El libro de María González Navarro se presenta a sí mismo como una “nueva hermenéutica” (23). La novedad involucra dos aspectos: uno que llamaremos metateórico y otro hermenéutico en propiedad. Hablando metateóricamente, el libro presenta una hermenéutica gadameriana vigorizada y robustecida por las teorías pragma-dialécticas de la argumentación. Desde el punto de vista hermenéutico propiamente dicho, la novedad reposa en que se considera que la interpretación correcta está indesligablemente vinculada a la argumentación abductiva.

Uno de los conceptos fundamentales del área de las Ciencias humanas y sociales es el de «cognición social». Este término se suele utilizar para referir teorías, categorías y principios que explican e interpretan fenómenos relacionados con el conocimiento que los seres humanos poseen sobre el mundo social.

Political theorists have recently sought to replace the liberal, contractual theory of the firm with a political view that models the authority relation of employee to firm, and its appropriate regulation, on that of subject to state. This view is liable to serious difficulties, however, given existing discontinuities between corporate and civil authority as to their coerciveness, entry and exit conditions, scope, legal standing, and efficiency constraints. I here inspect these, and argue that, albeit in some cases significant, such discontinuities (...) fail to undermine the firm/state analogy, either because they are not significant enough to do so or because the particular trait on which they hinge is not decisive for how authority, in the state and in the firm, should be regulated to be legitimate. A pro tanto requirement exists, I thus argue, that corporate authority be held to regulatory norms comparable to those legitimate states abide by, including civil liberties, rule-of-law constraints, and accountability to subjects. We may succed in the fulfilment of our desires but still fail to properly own our practical life, perhaps because we acted as addicts, driven by desires that are alien to our will, or as “wantons,” satisfying the desires that we simply happen to have (Frankfurt, 1988 ). May we equally fail to own the outcomes of our epistemic life? If so, how may we attain epistemic ownership over it? This paper explores the structural parallellism between practical and epistemic rationality, (...) building on Williamson’s ( 2002 ) suggestion that we should commence with successful performances as the foundation for both domains, be it action or knowledge. By highlighting the limitations of higher-order regulative approaches in epistemology, exemplified by Sosa ( 2007, 2011, 2015, 2021 ), the paper introduces a form of teleological epistemic constitutivism inspired by Velleman ( 2000, 2009 ). The proposal is that epistemic ownership is not attained in the mere pursuit of truth or knowledge, but requires furthermore a struggle to understand what we know. (shrink)

El propósito central del presente artículo, es formular un enfoque sistémico-jurídico para el análisis de los sistemas sociales. Para esto, se proponen tres tipologías de consensos denominados límites del sistema social: consenso normal, consenso normativo y consenso legítimo. La función de estas tipologías es, primero elaborar una explicación sobre la constitucionalización y democratización del poder político, con base en la regla de reconocimiento y la norma fundamental de un Estado; segundo postular dos metodologías normativas, un registro positivo y una demarcación (...) positiva, que desplieguen, tanto sobre las conductas sociales como sobre la estructura del sistema social, un proceso de legalidad emergente, cuya función sea, tercero regular, realimentar y optimizar el funcionamiento de la constitución política. Finalmente, se analizan los conceptos de completitud y de legitimidad del sistema normativo, con el fin de definir el alcance institucional que debe poseer un sistema jurídico sobre los subsistemas culturales del sistema social. Por ello, se desarrollará un proceso axiológico que ilustre cómo sucede el ingreso, la transición y la salida de códigos morales en función de un esquema cognitivo. Así pues, el proceso axiológico se postula, primero, en fundamento de tres sistemas: de mentalidad, de valores y (...) de biomoralidad y, segundo, conforme a la teoría de la información y de la teoría general de sistemas. It is widely held that there is a distinctive norm of assertion. A plausible idea is that there is an analogous, perhaps weaker, norm for indirect communication via implicatures. I argue against this type of proposal. My claim is that the norm of assertion is a social norm governing public updates to the conversational record. Off the record implicatures are not subject to social norms of this type. I grant that, as happens in general with intentional actions, off the record (...) communicative acts may be subject to normative assessments on different levels (for instance, regarding their moral or prudential appropriateness). However, such assessments do not generate distinctive norms that apply to all cases of implicature. (shrink)

En estas páginas hemos presentado varios argumentos para defender que existe una conexión entre el empleo de heurísticas y los procesos de deliberación. En lugar de caracterizar las heurísticas en función de las disciplinas, los campos y/o los ámbitos en que se emplean—tal y como hace, por ejemplo, el grupo ABC, i.e. racionalidad ecológica—las hemos proyectado sobre nuestros enclaves deliberativos, esto es, sobre un espacio eminentemente retórico y político. En dichos enclaves, tal y como solía recordarnos Quintín Racionero, la téchne (...) de la persuasión se nos presenta como parte del órganon de la filosofía práctica porque está aplicada a un espacio ontológico fundado por la comunicación humana. Y es en el seno de dicha comunicación como cabe entender la proliferación de razonamientos heurísticos encaminados al cálculo, la estimación y/o la ponderación, con ayuda de los cuales no sólo se orienta la acción colectiva sino las mismas fases de la deliberación. The neo-Leibnizian mark characterizes both his philosophical thesis and the terms has coined in his contributions to the theory of knowledge, theodicy, ontology, political philosophy, etc. Above all, this mark is present in his conception of Law and of the logic of legal situations. Workplace democracy is often defined, and has recently been defended, as a form of intra-firm governance in which workers have control rights over management with no ownership requirement on their part. Using the normative tools of republican political theory, the paper examines bargaining power disparities and moral hazard problems resulting from the allocation of control rights and ownership to different groups within democratic firms, with a particular reference to the European codetermination system. With various qualifications related to potentially mitigating factors, (...) such as workforce and shareholder composition or risk aversion and reallocation, the paper contends that forms of workplace democracy in which workers control and own the firm, such as cooperativism, are preferable to other forms, such as codetermination, in which ownership and control rights are formally separated. Self-employment merits protection and promotion, we often hear, because it confers independence from a boss. But what, if anything, is wrong with having a boss? On one of the two views that this chapter inspects, being under the power of a boss is objectionable as such, no matter how suitably checked this power may be, for it undermines workers’ agency. On a second view, which republican theorists favor, what is objectionable is subjection not to the power of a boss as (...) such but to their arbitrary power. The first view is unconvincing, I argue, as it entails (implausibly) that being under the power of others in realms like the family or the state is likewise objectionable as such. And although the second view yields compelling reasons for self-employment, it only does so when employers’ power is not suitably checked. When it is, such reasons are more easily outweighed by competing considerations, like those stemming from the further forms of dependence—on suppliers and purchasers—that self-employment may prompt. Our digital society increasingly relies in the power of others’ aggregated judgments to make decisions. Questions as diverse as which film we will watch, what scientific news we will decide to read, which path we will follow to find a place, or what political candidate we will vote for are usually associated to a rating that influences our final decisions.

In the last forty years the number of specialized publications on deliberative democracy has increased steadily. Yet, today, one of the greatest challenges we still face today is to deepen into the knowledge of our actual and singular deliberative cultures. In order to achieve this, it is necessary that we use theoretical and methodological approaches that enable us to capture the inherent complexity to the specific forms of deliberation that are present in as different areas as that of politics, economics, (...) law, science, urbanism or the Net. Despite renewed interest in work, philosophers have largely ignored self-employment. This neglect is surprising, not just because self-employment was central to classic philosophizing about work, but also given that half of the global workforce today, including one in seven workers in OECD countries, are self-employed. We start off by offering a definition of self-employment, one that accounts for its various forms while avoiding misclassifying dependent self-employed workers as independent contractors, and by mapping the barriers to becoming and remaining self-employed (section (...) 2). We then examine five arguments why governments ought to promote self-employment, despite the forgone opportunities to promote employee work instead that this often entails (sections 3-7): the argument from job creation, the argument from job satisfaction, the argument from independence, the argument from occupational freedom, and the argument from subsistence under non-ideal circumstances. Some of these are unconvincing, we argue, but others are not. Although the strength of the latter arguments hangs on various context-dependent conditions, such that they need to be carefully weighed against considerations of efficiency and equality, they nonetheless offer compelling pro tanto reasons to promote, and not just to protect, self-employment. The republican case for workplace democracy is presented and defended from two alternative means of ensuring freedom from arbitrary interference in the firm—namely, the right to freely exit the firm and workplace regulation. This paper shows, respectively, that costless exit is neither possible nor desirable in either perfect or imperfect labor markets, and that managerial discretion is both desirable and inevitable due to the incompleteness of employment contracts and labor legislation. The paper then shows that WD is necessary, from a (...) republican standpoint, if workers’ interests are to be adequately tracked in the exercise of managerial authority. Three important objections are finally addressed— that WD is redundant, that it is unnecessary provided that litigation and unionism can produce similar outcomes, and that it falls short of ensuring republican freedom compared to self-employment. According to the standard view, Montaigne’s Pyrrhonian doubts would be in the origin of Descartes’ radical Sceptical challenges and his cogito argument. Although this paper does not deny this influence, its aim is to reconsider it from a different perspective, by acknowledging that it was not Montaigne’s Scepticism, but his Stoicism, which played the decisive role in the birth of the modern internalist conception of subjectivity. Cartesian need for certitude is to be better understood as an effect of the Stoic (...) model of wisdom, which urges the sage to build an inner space for self-sufficiency and absolute freedom. In this paper I argue that some human reproductive genome editing interventions can be therapeutic in nature, and thus that it is false that all such interventions just create healthy individuals. I do this by showing that the conditions established by a therapy definition are met by certain reproductive genome editing interventions. I then defend this position against two objections: (a) reproductive genome editing interventions do not attain one of the two conditions for something to be a therapy, and (b) (...) some reproductive genome editing interventions are therapeutic but in a nonstandard way. In the Conclusion I call for a more nuanced discussion of the nature of reproductive genome editing interventions. (shrink)

The relationship between the necessity to ensure that information is shared in the stages of deliberation and the overcoming of what Dryzek (2001) called constriction of deliberative economy is directly related to the proponents and opponents’ propensity to submit and add information differently, in a plural manner. This article describes the salient features of the deliberative turn in order to defend that this propensity is not individual. The evolution of the public space in science and in politics are both paradigmatic (...) examples to appreciate that individual deliberation, and even mere aggregation of opinions, are consistently interpreted only if they are part of social practices and collective institutions aimed at defending tolerance towards positions, beliefs and interpretations that are different or even confronted. This paper argues that the so called model of contestatory deliberative democracy contributes to the acquisition of knowledge precisely because it fosters a plurality of epistemic states associated with practices as consensus and dissent. Reductive intellectualists (e.g., Stanley & Williamson 2001; Stanley 2011a; 2011b; Brogaard 2008; 2009; 2011) hold that knowledge-how is a kind of knowledge-that. If this thesis is correct, then we should expect the defeasibility conditions for knowledge-how and knowledge-that to be uniform—viz., that the mechanisms of epistemic defeat which undermine propositional knowledge will be equally capable of imperilling knowledge-how. The goal of this paper is twofold: first, against intellectualism, we will show that knowledge-how is in fact resilient to being undermined by (...) the very kinds of traditional (propositional) epistemic defeaters which clearly defeat the items of propositional knowledge which intellectualists identify with knowledge-how. Second, we aim to fill an important lacuna in the contemporary debate, which is to develop an alternative way in which epistemic defeat for knowledge-how could be modelled within an anti-intellectualist framework. Despite growing interest in workplace democracy, the question whether nonworker stakeholders, like suppliers and local communities, warrant inclusion in the governance of democratic companies, as workers do, has been largely neglected. We inspect this question by leaning on the boundary problem in democratic theory. We first argue that the question of who warrants inclusion in democratic workplaces is best addressed by examining why workplace democracy is warranted in the first place, and offer a twofold normative benchmark—addressing objectionable corporate power and (...) upholding efficiency—to assess the principles of democratic inclusion on offer. Against this benchmark, we next argue that the All-Affected Principle is unfit due to its over- and underinclusive extensional results, and that the All-Subjected Principle, whose variants we examine alongside their extensional results, holds more promise when coupled with independent considerations of justice or a constrained variant of the All-Affected Principle. These combinations need not entirely preclude, but speak against, nonworker stakeholder inclusion. (shrink)

La biología utiliza múltiples criterios para individuar fenómenos biológicos. Frente a esta diversidad, los enfoques monistas proponen criterios fundamentales para el reconocimiento unívoco de individuos, esto es, formas únicas de dividir el mundo biológico en entidades individuales. El pluralismo, por otro lado, argumenta que no deberíamos restringir el estudio de la individualidad a concepciones únicas, reconociendo, en su lugar, diferentes tipos de individuos. En este artículo, analizaré cómo ciertos enfoques monistas y pluralistas enfrentan la pluralidad de criterios de individuación utilizados (...) por la práctica científica. Siguiendo las recientes aproximaciones epistemológicas y pragmáticas en filosofía de la individualidad biológica, argumentaré por qué la diversidad de individuaciones no suele representar un inconveniente para la biología y por qué contribuye a nuestro conocimiento del mundo biológico. La conclusión general será que requerimos múltiples maneras de individuar la naturaleza para poder cumplir los diversos objetivos epistémicos de la biología, una labor que las aproximaciones monistas no suelen visibilizar. Seen from the point of view of evaluation conditions, a usual way to obtain a connexive logic is to take a well-known negation, for example, Boolean negation or de Morgan negation, and then assign special properties to the conditional to validate Aristotle’s and Boethius’ Theses. Nonetheless, another theoretical possibility is to have the extensional or the material conditional and then assign special properties to the negation to validate the theses. In this paper we examine that possibility, not sufficiently explored in (...) the connexive literature yet.We offer a characterization of connexive negation disentangled from the cancellation account of negation, a previous attempt to define connexivity on top of a distinctive negation. We also discuss an ancient view on connexive logics, according to which a valid implication is one where the negation of the consequent is incompatible with the antecedent, and discuss the role of our idea of connexive negation for this kind of view. Este artículo muestra la conexión entre heurísticas sociales y deliberación. En lugar de caracterizar las heurísticas según disciplinas o campos, aquí se proyectan sobre nuestros enclaves deliberativos. La autora sostiene que el empleo de heurísticas sociales orienta el flujo de la información y la participación en las distintas fases deliberativas, y es necesario analizarlas para establecer indicadores con los que medir grados de deliberación. Esta hipótesis da lugar a una visión pluralista sobre la función social de las heurísticas entendidas como (...) caja de herramientas con nuevos instrumentos y utilidades sociales. Según dicha perspectiva, habría que integrar este tipo de razonamiento en un plan de acción más amplio que explicara en qué sentido las heurísticas son recursos que producen conocimiento, al tiempo que un tipo de conocimiento ya producido. La oposición a una estricta separación entre las dimensiones dialéctica y retórica de la actividad argumentativa es una de las aportaciones más destacadas y peculiares de la denominada escuela holandesa sobre argumentación. Frans H. van Eemeren y Peter Houtlosser reaccionaron contra una separación estricta entre dialéctica y retórica en varios trabajos, pero uno de los más inspiradores es sin duda su artículo “William the Silent’s argumentative discourse” (1998) presentado en la ciudad de Ámsterdam con ocasión de la cuarta conferencia organizada (...) por la International Society for the Study of Argumentation (ISSA). Sobre este tema siguieron investigando para presentar un análisis de la perspectiva dialéctica inherente al caso de Guillermo I de Orange en un congreso de la Japan Debate Association en Tokio (van Eemeren y Houtlosser, 2000). The aim of this paper is to discuss a basic assumption tacitly shared by many philosophers of mind and language: that whatever can be meant, can be said. It specifically targets John Searle's account of this idea, focusing on his Principle of Expressibility . In the first part of the paper, PE is exposed underlining its analyticity and its relevance for the philosophy of language , mind , society and action . In the critical part, the notion of Background is (...) taken into account in order to re-evaluate two basic distinctions: the one between sentence and utterance meanings , and the one between native and type speakers . PE is reconsidered in the light of the previous arguments as a methodological strategy that does not prevent uses of language from eventual semantic excesses and deficits , and a complementary Principle of Expression Fallibility is finally proposed. A continuación, se plantea una genealogía queer de los usos de la teatralidad en las formas contemporáneas del activismo urbano. News about the first baby born after a mitochondrial replacement technique (MRT; specifically maternal spindle transfer) broke on September 27, 2016 and, in a matter of hours, went global. Of special interest was the fact that the mitochondrial replacement procedure happened in Mexico. One of the scientists behind this world first was quoted as having said that he and his team went to Mexico to carry out the procedure because, in Mexico, there are no rules. In this paper, we explore (...) Mexico's rule of law in relation to mitochondrial replacement techniques and show that, in fact, certain instances of MRTs are prohibited at the federal level and others are prohibited at the state level. According to our interpretation of the law, the scientists behind this first successful MRT procedure broke federal regulations regarding assisted fertilization research. (shrink)

Even one and the same author may offer more than one definition of what he understands by argumentation: this is partly because the problem of argumentation is not confined to a single area of knowledge or of practical life. Definitions of argumentation are as varied as the different positions taken on the question of what exactly we do when we argue. Several European countries are approving legislative reforms moving to a presumed consent system in order to increase organ donation rates. Nevertheless, irrespective of the consent system in force, family's decisional capacity probably causes a greater impact on such rates. In this contribution we have developed a systematic methodology in order to analyse and compare European organ procurement laws, and we clarify the weight given by each European law to relatives' decisional capacity over individual's preferences (expressed or not while alive) regarding (...) the destination of his or her organs after death. In this sense, the results constitute the first comprehensive and comparative legislative mapping on European transplantation laws. (shrink)

Para ello, se someterán a falsacionismo las tesis según las cuales la cualidad estructural es, primero, estructuralista y no analítica y, segundo, empírica, de acuerdo con la metodología holista de la ciencia. Recent breakthroughs in stem cell differentiation and reprogramming suggest that functional human gametes could soon be created in vitro. While the ethical debate on the uses of in vitro generated gametes (IVG) was originally constrained by the fact that they could be derived only from embryonic stem cell lines, the advent of somatic cell reprogramming, with the possibility to easily derive human induced pluripotent stem cells from any individual, affords now a major leap in the feasibility of IVG derivation and (...) in the scope of their potential applications. In this paper we develop an ethical framework, rooted in recent scientific evidence, to support a robust experimental pipeline that could enable the first-in-human use of IVG. We then apply this framework to the following objectives: (1) a clarification of the genetic parenting options afforded by IVG, along with their ethical underpinnings; (2) a defence of the use of IVG to remedy infertility, broadening their scope to same-sex couples; (3) an assessment of the most far-reaching implications of IVG for multiplex parenting. These include, first, the liberation of parenting roles from the constraints of biological generations in vivo, allowing multiple individuals to engage in genetic parenting together, thus blurring the distinction between biological and social generations. Second, we discuss the conflation of IVG with sequencing technology and its implications for the possibility that prospective parents may choose among a hitherto unprecedented number of potential children. In view of these perspectives, we argue that, contrary to the exhausted paradigm according to which society lags behind science, IVG may represent instead a salient and most visible instance where biotechnological ingenuity could be used in pursuit of social experimentation. Esta revisión de la idea de comunidad se pondrá en relación con el desarrollo de la medicina social urbana explorado por Michel Foucault para deslocalizar la resistencia a los procesos de estigmatización y normalización puestos en marcha (...) por la pandemia del sida para pensar, hoy, las biopolíticas emergentes en nombre del cuidado de la salud colectiva. -/- Abstract The discussion of the cultural politics of mourning offered by Judith Butler after the September 11 attacks will serve here to question the sexual, gender and racial fractures, among others, that govern the cultural intelligibility of shared vulnerability in pandemic contexts. This review of the idea of community will be related to the development of urban social medicine explored by Michel Foucault to delocalize the resistance to the stigmatization and normalization processes set in motion by the AIDS pandemic to think, today, emerging biopolitics in name of public health. Our goal in this paper is to articulate a precise concept of at least a certain kind of disease-mongering, showing how pharmaceutical marketing can commercially exploit certain diseases when their best definition is given through the success of a treatment in a clinical trial. We distinguish two types of disease-mongering according to the way they exploit the definition of the trial population for marketing purposes. We argue that behind these two forms of disease-mongering there are two well-known problems in the (...) statistical methodology of clinical trials (the reference class problem and the distinction between statistical and clinical significance). This paper addresses some relations between the spatial politics of queer assemblies in spaces of protest and the constitution of collective political subjects. It does so by exploring the spatial politics of queer activism within the global Occupy movements, in the light of Judith Butler’s work on the performative power of assembly and the ambivalences of the Foucauldian concept of heterotopia. Specific challenges faced by queer activists in various encampments will be addressed in order to expose some tensions between the (...) constitutive exclusions inherent to the constitution of spaces of protest and the processes of coalition building needed to effectively overcome those very constitutive exclusions. El estudio y análisis de las argumentaciones cotidianas entendidas como interacciones discursivas e intencionales encaminadas a dar cuenta de algo con el fin de lograr que aquello que se sostiene sea aceptado, sería inconcebible sin la aparición de la teoría de los actos de habla de Austin (1962), la propuesta de Searle (1969), el trabajo de Grice sobre la teoría de la conversación (1975) y el importante estudio sistemático de Hamblin sobre el argumento falaz (1970). Como una reelaboración de dichas (...) obras cabe entender la teoría pragmadialéctica de la argumentación propuesta inicialmente por Frans H. van Eemeren y Rob Grootendorst (1984). Algunos autores (Blair, 2006: 11; Woods, 1992) creen ver en ella, más que una teoría, una amalgama de varias teorías y una particular versión de la teoría pragmadialéctica de la argumentación, entendiendo ésta bajo una acepción más general. Otros consideran que ni es útil ni tampoco especulativamente productivo sostener que de toda argumentación pueda buscarse un modelo según el cual ésta buscaría resolver una diferencia de opinión (Goodwin, 1999). In response to the COVID‐19 pandemic philosophers and governments have proposed scarce resource allocation guidelines. Their purpose is to advise healthcare professionals on how to ethically allocate scarce medical resources. One challenging feature of the pandemic has been the large numbers of patients needing mechanical ventilatory support. Guidelines have paradigmatically focused on the question of what doctors should do if they have fewer ventilators than patients who need respiratory support: which patient should get the ventilator? There is, however, an important (...) higher level allocation problem. Namely, how are we to ethically distribute newly obtained ventilators across hospitals: which hospital should get the ventilator(s)? In this paper, we identify a set of principles for allocating newly obtained ventilators across hospitals. We focus particularly on low and middle income countries, who frequently have limited pre‐existing intensive care capacity, and have needed to source additional ventilators. We first provide some background. Second, we argue that the main population healthcare aim during the COVID‐19 pandemic should be to save the most lives. Next, we assess a series of potential heuristics or principles that could be used to guide allocation: allocation to the most densely populated cities, random allocation, allocation based on the ratio of patients to ICU personnel, prioritisation in terms of intrahospital mortality, prioritisation of younger populations, and prioritisation in terms of population mortality. We conclude by providing a plausible ranking of the principles, while noting a number of epistemological challenges, in terms of how they best further the aim of increasing the probability of saving the most lives.
