El autor estudia los supuestos y razones del nacimiento de la Teoría del Derecho, como intento de superación de las limitaciones e insuficiencias del iusnaturalismo, del iuspositivismo y de su Teoría General del Derecho, así como de la Filosofía del Derecho postpositivista. In 1930, the Spanish philosopher Miguel de Unamuno (1864–1936) wrote one of his most well-known novels, San Manuel Bueno, mártir [Saint Manuel Bueno, Martyr]. The novel is about the fictional character Manuel Bueno, a catholic priest from a small Spanish village who, despite being unable to believe the Christian claim that there is an after earthly death life, devotes himself to the spiritual care of his people, being thereby sanctified after his death. La formación docente es indispensable para responder a los requerimientos de la compleja sociedad actual. De su conocimiento, iniciativa, praxis y creatividad depende el éxito o el fracaso del sujeto que aprende. Al modificar el rol del docente se transforma la actitud de los estudiantes. ¿Cómo entender la formación filosófica transdisciplinar? Este texto responde a este y otros cuestionamientos: ¿cuáles son los planteamientos pedagógicos afines a la era digital? ¿en qué medida las TIC se encuentran al servicio de una filosofía (...) educativa transdisciplinar?, ¿cómo se explica ese enfoque en la formación del docente?, ¿cuál es la función de la formación en la innovación educativa?, ¿cómo formar para la ciudadanía mundial?, ¿cuáles son las contribuciones de las nuevas ciencias para la formación educativa? El crecimiento exponencial de la ciencia y de la tecnología nos obliga a pensar en procesos formativos innovadores. En tal sentido, resulta imprescindible el estudio de estas problemáticas. (shrink)

Esta entrevista se realizó en dos sesiones vía Zoom, cuyas fechas están ubicadas en agosto de 2021. La primera conversación que se tuvo consistió en que el filósofo Modesto Gómez Alonso brindara unas ideas panorámicas y reflexivas, las cuales se han colocado al inicio de cada resolución. Entretanto, en la segunda conversación, se partió de lo planteado anteriormente y de algunos apuntes que permitieron esbozar de una forma más contundente las respuestas. Todo este procedimiento sirvió para que se pudiera (...) tratar sobre la noción de la epistemología desde sus múltiples manifestaciones. Es por eso por lo que el filósofo Modesto Gómez recurrió a concepciones afines, como aquellas que proporcionan el conocimiento, al igual que buscó explicar con mayor detalle al citar a autores como Descartes, Sosa, entre otros. En ese sentido, esta entrevista tuvo el propósito de buscar las conexiones que existen de la Filosofía con la vida cotidiana en cuanto a que se indaga de las posibilidades de contribuir al conocimiento y contar con las herramientas adecuadas. As the subtitle “A Syncretistic Account of Fictional Entities” makes clear, Alberto Voltolini intends in this book to argue for a syncretic view of the ontology and the semantics of fiction. In the process, he offers sympathetic and clear presentations of the main contenders in the field, discussing first ontological matters (chapters 1–4) and then semantic questions (chapters 5–6), and concluding with an ‘ontological’ argument for the allegedly syncretic brand of realism about fictional entities he has by then endorsed. The book will therefore be very useful for all those who want to have a guided overview of the state of the art in the field, and very helpful if used as a main text for an introductory graduate course. Justice Across Ages offers an attractive account of justice between the young and the old that brings together three notable principles of age-group justice: complete-lives equality, relational equality, and prudence. Yet, the book says little about the fact that many of us live longer than others, and the little it does say casts doubt on whether lifespan inequality threatens justice as construed by the three principles. This essay argues, instead, that theories of justice between the young and the old should (...) not dispense with a conception of justice between different longevity groups. It concludes that we must be sensitive to lifespan variations when designing policies to promote justice across age groups. (shrink)

In his essay against Eberhard, Kant denies that there are innate concepts. Several scholars take Kant’s statement at face value. They claim that Kant did not endorse concept innatism, that the categories are not innate concepts, and that Kant’s views on innateness are significantly different from Leibniz’s. This paper takes issue with those claims. It argues that Kant’s views on the origin of the intellectual concepts are remarkably similar to Leibniz’s. Given two widespread notions of innateness, the dispositional notion and (...) the input/output notion, intellectual concepts are innate for Kant no less than for Leibniz. (shrink)

In this paper I argue for a syncretistic theory of depiction, which combines the merits of the main paradigms which have hitherto faced themselves on this issue, namely the perceptualist and semioticist approaches. The syncretistic theory indeed takes from the former its stress on experiential factors and from the latter its stress on conventional factors. But the theory is even more syncretistic than this, for the way it accounts for the experiential factor vindicates several claims defended by different perceptualist theories. (...) In a nutshell, according to the syncretistic theory a picture depicts its subject iff i) it is transformed into an entity-cum-meaning and ii) one has the twofold experience of seeing that subject in the picture qua noninterpreted entity, the image, just in case one consciously misrecognizes it in consciously seeing that image, for that subject resembles the image in some grouping properties (originally labelled Gestalt-qualities in psychology). By appealing to objective resemblance in grouping properties, the theory can vindicate what are nowadays taken to be the most neglected doctrines in the perceptualist camp: objective resemblance theories. By appealing, moreover, to conscious misrecognition, the theory not only squares with both the seeing-in and the recognition theories of depiction, but it also shows the grain of truth in illusion theories of depiction, since conscious misrecognition is a kind of perceptual illusion. Along with a well-honoured tradition, we will accept that intentionality is at least a property a thought holds necessarily, i.e., in all possible worlds that contain it; more specifically, a necessary relation, namely the relation of existential dependence of the thought on its intentional object. Yet we will first of all try to show that intentionality is more than that. For we will claim that intentionality is an essential property of the thought, namely a property whose predication to the thought (...) is true in virtue of the identity, or nature, of such a thought. More particularly, for us intentionality will again be a relation, yet a relation of ontological dependence of the thought on its intentional object; specifically, the relation for the thought of being constituted by its object. Moreover, we will try to show that if intentionality is such a constitutive relation for the thought that has it, certain metaphysical consequences ensue. First, an objectual thought, a thought whose content basically consists in its intentional object, is nothing but that object in a certain cogitative modality, or, which is the same, as playing a certain motivational role for the subject entertaining the thought itself (at a certain time). Second, if an objectual thought is nothing but an intentional object in a cogitative modality, such a thought, not only as a type, but also as a token, is an abstract entity. More specifically, an objectual thought-type, an abstract object par excellence, is indeed instantiated by objectual thought-tokens which are again abstract particulars, yet of a specific kind: namely, tropes of a relational sort depending for their existence on their bearers (and possibly also on their temporal location). According to Amos Funkenstein, Stephen Gaukroger and Andrew Cunningham, seventeenth-century natural philosophy was fused with theology, driven by theology, and pursued primarily to shed light on God. Experimental natural philosophy might seem to provide a case in point. According to its English advocates, like Robert Boyle and Thomas Sprat, experimental philosophy embodies the Christian virtues of humility, innocence, and piety, it helps establish God’s existence, attributes, and providence, and it provides a basis for evangelism. This chapter shows that, unlike their (...) English counterparts, experimental philosophers in seventeenth-century Italy kept natural philosophy sharply distinct from theological and religious matters. This indicates that seventeenth-century experimental philosophy was not, as such, theologically driven or oriented. It also suggests that there was no intrinsic relation between experimental philosophy and religion. Whether experimental philosophy was presented as an ally of religion or as distinct from it was, to a significant extent, a matter of cultural politics. It depended on which rhetorical and argumentative strategies were believed to be most likely to ensure freedom of research and institutional support for the work of experimental philosophers in a specific sociopolitical context. For most interpreters of the philosopher from Rotterdam, his political doctrine is solely a consequence of his religious and moral doctrines, and so an image of Bayle as a political philosopher is not usually presented. To my mind, however, only by analyzing his political doctrine can the extent of his religious proposal be understood. In this article, I intend to show that both the Baylean criticism of popular sovereignty and his rejection of the right of resistance are analyses that are (...) indissociable from the Baylean doctrine of tolerance. The protection of individual freedom of conscience and the defense of a multi-confessional state model, tolerant regarding religious minorities, can only be articulated as historical reality if they rest on the political doctrine of indivisible sovereignty and on the strictest separation between political obedience and religious membership. ‘Dogwhistle’ refers to a kind of political manipulation that some people carry out for political gains. According to Saul (2018), dogwhistles can be either intentional or unintentional depending on whether the speaker carried out the dogwhistle deliberately or not —although one cannot always recognize whether a particular case was intentional. In addition to being intentional or not, dogwhistles can also be overt or covert depending on whether the audience is aware or not of the dogwhistle. In the case of overt (...) dogwhistles, the speaker addresses a message to an audience with two possible interpretations. One of these is coded and affects only a subset the audience (Witten 2014). Covert dogwhistles, on the other hand, are not really about sending a “coded message.” Instead, they raise attitudes to salience, so people will act on them without realizing they are being moved on them. As Stanley (2015) points out, these kinds of dogwhistles work as a strategy for undermining democratic ideals without immediate rejection. Our key question is whether covert dogwhistles constitute a special form of implicit communication or whether they can be reduced to already existing forms of implicit communication such as presuppositions or implicatures. We will focus on covert dogwhistles because they seem more difficult to accommodate within the traditional categories of presuppositions and implicatures. To carry out this task, we compare the features of each of the mentioned phenomena and analyse how they behave in the face of retraction. (shrink)

In this paper, I want to show that a reasonable thesis on truth in fiction, Fictional Vichianism (FV)—according to which fictional truths are true because they are stipulated to be true—can be positively endorsed if one grounds Kripke’s justification for (FV), that traces back to the idea that names used in fiction never refer to concrete real individuals, into a creationist position on fictional entities that allows for a distinction between the pretending and the characterizing use of fiction-involving sentences. Thus, (...) sticking to (FV) provides a reason for a metaphysically moderate ontological realism on fictional entities. (shrink)

Despite being increasingly available to us all, retirement pensions remain unequally distributed: between rich and poor, young and old, men and women, and possibly different generations. As this topic receives little attention in moral and political philosophy, the articles in this thesis aim to deliver an original account of justice in retirement pensions along liberal egalitarian lines. The first part defends retirement pensions as a distribution of free time. It shows that including free time in the list of goods that (...) liberal egalitarians prioritise is plausible and avoids problems that would otherwise arise with other candidates, most notably leisure. Retirement as free time is an essential feature of liberal egalitarian societies by (re)distributing the means to pursue any life project, and especially valuable for the poor who work and contribute the longest. The second part makes a case for 'libertirement', a proposal to increase the freedom to enjoy free time across life, as a matter of justice between those who live long and those who die early. Specifically, I propose adding reverse pensions and sabbaticals on top of old-age retirement. Besides showing the importance of longevity for age-group justice, I also draw implications for distributing unconditional basic income and income taxes across life, which I suggest may offer alternative paths to libertirement. Finally, the third part discusses the cases of pension inequality between genders and generations, pushing us to refine our account further. I conclude that there is often a mismatch between liberal egalitarian justice and the design of retirement schemes. The solution is often but not always to reform these systems. Sometimes, we have reasons to revise our very own principles of justice. (shrink)

This chapter explores Kant’s, Reinhold’s, Fichte’s, and Hegel’s stances toward transcendental philosophy and transcendental arguments. Having explained the new meaning that Kant assigned to the term ‘transcendental’, the chapter surveys his attempt to develop a transcendental philosophy by employing transcendental arguments. Since these arguments presuppose unproven matters of fact, authors who were deeply concerned by scepticism deemed them unsuitable for the task. The chapter explains how Reinhold and Fichte sought to establish solid foundations for transcendental philosophy without relying on transcendental (...) arguments. The final section of the chapter discusses whether Hegel, who rejected transcendental philosophy, employed transcendental arguments. (shrink)

Retirement is often viewed as a reward for a working life. While many have reason to want a work-free retirement, not everyone does. Should working retirees have to give up their retirement pension and, consequently, their status as retirees? The answer, I argue, boils down to whether we conceive of retirement as free time (need-free) or as leisure (work-free). In this article, I put forward a liberal case in favour of free time, despite whether our liberalism leans towards perfectionism or (...) neutralism, with social primary goods being a case in point. Applying this case for free time to retirement yields two significant policy implications. First, it demands “free synchronic combination” – that retirees may use their retirement pensions however they see fit, including to work. Second, it also yields “free diachronic combination” – that, within limits, individuals have discretionary control over how to combine retirement and work across time – thus challenging the idea that retirement should be available only in old age and not earlier in life. So far, the literature on free time focused only on narrow temporal units, such as hours and days, but there is much to gain by extending the concept into retirement. (shrink)

In this article it is defended that the notion known as “The mark of the cognitive” is better characterized as a process that performs the function of generating intelligent behavior, in a flexible and adaptive way, capable of adapting to circumstances, given it is a context sensitive process. For that, some relevant definitions of cognition are examined. In the end, it is pointed out that the definition of the mark of cognition as a context-sensitive process takes into account several factors (...) that were added as constitutive parts of cognitive phenomena over the years, especially the 4E Cognition, which cannot be satisfactorily accommodated alongside the preceding notions of cognition. Accordingly, this essay shouldn’t be mistaken merely as an exercise in intellectual history, but as a brief and accessible attempt to advance the debate. (shrink)

In this article I propose an original view of the nature of shared intention. In contrast to psychological views (Bratman, Searle, Tuomela) and normative views (Gilbert), I argue that both functional roles played by attitudes of individual participants and interpersonal obligations are factors of central and independent significance for explaining what shared intention is. It is widely agreed that shared intention (I) normally motivates participants to act, and (II) normally creates obligations between them. I argue that the view I propose (...) can explain why it is not a mere accident that both (I) and (II) are true of shared intention, while psychological and normative views cannot. The basic idea is that shared intention involves a structure of attitudes of individuals –including, most importantly, attitudes of reliance – which normally plays the relevant motivating roles and creates the relevant obligations. Alireza Bagheri supports a policy on organ procurement where individuals could choose their own definition of death between two or more socially accepted alternatives. First, we claim that such a policy, without any criterion to distinguish accepted from acceptable definitions, easily leads to the slippery slope that Bagheri tries to avoid. Second, we suggest that a public discussion about the circumstances under which the dead donor rule could be violated is more productive of social trust than constantly moving the line (...) between life and death. El presente artículo analiza el fenómeno del mestizaje cultural que se da alrededor de la creación de la Virgen de Guadalupe. Se propone que la resignificación que se dio en torno al cerro del Tepeyac, donde originalmente se adoraba a Tonantzin, constituye un evento de creación de sentidos que se da en el contexto del mestizaje, y que incorpora la construcción discursiva de la hierofanía en torno a tres elementos: el objeto sagrado, el lugar del culto y el ritual de (...) adoración. Este evento tuvo una gran importancia, pues el guadalupanismo generó consigo una serie de sentimientos de pertenencia entre los criollos e indígenas, quienes encontraron en él una forma de entenderse como distintos al imperio español, lo que para muchos autores significó una de las primeras semillas de los ideales independentistas y la superación de la época colonial. This is a survey article on reductive views of shared intention.

At least some serial killers are psychopathic serial killers. Psychopathic serial killers raise interesting questions about the nature of evil and moral responsibility. On the one hand, serial killers seem to be obviously evil, if anything is. On the other hand, psychopathy is a diagnosable disorder that, among other things, involves a diminished ability to understand and use basic moral distinctions. This feature of psychopathy suggests that psychopathic serial killers have at least diminished responsibility for what they do. In this (...) chapter I consider whether psychopathic serial killers might be properly said to be both evil and morally responsible for their actions. I argue that psychopathic serial killers are plausibly evil in at least one recognizable sense of the term, but that they are nevertheless not likely to be responsible for many of the evils they perpetuate. It is usually assumed that political modernity and the reformation go hand in hand. Authors such as Hegel, Tocqueville, Jellinek or Martha Nussbaum find in the protestant reformation the origin of ideas such as political freedom or freedom of conscience. In this paper, I will try to analyze the relationship between these two concepts in two fundamental characters in the Calvinist tradition. John Calvin, its founding father, on the one hand, and, on the other, Pierre Bayle, the Rotterdam philosopher who (...) pushed Calvinism to its most heterodox forms in the XVII century. I will show how they both understand the interpretation of the Bible and the political arrangements that they defended for their close context. (shrink)

For the philosopher of Rotterdam, religious coercion has two essential sources of illegitimacy: the linking of religious and ecclesiastical belief and the use of politics for religious purposes. Bayle responds to it, with his doctrine of freedom of conscience, on one hand and by means of the essential distinction between voluntary religious affiliation and political obligation, on the other hand. From my perspective, his doctrine of tolerance does not involve an atheist state, nor does it mean the rejection of the (...) presence of religion in the public space or its displacement to the intimate sphere of the conscience. This paper proposes a reading of Baylean tolerance as a political doctrine that allows the articulation between freedom of conscience, minority confessions, and official religion. Thus, the Baylean theoretical model could be considered a proposal to provide a normative form to the practice of toleration present in the seventeenth -century Netherlands. (shrink)

In this article, I discuss the Protestant contribution to the modern concept of autonomy on the basis of an analysis of John Calvin's moral theology. I show that Calvin affirms our incapacity to know and want what is morally good, as expressed by natural law. Such incapacity is compensated for by the biblical mandates that, according to Calvin, should be incorporated into the positive legislation of Christian republics. In view of all this, I conclude that Calvin is far from the (...) Kantian idea of autonomy which defines our Modernity. (shrink)

This paper discusses the logical space of alternative conceptual engineering projects, with a specific focus on (1) the processes, (2) the targets and goals, and (3) the methods of such projects. We present an overview of how these three aspects interact in the contemporary literature and discuss those alternative projects that have yet to be explored based on our suggested typology. We show how choices about each element in a conceptual engineering project constrain the possibilities for the others, thereby giving (...) rise to distinct groupings of possible projects under the banner of conceptual engineering. We conclude with a critical reflection on the potential ethical issues that arise as a result of effectively putting conceptual engineering into practice. (shrink)

In this article, we will analyze the redefinition that Hobbes applies to the essential elements of Protestant biblical hermeneutics in the Leviathan. Establishing who is the authorized interpreter, defining the rules for conducting a proper exegesis, and determining the content that results from both tasks, is of utmost importance. The answers to these three questions lay the foundation for a new relationship between civil and ecclesiastical power and fully immerse Hobbes in the theological-political discussion of the 17th century.

Freedom as a natural right, the importance of consent, defending the idea that government should be in the hands of the most virtuous and reflective citizens, denouncing patronage, the need to link individual and political freedom ? These are some of the characteristics of La Boétie's doctrine that I believe place him within the tradition that Quentin Skinner calls the neo-Roman conception of civil liberty. Of course, La Boétie did not write a positive defence of the rule of law, as (...) Livy did in his History of Rome and as the English republicans do, but the Discourse can easily be read as a legal plea condemning absolute monarchy and any kind of arbitrary regime. (shrink)

In (1959), Carnap famously attacked Heidegger for having constructed an insane metaphysics based on a misconception of both the logical form and the semantics of ordinary language. In what follows, it will be argued that, once one appropriately (i.e., in a Russellian fashion) reads Heidegger’s famous sentence that should paradigmatically exemplify such a misconception, i.e., “the nothing nothings”, there is nothing either logically or semantically wrong with it. The real controversy as to how that sentence has to be evaluated—not as (...) to its meaning but as to its truth—lies at the metaphysico- ontological level. For in order for the sentence to be true one has to endorse an ontology of impossibilia and Leibniz’s principle of the identity of indiscernibles. (shrink)

We present a module based criterion, i.e. a sufficient condition based on the absolute value of the matrix coefficients, for the convergence of Gauss–Seidel method (GSM) for a square system of linear algebraic equations, the Generalized Line Criterion (GLC). We prove GLC to be the “most general” module based criterion and derive, as GLC corollaries, some previously know and also some new criteria for GSM convergence. Although far more general than the previously known results, the proof of GLC is simpler. (...) An important distinction lies between consciousness attributed to creatures, or subjects, (creature consciousness) and consciousness attributed to mental states (state consciousness). Most contemporary theories of consciousness aim at explaining what makes a mental state conscious, paying scant attention to the problem of creature consciousness. This attitude relies on a deeper, and generally overlooked, assumption that once an explanation of state consciousness is provided, one has also explained all the relevant features of creature consciousness. I call this the priority of state (...) consciousness thesis (PSC). In this paper, I want to explore how the renewed centrality bestowed to phenomenology in contemporary discussions on consciousness challenges PSC and, consequently, the standard way of framing the problem of consciousness. More precisely, I examine PSC in light of a view about the structure of phenomenal character that is paradigmatic of the approach above. This is subjectivism about phenomenal character (SUBJ), according to which a mental state is conscious when it acquires the property of for-me-ness. I argue that PSC and SUBJ are incompatible because the latter implies that creature consciousness is explanatorily prior to state consciousness. Consequently, if SUBJ is true, then PSC is false, and what constitutes the problem of consciousness is primarily a problem of explaining (a kind of) creature consciousness. I conclude by defending my claim from a pair of possible objections and drawing some implications for the discussion of for-me-ness and the debate on the explanation of consciousness. (shrink)

The articles in the special issue "Experience in natural philosophy and medicine" discuss the roles and notions of experience in the works of a range of early modern authors, including Galileo Galilei, Francis Bacon, the Dutch atomist David Gorlaeus, William Harvey, and Christian Wolff. The articles extend the evidential basis on which we can rely to identify trends, changes and continuities in the roles and notions of experience in the period of the Scientific Revolution. They shed light on the longstanding (...) influence of traditional views and the emergence of early modern experimental philosophy. This introduction highlights the benefits of considering medicine in connection with natural philosophy when studying early modern views on experience and summarizes the articles. (shrink)

Conceptual engineering means to provide a method to assess and improve our concepts working as cognitive devices. But conceptual engineering still lacks an account of what concepts are (as cognitive devices) and of what engineering is (in the case of cognition). And without such prior understanding of its subject matter, or so it is claimed here, conceptual engineering is bound to remain useless, merely operating as a piecemeal approach, with no overall grip on its target domain. The purpose of this (...) programmatic paper is to overcome this knowledge gap by providing some guidelines for developing the theories of concepts and of cognition that will ground the systematic unified framework needed to effectively implement conceptual engineering as a widely applicable method for the cognitive optimization of our conceptual devices. The Enhanced Indispensability Argument appeals to the existence of Mathematical Explanations of Physical Phenomena to justify mathematical Platonism, following the principle of Inference to the Best Explanation. In this paper, I examine one example of a MEPP—the explanation of the 13-year and 17-year life cycle of magicicadas—and argue that this case cannot be used defend the EIA. I then generalize my analysis of the cicada case to other MEPPs, and show that these explanations rely on what I will call ‘optimal (...) representations’, which are representations that capture all that is relevant to explain a physical phenomenon at a specified level of description. In the end, because the role of mathematics in MEPPs is ultimately representational, they cannot be used to support mathematical Platonism. I finish the paper by addressing the claim, advanced by many EIA defendants, that quantification over mathematical objects results in explanations that have more theoretical virtues, especially that they are more general and modally stronger than alternative explanations. In this paper, I want to address once more the venerable problem of intentional identity, the problem of how different thoughts can be about the same thing even if this thing does not exist. First, I will try to show that antirealist approaches to this problem are doomed to fail. For they ultimately share a problematic assumption, namely that thinking about something involves identifying it. Second, I will claim that once one rejects this assumption and holds instead that thoughts are (...) constituted either by what they are about, their intentional objects, or by what determines their proposition-like intentional contents, one can address the problem of intentional identity in a different way. One can indeed provide a new solution to it that basically relies on two factors: a) what sort of metaphysical nature intentional objects effectively possess, once they are conceived as schematic objects à la Crane (2001, 2013); b) whether such objects really belong to the overall ontological inventory of what there is. According to this solution, two thoughts are about the same nonexistent intentional object iff i) that object satisfies the identity criterion for objects of that metaphysical kind and ii) objects of that kind belong to the overall ontological inventory of what there is, independently of whether they exist (in a suitable first-order sense of existence). As such, this solution is neither realist nor antirealist: only if condition ii) is satisfied, different thoughts can be about the same nonexistent intentionale; otherwise, they are simply constituted by the same intentional content (provided that this content is not equated with that intentionale). Third, armed with this solution, I will hold that one can find a suitable treatment of the specific and related problem of whether different people may mock-think about the same thing, even if there really is no such thing. Finally, I will try to show that this treatment can be also applied to the case in which different thoughts are, according to phenomenology, about the same intentionale and yet this intentionale is of a kind such that there really are no things of that kind. For in this case, such thoughts are about the same intentionale only fictionally. (shrink)

Conscientious objection in health care is a form of compromise whereby health care practitioners can refuse to take part in safe, legal, and beneficial medical procedures to which they have a moral opposition (for instance abortion). Arguments in defense of conscientious objection in medicine are usually based on the value of respect for the moral integrity of practitioners. I will show that philosophical arguments in defense of conscientious objection based on respect for such moral integrity are extremely weak and, if (...) taken seriously, lead to consequences that we would not (and should not) accept. I then propose that the best philosophical argument that defenders of conscientious objection in medicine can consistently deploy is one that appeals to (some form of) either moral relativism or subjectivism. I suggest that, unless either moral relativism or subjectivism is a valid theory—which is exactly what many defenders of conscientious objection (as well as many others) do not think—the role of moral integrity and conscientious objection in health care should be significantly downplayed and left out of the range of ethically relevant considerations. Among other things, this proposal represents Berkeley ́s attempt to know the mind or spirit, that is, the thinking and active thing that by its own activity results unrepresentable as idea. As such knowledge is already mentioned in the Philosophical Commentaries, I will refer to them in order to know the origins of that proposal. However, as notional knowledge appears in more detail in later works, I will make use especially of the Treatise to address the complex notional doctrine. (shrink)

Philosophers disagree whether composition as identity entails mereological universalism. Bricker :264–294, 2016) has recently considered an argument which concludes that composition as identity supports universalism. The key step in this argument is the thesis that any objects are identical to some object, which Bricker justifies with the principle of the universality of identity. I will spell out this principle in more detail and argue that it has an unexpected consequence. If the universality of identity holds, then composition as identity not (...) only leads us to universalism, but also leads to the view that there are no mereological atoms. (shrink)

This paper traces the ancestry of a familiar historiographical narrative, according to which early modern philosophy was marked by the development of empiricism, rationalism, and their synthesis by Immanuel Kant. It is often claimed that this narrative became standard in the nineteenth century, due to the influence of Thomas Reid, Kant and his disciples, or German Hegelians and British Idealists. The paper argues that the narrative became standard only at the turn of the twentieth century. This was not due to (...) the influence of Reid, German Hegelians, or British Idealists as they did not endorse the narrative, although Thomas Hill Green may have facilitated its uptake. The narrative is based on Kant’s historiographical sketches, as corrected and integrated by Karl Leonhard Reinhold. It was first fleshed out into full-fledged histories by two Kantians, Wilhelm Gottlieb Tennemann and Johann Gottlieb Buhle. Numerous historians, several of whom were not Kantians, spread it in the English-speaking world. They include Kuno Fischer, Friedrich Ueberweg, Richard Falckenberg, and Wilhelm Windelband. However, the wide availability of their works did not suffice to make the narrative standard because, until the 1890s, the Hegelian account was at least as popular as theirs. Among the factors that allowed the narrative to become standard are its aptness to be adopted by philosophers of the most diverse persuasions, its simplicity and suitability for teaching. (shrink)

Conceptual engineering is the method for assessing and improving our concepts. However, little has been written about how best to conceive of concepts for the purposes of conceptual engineering. In this paper, I aim to fill this foundational gap, proceeding in three main steps: First, I propose a methodological framework for evaluating the conduciveness of a given concept of concept for conceptual engineering. Then, I develop a typology that contrasts two competing concepts of concept that can be used in conceptual (...) engineering — namely, the philosophical and psychological ones. Finally, I evaluate these two concepts of concept using the proposed methodological framework and I show that, when it comes to making conceptual engineering an actionable method, the psychological concept of concept outclasses its philosophical counterpart on all counts. This provides a baseline from which the concept of concept can be further improved for the purposes of conceptual engineering. (shrink)

Several scholars have criticized the histories of early modern philosophy based on the dichotomy of empiricism and rationalism. They view them as overestimating the importance of epistemological issues for early modern philosophers (epistemological bias), portraying Kant's Critical philosophy as a superior alternative to empiricism and rationalism (Kantian bias), and forcing most or all early modern thinkers prior to Kant into the empiricist or rationalist camps (classificatory bias). Kant is often said to be the source of the three biases. Against this (...) criticism, this paper argues that Kant did not have the three biases. However, he promoted a way of writing histories of philosophy from which those biases would naturally flow. (shrink)

Kant claims that the nominal definition of truth is: “Truth is the agreement of cognition with its object”. In this paper, I analyse the relevant features of Kant's theory of definition in order to explain the meaning of that claim and its consequences for the vexed question of whether Kant endorses or rejects a correspondence theory of truth. I conclude that Kant's claim implies neither that he holds, nor that he rejects, a correspondence theory of truth. Kant's claim is not (...) a generic way of setting aside a correspondence definition of truth, or of considering it uninformative. Being the nominal definition of truth, the formula “truth is the agreement of cognition with its object” illustrates the meaning of the predicate “is true” and people's ordinary conception of truth. True judgements correspond to the objects they are about. However, there could be more to the property of truth than correspondence. (shrink)

Although the notion of empiricism looms large in many histories of early modern philosophy, its origins are not well understood. This paper aims to shed light on them. It examines the notions of empirical philosopher, physician, and politician that are employed in a range of seventeenth- and eighteenth-century texts, alongside related notions (e.g. "experimental philosophy") and methodological stances. It concludes that the notion of empiricism used in many histories of early modern thought does not have pre-Kantian origins. Composition as Identity is the view that an object is identical to its parts taken collectively. I elaborate and defend a theory based on this idea: composition is a kind of identity. Since this claim is best presented within a plural logic, I develop a formal system of plural logic. The principles of this system differ from the standard views on plural logic because one of my central claims is that identity is a relation which comes in a variety of (...) forms and only one of them obeys substitution unrestrictedly. I justify this departure from orthodoxy by showing some problems which result from attempts to avoid inconsistencies within plural logic by means of postulating other non-singular terms besides plural terms. Thereby, some of the main criticisms raised against Composition as Identity can be addressed. Further, I argue that the way objects are arranged is relevant with respect to the question which object they compose, i.e. to which object they are identical to. This helps to meet a second group of arguments against Composition as Identity. These arguments aim to show that identifying composite objects on the basis of the identity of their parts entails, contrary to our common sense view, that rearranging the parts of a composite object does not leave us with a different object. Moreover, it allows us to carve out the intensional aspects of Composition as Identity and to defend mereological universalism, the claim that any objects compose some object. Much of the pressure put on the latter view can be avoided by distinguishing the question whether some objects compose an object from the question what object they compose. Eventually, I conclude that Composition as Identity is a coherent and plausible position, as long as we take identity to be a more complex relation than commonly assumed. (shrink)

While the Academic sceptics followed the plausible as a criterion of truth and guided their practice by a doxastic norm, so thinking that agential performances are actions for which the agent assumes responsibility, the Pyrrhonists did not accept rational belief-management, dispensing with judgment in empirical matters. In this sense, the Pyrrhonian Sceptic described himself as not acting in any robust sense of the notion, or as ‘acting’ out of sub-personal and social mechanisms. The important point is that the Pyrrhonian advocacy (...) of a minimal conception of ‘belief’ was motivated by ethical concerns: avoiding any sort of commitment, he attempted to preserve his peace of mind. In this article, I argue for a Cartesian model of rational guidance that, in line with some current versions of an agential virtue epistemology, does involve judgment and risk, and thus which is true both to our rational constitution and to our finite and fallible nature. Insofar as epistemic humility is a virtue of rational agents that recognise the limits of their judgments, Pyrrhonian scepticism, and a fortiori any variety of naturalism, is unable to accommodate this virtue. This means that, in contrast to the Cartesian model, the Pyrrhonist does not provide a satisfactory answer to the problem of cognitive disintegration. The Pyrrhonist thus becomes a social rebel, one that violates the norm of serious personal assent that enables the flourishing of a collaborative and social species which depends on agents that, however fallible, are accountable for their actions and judgments. The topic I address in this paper is whether the independence of Church and State brought about by the Lutheran Reformation tantamounted to the secularisation of the latter. Taking into account two recent essays by Harold Berman and John Witte on the Lutheran contribution to the Western legal tradition, I argue that Luther’s criticism of the catholic doctrine of Papal power came hand in hand with a theologization of the foundations of the authority of the State, which is difficult to (...) deem «secular». Conceptual engineering is the method for assessing and improving our concepts. Some have recently claimed that the implementation of such method in the form of ameliorative projects is truth-driven and should thus be epistemically constrained, ultimately at least (Simion 2018; cf. Podosky 2018). This paper challenges that claim on the assumption of a social constructionist analysis of ideologies, and provides an alternative, pragmatic and cognitive framework for determining the legitimacy of ameliorative conceptual projects overall. The upshot is that one should (...) not ameliorate for the sake of truth or knowledge, in the case of ideologies—at least, not primarily. (shrink)
