We examine whether the "evidence of evidence is evidence" principle is true. We distinguish several different versions of the principle and evaluate recent attacks on some of those versions. We argue that, whatever the merits of those attacks, they leave the more important rendition of the principle untouched. That version is, however, also subject to new kinds of counterexamples. We end by suggesting how to formulate a better version of the principle that takes into account those new counterexamples.

Suppose we learn that we have a poor track record in forming beliefs rationally, or that a brilliant colleague thinks that we believe P irrationally. Does such input require us to revise those beliefs whose rationality is in question? When we gain information suggesting that our beliefs are irrational, we are in one of two general cases. In the first case we made no error, and our beliefs are rational. In that case the input to the contrary is misleading. In (...) the second case we indeed believe irrationally, and our original evidence already requires us to fix our mistake. In that case the input to that effect is normatively superfluous. Thus, we know that information suggesting that our beliefs are irrational is either misleading or superfluous. This, I submit, renders the input incapable of justifying belief revision, despite our not knowing which of the two kinds it is. (shrink)

Identification of factors that predict recurrent antisocial behavior is integral to the social sciences, criminal justice procedures, and the effective treatment of high-risk individuals. Here we show that error-related brain activity elicited during performance of an in- hibitory task prospectively predicted subsequent rearrest among adult offenders within 4 y of release (N =96). The odds that an offender with relatively low anterior cingulate activity would be rearrested were approximately double that of an offender with high activity in this region, holding (...) constant other observed risk factors. These results suggest a potential neurocognitive biomarker for persistent antisocial behavior. (shrink)

ABSTRACTShould conciliating with disagreeing peers be considered sufficient for reaching rational beliefs? Thomas Kelly argues that when taken this way, Conciliationism lets those who enter into a disagreement with an irrational belief reach a rational belief all too easily. Three kinds of responses defending Conciliationism are found in the literature. One response has it that conciliation is required only of agents who have a rational belief as they enter into a disagreement. This response yields a requirement that no one should (...) follow. If the need to conciliate applies only to already rational agents, then an agent must conciliate only when her peer is the one irrational. A second response views conciliation as merely necessary for having a rational belief. This alone does little to address the central question of what is rational to believe when facing a disagreeing peer. Attempts to develop the response either reduce to the first response, or deem necessary an unnecessary doxastic revision, or imply that rational dilemmas obtain in cases where intuitively there are none. A third response tells us to weigh what our pre-disagreement evidence supports against the evidence from the disagreement itself. This invites epistemic akrasia. (shrink)

Epistemically akratic agents believe both p and that believing p is irrational for them. Some of the costs of thinking that epistemic akrasia can be rational are clear. It is hypocritical, and outright weird, to have beliefs that we consider irrational, let alone to reason with or act on those beliefs. However, as Maria Lasonen-Aarnio (2020) and Brian Weatherson (2019) have argued, the weirdness of akrasia does not obviously tell against its rationality. Here I argue that views permitting epistemic akrasia (...) fare worse than previously thought. These views imply that we should sometimes have beliefs that we know for certain are either irrational or false. And while having a belief that we know to be irrational is straightforwardly irrational, the additional possibility that the belief may be false cannot make having it any more rational. (shrink)

What it means for an action to have moral worth, and what is required for this to be the case, is the subject of continued controversy. Some argue that an agent performs a morally worthy action if and only if they do it because the action is morally right. Others argue that a morally worthy action is that which an agent performs because of features that make the action right. These theorists, though they oppose one another, share something important in (...) common. They focus almost exclusively on the moral worth of right actions. But there is a negatively valenced counterpart that attaches to wrong actions, which we will call moral counterworth. In this paper, we explore the moral counterworth of wrong actions in order to shed new light on the nature of moral worth. Contrary to theorists in both camps, we argue that more than one kind of motivation can affect the moral worth of actions. (shrink)

Is it ever rational to suspend judgment about whether a particular doxastic attitude of ours is rational? An agent who suspends about whether her attitude is rational has serious doubts that it is. These doubts place a special burden on the agent, namely, to justify maintaining her chosen attitude over others. A dilemma arises. Providing justification for maintaining the chosen attitude would commit the agent to considering the attitude rational—contrary to her suspension on the matter. Alternatively, in the absence of (...) such justification, the attitude would be arbitrary by the agent's own lights, and therefore irrational from the agent's own perspective. So, suspending about whether an attitude of ours is rational does not cohere with considering it rationally preferable to other attitudes, and leads to a more familiar form of epistemic akrasia otherwise. Richard Feldman has proposed and defended different versions of a principle about evidence. In slogan form, the principle holds that ‘evidence of evidence is evidence’. Recently, Branden Fitelson has argued that Feldman’s preferred rendition of the principle falls pray to a counterexample related to the non-transitivity of the evidence-for relation. Feldman replies arguing that Fitelson’s case does not really represent a counterexample to the principle. In this note, we argue that Feldman’s principle is trivially true.

The world’s first COVID-19 human challenge trial using the D614G strain of SARS-CoV-2 is underway in the United Kingdom. The Wellcome Trust is funding challenge stock preparation of the Beta variant (B.1.351) for a follow-up human challenge trial, and researchers at Imperial College London are considering conducting that trial. However, little has been written thus far about the ethical justifiability of human challenge trials with SARS-CoV-2 variants of concern. While vaccine resistance as such does not increase risks for volunteers in (...) COVID-19 challenge trials, we explore two specific characteristics of some variants that may initially be thought to make such trials unethical and conclude that SARS-CoV-2 variant challenge trials can remain ethical. When a belief is self-fulfilling, having it guarantees its truth. When a belief is self-defeating, having it guarantees its falsity. These are the cases of “self-impacting” beliefs to be examined below. Scenarios of self-defeating beliefs can yield apparently dilemmatic situations in which we seem to lack sufficient reason to have any belief whatsoever. Scenarios of self-fulfilling beliefs can yield apparently dilemmatic situations in which we seem to lack reason to have any one belief over another. Both scenarios have been used (...) independently to challenge Evidentialism, on which what we may rationally believe is all and only what fits our current evidence. Legal theorists have characterized physical evidence of brain dysfunction as a double-edged sword, wherein the very quality that reduces the defendant’s responsibility for his transgression could simultaneously increase motivations to punish him by virtue of his apparently increased dangerousness. However, empirical evidence of this pattern has been elusive, perhaps owing to a heavy reliance on singular measures that fail to distinguish between plural, often competing internal motivations for punishment. The present study employed a test of the theorized double-edge pattern using (...) a novel approach designed to separate such motivations. We asked a large sample of participants (N = 330) to render criminal sentencing judgments under varying conditions of the defendant’s mental health status (Healthy, Neurobiological Disorder, Psychological Disorder) and the disorder’s treatability (Treatable, Untreatable). As predicted, neurobiological evidence simultaneously elicited shorter prison sentences (i.e., mitigating) and longer terms of involuntary hospitalization (i.e., aggravating) than equivalent psychological evidence. However, these effects were not well explained by motivations to restore treatable defendants to health or to protect society from dangerous persons but instead by deontological motivations pertaining to the defendant’s level of deservingness and possible obligation to provide medical care. This is the first study of its kind to quantitatively demonstrate the paradoxical effect of neuroscientific trial evidence and raises implications for how such evidence is presented and evaluated. The goal of achieving Universal Health Coverage (UHC) can generally be realized only in stages. Moreover, resource, capacity and political constraints mean governments often face difficult trade-offs on the path to UHC. In a 2014 report, Making fair choices on the path to UHC, the WHO Consultative Group on Equity and Universal Health Coverage articulated principles for making such trade-offs in an equitable manner. We present three case studies which illustrate how these principles can guide practical decision-making. These case studies (...) show how progressive realization of the right to health can be effectively guided by priority-setting principles, including generating the greatest total health gain, priority for the worse off, and financial risk protection. Eyal et al have recently argued that researchers should consider conducting severe acute respiratory syndrome coronavirus 2 (SARS-CoV-2) human challenge studies to hasten vaccine development. We have conducted (J. L.) and overseen (L. D.) human challenge studies and agree that they can be useful in developing anti-infective agents. We also agree that adults can autonomously choose to undergo risks with no prospect of direct benefit to themselves. However, we disagree that SARS-CoV-2 challenge studies are ethically appropriate at this time, (...) for 3 reasons: (1) current scientific knowledge of SARS-CoV-2 infection is insufficient to manage risks; (2) autonomous decision making, while necessary, does not override concerns about risk; and (3) undertaking challenge studies now would imperil confidence in the research enterprise, potentially undermining the global response to the coronavirus disease 2019 (COVID-19) pandemic. Eyal Shahar’s essay review [1] of James Penston’s remarkable book [2] seems more inspired playful academic provocation than review or essay, expressing dramatic views of impossible validity. The account given of modern biostatistical causation reveals the slide from science into the intellectual confusion and non-science RCTs have created: “…. the purpose of medical research is to estimate the magnitude of the effect of a causal contrast, for example the probability ratio of a binary outcome …” But Shahar’s world is (...) simultaneously not probabilistic, but of absolute uncertainty: “We should have no confidence in any type of evidence ….. We should have no confidence at all”. Shahar’s "Causal contrast" is attractive. It seems to make sense, but bypasses in two words the means of establishing causation by the scientific method. This phrase assumes a numeric statistically significant “contrast” is causal rather than a potential correlation requiring further investigation. The concept of “causal contrast” is a slippery slope from sense into biostatistical non-science. This can be illustrated with an hypothetical RCT where 100% of interventions exhibit a posited treatment effect and 0% of placebo controls. Internal validity is seemingly quite reasonably assumed satisfied (common-sense dictating the likelihood of an awesome magnificent fraud, bias or plain error of the magnitude required is infinitesimal). Scientific method appears satisfied. The RCT demonstrates: (1) strict regularity of outcome in the presence of posited cause; (2) the absence of outcome in its absence and (3) an intervention (experiment) showing the direction of causation is from posited cause to posited effect. Now travel further down the slope from science. Assume 50% of interventions and 0% of controls are positive. We compromise scientific method, but justify this by assuming a large subgroup which we say surely must on these figures be exhibiting the posited treatment effect. But what of 10% of interventions and 9% of placebo controls exhibiting the posited treatment effect? Our biostatistician says the 1% “causal contrast” is statistically significant. But we have: (1) minimal evidence of regularity; (2) the posited outcome irrespective of presence of posited cause and (3) our intervention is at the highest equivocal in demonstrating any form of causation. This is not science. It is, however, where biostatistics has unthinkingly taken us, as Penston has shown comprehensively [2]. We, the audience of published medical research, are now for the 10% / 9% example well down the slope from science. An unattractive hypothesis results requiring numerous assumptions similar to these:- "There is a 'contrast' which is ‘causal’, albeit the method employed is not scientific. An effect of the intervention has been observed in a very small subgroup. This subgroup is susceptible to treatment. The similar number of placebo controls exhibiting the outcome sought is irrelevant, because the 1% difference between intervention and controls is statistically significant. The statistical analysis is valid and reliable. The RCT’s internal validity is sufficiently satisfied. No funding or bias or fraud has affected the results or their analysis.” As Penston notes: “Confirming and refuting the results of research is crucial to science …. But … there’s no way of testing the results of any particular large-scale RCT or epidemiological study. Each study … is left hanging in the air, unsupported.” It gets worse. To identify a rare serious adverse reaction of a frequency of 1:10,000 can require a trial of 200,000 or larger split between controls and interventions. This is not done. But for every 100 who prospectively benefit from the intervention, 9,900 also receive it. And for every 100 benefiting one person (who likely gains no benefit) will suffer a serious unidentified adverse reaction. In his influential history of the post-1967 history of the Palestinian Occupation, radical Israeli architect Eyal Weizman show how even well-meaning decolonial efforts from privileged allies can be coopted by the colonizers, in what I call “de-decolonizing.” Here I focus on one of his examples, namely IDF (Israeli Defense Force) military professors repurposing the anarcho-communist philosophy of French postmodernist Gilles Deleuze into a weapon against Palestinian guerrilla resistance. My conclusion is that attempted decolonizing via (inevitably complicit) privileged allies must (...) include what Weizman calls “co-resistance,” and I call “reconstruction.” In other words, when a Deleuzian “line of flight” to “escape” is impossible, as arguably for Palestinians today, then one should follow the heroic example of the Bedouins, who (as Weizman acknowledges) are the only Arabs who have never stopped rebuilding their Palestine. Cet article se propose explorer le cas de l’« architecte-historien », terme par lequel je désigne un architecte prenant lui-même en charge son histoire. Ainsi, quelle est la signification, pour un architecte, d’une telle prise en charge de l’interprétation de son œuvre? Aldo Rossi, en 1981, publie A Scientific Autobiography, livre qui constitue une enquête sur les sources de sa propre création. Mon intention dans cet article est de déchiffrer et de comprendre la position de la notion d’introspection dans la (...) réflexion d’Aldo Rossi. Un des objectifs de ma contribution est de montrer quelle est la signification de cette introspection pour le domaine de l’architecture. Dans l’épigraphe de son autobiographie, Rossi pose la question suivante : « Dès lors, à quoi ai-je pu aspirer dans mon métier? » (Rossi, 1988 [1981a] : 5). Cette interrogation montre sa volonté de mettre en question ou au moins d’examiner son apport à la connaissance et à la pratique architecturales. La réponse qu’il propose à sa propre question est la suivante : « [C]ertes à peu de choses, vu que la possibilité de réaliser de grandes choses est historiquement forclose. » (Rossi, 1988 [1981a] : 5). Bewusstsein äußert sich als System von Beziehungen. Unsere Welt entspricht einem Netzwerk von Akteuren und deren Verhältnissen. Gleichzeitig können wir Bewusstsein in unserer Wahrnehmung als Verweis auf eine Ganzheit erfahren – etwas, das wir in diesem Buch als Herausbildung eines Zeichens auffassen wollen. Die Aufgabe der Wissenschaften wird dann darin bestehen, dieses doppelte Erscheinen (einmal objektiv als System von Beziehungen, einmal subjektiv als Zeichen) zueinander in Relation zu setzen.

In his editorial, Nir Eyal argues that a nudge can exploit our propensity to feel shame in order to steer us toward certain choices. We object that shame is a cost and therefore cannot figure in the apparatus of a nudge.

I consider what prima facie attractive communitarian ethical perspectives salient among indigenous African peoples entail for distributive justice within a state, and I argue that they support a form of economic egalitarianism that differs in several important ways from varieties common in contemporary Anglo-American political philosophy. In particular, the sort of economic egalitarianism I advance rivals not only luck-oriented variants from the likes of Ronald Dworkin, G. A. Cohen and theorists inspired by them such as Richard Arneson, Carl Knight and (...) Nir Eyal, but also more ‘social’ kinds advocated by Elizabeth Anderson, Samuel Scheffler and Jonathan Wolff. Although I do not argue that these broadly Kantian egalitarianisms are less plausible than the Afro-communitarian version, I do aim to establish that it should be taken as seriously as they, at this stage of the debate. In seiner ‘Existenzerhellung der Freiheit’ reflektiert Jaspers, das Problemfeld der Freiheit in einem Kontrast zu den Begriffen, Phänomenen und Bedingungen der Unfreiheit und der Grenzen der Freiheit. Dem Problemfeld der Freiheit kann man im Denken und Handeln nur dann gerecht werden, wenn man nicht nur zwischen den verschiedenen Begriffen und Phänomenen der Freiheit unterscheidet, sondern auch zwischen den verschiedenen Begriffen und Phänomenen von Grenzen der Freiheit, wie z.B. durch die allgemeine Naturgesetzlichkeit und die menschliche Natur, durch besondere Bedingungen in Natur, (...) Kultur und Gesellschaft, durch gesundheitliches Befinden und individuelle Persönlichkeit, durch situative Begrenzungen, normative Forderungen und konkrete Grenzsituationen, wie z.B. von Leiden, Kampf, Schuld, Wagnis und Tod zeigen. Jaspers hat sich zum Problemfeld der Freiheit sowohl in seiner Allgemeinen Psychopathologie, in seinen pathographischen Untersuchungen, in seiner Psychologie der Weltanschauung und in einigen seiner philosophischen Schriften geäußert. Im zweiten Band seines frühen Hauptwerkes Philosophie mit dem Titel Existenzerhellung hat er jedoch eine umfassende Abhandlung zu dem komplexen Problemfeld der Freiheit verfasst. Dort behandelt Jaspers fast alle wesentlichen Begriffe und Phänomene der Freiheit bis hin zu seiner Konzeption einer existenziellen Freiheit. Jaspers geht anfangs von einem unbestimmten Begriff der Freiheit aus, dem kein bestimmtes Phänomen entspricht und der deswegen nur Illusionen erzeugen und einem ideologischem Denken dienen kann. Dann aber unterscheidet Jaspers zwischen verschiedenen Begriffen und Phänomenen der Freiheit. Dabei scheint er nicht nur wie die meisten zeitgenössischen Philosophen an Locke und Hume, Kant und Brentano, Wilhelm von Humboldt und John Stuart Mill anzuknüpfen, sondern auch an die Konzeptionen des Selbstbewusstseins bei Hegel, Fichte und Schelling. Da sich Jaspers nicht zuletzt auch mit den Schriften von Kierkegaard und Nietzsche auseinandergesetzt hat, gelangt er zu einer besonders umfangreichen und differenzierten Diskussion des ganzen Problemfeldes der Freiheit in der Moderne. Jaspers hat jedoch nicht nur verschiedene Freiheitsbegriffe und -phänomene unterschieden, sondern er hat auch zu den überlieferten Denkweisen im Form einer existenzphilosophischen Erhellung der Freiheit Stellung genommen. Dabei hat Jaspers’ Stellungnahme anders als viele zeitgenössische Beiträge über Freiheit und Determinimus den deutlichen und bewahrenswerten Vorzug, dass sie die unverfügbare und irreduzible Subjektivität der Willensfreiheit anerkennt. Damit knüpft Jaspers an Kants Einsicht an, dass der Freiheit des menschlichen Willens und ihrer praktischen Wirksamkeit immer nur die subjektive Evidenz inneren Erlebens zukommen kann. Dies unterscheidet sie von der Wahl- und Handlungsfreiheit, die man auch in konkreten Handlungssituationen objektiv feststellen kann. Der Freiheit des menschlichen Willens kommt damit weder die Objektivität empirischer Erkenntnis noch metaphysische Notwendigkeit zu. Die subjektive Evidenz des Erlebens eines freien Willens spricht nach Jaspers jedoch auch gegen einen weltanschaulichen, methodischen oder metaphysischen Determinismus, der sie aufgrund seiner Annahme einer kausal geschlossenen Wirklichkeit leichtfertig für eine bloße Illusion hält. Eine deterministische Weltanschauung oder Philosophie kann der condition humaine zumindest dann nicht gerecht werden, wenn sie die evidente Subjektivität eines freien Willens nicht auf eine plausible Art und Weise integriert. Jaspers’ wird der potentiellen Freiheit des menschlichen Willens dadurch gerecht, dass er ihre unverfügbare und irreduzible Subjektivität versteht und akzeptiert und erst gar nicht den abwegigen Versuch macht, sie durch eine objektivierende Einstellung zu objektivieren, wissenschaftlich zu erklären oder gar zu beweisen. In a previous Philo article, it was shown how properties could be ontologically dispensed with via a representational analysis: to be an X is to comprehensively represent all the properties of an X. The current paper extends that representationalist (RT) theory by explaining representation itself in parallel epistemic rather than ontological terms. On this extended RT (ERT) theory, representations of X, as well as the real X, both may be identified as providing information about X, whether partial or comprehensive. But (...) that information does not match ontological, property-based analyses of X, so it is epistemically fundamental–hence supporting a broadly conceptualist rather than nominalist metaphysics. Kurz bevor Goethe in den Jahren 1808/9 die Wahlverwandtschaften schrieb, hatte sich sein ehemaliger naturwissenschaftlicher Kooperationspartner Johann Ritter in Untersuchungen zu Wünschelruten und Pendeln (1807/8) verloren, aus denen angeblich eine weitere tiefgreifende Analogie zwischen den Polaritäten in der Natur und denen beim Menschen hervorgehen sollte. Ritter arbeitete damals schon seit Jahren erfolgreich mit Goethes Polaritätsbegriff, und war dadurch sogar auf seinen größten Erfolg geleitet worden (die Entdeckung des UV-Lichts). So ist es nicht überraschend, dass sich Goethe für die Pendelexperimente interessierte (...) – und ihnen im Roman ein literarisches Denkmal setzte (während er sich wissenschaftlich dazu sicherheitshalber nicht äußerte). Die von beiden geteilte Polaritätsidee lief auf mehr hinaus als den vagen Gegensatz zwischen irgendwelchen antagonistischen Wirkfaktoren; vielmehr hatte sie handfeste strukturelle Implikationen im Sinne einer mathematischen Symmetrie: Bei Vertauschung der entgegengesetzten Pole in irgendeiner gegebenen Konfiguration kehren sich die ursprünglich beobachtbaren Wirkungen genau in ihr Gegenteil um. Diese Idee ist ein Kerngedanke der Farbenlehre (1810) und liegt z. B. Goethes Farbenkreis zugrunde; überraschenderweise lässt sie sich an einigen entscheidenden Wendepunkten der Wahlverwandtschaften präzise dingfest machen, und dadurch gewinnt ein beliebtes Spiel unter Goethelesern einen neuen Dreh: Die Farben des Farbenkreises haben eindeutig identifizierbare Gegenstücke im Personentableau des Romans. Nur weil Goethes letzter Brief an den Aufklärer und versierten Experimentalphysiker Lichtenberg nicht mehr beantwortet worden ist, sind viele Interpreten zu dem Ergebnis gelangt, dass Lichtenberg den Briefwechsel aus Unwillen über Goethes unbelehrbare Newton-Kritik abgebrochen hätte; Goethe selbst hat diese Interpretation nahegelegt. Doch bei gründlicher Neulektüre ergibt sich ein optimistischeres Bild. Goethe stand damals am Anfang seiner Farbenforschung, äußerte sich zu Newton weit weniger polemisch als später, gegenüber Lichtenberg aber voller Respekt – und zeigte sich offen für Kritik. In einem (...) seiner fünf Briefe reagierte Lichtenberg mit der erwünschten Kritik, und zwar so, wie sie unter Fachwissenschaftlern idealerweise aussehen sollte: voller Schwung, hinreichend skeptisch und doch konstruktiv. Goethe hat Lichtenbergs Kritik beherzigt, aufgegriffen, weitergedacht. Umgekehrt ließ sich Lichtenberg vom Briefpartner wissenschaftlich anregen; in der Tat bot Goethe ihm mit großer Sorgfalt eine Reihe von Anregungen, die gut zu Lichtenbergs Arbeit passten. Ja, Goethe ist möglicherweise zu anregend für ihn gewesen. Jedenfalls hat Lichtenberg es trotz gut dokumentierter Anzeichen von Begeisterung für Goethes gewagtes Projekt nicht vermocht, den Gedankenaustausch auf dem hohen Niveau fortzusetzen, das er zunächst geboten hatte. Ob der Briefwechsel am Ende aus gesundheitlichen Gründen, aus Willensschwäche oder einfach nur wegen Überarbeitung versandet ist, lässt sich den Dokumenten nicht entnehmen. Selbst die Hypothese einer wissenschaftlichen Entfremdung bleibt im Reich des Denkbaren. Unwahrscheinlich erscheint sie u.a. deshalb, weil an mindestens zwei Stellen eine Geistesverwandtschaft zwischen den beiden Protagonisten bestanden hat, die Goethe wohl ahnte und die heute angesichts damals unzugänglicher Texte deutlich in den Blick genommen werden kann: Erstens waren beide gleichermaßen von naturwissenschaftlichen Anwendungen des Polaritätsgedankens fasziniert, der seinerzeit viele neue Entdeckungen geliefert hatte und weitere verhieß; zweitens haben sie wichtige Einsichten der Wissenschaftsphilosophie des 20. Jahrhunderts vorweggenommen, etwa die Skepsis gegenüber eindeutig aus der Empirie abzulesenden Theorien und die These von der Theoriebeladenheit der Beobachtung. Goethe hatte Pech, dass diese Gemeinsamkeiten nicht vor Lichtenbergs Tod (und bis heute nicht) ans Tageslicht gekommen sind. Seine Kooperation mit Lichtenberg hätte zum Erfolg führen können; und der fatale Eindruck seiner Unbelehrsamkeit hätte sich vermeiden lassen. (shrink)

Background. The COVID-19 pandemic necessitated drastic changes to undergraduate medical training at the University of Botswana (UB). To save the academic year when campus was locked down, the Department of Medical Education conducted a needs assessment to determine the readiness for emergency remote teaching (ERT) of the Faculty of Medicine, UB. Objectives. To report on the findings of needs assessment surveys to assess learner and teaching staff preparedness for fair and just ERT, as defined by philosopher John Rawls. Methods. Needs (...) assessment surveys were conducted using Office 365 Forms distributed via WhatsApp, targeting medical students and teaching staff during the 5 undergraduate years. Data were analysed quantitatively and qualitatively. Results. Ninety-two percent (266/289) of students and 73.5% (62/84) of teaching staff responded. Surveys revealed a high penetration of smartphones among students, but poor internet accessibility and affordability in homes. Some teaching staff also reported internet and device insufficiencies. Only WhatsApp was accessible to students and teaching staff. Conclusions. For equitable access to ERT in the future, the surveys revealed infrastructural improvement needs, including wider, stronger, affordable WiFi coverage within Botswana and enhanced digital infrastructures in educational institutions, with increased support for students. Seit kurzem wird des öfteren in Deutschland die Ansicht geäußert, Deutschland solle nun seine fremdenfeindliche Vergangenheit im Zweiten Weltkrieg endlich hinter sich lassen und von nun ab als >>normalisiertes<< Land der Zukunft gegenübertreten. Diese Meinung entsteht aus der Voraussetzung, daß Deutschland durch seine Geschichte von Xenophobie und Genozid im Zweiten Weltkrieg als abnormal, als ungewöhnlich gekennzeichnet ist. Aber das ist nicht wahr. Deutschlands blutige Geschichte ist mit derjenigen der Vereinigten Staaten, Großbritanniens, der Niederlande, Rußlands, Chinas, Japans, der Türkei, Vietnams, Kambodschas, (...) Somalias, Ruandas, des Irak, des Kosovo, Bosniens, und anderer Länder vergleichbar. Zu vergleichen bedeutet weder zu relativieren, noch zu entschuldigen, sondern bloß anzuerkennen, daß die Verbrechen gegen die Menschlichkeit, die in verschiedenen Ländern stattfinden, einige gemeinsame Eigenschaften haben. Academic integrity is an essential pillar of any educational system. It is defined as acting in a manner consistent with the values and accepted standards of ethical practices in teaching, learning, and scholarship (Fishman, 2015). Contract cheating, or ghostwriting, is currently one of the most severe violations of academic integrity. It involves students engaging a third party, usually an online essay writing service, to complete their academic works on their behalf (Draper et al., 2021). Some of these services offer pre-written (...) essays, whereas others offer bespoke custom-written essays. According to the academic literature, the advent of the internet and digital technologies underlay this rapid deterioration of academic integrity (Ison, 2020; Lancaster & Clarke, 2014). Different learning environments, such as face-to-face (i.e., a learning environment involving the physical presence of both instructor and students) and online web-based (i.e., teaching mode that takes place partially or entirely over the internet), have been shown to affect academic integrity in different ways (Eshet et al., 2021). While contract cheating is common in both conventional face-to-face (F2F) and online settings, it is more likely to take place in the latter (Lancaster & Clarke, 2014; Slade et al., 2018). There are several possible explanations for why online students engage in contract cheating more often than F2F students. In particular, this includes the problem issue of psychological distance, which adversely affects interpersonal relationships; and the problem issue of moral distancing, because the internet can obscure the line between academically honest and dishonest behavior (Sharma & Maleyeff, 2003). These issues were further exacerbated by the sudden shift from F2F to emergency remote teaching (ERT) in response to the COVID-19 pandemic (Ahsan et al., 2021; Bjelobaba, 2021). Indeed, contract cheating had become a significant COVID-19 side effect for higher education institutions. In contrast to the well-planned F2F or online learning courses, ERTbased courses are not originally designed to be delivered virtually (Fatonia et al., 2020). The chaos brought by the abrupt campus closure and related unexpected transition to ERT provided both the opportunity and the incentive for contract cheating (Hill et al., 2021). Through social media, students have very quickly become fully aware of the possibilities of a wide variety of options to carry out Plagiarism (Bautista et al., 2022). There has been an increase in ways to try to bypass text-matching or text-reuse (i.e., plagiarism) detection systems, for example using micro-spaces, white ink, punctuation, and typos (Abdelhamid et al., 2022). Even though ghostwriters, especially commercial ones, claim their essays are original and therefore cannot be detected using text-matching software, third-party assignments may still contain recycled text (Aitken et al., 2017; Newton & Lang, 2015). Text matching detection software could use these breaches to identify outsourced academic work (Lancaster & Clarke, 2016; Wang & Xu, 2021). This study aimed to evaluate the status of newly-hired public school teachers in terms of their TPACK Components and Emergency Remote Teaching (ERT) as indicated in their e-learning readiness, perceived effectiveness, attitude, satisfaction, and anxiety. Quantitative research particularly the correlational research design was employed in this study. Thirty-four(34) purposefully selected newly hired public school teachers were the participants of the study. Results showed that among the TPACK components, those that have technology integration were among the areas where teacher-participants need major (...) improvement. Their ERT Readiness scores showed 55.5% of the teacher-participants scored low in e-Learning Readiness, 55.9% scored moderately in perceived effectiveness, 73.5% were neutral in terms of attitude towards ERT, 58.8% moderately satisfied with ERT implementation, and 61.8% showed no anxiety. Findings showed a moderately positive and significant correlation between perceived effectiveness and attitude (r=.56, p<0.01); satisfaction and readiness (r=.35, p<0.05), satisfaction and perceived effectiveness (r=.34, p<0.05), attitude and anxiety (r=.34, p<0.05), but strongly positive and significant correlation between satisfaction and attitude (r=.69, p<0.01). Moreover, in terms of relationship between TPACK Components and ERT Indicators, a positive and significant correlation were also showed between perceived effectiveness and PK (r=.58, p<0.01), CK(r=.50, p<0.01), PCK(r=.48, p<0.01), and TCK(r=.40, p<0.05); and attitude between PK(r=.47, p<0.01) and PCK(r=.39, p<0.05The overall ERT readiness, where 56% of the teacher-participants scored low, is a product of the availability of ICT infrastructures in public schools, EdTech training, and pedagogical approaches in distance learning. It is recommended that the formulation of DepEd policies and programs are geared towards addressing these issues. (shrink)

»Aber wenn ich höre, alles andere habe vor dem Schutz des Lebens zurückzutreten, dann muss ich sagen: Das ist in dieser Absolutheit nicht richtig. Grundrechte beschränken sich gegenseitig. Wenn es überhaupt einen absoluten Wert in unserem Grundgesetz gibt, dann ist das die Würde des Menschen. Die ist unantastbar. Aber sie schließt nicht aus, dass wir sterben müssen.« So äußerte sich Wolfgang Schäuble im April 2020 im Zusammenhang mit den Maßnahmen gegen die Corona-Pandemie. Die fundamentale Stellung der Menschenwürde, die Schäuble in (...) seiner Aussage hervorhob, steht außer Streit. Der Schutz der Würde des Menschen bildet so etwas wie den Ankerpunkt, das Umwillen der Rechtsordnung. Was die Menschenwürde genau bedeutet, ist jedoch alles andere als klar. In der juristischen Literatur kommt die Schwierigkeit, die bei der Bestimmung des Begriffs besteht, vielfach zum Ausdruck. In den Kommentaren zum Grundgesetz wird etwa festgestellt, dass es einen allgemein akzeptierten, dogmatisch präzisen Rechtsbegriff der Menschenwürde nicht gebe. Ein operabler Begriff der Menschenwürde harre immer noch der Entwicklung. Das Zusammentreffen von fundamentaler Bedeutung und inhaltlicher Unbestimmtheit ruft nach theoretischer Reflexion. Dabei ist klar, dass gerade in der relativen Unschärfe und Offenheit des Begriffs der Menschenwürde auch ein Vorzug liegt. Gerade weil dieses Konzept so vage ist, kann es einen konsensfähigen Grund kollektiver Ordnung bilden. Die folgenden Überlegungen wollen dem Rechnung tragen und sind nicht von der Absicht geleitet, den Begriff abschließend zu definieren. Eher liegt das Ziel der Studie in einer Annäherung an den begrifflichen Gehalt der Menschenwürde. Disziplinär ist die folgende Untersuchung in erster Linie der Philosophie zuzuordnen, insbesondere der Rechts- und Moralphilosophie. Es handelt sich nicht um eine rechtswissenschaftlich-dogmatische Arbeit. Das Ziel der Arbeit besteht mithin nicht darin, den Rechtsbegriff der Menschenwürde auszulegen. Jedoch hat die Studie auch eine rechtlich-praktische Zielrichtung. Sie soll, auf philosophischer Grundlage, auch den Rechtsbegriff der Menschenwürde besser verstehen helfen und damit auch der juristischen Interpretation dienlich sein. Im dritten Teil wird die Arbeit daher Bezüge zum positiven Recht herstellen und eine juristische Interpretation des Begriffs vorschlagen. Bevor die Untersuchung einsetzt, ist eine kurze Verständigung darüber nötig, von welchem Begriff der Menschenwürde im Folgenden ausgegangen wird. Der Begriff kann unterschiedlich verstanden werden. Insbesondere bestehen Vorstellungen einer (wie man sagen kann) inhärenten und einer kontingenten Würde. Nach der ersten Vorstellung hat jeder Mensch eine Würde, die er nicht verlieren kann. Nach der zweiten Vorstellung ist Würde dagegen etwas, das ein Mensch je nachdem in größerem oder kleinerem Ausmaß besitzt. Die folgenden Überlegungen gehen von der Idee der inhärenten Würde aus. Diese Würde kann verletzt oder missachtet werden, sie kann dem Menschen aber nie eigentlich genommen werden. Die Menschenwürde auch in diesem Sinn basiert jedoch auf einer Zuschreibung. Der Mensch hat Würde nicht, wie er zwei Beine hat. Die menschliche Gemeinschaft schreibt sie ihm als unverlierbar zu. Es handelt sich bei dieser Zuschreibung mithin nicht um eine deskriptive, sondern um eine präskriptive Aussage. Gerade darin manifestiert sich der unverlierbare Gehalt der menschlichen Würde – denn in einem deskriptiven Sinn verstanden, kann diese durchaus verloren gehen. Ein Mensch kann faktisch unwürdig leben, entwürdigt werden, seiner Würde verlustig gehen. Das präskriptive Verständnis dagegen statuiert eine Würde, die alle faktischen Gegebenheiten überdauert und in jedem Fall besteht. Die folgenden Untersuchungen wollen diese Würde erläutern, aber nicht begründen. Denn nach hier vertretenem Verständnis bildet die Menschenwürde selbst den Grund der normativen Forderungen von Moral und Recht. Es gibt insoweit nichts weiter zu begründen – während die Würde, wie aufgezeigt werden soll, tatsächlich den Grund der Menschenrechte bildet. Insoweit – beim Verhältnis zwischen Menschenwürde und Menschenrechten – liegt ein Begründungsverhältnis vor. Dieses wird vor allem im zweiten Teil der Arbeit näher diskutiert. Im ersten Teil soll versucht werden, in einem allgemeinen, moralphilosophischen Sinn ein Verständnis der menschlichen Würde zu gewinnen. Dazu ist es zunächst nötig, sich die wichtigsten bestehenden Theorien zur Menschenwürde zu vergegenwärtigen. Die Auseinandersetzung mit diesen Theorien wird ein Defizit aufzeigen. Diesen Analysen schließt sich eine eigene Interpretation an, die am Schluss des ersten Teils mit einigen möglichen Gegenargumenten konfrontiert werden soll. (shrink)

Jürgen Habermas ist nicht der Erste, der in den letzten Jahren zu der Diagnose gelangt ist, dass das Internet und die sozialen Medien zu einem dramatischen Wandel der politischen Öffentlichkeit geführt hätten, mit gravierenden Folgen für die Existenzbedingungen der westlichen Demokratien. Aber wenn er, einer der international bedeutendsten und wirkmächtigsten politischen Theoretiker der letzten Jahrzehnte, sich dazu äußert, wie sich die „Struktur der Öffentlichkeit“ wandelt und was das für die Demokratie bedeutet, dann hat das einen besonderen Stellenwert.
