In the philosophy of mind, neuroscience, and psychology, the causal relationship between phenomenal consciousness, mentation, and brain states has always been a matter of debate. On the one hand, material monism posits consciousness and mind as pure brain epiphenomena. One of its most stringent lines of reasoning relies on a ‘loss-of-function lesion premise,’ according to which, since brain lesions and neurochemical modifications lead to cognitive impairment and/or altered states of consciousness, there is no reason to doubt the mind-brain identity. On (...) the other hand, dualism or idealism (in one form or another) regard consciousness and mind as something other than the sole product of cerebral activity pointing at the ineffable, undefinable, and seemingly unphysical nature of our subjective qualitative experiences and its related mental dimension. Here, several neuroscientific findings are reviewed that question the idea that posits phenomenal experience as an emergent property of brain activity, and argue that the premise of material monism is based on a logical correlation-causation fallacy. While these (mostly ignored) findings, if considered separately from each other, could, in principle, be recast into a physicalist paradigm, once viewed from an integral perspective, they substantiate equally well an ontology that posits mind and consciousness as a primal phenomenon. However, we will not argue in favor of vitalistic and idealistic conceptions. A view that emancipates free will by means of quantum indeterminism is frequently rejected based on arguments pointing out its incompatibility with what we know about quantum physics. However, if one carefully examines what classical physical causal determinism and quantum indeterminism are according to physics, it becomes clear what they really imply–and, especially, what they do not imply–for agent-causation theories. Here, we will make necessary conceptual clarifications on some aspects of physical determinism and indeterminism, review some of the major objections (...) against libertarian conjectures, and show that there is no conceptual incompatibility preventing us from taking a ‘quantum-libertarian’ approach to the problem of free will. In particular, we will illustrate the possible role of self-causation (causa sui) as a potential solution to otherwise apparently incompatible or even paradoxical statements concerning free will and quantum indeterminism. In the contemporary philosophy of mind and consciousness studies, views such as panpsychism or theories of universal consciousness, have enjoyed a recent renaissance of metaphysical speculations in Western philosophy. Its similarities with Eastern philosophical traditions went not unnoticed. However, the potential contribution that the evolutionary cosmology of the Indian poet, mystic and philosopher Sri Aurobindo can offer to these ontologies, remains largely unknown or unexplored. Here, consciousness, mind, life, matter and evolution are interpreted in an extended metaphysical framework, uniting Western (...) and Eastern traditions inside a modern philosophical system where materialism, panpsychism, cosmopsychism and philosophical idealism are not seen as irreconcilable exclusives, but different points of view that can be reconciled in a synthesis of knowledge, as envisioned from higher states of consciousness. This integral view of reality offers a conceptual platform that can complement and incorporate current theoretical approaches in modern philosophy, where their present internal inconsistencies do not emerge, and can be suggestive for scientists as well, especially in the fields of biology and physical sciences. This study deals with the philosophical problems of historical conscience which arose in conjunction with the wake of 19th century Historicism, whose aim was to do away with the metaphysical presuppositions of German Idealism. The heyday of the historicist movement will be dealt with as well as its vacillating contradictions (its metaphysics).

Public reason liberalism is defined by the idea that laws and policies should be justifiable to each person who is subject to them. But what does it mean for reasons to be public or, in other words, suitable for this process of justification? In response to this question, Kevin Vallier has recently developed the traditional distinction between consensus and convergence public reason into a classification distinguishing three main approaches: shareability, accessibility and intelligibility. The goal of this paper is to defend (...) the accessibility approach by demonstrating its ability to strike an appealing middle course in terms of inclusivity between shareability and intelligibility. We first argue against Vallier that accessibility can exclude religious reasons from public justification. Second, we use scientific reasons as a case study to show that accessibility excludes considerably fewer reasons than shareability. Throughout the paper, we connect our discussion of accessibility to John Rawls’s model of public reason, so as to give substance to the accessibility approach and to further our understanding of Rawls’s influential model. This paper attempts to show how Heidegger’s question concerning the sense of being implies not only the so called ‘hermeneutical transformation of phenomenology’, but also and most importantly what one might call a ‘phenomenological transformation of phenomenology’. This latter transformation, which amounts to the former, can be conceived of as a Heideggerian confrontation regarding the conception of phenomenology coined by Husserl by means of a discussion of the phenomenality of the phenomenon and thus of the fundamental maxime toward which the (...) phenomenological enterprise —at risk of endangering its original (Husserlian) nature notwithstanding— must lead its efforts. Occam’s razor is frequently considered to be a cornerstone of the scientific method. Indeed, it was and remains a valuable tool for scientific and philosophical inquiry. However, we provided an overview of some historical instances in which it led science away from a reasonable and sound heuristic approach. Some words of caution are necessary to clarify how, contrary to common belief, a too strict adherence to such a principle did not guarantee scientific rigor but, rather, obstructed further progress.

In its two parts, this study intends to reconstruct with some detail the fiasco of the Artificial Intelligence research project and the devastating critique carried out against it by Hubert Dreyfus in his magnum opus What Computers Still Can’t Do (1972, 1979, 1992). Part of these consequences is the emergence within this specialized field of a group of scholars who have called themselves ‘Heideggerian’. This definition shall be dealt with and criticized in the second part of this study. In this (...) first part, we go on to analize (i) the bizarre dreams and false expectations of AI researchers, and (ii) Dreyfus’ own criticism and its definitive thrust of phenomenological nature. This paper revises Heidegger’s interpretation of Aristotle, in which the greek philosopher is portrayed as a proto-phenomenologist. On this regard, an attempt is made in order to render an account of Heidegger’s teaching phase (1919-1927) right before the publication of Sein und Zeit, in which Heidegger develops a search of his own philosophical terminology, resulting from the phenomenological procedure of the so-called ‘destruction’ (Destruktion) of the ontological tradition.

The recent revival of metaphysical frameworks in Western consciousness studies, such as panpsychism, cosmopsychism and its idealistic and monistic versions, is viewed from the standpoint of an extended and more consistent spiritual emergentist evolutionary cosmology in the light of the Indian mystic, poet and philosopher Aurobindo Ghose (1872-1950). This integral Vedantic cosmology will be outlined and thus furnish a more coherent metaphysical framework, inside which several of the issues and shortcomings that vitiated the previous ontologies can find their natural accommodation. This paper deals with Daniel Dennett’s well-known charges against phenomenological philosophy as an endevour to restore the rights of introspection: that is, the attempt, albeit doomed to failure, to contribute to the science of the mind from a purported incorrigible, ineffable and ‘subjective’ (interpreted as ‘private’) first-person perspective. According to Dennett’s heterophenomenology, only a strict third-person method is possible when it comes to the scientific study of the mind. I will dispute Dennett’s method in order to do both: correct Dennett’s (...) caricaturization of phenomenological philosophy as naïve introspection and offer not only a clarification of phenomenology’s true aims and scope, but also a case in which phenomenology will stand as a crucial option in the new studies of the mind, under the sigh of fresh air that can be found in the new approaches to cognitive science (the so-called 4EA approaches: embodied, embedded, extended, enacted, affective). By way of introducing the concept of ‘phenomenological skillful-coping,’ an affirmative respond to Dennett’s own question shall be given: “Is there anything about experience that is not explorable by heterophenomenology? I’d like to know what.” The answer to Dennett should be firm: Yes there is! No less than the most basic non-theoretical, non-representational, embodied and embedded, human experience or coping. We review the spiritual cosmology of the 20th-century Indian mystic and yogi Sri Aurobindo. Our aim is twofold. First to furnish a basic philosophical understanding of Aurobindo’s vision, and secondly, that of making a comparative analysis with present scientific knowledge that could furnish an alternative metaphysical interpretation of the physical world. The rationale of our study is to question whether the observation of the physical world from the standpoint of the mystic experience could suggest some new theoretical framework for the (...) metaphysical ontology of the world itself. Taking perspectives from the states of consciousness described by mystics may furnish us with a deeper understanding of the material and metaphysical character of physical categories such as matter, energy, force, space, time, and space-time. The question of whether we have free will is a longstanding philosophical debate that has led to divided fronts and interpretations. The first ambiguity arises due to a misconception about the relation between causal determinism, as formulated in classical physics, and the notion of free will, which, once clarified, undermines not only compatibilism but also naïve formulations of libertarianism. We show that either one maintains a material monistic physical causal determinism and must give up free will, or one must give (...) up determinism and embrace metaphysical ontologies. Moreover, with the advent of modern neuroscientific investigations, the questions surrounding our freedom of choice have received renewed attention but, so far, lead to several inconclusive findings. In fact, the issue is far from settled and no resolution is in sight. We contend that an exclusively third-person approach that abstracts from the deeper complexities of the human psychological nature and resists a first-person inquiry has led to a much too simplistic and superficial understanding of the problem and is affected by fallacious inferences and unwarranted conclusions. Meanwhile, an introspective approach easily reveals that our identity can't be reduced to a single personality whose choice-making is determined by a unique agency and volition. Our nature is much more complex than that. Therefore, every analysis involving propositions about free will requires more careful articulation. One cannot meaningfully answer the question of free will if it is not clear (1) what determinism is in physical sciences, (2) who is supposed to be free from what and (3) what will is. Here, we show that the question regarding free will isn't meaningful in the first place unless cleared from conceptual conflations and that it is unlikely it will ever be answered by a binary ‘yes’ or ‘no’ statement. Schools, colleges, and universities have become homogenizing systems that are almost exclusively focused on imposing a pre-ordered curricula through exams and grades or tight research lines. In the process, they are killing passion, creativity, and individuals’ potential and skills. Ultimately, schools and academia make up a system that serves a collective machinery but suffocates individual growth. This state of affairs is not a necessary evil. Learning, discovering and teaching can be a natural, spontaneous and luminous expressions of a free and (...) progressive growth if they are allowed to be practiced in an appropriate environment. This is a ‘manifesto’ for a Free-Progress-Education (FPE) paradigm according to which the best way of learning, acquiring knowledge, and doing research comes through a process of free self-directed learning, and a progress of self-unfoldment and self-discovery, that must be guided from within. In schools, colleges, universities and beyond. A FPE learning centre would be expected to foster curiosity, intuition, self-directed-learning in diversity, and, especially, wholesome respect for the practice of complete and responsible freedom of individual expression.FPE goes beyond the standard paradigm of unschooling or the pedagogical approach of democratic schools since it includes self-directed-education that can also work in high schools, colleges, universities, and research centres. It iAfter a brief introductory presentation, a personal preamble of the author describes his experiences with institutionalized learning from childhood to the doctoral dissertation and in a high school as a teacher. Then, the roots of the stagnant state of education will be investigated which is still based on an industrial and mechanistic mindset, and is perceived with increasing dissatisfaction. While analysing the detrimental effects that a managerial and industrial mentality has had on the education and intellectual growth of several generations, we will take as an example the deficiencies of the so-called big science, i.e. of the modern, large-scale scientific initiatives. Surveying past and present learning approaches such as the interesting renaissance of homeschooling and welcoming new trends such as unschooling or democratic education, the second part of this book looks beyond these paradigms searching for a wider spirit of education. It is emphasized that no reform is possible inside the current school and university paradigm, because it is in its essence an authoritarian system that won't allow itself to be dismantled from within. The last part of this book focuses upon a brief set of alternative proposals, which aim at overcoming the centuries-old shortcomings of the present educational system, by favouring intrinsic over extrinsic motivation. Preliminary practical ideas are put forward on what a free-progress learning community might look like, and what the first steps for its realization might be. It is explained there why it is only through a change from the ground up that the certificate-oriented educational system can transform itself into a project-oriented, self-organized, competence-portfolio based one, with no exams, grades, degrees, or other administrative trammels. At the same time, it must be made clear that the ultimate aim of doing away with the present system of assessment criteria would be to install a much deeper and articulated paradigm shift than some superficial reform and even beyond the actually undeveloped democratic education concept which still falls short beyond high-school level. What is visualized is an evolutionary pedagogical perspective, compared to the conventional one, and presented as the necessary condition for a 'Copernican approach' to education. Only after that perspective has been realized can new competences, curiosity, intuition, and real forms of creative learning return to flourish in schools and academia. (shrink)

This paper attempts to exhibit the young Heidegger’s academic and personal thinking path which stems from the two university dissertations (1913 and 1915 respectively) and ends up leading to his first lecture at the University of Freiburg on the determination of philosophy (1919). It is purported in the first place to render an account of the personal circumstances that convinced Heidegger of modifying his own early purposes of becoming a priest, then a theologian and finally a confessional Catholic philosopher by (...) means of an examination of the philosophical themes which motivate his early work (Neokantianism, medieval speculative grammar and Husserlian phenomenology). In the second place, an attempt is made in order to consider Heidegger’s first Freiburg lecture in which the young philosopher intends the enterprise of undermining the primacy of the theoretical and in which he launches a series of remarkable objections (of hermeneutical nature) against Husserlian phenomenology. What is it for a picture to depict a scene? The most orthodox philosophical theory of pictorial representation holds that depiction is grounded in resemblance. A picture represents a scene in virtue of being similar to that scene in certain ways. This essay presents evidence against this claim: curvilinear perspective is one common style of depiction in which successful pictorial representation depends as much on a picture's systematic differences with the scene depicted as on the similarities; it cannot be analyzed (...) in terms of similarity alone. The same problem arises for many other kinds of depiction. The essay concludes that depiction in general is not grounded in resemblance but geometrical transformation. (shrink)

Norman Daniels’s theory of ‘accountability for reasonableness’ is an influential conception of fairness in healthcare resource allocation. Although it is widely thought that this theory provides a consistent extension of John Rawls’s general conception of justice, this paper shows that accountability for reasonableness has important points of contact with both utilitarianism and intuitionism, the main targets of Rawls’s argument. My aim is to demonstrate that its overlap with utilitarianism and intuitionism leaves accountability for reasonableness open to damaging critiques. The important (...) role that utilitarian-like cost-effectiveness calculations are allowed to play in resource allocation processes disregards the separateness of persons and is seriously unfair towards individuals whose interests are sacrificed for the sake of groups. Furthermore, the function played by intuitions in settling frequent value conflicts opens the door for sheer custom and vested interests to steer decision-making. (shrink)

The chapter will first consider why Peirce found Kant’s argument interesting and promising, given that it is often regarded as problematic and unsuccessful. It will then briefly reconstruct Kant’s refutation, highlighting its most problematic passages. This essay describes and motivates a new way of distinguishing iconic from symbolic representation. It locates the difference not in the signs themselves, nor in the contents they express, but in the semantic rules by which signs are associated with contents. The two kinds of rule have (...) divergent forms, occupying opposite poles on a spectrum of naturalness. Symbolic rules are composed entirely of primitive juxtapositions of sign types with contents, while iconic rules determine contents entirely by uniform natural relations with sign types. This distinction is marked explicitly in the formal semantics of familiar sign systems, both for atomic first-order representations, like words, pixel colors, and dials, and for complex second-order representations, like sentences, diagrams, and pictures. In this paper, I distinguish three general approaches to public trust in science, which I call the individual approach, the semi-social approach, and the social approach, and critically examine their proposed solutions to what I call the problem of harmful distrust. I argue that, despite their differences, the individual and the semi-social approaches see the solution to the problem of harmful distrust as consisting primarily in trying to persuade individual citizens to trust science and that both approaches face two general (...) problems, which I call the problem of overidealizing science and the problem of overburdening citizens. I then argue that in order to avoid these problems we need to embrace a (thoroughly) social approach to public trust in science, which emphasizes the social dimensions of the reception, transmission, and uptake of scientific knowledge in society and the ways in which social forces influence both positively and negatively the trustworthiness of science. Ground offers the hope of vindicating and illuminating an classic philosophical idea: the layered conception, according to which reality is structured by relations of dependence, with physical phenomena on the bottom, upon which chemistry, then biology, and psychology reside. However, ground can only make good on this promise if it is appropriately formally behaved. The paradigm of good formal behavior can be found in the currently dominant grounding orthodoxy, which holds that ground is transitive, antisymmetric, irreflexive, and foundational. However, heretics (...) have recently challenged the orthodoxy. In this paper, I examine ground’s ability to vindicate the layered conception upon various relaxations of the orthodox assumptions. I argue that highly unorthodox views of ground can still vindicate the layered conception and that, in some ways, the heretical views enable ground to better serve as a guide to reality’s layering than do orthodox views of ground. Carnap’s seminal ‘Empiricism, Semantics and Ontology’ makes important use of the notion of a framework and the related distinction between internal and external questions. But what exactly is a framework? And what role does the internal/external distinction play in Carnap’s metaontology? In an influential series of papers, Matti Eklund has recently defended a bracingly straightforward interpretation: A Carnapian framework, Eklund says, is just a natural language. To ask an internal question, then, is just to ask a question in, say, English. (...) To try to ask an external question is to try, absurdly, to ask a question in no language at all. Finding that so trivial an I/e distinction can’t help to explain Carnap’s deflationary metaontology, Eklund is led to attribute to Carnap a view he calls ontological pluralism. In this paper, I show that Eklund misreads Carnap, and I argue that this misreading obscures fundamental features of Carnap’s philosophy. I then defend an account of frameworks as what Carnap called semantical systems, and I place this account in the context of Carnap’s philosophical program of explication. Finally, I discuss the role that frameworks and the I/e distinction play in ESO, showing that ESO provides no reason to attribute the doctrine of ontological pluralism to Carnap. (shrink)

My two daughters would love to go tobogganing down the hill by themselves, but they are just toddlers and I am an apprehensive parent, so, before letting them do so, I want to ensure that the toboggan won’t go too fast. But how fast will it go? One way to try to answer this question would be to tackle the problem head on. Since my daughters and their toboggan are initially at rest, according to classical mechanics, their final velocity will (...) be determined by the forces they will be subjected to between the moment the toboggan will be released at the top of the hill and the moment it will reach its highest speed. The problem is that, throughout their downhill journey, my daughters and the toboggan will be subjected to an incredibly large number of forces—from the gravitational pull of any massive object in the universe to the weight of the snowflake that is sitting on the tip of one of my youngest daughter’s hairs—so that any attempt to apply the theory directly to the real-world system in all its complexity seems to be doomed to failure. A semantics of pictorial representation should provide an account of how pictorial signs are associated with the contents they express. Unlike the familiar semantics of spoken languages, this problem has a distinctively spatial cast for depiction. Pictures themselves are two-dimensional artifacts, and their contents take the form of pictorial spaces, perspectival arrangements of objects and properties in three dimensions. A basic challenge is to explain how pictures are associated with the particular pictorial spaces they express. Inspiration here comes from recent (...) proposals that analyze depiction in terms of geometrical projection. In this essay, I will argue that, for a central class of pictures, the projection-based theory of depiction provides the best explanation for how pictures express pictorial spaces, while rival perceptual and resemblance theories fall short. Since the composition of pictorial space is itself the basis for all other aspects of pictorial content, the proposal provides a natural foundation for further pictorial semantics. (shrink)

In Kant’s Critique of Pure Reason and the Method of Metaphysics (CUP 2023), I argue that the first Critique is not only a ‘propaedeutic’ to metaphysics, but actually already establishes parts of metaphysics. These parts belong to what Kant calls transcendental philosophy. Additionally, I also provide an account of Kant’s critique of dogmatism and Wolff as its main defender. In this paper, I take up Luigi Filieri’s and Davide Dalla Rosa’s invitation to further develop my characterization of transcendental philosophy and (...) The last couple of decades have witnessed a renewed interest in the notion of inductive risk among philosophers of science. However, while it is possible to find a number of suggestions about the mitigation of inductive risk in the literature, so far these suggestions have been mostly relegated to vague marginal remarks. This paper aims to lay the groundwork for a more systematic discussion of the mitigation of inductive risk. In particular, I consider two approaches to the mitigation of inductive (...) risk—the individualistic approach, which maintains that individual scientists are primarily responsible for the mitigation of inductive risk, and the socialized approach, according to which the responsibility for the mitigation of inductive risk should be more broadly distributed across the scientific community or, even more broadly, across society. I review some of the argument for and against the two approaches and introduce two new problems for the individualistic approach, which I call the problem of precautionary cascades and the problem of exogenous inductive risk, and I argue that a socialized approach might alleviate each of these problems. A filosofia da memória é uma área na qual se convergem conhecimentos próprios da filosofia, assim como de evidências empíricas provenientes da área da psicologia cognitiva e das neurociências. Um dos problemas vigentes dentro da filosofia da memória se concentra na busca de uma definição precisa de nossas memórias episódicas, isto é, nossas memórias de eventos do passado. Uma característica inescapável para qualquer definição precisa da memória episódica concerne sua fenomenologia específica. Apesar de ser um elemento majoritariamente estudado na psicologia, (...) vemos recentemente que a filosofia pode ajudar a clarificar a definição dessa fenomenologia. Além disso, as teorias filosóficas sobre a memória também têm um impacto significativo na maneira como entendemos a memória dentro das ciências empíricas. Assim, o objetivo desse artigo é a definição da fenomenologia da memória episódica, assim como a demonstração de sua fundamental importância para as teorias filosóficas mais recentes sobre a memória episódica. Acredito que através dessa clarificação, estaremos mais bem preparados para caminharmos em direção a um entendimento mútuo e interdisciplinar dessa capacidade cognitiva. (shrink)

In this chapter, I investigate a problem for Kant’s claim that metaphysics can reach the status of science. The problem arises when one considers Kant’s account of the “architectonic unity” of metaphysics in the Architectonic of Pure Reason. Attaining architectonic unity is a condition for becoming a science for any body of cognitions that purports to be such. This is achieved when the cognitions belonging to a science are systematically organized according to the “idea of reason” which lies at the (...) basis of that science. However, Kant suggests that nobody can ever legitimately claim to have matched the idea of the philosopher, where this appears to imply that nobody can justifiably claim that she has fully grasped the idea of metaphysics. This generates a problem. I suggest that when Kant claims that the idea of the philosopher must remain an ideal or an archetype, he has a particular conception of philosophy in mind, that is, philosophy as a doctrine of wisdom. According to this understanding, philosophy must provide an example of how one can become virtuous. However, this is only a partial solution to our problem, for reasons that will be illustrated. This paper explores the socio-epistemic practice of shopping for experts. I argue that expert shopping is particularly likely to occur on what Thi Nguyen calls cognitive islands. To support my argument, I focus on macroeconomics. First, I make a prima-facie case for thinking that macroeconomics is a cognitive island. Then, I argue that ordinary people are particularly likely to engage in expert shopping when it comes to macroeconomic matters. In particular, I distinguish between two kinds of expert shopping, which I (...) call cynical and wishful, and introduce the notion of assisted expert shopping, which occurs when people or organizations shop for experts on behalf of other people. I argue that assisted expert shopping can sometime result in what I call a propagandistic use of expertise. Finally, I critically examine some possible reasons for optimism and find them wanting. I conclude by suggesting that that much of what I said about shopping for macroeconomic experts might also apply mutatis mutandis to other policy-relevant domains of expertise. (shrink)

I develop an interpretation of Maurice Merleau-Ponty's concept of motor intentionality, one that emerges out of a reading of his presentation of a now classic case study in neuropathology—patient Johann Schneider—in Phenomenology of Perception. I begin with Merleau-Ponty's prescriptions for how we should use the pathological as a guide to the normal, a method I call triangulation. I then turn to his presentation of Schneider's unusual case. I argue that we should treat all of Schneider's behaviors as pathological, not only (...) his abstract movements, as is commonly acknowledged in the secondary literature, but also crucially his concrete movements. Using these facts of Schneider's illness, I reconstruct a ‘fundamental function’ of consciousness, as Merleau-Ponty called it, in which there are two kinds of bodily agency: the power of the body to be solicited by a situation and the power of the body to project a situation. I propose that these powers became dissociated in Schneider's case, as evidenced by his abstract and concrete movements, while in the normal case, these powers comprise a dynamic unity, enacted as motor intentionality. I also discuss how my interpretation complements Merleau-Ponty's assertion that motor intentions exist between mind and matter. (shrink)

Unlike his theory of justice as fairness, John Rawls’s political liberalism has generally been spared from critiques regarding what is due to the disabled. This paper demonstrates that, due to the account of the basic ideas of society and persons provided by Rawls, political liberalism requires that the interests of numerous individuals with disabilities should be put aside when the most fundamental issues of justice are settled. The aim is to accommodate within public reason the due concern for the disabled (...) while upholding political liberalism. To achieve this aim, a revision of the basic ideas of persons and society is proposed. The idea of persons should be regarded as more fundamental than that of social cooperation, and persons should be defined in terms of minimal moral powers. (shrink)

The standard model of precedential constraint holds that a court is equally free to modify a precedent of its own and a precedent of a superior court—overruling aside, it does not differentiate horizontal and vertical precedents. This paper shows that no model can capture the U.S. doctrine of precedent without making that distinction. A precise model is then developed that does just that. This requires situating precedent cases in a formal representation of a hierarchical legal structure, and adjusting the constraint (...) that a precedent imposes based on the relationship of the precedent court and the instant court. Normative political theorists have been growing more and more aware of the many difficult questions raised by the discretionary power inevitably left to public administrators. This article aims to advance a novel normative principle, called ‘principle of restraint’, regulating reform of established administrative agencies. I argue that the ability of public administrators to exercise their power in accordance with the requirements of public reason is protected by an attitude of restraint on the part of potential reformers. Specifically, they should refrain (...) from any reform of an administrative agency that involves a switch to a considerably more loosely interconnected system of values underlying the work of that agency. To illustrate the importance of the principle of restraint, I examine a case from British health policy, showing that a recent reform of the National Institute for Health and Care Excellence well exemplifies the serious problems brought by any violation of that principle. Interpretations of Kant’s account of the forms of “taking-to-be-true” (Fürwahrhalten) have generally focused on three such forms: opinion (Meinung), belief (Glaube), and knowledge (Wissen). A second distinction that has received comparatively less attention is that between conviction (Überzeugung) and persuasion (Überredung). Kant appears to use the distinction between the subjective and the objective sufficiency of a taking-to-be-true to characterize all of these forms. However, it is impossible to account for the differences between them by relying on this latter distinction alone. (...) In turn, this makes it difficult to fit all of these forms into a single classification of taking-to-be-true. In this chapter, I propose a new approach to conviction and persuasion that dissolves these problems. Conviction and persuasion are not single forms of taking-to-be-true with distinctive characteristics, yet it is not useful to treat them as “classes” of taking-to-be-true either. Rather, they are “operators” that determine whether a taking-to-be-true is apt or inapt, depending on whether it rests on a correct evaluation of the grounds we have. (shrink)

The victims of severe injustice are allowed to employ disruption and violence to seek political change. This article argues for this conclusion from within Rawlsian political liberalism, which, however, has been criticised for allegedly imposing public reason’s suffocating norms of civility on the oppressed. It develops a novel view of the applicability of public reason in non-ideal circumstances – the “no self-sacrifice view” – that focuses on the excessive costs of following public reason when suffering from severe injustice. On this (...) view, those treated in what Rawls describes as less than a reasonably just way are relieved of the duty of public reason and therefore entitled to employ disruption and violence. In contrast, their privileged fellow citizens must still obey public reason’s civility unless they have been authorised by the oppressed to join their fight. This article also starts exploring from within political liberalism the normative principles governing disruptive and violent protest. (shrink)

In this article, I link the empirical hypothesis that neural representations of sensory stimulation near the body involve a unique motor component to the idea that the perceptual field is structured by skillful bodily activity. The neurophenomenological view that emerges is illuminating in its own right, though it may also have practical consequences. I argue that recent experiments attempting to alter the scope of these near space sensorimotor representations are actually equivocal in what they show. I propose resolving this ambiguity (...) by treating these representations as responsive to the development or degeneration of know-how—which can be isolated as an appropriate object for scientific investigation.
