Writing about secession is not an easy task for a political philosopher. Yet, writing about secession in India raises further practical and theoretical problems. The incredible task of professor Chandhoke’s book, Contested Secessions, is thus to provide a restatement of a liberal theory of secession, understood as a remedial right theory, which is still compatible with situations of contested secessions, such as those occurring in post-colonial societies like India. This paper focuses on two distinct yet related aspects of Chandhoke’s theory: (...) her distinctive version of remedial right theory, and her emphasis on a form of comprehensive pluralist liberalism. I argue that this approach might result in inconsistency due to the conflicting demands of these two approaches. If we take seriously Chandhoke’s political claim in favour of the legitimacy of what she calls “formal” democracy, further clarifications are needed with respect to the account of pluralism she proposes. In this paper, I examine whether Wenar's Bloody Oil ( 2016) succeeds in providing a theory able to accommodate the statist commitment to peoples’ sovereignty without dismissing the cosmopolitan concern regarding a just global market. Contextualising Blood Oil within the broader debate on global justice and resource ownership, I focus on some specific aspects of Wenar’s Clean Trade scheme and explain why it comes to quite radical conclusions. Yet, if these conclusions are taken seriously, Clean Trade seems too demanding from (...) the point of view of a statist account of justice. For cosmopolitans, too, the lack of normative justification for any alleged national resource sovereignty might weaken this position, especially for those who might oppose arguments to justify different forms of resource ownership. I will therefore discuss two problems with Wenar’s theory. First, I will show that, in spite of its statist premises, Wenar’s radical conclusions hardly pass the test of anti-paternalism. Is the Clean Trade scheme able to accommodate the demand of pluralism emerging in the Society of Peoples? Second, I focus on an issue that is neglected in Wenar’s book and which refers directly to the normative basis of resources ownership. I argue that this is a crucial issue, especially in contexts where the traditional idea of national sovereignty is contested, which often occurs in resource-cursed societies. (shrink)

Transitional Justice (TJ) focuses on the processes of dealing with the legacy of large-scale past abuses (in the aftermath of traumatic experiences such as war or authoritarianism) with the aim of fostering domestic justice and creating the basis for a sustainable peace. TJ however also entails the problem of how a torn society may be able to become a self-determining member of a just international order. This paper presents a minimal conception of TJ, which departs from Rawls' conception of normative (...) stability of the international order, which suggests disentangling the two goals of fostering democracy within torn societies and TJ itself. The scope of TJ is therefore limited to enabling these societies to create minimal internal conditions for joining a just international order on equal footing. This paper makes an original contribution to two different debates, namely normative research on TJ, and post-Rawlsian literature in general. First, it provides a new direction for normative theorizing about TJ which takes both its domestic and international dimensions seriously into consideration. Second, it extends Rawls' political liberal outlook to an area where it is not usually understood to apply. (shrink)

Across almost a decade, Desmond Tutu, Anglican cleric and chairman of South Africa’s Truth and Reconciliation Commission, supported a model of civil resistance against the apartheid regime based solely on religious argument. Tutu is one of what Appleby (2000) calls the “religious militants for peace”: people of faith who use religious arguments to buttress resistance against unjust regimes and to support vital political change with regard to rights and justice. Yet the employment of religious arguments to justify political action seems (...) to contradict the liberal democratic requirements of public reason, particularly the duty of liberal citizens to provide reasons that others could reasonably endorse. If “religious militants” violate their duty of civility by appealing to their comprehensive doctrines, should liberal democracy exclude this form of religiously founded dissent as being unreasonable? Or, rather, should liberal democracy embrace and support the efforts of “religious militants” to enhance and/or restore political justice? (shrink)

Religions and religious actors are increasingly associated with extremism and violence. A mainstream view that sees religions as prone to violence has been affirmed within the West. Yet, to affirm that religions promote anti-democratic projects and are inclined to violence can only partially capture the impact of religious voices in contemporary societies. In fact, religions have often played an important role in promoting democratic transition and religiously inspired doctrines have importantly supported peace and reconciliation processes in divided societies. This paper (...) argues that the mainstream view reproduces and extends a traditional liberal wariness toward the alleged incendiary role of religions in politics, the so-called doctrine of religious restraint. This view, I argue, is based on a misinterpretation of contemporary liberal theory and, especially, of Rawls’s Political Liberalism. The paper shows that Rawls’s framework instead provides an extensive accommodation of religions in political life. Starting from this premise, this paper responds to the mainstream view by focussing on the role of religious actors and sensitivities in reconciling divided societies. (shrink)

This dissertation summarises a research path aimed at fostering the use of Cognitive Architectures in Serious Games research field. Cognitive Architectures are an embodiment of scientific hypotheses and theories aimed at capturing the mechanisms of cognition that are considered consistent over time and independent of specific tasks or domains. The theoretical approaches provided by the research in computational cognitive modelling have been used to formalise a methodological framework to guide researchers and experts in the game-based education sector in designing, implementing, (...) and evaluating Serious Games. The investigation of cognitive processes involved during the game experience represents the fundamental step of the pro- posed approach. Two different case studies are described to discuss the possible use of the suggested framework. In the first case study, the aim was to design a modified version of the Tetris game with the intention of making the game more effective in training the visual-spatial skill called mental rotation. In the second scenario, the frame- work was used as a basis for creating an innovative persuasive game. This case study provides an example of adopting cognitive architectures for implementing a non-player character with human-like behaviour developed using targeted cognitive theories. (shrink)

Discerning the decisionmaking of Kim Jong-Un and the North Korean regime on issues of peaceful engagement and warlike actions endures as a mighty challenge for U.S. intelligence analysts and policymakers. In this report, we seek to inform analysis of Democratic People’s Republic of Korea (DPRK) leadership decisionmaking. To do so, we use three discussion papers that were written to facilitate discussion of an interagency working group. The three papers are assembled here in a single report. The first discussion paper describes (...) decisionmaking among different authoritarian regimes, including North Korea, and the opening up of those economies to outside engagement. The second paper outlines two different scenarios that might occur when conventional deterrence on the Korean Peninsula breaks down and the resulting decisions that North Korea’s leadership could face. The third paper assesses DPRK decisionmaking about nuclear weapon use. The report concludes with some observations, drawn from the issues covered in these three discussion papers, about DPRK decisionmaking and stability on the Korean Peninsula. (shrink)

Feita de um ponto de vista sobretudo pessoal, esta homenagem não poderia deixar de mencionar algumas das virtudes que se sobressaem em seu trabalho e que no meu entendimento conferem exemplaridade às suas contribuições para os estudos Nietzsche no Brasil. Entre essas virtudes destaco por fim a gentileza, que curiosamente não costuma figurar no catálogo das virtudes intelectuais. O trabalho de André Itaparica é um convite (...) para que essa negligência seja revista.: This paper pays tribute to André Itaparica’s career in the Brazilian Nietzsche research. Written mostly from a personal point of view, this homage couldn’t fail to mention the many virtues embodied by his scholarly work, which in my view place it in an outstanding position in the Brazilian Nietzsche studies. Among his many virtues I finally emphasize courtesy, which remains largely unnoticed as an intellectual virtue. Itaparica’s work invites us, I submit, to compensate this undeserved neglect. (shrink)

The attention paid in the Giornale critico della filosofia italiana to the major exponents of seventeenth-century philosophical rationalism, from its foundation by Giovanni Gentile in 1920 until 1979, reveals important changes that provide us with interesting information on Italian Neo-idealism. The small number of articles on Descartes can be interpreted as the result of an overall approach – sanctioned by Gentile – different from that of Hegel, who considered Descartes as the founder of modern philosophy. For Gentile, (...) Descartes represents a stage in the history of philosophy spanning from Humanism to Spinoza, and, in a more particular Italian perspective, from Campanella to Vico. This interpretative scheme persisted also under the direction of Ugo Spirito, when Cartesianism continued to receive little theoretical and historical attention, with the exception of Eugenio Garin’s contributions. In the years from 1945 to 1979, the Giornale critico emphasized instead the interest for Spinoza, a very important author for Gentile, up to the double monographic issue published on the occasion of the third centenary of Spinoza’s death (1977). In turn, the lack of interest for Leibniz was constant and evident from the small number of articles published from 1920 to 1979, which were furthermore not particularly connected with the international, coeval Leibniz scholarship. Il testo inizia con l'interpretazione di G.W.F. Hegel e di B. Spaventa, per poi accedere a quella di G. Gentile. Il volume si conclude con l'analisi ed il commento dell'interpretazione fornita da N. MacDonald argues that a suite of genetic and cultural adaptations among Jews constitutes a “group evolutionary strategy.” Their supposed genetic adaptations include, most notably, high intelligence, conscientiousness, and ethnocentrism. According to this thesis, several major intellectual and political movements, such as Boasian anthropology, Freudian psychoanalysis, and multiculturalism, were consciously or unconsciously designed by Jews to promote collectivism and group continuity among themselves in Israel and the diaspora and undermine the cohesion of gentile populations, thus increasing the competitive advantage of (...) Jews and weakening organized gentile resistance. By developing and promoting these movements, Jews supposedly played a necessary role in the ascendancy of liberalism and multiculturalism in the West. While not achieving widespread acceptance among evolutionary scientists, this theory has been enormously influential in the burgeoning political movement known as the “alt-right.” Examination of MacDonald’s argument suggests that he relies on systematically misrepresented sources and cherry-picked facts. It is argued here that the evidence favors what is termed the “default hypothesis”: Because of their above-average intelligence and concentration in influential urban areas, Jews in recent history have been overrepresented in all major intellectual and political movements, including conservative movements, that were not overtly anti-Semitic. ABSTRACT This article studies the theory of animal seeds as purely material entities in the early seventeenth-century medical writings of Antonio Ponce Santacruz, royal physician to the Spanish king Philipp IV. Santacruz adopts the theory of the eduction of substantial forms from the potentiality of matter, according to which new kinds of causal powers can arise out of material composites of a certain complexity. Santacruz stands out among the late Aristotelian defenders of eduction theory because he applies the concept of (...) an instrument of direction developed by the medieval Avicenna commentator Gentile da Foligno and gives a novel turn to this concept by interpreting animal seeds as separate instruments. The article situates Santacruz's theory in the context of early modern debates about the concept of the eduction of forms, as well as in the context of early modern debates about the concept of separate instruments. Particular attention is paid to Santacruz's responses to the biological views of Julius Caesar Scaliger and Thomas Feyens. Santacruz's response to Scaliger turns out to be central for his explication of the eduction relation, and Santacruz's response to Feyens turns out to be central for his explication of the nature of instrumental causation. Il filosofo e la passione per il “gentil sesso”.

The contribution focuses on philosophical issues of justice of positive law in the light of the social teaching of John Paul II. The analyses start with consideration of anthropological foundations of justice as virtue, develop with the reflexion upon justice of actions realizing justice and finally arrive at examination of the criteria of justice of law. -/- It is argued that relations between a human being and goods (ends of actions) form ontological basis of natural law and justice of actions (...) – orders and prohibitions are secondary in respect to these relations. An aim of just law (and natural law) is not preservation or restoration of abstractly understood moral order based on norms – orders and prohibitions) but integral development (good) of a person – a being possessing dignity. John Paul’s II philosophy of law takes advantage primarily of Thomas Aquinas’ approach to law and combines it with constructions which are typical for modern human rights protection. John Paul’s II conception of natural law is anthropocentric and bases on subjective rights thinking. Human dignity and human rights which derive from it provide basic criteria for the justice of law. Human rights as subjective rights disclose natural law which is understood as a set of goods for a human person. These goods are ends of actions and as such they determine actions and their forms. This point of view is compatible with Aquinas’ definition: “law is nothing but a rational plan of operation, and … the rational plan of any kind of work is derived from the end” (Summa contra gentiles, lib. 3, cap. 114, n. 5). -/- Positive (human) law which is not just has no normative power in this sense that it does not in itself provide reasons for concrete actions of a concrete actor. Sometimes there are moral reasons for following unjust law, however if its norm prescribes actions which are wrong in themselves (internally wrong) there is moral obligation to act contrary to such a legal norm. -/- Zasadniczym przedmiotem opracowania jest filozoficzna refleksja Jana Pawła II nad sprawiedliwością prawa stanowionego. Analizy przebiegają od zagadnienia antropologicznych podstaw sprawiedliwości poprzez problematykę działań realizujących sprawiedliwość do zagadnienia sprawiedliwości prawa stanowionego. Opracowanie zamykają uwagi wskazujące na kontekst teologiczny istotny dla problematyki sprawiedliwości, którego analiza wykracza jednak poza podjęte zamierzenie koncentrujące się na problematyce filozoficznoprawnej. Argumentuje się, że u podstaw tej refleksji leży namysł nad relacją człowieka do dobra, która stanowi ontologiczną podstawę prawa naturalnego i sprawiedliwości – nakazy i zakazy są wtórne wobec tej relacji. Celem prawa i sprawiedliwości jest dobro konkretnego, obdarzonego godnością człowieka, a nie np. przywracanie abstrakcyjnie pojętego porządku moralnego. Od strony konstrukcji teoretycznej, filozofia prawa Jana Pawła II jest osadzona przede wszystkim na koncepcji Tomasza z Akwinu łączonej z konstrukcjami typowymi dla współczesnej ochrony praw człowieka. To w godności i wynikających z niej prawach człowieka poszukiwać trzeba zasadniczych treściowych kryteriów sprawiedliwości prawa. Prawa człowieka jako prawa podmiotowe są podstawowym wyrazem prawa naturalnego, stanowiącego ontyczną podstawę sprawiedliwości i które pojmowane jest jako zespół dóbr dla osoby, zatem i celów kształtujących działanie. Perspektywa pojmowania prawa naturalnego jest antropocentryczna. Prawo stanowione, które nie jest sprawiedliwe, nie ma „mocy prawa”, przede wszystkim w takim sensie, że nie stanowi samo w sobie racji działania. Niekiedy, ze względów moralnych, niesprawiedliwe prawo wymaga posłuszeństwa. Jeśli jednak prawo stanowione daje uprawnienia do czynów wewnętrznie złych i nakazuje takie czyny, to nie tylko nie obowiązuje w sumieniu i nie jest racją działania, ale obowiązkiem jest postępowanie wbrew takiemu prawu. In Search of the Girl Soldiers of Aboke Abstract In a story about class, power, belonging, disappearance, and political tension, journalist Els De Temmerman tells the story of one hundred and thirty-nine girls abducted from the Aboke School in Uganda, raped, given as wives to the soldiers, and forced to kill other children. Collectively, their stories become the voice of all children abducted into heinous armies; this is a summary of their disappearance, struggle, death, and, for some, liberation. The Lord’s (...) Resistance Army is run by Joseph Kony, a man with meager education and plans to “overthrow the government in Uganda and then rule the country by the Ten Commandments” (Temmerman 15). Temmerman begins each chapter with a Scripture, such as “‘The lion has come up from the thicket, and the destroyer of the gentiles is on his way; he is gone forth from his place to make thy land desolate’” (Temmerman 1). Kony believes his twisted movement has Biblical backing, thus justifying their crimes. These Scriptures describe what is taking place throughout Uganda. Like Ocol in Ugandan Okot p’Bitek’s Song of Lawino, the LRA think they are bringing civilization, “drunk with the illusion of real power” (p’Bitek 136), cleansing the world of evil. They believe that they are God’s chosen people. This is also the story of Sister Rachele’s plea to the Pope and the rulers of nations to rescue these children. President Obama is the first U. S. This essay explores and exposes Thomas Aquinas' notions of prudence and providence and interprets these notions in a bid to establish a relationship between human prudence and divine providence. At face value, it would seem that these two concepts are widely divergent and almost mutually exclusive. Nonetheless, the essay uses the phenomenological tool of analysis of relevant works of literature — the Summa Theologiae and the Summa Contra Gentiles — and argues that the ideas of human prudence and divine providence (...) have more in common than what they have apart. Accordingly, the essay avers that man's exercise of prudence is a participation in the works of divine providence or God's providential governance of the world. Likewise, the essay claims that human prudence is a response and compliance to the order initiated and willed by God's benevolent act of knowledge. These conclusions are arrived at through the knotting of prudence and providence as predicated by God. Thus, if prudence in God implies his providence and human prudence implies God's prudence (although an imperfect implication), it follows that human prudence implies divine providence. It is in this way that the essay proposes and concludes that man's exercise of prudence is a participation in divine providence. The paper adapts a theological method. (shrink)

This paper attempts to look Francesco Gentile's concept of the Law under phenomenological point of view. Francesco Gentile (1936-2009) was full professor of Philosophy of Law at Padua University and Dean of School of Law; during his academic career, based on Roman Jurisprudentia and Christian message of Redemption, he developed a personal conception of law like "conversion the human conflict to interpersonal dispute". Then, in this paper, I want to observe this philosophical result, under biblical term "justification" connected (...) to Levinas' ethic, and I want to aim to revalue and exploit the problem of his systematic approach like a specific theory of Law.
