In the marketplace of opinions concerning the metaphysics of mind and consciousness panqualityism (PQ) occupies an interesting position. It is a distinct variant of neutral monism, as well as of protophenomenalism, and as such it strives to carve out a conceptual niche midway between physicalism and mentalism. It is also a brand of Russellian monism, advocated by its supporters as a less costly and less extravagant alternative to panpsychism. Being clearly articulated and relatively well-developed it constitutes an intriguing view. Nonetheless, (...) the present paper takes a decisively critical stance towards PQ. In particular, it challenges it on two principal grounds. First, I argue that PQ's analysis of experience, and of the qualities tasked with constituting the phenomenal character of experience, is fundamentally flawed. Second, I argue that PQ's attempt to explain phenomenal consciousness as a function of reflective awareness is equally misguided. Along the way, the paper also points the shortcomings of previously established critiques of PQ. All in all, the discussion identifies some difficulties that are likely to generalize beyond PQ's specific circumstances, raising concerns regarding the viability of a "middle of the road" solution to the mind–body problem. The paper begins with the assumption that in order to explain the efficacy of harmony as an organizing force in human and natural affairs we must pay attention to the dynamic features characteristic of the growth and maintenance of harmonious forms. Two dynamic features are highlighted for their especial significance: revitalization, and self-surpassing. It is then argued that the two are substantively connected through the agency of creativity which, when given free reign, tends to preserve and fortify harmony by surpassing (...) existing harmonious configurations. It follows that the impetus towards self-transcendence is a vital aspect of the growth, the sustenance, and the flourishing of harmony. I then argue that this urge towards self-transcendence can be broadly identified with Plato's notion of Eros. Nevertheless, I also argue that this affinity does not commit us to a rigid Platonic scheme of the sort criticized by Chenyang Li (2014) as harmony by conformity. (shrink)

One of the most significant characteristics of intentional states is the fact that they represent their intentional objects under selec￾tive aspects (or modes of presentation); that is, that they manifest an aspectual shape (Searle, 1992). Surprisingly however, although this remarkable feature is widely recognized little has been done to explain what makes representation aspect-relative in the first￾place. In this article I attempt to outline an answer to this question. I begin with a critique of Searle’s explanation of aspectual shape as (...) nchored in conscious experience. I argue next that, since to represent an object under an aspect is to represent it relative to a selective set of properties, the task – from the perspective of a theory of mental representation – is to explain what makes intentional states property-relative. It is then argued that while this task cannot be handled properly by standard (in particular computational-representational) theories of mental representa￾tion, a shift towards an action-based framework for theories of perception and representation promises to provide the key with which to unlock the puzzle. Davis called for “extreme caution” in the use of non-invasive brain stimulation to treat neurological disorders in children, due to gaps in scientific knowledge. We are sympathetic to his position. However, we must also address the ethical implications of applying this technology to minors. Compensatory trade-offs associated with NIBS present a challenge to its use in children, insofar as these trade-offs have the effect of limiting the child’s future options. The distinction between treatment and enhancement has some normative force here. (...) As the intervention moves away from being a treatment toward being an enhancement—and thus toward a more uncertain weighing of the benefits, risks, and costs—considerations of the child’s best interests diminish, and the need to protect the child’s autonomy looms larger. NIBS for enhancement involving trade-offs should therefore be delayed, if possible, until the child reaches a state of maturity and can make an informed, personal decision. NIBS for treatment, by contrast, is permissible insofar as it can be shown to be at least as safe and effective as currently approved treatments, which are themselves justified on a best interests standard. Do đó, gần đây, các thông tin quốc tế về ăn côn trùng như nguồn dinh dưỡng ngày càng nhiều hơn. Ăn côn trùng không lạ ở Việt Nam. Cà cuống hay bò cạp ngày nay là các (...) món đặc sản, đắt tiền. Nhưng bình dân hơn như dế và châu chấu cũng không còn là món dễ kiếm nữa. This article argues that the Indian philosopher-mystic Sri Aurobindo espoused a sophisticated form of cosmopsychism that has great contemporary relevance. After first discussing Aurobindo’s prescient reflections on the “central problem of consciousness” and his arguments against materialist reductionism, I explain how he developed a panentheistic philosophy of “realistic Adwaita” on the basis of his own spiritual experiences and his intensive study of the Vedāntic scriptures. He derived from this realistic Advaita philosophy a highly original doctrine of evolutionary cosmopsychism, according to (...) which the Divine Saccidānanda is “involved” in everything in the universe and gradually manifests itself at each stage of the evolutionary process from matter to life to mind, and ultimately, to Supermind—the final stage that is yet to come, upon the attainment of which we will attain knowledge of our true divine nature as Saccidānanda. I then reconstruct Aurobindo’s novel solution to the individuation problem, according to which the Divine Saccidānanda individuates into various distinct consciousnesses by playfully limiting itself through a process of “exclusive concentration.” Finally, I highlight the continued relevance of Aurobindo’s evolutionary cosmopsychism by bringing him into conversation with Itay Shani, a contemporary proponent of cosmopsychism. How do brains create all our different colors, pains, and other conscious qualities? These various qualia are the most essential aspects of consciousness. Yet standard neuroscience (primarily based on synaptic information processing) has not found the synaptic-firing codes, sometimes described as the “spike code,” to account for how these qualia arise and how they unite to form complex perceptions, emotions, et cetera. Nor is it clear how to get from these abstract codes to the qualia we experience. But electromagnetic field (...) (versus synaptic) approaches to how qualia arise have been offered in recent years by Pockett, McFadden, Jones, Bond, Ward and Guevera, Keppler and Shani, Hunt and Schooler, et cetera. These EM-field approaches show promise in offering more viable accounts of qualia. Yet, until now, they have not been evaluated together. We review various EM field theories of qualia, highlight their strengths and weaknesses, and contrast these theories with standard neuroscience approaches. -/- . (shrink)

Panpsychism, the view that consciousness is present everywhere at the fundamental level of reality, has established itself as an increasingly popular option in the philosophy of mind. Situated between substance dualism and reductive physicalism, panpsychism aims to capture the intuitions behind both, integrating consciousness into the physical world without explaining it in terms of purely physical facts. In this thesis, I offer a defence of panpsychism. -/- First, I examine influential arguments against physicalism, such as Thomas Nagel’s (1974, 1979) perspective-based (...) proposal, Frank Jackson’s (1982) knowledge argument, David Chalmers’ (1996, 2010) conceivability argument, as well as vagueness arguments (Antony 2006a; Tye 1996). I argue that none of them offers a knockdown case against physicalism, particularly because of the threat presented by the phenomenal concept strategy (Chalmers 2007; Papineau 2007a), though they suggest panpsychism as a promising alternative that avoids many common objections. -/- Second, I discuss independent arguments for panpsychism, including the Russellian monist view (Goff 2017; Russell 1927/1992), the intrinsic nature argument (Seager 2006; Strawson 2006), recent developments in the literature as presented by Hedda Hassel Mørch (2018, 2020) and Luca Dondoni (2022), Tye’s (2021b) representational panpsychism based on the vagueness argument, as well as cosmopsychism (Nagasawa & Wager 2016; Shani 2015) – an alternative to panpsychism that shares its aims whilst claiming to avoid its shortcomings. -/- Third, I address the most pressing objection to panpsychism: the combination problem or the question of how fundamental consciousness can combine to lead to complex consciousness (James 1890). Focusing especially on the subject-summing version of the combination problem or the issue of how small subjects can combine to form complex subjects, I go over various proposals for either solving or avoiding it, such as Philip Goff’s (2016) phenomenal bonding relation and William Seager’s (2010) combinatorial infusion proposal, arguing against both and agreeing at the end with Sam Coleman (2014), who advocates that subject-summing is demonstrably incoherent. -/- However, as I argue in the fourth and final chapter, the panpsychist still has an option that avoids the subject-summing problem, while also circumventing the objections faced by the alternative view of cosmopsychism. Inspired though not reliant on the philosophy of Gottfried Wilhelm Leibniz (1902/2005), I introduce what I call monadic panpsychism, the view that the phenomenal character of any given consciousness-bearing physical ultimate is determined by its relations to other such ultimates featuring in the relevant causal structure. -/- The theory consists of two key claims. The first is that phenomenal qualities are relational rather than intrinsic. This view has precedent in literature on the philosophy of mind, such as in Rudolf Carnap (1928), Gottlob Frege (1956), Moritz Schlick (1959), as well as more recently in David Hilbert and Mark Kalderon (2000) and Austen Clark (2000), though not in the context of panpsychism. -/- The second claim is that physical ultimates only possess a very basic form of consciousness necessary for experiencing as such. There are many ways to conceptualise this basic consciousness: non-relational or intrinsic, rudimentary and non-specific, a point of view without experiences, the minimal subject, a mere conduit for experience, phenomenal space, etc. Russellian panpsychists offer a more detailed proposal in which every physical ultimate has an appropriate associated type of experience. For example, all quarks have the same quark-type of experience, assuming for the sake of discussion that quarks are ultimates. Still, arguing for a more minimal notion, as I do, requires making less claims and should not be controversial to any panpsychist. -/- So, what follows from these two claims? I propose that the relational constitution of phenomenal qualities has its endpoint at the fundamental level rather than at the level of a combined complex or emergent subject. Put simply, physical ultimates guarantee the basic consciousness or the point of view that I occupy, while the relational structure constitutes my rich and full human experience. So to speak, relationally constituted phenomenal qualities ‘anchor’ themselves in physical ultimates. As long as these relations result in a phenomenally unified experience, which is an uncontroversial thesis, then no matter where that process reaches the end of its causal chain, it will necessarily be experienced from a subjective point of view. -/- Since only qualities but not subjects need to combine, my proposal avoids the subject-summing version of the combination problem, which is arguably an insurmountable challenge to other forms of panpsychism. Because of this, I conclude that my theory contributes to the field, serving as a good starting point for further developments of neither combinatory nor emergent panpsychism with regard to subjects. How can legal orders coexist? Contemporary lawyers and philosophers frequently accept that a legal system operates under its own terms and is shaped by its own participants. Any problems posed by the plurality of legal orders in the world are to be dealt with by each legal order separately. So persons that are caught in transnational disputes because they are subject to two or more jurisdictions, have recourse to private international law, which is always part of domestic law, i.e. the (...) law where the case happens to arise. But this analysis does not capture international law. This is, or appears to be, a distinct legal order that is certainly not the law of a distinct nation or a people but aspires to cover the whole of the world and – perhaps surprisingly – does seem to meet many of the ordinary criteria of a legal order. This review essay discusses two recent attempts at accommodating international law, Regulating Jurisdictional Relations Between National and International Courts, by Yuval Shany and A Theory of Interpretation of the European Convention of Human Rights, by George Letsas. In their own ways both books outline a ‘substantive’ theory of international law, which is to be welcomed. (shrink)

Abstract: While pragmatism and the so-called 4E program may form a united front against methodological individualism, classical cognitivism, traditional internalism, and the like, the 4E approach is not without its own internal tensions. One such tension, between Embodied and Extended, is brought to light by Clark (2008), who argues in favor of the latter. Dempsey and Shani (2013) reply that Clark’s functionalism undercuts what should be a more fundamental commitment to Embodied. With respect to this tension, Gallagher (2014) claims (...) that “there may be resources in pragmatism that can help to adjudicate some of the current debate and to develop a more integrated perspective” (Gallagher 2014, 110). In this paper, I assess Gallagher’s strategy and offer a critical perspective on the use of Deweyan pragmatism to resolve these tensions in the 4E program. (shrink)

This dissertation takes up questions of access at the level of language itself, as well as in the context of cultural institutions in emerging global communities. Using the texts of James Joyce, Samuel Beckett, and Shani Mootoo, I argue experimental narrative techniques develop new understandings of mental disability by pushing against the limits of language, particularly in relation to mentally disabled women. The novels and plays examined function as creative objects that refigure the reader’s relationship to mental disability through (...) embodied reading practices. In resisting previous tendencies to read literary representations of mental disability as metaphor, I offer an alternative framework for understanding mental disability as an ongoing interactive process between bodies. Drawing on work from disability studies, critical gender studies, and trauma theory, I call for approaches to mental disability in literature that understand reading as an interactive process between reader and text, proposing a methodology for understanding how embodied reading practices inspire new understandings of mental disability and trauma in emerging global communities. In appreciating mental disability as an ongoing interactive process between bodies, readers can better attend to the nuanced ways in which complex embodiment calls for innovative modes of storytelling that challenge histories of representation. Những vụ kiện này thường xoay quanh các vấn đề quan trọng như biến đổi khí hậu, ô nhiễm, khai thác tài nguyên hủy hoại môi trường sống, gây rối loạn hệ sinh thái, hủy diệt đa dạng sinh học, và tiêu diệt nguồn sinh kế của người dân. Để đạt được các mục tiêu giảm biến đổi khí hậu, bảo vệ môi trường và môi sinh, đồng thời đảm bảo sự phát triển bền vững, cũng như là công lý cho cả con người và thiên nhiên, chính quyền và hệ thống tư pháp cần hiểu rõ bản chất bản chất của các mâu thuẫn dẫn đến cuộc chiến pháp lý về môi trường. Bài viết này có mục đích tìm hiểu bối cảnh phức tạp của các cuộc chiến pháp lý về môi trường, làm sáng tỏ tầm quan trọng và kết quả tiềm tàng của chúng, từ đó chỉ ra một số lỗ hổng pháp lý và khiếu kiện môi trường tại Việt Nam. Đại dịch COVID-19 đã gây ra những diễn biến phức tạp, khó lường và tác động đến nhiều mặt của đời sống xã hội, lĩnh vực giáo dục cũng không nằm ngoài tác động đó. Học sinh được trải nghiệm học tập trực tuyến và có những khoảng thời gian “bất thường” rời xa trường lớp, bạn bè và tự học ở nhà (Hoang, 2020; Tran, 2020). Các hoạt động khoa học và giáo dục cũng chịu tác động không nhỏ (...) (Vuong, 2018). Đời sống vật chất lẫn tinh thần của đội ngũ giáo viên cả trong nước lẫn giáo viên nước ngoài đi dạy tại các quốc gia đều bị suy giảm (Vu et al., 2020). Đã có gần 42.000 giáo viên phải hoãn hợp đồng làm việc và không có lương, trong đó có 29.700 giáo viên mẫu giáo bỗng chốc trở nên thất nghiệp và phải làm các công việc thời vụ để đáp ứng đời sống thường nhật (Bich Thanh, 2020). Khoảng 70% các tổ chức giáo dục tư nhân có thể sẽ phá sản khi không thể lưu động đủ chi trả các loại hình tài chính khác nhau (Nguyen, 2020). Rất nhiều trường học đang lo lắng về tình trạng không mong muốn này bởi giáo viên sẽ không thể đảm bảo chất lượng công việc khi mà chất lượng cuộc sống của họ cũng đang bị đe dọa (Canrinus et al., 2012). Hơn nữa, hiệu suất làm việc giáo viên được cho là yếu tố tác động quan trọng và có ảnh hưởng nhiều nhất đến học sinh (Darling-Hammond and Youngs, 2002; Staiger and Rockoff, 2010), so với các tác động bên ngoài như lòng yêu nghề, cách diễn đạt, sự tương tác hay mối quan hệ giữa giáo viên và học sinh (Marsh and Bailey, 1991). With the limited initial availability of COVID-19 vaccines in the first months of 2021, decision-makers had to determine the order in which different groups were prioritized. Our aim was to find out what normative approaches to the allocation of scarce preventive resources were embedded in the national COVID-19 vaccination schedules. We systematically reviewed and compared prioritization regulations in 27 members of the European Union, the United Kingdom, and Israel. We differentiated between two types of priority categories: groups that have increased (...) infection fatality rate (IFR) compared to the average for the general population and groups chosen because their members experience increased risk of being infected (ROI). Our findings show a clear trend: all researched schedules prioritized criteria referring to IFR (being over 65 years old and coexisting health conditions) over the ROI criteria (eg occupation and housing conditions). This is surprising since, in the context of treatment, it is common and justifiable to adopt different allocation principles (eg introducing a saving more life-year approach or prioritizing younger patients). We discuss how utilitarian, prioritarian, and egalitarian principles can be applied to interpret normative differences between the allocation of curative and preventive interventions. (shrink)

Những vụ kiện này thường xoay quanh các vấn đề quan trọng như: biến đổi khí hậu, ô nhiễm, khai thác tài nguyên hủy hoại môi trường sống, gây rối loạn hệ sinh thái, hủy diệt đa dạng sinh học, và tiêu diệt nguồn sinh kế của người dân. Les défenseurs d'Ion Antonescu considèrent l'acte du roi Mihai I comme une erreur tragique ou une « grave erreur politique », affirmant que le roi aurait dû attendre encore un mois ou deux pour que le Maréc lui-même exige un armistice. L'historien Neagu Djuvara a déclaré que ces « conditions plus faciles » qu'aurait obtenues Ion Antonescu « sont de pures fables », en réalité Antonescu avait l'intention de donner aux Allemands une pause pour quitter la Roumanie. Entre le 24 (...) et le 26 août, l'armée roumaine a vaincu les derniers points de résistance allemande, avec l'aide de volontaires civils. Jusqu'au 28 août, il n'y avait plus de troupes allemandes à Bucarest et ses environs, et jusqu'au 31 août, toutes les troupes allemandes du pays étaient expulsées. Le 10 février 1947 a lieu la cérémonie de signature du Traité de paix de Paris entre les puissances alliées et associées et la Roumanie. Les Alliés n'ont pas reconnu la Roumanie comme une nation co-belligérante, la considérant comme une « alliée de l'Allemagne hitlérienne ». La frontière avec l'URSS et la Bulgarie a été fixée dans son état en janvier 1941, mais la Roumanie a repris le nord de la Transylvanie, suite à la reconnaissance que la Roumanie « a agi dans l'intérêt de toutes les Nations Unies » après le 23 août 1944. -/- DOI: 10.13140/RG.2.2.32483.02086. Tiêu thụ năng lượng và tăng trưởng kinh tế có mối quan hệ chặt chẽ không thể tách rời, nó ảnh hưởng đến tình hình phát triển về mọi mặt của quốc gia. Việc điều phối tốt mối quan hệ giữa tiêu thụ năng lượng và tăng trưởng kinh tế sẽ giúp cho nền kinh tế phát triển mạnh mẽ, trên cơ sở năng lượng được sử dụng một cách tối ưu, tránh tình trạng tiêu thụ quá mức, dẫn tới (...) cạn kiệt năng lượng... Trên cơ sở nghiên cứu mối quan hệ giữa tiêu thụ năng lượng và tăng trưởng kinh tế, bài viết đề xuất một số giải pháp nhằm góp phần thực hiện quá trình chuyển đổi năng lượng (sản xuất, tiêu thụ năng lượng bền vững) hiệu quả phục vụ tăng trưởng xanh trong tương lai. Les officiers du groupe complotiste pour retourner les armes contre l'Allemagne augmentent le nombre d'unités roumaines présentes dans la capitale, afin de pouvoir affronter les Allemands. Une mission alliée clandestine a été parachutée à Bucarest et secrètement hébergée par le général Constantin Sanatescu. Suite au succès de l'offensive allemande sur l'alignement Iasi-Chisinau, le groupe complotiste décide d'accélérer (...) les préparatifs. Le 20 août, Mihai I et le groupe de soldats du complot ont fixé la date de l'action au 26 août. Dans la nuit du 21 août, les membres de l'opposition ont secrètement convenu de cette date. Sở hữu tư nhân hiện đại là chế độ sở hữu được cổ phần hóa, được xã hội hóa rất cao, công khai, minh bạch trên các thị trường chứng khoán. Tính xã hội cao của chế độ cổ phần hóa đã được C.Mác đánh giá, xem như là chế độ sở hữu quá độ sang hình thái kinh tế - xã hội mới. (shrink)

Đất đai cần được nhận diện như một đối tượng của tham nhũng để có biện pháp phòng chống tương xứng. Ai được hỏi tính hợp lý của dự án? Ai được hỏi giá đất đền bù bao nhiêu là hợp lý, rồi việc thu hồi, mua bán có làm lợi cho quan chức nào? De l'entre-deux-guerres jusqu'à la fin de la Seconde Guerre mondiale, la Roumanie s'est trouvée dans une sorte de labyrinthe géopolitique, dans lequel elle semblait avoir de multiples possibilités, mais elles allaient toutes dans le même sens : l'alliance avec l'Allemagne au début de la Seconde Guerre mondiale, l'acte du 23 août 1944 tel qu'il se présentait et le statut établi par la suite par le traité de Paris. Tout au long de cette période, l'armée roumaine a joué un rôle majeur (...) à travers ses dirigeants et le sacrifice des soldats roumains, et l'acte du 23 août 1944 a été un acte légitime et légal, dans lequel le roi Mihai I et l'armée ont été les principaux décideurs. Après une présentation du contexte de l'entrée de la Roumanie dans la Seconde Guerre mondiale, suit la description de l'évolution de la Roumanie pendant la guerre, en mettant l'accent sur les tentatives de conclure un armistice avec les Alliés occidentaux et le rôle de l'armée pendant cette période. L'acte du 23 août 1944 est ensuite détaillé à part, soulignant la diversité des opinions sur cet événement.
