ABSTRACT Testimony from victims of gendered violence is often wrongly disbelieved. This paper explores a way to address this problem by developing a phenomenological approach to testimony. Guided by the concept of ‘disclosedness’, a tripartite analysis of testimony as an affective, embodied, communicative act is developed. Affect indicates how scepticism may arise through the social moods that often attune agents to victims’ testimony. The embodiment of meaning suggests testimony should not be approached as an assertion, but as a process of (...) ‘articulating an understanding’. This account is deepened in the discussion of testimony as a communicative act. It is argued that testimony must be considered as a relational whole, and thus our aim in receiving victims’ testimony should be to honour the relational conditions under which the truth of testimony can be heard. Approaching testimony as the collaborative process of enabling an understanding to be articulated can enhance our conception of gendered violence, whilst also better serving the victims of gendered violence by helping to overcome the lack of trust and excessive scepticism with which victims’ testimony is often met. Hermann von Helmholtz’s geometrical papers have been typically deemed to provide an implicitly group-theoretical analysis of space, as articulated later by Felix Klein, Sophus Lie, and Henri Poincaré. However, there is less agreement as to what properties exactly in such a view would pertain to space, as opposed to abstract mathematical structures, on the one hand, and empirical contents, on the other. According to Moritz Schlick, the puzzle can be resolved only by clearly distinguishing the empirical qualities of spatial perception (...) from those describable in terms of axiomatic geometry. This paper offers a partial defense of the group-theoretical reading of Helmholtz along the lines of Ernst Cassirer in the fourth volume of The Problem of Knowledge of 1940. In order to avoid the problem raised by Schlick, Cassirer relied on a Kantian view of space not so much as an object of geometry, but as a precondition for the possibility of measurement. Although the concept of group does not provide a description of space, the modern way to articulate the concept of space in terms of transformation groups reveals something about the structure and the transformation of spatial concepts in mathematical and natural sciences. Most scientists and philosophers of science take for granted the standard empiricist view that the basic intellectual aim of science is truth per se. But this seriously misrepresents the aims of scieince. Actually, science seeks explanatory truth and, more generally, important truth. Problematic metaphysical and value assumptions are inherent in the real aims of science. Precisely because these aims are profoundly problematic, they need to be articulated, imaginatively explored and critically assesseed, in order to improve them, as an integral part (...) of science itself. This was how Einstein did science in developing the special and general theories of relativity. Science needs to put a new aim-oriented empiricist methodology into practice. (shrink)

The main argument of this paper is that the legal regulation of lobbying is an important factor for disciplining/curbing the undue (illicit) influence of different interest groups on the political-making process, especially in countries with post-communist and nonconsolidated democracies such as Albania. In three decades of political and economic transition from a one-party communist system to a democratic one and towards a market economy, the democratization of Albania has faced various problems, which have often led to a loss of public (...) confidence in the political class and apathy of citizens towards the political system. In many cases, this has come as a result of the perception or even the disclosure by the media and the public of corruption scandals, political clientelism, or undue influences in the decision-making processes in Albania. Surely, it can be said that political scandals of trading or exercising illicit influences on public officials can affect, as numerous cases have shown, every democratic political system in the world. However, they are more likely to occur in new democracies (post-communist) countries that face weak state structures and a legal environment that is not yet well consolidated and where a culture of informality exists alongside written rules and laws. For this purpose, that of disciplining and controlling the influences that specific interests exert on the decision-making process of governments, legislatures, or other regulatory agencies, a good part of European countries have considered undertaking legal regulatory initiatives for lobbying activity in their environments. Philosophers writing on forgiveness typically defend the Resentment Theory of Forgiveness, the view that forgiveness is the overcoming of resentment. Rarely is much more said about the nature of resentment or how it is overcome when one forgives. Pamela Hieronymi, however, has advanced detailed accounts both of the nature of resentment and how one overcomes resentment when one forgives. In this paper, I argue that Hieronymi’s account of the nature of forgiveness is committed to two implausible claims about the norms (...) bearing on forgiveness. Her account is highly instructive, however, for it brings into relief how certain intuitive views about the norms of forgiveness should be used to constrain our theories about its nature. This paper outlines a theory of radical democratic education by addressing a key concept in Laclau and Mouffe’s Hegemony and Socialist Strategy: articulation. Through their concept of articulation, Laclau and Mouffe attempt to liberate Gramsci’s theory of hegemony from Marxist economism, and adapt it to a political sphere inhabited by a plurality of struggles and agents none of which is predominant. However, while for Gramsci the political process of hegemony formation has an explicit educational dimension, Laclau and Mouffe (...) ignore this dimension altogether. My discussion starts with elaborating the concept of articulation and analysing it in terms of three dimensions: performance, connection and transformation. I then address the role of education in Gramsci’s politics, in which the figure of the intellectual is central, and argue that radical democratic education requires renouncing that figure. In the final section, I offer a theory of such education, in which both teacher and students articulate their political differences and identities. (shrink)

This paper argues for the view that metaphors are assertions by locating metaphor within our social discursive practices of asserting and inferring. The literal and the metaphorical differ not in the stating of facts nor in the representation of states of affairs but in the kind of inferential involvements they have and the normative score-keeping practices within which the inferential connections are articulated. This inferentialist based account of metaphor is supplemented by insights from accommodation theory. This paper seeks to re-assess Dilthey’s descriptive psychology in light of the charge of “psychologism”. The paper has two goals. First, I seek to give a fine-grained reconstruction of Dilthey’s foundational project. I provide a systematic account of how Dilthey sought to ground the knowledge claims of the human sciences in inner experience. I place special emphasis on Dilthey’s concept of “articulation” which mediates between inner experience and psychological knowledge, as well as between individual psychology and knowledge about the (...) socio-historical world. Second, I re-assess the allegedly “psychologistic” aspects of Dilthey’s philosophy. I reconstruct how Dilthey’s critics Husserl, Windelband and Rickert understood psychologism, highlight commonalities between them and explain why Dilthey’s approach seemed “psychologistic” from their perspective. At the same time, I show that Dilthey’s philosophical thinking goes against the very presuppositions that the “psychologism”-charges are usually based upon. The paper concludes with some reflections on the transition from Dilthey's descriptive psychology to his mature hermeneutics. (shrink)

This article intends to show the distance between work-life balance as a political and social issue at the EU and Romanian level, through the lens of the local gender equality policies following the process of EU accession. The article provides, in its first part, a brief presentation of the main theoretical axes structuring the available literature, followed up by the analysis of the occurrence of the work-life balance issue at the European level. Then the study examines the normative dimension of (...) work-life balance in post-communist Romania, seeking to understand to what extent work-life balance policies have been designed and implemented in the last 25 years. For most interpreters of the philosopher from Rotterdam, his political doctrine is solely a consequence of his religious and moral doctrines, and so an image of Bayle as a political philosopher is not usually presented. To my mind, however, only by analyzing his political doctrine can the extent of his religious proposal be understood. In this article, I intend to show that both the Baylean criticism of popular sovereignty and his rejection of the right of resistance are analyses that are (...) indissociable from the Baylean doctrine of tolerance. The protection of individual freedom of conscience and the defense of a multi-confessional state model, tolerant regarding religious minorities, can only be articulated as historical reality if they rest on the political doctrine of indivisible sovereignty and on the strictest separation between political obedience and religious membership. Construite en patchwork et sans prétention à la systématicité théorique, elle repose, dans des contextes toujours différents, la problématique de la régulation normative de la vie et de la mort. Aussi, c’est en prenant au sérieux la marge constituante qu’y représente la question animale et par la (re)lecture de ses textes consacrés à l’étude (...) de pratiques esthétiques et artistiques, que cet article propose un décentrement théorique pour penser la question politique des corps qui comptent des animaux. Il étudie, de manière comparée, les happenings publics de L214, 269Life, 269 Libération Animale et Anonymous for the Voiceless. Il suggère que les choix esthétiques de ces différents collectifs reflètent et alimentent un certain regard politique porté sur la cause animale et sa finalité aussi bien que sur le genre de subjectivité politique attribuée ou non aux animaux non-humains. Il montre d’abord que les animaux constituent, chez Judith Butler, d’autres corps qui comptent : il s’agit alors d’introduire la diversité des outils théoriques de læ philosophe qui articulent la dimension publique, esthétique et souvent même artistique de la vie des corps avec la question du politique. C’est cette fondation qui lui permet, ensuite, de s’atteler à l’élaboration d’une cartographie des articulations esthético-politiques dans les performances militantes antispécistes. Y sont discutées une esthétique humanimale subversive et critique du binarisme humain/animal, une esthétique de l’« horreur morale » qui appelle au changement de comportement individuel par la mise en évidence de la violence, et une esthétique de la reconnaissance, qui valorise la possibilité d’une égalité radicale entre humains et non-humains dans le partage de la précarité de toute vie et du deuil public de chaque mort. There are two primary arguments against scientific realism, one pertaining to underdetermination, the other to the history of science. While these arguments are usually treated as altogether distinct, P. Kyle Stanford's ‘problem of unconceived alternatives’ constitutes one kind of synthesis: I propose that Stanford's argument is best understood as a broad modus ponens underdetermination argument, into which he has inserted a unique variant of the historical pessimistic induction. After articulating three criticisms against Stanford's argument and the evidence that he offers, (...) I contend that, as it stands, Stanford's argument poses no threat to contemporary scientific realism. Nonetheless, upon identifying two useful insights present in Stanford's general strategy, I offer an alternative variant of the modus ponens underdetermination argument, one that, although historically informed by science, requires no inductive premises. I contend that this non-inductive but historically informed variant of the modus ponens clarifies and considerably strengthens the case against scientific realism. (shrink)

New York City has extensive public health regulations. Some regulations aim to reduce smoking, and they include high cigarette taxes and bans on smoking in public places such as bars, restaurants, public beaches, and public parks. Other regulations aim to combat obesity. They include regulations requiring display of calorie information on some restaurant menus and the elimination of transfats in much public cooking. One important issue is whether New York City officials -- including both public health officials and other city (...) officials -- have adequately explained the justification to the public. Explanation has practical importance; the public might not back controversial and restrictive regulations unless offered a good rationale. But explanation is also an official duty, since public officials should make their reasoning transparent to their constituents. This article argues that New York City has not adequately communicated the rationales for its regulations to the public. It then offers several suggestions for improving public communication. After laying out those suggestions, this article points out that even if communication were improved, New York City’s regulations would still raise difficult philosophical issues. This paper elaborates a neo-Wittgensteinian, philosophical-anthropological alternative to classically Aristotelian approaches in the philosophy of friendship. On the classic approach, the value of friendship, as a practice, and the value of particular friendships within the life of any given individual, are each subordinated to the ur-value of individual flourishing. That is, it starts with a value that it sees as frustrated or fulfilled by social practice. The alternative, meanwhile, moves from the articulation of social practice to the values these (...) practices frame. I will argue that the alternative is descriptively and prescriptively superior when what’s at issue is the status of a social practice like friendship. By acknowledging the co-constitution of self, practice, and other, the alternative gives one the latitude to recognize and philosophize about relationships that tend to fall out of contemporary accounts of love and friendship as these are actually lived; produces descriptions and questions that are truer to lived experiences of friendship; and respects one of the most basic norms of friendship—that is, a friend’s irreducible particularity to oneself—without having to provide a self-defeatingly instrumentalist or reductionist argument for it. ABSTRACT This article develops an Arendtian conception of resentment and shows that resentment as a response to injustice is in fact only possible within a community of persons engaged in moral and recognitive relations. While Arendt is better known for her work on forgiveness—characterized as a creative rather than vindictive response to injury—this article suggests that Arendt provides a unique way of thinking about resentment as essentially a response to another human's subjectivity. But when injury is massive, so beyond the (...) pale that the possibility of face-to-face human interaction is annihilated, the space for resentment is thereby destroyed. Ironically, while the absence of resentment might at first seem to be an unproblematically good thing, Arendt shows us that the loss of resentment actually signals the loss of the properly human realm. S'étonnant qu'un simple physicien sache traiter des rapports de la physique et de la métaphysique, Edmond Domet de Vorges s'était demandé si Pierre Duhem n'avait pas bénéficié de l'aide de quelque théologien dans l'élaboration de son articulation de ces deux disci­plines. Faisant suite à cette question très perti­nente, cet article liste d'abord les intellectuels catholiques qui étaient en relation avec Duhem avant la publication, en 1893, de son article Physique et métaphysique et qui auraient effec­tivement pu l'aider à concevoir (...) une telle articulation. Se con­sacrant ensuite spécifiquement à l'un d'entre eux, à savoir Maurice Blondel, il étudie les similitudes et divergences existant entre les pensées du physicien bordelais et du philosophe d'Aix pour conclure que Blondel ne peut pas être celui qui aurait inspiré Duhem. À l'appui de cette conclusion, il fait notamment état d'une lettre inédite adressée par Duhem à Ambroise Gar­deil et dans laquelle celui-ci porte un jugement sévère à l'en­droit de son «pauvre ami» Blondel. ––– One might be surprised to find that a simple physician could be able explain with clarity the subtle relationship between physics and metaphysics. It is with this question in mind that Edmond Domet de Vorges asked himself if it might not have been with the aid of theologians that Pierre Duhem was able to find and express his subtle articulation between the two disciplines. Following in the footsteps of this pertinent question, this article begins by listing the catholic intellectuals who were acquain­tances of Pierre Duhem before the publication in 1893 of “Physique et métaphysique”, who may have been able to help him arrive at the relationship between the two sciences expressed in his publication. This line of questioning is followed by a specific study of one of these men, namely Maurice Blondel. The similarities and differences in the opinions of the physician from Bordeaux and the philosopher from Aix are explored with the resulting conclusion that Blondel could not have been he who inspired Duhem. This conclusion can be confirmed by a previously unpublished letter from Duhem to Ambroise Gardeil which contains a very severe judgement with regards to his “poor friend” Blondel. (shrink)

This dissertation articulates our human capacity to judge as a capacity for knowledge, specifically for empirical knowledge, and for knowledge of itself as such. I interpret and draw on the account of such knowledge presented by Kant’s Critique of Pure Reason, situate this account historically, and relate it to relevant contemporary debates. The first chapter motivates my project by assessing the insights and shortcomings of Cartesian epistemology. I argue that while Descartes draws on the essential self-consciousness of judgement to show (...) that the cogito is knowledge, he fails, by his own standards, to secure this status for any judgement beyond the cogito. I conclude that self-consciousness alone is empty, but that, since we can judge beyond the cogito, judgement can be given content from elsewhere. The next chapter evaluates the empiricist doctrine that operations of the senses by themselves give content to judgement and can vindicate it as empirical knowledge. I contend that Kant deepens Hume’s finding, that empiricism fails to enable us to explain empirical knowledge, into the more radical insight that empiricism fails to enable us to understand the senses as providing any content. I conclude that the senses alone are blind and that our account of empirical knowledge must privilege neither sensory givenness nor intellectual self-consciousness. The third chapter contrasts two readings of Kant on the cooperation between sensibility and understanding in empirical knowledge. I argue, against many Kantians, that the Transcendental Deduction shows that instead of understanding this cooperation compositionally – so that operations of sensibility are intelligible independently of acts of the understanding – we must conceive of it hylomorphically – so that the operations of sensibility and understanding constitute the mutually dependent matter and form of empirical knowing respectively. The final chapter substantiates this hylomorphism by explicating the form of knowledge as synthesis. Following Kant, I argue that inference is a species of synthesis and provide a synthetic explanation of inference. The resulting account simultaneously illustrates synthesis, addresses a prominent contemporary problem regarding the nature of inference, and explains how our capacity to know provides not just isolated glimpses of empirical reality, but a unified conception of it. This essay presents an ideal for modern Western romantic love.The basic ideas are the following: people want to form a distinctive sort of plural subject with another, what Nozick has called a "We", they want to be loved for properties of certain kinds, and they want this love to establish and sustain a special sort of commitment to them over time.

This article deals with Bartolome´ de Las Casas’ contribution to the notion of universal human rights. Though much study has been devoted to Las Casas’ work, what remains understudied is the Spanish philosopher’s conception of religion, which in many ways resembles what Kant called “the religion of reason.” For Las Casas, then, Christianity was conceived more as a rational system of ethics than as a compendium of Biblical and scholastic dogmas. Like the later Enlightenment philosopher Johann Gottlieb Fichte, Las Casas (...) believed that all humans belonged to the same universal community of rational beings. By examining Las Casas together with Fichte, this article sheds further light on Las Casas’ anticipatory notions of moral agency, formal freedom, rational religion, and the rights of a free people against the use of coercion—regardless of their race, religion, or culture. They are the ideas underpinning his notion of universal human rights (Paulist and Thomist in nature), and his ethics of the Other, who “is just like me”: a rational, feeling human being, deserving of equal justice and rights. This work establishes that the primary justification for the state is its role as the guarantor of last resort of the personal safety, liberty and property of the citizens. The essay upholds that the state exists fundamentally for the protection of life and property and ensuring the wellbeing of the citizens and unless it performs this basic function it has no reason to exist. The essay equally establishes that no other time since the civil war era has Nigeria's state been (...) seriously engulfed in perennial security challenges than now. It is the stand of this essay that the current trend of violence imprints on the psyche of Nigerians that the government security apparatus is incapable of guaranteeing the security, safety and wellbeing of the people. It is the candid opinion of this essay that the paradox of Nigeria's state security is that instead of the state being a framework of lawful order and the highest source of authority, it now constitutes the greatest threat to itself. The essay submits that peaceful protest is against the ruling elite that has exploited and appropriated the collective patrimony to itself. It substantiates the legality of EndSARS Protest necessitated by the improprieties of the unit of Nigeria Police Force – Special Anti-Robbery Squad (SARS) against human rights violation, extortion, torture brutality and extra-judicial killings by SARS due to sustained years of leadership deficit in Nigeria. The protest though hijacked by hoodlums is a wake-up call for articulation of good leadership and governance in Nigeria. Philosophers sometimes wonder whether academic work can ever be truly interdisciplinary. Whether true interdisciplinarity is possible is an open question, but given current trends in higher education, it seems that at least gesturing toward such work is increasingly important. This volume serves as a testament to the fact that such work can be done. Of course, while it is the case that high-level theoretical work can flourish at the intersection of dance and philosophy, it remains to be seen how we (...) might share this with undergraduate students. For many of us in philosophy and dance, a large number of the students we teach are neither philosophy nor dance majors. As such, we are familiar with the challenge of convincing our students to care about our fields. Both philosophy and dance, qua disciplines on a college campus, face similar challenges. These disciplines are often deeply misunderstood, frequently presumed to be “impractical” (a powerful, but confused objection), intimidating, and frivolous. In this chapter, we offer an account of the course we co-taught at Southern Utah University in the Spring of 2016 titled “Movement and Space” as a rough framework for how to introduce the intersection between philosophy and dance to students. We simultaneously attempted to break students of their misconceptions about philosophy and dance, and worked to engage students and professors alike in a truly interdisciplinary educational experience. Treating philosophy as an embodied endeavor, and employing philosophical concepts through the act of dance encouraged students and faculty alike to rethink the fundamental nature of aesthetics. Nous ralliant à la perspective ouverte par Gontier, nous souhaitons dans cet article examiner la formation de cet égoïsme vertueux à l’aune des influences que les guerres de Religion ont eu sur la pensée politique et morale de Montaigne. Sur la base d’un bref rappel de l’histoire du républicanisme, nous tentons, (...) dans un premier temps, de montrer pourquoi les idéaux républicains et les valeurs qui les accompagnent ne sont plus de mise dans le contexte français du XVIe siècle. Cela nous permet, dans un second temps, d’exposer comment Montaigne, afin de répondre à la crise sociale, déploie une pensée qui, reconnaissant l’importance du bien public, mise néanmoins avant tout sur la conquête de soi. In addition to providing a rebuttal of the “paper-doubts” of the would-be skeptic, pragmatists have also been quite responsive to the social dimensions of doubt. This is true concerning the causes of doubt. This is true also regarding its consequences: doubt has consequences on epistemic trust; on the way we discuss truths, either about the sciences or about the “construction of good”. Readers of Dewey’s The Quest for Certainty and of some of his most important political writings can easily see (...) how practical uncertainty can degenerate into practical and political skepticism, preventing the emergence of the public. This social aspect of the question has received less attention, perhaps, than the general pragmatist stance towards skepticism, and the present symposium offers a rst round of insights into this aspect of the question: the papers retrieved below all cast light on important aspects of the debate on justi cation, on scienti c dogmatism, on irony and skepticism, on doubt and legal theory, on skepticism and political anarchism. This essay is titled "Critique the Postulation of the Historical Law Theory and relate it to African Law. The postulation of the historical law school that law emanates from customs through an ordered pattern of systematized progress into a codified system in relation to African law forms the crust of this essay. To achieve this task, this essay adopts a critical method in exposing c postulation of the historical law school and the African Law (keeping in mind the Ukelle communal (...) Law System). This essay questions whether there can be an independent law made or promulgated without targeting a given people or that there can be a people-free law? This essay claims that like the historical law school, laws emanate from their ground norms but insists that unlike the historical law school, laws in Ukelle Traditional System do not necessarily have to submit to through the rigor of systematic and strict evolutionary pattern of progress. Like Herder, this essay avers that there is a unique character with each culture, and as such Ukelle Traditional Law does not have to submit to any universal character of law. (shrink)

Alexander Bird indicates that the significance of Thomas Kuhn in the history of philosophy of science is somehow paradoxical. On the one hand, Kuhn was one of the most influential and important philosophers of science in the second half of the twentieth century. On the other hand, nowadays there is little distinctively Kuhn’s legacy in the sense that most of Kuhn’s work has no longer any philosophical significance. Bird argues that the explanation of the paradox of Kuhn’s legacy is that (...) Kuhn took a direction opposite to that of the mainstream of the philosophy of science in his later academic career. This paper aims to provide a new way to understand and develop Kuhn’s legacy by revisiting the development of Kuhn’s philosophy of science in 1970s and proposing a new account of exemplar. Firstly, I propose my diagnosis of Kuhn’s “wrong turning” by identifying Kuhn’s two novel contributions: the introduction of paradigm and the proposal of the incommensurability thesis. Secondly, I argue that Kuhn made a conceptual/terminological turn from paradigm to theory, which undermined Kuhn’s novel contributions. Thirdly, I propose a new articulation of exemplar and propose an exemplar-based approach to analysing the history of science. Finally, I show how the exemplar-based approach can be applied to analyse the history of science by my case study of the early development of genetics. (shrink)

Although previous treatments of affective injustice have identified some particular types of affective injustice, the general concept of affective injustice remains unclear. This article proposes a novel articulation of this general concept, according to which affective injustice is defined as a state in which individuals or groups are deprived of “affective goods” which are owed to them. On this basis, I sketch an approach to the philosophical investigation of affective injustice that begins by establishing which affective goods are fundamental, (...) and then considers which subsidiary goods—such as freedoms, resources, opportunities, and forms of recognition—may be necessary for the provision of those fundamental affective goods. Drawing from and developing ideas in the extant literature, I argue that two such fundamental affective goods include subjective well-being and emotional aptness. I then show that by analyzing deprivations of the subsidiary goods that enable a person to pursue and attain subjective well-being and emotional aptness, it is possible to shed new light on the cases of affective injustice that have been described in the extant literature, while also identifying other kinds of cases that have not been theorized to the same extent. Implicit in much of the recent literature on conceptual engineering and conceptual ethics is the assumption that when speakers argue that we should talk or think about a concept in a specific way, they are doing so as inquirers—as speakers who are invested in arriving at the correct or best view of this concept. In this paper I question that assumption and argue that philosophers have been too quick to project idealized versions of themselves into the contexts of conceptual (...) class='Hi'>articulation and conceptual dispute. Speakers often engage in this activity to further interests of theirs that have nothing to do with inquiry, instead carrying out what I call ‘conceptual domination’. Speakers are engaged in conceptual domination when they aim to bring about and enforce widespread uptake for a view of a concept by exploiting institutions and institutional authority. They do so because this view best serves interests that are either irrelevant to or actively interfere with inquiry concerning this concept—paradigmatically their material interests. I consider sources of evidence for assessing whether speakers are engaging in conceptual domination, analyze two case studies, and consider how to push back against conceptual dominators. (shrink)

In this essay I address the question, “What is the subject matter of phenomenological research?” I argue that in spite of the increasing popularity of phenomenology, the answers to this question have been brief and cursory. As a result, contemporary phenomenologists lack a clear framework within which to articulate the aims and results of their research, and cannot easily engage each other in constructive and critical discourse. Examining the literature on phenomenology’s identity, I show how the question of phenomenology’s subject (...) matter has been systematically neglected. It has been overshadowed by an unending concern with phenomenology’s methodological identity. However, an examination of recent contributions to this literature reveals that a concern with articulating phenomenology’s subject matter has gradually increased, although such articulations remain preliminary. In light of this, I delineate, define, and illustrate three layers of phenomenological research, which I term “existentials,” “modes,” and “prejudices.” While the delineation of these layers is drawn primarily from classical phenomenological texts, they are defined and illustrated through the use of more contemporary literature. Following the articulation of this subject matter, I briefly consider some of the debates—both foundational and applied—that can be facilitated by the adoption of this framework. (shrink)

This paper examines the differences between moralist, realist, and pragmatist approaches to political legitimacy by articulating their largely implicit views of judgment. Three claims are advanced. First, the salient opposition among approaches to legitimacy is not between “moralism” and “realism.” Recent realist proposals for rethinking legitimacy share with moralist views a distinctive form, called “normativism”: a quest for knowledge of principles that solve the question of legitimacy. This assumes that judging legitimacy is a matter of applying such principles to a (...) case at hand. Second, neither Rawls nor Habermas is a normativist about political legitimacy. The principles of legitimacy they proffer claim to express rather than adjudicate the legitimacy of a liberal-democratic regime, and thus cannot solve the question of legitimacy at a fundamental level. But perhaps we should question the normativist aspiration to theoretically resolving the problem to begin with. My third claim is that a “pragmatist” approach enables us to rethink political legitimacy more deeply by shifting focus from the articulation of principles to the activity of judging. Implicit in Rawls’s and Habermas’s theories I then find clues towards an alternative account of judgment, in which the question of legitimacy calls not for theoretical resolution but for ongoing practical engagement. The idea of dignity is pervasive in political discourse. It is central to human rights theory and practice, and it features regularly in conceptions of social justice as well as in the social movements they seek to understand or orient. However, dignity talk has been criticized for leading to problematic exclusion. Critics challenge it for undermining our recognition of the rights of non-human animals and of many human individuals (such as children, the elderly, and people with disabilities). I argue that, (...) on a plausible articulation of it, the idea of dignity does not lead to these exclusions and that it in fact helps defend an appropriately inclusive moral and political treatment of all individuals. Difficult issues about equality and diversity indeed arise, but a dignitarian approach can provide good answers to them or at least help make them clearer and more tractable. (shrink)

The Parmenides is arguably the pivotal text for understanding the Platonic corpus as a whole. I offer a critical analysis that takes as its key the closely constructed dramatic context and mimetic irony of the dialogue. Read with these in view, the contradictory characterizations of the "one" in the hypotheses dissolve and reform as stages in a systematic response to the objections that Parmenides earlier posed to the young Socrates' notions of forms and participation, potentially liberating Socrates from his dependence (...) on sensible simile and yielding a distinctively conceptual articulation of the difference and relation of forms and their sensible participants. The dialogue as a whole thereby functions as the means for the "conversion" of the soul to eidetic being for which Plato has the elder Socrates call in Republic VII. (shrink)

The paper examines the justification of warfare. The main thesis is that war is very difficult to justify, and justification by invoking “justice” is not the way to succeed it. Justification and justness are very different venues: while the first attempts to explain the nature of war and offer possible schemes of resolution, the second aims to endorse a specific type of warfare as correct and hence allowed – which is the crucial part of “just war theory.” However, “just war (...) theory,” somewhat Manichean in its nature, has very deep flaws. Its final result is criminalization of war, which reduces warfare to police action, and finally implies a very strange proviso that one side has a right to win. All that endangers the distinction between ius ad bellum and ius in bello, and destroys the collective character of warfare. Justification of war is actually quite different – it starts from the definition of war as a kind of conflict which cannot be solved peacefully, but for which there is mutual understanding that it cannot remain unresolved. The aim of war is not justice, but peace, i.e. either a new articulation of peace, or a restoration of the status quo ante. Additionally, unlike police actions, the result of war cannot be known or assumed in advance, giving war its main feature: the lack of control over the future. Control over the future, predictability, is a feature of peace. This might imply that war is a consequence of failed peace, or inability to maintain peace. The explanation of this inability forms the justification of war. Justice is always an important part of it, but justification cannot be reduced to it. The logic contained here refers to ius ad bellum, while ius in bello is relative to various parameters of sensitivity prevalent in a particular time, with the purpose to make warfare more humane and less expensive. Since the 1990s the so-called transparency of experience has played a crucial role in core debates in philosophy of mind. However, recent developments in the literature have made transparency itself quite opaque. The very idea of transparent experience has become quite fuzzy, due to the articulation of many different notions of transparency and transparency theses. Absent a unified logical space where these notions and theses can be mapped and confronted, we are left with an overall impression of conceptual chaos. (...) This is a problem, given the constant and ubiquitous references to transparency in the literature and its prominent position in the contemporary philosophy of mind. My goal in this paper is to restore clarity through proper analysis of the mutual relations between the different transparency theses. This allows me to uncover a unitary multidimensional logical space where existing (as well as possible) views can be properly singled out and located. (shrink)

The majority of studies on absorptive capacity (AC) underscore the importance of absorbing technological knowledge from other firms to create economic value. However, to preserve moral legitimacy and create social value, firms must also discern and adapt to (shifts in) societal values. A comparative case study of eight firms in the food industry reveals how organizations prioritize and operationalize the societal value health in product innovation while navigating inter- and intravalue conflicts. The value-sensitive framework induced in this article extends AC (...) by explaining how technically savvy, economic value–creating firms diverge in their receptivity, articulation, and reflexivity of societal values. Many normative judgments play a practical role in our thought. This paper concerns how their practical role is reflected in language. It is natural to wonder whether the phenomenon is semantic or pragmatic. The standard assumption in moral philosophy is that at least terms which can be used to express “thin” normative concepts – such as 'good', 'right', and 'ought' – are associated with certain practical roles somehow as a matter of meaning. But this view is rarely given explicit defense (...) or even articulation. I’ll consider several versions of the view, and argue that even the most promising among them are problematic. Terms like 'ought' are often used in ways where their customary practical role is absent. Such cases give us a choice: either offer some plausible explanation of why the relevant practical upshots don’t show up in these cases despite featuring in our semantic theory for these expressions, or else don’t build them into that theory. I argue that plausible explanations of the requisite sort aren’t forthcoming in either descriptive semantics or metasemantics for normative language. In closing I briefly consider the prospects for a pragmatic account of the phenomenon and some broader ramifications for metaethics and the philosophy of normativity. (shrink)

Is understanding epistemic in nature? Does a correct account of what constitutes understanding of a concept mention epistemological notions such as knowledge, justification or epistemic rationality? We defend the view that understanding is epistemic in nature – we defend epistemological conceptions of understanding. We focus our discussion with a critical evaluation of Tim Williamson's challenges to epistemological conceptions of understanding in The Philosophy of Philosophy. Against Williamson, we distinguish three kinds of epistemological conceptions and argue that Williamson's arguments succeed against (...) only the most heavily committed kind, and leave the less heavily committed kinds untouched. Further, we argue that Williamson's elaboration of lessons from his arguments point in a direction opposite of his own conclusions and give vivid articulation and support to epistemological conceptions. We suggest also that skepticism about Williamson's larger metaphilosophical conclusions – according to which understanding plays no special role in the epistemology of philosophy – may be in order. According to the Guise of the Good, an agent only does for a reason what she sees as good. One of the main motivations for the view is its apparent ability to explain why action for a reason must be intelligible to its agent, for on this view, an action is intelligible just in case it seems good. This motivation has come under criticism in recent years. Most notably, Kieran Setiya has argued that merely seeing one’s action as good does (...) not suffice to make the action intelligible. In this paper, I show that this objection has bite only because the Guise of the Good’s theory of intelligibility has yet seen little sustained articulation. Properly understood, this theory holds that an action is intelligible to an agent only if it appears to them to possess some substantive evaluative property. I then argue that this response to the objection has a significant implication for contemporary Guise of the Good theories, for it shows that the currently ascendant version of the theory, the attitudinal theory, cannot avail itself of the intelligibility motivation. The conceptualisation of kinship and its study remain contested within anthropology. This paper draws on recent cognitive science, developmental cognitive psychology, and the philosophy of science to offer a novel argument for a view of kinship as progeneratively or reproductively constrained. I shall argue that kinship involves a form of extended cognition that incorporates progenerative facts, going on to show how the resulting articulation of kinship’s progenerative nature can be readily expressed by an influential conception of kinds, the homeostatic (...) property cluster view. Identifying the distinctive role that our extended cognitive access to progenerative facts plays in kinship delivers an integrative, progenerativist view that avoids standard performativist criticisms of progenerativism as being ethnocentric, epistemically naïve, and reductive. Anscombe famously argues that to act intentionally is to act under a description, and that “it is the agent's knowledge of what he is doing that gives the descriptions under which what is going on is the execution of an intention.” Further, she takes ‘knows’ to mean that the agent can give these descriptions herself. It would seem to follow that animals cannot act intentionally. However, she denies this, insisting that although animals cannot express intentions, they can have them. But (...) how can we speak without equivocation of humans and animals acting intentionally while maintaining that linguistic expressibility is an essential characteristic of only human action? The human capacity for articulation, I argue, transforms animal intention in the following way: Whereas animal intentions are immanent in their behavior, human action is an actualization of the power to make judgments about what is to-be-done; this confers on human intentions a distinctive sort of independence from behavior. Within contemporary evangelical theology, a peculiar controversy has been brewing over the past few decades with regard to the doctrine of the Trinity. A good number of prominent evangelical theologians and philosophers are rejecting the doctrine of divine processions within the eternal life of the Trinity. In William Hasker’s recent Metaphysics and the Tri-Personal God, Hasker laments this rejection and seeks to offer a defense of this doctrine. This paper shall seek to accomplish a few things. In section I, I (...) shall first set the stage for a proper understanding of the discussion. Section II will articulate the basic Trinitarian desiderata that must be satisfied by any model of the doctrine of the Trinity. This will help one understand the debate between Hasker and the procession deniers. Section III will offer an articulation of what the doctrine of divine processions teaches. Section IV will examine Hasker’s defense of the doctrine point by point. I shall argue that his defense of the doctrine of the divine processions fails. (shrink)

This paper offers a brand storytelling, that is a narratological account of Covid-19 pandemic’s emergence phase. By adopting a fictional ontological standpoint, the virus’ deploying media story-world is identified with a process of narrative spacing. Subsequently, the brand’s personality is analyzed as a narrative place brand. The narrative model that is put forward aims at outlining the main episodes that make up the virus’ brand personality as process and structural components (actors, settings, actions, relationships). A series of deep or ontological (...) metaphors are singled out as the core DNA of this place brand, by applying metaphorical modeling to the tropical articulation of Covid-19’s narrative. The virus’ kernel is identified with terror, as a menacing force that wipes out existing regimes of signification due to its uncertain motives, origins and operational mode. In this context, familiar urban spaces, cultural practices and intersubjective communications are redefined, repurposed and reprogrammed. This process is called terrorealization, as the desertification and metaphorical sublation of all prior territorial significations. This study contributes to the narrative sub-stream of place branding by approaching a globally relevant sociocultural phenomenon from a brand storytelling perspective. (shrink)

Debates on the practical relevance of ideal theory revolve around Sen's metaphor of navigating a mountainous landscape. In *The Tyranny of the Ideal*, Gerald Gaus presents the most thorough articulation of this metaphor to date. His detailed exploration yields new insight on central issues in existing debates, as well as a fruitful medium for exploring important limitations on our ability to map the space of social possibilities. Yet Gaus's heavy reliance on the navigation metaphor obscures questions about the reasoning (...) by which ideal theories are justified. As a result, Gaus fails to notice the ways in which his theory of the Open Society resembles the ideal theories he aims to dismiss. Ironically, Gaus winds up neglecting the ways in which the Open Society might tyrannize our efforts to realize greater justice. By creating certain marks on paper, or by making certain sounds-breathing past a moving tongue-or by articulation of hands and bodies, language users can give expression to their mental lives. With language we command, assert, query, emote, insult, and inspire. Language has meaning. This fact can be quite mystifying, yet a science of linguistic meaning-semantics-has emerged at the intersection of a variety of disciplines: philosophy, linguistics, computer science, and psychology. Semantics is the study of meaning. But what exactly is (...) "meaning"? What is the exact target of semantic theory? Much of the early work in natural language semantics was accompanied by extensive reflection on the aims of semantic theory, and the form a theory must take to meet those aims. But this meta-theoretical reflection has not kept pace with recent theoretical innovations. This volume re-addresses these questions concerning the foundations of natural language semantics in light of the current state-of-the-art in semantic theorising. (shrink)
