
