Based on a critical interpretative review of existing qualitative research investigating accounts of ‘lived experience’ of surrogates and intended parents from a relational perspective, this article proposes a typology of surrogacy arrangements. The review is based on the analysis of 39 articles, which belong to a range of different disciplines (mostly sociology, social psychology, anthropology, ethnology, and gender studies). The number of interviews in each study range from as few as seven to over one hundred. Countries covered include Australia, (...) Canada, Greece, India, Iran, Israel, Italy, Mexico, Norway, Russia, Sweden, UK, Ukraine, and the USA. Most studies focus only on surrogacy practices in one country (although often with intended parents from other countries), and some include several countries (e.g. interviewees from several countries or fieldwork in different field-sites). The proposed typology goes beyond the division between altruistic versus commercial, and traditional versus gestational surrogacy, in order to inform further research and to contribute to bioethical and policy debates on surrogacy in a transnational context. Four types of relations are identifiable: open, restricted, structured, and enmeshed. The criteria which influence these relationships are: the frequency and character of contact pre- and post-birth; expectations of both parties; the type of exchange involved in surrogacy arrangements; and cultural, legal, and economic contexts. The theoretical contribution of the article is to further the development of a relational justice approach to surrogacy. (shrink)

Strauss’s analysis of Machiavelli is both about his argument and action. He looks Machiavelli’s argument through the lens of classicalpolitical philosophy especially Plato’s political philosophy. He believed Machiavelli had not achieved important theoretical innovation. He looks Machiavelli’s action through the lens of modernity. He believed Machiavelli’s political thought did not perform a good function as it did in the last several centuries any more. Moreover, Strauss supplement Machiavelli’s political thought with a discussion of the problem of technique. Strauss’s caution of (...) the technical innovation makes sense, but his distinction between theoretical science and technique is not convincing. (shrink)

Background Genomic research on neurodevelopmental disorders (NDDs), particularly involving minors, combines and amplifies existing research ethics issues for biomedical research. We performed a review of the literature on the ethical issues associated with genomic research involving children affected by NDDs as an aid to researchers to better anticipate and address ethical concerns. Results Qualitative thematic analysis of the included articles revealed themes in three main areas: research design and ethics review, inclusion of research participants, and communication of research results. Ethical (...) issues known to be associated with genomic research in general, such as privacy risks and informed consent/assent, seem especially pressing for NDD participants because of their potentially decreased cognitive abilities, increased vulnerability, and stigma associated with mental health problems. Additionally, there are informational risks: learning genetic information about NDD may have psychological and social impact, not only for the research participant but also for family members. However, there are potential benefits associated with research participation, too: by enrolling in research, the participants may access genetic testing and thus increase their chances of receiving a (genetic) diagnosis for their neurodevelopmental symptoms, prognostic or predictive information about disease progression or the risk of concurrent future disorders. Based on the results of our review, we developed an ethics checklist for genomic research involving children affected by NDDs. Conclusions In setting up and designing genomic research efforts in NDD, researchers should partner with communities of persons with NDDs. Particular attention should be paid to preventing disproportional burdens of research participation of children with NDDs and their siblings, parents and other family members. Researchers should carefully tailor the information and informed consent procedures to avoid therapeutic and diagnostic misconception in NDD research. To better anticipate and address ethical issues in specific NDD studies, we suggest researchers to use the ethics checklist for genomic research involving children affected by NDDs presented in this paper. James Kreines's Reason in the World (2015) offers an engaging and thought-provoking examination of Hegel's ambitions in the Science of Logic. However, it has gone unnoticed that there are two fundamental misinterpretations in his account of ‘Mechanism’ from the Logic. First, Kreines interprets the chapter as beginning with a ‘pure mechanism’ hypothesis that investigates the coherence of a purely mechanistic explanation of the world that makes no appeal to the immanent concept of things. Thus, according to Kreines, the Concept is (...) absent from the beginning of ‘Mechanism’ and only appears in the final section of the chapter, in ‘C. Absolute Mechanism’ in the subsection on the law, what Kreines conceptualizes as ‘reasonable mechanism’. Second, within his overall interpretation of ‘Mechanism’ as the development from the ‘pure mechanism’ hypothesis to ‘reasonable mechanism’ Kreines claims that there are logical moments that are explanatorily relevant and some that are not. Thus, Kreines will want to claim that Hegel's analysis of ‘pure mechanism’ reveals that ‘pure mechanism’ fails to be explanatorily relevant because, a) the logical moments do not have a concept immanent to them, and b) have ‘indifference’. It is only in the law that mechanistic explanations become explanatorily relevant because of the appearance of the Concept and the disappearance of ‘indifference’. I argue against both these positions. First, I think that there is no textual support for the idea that ‘Mechanism’ begins without the Concept immanent to it. Second, I think that Kreines is mistaken to equate ‘indifference’ with explanatory irrelevance and the absence of the Concept. My approach in this paper is to give my own analysis of the relevant passages from ‘Mechanism’ and, in doing so, to both show the misgivings of Kreines's interpretation and to offer an alternative way of reading the chapter. Interpreting J.L. Austin: Critical Essays Edited by TsohatzidisSavas L.Oxford University Press, 2018. xii + 238 pp.

In a recent paper, Francis Y. Lin proposes a “memory-challenge” to two main interpretations of Wittgenstein’s private language argument: the “no-criterion-of-correctness” interpretation and the “no-stage-setting” interpretation. According to Lin, both camps of interpretation fail to explain why a private language is impossible within a short time period. To answer the “memory-challenge”, Lin motivates a grammatical interpretation of the private language argument. In this paper, I provide a critical discussion of Lin’s objection to these interpretations and (...) argue that Lin’s objection fails. In the case of the “no-stage-setting” interpretation, Lin suggests that the private language user can establish a stage within a short time period. However, I show that this stage is insufficient for a private language to be used correctly. In the case of the “no-criterion-of-correctness” interpretation, Lin believes that since memory is reliable within a short period, no criterion is needed for the correct use of a private language. However, I argue that his objection attacks a strawman, since the interpretation concerns the structure of justification, rather than the weakness of memory itself. I conclude with a critical discussion on memory and primitive expressions, the latter of which are crucial to Wittgenstein’s approach to public language. This discussion will help to draw a sharp line between private language and public language, and cast some doubt on Lin’s grammatical interpretation. (shrink)

This collection is the first volume published by Cambridge University Press devoted exclusively to Schelling scholarship. It contains eleven essays on diverse topics in Schelling’s philosophy, covering the entirety of his philosophical development, but mostly focusing on writings up to 1815. A number of the contributors are well-established scholars best known for their work on other thinkers in German Idealism. The volume thus offers readings of Schelling that are especially sensitive to his relationship to other figures in classical German philosophy. (...) Perhaps the richest contribution in the volume is Manfred Frank’s essay on Schelling’s theory of identity, which covers the theory’s historical sources, its application to the mind-body problem, and Schelling’s disagreement with Hegel. In a beautiful recent essay, the philosopher Walter Sinnott-Armstrong explains the reasons for his departure from evangelical Christianity, the religious culture in which he was brought up. Sinnot-Armstrong contrasts the interpretive methods used by good philosophers and fundamentalist believers: Good philosophers face objections and uncertainties. They follow where arguments lead, even when their conclusions are surprising and disturbing. Intellectual honesty is also required of scholars who interpret philosophical texts. If I had distorted Kant’s view to make him reach a conclusion (...) that I preferred, then my philosophy professor would have failed me. The contrast with religious reasoning is stark. My Christian friends seemed happy to hide serious problems in the Bible and in their arguments. They preferred comfort to intellectual honesty. I couldn’t. To what extent can we, historians of philosophy, claim the virtue of intellectual honesty? Speaking frankly, I do not find the practice criticized by Sinnot-Armstrong’s philosophy professor rare or unusual at all. We very frequently distort the views of past philosophers in order to reach the conclusions we prefer. We just call it “Charitable Interpretation.” In this essay, I discuss and criticize the logic behind so-called charitable interpretations in the history of philosophy. This phenomenon is ubiquitous and is not at all restricted to a particular philosophical strand or ideology. Analytic philosophers and post-modernists, Marxists, liberals, secularists, and fundamentalists, we all engage in the very same domestication project. Even more disturbing than the sheer ideological pervasiveness of this phenomenon is the fact that, on many occasions, superb philosophers and historians take part in this fairly childish endeavor. In the first part of this essay, I discuss the general logic of charitable interpretations in the history of philosophy, mostly by addressing discussions in metaphysics and epistemology. In the second part, I focus on the somewhat less noticed use of charitable interpretations in the study of political philosophy, and point out the quintessential role ideology plays in these discussions. In both parts, I concentrate mostly on the interpretation of Spinoza’s thought. I do so not because I have special fondness for Spinoza (“guilty as charged,” I admit), but because Spinoza is such a beast (and may I add, an enchanting beast) and attracts a disproportionate share of the domestication efforts from historians and philosophers of all creeds and persuasions. In the third and final part of the paper, I will begin to outline an alternative methodology, which suggests that past philosophers can be most relevant to our current philosophical discussion, to the extent that they provide us with well-motivated challenges to our common-sense beliefs. Such challenges have the invaluable virtue of being able to undermine our most fundamental and secure beliefs, and force us to engage with the most fundamental questions. Philosophers of music commonly distinguish performative from critical interpretations. I would like to suggest that the distinction between critical and performative interpretations is well captured by an analogy to legal critics and judges. This parallel draws attention to several features of performative interpretation that are typically overlooked, and deemphasizes epistemic problems with performative interpretations that I believe are typically blown out of proportion and ultimately fail to capture interesting features of performative interpretation. There is an important (...) distinction to be made between critical and performative interpretation, but its source lies in a difference between the authority of critical and performative interpretations. Recent debates over artificial intelligence have focused on its perceived lack of interpretability and explainability. I argue that these notions fail to capture an important aspect of what end-users—as opposed to developers—need from these models: what is needed is systematicity, in a more demanding sense than the compositionality-related sense that has dominated discussions of systematicity in the philosophy of language and cognitive science over the last thirty years. To recover this more demanding notion of systematicity, I distinguish between (i) the (...) systematicity of thinkable contents, (ii) the systematicity of thinking, and (iii) the ideal of systematic thought. I then deploy this distinction to critically evaluate Fodor’s systematicity-based argument for the language of thought hypothesis before recovering the notion of the systematicity of thought as a regulative ideal, which has historically shaped our understanding of what it means for thought to be rational, authoritative, and scientific. To assess how much systematicity we need from AI models, I then argue, we must look to the functions of systematizing thought. To this end, I identify five functions served by systematization, and show how these can be used to arrive at a dynamic understanding of the need to systematize thought that can tell us what kind of systematicity is called for and when. Aldo Leopold’s A Sand County Almanac emphasizes values of receptivity and perceptivity that appear to be mutually reinforcing, critical to an ecological conscience, and cultivatable through concrete and embodied experience. His priorities bear striking similarities to elements of the ethics of care elaborated by feminist philosophers, especially Nel Noddings, who notably recommended receptivity, direct and personal experience, and even shared Leopold’s attentiveness to joy and play as sources of moral motivation. These commonalities are so fundamental that ecofeminists can and (...) should see Leopold as a philosophical ally. The three ecofeminist scholars who have devoted the most concerted attention to Leopold’s work argue that his Land Ethic is not, and does not provide a basis for, an ecofeminist ethic. I dispute the main criticisms of these scholars, and conclude that ecofeminists should attend more often to Leopold’s work, which extends possibilities for excellent praxis. (shrink)

Science is founded on a method based on critical thinking. A prerequisite for this is not only a sufficient command of language but also the comprehension of the basic concepts underlying our understanding of reality. This constraint implies an awareness of the fact that the truth of the World is not directly accessible to us, but can only be glimpsed through the construction of mod- els designed to anticipate its behaviour. Because the relationship between models and reality rests on (...) the interpretation of founding postulates and in- stantiations of their predictions (and is therefore deeply rooted in language and culture), there can be no demarcation between science and non-science. However, critical thinking is essential to ensure that the link between models and reality is gradually made more adequate to reality, based on what has already been established, thus guaranteeing that science progresses on this basis and excluding any form of relativism. This essay explains various significant errors, imprecisions, and omissions concerning libertarianism in Long 2013. The “right not to be aggressed against” is not, as such, the libertarian right because the ‘right to liberty’ must be that right (although not being aggressed against can charitably be interpreted as equivalent). There are non-libertarian rights, but they don’t override the right to liberty. Unsupported assumptions are inevitable because justifications are impossible. Rights should not be “defined” but, rather, morally and metaphysically theorised—with criticism permanently (...) invited. Moral and legal permissibility need to be clearly distinguished. The conceptions of “aggression” and “force” are normative and confused. It is possible to advocate the right to liberty on no grounds whatsoever and also to conjecture that liberty (deontologically) and welfare (consequentially) are systematically compatible in practice for theoretical and causal reasons. The rejection of positive rights is “privileging” and not “conceptual”. Libertarian property needs to be derived from an explicit, non-normative, theory of libertarian liberty. Long 2013’s overall account is “mysterious” and “one-sided”. (shrink)

In our paper "Surface and Deep Interpretation," we sought to provide detail and texture to Arthur Danto's views on interpretation, thereby explicating and defending them (as published in Mark Rollins, ed., Danto and His Critics (Blackwell, originally published 1993; second edition 2012). Leddy objects to our views; in the end, Danto's view, given our explication of it, remains tenable.

One of the key insights of Simone de Beauvoir’s The Second Sex is the idea that gender-based subordination is not just something done to women, but also something women do to themselves. This raises a question about ethical responsibility: if women are complicit, or actively implicated in their own oppression, are they at fault? Recent Beauvoir scholarship remains divided on this point. Here, I argue that Beauvoir did, in fact, ethically criticize many women for their complicity, as a sign of (...) what she called “bad faith”. I challenge recent accounts by Nancy Bauer and Manon Garcia, who both read Beauvoir as exonerating complicit women. According to this reading, women emerge as human “freedoms” within a social world where a “destiny” of inferiority is already prepared for them. Their self-subordination is then an inevitable product of acting in a patriarchal world. I argue, however, that this interpretation generates a crucial tension, leading Bauer and Garcia to call on women to stop being complicit, while also claiming they cannot avoid complicity. I propose instead a different interpretation, on which feminine complicity is often fueled by criticizable ethical attitudes that are far from inevitable. By revisiting Beauvoir’s notion of “bad faith”, I show that this account is compatible with recognizing the limitations imposed on women’s agency and I show that this feminist ethical criticism is itself an important part of a collective project of social transformation. Artificial intelligence (AI) systems have demonstrated impressive performance across a variety of clinical tasks. However, notoriously, sometimes these systems are 'black boxes'. The initial response in the literature was a demand for 'explainable AI'. However, recently, several authors have suggested that making AI more explainable or 'interpretable' is likely to be at the cost of the accuracy of these systems and that prioritising interpretability in medical AI may constitute a 'lethal prejudice'. In this paper, we defend the value of interpretability (...) in the context of the use of AI in medicine. Clinicians may prefer interpretable systems over more accurate black boxes, which in turn is sufficient to give designers of AI reason to prefer more interpretable systems in order to ensure that AI is adopted and its benefits realised. Moreover, clinicians may be justified in this preference. Achieving the downstream benefits from AI is critically dependent on how the outputs of these systems are interpreted by physicians and patients. A preference for the use of highly accurate black box AI systems, over less accurate but more interpretable systems , may itself constitute a form of lethal prejudice that may diminish the benefits of AI to - and perhaps even harm - patients. This paper explores Dilthey’s radical transformation of epistemology and the human sciences through his projects of a critique of historically embodied reason and his hermeneutics of historically mediated life. Answering criticisms that Dilthey overly depends on epistemology, I show how for Dilthey neither philosophy nor the human sciences should be reduced to their theoretical, epistemological, or cognitive dimensions. Dilthey approaches both immediate knowing (Wissen) and theoretical knowledge (Erkenntnis) in the context of a hermeneutical phenomenology of historical life. Knowing is not (...) an isolated activity but an interpretive and self-interpretive practice oriented by situated reflexive awareness (Innewerden) and self-reflection (Selbstbesinnung). As embedded in an historical relational context, knowing does not only consist of epistemic validity claims about representational contents but is fundamentally practical, involving all of human existence. Empirically informed Besinnung, with its double reference to sense as meaning and bodily awareness, orients Dilthey’s inquiry rather than the “irrationalism” of immediate intuition or the “rationalism” of abstract epistemological reasoning. The paper discusses different interpretations of Callicles and Thrasymachus’ positions. There are good reasons for interpreting Callicles as a critic of democracy and as an aristocratic political thinker whose political views are closer to Plato’s than is usually assumed. The paper argues that Callicles defends a natural right of the best citizens to rule over the crowd. However, in contrast to Plato, for Callicles the rule of the best should not aim at the common good but at their personal advantage. (...) The paper also discusses the view that Thrasymachus is just a sociologist of power who diagnoses what actually happens in politics (Henning Ottmann, Max Salomon). This interpretation is still current, and enables us to understand important aspects of legislation in contemporary democracies. Finally, the paper argues that there are reasons to understand Thrasymachus not only as a political realist, but, similar to Protagoras, as a moral sceptic. (shrink)

This paper deals with the study of the nature of mind, its processes and its relations with the other filed known as logic, especially the contribution of most notable contemporary analytical philosophy Ludwig Wittgenstein. Wittgenstein showed a critical relation between the mind and logic. He assumed that every mental process is logical. Mental field is field of space and time and logical field is a field of reasoning (inductive and deductive). It is only with the advancement in logic, we (...) are today in the era of scientific progress and technology. Logic played an important role in the cognitive part or we can say in the ‗philosophy of mind‘ that this branch is developed only because of three crucial theories i.e. rationalism, empiricism, and criticism. In this paper, it is argued that innate ideas or truth are equated with deduction and acquired truths are related with induction. This article also enhance the role of language in the makeup of the world of mind, although mind and the thought are the terms that are used by the philosophers synonymously but in this paper they are taken and interpreted differently. It shows the development in the analytical tradition subjected to the areas of mind and logic and their critical relation. (shrink)

This chapter proposes a dialectical approach to legal interpretation, consisting of three dimensions: a formalization of the canons of interpretation in terms of argumentation schemes; a dialectical classification of interpretive schemes; and a logical and computational model for comparing the arguments pro and contra an interpretation. The traditional interpretive maxims or canons used in both common and civil law are translated into defeasible patterns of arguments, which can be evaluated through sets of corresponding critical questions. These (...) interpretive argumentation schemes are classified in general categories and a distinction is drawn between schemes supporting and rebutting an interpretation. This framework allows conceiving statutory interpretation as a dialectical procedure consisting in weighing arguments pro and contra an interpretation. Drawing from the work of Mabogo More, this paper will attempt to present a comprehensive analysis of Steve Biko’s views on race and racism. The analysis will commence by reviewing and outlining the broad philosophical schools of thought regarding the conceptualization of race, and it’s relevance within society, namely; Racial Naturalism, Racial Nihilism or Skepticism, and Racial Constructivism. Subsequently, this paper will attempt to locate More’s interpretation of Biko’s views as being constructivist, despite the prevalence of non-racial, skeptical conceptions (...) within contemporary South Africa. In light of these skeptical conceptions, this paper will apply Biko’s philosophical views to specifically answer the following questions: Firstly, Can black people be racist? Secondly, Could racism ever go out of existence? Finally, this paper will address the question: Could race ever cease to exist? (shrink)

This paper addresses specific concerns that emerge as a consequence to the current educational reforms in the Philippines. These concerns are philosophical and pedagogical. The philosophical concern underscores the importance to situate philosophical thought within concrete historical conditions. In this way, philosophy does not only become a pure abstract enterprise, but an intellectual struggle at the service of historical novelties. I propose a philosophical paradigm that values collective practice at the service of truth. As new situations demand new interpretations and (...) contextualization, I shall also employ a philosophical discourse and practice not only contemporary to, but also one of the bests of our times: the philosophy of Alain Badiou. The pedagogical concern elucidates the political nature of education, which is what Critical Pedagogy argues essentially. This paradigm puts importance above all on the role critical knowledge and collective practice plays in the educational and socio-political arena. The critical pedagogy which I propose is not far from the emancipation politics also embedded in Badiouian Philosophy. Hence, there is a connection between the kind of philosophy I propose and the pedagogical paradigm I present as an alternative. From the philosophical and pedagogical arguments presented, I shall argue for the need to rescue education from the influence of neoliberalism. The resistance necessitates the movement of the collective through the agency of the teacher-militant. (shrink)

The paper is a response to recent criticisms of agatheism, a new pluralistic interpretation of religious belief put forward by Janusz Salamon with the aim of accommodating the epistemological challenge of religious diversity. Agatheism is an axiologically grounded religious belief which identifies God, the Absolute or the ultimate reality religiously conceived with the ultimate good as the ultimate end of all human agency and thus an explanation of its irreducibly teleological character and a source of its meaning. Janusz Salamon (...) argues that this grounding of religious belief in the human axiological consciousness makes it immune to falsification by any future science. Replying to the concerns of the critics about about irrationality of doxastic commitment to a particular religious tradition, Janusz Salamon argues that to the extent the fundamental agatheistic religious belief is presupposed in such tradition as its doxastic core, its belief system - if internally coherent and aligned with a worldview that is consistent with undisputed scientific findings - may be considered rational, despite there being a plurality of such belief systems. Aestheticians in the tradition of Critical Theory have claimed that the or a purpose of musical interpretation is somehow to save or salvage or rescue ("retten") the musical work. What sense, if any, can be made of this claim? The notion of salvage or rescue presupposes the concept of danger. Threats to works of art emerge from two sources: from outside and from inside. Whilst the former problem is only touched upon, the latter is discussed in some detail, (...) using the example of Brahms' Alto Rhapsody op. 53. Kathleen Ferrier's and Clemens Krauss' interpretation of 1947 deals with rather than ignores the composer's crumbly attempt at fusing art and religion. Salvage as their attitude vis-a-vis the work is distinguished from cover-up on the one hand and exposure on the other hand. (shrink)

From a critical review of the literature, we analyze the incompatibility between the possibility of incorporating moral principles to the law and its authoritative nature, as argued by exclusive positivists, such as J. Raz. After presenting his argument in second section, we argue in the third section that it is incompatible with commonly accepted (even by Raz) premises of the theory of legal interpretation, or else it would lead to contradiction - unless one presupposes, within the premises, a (...) strong version of the sources thesis (which is what Raz intends to prove). In conclusion, we return to the arguments presented, concluding with a possible difficulty for the adoption of exclusive positivism by people inside a legal practice. (shrink)

This paper constitutes one extended argument, which touches on various topics of Critical Rationalism as it was initiated by Karl Popper and further developed in his aftermath. The result of the argument will be that critical rationalism either offers no solution to the problem of induction at all, or that it amounts, in the last resort, to a kind of Critical Rationalist Inductivism as it were, a version of what I call Good Old Induction. One may think (...) of David Miller as a contemporary representative of what I consider as the ‘no solution’ version of critical rationalism, while Alan Musgrave stands for the version of ‘critical rationalist induction’. This paper argues that Nietzsche is a critic of just the kind of genealogical debunking he is popularly associated with. We begin by showing that interpretations of Nietzsche which see him as engaging in genealogical debunking turn him into an advocate of nihilism, for on his own premises, any truthful genealogical inquiry into our values is going to uncover what most of his contemporaries deem objectionable origins and thus license global genealogical debunking. To escape nihilism and make room for naturalism (...) without indiscriminate subversion, we then argue, Nietzsche targets the way of thinking about values that permits genealogical debunking: far from trying to subvert values simply by uncovering their origins, Nietzsche is actively criticising genealogical debunking thus understood. In this paper I critically engage with Pauline Kleingeld’s ‘volitional self-contradiction’ interpretation of Kant’s formula of universal law. I make three remarks: first, I seek to clarify what it means for a contradiction to be volitional as opposed to logical; second, I suggest that her interpretation might need to be closer to Korsgaard’s ‘practical contradiction’ interpretation than she thinks; and third, I suggest that more work needs to be done to explain how a volitional self-contradiction generates both (...) a ‘contradiction in conception’ and a ‘contradiction in will.’. This paper aims to offer a novel interpretation of Socrates’ autobiography in the Phaedo 96-102 by using reliabilist epistemology as a heuristic guide to spell out the complex dynamics of the intellectual development of Socrates of the Phaedo. Surprisingly, scholars have mostly focused on the outcomes of Socrates’s scientific investigations, but they neglected the dynamics of the discovery process. The reason why Socrates rejected many earlier scientific ideas and the way in which he discovered new theories as much significant (...) and noteworthy as those theories. I argue that Socrates’ discovery and implementation of new methods of inquiry meet the epistemic standards of reliabilism that emphasize the reliability of processes involved in belief-formation. I show that Socrates criticized the physicists’ materialistic-mechanistic approach to explain coming-to-be, perishing, and being because of its unreliability. The paper concludes that (a) the concept of reliability is used as a guide to theory choice in Socrates’ autobiography (b) the positive feature of Socrates’ second sailing is its reliability and (c) reliability is the motive behind Socrates’ choice of certain belief-forming processes, namely a priori reasoning, the method of hypothesis, and the theory of Forms, in the search of the cause of coming-to-be, perishing, and being. -/- KEYWORDS: reliabilism, Phaedo, Socrates’ autobiography, deuteros plous. In this paper it is shown how certain defeasible argumentation schemes can be used to represent the logical structure of the most common types of argument used for statutory interpretation both in civil and common law. The method is based on an argumentation structure in which the conclusion, namely, the meaning attributed to a legal source, is modeled as a claim that needs that is be supported by pro and con defeasible arguments. The defeasible nature of each scheme is (...) shown by means of critical questions, which identify the default conditions for the accepting interpretative arguments and provide a method for evaluating a given argument as weak or strong. The recently rising field of Critical Data Studies is still facing fundamental questions. Among these is the enigma of digital subjectivation. Who are the subjects of Big Data? A field where this question is particularly pressing is finance. Since the 1990s traders have been steadily integrated into computerized data assemblages, which calls for an ontology that eliminates the distinction between human sovereign subjects and non-human instrumental objects. The latter subjectivize traders in pre-conscious ways, because human consciousness runs too slow (...) to follow the volatility of the market. In response to this conundrum Social Studies of Finance has drawn on Actor-Network Theory to interpret financial markets as technically constructed networks of human and non-human actors. I argue that in order to develop an explicitly critical data study it might be advantageous to refer to Maurizio Lazzarato’s theory of machinic subjugation instead. Although both accounts describe financial digital subjectivation similarly, Lazzarato has the advantage of coupling his description to a clear critique of and resistance to finance. (shrink)

This article takes up Lipovetsky‟s discussion on artistic capitalism in L’esthétisation du monde. Vivre à l’âge du capitalisme artiste, to trace its definitions and methodological construction, but also in order to create a critical theory of artistic capitalism, based on the following working-hypothesis: the production of art and the production of self, understood in the sense of a Foucauldian project of the aesthetics of existence, represent correspondent purposes in artistic capitalism. My research will be focused on examining previous attempts (...) of developing such a critical inquiry, claimed by Luc Boltanski, Eve Chiapello, and Luc Ferry. It is my thesis that the failure of a homogeneous critical theory of artistic capitalism is owed to different inconsistent interpretations of contaminating ethics with aesthetics in order to create an ideal of morality and authenticity for the existence of the individual inspired by contemporary techniques of art production, aspects that were conceived by Lipovetsky as parts of the process of the “aestheticization of the world”. The general aim of this article is to give a critical interpretation of post-trial obligations towards individual research participants in the Declaration of Helsinki 2013. Transitioning research participants to the appropriate health care when a research study ends is a global problem. The publication of a new version of the Declaration of Helsinki is a great opportunity to discuss it. In my view, the Declaration of Helsinki 2013 identifies at least two clearly different types of post-trial obligations, specifically, (...) access to care after research and access to information after research. The agents entitled to receive post-trial access are the individual participants in research studies. The Declaration identifies the sponsors, researchers and host country governments as the main agents responsible for complying with the post-trial obligations mentioned above. To justify this interpretation of post-trial obligations, I first introduce a classification of post-trial obligations and illustrate its application with examples from post-trial ethics literature. I then make a brief reconstruction of the formulations of post-trial obligations of the Declaration of Helsinki from 2000 to 2008 to correlate the changes with some of the most salient ethical arguments. Finally I advance a critical interpretation of the latest formulation of post-trial obligations. I defend the view that paragraph 34 of ‘Post-trial provisions’ is an improved formulation by comparison with earlier versions, especially for identifying responsible agents and abandoning ambiguous ‘fair benefit’ language. However, I criticize the disappearance of ‘access to other appropriate care’ present in the Declaration since 2004 and the narrow scope given to obligations of access to information after research. Quantum Mechanics is a fundamental physical theory about atomic-scale processes. It was built between 1920 and 1940 by the most distinguished physicists of that time. The accordance between the predictions of the theory and experimental results is remarkable. The physical interpretation of its mathematical constructs, however, raised unprecedented controversies. Ontological, semantic, and epistemic vagueness abound in the orthodox interpretations and have resulted in serious misunderstandings that are often repeated in textbooks and elsewhere. In this paper, I will argue against certain criticisms of Kripke’s Wittgenstein’s sceptical argument and sceptical solution, made especially by Baker and Hacker, McGinn, and McDowell. I will show that their interpretation of Kripke’s Wittgenstein’s view is misplaced. According to Kripke’s Wittgenstein’s sceptical argument, there is no fact as to what someone means by her words. For Kripke, this conclusion, combined with Classical Realist view of meaning, leads to the Wittgensteinian paradox, according to which there is no such thing (...) as meaning anything by any word. Wittgenstein presents this paradox in paragraph 201 of the Philosophical Investigations. As Kripke reads Wittgenstein, Wittgenstein is in agreement with his sceptic on the sceptical conclusion of the sceptical argument, that is, that there is no fact about meaning, and builds his sceptical solution on an endorsement of that. McDowell, McGinn, and others have objected that Kripke has failed to properly understand Wittgenstein’s main remarks in 201, that is, that the paradox is the result of a misunderstanding of the ordinary notion of meaning. Wittgenstein does not accept such a sceptical conclusion. I will use the distinction George Wilson draws between two different conclusions of the sceptical argument and show that Kripke has respected all of the remarks that Wittgenstein has put in section 201. This essay critically assesses Roman Ingarden’s 1915 review of the second edition of Edmund Husserl’s Logical Investigations. I elucidate and critique Ingarden’s analysis of the differences between the 1901 first edition and the 1913 second edition. I specifically examine three tenets of Ingarden’s interpretation. First, I demonstrate that Ingarden correctly denounces Husserl’s claim that he only engages in an eidetic study of consciousness in 1913, as Husserl was already performing eidetic analyses in 1901. Second, I show that Ingarden is (...) misguided, when he asserts that Husserl had fully transformed his philosophy into a transcendental idealism in the second edition. While Husserl does appear to adopt a transcendental phenomenology by asserting–in his programmatic claims–that the intentional content and object are now included in his domain of research, he does not alter his actual descriptions of the intentional relationship in any pertinent manner. Third, I show Ingarden correctly predicts many of the insights Husserl would arrive at about logic in his late philosophy. This analysis augments current readings of the evolution of Ingarden’s philosophy, by more closely examining the development of his largely neglected early thought. I execute this critical assessment by drawing both from Husserl’s later writings and from recent literature on the Investigations. By doing so, I hope to additionally demonstrate how research on the Investigations has matured in the one hundred years since the release of that text, while also presenting my own views concerning these difficult interpretative issues. This dissertation articulates and defends a conception of philosophical anthropology by reading Martin Heidegger’s ‘analytic of Dasein’ as an exemplary case of it and developing its account of anxiety and boredom. I define philosophical anthropology in distinction to empirical anthropology, which I argue is concerned with specificity and difference. Anthropology investigates human beings and their societies in their historical specificity, situated in context, thereby contributing to the understanding of the differences between human beings and their societies across the world and (...) throughout history. Philosophical anthropology, however, concerns the commonality between human beings. It questions at a more abstract level, asking what being a human being is like in general, what structures every case of human existence, what is common to all instances of it. It attempts to account for the structures of human existence and generate conceptual frameworks and vocabularies for describing and analyzing human life. I claim philosophical anthropology and empirical anthropology can complement, make use of and relate productively to each other, two sides of the same coin in the investigation of human existence. After outlining my conception of philosophical anthropology, I show how Heidegger engages in it in Being and Time’s ‘analytic of Dasein’ and other texts of the late 1920s that followed shortly after and continue this sort of project. Heidegger himself, emphatically and repeatedly throughout his career, opposed this reading of his work, but I will show that his most significant arguments in support of this opposition are unconvincing. I then critically develop one aspect of his analysis: its account of what I call the ‘revelatory moods’ of anxiety and boredom. Heidegger theorizes a variety of these moods as involving intense, profound experiences of total meaninglessness, with the very significance of the world receding from us. These experiences convey important insights to us about what it means to exist as human beings. In a brief passage, without arguing for it, Heidegger claims that joy is also a revelatory mood in the same sense, despite its seeming very different from anxiety and boredom. I critically develop Heidegger’s account to theorize joy as a revelatory mood, supplementing his analysis and deepening its usefulness as a philosophical anthropology. Heidegger gives us a conceptual framework for analyzing important human affective phenomena, interpreting their existential significance and their function in the context of our lives. I conclude with a corollary investigation into the relevance that my conception of philosophical anthropology might have to Cognitive Science. I argue, drawing on the work of Heidegger, Merleau-Ponty and Mark Rowlands, that philosophical anthropology could aid Cognitive Science in the construction of what Imre Lakatos called a ‘hard core’ – something that has recently been argued to be problematically missing in Cognitive Science. A ‘hard core’ is a set of refutationresistant principles, conceptions or theories around which a coherent scientific research program can take place. I show that the work of philosophical anthropologists could be useful in debating and deciding what needs to be included in Cognitive Science’s hard core. (shrink)

A prominent argument for moral realism notes that we are inclined to accept realism in science because scientific inquiry supports a robust set of critical practices—error, improvement, explanation, and the like. It then argues that because morality displays a comparable set of critical practices, a claim to moral realism is just as warranted as a claim to scientific realism. But the argument is only as strong as its central analogy—and here there is trouble. If the analogy between the (...) critical practices of science and morality is loosely interpreted, the argument does not support moral realism—for paradigmatically constructivist discourses like fashion display the relevant critical practices just as well. So if the argument is to have force, the realist must say more about why the critical practices of morality are sufficiently like those of science to warrant realism. But this cannot be done—moral inquiry differs from scientific inquiry in too many important ways. So the analogy with the critical practices of science fails to vindicate moral realism. But there are further lessons: in looking closely at the critical practices of our moral discourse—and in comparing them to the critical practices of science and fashion—we gain insight into what is distinctive about morality objectivity and moral metaphysics. The Orthodox Churches are part of the ecumenical movement with the inner wish to clarify the theological elements which keep the whole Christianity divided. For this goal, every Church is represented somehow in discussions by her theologians who are training to carry a theological dispute at this level. The Romanian Orthodox Church was indirectly represented in the World Council of Church by professor Ion Bria (1929-2002), who had worked officially at the Ecumenical Centre in Geneva for more than 20 years. (...) This theological research has the aim to speak to us about Bria’s personality and ecumenical activity. In order to accomplish this goal, I will expand my research in three chapters. In the first one, I will present his biographical life. Until this moment he remains the most important Romanian theologian involved in the ecumenical dialogue. The second chapter deals with the history of the modern ecumenical movement and also with Bria’s perspective on the dialogue between Orthodoxy and ecumenism, which are for him two correlative elements. Bria comes to confront the anti-ecumenical part within the Orthodox Church who does not accept the Christian dialogue being afraid of heresy. Bria explain how through dialogue, the line between Orthodoxy and the other Christians can be overrun. In the third chapter I explain the missionary concept ‘liturgy after the Liturgy’, both historically and theologically. Being aware that there are some uncertainties around this concept I decided to clarify it in a proper way. Bria is known as the promoter of this concept, so I will search to find out who is the originator of this expression as such. In the same chapter I will analyze the ecclesiological elements from Bria’s writings. The ecumenical dialogue is interpreted of being an ecclesiological problem par excellence so I will outline Bria’s position regarding the teaching of the Church. In conclusion I will present in a synthetic way the results of this study. (shrink)

Although Henry Lee is often recognized to be an important early critic of Locke's 'way of ideas', his Anti-Scepticism (1702) has hardly received the scholarly attention it deserves. This paper seeks to fill that lacuna. It argues that Lee's criticism of Locke's alleged representationalism was original, and that it was quite different from the more familiar kind of criticism that was launched against Locke's theory of ideas by such thinkers as John Sergeant and Thomas Reid. In addition, the paper offers (...) an interpretation of Lee’s claim that, pace Locke, attempts to prove the veridicality of our cognitive apparatus are fundamentally misguided. (shrink)

How do concert pianists commit to memory the structure of a piece of music like Bach’s Italian Concerto, learning it well enough to remember it in the highly charged setting of a crowded performance venue, yet remaining open to the freshness of expression of the moment? Playing to this audience, in this state, now, requires openness to specificity, to interpretation, a working dynamicism that mere rote learning will not provide. Chaffin, Imreh and Crawford’s innovative and detailed research suggests that (...) the key to this skill is a declarative mental roadmap aiding musical performance. This hypothesis is neatly and unintentionally summarized by professional pianist Imreh, who states when learning a new piece of music “My fingers were playing the notes just fine. The practice I needed was in my head. I had to learn to keep track of where I was. It was a matter of learning exactly what I needed to be thinking of as I played, and at exactly what point. A commentary on articles by Klein, Pockett, and Trevena and Miller, in this issue, is given. Average shift in the point of subjective equality , calculated by Klein on Libet's data, and corresponding change in mean shift, calculated by Libet et al. , may be “corrected,” taking as a reference point the end of the minimum train duration. Values obtained, if significant, indicate a latency for conscious sensation of the skin stimulus of at least 230 ms. Pockett's main conclusions are (...) favored, but her explanation of peripheral–lemniscal couplings is found to be unconvincing. Trevena and Miller's article unsuccessfully tries to rescue a dualist interactionist view. Libet's method of timing intentions is thoroughly criticized. (shrink)

I explore the critical significance of the phenomenological notion of intuition. I argue that there is no meaning that is originally formal-conceptual. The meanings of concepts function as symbolic approximations to original nonconceptual, intuitive givens. However, the meaning content originally intuitively given in lived experience has a tendency to be lost in pursuit of universalizability and communicability of conceptual content. Over time, conceptual approximations lose their reference to the experience that had given them their meaning in the first place. (...) The loss of an experiential reference makes for a vacuous set of concepts, giving way to ideologies, by which I mean the conscious prejudicial support for a set of ideas without the experiential, intuitive context that is necessary to see the value of those ideas. A critical phenomenology is a critique of ideological views by descriptively recovering the intuitive content whereby concepts can be adequately reevaluated. -/- This main aim of this work is to establish the methodological features of critical phenomenology by responding to the objections made against phenomenology and intuition by Frankfurt School critical theorists. Scheler’s phenomenology is used as a way forward due to his far-reaching critique of reason and emphasis on the phenomenological intuition of value. -/- Chapter 1 considers three Frankfurt School objections of Husserlian phenomenology, as (1) immanentist (Adorno), (2) idealist (Adorno), and (3) normatively empty (Habermas). Each fail to discern the subtle features of nonidentity with respect to Husserl’s notions of apperception and adumbrated phenomena. -/- Chapter 2 shows how Scheler’s original view of the phenomenological attitude makes more explicit Husserl’s subtle dialectical elements. Adequate and inadequate givenness is interpreted with respect to one’s intentional orientation and the moral attitudes carried within the world, influencing the content of the given. -/- Chapter 3 confronts the popular charge of idealism. Reality is a problem for phenomenology only to conscious modes of givenness. But through ecstatic modes of givenness (in resistances) Scheler’s phenomenology achieves an existential ground that is crucial for phenomenology to engage actually existing social structures and factors. -/- Chapter 4 concerns the charge that phenomenology is normatively empty. That Scheler had developed a theory of value is not enough to rebut the charge but his view of value-givenness as an attitude informed by the act of loving, opens an awareness of the values disclosed by that attitude. -/- Chapter 5 shows that Scheler’s sociology of knowledge, in contrast to Karl Mannheim’s interpretation, provides a unified picture of the interdependency of spirit and life needed for the realization of values in the world and society. -/- Chapter 6 suggests a way of framing a phenomenological critique of ideology. Scheler points to the attitudinal factors of loving and hating to disclose systemic devaluation and overvaluation. This awareness arises (1) from noticing how individual valuation reflects social valuation, and (2) by being attuned to how one’s own intuitions contradict prevailing social valuation and thought, thereby opening a space for a critique of those patterns. Artificial intelligence (AI) systems have demonstrated impressive performance across a variety of clinical tasks. However, notoriously, sometimes these systems are “black boxes.” The initial response in the literature was a demand for “explainable AI.” However, recently, several authors have suggested that making AI more explainable or “interpretable” is likely to be at the cost of the accuracy of these systems and that prioritizing interpretability in medical AI may constitute a “lethal prejudice.” In this paper, we defend the value of interpretability (...) in the context of the use of AI in medicine. Clinicians may prefer interpretable systems over more accurate black boxes, which in turn is sufficient to give designers of AI reason to prefer more interpretable systems in order to ensure that AI is adopted and its benefits realized. Moreover, clinicians may be justified in this preference. Achieving the downstream benefits from AI is critically dependent on how the outputs of these systems are interpreted by physicians and patients. A preference for the use of highly accurate black box AI systems, over less accurate but more interpretable systems, may itself constitute a form of lethal prejudice that may diminish the benefits of AI to—and perhaps even harm—patients. The sociopolitical and cultural evolution as a result of the Reform and Opening up in 1978, facilitated not least by the inexorable juggernaut of globalization and technological advancement, has revolutionized the way China engages domestically and interacts with the outside world. The need for more proactive diplomacy and open engagement witnessed the institutionalization of the interpreter-mediated premier's press conferences. Such a discursive event provides a vital platform for China to articulate its discourse and rebrand its image in tandem with the (...) profound changes signaled by the Dengist reform. This chapter investigates critically how political press conference interpreting and interpreters' agency in China are impacted in relation to such dramatic transformations. It is revealed that, while interpreters are confronted with seemingly conflicting expectations, in actual practice they are often able to negotiate a way as highly competent interpreting professionals with the additional missions of advancing China's global engagement and safeguarding China's national interests.
