John Rawls’s political liberalism and its ideal of public reason are tremendously influential in contemporary political philosophy and in constitutional law as well. Many, perhaps even most, liberals are Rawlsians of one stripe or another. This is problematic, because most liberals also support the redefinition of civil marriage to include same-sex unions, and as I show, Rawls’s political liberalism actually prohibits same- sex marriage. Recently in Perry v. Schwarzenegger, however, California’s northern federal district court reinterpreted the traditional rational basis review (...) in terms of liberal neutrality akin to Rawls’s “public reason,” and overturned Proposition 8 and established same-sex marriage. (This reinterpretation was amplified in the 9th Circuit Court’s decision upholding the district court on appeal in Perry v. Brown.) But on its own grounds Perry should have drawn the opposite conclusion. This is because all the available arguments for recognizing same-sex unions as civil marriages stem from controversial comprehensive doctrines about the good, and this violates the ideal of public reason; yet there remains a publicly reasonable argument for traditional marriage, which I sketch here. In the course of my argument I develop Rawls’s politically liberal account of the family by drawing upon work by J. David Velleman and H. L. A. Hart, and discuss the implications of this account for political theory and constitutional law. (shrink)

Nietzsche is known for his penetrating critique of Mitleid. He seems to be critical of all compassion but at times also seems to praise a different form of compassion, which he refers to as “our compassion” and contrasts it with “your compassion”. Some commentators have interpreted this to mean that Nietzsche’s criticism is not as unconditional as it may seem – that he does not condemn compassion entirely. I disagree and contend that even though Nietzsche appears to speak favorably of (...) some forms of compassion, he regards the nature of all compassion to be fundamentally bad. Furthermore, I suggest that Nietzsche’s discussion on different forms of compassion have significant implications for achieving greatness and meaning in life. More specifically, I argue that, for Nietzsche, “our compassion,” however regrettable qua compassion it is, may give occasion for a rare and peculiar insight into “co-suffering” with others, which in turn results in overcoming compassion entirely. I also argue that although Nietzsche objects to compassion, he approves of a form of what feminist theorists might now call “anticipatory empathy.” Even though a large body of literature has evolved over Nietzsche’s critical evaluation of compassion, his understanding of a non-compassionate response to suffering is, in my view, rather overlooked and should receive more attention. The general attitude towards Arthur Schopenhauer’s metaphysics is rather fiercely critical and at times even tendentious. It seems that the figure of Schopenhauer as an irredeemably flawed, stubborn, and contradictory philosopher serves as a leitmotiv among scholars. Schopenhauer’s identification of the thing-in-itself with the will continues to be a thorny puzzle in the secondary literature, and it presents perhaps the greatest challenge to Schopenhauer scholars. Schopenhauer borrows the term ‘thing-in-itself’ from Immanuel Kant, who uses it to refer to a reality (...) that is distinct from what appears to us, and hence unknowable. Despite the fact that several interpretations have been offered to make sense of Schopenhauer’s identification of the thing-in-itself with the will, there appears to be no consensus about how to interpret this identification as well as his understanding of the term ‘thing-in-itself’. Unlike the other interpretations, the interpretation that I offer here distinguishes between three distinct and mutually incompatible views that Schopenhauer formulates about the thing-in-itself. I argue that it is not only difficult to give a coherent, consistent account of Schopenhauer’s position, but also not worth trying, because such an endeavor comes at the cost of ignoring the textual richness and depth of thought that Schopenhauer’s works offer. I argue against a prevailing interpretation of Schopenhauer’s account of inner awareness and world-understanding. Because scholars have typically taken on board the assumption that inner awareness is non-representational, they have concerned themselves in the main with how to transfer this immediate cognition of will in ourselves and apply it to our understanding of the world–as–representation. Some scholars propose that the relation of the world-as-will to the world-as-representation is to be understood in figurative or metaphorical terms. I disagree because, for Schopenhauer, (...) inner awareness reveals a genuine philosophical truth. Some scholars also suggest that it is only via analogical transference that one can interpret the world as having the same inner nature as oneself. I disagree and point out the downside of this suggestion. I use both textual evidence and general philosophical considerations to demonstrate that inner awareness, for Schopenhauer, has a representational dimension. Overlooking this point has led scholars to misconstrue how inner awareness relates to world-understanding. I provide an alternative interpretation against figurative and analogical readings. I propose that, for Schopenhauer, we cognize partially a priori that all things are merely different expressions of the same activity that we are acquainted with in inner awareness. (shrink)

Nietzsche is not known for his theory of empathy. A quick skimming of the Stanford Encyclopedia of Philosophy entry on empathy demonstrates this. Arthur Schopenhauer, Robert Vischer, and Theodor Lipps are among those whose views are considered representative, but Nietzsche has been simply forgotten in discussion of empathy. Nietzsche’s theory of empathy has not yet aroused sufficient interest among commentators. I believe that his views on this subject merit careful consideration. Nietzsche scholars have been interested in his naturalistic accounts of (...) other phenomena, but there seems to be relatively limited interest in his naturalistic account of a phenomenon that is so central to his disagreement with Schopenhauer, namely, empathic concern for others. This is surprising because Nietzsche makes a valuable contribution; he has views more in keeping with contemporary theories of empathy than others of his time. My goal here is to fill in this gap in the scholarship and provide the first thorough analysis of Nietzsche’s theory of empathy, which appears most clearly in Dawn. (shrink)

In Nietzsche and Sociology: Prophet of Affirmation, Anas Karzai attempts to revive and defend the thesis that there is a crucial yet neglected connection between Nietzsche and sociology. In particular, Karzai’s book discusses the relevance of Nietzsche’s critical reflections on society and culture to modern sociological theory, which descends from Kant and Comte through Marx and Engels to Durkheim and Weber. The book has a critical agenda as well. The data analyzed in this paper are part of the results described in Bueno et al. (2000). Three cytogenetics endpoints were analyzed in three populations of a species of wild rodent – Akodon montensis – living in an industrial, an agricultural, and a preservation area at the Itajaí Valley, State of Santa Catarina, Brazil. The polychromatic/normochromatic ratio, the mitotic index, and the frequency of micronucleated polychromatic erythrocites were used in an attempt to establish a genotoxic profile of each area. It (...) was assumed that the three populations were in the same conditions with respect to the influence of confounding factors such as animal age, health, nutrition status, presence of pathogens, and intra- and inter-populational genetic variability. Therefore, any differences found in the endpoints analyzed could be attributed to the external agents present in each area. The statistical models used in this paper are mixtures of negative-binomials and Poisson variables. The Poisson variables are used as approximations of binomials for rare events. The mixing distributions are beta densities. The statistical analyzes are under the bayesian perspective, as opposed to the frequentist ones often considered in the literature, as for instance in Bueno et al. (2000). (shrink)

Three arguments summarize opposition to laws protecting LGBTQ+ persons from discrimination: (1) The pseudo-democratic argument (social change should be free of governmental coercion); (2) The clinical argument (homosexuality is an illness); (3) The choice argument (homosexuality is a choice). My purpose is to show the three are vulnerable to damaging objections. This article reflects conditions as they were in 1987 in the USA. For example, the expression LGBTQ+ had not been coined. The influence of relativism and the paradigm shift in humanity made homosexuality not just acceptable, but in many cases a norm. Although queer families have become recognised over time, same-sex couples striving to become parents through adoption still represent a small percentage of the overall number of couples approved each year. Pathways to adoption have been shown to differ between heterosexual people, lesbians, and gay men. While many gay male couples report their interactions with social care systems have for the most part been positive, instances surface whereby gay men describe social care actors as lacking in a fundamental understanding of sexual (...) identities. Heteronormativity has exercised a profound influence on scholarly research and social work practice, leading to a privileging of heterosexual couples as adopters. This article explores the experiences of gay men seeking to become adoptive fathers, and through an analysis of the decentering heteronormativity model, it challenges social workers to recognise the role played by heteronormative assumptions concerning queer families. Assumptions that include fears regarding the child’s developing sense of self, and the conviction that a child parented by a gay male couple can anticipate a less optimal outcome. (shrink)

This essay derives its focus on poetry from the subtitle of Die Fröhliche Wissenschaft: “la gaya scienza.” Nietzsche appropriated this phrase from the phrase “gai saber” used by the Provençal knight-poets (or troubadours) of the eleventh through thirteenth centuries — the first lyric poets of the European languages — to designate their Ars Poetica or “art of poetry.” I will begin with an exploration of Nietzsche’s treatment of poets and poetry as a subject matter, closely analyzing his six aphorisms which (...) deal explicitly with poets and poetry. Having considered The Gay Science as a text about poetry, I will then briefly explore three further ways in which The Gay Science can be thought of as itself a kind of poetry. The result of these analyses is an understanding of Nietzsche’s own understanding of philosophy (and of the best way to live) as also a form of poetry. (shrink)

Why has modern American conservatism committed itself to gender binaries? Examining why this new categorizing unsettles conservatives (and how they have reacted against teacher unions and transgender influencers), this paper turns to Nietzschean analysis. It finds that the unsettling of heteronormative gender norms resulted in a pivot by conservatism to perpetuate a new gender identity politics in which nonbinary and especially transgender people are scapegoated. Imagining a nihilistic interpretation of gender, conservatives have made “transgender” a signifier of amorality and barbarism, (...) envisioning themselves as warriors of normalcy. Conservative activists have named their frontier “radical gender ideology” while contesting the legitimacy of diagnosed gender dysphoria, revising its pathology, and alleging clinical gender transitioning is a financial ploy. As a result, bodies have become sites of contestation between doctors, trans activists, and groups that advocate against gender-affirming care. This paper traces the conservative movement from resentment to opposition on three fronts – pathology, pronouns, and restrooms. (shrink)

There are no technologies at the present time that would allow parents to select the sexual orientation of their children. But what if there were? Some commentators believe that parents should be able to use those techniques so long as they are effective and safe. Others believe that these techniques are unethical because of the dangers they pose to homosexual men and women in general. Both sides point to motives and consequences when trying to analyse the ethics of this question. (...) These arguments are reviewed, and it is concluded that opponents of these technologies have not shown good reason why the law or policy should override parental choice in this matter. In general, therefore, if technologies become available to choose the sexual orientation of children, parents should be allowed to use them, provided they are safe and disrupt no interest of the child. This use will, at the very least, protect homosexual children from parents who do not want them, but it will also allow parents who want homosexual children to make that choice as well. (shrink)

The endurance of depression, anxiety and suicidal ideation among gay and bisexual men persists despite advances in civil rights and wider social acceptance. While minority stress theory provides a framework for much scholarly debate as to the causes of mental distress among non-heterosexual men, there is a growing interest into the detrimental effects that competitiveness within the gay community itself can have. Past studies have celebrated involvement in gay culture as being associated with better mental health outcomes by tempering the (...) impact of hegemonic heteronormativity. Yet between non-heterosexual men and the general population, there are stark mental health inequalities that require investigation. As a means of proving manhood, men in general are predisposed toward competitiveness and risk, but within a subculture where the attention is exclusively on male sex, the focus is primarily status conscious. This article draws on minority stress theory to consider societal discrimination. It also applies inter-minority gay community stress theory to explore pressures emanating from gay spaces with fixations on masculinity, income and rivalry as major sources of mental health problems in gay and bisexual men. The causes for health disparities illustrated in this article, demonstrate a critical need for public health and social care organizations to respond with innovatory services, based on a firm understanding of stressors arising from interactions between men in gay spaces. -/- . What’s important about ‘coming out’? Why do we wear business suits or Star Trek pins? Part of the answer, we think, has to do with what we call agential identity. Social metaphysics has given us tools for understanding what it is to be socially positioned as a member of a particular group and what it means to self-identify with a group. But there is little exploration of the general relationship between self-identity and social position. We take up this exploration, developing (...) an account of agential identity—the self-identities we make available to others. Agential identities are the bridge between what we take ourselves to be and what others take us to be. Understanding agential identity not only fills an important gap in the literature, but also helps us explain politically important phenomena concerning discrimination, malicious identities, passing, and code-switching. These phenomena, we argue, cannot be understood solely in terms of self-identity or social position. (shrink)

On Nietzsche, science, the oral tradition -- or the troubadours and ancient Greek music drama.

The aim of this essay is to review Friedrich Nietzsche's "The Gay Science" in English Translation. It compares and contrasts the translations by Thomas Common, Walter Kaufmann, Josefine Nauckhoff, and R. Kevin Hill. First, I argue in favor of translating the work's title "Die Fröhliche Wissenschaft" as "The Gay Science" or perhaps more precisely as "The Gay Knowledge". Nietzsche who is likely the greatest stylist in the German language wrote with philological precision and succinctness. This exactitude and awareness of the (...) shaping influence of linguistic means on the contents expressed therefore needs to be reflected throughout in any kind of rendition of Nietzsche's artful texts and the evaluation and assessment thereof. Two studies demonstrate that a dispositional proneness to disgust (“disgust sensitivity”) is associated with intuitive disapproval of gay people. Study 1 was based on previous research showing that people are more likely to describe a behavior as intentional when they see it as morally wrong (see Knobe, 2006, for a review). As predicted, the more disgust sensitive participants were, the more likely they were to describe an agent whose behavior had the side effect of causing gay men to kiss in (...) public as having intentionally encouraged gay men to kiss publicly— even though most participants did not explicitly think it wrong to encourage gay men to kiss in public. No such effect occurred when subjects were asked about heterosexual kissing. Study 2 used the Implicit Association Test (IAT; Nosek, Banaji, & Greenwald, 2006) as a dependent measure. The COVID-19 pandemic paved the way for the emergence of the Boys’ Love (BL) theme and genre throughout various media platforms, causing disruptive visibility to the narratives and representation of gays (Andrada in an interview by Antonio, 2021; Ting, 2020). This disruption may have started a dialogue in social media, but this dialogue was only a limited attempt given that most of the discussions have stereotypical representations of gay men (Celso, 2020). This study analyzes how humor was applied in the (...) online comic, SariSari Story, and how humor is used in the portrayal of the gay characters in this online comic. The analysis uses Grice’s (2012) pragmatic framework of conversational maxims: quality, quantity, manner, and relation. Humor was indicated in the non-observance of one or more maxim(s), which, then, caused the implicatures. The study found that the most non-observed maxims were quantity, manner, and relation. The prominent type of humor present in the comic was the Freudian slip, where the slips contained sexual metaphors mostly associated with the characters’ sexual desires towards each other. As an example of the BL genre, the Sari-Sari Story online comic stereotyped its presentation of gay characters as hypersexual in their relationships with each other. In this, it deviated from the conventions of the Pinoy BL present in the mainstream media. (shrink)

This monograph traces the history of the concept of Gay Science, made popular by Friedrich Nietzsche through his book The Gay Science. Contrary to Nietzsche’s mistaken notion of the concept, it did not refer to a Troubadour poetics, but rather to a post-Troubadour poetics of recuperation—the complete opposite of what Nietzsche had thought. This poetry was not sung to young maidens, but instead to the Virgin Mary. The poetics of the Gay Science is found in an eight hundred page compendium (...) entitled Las leys d’amors, compiled in 1536 by Guilhem Molinier, and edited by Joseph Anglade in 1919. This post-Troubadour poetics gave rise to two schools of gaya sciensa, one in Toulouse (“Consistoire du Gai Savoir” in 1323) and the other in Barcelona (“Consistori de Barcelona” in 1338), where floral games took place. The aim here, then, is to trace the genealogy of the gay science through the cultural history of Toulouse, Barcelona, the Spanish poets of the 15th century, and its last “inheritor,” Nietzsche. -/- . ABSTRACTAmor fati—the love of fate—is one of many Nietzschean terms which seem to point towards a positive ethics, but which appear infrequently and are seldom defined. On a traditional understanding, Nietzsche is asking us to love whatever it is that happens to have happened to us—including all sorts of horrible things. My paper analyses amor fati by looking closely at Nietzsche's most sustained discussion of the concept—in book four of The Gay Science—and at closely related passages in that book. I (...) argue that by ignoring the context in which Nietzsche writes about amor fati in The Gay Science, we are liable to ignore several exegetical and philosophical problems with the traditional understanding of the term. I'll argue for a different interpretation which locates Nietzsche's amor fati within the philosophical project of The Gay Science and which copes better with the objections that plague the traditional view. This paper concerns the investigation of some speciñc possible relation between Rev. John Gay’s and David Hume’s moral theories. In the part, Gay’s thought is reconstructed trying to show his relatively neglected central role in the utilitarian tradition. From a close scrutiny of Gay’s criticisms to Hutcheson's moral theory it is possible to show how the author, Working on lockean views of language and psychology, have constructed in the moral branch an specifically utilitarian theoretical framework. In the second part, it (...) is argued in favor of a certain continuity between Gay’s and Hume’s moral thought. The comparison of the Rev. John Gay’s Dissertation concerning the fundamental principle ofthe virtue or morality with Hume’s books II and III of A Treatise of human Nature reveals similarities which support the hypothesis, chronologically possible, that Hume was inspired or perhaps influenced by the reading of Gay's Dissertation. As matter of conclusion it is suggested that Hume’s Tïeatise paragraph about “is” and “ought” is somehow related to Gay's Dissertation paragraph in which We can read “...some things and actions are apt to produce pleasure, others pain; some are convenient, other inconvenient for a society; some are for the good of mankind; others tend to detriment of it; therefore those are to be chosen which tend to the good of mankind, the others to be avoided.”. One of the issues that caught my attention in the discussion on Religion and Human Rights, which is also an issue that has recently started to be hotly discussed in Indonesia, is the issue of LGBTQ+ minority rights (gay rights). This issue becomes interesting, the issue of gay rights, especially when this issue deals with the Freedom of Religion or Belief (FoRB). As we saw in the discussion of human rights at International, tensions between gay rights and FoRB in several (...) countries have their own characteristics. For example, in Indonesia, recently, the movement for defenders of the FoRB has begun to bloom, and, I observe, there is a tendency to include minority groups such as indigenous people, including LGBTQ+ people (gay rights), into their circle of struggle. The question is, how do religious freedom rights (FoRB) deal with gay rights? Or conversely, how do gay rights deal with religious freedom? In that context, this book becomes relevant to discuss. This book provides each author’s many different moral arguments and philosophical commitments. (shrink)

Research has uncovered consistent gender differences in attitudes toward gay men, with women expressing less prejudice than men (Herek, 2003). Attitudes toward lesbians generally show a similar pattern, but to a weaker extent. The present work demonstrated that motivation to respond without prejudice importantly contributes to these divergent attitudes. Study 1 revealed that women evince higher internal motivation to respond without prejudice (IMS, Plant & Devine, 1998) than do men and that this difference partially mediates the relationship between gender and (...) attitudes toward gay men. The second study replicated this finding and demonstrated that IMS mediates the relationship between gender and attitudes toward lesbians. Study 2 further revealed that gender-role variables contribute to the observed gender differences in motivation to respond without prejudice. These findings provide new insights into the nature of sexual prejudice and for the first time point to possible antecedents of variation in motivation to respond without prejudice. (shrink)

This paper defends a legal and political conception of sexual relations grounded in Kant’s Doctrine of Right. First, I argue that only a lack of consent can make a sexual deed wrong in the legal sense. Second, I demonstrate why all other legal constraints on sexual practices in a just society are legal constraints on seemingly unrelated public institutions. I explain the way in which the just state acts as a civil guardian for domestic relations and as a civil guarantor (...) for private property and contract relations—and thereby enables the existence of legally enforceable claims. Throughout the aim is to demonstrate that Kant’s relational conception of justice entails that legally enforceable claims regarding sexual deeds are fully justifiable only insofar as they are determined and enforced by a public authority that we may refer to as a liberal democratic welfare state. It is unclear that United States schools are doing sufficient work to identify and protect the interests of their LGB students this analysis, we rely on certain public-health research in social epidemiology to show that discrimination against LGB adolescents imposes morally significant harms to both adolescents and community. We apply "trust” and “social capital” to educational standards and practices as foundations for educational practices that work toward full equality of LGB students in regard to opportunity and other primary social goods.

After stating "I am gay" Navy Lieutenant Paul G. Thomasson was honorably discharged from the military. In Thomasson v. Perry (1996), the United States Court of Appeals for the Fourth District affirmed Thomasson's discharge. Thomasson is now considered the leading case evaluating the U.S. military's "don't ask, don't tell" policy. In this paper, I show that the court's analysis of the Department of Defense policy rests of two unarticulated and undefended assumptions about sexuality. The first is that an act of (...) sex is essentially defined in terms of the sexual orientation of the persons engaging in that act. The second is that whether or not a person is an open homosexual determines the essential nature of the homosexual acts of others. I conclude that both assumptions are untenable, therefore the "don't ask, don't tell" policy is indefensible. (shrink)

Lesbian organizations have frequently cited the concept of a Lesbian Nation as an ideal community where women could be freed from the oppression of relationships with men. The term was used in speeches made by lesbian activists beginning in the 1970s. However, lesbian militant activities have increasingly merged with the overall gay civil rights movement, so that most activists have preferred to use the term Queer Nation to refer to the movement in general.

My paper is a reaction to polemic of Tomasz Sieczkowski "Discrimination nonetheless. A reply to Krzysztof Saja” [ICF "Diametros" (36) 2013] that he wrote against my paper "Discrimination against same-sex couples" [ICF “Diametros" (34) 2012]. The purpose of the paper is to refute Sieczkowski’s objections that rely on wrong interpretation of the structure of my main argument. I will describe the proper course of the reasoning that I have expressed in the first article and undermine the Sieczkowski’s proposal to justify (...) gay marriages by referring to values such as dignity, freedom and equality. The ideological interface between Muslims and liberal educators undoubtedly is strained in the realm of sex education, and perhaps on no topic more so than homosexuality. Some argue that schools should not try to ‘undermine the faith’ of Muslims, who object to teaching homosexuality as an ‘acceptable alternative lifestyle’. In this article, I will argue against this monolithic presentation of Islam. Furthermore, I will argue that a narrow view of Islam is neglectful of gay and lesbian Muslims who are particularly (...) vulnerable to the unrepentant hostilities of their own communities. (shrink)

Wir - als Queers - sollten uns schämen. Denn Scham ist, so verspricht „Gay Shame“, ein Weg zu einer neuen Radikalisierung von queerer Kritik. Gay Shame ist der wörtliche Gegensatz zu Gay Pride und kritisiert, dass der stolze Mainstream der LGBT-Community in den letzten Jahren immer angepasster, bürgerlicher, kapitalistischer und homonormativer geworden ist. Stolz ist man vor allem darauf, endlich dazuzugehören und mitheiraten oder mitkämpfen zu dürfen. Was Scham ist und welche queerpolitische Bedeutung sie hat wird in dem Sammelband von (...) Akademiker_innen, Aktivist_innen und Künstler_innen diskutiert. Sie öffnen den Blick für „beschämende“ Aspekte des queeren Lebens, die in der LSBT-Forschung weitgehend verdrängt wurden, um bestehende homophobe Ideen und Klischees nicht noch zu bestärken. This paper comments on the strategies and goals of a politics of recognition as celebrated by Nancy Nicol’s important documentary coverage of the gay and lesbian movement for family rights in Quebec. While agreeing that ending legal discrimination against lgbt families is important, I suggest that political recognition of same-sex families and their children is a too limited goal for queer families and their allies. Moreover, it is a goal, I argue, that often trades on trades on troublesome assumptions about (...) gender, class, race, age and normative commitments to monogamy as these relate to distinctions between, for example, “fit” and “unfit” parents. Akin to the mathematical recreations, John Wilkins' Mathematicall Magick (1648) elaborates the pleasant, useful and wondrous part of practical mathematics, dealing in particular with its material culture of machines and instruments. We contextualize the Mathematicall Magick by studying its institutional setting and its place within changing conceptions of art, nature, religion and mathematics. We devote special attention to the way Wilkins inscribes mechanical innovations within a discourse of wonder. Instead of treating ‘wonder’ as a monolithic category, we present a typology, (...) showing that wonders were not only recreative, but were meant to inspire Wilkins' readers to new mathematical inventions. In The Gay Science (1882), Nietzsche heralded the problem of nihilism with his famous declaration “God is dead,” which signalled the collapse of a transcendent basis for the underpinning morality of European civilization. He associated this collapse with the rise of the natural sciences whose methods and pervasive outlook he was concerned would progressively shape “an essentially mechanistic [and hence meaningless] world.” The Russian novelist Turgenev had also associated a scientific outlook with nihilism through the scientism of Yevgeny Bazarov, a (...) character in Fathers and Sons. A century or so later, can we correlate relevant scientific results and the nihilistic consequences that worried these and other nineteenth-century authors? The aversion of empirical disciplines to such non-empirical concepts as personhood and agency, and their methodological exclusion of the very idea of value would make this a difficult task. Recent neuroscientific (MRI) investigations into free will might provide a useful starting point for anyone interested in this sociological question, as might the research results of experimental or evolutionary psychologists studying what they take human beings to be. In this paper, I turn instead to a more basic issue of science. I will question the universality of a principle of identity assumed by a scientific understanding of what it means for anything to exist. I will argue that the essential features of human existence present an exception to this principle of identity and thereby fall outside the grasp of scientific inquiry. The basis of this argument will be an explanation of why it is nonetheless rational for us to affirm personhood, agency, moral values, and many more concepts that disappear under the scrutiny of the sciences. Gay men have been severely affected by the AIDS crisis, and gay subjectivity, sexual ethics, and politics continue to be deeply influenced by HIV to this day. PrEP (Pre-Exposure Prophylaxis) is a new, drug-based HIV prevention technique, that allows disentangling gay sex from its widespread, 40 yearlong association with illness and death. This article explores PrEP's fundamental impact on gay subjectivity, sexual ethics, and politics. It traces the genealogy of gay politics regarding homophobia and HIV stigma, suggesting a new biopolitical (...) and body political framework that accounts for the agency of activists as well as pharmapower, and proposing that PrEP is an example of democratic biopolitics. Highlighting the entanglement of medical technology, sexual ethics, and politics, the article shows how conservative and homonormative gay politics developed as a reaction to HIV stigma and how, by overcoming this stigma, PrEP enables a new era of intersectional queer politics and solidarities. It thereby develops a Foucauldian account of sexual liberation beyond the repression hypothesis that accounts for the ambivalence of sexual subjectification and the political potential of sexuality. Chapter 1 of this book argued that moral philosophy should be based on seven principles of theory selection adapted from the sciences. Chapter 2 argued that these principles support basing normative moral philosophy on a particular problem of diachronic instrumental rationality: the ‘problem of possible future selves.’ Chapter 3 argued that a new moral principle, the Categorical-Instrumental Imperative, is the rational solution to this problem. Chapter 4 argued that the Categorical-Instrumental Imperative has three equivalent formulations akin to but superior to (...) Kant’s formulations of the Categorical Imperative. Chapter 5 argued that my principle’s three formulations make it rational to adopt a Moral Original Position to derive moral principles. The present chapter derives Four Principles of Fairness from the Moral Original Position--principles of coercion minimization, mutual assistance, fair negotiation, and virtue—and unifies them into a single principle of rightness: Rightness as Fairness. Finally, this chapter argues that Rightness as Fairness entails a novel approach to applied ethics called ‘principled fair negotiation’, illustrating how the theory provides a plausible new framework for addressing applied cases including lying, suicide, trolleys, torture, distribution of scarce resources, poverty, and the ethical treatment of animals. Russellian monism (RM) attributes experience to the intrinsic nature of physics’ abstract mathematical accounts of the world. It’s touted as a promising mind-body solution, for it avoids dualist and physicalist issues. Yet this status is imperiled by its deeply obscure ideas of mental combination, protophenomenal entities, emergent experience, grounded abstractions, et cetera. This “metaphysical magical mystery tour” may render RM as problematic as competing views. A clear, simple panpsychism akin to Strawson’s might avoid these issues. In this theory (NPP), experience (...) is the real, underlying nature of matter-energy, hidden beyond its sensory appearances. NPP may avoid panpsychist combination problems by showing how neurons can electrically bind their minimal experience to form percepts, thoughts, and subjects. This might explain combination in testable ways, while RM instead turns to questionable microsubjects and binding mechanisms. NPP’s virtues are its metaphysical simplicity, empirical support, testable foundations—and its avoidance of the issues in RM and other standard theories. It might point to a mind-body solution. This essay involves exploration of certain repercussions of Bernard Williams’ view that there is, in Wittgenstein’s later work, a transcendental idealism akin to that found in the Tractatus—sharing with it the feature that it cannot be satisfactorily stated. It is argued that, if Williams is right, then Wittgenstein’s later work precludes a philosophically substantial theory of meaning; for such a theory would force us to try to state the idealism. In a postscript written for the reprint of the essay, reasons (...) are given for thinking that Williams is not right: Wittgenstein’s later work actually helps us to repudiate as ill-conceived all those questions whose answers invite us to embrace any such idealism. But the main thesis of the essay remains intact. Indeed the idea that Wittgenstein’s later work precludes a philosophically substantial theory of meaning is reinforced. (shrink)

The point of this paper is to reveal a dogma in the ordinary conception of sensory imagination, and to suggest another way forward. The dogma springs from two main sources: a too close comparison of mental imagery to perceptual experience, and a too strong division between mental imagery and the traditional propositional attitudes (such as belief and desire). The result is an unworkable conception of the correctness conditions of sensory imaginings—one lacking any link between the conditions under which an imagining (...) aids human action and inference and the conditions under which it is veridical. The proposed solution is, first, to posit a variety of imaginative attitudes—akin to the traditional propositional attitudes—which have different associated correctness (or satisfaction) conditions. The second part of the solution is to allow for imaginings with “hybrid” contents, in the sense that both mental images and representations with language-like constituent structure contribute to the content of imaginings. The suggestion of something akin to a ‘relativist solution to the Mind-Body problem’ has recently been held by some scientists and philosophers; either explicitly (Galadí, 2023; Lahav & Neemeh, 2022; Ludwig, 2015) or in more implicit terms (Solms, 2018; Velmans, 2002, 2008). In this paper I provide an argument in favor of a relativist approach to the Mind-Body problem, more specifically, an argument for ‘1st/3rd person relativism’, the claim that ‘The truth value of some sentences or propositions is relative to (...) 1st and 3rd person perspectives’. The argument for 1st/3rd person relativism is close to a forma proof. It is shown that, just by assuming the 1st/3rd person distinction itself and using first order logic and set theory, ‘1st/3rd person relativism’ follows as a theorem. Some consequences of ‘1st/3rd person relativism’ to the Mind-Body Problem are evaluated. It is shown that ‘1st/3rd person relativism’ predicts the existence of an (apparent) Explanatory Gap; explains why the Explanatory Gap is just apparent (and the origins of such illusion); dissolves the Hard-Problem; provides a possible solution the problem of Mental Causation; explains why Mental Causation looks like a problem in the first place and accurately predicts the actual empirically found correlation and covariation between conscious experiences and brain states. This explanatory power of ‘1st/3rd person relativism’ is particularly impressive since it was not designed as a possible solution to the Mind-Body problem in the first place. (shrink)

In this essay we take the view that too much reality has been afforded to the notion of ‘particles’ and to ‘flow of supercurrent,’ in the superconducting state. Instead we take the original point of view of Josephson that “ It is clear that intuition is of no great help in understanding the supercurrent as a flow of Cooper pairs “ which is more akin to, and in line with, a “telegraphing of amplitudes” approach. With this conception in mind, we (...) examine the results of Jillie et al and Smith et al. of two Josephson junctions connected in series by a superconducting join. We argue that their results can best be understood in terms of the entanglement of current elements via the interfering of amplitudes. We sketch an approach to calculating the current spanning two entangled Josephson junctions, which reduces to the relation for a single junction when the current is set zero in either of the pair, or the entanglement ceases. We speculate that if this interfering of amplitudes was found to persist, after the separation of the junctions in space, there still remaining a connection in their common past, then this would furnish, at least the possibility, of a new means of signalling without wires. Measuring the effectiveness of medical interventions faces three epistemological challenges: the choice of good measuring instruments, the use of appropriate analytic measures, and the use of a reliable method of extrapolating measures from an experimental context to a more general context. In practice each of these challenges contributes to overestimating the effectiveness of medical interventions. These challenges suggest the need for corrective normative principles. The instruments employed in clinical research should measure patient-relevant and disease-specific parameters, and should not be sensitive (...) to parameters that are only indirectly relevant. Effectiveness always should be measured and reported in absolute terms (using measures such as 'absolute risk reduction'), and only sometimes should effectiveness also be measured and reported in relative terms (using measures such as 'relative risk reduction')-employment of relative measures promotes an informal fallacy akin to the base-rate fallacy, which can be exploited to exaggerate claims of effectiveness. Finally, extrapolating from research settings to clinical settings should more rigorously take into account possible ways in which the intervention in question can fail to be effective in a target population.
