Advocates of the Person-Centered Healthcare (PCH) approach say that PCH is a response to a failure of caring for patients as persons. Nevertheless, there are many human subjects falling to fulfill the requirements of a traditional philosophical definition of personhood. Hence, if we take, PCH seriously, a greater clarification of the key terminology of PCH is urgently needed. It seems necessary, for instance, that the concept of the person should be extended in order to include those individuals with insipient or (...) immature levels of consciousness, as well as those who are severely and permanently mentally handicapped. In this article, we will depart from some well-known philosophical concepts of what it means to be a person and try to offer a broader and more inclusive meaning. We suggest that persons are human beings with a socially recognized biography, which implies to recognize as persons individuals with necessities, but also with narratives about their interests and claims, expressed sometimes by other people related to them. This is particularly the case of individuals that suffer from severe disorders of consciousness. For those, is not only care that matters; respect matters too. Caregivers should therefore not only sympathetically care for the well-being of these people; they should also be concerned to respect their interests and claims by interpreting them empathetically, in the light of their biographical story. Our conclusion is that, in order to be coherent, PCH must consider individuals with severe disorders of consciousness as persons and we think that our revised concept of personhood fits with this requirement. Since before we can remember, humanity aims to overcome its biological limitations; such a goal has certainly played a key role in the advent of technique. However, despite the benefits that technique may bring, the people who make use of it will inevitably be under risk of harm. Even though human technical wisdom consists in attaining the best result without compromising anybody’s safety, misuses are always a possibility in the horizon. Nowadays, technology can be used for more than just improving (...) human capacities, preserving and restoring health or promoting human well-being. It also enables us to overcome human limitations and reach way beyond our "natural design". That being said, what could possibly justify the fear for these new directions of biotechnology? Should medicine and health care change their traditional goals and begin searching for artificial improvements to wellness in human nature? In this paper, I will hereby present and briefly discuss the main topics of the contemporary issue of human enhancement: the therapy-enhancement distinction, the possibility of cognitive enhancements and better physical performances, the fight against senescence, the arguments for and against human eugenics, the search for perfection, the quest of moral enhancement, the problem of public priorities, and some questions on medical ethics. Then, finally, I will want to present some realist perspectives on the subject. (shrink)

The basic assumption present in these articles is that naturalism is highly compatible with a wide range of relevant philosophical questions and that, regardless of the classical problems faced by the naturalist, the price paid in endorsing naturalism is lower than that paid by essentialist or supernaturalist theories. Yet, the reader will find a variety of approaches, from naturalism in Moral Philosophy and Epistemology to naturalism in the Philosophy of Language, Philosophy of Mind and of the Aesthetics.

O direito à morte digna é majoritariamente ignorado pelo ordenamento brasileiro. Essa invisibilidade do processo de finitude e suas consequências são tema deste estudo, que objetiva realizar um levanta-mento exploratório para identificar pontos relevantes que devem ser desenvolvidos para garantir um processo de finitude digno. Foram analisadas 50 publicações, mediante levantamento online e físico de obras publicadas até março de 2023. Os estudos analisados expressam preocupação com dilemas éticos do cuidar do ser humano em finitude, mas não analisam formas existentes (...) de tutela da finitude nem quais searas ainda são carentes de normatização para dar eficácia a esse cuidado. Espera-se que esta pesquisa contribua para fortalecer o olhar crítico ao tema, considerando as atuais tutelas da fini-tude, os limites legais do Estado e os potenciais passos futuros para fazer avançar os estudos aplicados à atualização prática do ordenamento brasileiro. SOBRE A DEFINIÇÃO DO TRABALHO -/- Gostaríamos de começar esse texto com uma introdução à definição de trabalho, uma questão de importância indiscutível, considerando o trabalho não apenas como o objeto de estudo da Sociologia do Trabalho, mas também como um tema de discussão contemporânea que obteve inúmeros conceitos de grandes autores ao longo da história, desde o trabalho como algo “escravista” ao homem, até a supervalorização do mesmo mediante ao homem. -/- O trabalho, nas palavras de Yves Simon (1903-1961) , é um daqueles termos que são precedidos por fatos da vida cotidiana do homem, que se escondem por trás do mistério do habitual ou usual. É um termo, portanto, que possui uma riqueza factual muito superior à qualquer definição que se pode concentrar. Santo Agostinho (354-430), referindo-se ao tempo, sabia o que era, mas se o perguntassem como defini-lo, apontou que não sabia como fazê-lo (“Si nemo ex me quaerat, scio; si quaerenti explicare velim, nescio”), traduzindo (“Se ninguém me perguntar, sei o que é; mas se quiser explicá-lo a quem me perguntar, não sei”). -/- Assim como Agostinho, algo parecido acontece conosco quando nos pedem para definir o trabalho. Assim como diria Werner Sombart (1863-1941), a palavra pode não ter um significado real, apesar de seu uso frequente. E é que o trabalho, como uma atividade criativa, faz parte da história humana desde sua gênese, há mais de 2 milhões de anos atrás, quando o homo habilis mostrou-se capaz de criar conscientemente e por si próprio (e não por mera carga genética como acontece com várias espécies animais) seus próprios instrumentos. -/- O supracitado Yves Simon, escolheu em seu texto mais representativo sobre o tema, uma maneira mais razoável de se definir o trabalho. Começou com o método de caso mais óbvio. Nesse sentido, mostrou que a ambivalência entre o trabalho manual e intelectual que o tempo parece não deixá-lo ir completamente, optara pelos “trabalhadores ao invés dos advogados, comerciantes ou homens de letras”. Essa ordem de prioridade não significa exclusão, mas sim graus de aceitação que considero fazer parte do critério ainda mantido por muitos a respeito do termo “trabalho”. -/- Nesse sentido, argumenta-se que o trabalho manual corresponde a sua ligação direta com a natureza física. O termo “direto” não ignora a mediação de máquinas e ferramentas, apenas comenta seu caráter relacional com a natureza. Logo, o trabalho significa a modificação de algo. -/- Entre as características desse trabalho, ao menos o manual, Simon ressalta que é uma atividade apenas transitória. Isso significa que o trabalho produz um efeito fora do agente que o executa. É o caso de um carpinteiro que age sobre a madeira para moldá-la e transformá-la em um bem de uso posterior como uma mesa, um banco, etc. -/- O mesmo autor ressalta que, se o efeito reside apenas no agente e não em um assunto externo, estaríamos enfrentado algo que chamaríamos de jogo, esporte, exercício ou mesmo a “imitação do trabalho”. -/- Por outro lado, o trabalho é uma atividade útil, isto é, propício para produzir um bem que seja útil e desejável por alguém. Finalmente, a racionalidade é um elemento que distingue o trabalho dos homens em relação com os animais. Essa ideia remonta com Hume (1711-1776), que insistia que o trabalho distingue os homens dos animais. Essa visão também será desenvolvida com Marx (1818-1883), que reproduzimos mediante uma célebre passagem do primeiro livro de O Capital. -/- [...] Pressupomos o trabalho numa forma em que pertence exclusivamente ao homem. Uma aranha executa operações semelhantes às do tecelão, e a abelha envergonha mais de um arquiteto humano com a construção dos favos de suas colmeias. Mas o que distingue, de antemão, o pior arquiteto da melhor abelha é que ele construiu o favo em sua cabeça, antes de construí-lo em cera (MARX, 1996, p. 297/98). -/- Na tradição marxista, foi Engels (1820-1895) quem parou mais nesses questões. Em seu ensaio particular escrito em 1876 e intitulado “O papel do trabalho na transformação do macaco em homem”, sintetiza a ideia de que é o trabalho quem cria e faz o homem. -/- Passando para o trabalho intelectual, Simon ressalta que, na verdade, a medida em que contribui para o trabalho manual desenvolvido por outros, a atividade intelectual também poderá ser denominada de trabalho. Avançando nessa concepção do filósofo, posteriormente, ele aponta “para que uma atividade seja qualificada como trabalho, ela deve ser não apenas honesta mas, também, socialmente produtiva”. -/- Essa concepção de utilidade produtiva é a mais generalizada no momento de distinção do trabalho com demais atividades. Como exemplo, podemos citar Friedmann (1902-1977) que aponta que a utilidade é a primeira característica do trabalho humano. E ainda cita economistas como Colson (1853-1939). Ressalta ainda que “o trabalho é o meio pelo qual o homem exerce suas capacidades físicas e morais para a produção de riquezas ou serviços”. Por outro lado, o filósofo Bergson (1859-1941) escreveu que “o trabalho humano consiste em criar utilidade”. Não obstante, Friedmann se pergunta se a teleologia do trabalho é a única variável a ser tomada em conta para a construção da definição do conceito. Nesse sentido, ele aponta a necessidade de se incluir outros fatores relevantes para essa edificação do conceito, uma vez que os animais também “criam utilidade”. Logo, a distinção poderia estar presente no “marco de uma luta social contra a natureza”. Mediante isso, o trabalho seria “essencialmente através da técnica, a transformação que o homem faz da natureza que, por sua vez, reage ao homem modificando-a”. É a mesma visão marxista que fizemos referência anteriormente, segundo o qual o “trabalho é, em primeiro lugar, um processo entre o homem e a natureza, como o qual o homem regula, realiza e a controla por meio de suas ações, sua troca de assuntos com a natureza. Coloca em ação suas forças naturais que configuram sua corporeidade, seus braços e pernas, cabeça e mãos, para que desse modo, possa assimilar, sob uma forma útil à sua própria vida, os materiais que a natureza o proporciona. E ao mesmo tempo que age na natureza externa e a transforma, transforma também sua própria natureza, desenvolvendo, assim, as faculdades antes adormecidas em si”. Inteligentemente, Friedmann foi capaz de assegurar que, no mundo contemporâneo, tal definição é parcial, uma vez que, nem todas as atividades do homem são rurais e manufatureiras, onde a relação-transformação com a natureza é mais evidente. As atividades denominadas terciárias, segundo a tradicional tipologia de Colin Clark (1905-1989), e que ampliarei posteriormente no conceito de trabalho intelectual, também devem ser levadas em consideração. Nesse sentido, Friedmann ressalta que, no século XX, o homem no trabalho não é sempre e menos ainda, no sentido clássico do termo, um homo faber. -/- Todavia, isso força Friedmann a pensar em um conceito diferente de trabalho e, para isso, ele confia que “determinada imposição” é específica e o diferencia de outras atividades que não são trabalho. Dessa maneira, para um trabalho ser tal deverá ter uma quota indispensável de obrigações. -/- Tantas indagações e reflexões acerca do supracitado, nos obriga a perguntamo-nos: a pessoa “trabalha” apenas se for obrigada a fazê-lo? Os animais não trabalham/produzem? Em condições de alienação desenvolvida e, portanto, o homem desconhecendo o fim último do seu labor, não estamos lidando com um trabalho? Quem age sobre a natureza, afim de destruí-la logo, não lhe conferindo valor, está trabalhando? A dona de casa que não produz para o mercado de trabalho não está trabalhando? Todas essas perguntas, se respondidas, fariam menção a um conceito de trabalho que, sem dúvida, ainda não foi unanimemente construído pela humanidade. De fato, quando vemos culturas e povos distintos, notamos que eles lidaram com conceitos muito diferentes sobre o que é e o que não é trabalho. Mesmo dentro dessas culturas – incluindo a nossa- e aqueles tempos - incluindo o nosso -, podemos notar uma pluralidade de abordagens que obedece a perspectivas distintas e, por vezes, conflitantes. Acrescenta-se a isso que, hoje em dia, temos herdado muitos atributos do trabalho das culturas anteriores, o que torna nossa sociedade representada, sociologicamente, por um caldeirão de comportamentos e conceitualizações relacionados ao trabalho, o que dificulta a partir de critérios mais ou menos consensuais. Posteriormente, veremos quais são esses critérios e como eles evoluíram ao longo da história para alicerçar nossa perspectiva contemporânea acerca do trabalho. -/- Hannah Arendt (1906-1975), dado às dificuldades supracitadas, decidiu traçar a etimologia dos termos de trabalho em questão, em sua famosa obra A condição humana de 2007, em que aclara os termos e as distinções entre trabalho e labor. Etimologicamente temos o grego distinguindo a partir de ponein e ergazesthai; o Latim entre laborare e facere ou fabricare; o inglês com labor e work e, por fim, o alemão entre arbeiten e werken. Em todos eles, aponta Arendt, apenas os equivalentes de “trabalho” significam, sem infortúnio, sofrimento e infelicidade. O Arbeiten alemão foi aplicado somente para designar as atividades de campo exercida pelos servos e não ao trabalho dos artesãos, denominado Werken. Outros autores sinalam que em francês Travailler que tem uma substituição do termo “trabalho”, vem do “Tripalium” (do latim “Tripaliare”, uma espécie de instrumento de tortura usado na antiguidade para castigar os escravos). De qualquer forma, todos os supra conceitos não são aceitos por todos os etimologistas. -/- Essas distinções são eloquentes na medida em que reproduzem a visão de diferentes e inúmeras culturas em relação ao trabalho. Nesse sentido, seguindo o pensamento arendtiano, existe um conceito que faz menção à uma avaliação notadamente negativa, e é o que deu origem à conformação do termo “labor”. Por outro lado, a mesma etimologia distingue outro termo (a obra) que representa conotações positivas. O que distingue os dois termos e o que popularizou Locke quando se referiu ao “trabalho de nossos corpos e trabalho de nossas mãos”? A diferença está, de acordo com Arendt, em que o trabalho cria bens fúteis dedicados ao mero consumo promovendo assim, com o passar dos anos, uma sociedade de massas onde desaparecerá o trabalho dito bem feito, típico de artesãos, que criam objetos de uso durável ao longo do tempo, mediante um processo de fabricação e que, em nenhum momento, implica o tédio ou a alienação características de uma sociedade de massa. Os gregos, segundo a pensadora, e então vamos confirmar isso, nunca praticaram essa diferença: tanto o trabalho quanto o artesanato na antiguidade grega eram reservados para os escravos, uma vez que todas as obrigações tinham uma natureza servil. Estes se opuseram à contemplação de quaisquer tipos de atividades. Nos chama a atenção que em nossa sociedade, a partir da idade moderna, houve a inversão da perspectiva acerca do trabalho, isto é, houve uma “glorificação” do mesmo em que foi conferido uma elevação do animal laborans sobre o animal racional. A pensadora alemã ainda nos diz que em vez da distinção trabalho-labor, surge outras que devemos nos atentar, são a relação entre trabalho produtivo e improdutivo; entre trabalho qualificado e não qualificado e, finalmente, entre o já conhecido binômio do trabalho manual-intelectual. A primeira dessas distinções, a relação entre produtividade e improdutividade, foi a mais transcendente e primordial nas origens das ciências econômica e social. Adam Smith (1723-1790) e Karl Marx desprezaram o trabalho improdutivo a tal ponto de não considerar o mesmo como trabalho ao menos que enriquecesse o mundo. Essa distinção se aproxima do supracitado trabalho-labor do princípio. A elevação do trabalho produtivo, acima das visões antigas; é expressamente perceptível em alguns autores clássicos. É o que acontece com as contribuições do filósofo Marx, para quem o trabalho é uma fonte de produtividade (originada na energia humana não exaurida e que produz a mais-valia); com Smith, para quem o trabalho é uma fonte de riqueza; e com Locke, para qual o trabalho é fonte de propriedade. -/- Em relação ao trabalho qualificado e não qualificado, Arendt nos diz que não tem mais sentido na atualidade a sua discussão, uma vez que, esse praticamente desapareceu sob a influência das modernas tecnologias organizacionais. Logo, a distinção entre trabalho e labor estaria obsoleta e abandonada em favor do próprio trabalho. -/- A distinção entre trabalho manual e intelectual tornou-se amplamente interessante desde a perspectiva arendtiana. Com efeito, como cada ocupação deve mostrar sua utilidade para toda a sociedade em seu conjunto, e a utilidade da ocupação intelectual -diz Arendt- chega a ser mais que duvidosa quando confrontada com a glorificação do trabalho, seria mais que natural que os intelectuais quisessem conformar a população laboriosa, algo inimaginável entre os gregos. A isso se soma a demanda que o mundo contemporâneo faz do trabalho intelectual. -/- O pensamento revolucionário do século XX não era alheio a essa distinção. Haya de la Torre (1895-1979), um pensador e líder da oposição peruana do século XX, disse afirmando claramente uma leitura de classe que divide o trabalhador do explorador: -/- “A revolução está em uma distinção que todos podemos fazer por si só: há aqueles que vivem do seu próprio trabalho e há aqueles que vivem do trabalho dos outros. Todos, de acordo com sua consciência, poderá decidir a qual dessas duas classes pertence” (1924, pp. 24-25). (Tradução própria). -/- Se rastrearmos por uma linha histórica, no entanto, veremos como esse trabalho intelectual não foi considerado trabalho, uma vez que partiu do mundo do lazer e da contemplação entre os gregos. -/- Apenas com a “glorificação” do trabalho, antes supracitada, é que o “intelectual” assume uma perspectiva de ser considerado trabalho, não obstante, sob pena de ser considerado improdutivo em uma sociedade onde o valioso parece ser tudo aquilo que tem poder produtivo. -/- Posteriormente, traçaremos uma linha histórica sobre os conceitos e perspectivas acerca dos trabalhos manual e intelectual desde os gregos, passando pela “glorificação” na era moderna até os dias atuais. -/- -/- REFERENCIAL TEÓRICO -/- ARENDT, H. In Brazil, the social demand for veterinary expertise is growing. However, there is still a shortage of professionals trained in this area to apply specific knowledge to each case. Studies and research into forensic veterinary medicine are necessary for veterinary experts to assist in investigations and legal proceedings. Veterinary medicine has subjects on its curriculum that cover the knowledge needed to apply in the fields of animal health, public health and the environment. The interaction between human and veterinary medicine, as (...) well as other areas of health, is of great importance in the prevention and control of various diseases, both in animals and humans. Some cases of infectious bovine abortion have a major impact not only on cattle farming and animal health, but also on public and environmental health. The concept of "One Health" integrates human medicine and health professionals. In this context, knowledge of infectious abortive diseases that affect animal, human and environmental health is fundamental. Cattle are affected by specific infectious abortive diseases, caused by pathogens with different forms of presentation and transmission mechanisms. These include brucellosis, leptospirosis and listeriosis, which are potentially zoonotic diseases. Controlling these diseases can contribute to effective public health actions and reduce global health risks. In order to establish the diagnosis of these diseases, it is essential to properly collect specimens from live or dead animals under biosafety and biosecurity conditions, following the chain of custody for each case. These procedures allow for greater success in diagnosing the suspected agent and facilitate the investigation of other causes. Animal health standards for the prophylaxis and control of these diseases are established by specific legislation, including those of the Ministry of Agriculture, Livestock and Supply (MALS). This literature review was based on current knowledge on the Pubmed platform, Google Scholar, articles and textbooks. This paper focuses on Schopenhauer’s On the Will in Nature (1836), a book which is generally underestimated by scholars interested in Schopenhauer’sphilosophy. This essay analyses its genesis in Schopenhauer’s manuscripts, examines its role in Schopenhauer’s thought and its relationship with The World asWill and Representation, and locates its content and meaning with reference to the philosophical and scientific context. Aim of the article is a better understanding of Schopenhauer’s treatise, and such a scope is pursued by accurate insight of its (...) central theme: the notion of Bestätigung, that is the scientific corroboration of the philosophical knowledge. Grice in pragmatics and Levelt in psycholinguistics have proposed models of human communication where the starting point of communicative action is an individual intention. This assumption, though, has to face serious objections with regard to the alleged existence of explicit representations of the communicative goals to be pursued. Here evidence is surveyed which shows that in fact speaking may ordinarily be a quite automatic activity prompted by contextual cues and driven by behavioural schemata abstracted away from social regularities. On the (...) one hand, this means that there could exist no intentions in the sense of explicit representations of communicative goals, following from deliberate reasoning and triggering the communicative action. On the other hand, however, there are reasons to allow for a weaker notion of intention than this, according to which communication is an intentional affair, after all. Communicative action is said to be intentional in this weaker sense to the extent that it is subject to a double mechanism of control, with respect both to present-directed and future-directed intentions. The scope of this article is to propose a reflection about the concept of citizenship presented by Aristotle in his work “Politics”, and which people were considered citizens then in comparison to nowadays. There is no intention to make a deep historical assessment about the particularities of each period of time, but analyse the characteristics which kept some groups inside of the political life and as well kept other groups away from it, in order to demonstrate how strong is the (...) maintenance of the estrangement between people who achieve everything is possible to, whereas other groups cannot achieve even what is deemed to be worthy by law. I discuss Clark’s predictive processing/extended mind hybrid, diagnosing a problem: Clark’s hybrid suggests that, when we use them, we pay attention to mind-extending external resources. This clashes with a commonly accepted necessary condition of cognitive extension; namely, that mind-extending resources must be phenomenally transparent when used. I then propose a solution to this problem claiming that the phenomenal transparency condition should be rejected. To do so, I put forth a parity argument to the effect that phenomenal transparency cannot be a (...) necessary condition on cognitive extension: roughly, since internal cognitive resources can fail to be transparent when used, by parity, external resources can fail to be phenomenally transparent too. Further, I argue that phenomenal transparency is not even a reliable indicator of cognitive extension; hence its absence should not be considered a problem for Clark’s extended mind-predictive processing hybrid. Lastly, I consider and allay a number of worries my proposal might raise, and conclude the paper. (shrink)

Some philosophers argue that a theory of logical validity should not interpret its own language, because a Russellian argument shows that self-applicability is inconsistent with the ability to capture all the interpretations of its own language. First, I set up a formal system to examine the Russellian argument. I then defend the need for self-applicability. I argue that self-applicability seems to be implied by generality, and that the Russellian argument rests on a test for meaning that is biased against self-applicability. (...) I propose an alternative test which is unproblematic for self-applicability. I conclude that self-applicability can be vindicated and the Russellian argument can be resisted. (shrink)

Across two studies, one of which was pre-registered, we find that a simple questionnaire that measures intellectual virtue and vice predicts how many fake news articles and conspiracy theories participants accept. This effect holds even when controlling for multiple demographic predictors, including age, household income, sex, education, ethnicity, political affiliation, religion, and news consumption. These results indicate that self-report is an adequate way to measure intellectual virtue and vice, which suggests that they are not fully immune to introspective awareness or (...) “stealthy” in the sense that Cassam (2015) argues. This is an important methodological result and may pave the way for future research on intellectual virtue and vice. (shrink)

Thematisch kreisen sie um Georg Wilhelm Friedrich Hegel, dessen Logik und praktische Philosophie sprachanalytisch erweitert wird. Daran schließen sich Untersuchungen zur Sprachphilosophie von Ludwig Wittgenstein und zur Ökonomiekritik von Karl Marx an. Es folgen Texte zu aktuellen (...) Problemen der Globalisierung und zur Tierethik. Marco war keineswegs ein purer Philologe, sondern ein eigenständiger Philosoph, der sich mit den gegenwärtigen Krisen auseinandergesetzt hat. (shrink)

The purpose of this article is to examine two important issues concerning the agency theory of causality: the charge of anthropomorphism and the relation of simultaneous causation. After a brief outline of the agency theory, sections 2–4 contain the refutation of the three main forms in which the charge of anthropomorphism is to be found in the literature. It will appear that it is necessary to distinguish between the subjective and the objective aspect of the concept of causation. This will (...) lead, in section 5, to contrast two kinds of anthropomorphism, one which has been rightly rejected by modern science and one which is fully compatible with the objective reality of the causal processes. Finally, section 6 will apply the preceding considerations to simultaneous causation. On the one hand, in a basic sense, there can be no simultaneous causal relations. On the other hand, simultaneous causation arises when we consider the natural change by abstracting from the agent and from her/his projects of interven.. (shrink)

The aim of this paper is to account for the (metaphorical) movement of the property of being present (or presentness) within the so-called Moving Spotlight Theory (MST). I will be leveraging the key argument by Emanuele Severino’s masterpiece, 'La Gloria' (2001), according to which it is impossible that a (maximal consistent) state of affairs begins to appear and lasts forever in our experience. After a brief overview of the MST’s main tenets (§1.1), I argue that Severino’s ontology might be interpreted (...) as a sort of MST (§1.2), following the hint by Federico Perelda (2017). Thereafter, I briefly recall Severino’s original argument in his own jargon, also proposing English lexical and conceptual translations of the main Italian phrases (§1.3). Then, I propose both a semi-formalization of Severino’s argument (§2.1) and a full formalization by means of temporal logic (§2.2). Finally, I assess all the three versions of the argument, concluding that my formalization might account for the movement of presentness in a non-metaphorical way (§2.3). (shrink)

Der vorliegende Aufsatz behandelt zwei Bereiche, deren Zusammenhang in der aktuellen Husserlforschung zu Unrecht in Vergessenheit geraten zu sein scheint: Zum einen konturiere ich den Habitusbegriff und das damit verbundene Problem der Habituskonstitution im Spätwerk E. Husserls. Zum anderen dient das Ergebnis dieser ersten Untersuchung dann als Grundlage für die Frage nach dem Wesen des Ich in der genetischen Phänomenologie. Die Untersuchung besteht aus drei Teilen: Zuerst stelle ich, um die Bedeutung des Begriffs „Habitus“ zu klären, Ingardens Interpretationsalternativen der Habituskonstitution (...) vor. Im Anschluss daran werde ich mich mit dem sogenannten „transzendentalen Okkasionalismus“ befassen, der eine der zuvor vorgestellten Alternativen Ingardens aufgreift und weiterführt. Der „transzendentale Okkasionalismus“ vertritt die These, dass die habituellen Eigenschaften des Ich durch den einfachen Vollzug der Akte entstünden. Weil diese These als Interpretation des Habitusbegriffs bei Husserl weit verbreitet ist, muss sie als Lösungsansatz in Erwägung gezogen werden. Jedoch zeigt eine genaue Lektüre der Forschungsmanuskripte Husserls, dass dieser scheinbare Lösungsansatz einen dort wichtigen Begriff außer Acht lässt: die „Geschichte des Ich“. Diese wird im dritten und letzten Teil dieses Aufsatzes näher betrachtet und erläutert. Husserl selbst hob nämlich einen wesenhaften Zusammenhang zwischen den mannigfaltigen Erfahrungen des Ich hervor, durch den die Bezeichnung der Habituskonstitution als „Okkasionalismus“ nicht zutreffend sein kann. Aus diesem Grund geht dieser Beitrag über die reine Wiedergabe der Habitusproblematik in Husserls Phänomenologie hinaus und beschreibt eine Auffassung der transzendentalen Subjektivität, die aus dem Spätwerk Husserls stammt. Within the field of neuroscience, it is assumed that the central nervous system is divided into two functionally distinct components: the brain, which does the cognizing, and the spinal cord, which is a conduit of information enabling the brain to do its job. We dub this the “Cinderella view” of the spinal cord. Here, we suggest it should be abandoned. Marshalling recent empirical findings, we claim that the spinal cord is best conceived as an intrabodily cognitive extension: a piece of (...) biological circuitry that, together with the brain, constitutes our cognitive engine. To do so, after a brief introduction to the anatomy of the spinal cord, we briefly present a number of empirical studies highlighting the role played by the spinal cord in cognitive processing. Having so done, we claim that the spinal cord satisfies two popular and often endorsed criteria used to adjudicate cases of cognitive extension; namely the parity principle and the so-called “trust and glue” criteria. This, we argue, is sufficient to vindicate the role of the spinal cord as an intrabodily mental extension. We then steel our case considering a sizable number of prominent anti-extension arguments, showing that none of them poses a serious threat to our main claim. We then conclude the essay, spelling out a number of far-from trivial implications of our view. (shrink)

A view that emancipates free will by means of quantum indeterminism is frequently rejected based on arguments pointing out its incompatibility with what we know about quantum physics. However, if one carefully examines what classical physical causal determinism and quantum indeterminism are according to physics, it becomes clear what they really imply–and, especially, what they do not imply–for agent-causation theories. Here, we will make necessary conceptual clarifications on some aspects of physical determinism and indeterminism, review some of the major objections (...) against libertarian conjectures, and show that there is no conceptual incompatibility preventing us from taking a ‘quantum-libertarian’ approach to the problem of free will. In particular, we will illustrate the possible role of self-causation (causa sui) as a potential solution to otherwise apparently incompatible or even paradoxical statements concerning free will and quantum indeterminism. The role of conscious attention in language processing has been scarcely considered, despite the wide-spread assumption that verbal utterances manage to attract and manipulate the addressee’s attention. Here I claim that this assumption is to be understood not as a figure of speech but instead in terms of attentional processes proper. This hypothesis can explain a fact that has been noticed by supporters of Relevance Theory in pragmatics: the special role played by speaker-related information in utterance interpretation. I argue that (...) representation of the speaker in working memory reliably enhances the activation of speaker-related information and, consequently, the role it plays in determining the content of interpretations. Abstract. This paper argues that the “Argument from Moral Peer Disagreement” fails to make a case for widespread moral skepticism. The main reason for this is that the argument rests on a too strong assumption about the normative significance of peer disagreement (and higher-order evidence more generally). In order to demonstrate this, I distinguish two competing ways in which one might explain higher-order defeat. According to what I call the “Objective Defeat Explanation” it is the mere possession of higher-order evidence (...) that explains defeat. I argue that this type of explanation is problematic and that it at best collapses into another explanation I call the “Subjective Defeat Explanation”. According to this explanation, it is coming to believe that one’s belief fails to be rational that explains defeat. Then I go on to argue that the Subjective Defeat Explanation is able to provide a straightforward explanation of higher-order defeat but that it entails that peer disagreement (and higher-order evidence more generally) only contingently gives rise to defeat, and importantly, that the condition it is contingent upon is very often not satisfied when it comes to moral peer disagreement specifically. As a result, it appears that moral knowledge is seldom threatened by moral peer disagreement. (shrink)

My main purpose here is to provide an account of context selection in utterance understanding in terms of the role played by schemata and goals in top-down processing. The general idea is that information is organized hierarchically, with items iteratively organized in chunks—here called “schemata”—at multiple levels, so that the activation of any items spreads to schemata that are the most accessible due to previous experience. The activation of a schema, in turn, activates its other components, so as to predict (...) a likely context for the original item. Since each input activates its own schemata, conflicting schemata compete with (and inhibit) each other, while multiple activations of a schema raise its likelihood to win the competition. There is therefore a double movement—with bottom-up activation of schemata enabling top-down prediction of other contextual components—triggered by multiple sources. Another claim of the paper is that goals are represented by schemata placed at the highest-levels of the executive hierarchy, in accordance with Fuster’s model of the brain as a hierarchically organized perception action cycle. This account can be considered, in part at least, a development of ideas contained in Relevance Theory, though it may imply that some other claims of the theory are in need of revision. Therefore, a secondary purpose of the paper is a contribution to the analysis of that theory. (shrink)

Husserl’s phenomenology of imagination embraces a cluster of different theories and approaches regarding the multi-faced phenomenon of imaginative experience. In this paper I consider one aspect that seems to be crucial to the understanding of a particular form of imagination that Husserl names pure phantasy. I argue that the phenomenon of Ego-splitting discloses the best way to elucidate the peculiarity of pure phantasy with respect to other forms of representative acts and to any simple form of act modification. First, I (...) unravel the phenomenological distinctions which, respectively, oppose phantasy to perception, on the one hand, and phantasy to other forms of the so-called “intuitive re-presentations”. Second, I introduce the difference between presentative and representative acts, arguing that this cannot help us to single out the defining feature of phantasy experiences. The third section draws again an important distinction between pure phantasy and neutrality modification, which allows me to finally determine an internal trait of phantasy experiences, which Husserl refers to as the “Ego-splitting”. In this way, I hope to contribute to a refined characterization of Husserl’s phenomenology of imagination. (shrink)

AI-based technologies are increasingly pervasive in a number of contexts. Our affective and emotional life makes no exception. In this article, we analyze one way in which AI-based technologies can affect them. In particular, our investigation will focus on affective artificial agents, namely AI-powered software or robotic agents designed to interact with us in affectively salient ways. We build upon the existing literature on affective artifacts with the aim of providing an original analysis of affective artificial agents and their distinctive (...) features. We argue that, unlike comparatively low-tech affective artifacts, affective artificial agents display a specific form of agency, which prevents them from being perceived by their users as extensions of their selves. In addition to this, we claim that their functioning crucially depends on the simulation of human-like emotion-driven behavior and requires a distinctive form of transparency—we call it emotional transparency—that might give rise to ethical and normative tensions. Higher-order evidence appears to have the ability to defeat rational belief. It is not obvious, however, why exactly the defeat happens. In this paper, I consider two competing explanations of higher-order defeat: the “Objective Higher-Order Defeat Explanation” and the “Subjective Higher-Order Defat Explanation.” According to the former explanation, possessing sufficiently strong higher-order evidence to indicate that one’s belief about p fails to be rational is necessary and sufficient for defeating one’s belief about p. I argue that this type of explanation (...) is defective or at best collapses into the other type of explanation. According to the latter explanation, Believing that one’s belief about p fails to be rational (in response to higher-order evidence about p) is necessary and sufficient for defeating one’s belief about p. I argue that this type of explanation is better suited to explain higher-order defeat given that what one is rational to believe partly depends on the relations among one’s doxastic attitudes. Finally, I address an peculiar feature of the Subjective Higher-Order Defeat Explanation: higher-order defeat becomes contingent on one’s response to the higher-order evidence. (shrink)

El derecho a una muerte digna es ampliamente ignorado por el ordenamiento jurídico brasileño. Esta invisibilidad del proceso de finitud y sus consecuencias son el objeto de este estudio, que tiene como objetivo realizar una encuesta exploratoria para identificar los puntos relevantes que deben desarrollarse para garantizar un proceso de finitud digno. Se analizaron 50 publicaciones a través de una encuesta online y física de obras publicadas hasta marzo de 2023. Los estudios analizados expresan preocupación por los dilemas éticos de (...) la atención a seres humanos en finitud, pero no analizan las formas de pro-tección a la finitud existentes ni cuáles son las áreas que aún necesitan regulación para hacer efectiva esta atención. Se espera que esta investigación contribuya a fortalecer la visión crítica de la finitud, considerando la protección actual de la finitud, los límites jurídicos del Estado y los posibles pasos futuros para avanzar en los estudios aplicados a la actualización práctica del sistema jurídico brasileño. In this paper, I contend that there are at least two essential traits that commonly define being an I: self-identity and self-consciousness. I argue that they bear quite an odd relation to each other in the sense that self-consciousness seems to jeopardize self-identity. My main concern is to elucidate this issue within the range of the transcendental philosophies of Immanuel Kant and Edmund Husserl. In the first section, I shall briefly consider Kant’s own rendition of the problem of the Egosplitting. (...) My reading of the Kantian texts reveals that Kant himself was aware of this phenomenon but eventually deems it an unexplainable fact. The second part of the paper tackles the same problematic from the standpoint of Husserlian phenomenology. What Husserl’s extensive analyses on this topic bring to light is that the phenomenon of the Ego-splitting constitutes the bedrock not only of his thought but also of every philosophy that works within the framework of transcendental thinking. This paper treats of Husserl’s phenomenology of happiness or eudaimonia in five parts. In the first part, we argue that phenomenology of happiness is an important albeit relatively neglected area of research, and we show that Husserl engages in it. In the second part, we examine the relationship between phenomenological ethics and virtue ethics. In the third part, we identify and clarify essential aspects of Husserl’s phenomenology of happiness, namely, the nature of the question concerning happiness and the possibility of (...) a phenomenological answer, the power of the will, the role of vocation, the place of obligation, the significance of habituation, the necessity of selfreflection and self-criticism, the importance of sociability and solidarity, the impact of chance and destiny, and the specter of regret. In the fourth part, we establish the inextricable linkage between Husserl’s metaethics and his metaphysics. In the fi ft h part, we provide a provisional exploration of his conception of the connection between happiness and blessedness. We acknowledge that there is an extensive literature on Husserl’s phenomenological ethics, and our study has benefitted greatly from it, but we also suggest that our holistic approach critically clarifies his description of happiness, virtue, and blessedness by fully recognizing that his phenomenological metaethics is embedded in his phenomenological metaphysics. Some philosophers search for the mark of the cognitive: a set of individually necessary and jointly sufficient conditions identifying all instances of cognition. They claim that the mark of the cognitive is needed to steer the development of cognitive science on the right path. Here, I argue that, at least at present, it cannot be provided. First (§2), I identify some of the factors motivating the search for a mark of the cognitive, each yielding a desideratum the mark is supposed (...) to satisfy (§2.1). I then (§2.2) highlight a number of tensions in the literature on the mark of the cognitive, suggesting they’re best resolved by distinguishing two distinct programs. The first program (§3) is that of identifying a mark of the cognitive capturing our everyday notion of cognition. I argue that such a program is bound to fail for a number of reasons: it is not clear whether such an everyday notion exists; and even if it existed, it would not be able to spell out individually necessary and jointly sufficient conditions for cognition; and even if it were able to spell them out, these conditions won’t satisfy the desiderata a mark of the cognitive should satisfy. The second program is that of identifying a mark of the cognitive spelling out a genuine scientific kind. But the current state of fragmentation of cognitive science, and the fact that it is splintered in a myriad of different research traditions, prevent us from identifying such a kind. And we have no reason to think that these various research traditions will converge, allowing us to identify a single mark. Or so, at least, I will argue in (§4). I then conclude the paper (§5) deflecting an intuitive objection, and exploring some of the consequences of the thesis I have defended. (shrink)

Austin's theory of performatives has recently inspired much literature on political correctness, based on the idea that they can be essential for the individuals' identity construction, but also for oppression and offence. In this paper I intend to analyze the power but also the limitations of performatives: we should refrain from attributing them magical efficacy, insofar as their power is actually constrained by objective conditions. This invites a revision of post-modern theories according to which any speech creates its own «regime (...) of truth», without any chance for an objective analysis of ideology. (shrink)

The distinction between nature and artifice has been definitive for Western conceptions of the role of humans within their natural environment. But the human must already be separated from nature in order to distinguish between nature and artifice. This separation, in turn, facilitates a classification of knowledge in general, typically cast in terms of a hierarchy of sciences that ascends from the natural sciences to the social (or human) sciences. However, this hierarchy considers nature as a substantial foundation upon which (...) artifice operates and to which it responds. Here I examine three inter-related concepts that, by focusing on events rather than substances, operate beyond the nature–artifice distinction and thereby resist the hierarchical classification of the sciences: Foucault’s concept of technology, the concept of milieu as it crosses over historically from physics to biology and anthropology, and Deleuze and Guattari’s reconfiguration of the concept of milieu in terms of their concept of machine. The article focuses on Patočka early phenomenological thought developed around the concept of the natural world. More precisely, the aim of the article is to explore Patočka recently published manuscript studies and fragments, dating from the first half of the 1940s, in which Patočka attempts to establish a deeper living correlation between man and world based on a certain metaphysical conception of nature which is not, as for Husserl, just one of the horizons which experiencing creates around itself, nor it (...) is just a basis on which the harmony of experiencing and its evironment must develop, but in which nature also includes an aspect which is closed and alien to subjectivity. In this way, the article shows that Patočka makes a step beyond of Husserl's and Heidegger's schemes of a correlation of life and world, understanding and being. The article thus shows that Patočka early writings throw a certain amount of light on his later phenomenological work that had been most notably developed from 1960s onwards. (shrink)

The aim of this essay is to build an interpretation of Passion according to G.H. (1964), by the Ukrainian-Brazilian writer Clarice Lispector, having hospitality as our horizon for the discussions that follow. Discussions concerning the personal/home aspects, but also the external and political side of the discussions. This analysis has the Freudian concept of the Unheimlich as the conductor for the debates on identity questions, which range from race, nationality and the construction of subjectivities. Structural representations are increasingly popular in philosophy of cognitive science. A key virtue they seemingly boast is that of meeting Ramsey's job description challenge. For this reason, structural representations appear tailored to play a clear representational role within cognitive architectures. Here, however, I claim that structural representations do not meet the job description challenge. This is because even our most demanding account of their functional profile is satisfied by at least some receptors, which paradigmatically fail the job description challenge. Hence, (...) the functional profile typically associated with structural representations does not identify representational posits. After a brief introduction, I present, in the second section of the paper, the job description challenge. I clarify why receptors fail to meet it and highlight why, as a result, they should not be considered representations. In the third section I introduce what I take to be the most demanding account of structural representations at our disposal, namely Gładziejewski's account. Provided the necessary background, I turn from exposition to criticism. In the first half of the fourth section, I equate the functional profile of structural representations and receptors. To do so, I show that some receptors boast, as a matter of fact, all the functional features associated with structural representations. Since receptors function merely as causal mediators, I conclude structural representations are mere causal mediators too. In the second half of the fourth section I make this conclusion intuitive with a toy example. I then conclude the paper, anticipating some objections my argument invites. (shrink)

This is an article about Legal Pragmatism, studied under the prism of the Philosophy of Law. The pragmatist philosophical current, born in the United States, was responsible for consolidating the line of legal reasoning aimed at obtaining the results that best meet social desires and human hopes. Legal Pragmatism is not presented as a Theory of Law, consubstantiating itself, in reality, in a method based on argumentation, capable of substantiating decision making. Finally, an attempt was made to ponder on Legal (...) Pragmatism in the Brazilian legal system, as a guide for new perspectives on the application of Law, with emphasis on the recent changes in the Law of Introduction to the Rules of Brazilian Law (Lei de Introdução às Normas do Direito Brasileiro). The right to a dignified death is largely overlooked by Brazilian law. This neglect of the end-of-life process and its ramifications is the focus of this study, which aims at an exploratory survey to identify pertinent aspects requiring development to ensure a dignified end-of-life experience. In total, 50 publications were examined with online and physical surveys of works published up to March 2023. They express concerns regarding ethical dilemmas in caring for individuals nearing the end of life, yet they do (...) not delve into existing mechanisms for safeguarding end-of-life dignity or identify areas that still lack standardization to ensure effective care. This study should contribute to the enhancement of critical perspectives on the issue of end-of-life experiences, considering current safeguards, the legal boundaries set by the State, and potential future strides toward advancing studies aimed at the practical update of the Brazilian legal system. This study evaluates the relationship between mental health and academic motivation among third-year college TES grantees. Thus, correlational design was employed to determine if there is a significant relationship between mental health and academic motivation among 150 third-year TES grantees. Statistical findings reveal that the r coefficient of 0.52 indicates a moderate positive correlation between the variables. The p-value of 0.00, which is less than 0.05, leads to rejecting the null hypothesis. Esta contribución presenta como el concepto filosófico de “donación” es reinterpretado en la reflexión de Patočka. Partiendo de la lección husserliana, gracias a la cual las cosas son dadas en la pura inmanencia de la consciencia, él critica esta orientación “subjetivista” porque no desarrolla adecuadamente el tema del aparecer en el campo fenomenal. La segunda sección analiza tres desplazamientos metódicos que abarcan: el rol del sujeto, su relación con la trascendencia, el darse a sí mismo del mundo en su totalidad. (...) La tercera sección compara la reflexión de Patočka con dos referencias cruzadas a algunos intentos similares en la historia de la fenomenología. El tema de “la donación”, por tanto, nos traslada al mayor problema con el que ha trabajado siempre la filosofía: la manifestación del mundo. Consciousness vehicle externalism is the claim that the material machinery of a subject’s phenomenology partially leaks outside a subject’s brain, encompassing bodily and environmental structures. The DEUTS argument is the most prominent argument for CVE in the sensorimotor enactivists’ arsenal. In a recent series of publications, Kirchhoff and Kiverstein have deployed such an argument to claim that a prominent view of neural processing, namely predictive processing, is fully compatible with CVE. Indeed, in Kirchhoff and Kiverstein’s view, a proper understanding of (...) predictive processing mandates CVE. In this essay, we critically examine Kirchhoff and Kiverstein’s argument. Our aim is to argue in favor of the following three points. First, that Kirchhoff and Kiverstein’s emphasis on cultural practices lends no support to CVE: at best, it vindicates some form of content externalism about phenomenal content. Secondly, the criteria Kirchhoff and Kiverstein propose to identify a subject’s phenomenal machinery greatly overgeneralize, leaving them open to a “consciousness bloat” objection, which is an analog of the cognitive bloat objection against the extended mind. Lastly, we will argue that the “consciousness bloat” problem is inbuilt in the very argumentative structure of the DEUTS argument. We will thus conclude that, contrary to the philosophical mainstream, DEUTS is not the best argument for CVE in the sensorimotor enactivists’ argumentative arsenal. (shrink)

O presente estudo, fruto de inquietação surgida em aulas de Filosofia no curso de mestrado em Direito pela Pontifícia Universidade Católica de São Paulo (PUC-SP), investiga a concepção filosófica da liberdade humana e o impacto da pena de prisão, visando à compreensão da eficácia da ressocialização. Com esta pesquisa, busca-se verificar como ocorre a privação de liberdade no Brasil para que se possa compreender de que forma o sistema de Justiça brasileiro persegue a almejada ressocialização prevista no art. 1º da (...) Lei nº 7.210/1984 (Lei de Execução Penal). Utilizando metodologia de levantamento bibliográfico, aborda-se inicialmente a perspectiva de renomados filósofos sobre a liberdade. Em seguida, traça-se uma análise histórica das origens das prisões e sua evolução como forma de punição estatal. O artigo também examina a realidade contemporânea do sistema carcerário, destacando violações de Direitos Humanos e dados estatísticos relevantes, além de considerar decisões da Suprema Corte brasileira. Conclui-se que a restrição da liberdade pode não ser o caminho para se atingir a ressocialização de pessoas que não utilizaram bem sua liberdade e, como consequência, cometeram crimes. Com isso, não se quer defender o fim da pena privativa de liberdade, mas reservar essa intervenção aos casos estritamente necessários. Diante do atual cenário de encarceramento em massa e do Estado de Coisas Inconstitucional do sistema carcerário, o Estado brasileiro não proporciona efetivavas condições à ressocialização dos detentos. Este estudo contribui para a discussão crítica da política de encarceramento a fim de contribuir com soluções para os desafios enfrentados pelo sistema prisional. (shrink)

According to the extended cognition thesis, an agent’s cognitive system can sometimes include extracerebral components amongst its physical constituents. Here, we show that such a view of cognition has an unjustifiably anthropocentric focus, for it tends to depict cognitive extensions as a human-only affair. In contrast, we will argue that if human cognition extends, then the cognition of many non-human animals extends too, for many non-human animals rely on the same cognition-extending strategies humans rely on. To substantiate this claim, we (...) will proceed as follows. First (Sect. 1), we will introduce the extended cognition thesis, exposing its anthropocentric bias. Then, we will show that humans and many non-human animals rely on the same cognition-extending strategies. To do so, we will discuss a variety of case studies, including “intrabodily” cognitive extensions such as the spinal cord (Sect. 2), the widespread reliance on epistemic actions to solve cognitive tasks (Sect. 3) and cases of animal cognitive offloading (Sect. 4). We’ll then allay some worries our claim might raise (Sect. 5) to then conclude the paper (Sect. 6). (shrink)

Since the publication of Kitcher’s influential paper The Division of Cognitive Labor, some philosophers wondered about these two related issues: (1) which is the optimal distribution of cognitive efforts among rival methods within a scientific community?, and (2) whether and how can a community achieve such an optimal distribution? Though not committing to any specific answer to question (1), I claim that issue (2) does not depend exclusively on an invisible hand like mechanism, since both intra-scientific and extra-scientific institutions may (...) play a major role. Finally, I examine some practical difficulties of reallocating scientists from a method to another, which leads to stress the importance of well-planned training and recruitment. (shrink)

A common distinction is the one drawn between individuals and kinds. On the one hand, individuals are entities such as the chair where I am now sitting, my cat Aristotle, the particles that compose the chair and my cat, and the 2023 Rugby World Cup, that is, particular objects or events. On the other hand, kinds are entities such as chairs, cats, and world-cup finals, that is, roughly, groupings of particular objects or events. Granting this distinction and the assumption that (...) at least some entities have at least some essential properties, one faces two distinct types of questions: (1) what is essential to an individual? (2) what is essential to a kind? After giving a short discussion of the difference between individuals and kinds, this chapter will tackle the first question and consider various possibilities of what may count as essential to an individual.
