The paper focuses on the issue of truth-telling in non-fictional narratives of (in)justice. Based on examples of rape narratives, domestic abuse narratives, human trafficking narratives and asylum seeker narratives, I examine the various difficulties in telling the truth in such stories, particularly those related to various culturally conditioned ideas of how the world works, which at the same time form the basis of, among other things, legal discourse and officials’ decision-making processes. I will also demonstrate that such culturally conditioned ideas, (...) which are the basis of official discourse, can be considered within the category of both the social imaginary of the just world in the Taylorian sense of the term, and the social master narrative, which in the case of stories of (in)justice is often based on the just world hypothesis. We start by presenting three different views that jointly imply that every person has many conscious beings in their immediate vicinity, and that the number greatly varies from person to person. We then present and assess an argument to the conclusion that how confident someone should be in these views should sensitively depend on how massive they happen to be. According to the argument, sometimes irreducibly de se observations can be powerful evidence for or against believing in metaphysical theories.

Dominują w nim skrótowe i kompaktowe wypowiedzi; język z jednej strony traci na znaczeniu, z drugiej zaś - chłonie nowinki z innych systemów językowych, z którymi wchodzi w interakcje na różnych płaszczyznach. Niewątpliwe ogromną rolę odgrywają w tym procesie różnice kulturowe i związane z tym nie tylko kwestie mentalności, stereotypy, lecz także odmienne pojmowanie zjawisk dnia codziennego, w tym (...) również sposób definiowania poczucia humoru. Ciekawą rzeczą jest więc próba wskazania na podobieństwa oraz różnice między tzw. „typowo niemieckim” poczuciem humoru a niemieckim programem komediowym Was guckst du?, produkowanym i prowadzonym przez obcokrajowca. Kaya Yanar, autor i gospodarz tego programu, jest niewątpliwie najlepszym przykładem na to, że wymienione wcześniej „typowo niemieckie” poczucie humoru odbiega w znacznym stopniu od rodzaju żartu, proponowanego właśnie przez Yanara. Was guckst du? daje możliwość zanalizowania języka audycji komediowej, odwołującej się głównie do kultury świata arabskiego i wszelkich zjawisk z nią związanych, kwestii opanowania i posługiwania się językiem niemieckim właśnie przez obcokrajowców z tego kręgu kulturowego. W przełożeniu na leksykę i jej użycie w praktyce oznacza to wykorzystanie w programie zjawiska wieloznaczności, wynikających z braku znajomości języka, jako źródła sytuacji komediowych, które w połączeniu z niezwykle barwną osobą prowadzącego, odpowiednim obrazem, charakterem postaci oraz motywami muzycznymi, jest punktem wyjścia do całościowej analizy tegoż programu. Zmiany dokonujące się w języku na przestrzeni dziejów są wynikiem zmian w rzeczywistości pozajęzykowej. Nowe elementy leksyki są m. in. efektem procesu zapożyczenia z innych języków. Słowa te w momencie przejmowania ich przez inny język tracą swe wszelkie pierwotne powiązania z innymi leksemami, które miały w języku, z jakiego zostały przejęte, i wchodzą w nowe relacje semantyczne z istniejącymi już w danym poiu wyrazowym słowami, stając się jego nieodłącznym elementem. W procesie asymilacji na płaszczyźnie semantycznej wchodzą one w nowe dla (...) siebie relacje paradygmatyczne i syntagmatyczne, wpływając znacząco na strukturę danego pola wyrazowego i przyczyniając się do zmian w jego obrębie. Zapożyczone z innego języka wyrazy mogą ze względu na swe znaczenie stać się w danych polach elementami dominującymi lub też pojawić się w nowym otoczeniu leksykalnym obok rodzimych synonimów. Jedynie użytkownik języka, przy uwzględnieniu kontekstu językowego i sytuacyjnego, decyduje o ich użyciu. (shrink)

W wyniku kontaktów polsko-niemieckich na płaszczyźnie kultury, polityki i gospodarki na przestrzeni dziejów pojawiły się w języku polskim liczne wyrazy pochodzenia niemieckiego. We współczesnej polszczyźnie występuje bardzo wiele zapożyczeń niemieckich, z czego większość stanowią rzeczowniki. Najczęściej jednak ich obce pochodzenie nie jest znane przeciętnemu użytkownikowi języka polskiego, gdyż wyrazy te zasymilowały się w polszczyźnie zarówno na płaszczyźnie fonologicznej, graficznej, jak i morfologicznej. Największą grupę rzeczowników pochodzenia niemieckiego stanowią te, w których przypadku zachowane zostało ich pierwotne znaczenie, co wiąże się z (...) faktem, że jako pojęcia i terminy fachowe nie miały w języku polskim swoich odpowiedników, pod wpływem których mogłoby ulec zmianie ich znaczenie. Wśród zapożyczeń znajdują się również takie, których znaczenie całkowicie różni się od pierwotnego znaczenia słowa niemieckiego. Znaczenie zapożyczeń ulegało zawężeniu, gdy dany wyraz pojawiał się w języku polskim nie we wszystkich swych znaczeniach pierwotnych lub też rozszerzeniu, gdy został on zapożyczony zс wszystkimi pierwotnymi znaczeniami i dodatkowo obok nich pojawiło się zupełnie nowe znaczenie. Częstym zjawiskiem jest występowanie równocześnie różnych typów zmian znaczenia wyrazu zapożyczonego, np. zawężenia i przesunięcia lub/i rozszerzenia znaczenia. (shrink)

The paper contains a general characteristics of the relation between Lev Shestov’s philosophy of existence and transcendental phenomenology of Edmund Husserl. The analysis was largely inspired by Cezary Wodziński’s research on Shestov’s writings, including his book published in Polish Wiedza a zbawienie. Studium myśli Lwa Szestowa (1991). In 1931, inspired by Descartes’ Meditationes de prima philosophiae, Husserl began a total transformation of philosophy into a science absolutely founded, assumptionless and developed in the spirit of absolute self-responsibility. Thus, the idea of (...) philosophy as an exact science and Descartes’ idea of a science absolutely founded became the aim. It resulted in a project of universal science which — according to Husserl — has been the aim of European philosophy from the beginning. Ultimately, this philosophy was to rebuild the whole model of European culture. Less than two years after the first edition of Die Krisis der europäischen Wissenchaften und die transzendentale Phänomenologie, Lev Shestov published his Athens and Jerusalem (1938) where he agrees with Husserl’s diagnosis that the whole European culture is in a stage of a deep crisis which goes to its very foundations. However, Shestov points at the radically different sources of that crisis. Paradoxically, a remarkable friendship connecting these two thinkers did not affect the similarity of their views. In fact, they are located at the opposite poles of the contemporary philosophical scene. The friendship of Shestov and Husserl was born in the atmosphere of an intense and uncompromising intellectual debate. Both thinkers are strongly convinced that the fate of European culture and European understanding what it is to be man are decided in the realm of philosophy. So, the philosophical projects they offer are two extremely critical visions of culture. MacKay and Robinson (2016) claim that some legal procedures that regulate organ donations (VAC, opt-in, opt-out) bypass people's rational capacities and thus are “potentially morally worse than MAC”, which only employs a very mild form of coercion. We provide a critique of their argumentation and defend the opposite thesis: MAC is potentially morally worse than the three other options.

Background: Biomedical research nowadays is increasingly carried out in multinational and multicenter settings. Due to disparate national regulations on various ethical aspects, such as informed consent, there is the risk of ethical compromises when involving human subjects in research. Although the Declaration of Helsinki is the point of reference for ethical conduct of research on humans, national normative requirements may diverge from its provisions. The aim of this research is to examine requirements on informed consent in biomedical research in Germany, (...) Poland, and Russia to determine how each national regulatory framework relates to the provisions of the Declaration of Helsinki. Methods: For this analysis, we conducted a search of the legal databases “Gesetze im Internet” for Germany, “Internetowy System Aktow Prawnych” for Poland, and “ГAPAHT – Garant” for Russia. The search was complemented by a review of secondary literature contained in the databases Google Scholar, PubMed, Polish National Library, and eLibrary ru. We have identified 21 normative regulations containing provisions on informed consent in clinical research in all three countries. The content of these documents was systematically categorized and analyzed. Results: The normative framework in all three countries shows a strong commitment towards the core ethical principles of research envisaged in the Declaration of Helsinki. Nevertheless, provisions on informed consent vary between these three countries. The differences range from the method and language in which information should be provided, through the amount of information required to be disclosed, to the form of documenting consent or withdrawal. In the case of research on vulnerable groups, these differences are particularly visible. Conclusions: The identified differences can negatively impact the ethical conduct of international clinical studies. Attention needs to be paid that flexibilities within national regulations are not misused to undermine the protection of research subjects. Achieving global or regional legislative harmonization might prove impossible. Such lack of legal consensus reinforces the significance of the international ethical agreements. (shrink)

Capitalism: The Birth of an Idea. Amongst the Enlightenment’s emancipatory slogans was a call for the liberation of economic energy, a call that was most fully expressed by Adam Smith in Inquiry into the Nature and Causes of the Wealth of Nations. Smith provided a final analysis of the mercantilist system that had been prevailing from the beginning of the sixteenth century. By justifying the superiority of the free market economy models, Smith created the intellectual foundations for the capitalist order. (...) He proposed a model for the production and distribution of goods that was based on two pillars: the right to private property and free market institutions. The vision of capitalism created by Smith was a system of power and freedom: a system of individual sovereignty over the world of objects and a system of the free circulation of goods. The combination of these two principles resulted in a coherent system which, when used in practice, has shown remarkable efficiency. Smith’s work proved to be a reliable way to achieve worldly success, one that has worked wherever it was tried out. Capitalism, and the accompanying moral philosophy, was the most commonly pursued idea of the eighteenth century. (shrink)

Badania prezentowane w niniejszej publikacji miały na celu dostarczenie danych koniecznych do prowadzenia polskiej polityki zagranicznej rozszerzonej o wymiar samorządowy i obywatelski w województwie podlaskim. Głównym celem diagnozy było zbadanie, jak jednostki samorządu terytorialnego, organizacje pozarządowe, przedsiębiorstwa oraz uczelnie wyższe nawiązywały współpracę transgraniczną z partnerami na Litwie, Białorusi, Ukrainie i w Rosji (Obwód Kaliningradzki). W publikacji wskazano miejsca największego potencjału, jak również barier na drodze do takiej współpracy w regionie. Zwrócono szczególną uwagę na kooperację tych podmiotów, łączenie swoich potencjałów i (...) tworzenie wspólnych projektów. * Studies presented in this publication were aimed at provide data necessary for the conducting of local government and citizenship dimension of the enlarged Polish foreign policy in Podlaskie region. The main objective was to investigate the diagnosis, as the local government units, non-governmental organizations, businesses and universities alluded cross-border cooperation with partners in Lithuania, Belarus, Ukraine and Russia (Kaliningrad). The publication indicated areas of the greatest potential, as well as barriers to such cooperation in the region. This study aims to bring out the explanatory potential of embodied predictionism versus passive feed-forward model of sensory stimulation in the pursuit of a parsimonious naturalist account of sensation as a salient feature and an end point of conscious experience. Theoretical approaches towards sensory experience are tested against specific scenarios of the absence of observable or palpable qualities including but not limited to the thought-experimental phenomenon of negative synesthesia at the conclusion of the argument. . Predictionism is first explored in (...) its own right only to be found insufficient to do justice to the actual mechanism behind full-blown immediate perception. The Axis II Work Group of the Task Force on Diagnostic and Statistical Manual of Mental Disorders (DSM-IV) has expressed concern that antisocial personality disorder (APD) criteria are too long and cumbersome and that they focus on antisocial behaviors rather than personality traits central to traditional conceptions of psychopathy and to international criteria. R. D. Hare et al describe an alternative to the approach taken in the DSM-III—Revised (DSM-III—R; American Psychiatric Association, 1987), namely, the revised Psychopathy Checklist. Increasingly im- portant in the socio-economic transformation is cultural sector as well as promotion of culture and creative industries development including their linkages with dependent sectors such as tourism, architecture and industrial design. The aim of this article is to refer these processes and phenomena to the conditions of Podlaskie Voivodship and to discuss the main reasons of Regional Observatory of Culture establishment. Article indicates the need for and potential benefits of knowledge management on culture at the regional level by conducting theoretical and methodological work within the observatory. Essay based on an analysis of existing data and own research results highlights the main features of the region, information needs of cultural and art institutions, culture observatory possible models, potential activity areas of the regional observatory and the arising benefits from its activities. The matter under consideration in this article is the ethnic joke as a primary element of the German TV comedy “Was guckst du?”. The starting point is a short overview of the ethnic joke and the extralingual phenomena that are associated with such jokes, and – above all – pointing at the function of stereotypes as causes for jokes about individual nations. Texts of jokes concerning individual nations were used to illustrate the reviewed problems. Background: The internationalization of clinical studies requires a shared understanding of the fundamental ethical values guiding clinical studies. It is important that these values are not only embraced at the legal level but also adopted by clinicians themselves during clinical studies. Objective: Our goal is to provide an insight on how clinicians in Germany and Poland perceive and identify the different ethical issues regarding informed consent in clinical studies. Methods: To gain an understanding of how clinicians view clinical studies in (...) the countries they work in, we carried out semi-structured problem-centered interviews per telephone in Poland (n = 6) and Germany (n = 6). Our interviewees concentrated on three main topics: an appraisal of the normative framework, challenges in the information process and the protection of all participants in clinical studies. Results: Clinicians generally supported the normative framework, even though they considered it quite complex. In the two study countries, a widely noted dilemma in the information process was whether to overburden participants with extensive information or risking leaving out important facts. Clinicians were ready to exclude larger population groups from participating in clinical studies when the information process could not be carried out with standard procedures or when their inclusion was ethically sensitive. Conclusion: Clinicians need to gain a better understanding of the consequences of excluding larger population groups form participating in clinical studies. They should seek assistance in improving the information process for the inclusion of underrepresented groups in clinical studies. (shrink)

The development of new methods in the field of prenatal testing leads to an expansion of information that needs to be provided to expectant mothers. The aim of this research is to explore opinions and attitudes of gynecologists in Germany, Poland and Russia towards access to prenatal testing and diagnostics in these countries. Semi-structured interviews were conducted with n = 18 gynecologists in Germany, Poland and Russia. The interviews were analyzed using the methods of content analysis and thematic analysis. Visible (...) in all three countries is a connection of prenatal medicine with the politically and socially contentious issue of pregnancy termination. Respondents in Poland and Russia concentrated on the topic of inadequate resources. Quality of information for expectant mothers is an important point in all three countries. Only in Germany was the issue of language barriers in communication raised. With regard to non-invasive prenatal testing (NIPT) respondents in Germany focused on the ethical issues of routinization of testing; in Poland and Russia they concentrated on fair access to NIPT. Challenges in all three countries arise from structural factors such as imprecise and prohibitive regulations, lack of resources or organization of healthcare services. These should be addressed on a political and medico-ethical level. (shrink)

Hare (1935-2008) developed informed, original views about the proposition: some published (Hare 1969 and Hare-Madden 1975); some expressed in conversations at scores of meetings of the Buffalo Logic Colloquium and at dinners following. The published views were expository and critical responses to publications by Curt J. Ducasse (1881-1969), a well-known presence in American logic, a founder of the Association for Symbolic Logic and its President for one term.1Hare was already prominent in the University of Buffalo's Philosophy Department in (...) 1969 when I was appointed. History witnesses alternative approaches to “the proposition”. The proposition has been referred to as the object of belief, disbelief, and doubt: generally as the object of propositional attitudes, that which can be said to be believed, disbelieved, understood, etc. It has also been taken to be the object of grasping, judging, assuming, affirming, denying, and inquiring: generally as the object of propositional actions, that which can be said to be grasped, judged true or false, assumed for reasoning purposes, etc. The (...) proposition has also been taken to be the subject of truth and falsity: generally as the subject of propositional properties, that which can be said to be true, false, tautological, informative, inconsistent,etc. It has also been taken as the subject and object of logical relations, e.g. that which can be said to imply, be implied, contradict, be contradicted, etc. Prima facie, such properties and relations are non-mental and objective. It has also been taken to be the resultants or products of propositional operations, usually mental or linguistic; e.g. judging, affirming, and denying have been held to produce propositions called judgments, affirmations, and negations, respectively. Propositions have also been taken to be certain declarative sentences. Finally,propositions have been taken to be meanings of certain declarative sentences. This essay is an informal, selective, and incomplete survey of alternative approaches to “the proposition” with special attention to the views of the late American philosopher Peter Hare (1935–2008)and of those who influenced him. Ethics of Richard M. Hare is widely considered as a classical example of the strong internalistic theory of motivation: he is thought to believe that having a moral motive is a sufficient condition to act accordingly. However, strong internalism has difficulties with explaining the phenomenon of acrasia and amoralism. For this reason some critics charge him with developing a false theory of moral motivation. In the article I present Hare's answer to these questions by dividing the discussion about motivation into (...) three levels: semantical, epistemological, and ontological. I also explain his concept of internal motivation and argue that his theory, contrary to what his critics assume, may be called a weak motivational internalism. (shrink)

l. There is an antinomy in Hare's thought between Ought-Implies-Can and No-Indicatives-from-Imperatives. It cannot be resolved by drawing a distinction between implication and entailment. 2. Luther resolved this antinomy in the l6th century, but to understand his solution, we need to understand his problem. He thought the necessity of Divine foreknowledge removed contingency from human acts, thus making it impossible for sinners to do otherwise than sin. 3. Erasmus objected (on behalf of Free Will) that this violates Ought-Implies-Can which he (...) supported with Hare-style ordinary language arguments. 4. Luther a) pointed out the antinomy and b) resolved it by undermining the prescriptivist arguments for Ought-Implies-Can. 5. We can reinforce Luther's argument with an example due to David Lewis. 6. Whatever its merits as a moral principle, Ought-Implies-Can is not a logical truth and should not be included in deontic logics. Most deontic logics, and maybe the discipline itself, should therefore be abandoned. 7. Could it be that Ought-Conversationally-Implies-Can? Yes - in some contexts. But a) even if these contexts are central to the evolution of Ought, the implication is not built into the semantics of the word; b) nor is the parallel implication built into the semantics of orders; and c) in some cases Ought conversationally implies Can, only because Ought-Implies-Can is a background moral belief. d) Points a) and b) suggest a criticism of prescriptivism - that Oughts do not entail imperatives but that the relation is one of conversational implicature. 8. If Ought-Implies-Can is treated as a moral principle, Erasmus' argument for Free Will can be revived (given his Christian assumptions). But it does not 'prove' Pelagianism as Luther supposed. This book presents a selection of theoretical and applied texts of Richard Hare, as well as an appendix which includes several fundamental studies for the understanding of the ethics of 20th century.

A synthetic glance about the basic outlines of Hare's Meta-ethics is offered in this paper to support the idea that Hume's law is still a productive resource for ethical studies. Hare accepted the emotivist premise that moral judgments do not, in the same way as ordinary statements do, state matters of fact that are either true or false, but denied that therefore they must be forms of exclamation. The essential character of moral discourse consisted, not, as the emotivists had held, (...) in its links with subjective attitudes, but with action; moral judgments were prescriptive, in that they expressed commitments to action on the part of the person uttering them, and at the same time their rationality was assured by their universalisability, i.e. their property of applying not merely to the person uttering them, but to all similar persons in similar circumstances. With his 1998 book, In Nature’s Interests? Gary Varner proved to be one of our most original and trenchant of environmental ethicists. Here, in the first of a promised two volume set, he makes his mark on another field, animal ethics, leaving an even deeper imprint. Thoroughly grounded in the relevant philosophical and scientific literatures, Varner is as precise in analysis as he is wide-ranging in scope. His writing is clear and rigorous, and he explains philosophical nuances with extraordinary economy (...) of expression. Never one to add an unnecessary clause to a sentence, Varner nonetheless constructs a formidable edifice while always dealing fairly with the authors he criticizes. His explication of the properties and moral status of what he calls near-persons is a crucial addition to the discussion of personhood initiated by Parfit in Reasons and Persons and subsequently applied to animals by McMahan in The Ethics of Killing. The comparison to McMahan is intentional for, to my mind, Varner vies with him as the most important animal ethicist since Singer and Regan. (shrink)

Katarzyna de Lazari-Radek and Peter Singer have recently provided an evolutionary argument for utilitarianism. They argue that most of our deontological beliefs were shaped by evolution, from which they conclude that these beliefs are unjustified. By contrast, they maintain that the utilitarian belief that everyone’s well-being matters equally is immune to such debunking arguments because it wasn’t similarly influenced. However, Guy Kahane remarks that this belief lacks substantial content unless it is paired with an account of well-being, and he (...) adds that utilitarian beliefs about wellbeing—e.g. the belief that pleasure is good and pain is bad—were probably shaped by evolution. Logically, de Lazari-Radek and Singer should therefore reject these beliefs along with the deontological beliefs that evolved. The present paper is a defense of their argument. After considering a number of unsuccessful replies to Kahane’s objection, I put forward a more promising solution: de Lazari-Radek and Singer should combine their objectivist view in metaethics with a subjectivist account of well-being, such as the desire theory. Such a hybrid account would tackle Kahane’s challenge because subjective accounts of value are immune from evolutionary debunking arguments. And it would be compatible with utilitarianism, which doesn’t fit very well with metaethical subjectivism. Before concluding, I deal with two concerns that this solution might raise: I argue that the desire theory is actually subjective enough to escape Kahane’s objection, and I deny that retreating to the combination of ethical objectivism and prudential subjectivism is ad hoc. This article responds to an argument from Katarzyna de Ladari-Radek and Peter Singer in their article, "The Objectivity of Ethics and the Unity of Practical Reason.".

I examine the two-level utilitarian case for humane animal agriculture (by R. M. Hare and Gary Varner) and argue that it fails on its own terms. The case states that, at the ‘intuitive level’ of moral thinking, we can justify raising and killing animals for food, regarding them as replaceable, while treating them with respect. I show that two-level utilitarianism supports, instead, alternatives to animal agriculture. First, the case for humane animal agriculture does not follow from a commitment to two-level (...) utilitarianism combined with a commitment to respecting animal lives. Secondly, the two-level utilitarian case falls prey to a compartmentalization problem and cannot uphold both respect and replaceability. What I call ‘humane lives’ are not appropriately valued by the lights of two-level utilitarianism itself. (shrink)

Frank Snare had a puzzle. Noncognitivism implies No-Ought-From-Is but No- Ought-From-Is does not imply non-cognitivism. How then can we derive non-cognitivism from No-Ought-From-Is? Via an abductive argument. If we combine non-cognitivism with the conservativeness of logic (the idea that in a valid argument the conclusion is contained in the premises), this implies No-Ought-From-Is. Hence if No-Ought-From-Is is true, we can arrive at non-cognitivism via an inference to the best explanation. With prescriptivism we can make this argument more precise. I develop (...) an account of imperative consequence that underwrites Hare’s principle that you cannot derive imperatives from indicatives. Thus if moral judgments contain an imperative component, it will be impossible to derive moral conclusions from indicative or non-moral premises. Given this account of imperative consequence, we can explain No-Ought-From-Is without appealing to anything as nebulous as the conservativeness of logic. Hence if No-Ought-From-Is is true, we have an inference to the best explanation for prescriptivism. Both lines of argument face problems from Prior. Given Prior’s counterexamples, No-Ought-From-Is as originally conceived is false. The version that survives is No-Non-Vacuous-Ought-From-Is. But the best explanation of this does not include non-cognitivism. With prescriptivism it is worse. For the version of No-Ought-From-Is that prescriptivism ‘explains’ – that is, the version of No-Ought-From-Is that prescriptivism implies – would exclude Prior’s counter-examples to Autonomy as invalid. But they are not invalid. Thus Prior’s counter-examples to No-Ought-From- Is refute prescriptivism. Thus from 1960 onwards R. M.Hare was a dead philosopher walking. But if non-cognitivism cannot be derived from No-Ought-From-Is, this suggests that it is not what Hume was trying to prove. I argue that what Hume was trying to prove is that moral truths are not demonstrable. To be demonstrable, a proposition must be either self-evident or logically derivable from self-evident propositions. By Treatise 3.1.1.27, Hume had proved to his own satisfaction that no moral propositions are self-evident. That leaves open the possibility that they are logically derivable from self-evident but NON-moral propositions. The point of No-Ought-From-Is was to exclude this possibility. If you cannot logically derive moral conclusions from non-moral premises, you cannot demonstrate the truths of morality by deriving them from self-evident but NON-moral truths. I also discuss why Hume abandoned No-Ought-From-Is in the EPM. He had no need of it since he thought he had a proof that (with some exceptions) no nontrivial truths are demonstrable. Hence no non-trivial MORAL truths are demonstrable. No-Ought-From-Is drops out as unnecessary. (shrink)
