St. Thomas Aquinas has always considered intelligence a potency higher than the will, absolutely speaking. That being said, and in my view, the existential primacy of the will in the act of freedom (particularly in choosing the existential end) is also indisputably Thomistic, as Cornelio Fabro has shown. This paper endeavors to explain Aquinas' doctrine on the absolute primacy of the intellect and thus show that these two primacies can be affirmed coherently, that is, (...) the intellect’s absolute primacy and the will’s existential primacy. Firstly, I will explain the reasoning St. Thomas Aquinas uses in the Summa to justify the absolute primacy of the intellect over the will. Secondly, I will explore some parallel texts, in order to shed light on my interpretation of the Summa and expand our view regarding this and related doctrinal points. Thirdly, I will offer a brief study of Fabro’s position, one in which his concerns regarding the intellect’s absolute primacy are taken into account and carefully considered. (shrink)

This paper deals with the question of agency and intentionality in the context of the free-energy principle. The free-energy principle is a system-theoretic framework for understanding living self-organizing systems and how they relate to their environments. I will first sketch the main philosophical positions in the literature: a rationalist Helmholtzian interpretation (Hohwy 2013; Clark 2013), a cybernetic interpretation (Seth 2015b) and the enactive affordance-based interpretation (Bruineberg and Rietveld 2014; Bruineberg et al. 2016) and will then show how agency (...) and intentionality are construed differently on these different philosophical interpretations. I will then argue that a purely Helmholtzian is limited, in that it can account only account for agency in the context of perceptual inference. The cybernetic account cannot give a full account of action, since purposiveness is accounted for only to the extent that it pertains to the control of homeostatic essential variables. I will then argue that the enactive affordance-based account attempts to provide broader account of purposive action without presupposing goals and intentions coming from outside of the theory. In the second part of the paper, I will discuss how each of these three interpretations conceives of the sense agency and intentionality in different ways. (shrink)

The objective of this article is to compare and contrast the influential notion of natural and property rights created by John Locke in his "Second Treatise on Government" (1689) to the posterior notion of abstract right expressed by Georg Wilhelm Friedrich Hegel in his "Elements of the Philosophy of Right". Said analysis is particularly pertinent given the complexity of Hegel’s political philosophy, and, perhaps more importantly, seeing as Hegel’s abstract right was (allegedly and in part) intended to point out the (...) shortcomings of Locke’s theory of natural and property rights, in order to further the human understanding of the world. More specifically, this article will examine the two rights theories in terms of their respective amounts of emphasis on individualism, or lack thereof. It will reveal three areas in which Lockean rights are more geared towards the primacy of the individual than Hegelian rights: (1) in their respective understandings of what it means to be a person, (2) in their conduciveness to individual wellbeing through the obligations each theory entails, and (3) in the extent of the rights themselves in relation to the state. They as well as other ethnic nationalities that constitute Nigeria, found themselves bound (...) to the contingencies and exigencies of the nation-state called Nigeria not by act of will or treaty but by the Lugardian fiat which in itself was a full expression of the British imperialist will to power. By fiat and history, a country was made; the country is Nigeria, its people simply are; a fact of history. Their mode of being however, is a confluence of contraction and progress. So many models of nationhood explicates Nigeria. But Nigeria, is undeniably a “torn” nation. In the words of Samuel Huntington, a nation of conflicting civilizations: the Islamic civilization and the Judeo-Christian civilization. The Ijaws, an oil rich minority tribe found themselves entwined and involved in the destiny of this phenomenal nation called Nigeria. Has such an entwinement been a curse or blessing? Have the Ijaws significant power in the organogram of the Nigerian nationhood? Are they tossed about by the tide and flow of events or are they active movers in the making of the Nigerian history? This paper critically looks at these existential realities and elucidates the existential condition of the Ijaws in the contemporary Nigeria . (shrink)

What follows is an investigation of the ontology of Franz Brentano with special reference to Brentano's later and superficially somewhat peculiar doctrine to the effect that the substances of the material world are three dimensional places. Taken as a whole, Brentano's philosophy is marked by three, not obviously compatible, trait. In the first place, his work is rooted in the metaphysics of Aristotle, above all in Aristotle's substance/accident ontology and in the Aristotelian theory of categories. In the second place, Brentano (...) embraced a Cartesian epistemology. He saw the source of all knowledge as residing in our direct awareness of our own mental phenomena and in our capacity to grasp evident incompatibilities in the realm of concepts.) Thirdly, he regarded the existence of an external world as at most probable, and denied outright the existence of a world similar to the world that is given in experience. Finally, and in some sense linking together these opposing strands, he propagated an idea of what he called "descriptive psychology", a discipline which would on the one hand yield exact knowledge of the structures and categories of mental life, and on the other hand provide an epistemologically sure foundation for other branches of philosophy. As we shall see, it is this psychological aspect of Brentano's philosophy which leads him to his conception of the substantiality of place. Surprisingly, however, the psychological considerations which underlie Brentano's thinking will be shown to raise a series of questions strictly ontological in nature, questions which are not without a systematic interest of their own. Ricoeur’s application of phenomenology to the existential human condition brings us to an understanding of human freedom in the light of an embodied human existence that is acting or willing or choosing freely, voluntarily, and responsibly. Human will is not therefore a concept or an abstract manipulated by the powers of the intellectuals. Rather, it is about man’s action, his agency, his being a doer, the one willing, instead of being just the one thinking or loving. Likewise, Ricoeur’s (...) recourse to existentialism sheds light to our faulted condition. We could say of a negation of man as a willing being: while man is capable of willing, he wills with recognition of his limitations. He always wills within the bounds of his finitude. Indeed, there is always this tension yet there is also this fusion. Nonetheless, it is possible for man to live in this contradiction as contradictions. Man is harmonic in contradictions. This paper explores R. D. Laing's application of existential and phenomenological tradtions, specifically Hegel and Heidegger, to his groundbreaking work with psychotic process as well as psychotherapeutic practice more generally.

Personal recovery entails the idea of learning to live a good life in the face of mental illness. It takes place in a continuous dynamic between change and acceptance and involves the existential dimension in the broadest sense. With cognitive self-regulation and empowerment as central elements, however, current models of recovery mostly have an individual focus instead of a relational one. Furthermore, there seems to be an emphasis on the component of change. Little attention is payed to the role (...) and integration of dealing with loss in personal recovery. In this paper, the role of loss in mental illness will be elaborated from an existential perspective. This will be done by relating existential changes to possibly disruptive experiences of loss in wider experience. With the help of several perspectives on dealing with loss it will be argued this can be integrated in processes of recovery. Then, it will be elaborated how reexperiencing a state of being surrounded, or being included, being held is a necessary part of recovery. The result consists of a refinement of the view on personal recovery. The aim of this paper is therefore twofold: (1) to arrive at a better understanding of what existential loss and loss in wider experience in the context of psychopathology entails, and (2) to further develop perspectives on recovery in mental health care. Malone Dies marks the point where Samuel Beckett foremost turns to “metaphysical destruction” of “untrue self,” and Derrida’s critique of the notion of “self-presence” of the subject. In this article, I examine Beckett’s literary absurdities to his readers’ concerns of “abuse” through them. For this investigation Malone Dies posits a stream of conflicting “linguistic nihilism” to the concerns of deconstructing “untrue self,” arguably, which will reflect how abuse of Beckettian readers is stimulated. In this context, abuse is specific forms (...) of emotional tensions aroused by the readers encounter with the Beckettian intersubjectivity. In particular, the existential model of abuse will be analysed as a part of beyond “self-deconstruction” autonomy. (shrink)

In this article, an attempt will be made to analyse the Jesuit drama of Georg Bernardt, in terms of its existential philosophy content. It will become apparent that the Jesuits, in accordance here with reformatory theology, assume the existence of a normative facticity. In this normative facticity, the Jesuits then, in most profound conflict with reformatory thought, believe in the possibility to work towards one’s state of grace.

This paper is an analysis of one theoretical facet of the problem of Buddhist participation in closed nationalist discourses: the essential relationship between the dislocation of subjectivity (or the emptying of ego) and the formation of communities (such as a nation-state or a Volk). Through this, I hope to explore the effects disciplines of subjectivity (including Buddhism) might have on socio-political formations (such as closed nationalism or imperialism). In order to do so, I will compare two key works in (...) which the existential structure of ethical community is examined: Watsuji Tetsurō's Ethics (Rinrigaku jōkan 倫理学 上巻 1937) and Jean-Luc Nancy's The Inoperative Community (La Communauté désœuvrée 1983). -/- In the first section, after briefly introducing the two thinkers, I will examine their views on the basic structure of the individual and community and how it leads to a sense of ethics. In the second section, I will delve into the essential differences between Watsuji and Nancy, beginning with their differing responses to Heidegger's notion of being-toward-death. I will then proceed to a critical re-reading of Watsuji's ethics possible from Nancy's thought. I will end by connecting the results of this comparative study to the problem of Buddhist involvement in immanent nationalism, in hopes of shedding light on one key theoretical aspect of this multi-faceted problem. Most analytic philosophers believe that the existential quantifier, ∃, has ontological import. Mario Bunge was one of the first thinkers to challenge this view. He traces a distinction between the quantifier ∃ and a first-order existence predicate. Furthermore, he acknowledges two kinds of existence: real and conceptual. One of the reasons for accepting Bunge’s proposal is that it can do justice to statements about fictional entities, which is something that rival proposals do not seem to be capable of doing. (...) One of the controversial issues in the development of Heidegger’s thought is the problem of the will. Th e communis opinio is that Heidegger embraced the concept of the will in a non-critical manner at the beginning of the thirties and , in particular, he employed it in his political speeches of 1933–1934. Jacques Derrida for instance speaks about a “massive voluntarism” in relation to Heidegger’s thought in this period. Also Brett Davis discerns a period of “existential (...) voluntarism” in 1930–1934, in which Heidegger takes over a notion of the will in a non-critical manner. In this article, this interpretation is challenged and a stronger interpretation of Heidegger’s concern with the will is developed. Our hypothesis is that Heidegger’s concern with the will at the onset of the thirties is brought about by his confrontation (Auseinandersetzung) with the concept of the will. Based on his lecture courses from 1930 and 1936/37 and his Rectoral Address from 1933, enables us to discern three main characteristics of Heidegger’s destructed concept of the will in the early thirties. The institute of education in modern society is currently in the process of serious transformation associated with the large-scale introduction of high technologies, which is due to a similar process in post-industrial society as a whole. There is a growing understanding of the negative consequences of digitalization of society and education along with the understanding of the objective necessity of such transformation. The article contains an analysis of the negative consequences and problems arising in the course of the spread of (...) digitalization of higher education in Russia. Methodology and sources . The methodology of the research is based on the methods of comparative analysis and extrapolation of transformations of social environment and anthropological factors under the influence of technological progress in the field of higher education. The signs of “high technology poisoning” considered by J. Naisbitt in his book “High Tech – High Touch: Technology and Our Search for Meaning” and the concept of extensive and intensive types of creativity formulated by A.I. Stoletov are a conceptual basis for analyzing the impact of high technology on education. Results and Discussion . Seven symptoms of technological poisoning in higher education, representing the main risks of the modern educational system, their manifestations in the educational process and prospects in case the existing trend persists, have been considered. One of the sources of manifestation of these symptoms is the extensive character of creativity inherent in scientific and technological activity of the society, which stakes on innovative development and mastering of material aspects of nature. The technogenic character of the emerging innovation process levels out the activities associated with the intensive type of creativity, aimed at the meaning-creating and existential aspects of human existence. Conclusion. Minimization of negative consequences presupposes the strengthening of the humanitarian component in education, allowing to form a culture of “pause of contemplation” (Grigory Pomerantz), in which technology will acquire, as it was suggested by J. Naisbitt himself, a fullness of meaning that goes beyond instrumental values into the realm of ethical and existential ones. (shrink)

In the Freedom essay, Schelling charges that (1) idealism fails to grasp human freedom’s distinctiveness and that (2) this failure undermines idealism's attempt to refute pantheism, as exemplified by Spinoza. This raises two questions, which I will answer in turn: what, for Schelling, is distinctive of human freedom; and how does the idealists’ failure to grasp it render them unable to refute pantheism? To answer these questions, I will reconstruct Schelling’s argument that freedom has the distinctness of being (...) the unconditioned condition of the world’s intelligibility. My reconstruction will illustrate how Schelling’s notion of freedom as primal will grounds the alleged primacy of practical reason as Kant and Fichte conceive it. I will then consider three objections to Schelling’s argument. Throughout, I will develop the Schellingian idea that freedom is enacted in an unprethinkable decision that cannot be anticipated by any law or principle. (shrink)

Paper presented at the Heidegger Circle 2011. Although Aristotle’s influence on young Heidegger’s thought has been studied at length, such studies have almost exclusively focused on his interpretation of Aristotle’s ethics, physics and metaphysics. I will rather address Heidegger’s appropriation of Aristotle’s ontology of life. Focusing on recently published or recently translated courses of the mid 20’s (mainly SS 1924, WS 1925-26 and SS 1926), I hope to uncover an important aspect of young Heidegger’s thought left unconsidered: namely, that (...) Dasein’s existential structures – Befindlichkeit, Understanding and being-with-one-another through language – arose from his close reading of Aristotle’s ontology of life, of animal life. (shrink)

Schnieder (2020) argues, against Orilia (2009) and Koslicki (2013), that claims of existential grounding of the form “the fact that x exists is grounded in the fact that y is F” cannot be grounded in claims of existential dependence of the form “x existentially depends on y” and defends the view that the latter claims are grounded, via a definition of existential dependence, in the former. I will firstly argue that Schnieder’s main point against the claim (...) that existential grounding is grounded in existential dependence is not conclusive; I will then put forward a proposal concerning how claims of existential grounding can be grounded in claims of existential dependence. The proposal is a third way between those of Schnieder and Orilia/Koslicki which, although accepting the former’s definition of existential dependence in terms of grounding, makes room for the latter’s idea that existential dependence does the real job in structuring reality. This article discusses a relation between the formal science of logical semantics and some monotheistic, polytheistic and Trinitarian Christian notions. This relation appears in the use of the existential quantifier and of logical-modal notions when some monotheistic and polytheistic concepts and, principally, the concept of Trinity Dogma are analyzed. Thus, some presupposed modal notions will appear in some monotheistic propositions, such as the notion of “logically necessary”. From this, it will be shown how the term “God” is (...) a polysemic term and is often treated as both subject and predicate. This will make it clear that there is no plausible intellectual justification for believing that the term “God” can only be used as a name and never as a predicate, and vice versa. After that analysis, I will show that the conjunction of the “Trinity Dogma” with some type of “monotheistic position” would necessarily imply some class of absurdity and/or semantic “oddity”. The ongoing evolution of advanced AI systems will have profound, enduring, and significant impacts on human existence that must not be overlooked. These impacts range from empowering humanity to achieve unprecedented transcendence to potentially causing catastrophic threats to our existence. To proactively and preventively mitigate these potential threats, it is crucial to establish clear redlines to prevent AI-induced existential risks by constraining and regulating advanced AI and their related AI actors. This paper explores different concepts of AI (...) class='Hi'>existential risk, connects the enactment of AI red lines to broader efforts addressing AI's impacts, constructs a theoretical framework for analyzing the direct impacts of AI existential risk, and upon that proposes a set of exemplary AI red lines. By contemplating AI existential risks and formulating these red lines, we aim to foster a deeper and systematic understanding of the potential dangers associated with advanced AI and the importance of proactive risk management. I present an image of humanity as the will to power expressed in context of affirmationand danger in the eternal return. Nietzsche argues the death of God not as a theological argument but as an existential challenge for humanity to be re-experienced. It is read in light of the eternal return: without ontological references or quasi-transcendentals, how is life to be lived? Deleuze contextualizes Nietzsche’s critique of nihilism qua a typology of active and reactive modes of being, however (...) I go beyond to provide what I consider an anthropological account. I do this by differentiating the will to power from individual willing and present the danger that an affirmation of life entails. Nietzsche challenges us with the eternal return. With this, one is led to realize that she is her own destruction (Untergehen) at the same time as her overture (Übergehen). She has the ability, power, capacity to overcome and self-create. With this realization one ought to remain truthful to this in form of truth-telling (Redlichkeit). Nietzsche projects humanity as a perilous crossing over from nihilism to affirmation with an embrace of an ethics of danger. This crossing over is a mark of life as the will to power. It is an overcoming of nihilism and the assurance amidst nihilism’s farce that the godhead is dead and that the eternal return is a daunting challenge we cannot escape from. With these, we are afforded an image of humanity as the will to power. (shrink)

Whence comes the evil will? My paper examines Kant’s notion of radical evil and Kierkegaard’s analysis of sin in order to uncover the existential-ontological dynamic of the evil will. Ultimately, I argue, the evil will arises in response to the anxiety inherent in freedom itself. I conclude with an examination of Kierkegaard’s ‘formula of faith’ as a solution to the dilemma of freedom, and consider the role faith may play in freedom’s moral maturation.

In Schopenhauer’s thought, the will’s primacy over the intellect seems to suggest that the intellect plays no role in determining what we do. I provide an alternative picture of the intellect as actively deliberating and choosing in abstract cognition from what it passively receives from the will in natural cognition.

According to Mulla Sadra, the will is an existential phenomenon that is free from the essence. Therefore, there is no essential and correlational definition which contains its truth completely. As a matter of fact, the definition made by Mulla Sadra is a nominal definition. Mulla Sadra, unlike the former philosophers and the theologians, expressed that the will is homogeneous with existence for the first time. Moreover, he claims that characteristics of the will and the existence is (...) the same. According to this approach, the first feature of the will is that it has a shared meaning like existence. In other words, concept of the will involves the same signification when it is used about God and the creatures. The second feature of the will, like existence too, indicates varied existential grades. That is to say, the will is a single truth, but it has different existential grades and is manifested in a different way in every aspects of the being. Therefore, it has its own domination and is obligatory in some grades while it is only propable in others. In this way, Mulla Sadra solved the problems that would arise when the divine will has both essential and intellectual qualities. In addition, he explained that the will is eternal for God, temporal for the human beings. (shrink)

The Eucharist, as a pillar of Christian life and faith, stands at the center of the Mass. It bears multi-dimensional meanings and functions, each of which addresses a different aspect of Christian life and mindset. The study resonates dialectically between the Eucharist as a unique religious affirmation of faith and philosophical strategies that are developed to meet its challenges, particularly the rational frameworks by which the believer affirms that the consecrated bread and wine are Christ’s body and blood. On the (...) one hand, the philosophical examination offers new perspectives to understand the Eucharist and its influence on the faithful; on the other hand, the Eucharist and the unique challenges it poses allow us to examine man’s relation to reality within the colors of faith. It will be argued that Edward Schillebeeckx’s discussion of the Eucharist, particularly his attempt to bridge between reality and the symbolic sphere, accords with Heidegger’s reevaluation of the question of Being. The present reading limits itself to the encounter between the mind and the phenomenon and does not proceed to the meaning of the Eucharist as part of the Mass and the crucifixion of Christ. However, the focus of the article is not on the phenomenon but rather on the existential position of the subject and his orientation toward reality. (shrink)

This work is focused on the thought that the nature of communication between a father and his daughter influences how that woman will perceive her identity. It is known that a person's perception of his own identity affects his attitude. A person who has a positive perception of identity can realize himself by reaching his reality, while it is thought that a person with a negative and non-constructive perception of identity will experience difficulties in reaching his reality. The (...) objective of this thesis is to review father-daughter communication and attain its effects on how a woman perceives her identity. Father-daughter communication will be discussed based on the Existential Communication concept of the existential philosopher Karl Jaspers, who puts communication at the core of his philosophy. Semi-structured in-depth interviews were conducted with seven female participants who were identified by applying the snowball sampling recruitment technique. During the interviews, the participants were asked questions about their communication with their father. Records of the interviews were analyzed and resolved with the thick description method. The participant data obtained from the in-depth interviews was reviewed in the context of the Existential Communication concept and the findings include results that support the hypothesis of this master thesis work. Graham Greene's novels are often read with no reference to his Roman Catholic Faith. Particularly, in India there is little knowledge among both students and scholars about the primacy and the nature of the Roman Catholic Faith. They miss the point that the Roman Faith is a deeply Mysterious Faith. The term "Mystery" is used here in the Catholic sense of that Faith's 'Mysteries'. The essay and the long endnotes try to rectify the errors which creep in when Greene (...) is decontextualized from his Faith by logical positivists. In the name of the 'death of the author' religious relativists contaminated with the heresies of modernism misinterpret Greene. 'Heresies of Modernism' will be alien to those whose academic limits do not go beyond staid woke-seminars. -/- The essay is discursive in nature, but on purpose. It sees Greene's works through the lens of the Suffering Servant and Paul's Hymn to Love. It has to be kept in mind that Greene is a Roman Catholic writer who knew his Church's teachings well. Christianity is not a homogenous term. "Religious" in the essay often means those who are lead consecrated lives within the Catholic Church as distinct from diocesan clergy. (shrink)

Problems and questions originally raised by Robert Nozick in his famous thought experiment ‘The Experience Machine’ are frequently invoked in the current discourse concerning virtual worlds. Having conceptualized his Gedankenexperiment in the early seventies, Nozick could not fully anticipate the numerous and profound ways in which the diffusion of computer simulations and video games came to affect the Western world. -/- This article does not articulate whether or not the virtual worlds of video games, digital simulations, and virtual technologies currently (...) actualize (or will actualize) Nozick’s thought experiment. Instead, it proposes a philosophical reflection that focuses on human experiences in the upcoming age of their ‘technical reproducibility’. -/- In pursuing that objective, this article integrates and supplements some of the interrogatives proposed in Robert Nozick’s thought experiment. More specifically, through the lenses of existentialism and philosophy of technology, this article tackles the technical and cultural heritage of virtual reality, and unpacks its potential to function as a tool for self-discovery and self-construction. Ultimately, it provides an interpretation of virtual technologies as novel existential domains. Virtual worlds will not be understood as the contexts where human beings can find completion and satisfaction, but rather as instruments that enable us to embrace ourselves and negotiate with various aspects of our (individual as well as collective) existence in previously-unexperienced guises. Since the release of ChatGPT, there has been a lot of debate about whether AI systems pose an existential risk to humanity. This paper develops a general framework for thinking about the existential risk of AI systems. We analyze a two-premise argument that AI systems pose a threat to humanity. Premise one: AI systems will become extremely powerful. Premise two: if AI systems become extremely powerful, they will destroy humanity. We use these two premises to construct (...) a taxonomy of ‘survival stories’, in which humanity survives into the far future. In each survival story, one of the two premises fails. Either scientific barriers prevent AI systems from becoming extremely powerful; or humanity bans research into AI systems, thereby preventing them from becoming extremely powerful; or extremely powerful AI systems do not destroy humanity, because their goals prevent them from doing so; or extremely powerful AI systems do not destroy humanity, because we can reliably detect and disable systems that have the goal of doing so. We argue that different survival stories face different challenges. We also argue that different survival stories motivate different responses to the threats from AI. Finally, we use our taxonomy to produce rough estimates of ‘P(doom)’, the probability that humanity will be destroyed by AI. (shrink)

We subsist under the law where we claim our rights and are obliged to do something enforced. What is a law? The question would be perplexing in history, and one of crucial themes with many lawyers or legal philosophers. As we know, two most important perspectives had earned a universal and historical forge in academics, to say, the natural law and legal positivism. The concept of natural law deals in its primacy for the humanity and natural order which often (...) can be traded as something inviolable or inalienable. The concept has strands in several aspects; (i) its anchor with the civil democratic revolution around 17 and 18 centuries (ii) its supremacy with the new constitutional states (iii) less quality as a realist law from ambiguities and lack of clear definition. The concept of public policy may be related with the social justice, ethics and administration. It generally pursues a justice and desired state of public or community where the tension and conflict always exist between the ruling class and citizens. Historically, the public policy could be mightier to address the society than law where the benevolent Kings or Sovereigns liked to address both their needs and social justice. They may abrogate, more in endowment and divinity, the laws or social customs. The tension between the public power and private interests could be one reason as well as offers a good dualism in understanding the rule of law concept and advent of modern democracy. In this dimension, the King would no longer be divine nor entitled to exercise a plenary power of state rule. Instead, the popular sovereignty in the US democracy or parliamentary type in the UK were to be established to resolve a feudal conflict within the class and society. Lighted to be in vein of influence could arise the two contexts which are a contractarian view and plutocracy desire of the founding fathers. They underlay the mood and philosophical ethos of US revolution. Hence, three concepts as a pillar in private law were sanctified in the very foundation of US constitutional state, sanctity of property right, freedom of contract and due limits for the civil liability. The governmental power should be limited to protect the life and limb of citizens which addressed the Hobbes’ evil, “war against all the rest.” The due process concept was expressed as a fundamental principle of constitution where the human rights are inviolable and inalienable. The separation of powers principle could serve the freedom and wealth of new civil class in the continent, and bicameralism was devised for the check and balance within the federal congress. They see the role of judicial branch is important to preserve their civil interest. Then we can derive some assumptions between the law and public policy. First, a law plays to protect the private interest while the public policy pursues the social justice and mediates the competing interests, “private v. private” and “public v. private.” The civil courts may address a first nature of conflict and the law of takings or regulatory laws may deal with the second aspect. Second, the public or administrative law can shape a legal plane of bureaucracies or public administration, and may guarantee the rule of law ideals. It plays as an enabling authority and, on the other, monitors an arbitrariness and unfairness in the bureaucratic government. In this context, the unresponsive and unfathomable bureaucracy in the Kafka’s could be remedied. Third, for the welfare state in the late 19th and 20th century, a law can well be seen as one of authoritative expression of public policy to redress the evils of capitalist states. Some public laws, such as the Sherman Act classically and Lanham Act recently, may act to regulate the monopoly or oligopoly while other laws were enacted to restore justice between the labor and employers. Through the chapters, the fundamentals of law and public policy will be considered to address their proper status. (shrink)

The Church faces a number of challenges concerning the sociological impact postmodernism is having on society. And one very significant area that has been profoundly disputed is the epistemological content of the concept of truth. Evangelical Christians believe in Objectivism: the conviction that there exists some ahistorical (outside of history) source, foundation or framework to which we can appeal to in determining the substance and nature of truth, knowledge, reality, right or wrong that is independent and external to personal experience (...) or thinking. However, the majority of people no longer believe in absolute truth but in relativism. Relativism is the denial that there exists such an ahistorical source or foundation that we can appeal to. Truth, knowledge, reality, right and wrong are all concepts that are relative to a specific conceptual scheme, framework, or paradigm founded in a society, religion and culture. This paper represents an endeavour to dialogically reunite the two perspectives by arguing for the seeking of the truths in both perspectives. God is Objective Truth and has become involved in history: in the existential; in the material setting of our relative and infallible thoughts and the slanted interpretative experiences of the Triune God and life. The synthesis will be an affirmation that for Christians Truth is discovered and revealed in fellowship within community. And members of the Body of Christ are first and finally called to reveal and demonstrate truth to the world - in their unity. (shrink)

Discussions of the concept of authenticity often fail to define the conditions of an appropriate emotional orientation toward the world. With a more solid philosophical understanding of emotion, it should be possible to define more precisely the necessary conditions of emotional authenticity. Against this background, I interpret Kierkegaard’s Either/Or as a narrative text that suggests a moral psychology of emotion that points toward the development of a better way of thinking about the ethics of authenticity. In the process, I also (...) engage with the positions of other philosophers, both “existential” and “analytic.” The upshot of my argument is that a cognitive phenomenology of emotion can flesh out the ideal of truthfulness as a virtue of character, while forcing moral philosophers to question whether authenticity should be understood as an achievement of the will rather than as a matter of affective receptivity. Many manipulation arguments against compatibilism rely on the claim that manipulation is relevantly similar to determinism. But we argue that manipulation is nothing like determinism in one relevant respect. Determinism is a "universal" phenomenon: its scope includes every feature of the universe. But manipulation arguments feature cases where an agent is the only manipulated individual in her universe. Call manipulation whose scope includes at least one but not all agents "existential manipulation." Our responsibility practices are impacted in different ways (...) by universal and existential phenomena. And this is a relevant difference, especially on Strawsonian approaches to moral responsibility, which take facts about our responsibility practices to be deeply connected to the nature of responsibility itself. We argue that Strawsonian accounts of moral responsibility are immune to manipulation arguments, and no attempt to modify the scope of manipulation or determinism featured in these arguments will help incompatibilists secure their desired conclusion. A small but growing number of studies have aimed to understand, assess and reduce existential risks, or risks that threaten the continued existence of mankind. However, most attention has been focused on known and tangible risks. This paper proposes a heuristic for reducing the risk of black swan extinction events. These events are, as the name suggests, stochastic and unforeseen when they happen. Decision theory based on a fixed model of possible outcomes cannot properly deal with this kind of (...) event. Neither can probabilistic risk analysis. This paper will argue that the approach that is referred to as engineering safety could be applied to reducing the risk from black swan extinction events. It will also propose a conceptual sketch of how such a strategy may be implemented: isolated, self-sufficient, and continuously manned underground refuges. Some characteristics of such refuges are also described, in particular the psychosocial aspects. Furthermore, it is argued that this implementation of the engineering safety strategy safety barriers would be effective and plausible and could reduce the risk of an extinction event in a wide range of possible scenarios. Considering the staggering opportunity cost of an existential catastrophe, such strategies ought to be explored more vigorously. (shrink)

It is more than a platitude to admit that we are always dying. It is a recognition of the fundamental finitude that marks our existence as human persons. It says something essential about the human condition. We are all born. We all die. And the very living of life is, leaving aside for the moment religious considerations, oriented toward death. Phenomenologists make much of this observation, perhaps none more so than Martin Heidegger who argues that our being-toward-death permits the ontological (...) grasping of Da-sein as a whole. Indeed for him, the“existential and ontological concept of death” is “the own most nonrelational, certain, and, as such, indefinite and not to be bypassed possibility of Da-sein.” However, if one spends much time around those who are very close to death it can begin to sound disingenuous to talk about death as one’s own most possibility. It is easy to think these patients are dying—not me. Still, the phenomenologist might claim that, vis-à-vis our being-toward-death, the difference between me and the terminally ill patient is a matter of degree and not kind. But, is this so? One may be excused for thinking not. There appears to be an important difference in the kinds of possible experiences open to us. I may experience healing if I become ill; on the other hand, the very condition of the patient with a terminal illness is defined by the impossibility of her experiencing healing. The primary aim of this paper is to argue that the terminally ill patient can, in fact, experience healing at the end of her life and in the face of impending death. I will not argue that the possibility of experiencing healing at the end of life means leaving room for divine intervention, though neither do I intend to preclude such a possibility. Rather, I will argue that healing is something that we experience quite apart from what happens to our biological make-up. While healing is often correlated with a change in the state of our bodies, it need not be. (shrink)

One debate surrounding Derk Pereboom’s (2001, 2014) four-case argument against compatibilism focuses on whether, and why, we judge manipulated agents to be neither free nor morally responsible. In this paper, we propose a novel explanation. The four-case argument features cases where an agent is the only individual in her universe who has been manipulated. Let us call manipulation whose scope includes at least one but not all agents existential manipulation. Contrast this with universal manipulation, which affects all agents within (...) a universe. We propose that we find agents in Pereboom’s manipulation cases less free and morally responsible in part because they are the target of existential manipulation. We empirically tested this hypothesis and found that people’s free will and moral responsibility judgments were sensitive to the scope of manipulation: people judged existentially manipulated agents significantly less free and responsible than universally manipulated agents. Process philosophies tend to emphasise the value of continuous creation as the core of their discourse. For Bergson, Whitehead, Deleuze, and others the real is ultimately a creative becoming. Critics have argued that there is an irreducible element of (almost religious) belief in this re-evaluation of immanent creation. While I don’t think belief is necessarily a sign of philosophical and existential weakness, in this paper I will examine the possibility for the concept of universal creation to be a (...) political and ethical axiom, the result of a global social contract rather than of a new spirituality. I argue here that a coherent way to fight against potentially totalitarian absolutes is to replace them with a virtual absolute that cannot territorialise without deterritorialising at the same time: the Creal principle. Alan Turing, one of the fathers of computing, warned that Artificial Intelligence (AI) could one day pose an existential risk to humanity. Today, recent advancements in the field AI have been accompanied by a renewed set of existential warnings. But what exactly constitutes an existential risk? And how exactly does AI pose such a threat? In this chapter we aim to answer these questions. In particular, we will critically explore three commonly cited reasons for thinking that (...) We reflect on the nature of corporate codes of conduct is this article. Based on John Austin’s speech act theory, four characteristics of a performative concept of corporate codes will be introduced: 1) the existential self-performative of the firm identity, 2) which is demanded by and responsive to their stakeholders; 3) Because corporate codes are structurally threatened by the possibility of failure, 4) embracing the code not only consists in actual corporate responsible behaviour in light of the code, (...) but in the incessant recapturing of the code in the struggle of firms against the possible incongruence between their ethical principles and their actual responsible behaviour. A performative concept of corporate codes helps to bridge classical dichotomies like individualist versus collectivist approaches of moral agency and restrictive versus empowering ethics, and opens a new perspective on the interaction between individual ethical behaviour and the corporate institutionalisation of codes. In this essay I argue that a comprehensive understanding of addiction and its treatment should include an existential perspective. I provide a brief overview of an existential perspective of addiction and recovery, which will contextualize the remainder of the essay. I then present a case study of how the six-step philosophical practice method of Logic-Based Therapy can assist with issues that often arise in addiction treatment framed through an existential perspective.

The thesis defended is that ordinary perception does not present us with the existential independence of its objects from itself. The phenomenology of ordinary perception is mute with respect to the subject-object distinction. I call this view "phenomenal neutral monism" : though neutral monists are wrong about the metaphysics of perception (in every perceptual episode, there is a distinction between the perceptual act and its perceptual objet), they are right about its phenomenology. I first argue that this view is (...) not as counter-intuitive as it might initially seem, by stressing (i) that the lack of presentation of the mind-independence of perceptual objects does not entail their being presented as mind-dependent. (ii) That phenomenal neutral monism is true of ordinary perception in the thin sense, but not in the thick sense (that includes expectations, guesses, feelings etc. grounded on thin perception). (iii) That the concept of a perceptual perspective or point of view should not be confused with the concept of the subject or intentional act of perception. Second, I propose three positive arguments in favor of phenomenal neutral monism. (i) It does justice to the recurring idea that only resistance to our will presents us with the world qua independent from us. (ii) It does justice to the recurring idea that the most natural attitude towards the perceptual world is that of being absorbed in it. (iii) It is entailed by the view that intentional acts are phenomenally transparent (a view held by Russell and Moore, and most contemporary representationalists) together with the view that in order to be presented with a relation (here the act-object distinction) one has to be presented with its relata. This article synthesizes the current theoretical attempts to understand human-machine interactions and introduces seven premises to understand our emerging dynamics with increasingly competent, pervasive, and instantly accessible algorithms. The hope that these seven premises can build toward a social theory of human-AI cocreation. The focus on human-AI cocreation is intended to emphasize two factors. First, is the fact that our machine learning systems are socialized. Second, is the coevolving nature of human mind and AI systems as smart devices form an (...) indispensable part of our cognitive scaffolds, thus, shaping how we perceive the world and ourselves. The seven premises include: primacy of social structures; human’s desire for freedom and autonomy; AI systems will form inseparable parts of our cognitive/affective scaffolds and can change our self-understanding; philosophy and humanistic foundations on human flourishing as a guide to human-AI interaction; mindsponge information-filtering process; acculturative process of how values change and emerge from human-AI interaction; overlapping Venn diagram of the human-human, human-nature, and human-machine interactions. This article concludes with a discussion on human agency in our entanglements with socialized machines and the illusoriness of the Cartesian agent view of the mind. (shrink)

The article provides the analysis of the entrance into the innovative activity and organized regulation of interaction which is based on the scientific and technological changes, concentration of production and the feasibility study of administrative decisions, which are dominated by a conglomerate of technical, technological and engineering management decisions. The research formulates the provisions for the productive use of business as the form of economic relations which is based on the entrepreneur function. These provisions are formulated basing on the conditions (...) of efficient division of labour and cooperation. The research singles out a number of systemic positions which allow perceiving logically and distinguishing the production, service and business, to distribute human activities between the groups of occupations and types of service activities. Among these systemic provisions the most efficient is a modelling approach which, when the society enters more complex social and economic stage, transfers the science from the environment of operations with the bulk characteristics into the environment of the analysis of specific sets of coefficients. The logistics of Ukraine’s joining the process of business is associated with the position of the recognition of the primacy of the physical abilities of the person, which should be developed in part in the system of public security and partly in the business environment, commercialization and private capital. Person enters the business environment and habitat as an initiative individual. These indicators are the following: «connections» between the old and the new, between the objects which exist and those which only start to appear and will exist in future; «sources» of development, movement, changes; «mechanism» of development, ways of changing from old to new quality; «direction» of development; «style» of thinking, understanding reality; «essence» of true knowledge; «essence itself» of cognition; «alternativeness» of metaphysics and dialectics. This paper attempts to bring the traditional theodicy on the question of evil and the Divine Providence, to its logical conclusion, in such a way that a believer is challenged to totally accept the implication of his or her faith in God. To have faith is to completely surrender to Divine Providence. It is to completely surrender ones free will to the rational conclusions or consequences of faith in the Divine Providence. Hence, this paper is for those who are (...) perplexed due to the Pandemic. Especially for Christians whose faith in God is perplexed because of their existential experience of the COVID 19 pandemic as evil. The existential reality of dread and misery caused by this pandemic is globally and more subjectively experienced due to the digitalization of this age. This shows how disastrously powerful the digitalization of our world can be in the proliferation of dread, misery and hopelessness. (shrink)

This essay aims to adumbrate the relationship between ordinary language, history, and cognition in Joseph Margolis’ pragmatist account of the historical constitution of the human, cultural world. It emphasizes the important connections between his arguments for the essentially practical grounding of all forms of cognitive activity; the existential primacy of the historically evolved ordinary language in the formation of aptly socialized human persons as well as of productively functioning human societies; the transformational role of consciousness in history, including (...) the history of cognition; and the insuperable informality inherent in all philosophical attempts to justify our historically articulated norms of cognition and our way of life. Margolis’ analysis of these relationships claims to show that cultural tolerance and historical plasticity deserve to displace the philosophical ideas of invariance and fixity as the favored resources of conceptual and social stability. This recognition, on Margolis’s view, constitutes pragmatism’s distinctive promise and advantage. (shrink)

One of the central questions of Jacques Derrida's later writings concerns the sources of religion. At times he gives explicit priority to the universal dimension of religion. In other places, however, he considers the primacy of faith in its concrete, historical context. This paper will clarify Derrida's relationship to universality and historicity by first comparing his notion of "messianicity without messianism" to that of Walter Benjamin's "weak Messianism." After drawing out these differences, I will focus on Derrida's (...) later writings. I will show that much of the ambiguity of Derrida's thinking on religion can be resolved by turning to his work on khōra, the Greek word for "space" or "matter." The rhetoric of khōra can allow us to think through a twofold logic, one that includes the universal/historical distinction and exceeds its alternatives. (shrink)

We might describe the philosophical issue of human freedom and moral responsibility as an existential metaphysical problem. Problems of this kind are not just a matter of theoretical interest and curiosity: They address issues that we care about and that affect us. They are, more specifically, relevant to the significance and value that we attach to our lives and the way that we lead them. According to the orthodox view, there is a tidy connection between skepticism and pessimism. Skepticism (...) threatens a wide range of interests and concerns that themselves rest on the foundation of our self-conception as responsible moral agents. From this perspective, whereas skepticism licenses a degree of pessimism about our human predicament, the defeat of skepticism serves to vindicate optimism. In recent years this orthodox view of the relationship between skepticism and pessimism has been challenged. It has been argued, for example, that skepticism may be defended in much more optimistic terms. While we have reason to accept skepticism, we have no reason to draw any bleak or depressing consequences from this. Another way of severing the orthodox connection between skepticism and pessimism is to reject skepticism but deny that this will serve to secure or salvage any unqualified form of optimism. This chapter reviews and contrasts these various positions and approaches, beginning with an account of P. F. Strawson’s particularly influential statement of the relationship between the skeptical challenge and pessimism. (shrink)
