Two experiments with undergraduates as subjects were carried out with the aim of replicating and extending previous results showing that the implication of the behavioral life-cycle hypothesis (H. M. Shefrin & R. H. Thaler, 1988) that people classify assets in different mental accounts (current income, current assets, and future income) may explain how consumption choices are influenced by temporary income changes. In both experiments subjects made fictitious choices between paying for a good in cash or according to a more expensive (...) installment plan after they had received an income which was either less, the same, or larger than usual. In Experiment 1 subjects were supposed to have savings so that the total assets were equal, whereas in Experiment 2 the total assets varied. The results of both experiments supported the role of mental accounts in demonstrating that subjects were unwilling to pay in cash after an income decrease even though they had access to saved money. Thus, in effect they chose to pay more for the good than they had to. Indicating a need for further refinement of the concept of mental account, choices to pay in cash after an income decrease tended to be more frequent when the consumption and savings motives were compatible than when they were incompatible. Furthermore, increasing the total assets made subjects more willing to pay in cash after an income decrease. (shrink)

Two experiments with undergraduates as subjects tested explanations of how a prior temporary income change influences choices between buying and deferred buying. In Experiment 1 predictions from the behavioral life-cycle theory (Shefrin & Thaler, 1988), the renewable resources model (Linville & Fischer, 1991) and the loss-sensitivity principle (Garling & Romanus, 1997) were contrasted. The results are inconsistent with the latter two explanations since the framing of buying as positive (buying a new model of a product) or negative (replacing a broken (...) product) did not interact with the income change. Congruent with the behavioral life-cycle theory, willingness to buy was greater when subjects received a temporary income increase than when they received a temporary income decrease although total assets were equal. Further support for the behavioral life-cycle theory is obtained in Experiment 2 where four income-change conditions and durable and nondurable goods are compared. (shrink)

This paper builds on his argumentation, but uses the concept of the Fediverse – a decentralized alternative to closed social media platforms – instead of traditional social media to argue for universal internet access, by this completing (...) his argument and additionally, leading to a Kantian right to Fediverse access and three follow-up questions: What are reasonable ways to achieve universal Fediverse Access? The life-cycle theory of saving behavior (Modigliani, 1988) suggests that humans strive towards an equal intertemporal distribution of wealth. However, behavioral life-cycle theory (Shefrin & Thaler, 1988) proposes that people use self-control heuristics to postpone wealth until later in life. According to this theory, people use a system of cognitive budgeting known as mental accounting. In the present study it was found that mental accounts were used differently depending on if the income change was positive or negative. This was shown (...) both in a representative nationwide sample of households and in a student sample. Respondents were more willing to cut down on their propensity to consume when faced with an income decrease than to raise it when the income increased. Furthermore, contrary to the predictions of behavioral life-cycle theory, it was found that the respondents adjusted their propensity to consume the most when the income increases or decreases took place immediately. Hence, it is suggested that theories of intertemporal choice (e.g., Loewenstein, 1988; Loewenstein & Prelec, 1992) provide a better account of the data than does the behavioral lifecycle theory. Mental accounting is a concept associated with the work of Richard Thaler. According to Thaler, people think of value in relative rather than absolute terms. They derive pleasure not just from an object’s value, but also the quality of the deal – its transaction utility (Thaler, 1985). In addition, humans often fail to fully consider opportunity costs (tradeoffs) and are susceptible to the sunk cost fallacy. Why are people willing to spend more when they pay with a credit card than (...) cash (Prelec & Simester, 2001)? Why would more individuals spend $10 on a theater ticket if they had just lost a $10 bill than if they had to replace a lost ticket worth $10 (Kahneman & Tversky, 1984)? Why are people more likely to spend a small inheritance and invest a large one (Thaler, 1985)? According to the theory of mental accounting, people treat money differently, depending on factors such as the money’s origin and intended use, rather than thinking of it in terms of the “bottom line” as in formal accounting (Thaler, 1999). An important term underlying the theory is fungibility, the fact that all money is interchangable and has no labels. In mental accounting, people treat assets as less fungible than they really are. Even seasoned investors are susceptible to this bias when they view recent gains as disposable “house money” (Thaler & Johnson, 1990) that can be used in high-risk investments. Priority setting in health care is ubiquitous and health authorities are increasingly recognising the need for priority setting guidelines to ensure efficient, fair, and equitable resource allocation. While cost-effectiveness concerns seem to dominate many policies, the tension between utilitarian and deontological concerns is salient to many, and various severity criteria appear to fill this gap. Severity, then, must be subjected to rigorous ethical and philosophical analysis. Here we first give a brief history of the path to today’s severity criteria in (...) Norway and Sweden. The Scandinavian perspective on severity might be conducive to the international discussion, given its long-standing use as a priority setting criterion, despite having reached rather different conclusions so far. We then argue that severity can be viewed as a multidimensional concept, drawing on accounts of need, urgency, fairness, duty to save lives, and human dignity. Such concerns will often be relative to local mores, and the weighting placed on the various dimensions cannot be expected to be fixed. Thirdly, we present what we think are the most pertinent questions to answer about severity in order to facilitate decision making in the coming years of increased scarcity, and to further the understanding of underlying assumptions and values that go into these decisions. We conclude that severity is poorly understood, and that the topic needs substantial further inquiry; thus we hope this article may set a challenging and important research agenda. (shrink)

What is to be learned from the chaotic downfall of the Weimar Republic and the erosion of European liberal statehood in the interwar period vis-a-vis the ongoing European crisis? This book analyses and explains the recurrent emergence of crises in European societies. It asks how previous crises can inform our understanding of the present crisis. The particular perspective advanced is that these crises not only are economic and social crises, but must also be understood as crises of public power, order (...) and authority. In other words, it argues that substantial challenges to the functional and normative setup of democracy and the rule of law were central to the emergence and the unfolding of these crises. The book draws on and adds to the rich ’crises literature’ developed within the critical theory tradition to outline a conceptual framework for understanding what societal crises are. The central idea is that societal crises represent a discrepancy between the unfolding of social processes and the institutional frameworks that have been established to normatively stabilize such processes. The crises at issue emerged in periods characterized by strong social, economic and technological transformations as well as situations of political upheaval. As such, the crises represented moments where the existing functional and normative grid of society, as embodied in notions of public order and authority, were severely challenged and in many instances undermined. Uncertainty, insufficient information or information of poor quality, limited cognitive capacity and time, along with value conflicts and ethical considerations, are all aspects thatmake risk managementand riskcommunication difficult. This paper provides a review of different risk concepts and describes how these influence risk management, communication and planning in relation to forest ecosystem services. Based on the review and results of empirical studies, we suggest that personal assessment of risk is decisive in the management of forest ecosystem services. The results are (...) used together with a reviewof different principles of the distribution of risk to propose an approach to risk communication that is effective aswell as ethically sound. Knowledge of heuristics and mutual information on both beliefs and desires are important in the proposed risk communication approach. Such knowledge provides an opportunity for relevant information exchange, so that gaps in personal knowledge maps can be filled in and effective risk communication can be promoted. (shrink)

O anseio deste artigo acadêmico é introduzir os conceitos gerais da teoria de sistemas de Niklas Luhmann. Para atingir seus objetivos, esta teoria é hermética e filosófica, com uma ampla gama de definições e busca apresentar um conjunto de conceitos que proporcionem um suporte adequado para a sociedade como um todo. Luhmann abordou a questão da complexidade em vários estudos e desenvolveu uma metodologia baseada em uma noção de sistemas autopoiéticos, funcionalmente fechados e distintos. A observação de segunda ordem (...) é um dos conceitos centrais da teoria de sistemas de Luhmann, assim como a comunicação é elemento importante na formação dos sistemas sociais e na sua distinção de outros sistemas existentes. Eva Erman and Niklas Möller have recently presented a trenchant critique of my (2015) argument that ideal normative theories are uninformative for certain practical purposes. Their criticisms are largely correct. In this note, I develop the ideas behind my earlier argument in a way that circumvents their critique and explains more clearly why ideal theory is uninformative for certain purposes while leaving open the possibility that it might be informative for other purposes.

In 1985, German sociologist Niklas Luhmann published a monograph on ecology, which appeared in English translation in 1989 as Ecological Communication. It contained many original insights for ecological thinking and, despite being well-reviewed upon publication, has had a relatively minor impact on Anglophone environmental discourse. This inattention is also present in environmental law, which has recently seen an increase in legal theories that challenge its mainstream. This contribution first investigates why Ecological Communication has received scant attention, pointing to changes (...) in the climatic context in which it first appeared and the reactionary nature of its arguments. Recognising that the work nevertheless contains critical theoretical insights for environmental law scholarship, the second aim of the article is to spotlight what from Ecological Communication remains relevant at the hand of three common claims progressive researchers level against mainstream environmental law: The critique of law's marriage to Cartesian dualism, that law should be better informed by climate science,of and law's anthropocentrism. Finally, environmental lawyers are called upon not to ignore Ecological Communication but to engage with it fruitfully. (shrink)

The article aims at contrasting the autopoietic understanding of an individual and her or his actions as described by Niklas Luhmann with Paul Ricoeur’s notion of narrative identity, focusing on people as legal subjects. The article assumes that when legal subjects necessitate ethical engagement and evaluation, the law could cease to deal with problems in a mere legalistic fashion but is allowed the freedom to appeal to norms of justice external to itself as in other natural law theories. Usually regarded as a 1970s phenomenon, this article demonstrates that the debate between Jürgen Habermas and Niklas Luhmann continued until Luhmann’s death in 1998, and that the development of the two theorists’ positions during the 1980s and 1990s was characterised by convergence rather than by divergence. In the realm of legal theory, the article suggests, convergence advanced to the extent that Habermas’ discourse theory may be characterised as a normative superstructure to Luhmann’s descriptive theory of society. It is further (...) shown that the debate’s result was an almost complete absorption of Habermas’ theory by Luhmann’s systems theoretical complex – an outcome facilitated by Luhmann’s deliberate translation of central Habermasian concepts into systems theoretical concepts. The article argues that both the debate and Habermas’ conversion were made possible because not only Habermas’ but also Luhmann’s work can be considered a further development of the German idealist tradition. What Luhmann did not acknowledge was that this manoeuvre permitted the achievement of Habermas’ normative objectives; nor did he notice that it could eradicate a central flaw in the system theoretical construction, by allowing the context within which distinctions are drawn to be mapped – an issue of pivotal importance for grasping relationships between different social systems, and coordinating them, via the deployment of legal instruments. This book is a PhD dissertation and a very personal book at the same time. It asks the question whether society can and should be a point of orientation ("Bezugspunkt") for the human individual. Please note, that this cannot be a scientific book: If sociology is defined as society observed by society (or by sociologists, who are the agents of society), society observed by a single person (and for the aim of this single person) cannot be scientific. This is also (...) true if the researcher adheres to reason and scientific methodology: observations and understanding created by the human individual for its own private purposes simply are not scientific because they lack universality. "Bezugspunkt Gesellschaft" studies a number of different strains of sociology (and their scientific representatives, e.g. Pierre Bourdieu, Niklas Luhmann, Ralf Dahrendorf, Norbert Elias, Berger/Luckmann) in order to find out what it is that sociology studies? Is sociology the study of a society of human beings? Or is it true that society does not consist of human beings, but, as Luhmann claims, of acts of communication? Or is it true, as Bourdieu claims, that society consists of the instances of freedom abandoned half willingly, half out of habitude, by human individuals like in the case of a coffeehouse waiter who over time has just given up the idea that he could be anything else than a coffeehouse waiter. This book was inspired by a deconstructivist method of analysis in the field of literary theory where researchers state that it is of no interest what the author of a book wanted to say. Instead we should treat the work of literature as if the society of the author's epoch had written it. This theoretical "murder" of the human being in the form of the authors of works of literature in literary theory might have its analogy in sociology: Maybe sociology is also, like literary theory, not about people? However, if sociology is not about people - what can sociology teach us, us people? The book looks at different concepts of society throughout history, starting from the ancient concept that society is community, or that it is a circle of friendships, to more modern and dystopian concepts like that society is some kind of unhuman society. The book ends with the "Balzac machine", representing the incredibly talented and prolific French author Honoré de Balzac as a person who was an expert in the study of society and entirely blind to the phenomenon of society at the same time. The paradox of Balzac manifested itself in the fact that he literally worked himself to death in an attempt to gain society's recognition. (shrink)

The double subjectivity of conscience and the need to test conscientious objections -/- Abstract In spite of the collapse of the traditional objective concept of conscience and the subsequent subjectivation of conscience, conscientious objections are still often considered as a valid ground for exemption from legal and professional obligations. Conscientious objections are seen as more serious than ordinary moral objections. It is not evident why this is so. I argue, with Niklas Luhmann, that the function of conscience is to (...) protect the moral core of a person’s identity. Overruling conscientious objections threatens this core. Claims of conscience are usually founded on the right of freedom of conscience. This right is not absolute. I discuss the view of Richard Arneson who rejects the right of freedom of conscience and defends the right against conscience. I agree with Arneson that, at the one hand, conscientious objectors may constitute a threat to the social and legal order when their objections are not recognised and, at the other hand, too easy giving in to conscientious objections may also threaten the viability of social and legal order. That is why it is needed to determine when conscientious objections cannot be taken at face value, but should be subjected to a series of tests. The aim of these tests is to contain the number of objectors. I discuss 6 criteria for determining whether conscientious objections ground an exemption to legal and professional obligations. At the end of the article I discuss the conscientious objections of medical doctors. (shrink)

¿Què se avizora para el ser humano cuando se piensa en un tema tan existencial como lo es el de sus derechos? ¿Predomina la incertidumbre, la desazòn, los diagnòsticos interminables sobre los males por los cuales la especie humana agonizarà inexorablemente? ¿O por el contrario, se vislumbra con optimismo un futuro de posibilidades siempre abiertas? La cuestiòn de los derechos humanos remite a reflexiones muy profundas en torno a la Identidad y a la Alteridad. Ambas nociones aparecen como supuestos implicitos (...) o explicitos en las diversas estrategias empleadas para el abordaje de un tema tan complejo. El fondo cultural desde el que emergen acompaña las perspectivas teòricas de interpretaciòn y las politicas que las ponen en pràctica. En ambos planos surge con frecuencia la palabra tolerancia aunque en occasiones es utilizada con un significado muy ambiguo. La tolerancia requiere de seres razonables para alcanzar sociedades autènticamente democràticas. La razonabilidad a su vez se logra en la medida en que se estimule el desarrollo del pensamento critico. En este contexto, los aportes de la epistemologia de la complejidad de Edgar Morin, (la cual surgiò como alternativa frente a las epistemologias cerradas), posee una especial relevancia para la reflexiòn de los derechos humanos en el contexto històrico-cultural latinoamericano. En esa misma linea se ubica la teoria general de los sistemas sociales de Niklas Luhmann y las reflexiones sobre la identidad del sociòlogo polaco Zygmunt Baumann. En esta ponencia se busca mostrar la estrecha interrelaciòn entre esos autores con respecto al modo de interpretar la identidad y la alteridad, bases ineludibles para la construcciòn del respeto por los derechos del otro en cuanto tal. Can transformative law become an ambitious program for rethinking the theoretical basis for our understanding of law and its position in society? A program which explicitly goes beyond emotion and ideology. One way of dealing with both emotion and the devotion to ideology is, as also argued by Karl Mannheim back in 1926, to deploy an analytical lens, i.e. to substitute emotion and ideology with sophisticated theorizing. A form of theorizing which only is possible if deployed while maintaining proper analytical (...) distance to the object matter. On this background one might distinguish between three models of transformative law: Instrumentalization, Political Programming or Normative Selection, with the latter providing a third way between the two hitherto dominant approaches. Habituellement considéré comme un phénomène des années 1970, le débat entre Jürgen Habermas et Niklas Luhmann s’est en réalité poursuivi jusqu’à la mort de Luhmann, en 1998 ; et l’évolution des positions des deux théoriciens au cours des années 1980 et 1990 s’est caractérisée par une convergence, plutôt que par une divergence. Dans le domaine de la théorie du droit, suggère cet article, la convergence a progressé dans la mesure où la théorie de la discussion (Diskursetheorie) d’Habermas peut se (...) caractériser comme une superstructure normative au regard de la théorie descriptive de la société formulée par Luhmann. De plus, le résultat du débat a été une absorption presque complète de la théorie habermassienne par le complexe de la théorie des systèmes de Luhmann – issue facilitée par le fait que ce dernier a délibérément traduit les concepts habermassiens centraux dans les concepts de la théorie des systèmes. Le débat et la conversion d’Habermas ont été possibles parce que le travail de celui-ci mais aussi celui de Luhmann peuvent être considérés comme un fruit de la tradition idéaliste allemande. Luhmann n’a pas vu que cette manœuvre permettait la réalisation des objectifs normatifs d’Habermas ; pas plus qu’il n’a perçu qu’il pouvait éradiquer une faille centrale de la construction de la théorie des systèmes en permettant de cartographier le contexte dans lequel les distinctions sont tracées – problème d’importance cruciale pour saisir les relations entre les différents systèmes sociaux et les coordonner via le déploiement d’instruments juridiques. The following article was written to honour Johan Buitendag’s contribution to the discipline of eco-theology. Assuming an interdisciplinary stance, eco-theology in general and his work, in particular, is observed from the position of legal theory and sociology. As such, eco-theology is not assessed on theological grounds but is treated interdisciplinary through comparison with environmental law. More specifically, the project of eco-theology is shown to share certain characteristics with the nascent subdiscipline of Earth systems law within environmental law. It is argued (...) that one of the most important of these is the use of norms as an ecological strategy. This is understandable as both the religious and legal systems rely on the norm form to a lesser or greater extent. However, in the legal sociology of systems theory, the shortcomings of norms have been eloquently argued. This article thus posits the limits of norms to eco-theology and Earth systems law as a challenge deserving attention. However, social systems theory has its shortcomings, and a preliminary line of flight away from this challenge is suggested in the shape of Agamben’s description of the monastic form-of-life, where life and norm overlap so intensely that suggestions of a new worldview gain plausibility. As questões sociais, que até então podiam estar localizadas em países ou em blocos de países, também se tornaram mundializadas, e vários pensadores passaram a refletir sobre temas chamados de pós-modernos, hipermodernos ou simplesmente contemporâneos, e que afetam um país, uma região ou todo o mundo. A Sociologia contemporânea, porém, mantém uma relação significativa com as grandes vertentes da Sociologia anterior: • a marxista ou histórico-estrutural, com suas variações; • a durkheimiana ou funcionalista, com o desenvolvimento de um neofuncionalismo; • a weberiana ou compreensiva, com o desenvolvimento da fenomenologia e da hermenêutica; • a teórica e pragmática estadunidense, com variadas linhas. Além dessas vertentes, pensadores como Jean-Gabriel de Tarde e Georg Simmel, que estavam um tanto esquecidos, pelo menos no Brasil, em razão da ênfase em Émile Durkheim, num caso, e em Max Weber, em outro, retomaram seus lugares de destaque. Essas vertentes inspiraram outros tantos pensadores, que – refletindo sobre a realidade em que vivem, mesclando ou não contribuições de diferentes linhas teóricas e formulando uma série de conceitos – demonstram as possibilidades e a diversidade do pensamento sociológico e fazem a Sociologia avançar muito no processo de compreensão da realidade contemporânea. A combinação de diversas vertentes teóricas torna difícil fazer qualquer enquadramento ou mesmo tentar classificar determinados autores. Muitos analistas veem nisso uma crise de paradigmas na Sociologia contemporânea. Essa “crise” poderia ser entendida do ponto de vista epistemológico; entretanto, sempre houve diversidade de epistemologias na Sociologia. Global law settings are characterized by a structural pre-eminence of connectivity norms, a type of norm which differs from coherency or possibility norms. The centrality of connectivity norms emerges from the function of global law, which is to increase the probability of transfers of condensed social components, such as economic capital and products, religious doctrines, and scientific knowledge, from one legally structured context to another within world society. This was the case from colonialism and colonial law to contemporary global supply (...) chains and human rights. Both colonial law and human rights can be understood as serving a constitutionalizing function aimed at stabiliz- ing and facilitating connectivity. This allows for an understanding of colonialism and contemporary global governance as functional, but not as normative, equivalents. (shrink)

Does Normative Behaviourism Offer an Alternative Methodology in Political Theory?

The task of visual search is to determine as rapidly as possible whether a target item is present or absent in a display. Rapidly detected items are thought to contain features that correspond to primitive elements in the human visual system. In previous theories, it has been assumed that visual search is based on simple two-dimensional features in the image. However, visual search also has access to another level of representation, one that describes properties in the corresponding three-dimensional scene. Among (...) these properties are three dimensionality and the direction of lighting, but not viewing direction. These findings imply that the parallel processes of early vision are much more sophisticated than previously assumed. (shrink)

He argues that this view has all of the strengths of deflationism, while also providing an elegant resolution of the Liar Paradox and its kin. For the (...) alethic nihilist, Liar and related sentences are not true, and that is the end of the story. No contradiction arises because it does not thereby follow that any of these sentences are also true, since nothing is. Gamester concludes that the simplicity of this response to the semantic paradoxes makes alethic nihilism an attractive approach. We disagree. In addition to providing insurmountable obstacles for his form of alethic nihilism, we contend that a certain form of non-nihilist deflationism is better placed to deal with the paradoxes and to account for truth-talk more generally. Driven by technological innovations, newborn screening (NBS) panels have been expanded and the development of genomic NBS pilot programs is rapidly progressing. Decisions on disease selection for NBS are still based on the Wilson and Jungner (WJ) criteria published in 1968. Despite this uniform reference, interpretation of the WJ criteria and actual disease selection for NBS programs are highly variable. A systematic literature search [PubMED search “Wilson” AND “Jungner”; last search 16.07.22] was performed to evaluate the applicability of the WJ (...) criteria for current and future NBS programs and the need for adaptation. By at least two reviewers, 105 publications (systematic literature search, N = 77; manual search, N = 28) were screened for relevant content and, finally, 38 publications were evaluated. Limited by the study design of qualitative text analysis, no statistical evaluation was performed, but a structured collection of reported aspects of criticism and proposed improvements was instead collated. This revealed a set of general limitations of the WJ criteria, such as imprecise terminology, lack of measurability and objectivity, missing pediatric focus, and absent guidance on program management. Furthermore, it unraveled specific aspects of criticism on clinical, diagnostic, therapeutic, and economical aspects. A major obstacle was found to be the incompletely understood natural history and phenotypic diversity of rare diseases prior to NBS implementation, resulting in uncertainty about case definition, risk stratification, and indications for treatment. This gap could be closed through the systematic collection and evaluation of real-world evidence on the quality, safety, and (cost-)effectiveness of NBS, as well as the long-term benefits experienced by screened individuals. An integrated NBS public health program that is designed to continuously learn would fulfil these requirements, and a multi-dimensional framework for future NBS programs integrating medical, ethical, legal, and societal perspectives is overdue. The article offers a reconstruction of John Rawls views on political legitimacy, from A Theory of Justice to his late writings on political liberalism. It argues that Rawls had three conceptions of legitimacy, not two as one might expect based on the distinction between his two major works. Its argument is that the most radical change in Rawls’ thinking about legitimacy occurs in ‘Introduction to the Paperback Edition’ and ‘The Idea of Public Reason Revisited’. Here Rawls assumes that there can (...) be a reasonable pluralism not only of comprehensive doctrines, but also of political liberal conceptions of justice. As a consequence, the standard of political legitimacy is no longer specified as sufficient justice relative to justice as fairness, but instead as sufficient justice relative to a family of political conceptions of justice – a family which in turn is animated by an ideal of public reasoning about constitutional matters and matters of basic justice. The article also shows how Rawls’ late ideal of public reason is grounded in the need for legitimate constitutional government. (shrink)

We address a long-standing debate over whether classical magnetic forces can do work, ultimately answering the question in the affirmative. In detail, we couple a classical particle with intrinsic spin and elementary dipole moments to the electromagnetic field, derive the appropriate generalization of the Lorentz force law, show that the particle's dipole moments must be collinear with its spin axis, and argue that the magnetic field does mechanical work on the particle's elementary magnetic dipole moment. As consistency checks, we calculate (...) the overall system's energy-momentum and angular momentum, and show that their local conservation equations lead to the same force law and therefore the same conclusions about magnetic forces and work. We also compute the system's Belinfante-Rosenfeld energy-momentum tensor. (shrink)

This essay clarifies and defends the methodological multidimensionality and improvisational character of Clifford Geertz’s account of interpretation and explanation. In contrast to accounts of power analysis offered by Michel Foucault and Talal Asad, I argue that Geertz’s work can simultaneously attend to meaning, power, identity, and experience in understanding and assessing religious practices and cultural formations.

This study examined students’ perception of rape and sexual violence and methods of prevention in tertiary institutions in Lagos State. It was a cross-sectional study carried out among one thousand, two hundred and eleven (1,211) female undergraduates selected from two tertiary institutions in Lagos State. The sample size for the study was one hundred and twenty-one (121) representing 10% of the population. Inferential statistics was used for analysis. The results revealed that majority of the students are aware of the different (...) types of rape but did not consider forced sexual intercourse between spouses as rape. The students have a good knowledge of rape and sexual violence. The students perceive that rape can have detrimental effects on the victims’ mental, physical and reproductive health. Avoiding late nights, dressing decently, increasing the presence of security officers at strategic places on campus and the likes were identified ways of preventing rape in tertiary institutions. Among the recommendations proffered are that students should review their dressing styles to conform to the morals of the society to prevent the occurrence of rape. (shrink)

This study explores the employee retention strategies implemented by administrators in educational institutions, focusing on Immaculate Conception College of Balayan, Inc. The qualitative case study involved 10 participants, including administrators and employees selected based on stable tenure and appropriate qualifications. Through face- to-face interviews, key determinants influencing retention, such as teacher satisfaction, job contentment, professional growth, and loyalty, were identified. Recognition and incentives emerged as the primary retention strategy, significantly influencing employee satisfaction and fostering a sense of belonging. The study (...) concludes that these strategies are effective, contributing to the retention of skilled professionals. Recommendations emphasize the importance of recognizing and providing incentives as core strategies for administrators in educational settings, recognizing their role in creating a positive work environment and promoting sustained employee commitment. The findings at ICCBI underscore the observed effectiveness of these strategies. (shrink)

Summary: In this paper author maintains that the term “ideal border” used by Roman Ingarden several times in his writing on music perception has more to offer than its face value suggests. The term is ambiguous and in its first reading seems to imply that Ingarden's take on musical work is all but coherent. Yet author tries to show that the term itself if taken seriously in its various possible interpretations makes Ingarden's aesthetics of music more interesting and inspiring then (...) ever. The musical work seen as wobbly yet somehow graspable ideal [border] which is at the same time the point of departure and the point of destination for composers, artists and listeners in their respective experiences, makes Ingarden's music aesthetics more accessible and more telling in its attempt to discover the true nature of our aesthetic perception of music. The study aimed to identify the level of business intelligence in its dimensions (data reliability, information technology, competitive intelligence, analytical ability, business management performance, immediate analytical processing) in NGOs in the southern Palestinian governorates. The study used the analytical descriptive approach, and a structured questionnaire was used to collect data. Which contribute to the development of the objectives of the study, and the study population consists of employees in Non-Governmental Organizations in the southern Palestinian governorates, and a random sample was (...) used to collect data from the study community, as the sample reached (184) individuals, and the results of the study showed that the general estimate of business intelligence came with a high level and weight Relative (90.49%), and the arrangement of business intelligence dimensions was as follows: (data reliability, information technology, competitive intelligence, analytical ability, business management performance, and instant analytical processing). The study presented a set of recommendations, the most important of which are: the need for the organization to use modern technological systems to analyze and make its own reports, to work on employing the use of business intelligence techniques in detecting new competitors, and predicting their strategies. The purpose of the article is to solve an important scientific problem – further development of the basics of management decisions on the implementation of export-import activities based on the results of enterprise symptomatic diagnostics in disruption conditions of sustainable development of the world economy. The essence of enterprise symptomatic diagnostics in the context of management activity is specified by the results of the critical analysis of the scientific publications. The study of the features of the symptomatic diagnostics process of (...) enterprise export-import activity might become the basis for the development of a comprehensive approach to its implementation, which reveals the interaction of the theoretical, scientific and methodological basis and the targeted direction of managers` actions in the diagnostics process. Generalization of symptomatic complex of export-import activity of enterprises-manufacturers of BOPP films – Terichem Tervakoski, a.s. and Xpro India Ltd, helped to identify issues that are reducing its performance. A set of measures was explored in order to avoid the negative symptoms of export-import activity of Terichem Tervakoski and Xpro India Ltd. The authors revealed some dependency respecting that the more negative symptoms of export-import activity realization lead to decline the efficiency of its implementation. The results of the study might clarify the impact of symptoms on the results of the enterprise export-import performance. Symptomatic diagnostics of enterprise export-import activity is considered as the basis of a sequence of management measures in order to avoid negative symptoms of export-import activity. (shrink)

This paper refines a number of theoretical distinctions relevant to deceptive play, in particular the difference between merely misleading actions and types of simulation commonly considered beyond the pale, such as diving. To do so, I rely on work in the philosophy of language about conversational convention and implicature, the distinction between lying and misleading, and their relation to concepts of seduction and bullshit. The paper works through a number of possible solutions to the question of what is wrong with (...) simulation and its difference from strategic fouling, including the argument that games and their rules operate like contracts. I conclude that the wrongness lies in the injustice of unfair advantage gained through actions that silence opposition by resort to unanswerable play. (shrink)

:The study aimed to identify the level of enhancing the competitive advantage of training institutions in Palestine. The study used the descriptive analytical approach. A structured questionnaire was used to collect data that contribute to achieving the objectives of the study. The study population consists of workers in training institutions operating in the southern Palestinian governorates. The random sample for data collection, where (90) applicable questionnaires were retrieved. The results of the study showed that the general estimate for the competitive (...) advantage axis came with a high degree and a relative weight (90.67%). The results also showed that there were no statistically significant differences in enhancing the competitive advantage according to the variables (gender, governorate). As well as the existence of statistically significant differences in enhancing the competitive advantage according to the variables (Educational Qualification, Age Group, Number Of Years of Service). The study presented a set of recommendations, the most important of which are: the need for centers to develop their training systems in line with modern technology, in addition to the need for centers to target new areas in their service by opening other branches in diffe rent geographical locations. The study aimed to identify the level of institutional competence in Non-Governmental Organizations in Palestine. The study used the descriptive analytical approach. A structured questionnaire was used to collect data that contribute to achieving the objectives of the study. The study population consists of employees in Non-Governmental Organizations in the southern Palestinian governorates, and a random sample was used. For data collection, (183) applicable questionnaires were retrieved. The results of the study showed that the general assessment of the level of (...) institutional efficiency was high with a relative weight of (91.85%). The results also showed that there were statistically significant differences in achieving institutional efficiency according to the variables (gender, number of years of service), while it was found that there were no statistically significant differences in achieving institutional efficiency. Depending on the variables (educational qualification, age group). The study presented a set of recommendations, the most important of which are: the necessity of providing a budget for training and development, and attracting expertise and specialists in digital transformation to work in organizations. About six weeks ago, our post referred to the long-winding path to a new theoretical innovation as the pursuit of “useless knowledge” in Flexner’s terms. That little creation is the freshly minted informational entropy-based definition of value, presented in a very short paper, initially regarded by its authors as a research note. (And it still is.) Well, only two and a half months since its birth, this new concept of value has had enough time to power up several of our (...) publications in different disciplinary fields. The first published paper using the new definition deals with climate change denialism. The second paper (forthcoming) discusses the problem of academic retractions amidst the growing influence of generative AI. And the third, just accepted, explains the underlying mechanism of submission mechanism employed by journal editors and peer-reviewers, and the information-value nexus associated with it. (shrink)
