In this article we argue that the social value of health research should be conceptualized as a function of both the expected benefits of the research and the priority that the beneficiaries deserve. People deserve greater priority the worse off they are. This conception of social value can be applied for at least two important purposes: in health research priority setting when research funders, policy-makers, or researchers decide between alternative research projects; and in evaluating the ethics of proposed research proposals (...) when research ethics committees assess whether the social value of the research is sufficient to justify the risks and burdens to research participants and others. In assessing how far a proposed research project will advance the interests of people who are more disadvantaged, research priority setters and RECs should examine the diseases that the research targets and the type of research. Just as certain diseases impose a greater burden on people who are more disadvantaged, so certain types of intervention and forms of research are more likely to benefit people who are more disadvantaged. We outline which populations are likely to be representative of the global worst off and identify what types of health research, and which disease categories, are priorities for these populations. The διακριτικὴ τέχνη (the art of separating or discriminating), from which the sixth definition of theSophiststarts (226b1–231b9), is puzzling.Prima faciethe art of separating does not fit the initial division of art between ποιητικὴ τέχνη (production) and κτητικὴ τέχνη (acquisition) at 219a8–c9. Therefore, scholars generally agree that, although mutually exclusive, ποιητική and κτητική are not exhaustive and leave room for a third species of art, διακριτικὴ τέχνη, on a par with ποιητική and κτητική. However, I argue that textual evidence suggests otherwise.

Alors que le débat sur le caractère scientifique ou pseudo-scientifique de l’agriculture biodynamique occupe régulièrement le débat public, l’histoire et la philosophie des sciences ne semblent que très peu s’être emparées de ce sujet. La thèse défendue ici est double : tout d’abord, si l’agriculture biodynamique rencontre un relatif succès aujourd’hui, cela tient sans doute au fait que son théoricien, R. Steiner, a été un des premiers à critiquer le paradigme qui domine l’agronomie, ou en tout cas l’agriculture, depuis plus (...) d’un siècle. Cette critique semble d’ailleurs se maintenir dans ses motifs tout au long du XXe siècle, jusqu’à une certaine critique contemporaine de l’agro-industrie et de ses conséquences désastreuses sur l’environnement. Or, et c’est la seconde thèse défendue ici, cette critique semble méconnaître voire occulter la réalité des débats internes qui ont traversé l’agronomie au cours du XXe siècle et qui continuent de l’agiter aujourd’hui : l’agronomie système a ainsi par exemple intégré dans ses objets des éléments de l’agriculture biodynamique. Selon nous, le problème principal est que l’agronomie est souvent abordée selon une approche externaliste, qui doit impérativement être complétée par une approche internaliste afin tout d’abord de distinguer ce qui relève de la science et ce qui relève du mysticisme, et ensuite de saisir toute la richesse historique et épistémologique de l’agronomie. [ES] En recientes décadas se ha observado un renovado interés por algunos de los temas clásicos de la ontología, desde áreas de conocimiento externas a la filosofía, sin embargo, este renacimiento ontológico ha «estimulado» una multiplicidad y diversidad de teorías y concepciones «ontológicas» que ha dado como consecuencia una proliferación de «ontologías» y de interminables batallas para determinar qué tipo de «entidades» estudian sus respectivos «dominios», que a su vez se consideran autónomos e independientes entre sí, inclusive de la propia (...) ontología. En este sentido, el propósito de este trabajo es caracterizar y representar de manera adecuada estas «ontologías», dentro del marco general del debate acerca de la naturaleza de la ontología. Es así que, en la primera sección haré un diagnostico de la ontología contemporánea; en la segunda proporcionaré algunas definiciones y caracterizaciones de las principales concepciones, en especial de las denominadas «ontologías aplicadas»; y en la tercera analizaré sí estas concepciones pueden ser consideradas diversos tipos de ontología o simplemente son diversos niveles de ontología. El marco de la discusión no se centrará en confrontar todas estas nociones, sino en describirlas y analizarlas para ofrecer un enfoque sobre el estado actual de la ontología y sus problemas. [EN] In recent decades there has been a renewed interest in some of the classic themes of ontology, from areas of knowledge external to philosophy; however, this ontological revival has «stimulated» a multiplicity and diversity of «ontological» theories and concepts that has resulted in a proliferation of «ontologies» and endless battles to determine what kind of «entities» study their respective «domains», which in turn are considered autonomous and independent, even of ontology itself. In this sense, the purpose of this work is to adequately characterize and represent these «ontologies», within the general framework of the debate about the nature of ontology. Thus, in the first section I will make a diagnosis of contemporary ontology; in the second I will provide some definitions and characterizations of the main concepts, especially the so-called «applied ontologies»; and in the third I will analyze whether these concepts can be considered different types of ontology or simply are different levels of ontology. The framework of the discussion will not center on confronting all these notions, but to describe and analyze them to provide a focus on the current state of ontology and its problems. (shrink)

There seems to be an inconsistency at the heart of Aristotle’s Metaphysics: a differentia is said both to presuppose its genus (in vii 12) and to be logically independent from it (in x 7). I argue that the relation of analogy resolves this inconsistency, restores the coherence of the concepts of differentia and species, and gives x 7 its rightful place in the development of the Metaphysics.

Do scientific theories limit human knowledge? In other words, are there physical variables hidden by essence forever? We argue for negative answers and illustrate our point on chaotic classical dynamical systems. We emphasize parallels with quantum theory and conclude that the common real numbers are, de facto, the hidden variables of classical physics. Consequently, real numbers should not be considered as ``physically real" and classical mechanics, like quantum physics, is indeterministic.

This collection highlights the new trend away from rationalism and toward empiricism in the epistemology of modality. Accordingly, the book represents a wide range of positions on the empirical sources of modal knowledge. Readers will find an introduction that surveys the field and provides a brief overview of the work, which progresses from empirically-sensitive rationalist accounts to fully empiricist accounts of modal knowledge. Early chapters focus on challenges to rationalist theories, essence-based approaches to modal knowledge, and the prospects for naturalizing (...) modal epistemology. The middle chapters present positive accounts that reject rationalism, but which stop short of advocating exclusive appeal to empirical sources of modal knowledge. The final chapters mark a transition toward exclusive reliance on empirical sources of modal knowledge. They explore ways of making similarity-based, analogical, inductive, and abductive arguments for modal claims based on empirical information. We present in this paper a novel ontological theory of events whose central tenet is the Aristotelian distinction between the object that changes and the actual subject of change, which is what we call an individual quality. While in the Kimian tradition events are individuated by a triple ⟨ o, P, t ⟩, where o is an object, P a property, and t an interval of time, for us the simplest events are qualitative changes, individuated by a triple ⟨ o, (...) q, t ⟩, where q is an individual quality inhering in o or in one of its parts. Detaching the individuation of events from the property they exemplify results in a fine-grained theory that keeps metaphysics and semantics clearly separate, and lies between the multiplicative and the unitarian approaches. We discuss then the way language refers to events, observing that, in most cases, event descriptions refer to complex, cognitively relevant clusters of co-occurring qualitative changes, which exhibit a synchronic structure depending on the way they are described. Contra Bennett, who famously argued that the semantics of event names ultimately depends on “local context and unprincipled intuitions”, we show how the lexicon provides systematic principles for individuating such clusters and classifying them into kinds. Finally, we address some open challenges in the semantics of locative and manner modifiers. (shrink)

Cet article est consacré au problème du rapport entre l’entrelacement des genres (συμπλοκὴ τῶν εἰδῶν) et le logos dans le Sophiste. Après avoir brièvement présenté le problème, je discute, dans la première partie, différentes solutions proposées par les commentateurs. Je cherche à montrer qu’aucune de ces solutions n’est pleinement satisfaisante. Dans la deuxième partie, je propose une nouvelle solution au problème de la συμπλοκὴ τῶν εἰδῶν fondée sur une distinction entre deux types de logos, le logos dialectique et le logos (...) doxique. Dans la troisième partie, je cherche à justifier textuellement cette solution en recourant à la fois au texte du Sophiste lui-même et à la dernière partie du Théétète. Dans ma conclusion, je suggère que la distinction entre logos dialectique et logos doxique correspond à une différence qui traverse toute l’œuvre de Platon, à savoir la différence entre connaissance et opinion. / This paper deals with the problem of the συμπλοκὴ τῶν εἰδῶν in the Sophist. In the first part, after a brief presentation of this problem, I discuss different solutions which have been proposed in the recent literature. I try to show that none of them is entirely satisfying. In the second part, I propose and explain a new solution based on a distinction between two types of logos : dialectical logos and doxastic logos. In the third part, I try to justify this solution on the basis of some passages of the Sophist and of the final part of the Theaetetus. To conclude, I suggest that the distinction between dialectical logos and doxasticlogos matches the difference between knowledge and belief made by Plato in his dialogues. (shrink)

Animals who live in cities must coexist with us. They are, as a result, entitled to the conditions of their flourishing. This article argues that, as the boundaries of cities and urban areas expand, the boundaries of our conception of captivity should expand too. Urbanization can undermine animals’ freedoms, hence their ability to live good lives. I draw the implications of an account of “pervasive captivity” against the background of the Capabilities Approach. I construe captivity, including that of urban animals, (...) as affecting a range of animal capabilities, understood as freedoms, and I address some tensions within Nussbaum’s treatment of human-animal conflicts. Using the Capabilities Approach as a guide, I will attempt to motivate a convergence between habitat preservation in urbanized environments, urban design guided by justice, and the individual freedoms of animals. Relying on evidence from fifteen epigraphic collections and sixty-odd ancient sources as well as discussing a literature of over five hundred titles, the essay’s highly unorthodox conclusions are a case in point of the micrological ideal of achieving novelty on any given subject by way of transcribing and studying first-hand all relevant materials – edited and unedited alike. The paper’s ambition was to shed new light on one of the most intriguing analogies of the whole Aristotelian corpus, namely the comparison (...) between words and pebbles. A review of all material evidence and virtually all extant sources made short work of two related, albeit mutually exclusive, misconception about ancient reckoning boards and their workings: (1) the idea that – for all practical purposes – the abacus’ arrangement mirrored the decimal system, its columns and rows conveniently matching units, tens, hundreds, thousands, etc. (2) the idea that the inscriptions on several surviving counting boards were a nuisance to the extent that, being inconsistent to a fault with the decimal system itself, they made actual calculations harder than they already were (as opposed to making them easier, as one would expect). The paper demonstrated that the first assumption – the « decimal » bias – is simply mistaken and betrays little or no awareness of the epigraphic and archaeological evidence. The paper also demonstrated that the second assumption – the « abacus riddled with complications » bias – simply defeats the purpose of resorting to the abacus in the first place and betrays a poor understanding of its practical vocation which, most assuredly, was not to add to the very problem it was meant to solve. After bulldozing its way through both misunderstandings, the essay focused on the abacus most distinctive features, that is positionality (i.e. the abacus being a positional system through and through) and hybridity (i.e. the abacus’ place value system being monetary in nature and purpose, as opposed to it being abstract and homogeneous). The final result is an interpretation that moves away from the received views by showing that the prologue of the Sophistici elenchi offers no support to the notion that, when Aristotle referred to counters, he was leaning on a kinship of sorts – or any kinship, for that matter – between abstract calculation and speech. Once we turns the pebble’s simile on its head and set it back upon its feet (Aristotle’s pebble analogy is about pebbles, what else?), it becomes clear that it presupposed numeracy all right, but it was not about numeracy itself. Moreover its goal was not to explain why computational and linguistic symbolisms succeed, but to explain how they fail – failure being the whole point; in this particular instance, failure to detect and prevent abusive value shifts affecting words and counters alike. Despite intensive exegetical work, Plato’s description of dialectic in the Sophist still raises many questions. Through a close reading of this passage that contextualizes it in the general organisation of the Sophist, this paper provides answers to these questions. After presenting the difficult text, I contend that the “vowel-kinds” are necessary conditions for the blending of kinds. Then, I interpret the “cause of divisions” mentioned by the Stranger as the kinds responsible of the dichotomous division in the first half of (...) the dialogue. In the next part, I show that 235d5-e2 does not describe a procedure of “meta-divison” as some commentators have it, but that it describes the method of division itself. Finally, I connect the difficulty and the obscurity of the passage to the fact that dialectic is the supreme science and I explain why dialectic is the science of free men. (shrink)

Evoluția testelor gravitaționale dintr-o perspectivă epistemologică încadrată în conceputul de reconstrucție rațională al lui Imre Lakatos, pe baza metodologiei acestuia a programelor de cercetare. Perioada evaluată este foarte vastă, începând cu filosofia naturală a lui Newton și până la teoriile gravitației cuantice din zilele noastre. Pentru a explica mai rațional evoluția complexă a conceptului de gravitație din ultimul secol, propun o extindere naturală a metodologiei programelor de cercetare pe care o folosesc apoi pe parcursul lucrării. Consider că această abordare oferă (...) o nouă perspectivă asupra modului în care au evaluat în timp conceptul de gravitație și metodele de testare a fiecărei teorii a gravitației, prin observații și experimente. Argumentez, pe baza metodologiei programelor de cercetare și a studiilor oamenilor de știință și filosofilor, că actualele teorii ale gravitației cuantice sunt degenerative, datorită lipsei dovezilor experimentale pe o perioadă îndelungată de timp și a auto-imunizării împotriva posibilității falsificării. Mai mult, în prezent este în curs de dezvoltare un curent metodologic care atribuie un rol secundar, neimportant, verificărilor prin observații și/sau experimente. Din această cauză, nu va fi posibilă o teorie completă a gravitației cuantice în forma actuală care să includă la limită relativitatea generală, întrucât teoriile fizice au fost dintotdeauna ajustate, în decursul evoluției lor, pe baza testelor observaționale sau experimentale, și verificate prin predicțiile făcute. De asemenea, contrar unei opinii răspândite și a unor programe active actuale privind unificarea tuturor forțelor fundamentale ale fizicii într-o singură teorie finală, pe baza teoriei corzilor, argumentez că este puțin probabil în general să se realizeze această unificare, și nu este posibil oricum ca unificarea să se elaboreze pe baza teoriilor actuale ale gravitației cuantice, inclusiv prin teoria corzilor. În plus, susțin punctele de vedere ale unor oameni de știință și filosofi că în prezent se consumă mult prea multe resurse pe ideea dezvoltării teoriilor gravitației cuantice, și în special teoria corzilor, care să includă relativitatea generală și să unifice gravitația cu celelalte forțe, în condițiile în care știința nu impune astfel de programe de cercetare. -/- DOI: 10.13140/RG.2.2.14582.75842 . We aim to do two things in this article. On the positive end, our goal is to explain how some seemingly incompatible aspects of belief live together, by presenting distinct mechanistic explanations of each of them: in particular we want to show how belief can be discerning, credulous, rational, and irrational. After clarifying our positive view, we take aim at some competitor views in the second half of the paper, particularly offering critiques of epistemic vigilance and social marketplace accounts of (...) belief. We conclude by inviting proponents to provide an architecture for belief that can be tested against existing models. (shrink)

This article defends a relational account of personhood. I argue that the structure of personhood consists of dyadic relations between persons who can wrong or be wronged by one another, even if some of them lack moral competence. I draw on recent work on directed duties to outline the structure of moral communities of persons. The upshot is that we can construct an inclusive theory of personhood that can accommodate nonhuman persons based on shared community membership. I argue that, once (...) we unpack the internal relation between directed duties, moral status, and flourishing, relations can ground personhood and include nonhuman animals. (shrink)

This paper demonstrates the central role of the Socratic elenchus in the Sophist. In the first part, I defend the position that the Stranger describes the Socratic elenchus in the sixth division of the Sophist. In the second part, I show that the Socratic elenchus is actually used when the Stranger scrutinizes the accounts of being put forward by his predecessors. In the final part, I explain the function of the Socratic elenchus in the argument of the dialogue. By contrast (...) with standard scholarly interpretations, this way of reading the text provides all the puzzles about being (241c4–251a4) with a definite function in the dialogue. It also reveals that Plato’s methodology includes a plurality of method and is more continuous than what is often believed. (shrink)

Most physics theories are deterministic, with the notable exception of quantum mechanics which, however, comes plagued by the so-called measurement problem. This state of affairs might well be due to the inability of standard mathematics to “speak” of indeterminism, its inability to present us a worldview in which new information is created as time passes. In such a case, scientific determinism would only be an illusion due to the timeless mathematical language scientists use. To investigate this possibility it is necessary (...) to develop an alternative mathematical language that is both powerful enough to allow scientists to compute predictions and compatible with indeterminism and the passage of time. We suggest that intuitionistic mathematics provides such a language and we illustrate it in simple terms. (shrink)

In the biomedical context, policy makers face a large amount of potentially discordant evidence from different sources. This prompts the question of how this evidence should be aggregated in the interests of best-informed policy recommendations. The starting point of our discussion is Hunter and Williams’ recent work on an automated aggregation method for medical evidence. Our negative claim is that it is far from clear what the relevant criteria for evaluating an evidence aggregator of this sort are. What is the (...) appropriate balance between explicitly coded algorithms and implicit reasoning involved, for instance, in the packaging of input evidence? In short: What is the optimal degree of ‘automation’? On the positive side: We propose the ability to perform an adequate robustness analysis as the focal criterion, primarily because it directs efforts to what is most important, namely, the structure of the algorithm and the appropriate extent of automation. Moreover, where there are resource constraints on the aggregation process, one must also consider what balance between volume of evidence and accuracy in the treatment of individual evidence best facilitates inference. There is no prerogative to aggregate the total evidence available if this would in fact reduce overall accuracy. (shrink)

Is suffering really bad? The late Derek Parfit argued that we all have reasons to want to avoid future agony and that suffering is in itself bad both for the one who suffers and impersonally. Nietzsche denied that suffering was intrinsically bad and that its value could even be impersonal. This paper has two aims. It argues against what I call ‘Realism about the Value of Suffering’ by drawing from a broadly Nietzschean debunking of our evaluative attitudes, showing that a (...) recently influential response to the debunking challenge (the appeal to phenomenal introspection) fails. It also argues that a Nietzschean approach is well suited to support the challenge and is bolstered by the empirical literature. As strangers to ourselves, we cannot know whether suffering is really intrinsically bad for us. (shrink)

A constitutive theory of representation must address two challenges. The content determination challenge requires specifying why a particular state has a given content. The job description challenge requires spelling out the explanatory role that representational notions play in that theory. Recently, Nicholas Shea has advanced *varitel semantics* as a hybrid approach to representation to answer those challenges, supplementing teleosemantics with non-historical features –namely, exploitable relations and robustness. In this paper, I critically assess the hybrid theory’s answers to both challenges, arguing (...) that their hybrid nature undermines their merits. In each case, I will show that it is hard to establish how the alleged complementariness of the hybrid account components works. I will conclude that internal problems beset Shea’s theory of representation. (shrink)

It is usual to identify initial conditions of classical dynamical systems with mathematical real numbers. However, almost all real numbers contain an infinite amount of information. I argue that a finite volume of space can’t contain more than a finite amount of information, hence that the mathematical real numbers are not physically relevant. Moreover, a better terminology for the so-called real numbers is “random numbers”, as their series of bits are truly random. I propose an alternative classical mechanics, which is (...) empirically equivalent to classical mechanics, but uses only finite-information numbers. This alternative classical mechanics is non-deterministic, despite the use of deterministic equations, in a way similar to quantum theory. Interestingly, both alternative classical mechanics and quantum theories can be supplemented by additional variables in such a way that the supplemented theory is deterministic. It is said that society is in a moral crisis. And, what is worse, it seems to be deteriorating at an ever increasing rate. We all agree that something needs to be done. Our politicians and preachers say we need to help each other more, we need to have "family values", we need to contribute to society and we need to have high moral standards. This article explores the phenomenology of time and eschatology in the thought of Jean-Yves Lacoste, including his recent book on the philosophy of history. Lacoste’s idea of “the hidden present” is examined within the context of his broader theological and philosophical framework, with a particular focus on the way it addresses the intersection of temporality and eternity. Human temporality is characterized by finitude and death, which are interpreted both philosophically—under the influence of Heidegger’s philosophy—and theologically. Using Husserlian and Heideggerian concepts, (...) Lacoste proposes a theologically inspired conceptual network: phenomenological reduction versus theological reduction, world versus creation, death versus resurrection, care (Sorge) versus eschatological restlessness, and time versus eschaton. All of these describe the liturgical experience of man before God and the possibility of an eternity which, from the point of view of the world and of our experience in the world, can only take on the ever-provisional figure of anticipation. The present article argues for the existence of a theological paradox of eschatology in the writings of the French phenomenologist: even if eschatology is only anticipated, the liturgical man, situated before God (coram Deo), experiences it in an incomplete and apophatic manner. The claim that the observation of a violation of a Bell inequality leads to an alleged alternative between nonlocality and non-realism is annoying because of the vagueness of the second term.

There is some cost to you in voting. While it may be small for some, it is significant for others. Some people go to a great deal of effort just to vote. What return do they get for this effort? Zilch! A single vote can only impact an election when there is a tie, which has essentially zero chance of happening in a state or national election. It’s constitutive of classical theism that there is a necessarily existent personal god who is also the creator of the universe, where the latter claim includes at least the following three theses: (i) God is wholly distinct from the natural world; (ii) God is the originating or sustaining cause of the natural world; and (iii) God created the natural world ex nihilo, i.e., without the use of pre-existing materials. Call this tripartite component of classical theism the classical view of creation. (...) In this paper, I offer a new argument against classical theism. In particular, I argue that creation ex nihilo is prima facie impossible, and that since the doctrine of creation ex nihilo is constitutive of classical theism, classical theism is false. (shrink)

Lo anterior, de una u otra manera ha dificultado el conocimiento objetivo de su obra. Es por (...) este motivo, que en este breve trabajo, me propongo presentar en forma esquemática una apostilla sobre su vida y su obra —y no una biografía completa—, que nos permita sentar las bases histórico-filosóficas para una primera aproximación a algunas de sus preocupaciones filosóficas. [EN] Nicolai Hartmann is one of the most significant philosophers in contemporary philosophy; however, today is little known by our philosophical world, possibly because the splendor of his philosophy coincided with the nascent linguistic turn and the heyday of existentialism, which, as is known, absorbed much of the attention and philosophical work of the time. This, in one way or another has hindered the objective knowledge of his work. It is for this reason that in this short paper, I intend to present in schematic form a commentary on his life and his work —and not a full biography—, that allows us to lay the historical and philosophical foundations for a first approach to some of its philosophical concerns. A key premise of the kalam cosmological argument is that the universe began to exist. However, while a number of philosophers have offered powerful criticisms of William Lane Craig’s defense of the premise, J.P. Moreland has also offered a number of unique arguments in support of it, and to date, little attention has been paid to these in the literature. In this paper, I attempt to go some way toward redressing this matter. The picture of moral development defended by followers of Aristotle takes moral cultivation to be like playing a harp; one gets to be good by actually spending time playing a real instrument. On this view, we cultivate a virtue by doing the actions associated with that virtue. I argue that this picture is inadequate and must be supplemented by imaginative techniques. One can, and sometimes must, cultivate virtue without actually performing the associated actions. Drawing on strands in Buddhist philosophy, I (...) explain several methods of moral development that rely on imagination and visualization rather than overt action. These techniques are essential in cases where cultivating virtue the way one practices the harp is impossible. In particular, I focus on single-event virtues, first-time virtuous acts, and morally dangerous situations. (shrink)

Scholarly dissatisfaction with Aristotle’s fallacy of accident has traditionally focused on his examples, whose compatibility with the fallacy’s definition has been doubted time and again. Besides a unified account of the fallacy of accident itself, the paper provides a formalized analysis of its several examples in Aristotle’s Sophistici elenchi. The most problematic instances are dealt with by means of an internal reconstruction of their features as conveyed by Aristotle’s text and an extensive survey of their interpretation in the Byzantine and (...) Latin exegetical tradition. Carefully handled a doxographical approach, as opposed to rapid results oriented practices, proves to be most effective in that it supplies both useful albeit ordinarily overlooked insights and a comprehensive framework of reference for further investigations. The method of the transcendental reduction, which takes place as a return revealing the subjectivity to itself, makes possible to grasp the link connecting the worldly reality and the egological dimension, i.e. the world’s becoming in the ways of the originally subjective constitution. The legitimate aim of the psychological experience to understand the basic structures of the life-consciousness can find in the conceptual figure of the phenomenological reduction both a valid methodological approach and a useful terms of comparison.

The paper aims at analyzing the inner development of self-identity from its pre-reflective level to the full awareness one. The recent findings of neurosciences and cognitive studies suggest focusing attention on the complex relation between self as consciousness and self as subjectivity, both with regard to their interdependency and to their reference to a shared context. Phenomenology, thanks to the careful consideration of the issues regarding the constitution of mental life articulated by its classic researches and current inquires, offers a (...) valuable opportunity to set the scientific outcomes in an authentically philosophical perspective. Beall and Restall 2000; 2001; 2006 advocate a comprehensive pluralist approach to logic, which they call Logical Pluralism, according to which there is not one true logic but many equally acceptable logical systems. They maintain that Logical Pluralism is compatible with monism about metaphysical modality, according to which there is just one correct logic of metaphysical modality. Wyatt 2004 contends that Logical Pluralism is incompatible with monism about metaphysical modality. We first suggest that if Wyatt were right, Logical Pluralism would (...) be strongly implausible because it would get upside down a dependence relation that holds between metaphysics and logic of modality. In this brief introduction, I shall rather reflect, from a biographer’s viewpoint, on the significance of Discretion for our understanding of the trajectory of Hart’s ideas and on the significance of his year at Harvard. I shall then move on to consider the intriguing question of why Hart did not subsequently publish or build on some of the key insights in the paper itself. Here I highlight the fact that, almost uniquely in Hart’s work, Discretion features a notable emphasis on (...) the significance of institutional factors in our understanding of the nature of legal decisionmaking; and I argue that Hart’s failure fully to develop this insight in the essay, or to build on it in his subsequent work, derives from the fact that such a development would have necessitated a diversion from the philosophical issues that were his core intellectual concern, and moreover would have presented certain dangers to his conception of legal positivism. I shall conclude by considering what contribution the essay makes to our overall interpretation and evaluation of Hart’s legal philosophy. (shrink)

What does it mean to say that some features, such as gender, race and sexual orientation, are socially constructed? Many scholars claim that social constructionism about a kind is a version of realism about that kind, according to which the corresponding kind is a social construction, that it, it is constituted by social factors and practices. Social constructionism, then, is a version of realism about a kind that asserts that the kind is real, and puts forward a particular view about (...) the nature of the kind, namely, that it is constituted by social factors and practices. Social constructivists about human kinds such as gender, race and sexual orientation often make an additional claim, namely, that these kinds are social constructions but they are typically believed to be biological kinds (that is, people are typically wrong about the nature of these kinds). Ron Mallon (2017) calls social constructions that are (falsely) taken to be biological kinds covert social constructions. This paper is about how we could have terms in our natural language that come to refer to covert social constructions. (shrink)

Reflection on the nature and value of fiction has often paid attention to the possibility of acquiring knowledge through engaging with fictional works. The alleged imaginative character of fiction appreciation and the sort of emotional responses that fiction is able to prompt in the viewer have been frequently invoked in order to explain the peculiar cognitive value that fictions may possess. In this paper, I would like to question whether fiction as such possesses a specific kind of value. Although I (...) agree that fictional works can convey certain kinds of knowledge, I think that the cognitive virtues that we attribute to fictional works do not have much to do with their fictional character as such. Rather, these values are grounded upon the various properties that the different representational artifacts that can serve to produce fictional works possess. Thus while I think fictional works can deliver various sorts of cognitive value, this value is not intrinsically connected with the fictional nature of these works. (shrink)

We propose a novel ontological analysis of relations and relationships based on a re-visitation of a classic problem in the practice of knowledge repre- sentation and conceptual modeling, namely relationship reification. Our idea is that a relation holds in virtue of a relationship's existence. Relationships are therefore truthmakers of relations. In this paper we present a general theory or reification and truthmaking, and discuss the interplay between events and rela- tionships, suggesting that relationships are the focus of events, which emerge (...) from the context (the scene) they occur in. The prologue of the Sophistici elenchi is as close an Aristotelian text gets to dealing with language as a subject matter in its own right, only in reverse. Language and its features bear consideration to the extent that they account for some major predicaments discursive reasoning is prone to, both as a separate and as a common endeavour. That being said, the linguistic pitfalls that trick us into thinking that whatever is the case for words and word-compounds is also the (...) case for the things and facts linguistic items stand for reveal as much about good linguistic habits and sound argumentation as they themselves are revealed by the principles and rules our argumentation goes by. In this connection, Aristotle resorted to a curious (or not so curious) analogy between words and counters which played a major role in explaining why language is such a powerful source of illusion and deception. As it happens, Aristotle accounting analogy is a case in point for showcasing the level of sophistication medieval Latin literature on fallacies achieved as early as the first half of the twelfth century. As a matter of fact, Western commentators managed to build compelling cases both in favour of and against the understanding that was to become and still is the standard story – which, of course, speaks volumes about their exegetical proficiency and technical expertise. On the one hand, trusting implicitly Boethius’ translation and well aware of his views on disputational hazards as opposed to computational reliability, they usually understood Aristotle’s comparison as if it was an analogy in name only. On the other hand, despite Boethius’ translation put them at a considerable disadvantage, Latin commentators were able to construe Aristotle’s analogy as bringing together two sets of symbolic variables (words and counters) that are neither entirely free nor entirely bound – which expose them to subtle but critical shifts in value and meaning. In a number of papers, Kit Fine introduced a theory of embodiment which distinguishes between rigid and variable embodiments, and has been successfully applied to clarify the ontological nature of entities whose parts may or may not vary in time. In particular, he has applied this theory to describe a process such as the erosion of a cliff, which would be a variable embodiment whose manifestations are the different states of erosion of the cliff. We find this theory very powerful, (...) and especially appropriate to capture the intuition that the same process may go on at different times. However, its formal principles have been subject to some criticisms, mainly concerning the mereological structure of a variable embodiment. Moreover, since the notion of variable embodiment is very general, simply saying that processes are variable embodiments is not enough to understand their ontological nature. To address these concerns, in this paper we proceed in two phases: first, we propose a revised version of Fine’s original theory adapted to the case of processes, which adopts a classical mereology instead of Fine’s hylomorphic mereology, and a temporalized constitution relation in place of Fine’s function of variable embodiment; second, we go deeper into the ontological nature of processes by revisiting the notions of homogeneity, intentionality, and telicity discussed in the literature, and propose an account based on ontological principles and not on semantic properties of predicates. This allows us to organize processes into a novel taxonomy based exclusively on their unity and individuation principles. (shrink)

El presenta trabajo describe y caracteriza de manera breve y concisa lo que podría ser una ontología del arte. En la primera sección se presentan las dificultades actuales, así como las nociones y preguntas principales de la ontología. En la sección segunda, se bosquejan las definiciones y caracterizaciones actuales de la ontología, se hace especial hincapié, en la ontología aplicada. En la tercera, cuarta y quinta sección se caracteriza y configura lo que podría ser una ontología del arte, se evidencian (...) sus limitaciones así́ como sus perspectivas y trazabilidad para hacer viable dicha ontología; adicionalmente se abordan los aportes del realismo anglosajón a la cuestión. El propósito de esta caracterización es hacer evidente que es plausible dar un tratamiento integral al problema de la realidad y su configuración y desarrollo en los mundos regionales, como, el mundo del arte. Dans On What Matters Parfit défénd un objectivisme moral sur lequel il espère que les philosophes finiront par converger. Au cœur de cet espoir sont des vérités normatives irréductibles telles que l’affirmation que la souffrance est intrinsèquement mauvaise. Parfit se demande si Nietzsche menace son édifice et lui consacre un chapitre entier chapeautant la discussion du désaccord moral et de la convergence, et conclut que Nietzsche soit n’est pas en vrai désaccord, soit ne raisonne pas dans des conditions satisfaisantes. Je (...) mets ici à l’épreuve la prédiction de convergence de Parfit et montre que Nietzsche pose une menace encore plus sérieuse que ne le prétend Parfit. Je montre que l’idée que la souffrance peut être bonne est intelligible, cohérente et plus complexe que la lecture de Parfit ne le révèle. (shrink)

In this article we examine the role of Entscheider (decision-makers) in the German asylum procedure, both legally and ethical. As the responsibility for deciding on asylum applications lies exclusively with them, their significance for the German asylum procedure can hardly be underestimated. However, over the last few decades the situation of Entscheider changed significantly: While the number and complexity of the cases they have to decide on has increased due to the growing immigration, the requirements for their education have been (...) lowered, owed to critical amendments to the relevant law. We analyze how the law currently defines the role of Entscheider, whether the legal framework is constitutional, and what modifications morality requires. Although the law defining their role seems to be constitutional, Entscheider’s education must be improved and they must be entrusted with the hearing of the applicants to meet what morality requires, we conclude. Y a-t-il des Idées et peut-on démontrer qu’elles existent ? Parmi les protagonistes anciens de la controverse qui a opposé partisans et adversaires des Idées, Aristote mérite une attention toute particulière. De fait, si – au moment où Aristote intervient dans le débat autour de l’hypothèse des Idées – ce débat a déjà une histoire, c’est avec lui que cette histoire atteint une maturité qui est à la fois d’ordre doctrinal et doxographique. De fait, non seulement Aristote est le premier (...) à avoir défini certaines au moins des propriétés de ce qui est et se dit en commun de plusieurs, mais encore a-t-il pris soin d’inscrire ces définitions dans la continuité de l’héritage socratique dont il s’est explicitement revendiqué tout en dénonçant sa dérive aux mains des successeurs de Socrate. L’objectif principal du cycle de conférences a été d’étudier les objections qu’Aristote a formulées à l’encontre des partisans des Idées en prenant comme fil conducteur la notion de substance que sa discussion des Formes platoniciennes tantôt présuppose, tantôt mobilise explicitement. Pour ce faire, nous avons procédé à une lecture détaillée d’un certain nombre de documents, tirés aussi bien de ses écrits d’école que des vestiges de ses traités perdus, où Aristote rejette la notion d’un universel substantiel (autant dire, en l’occurrence, séparé) et s’efforce de mettre à mal les arguments que ses partisans avançaient pour prouver son existence.
