This article introduces a new formulation of the interest theory of rights. The focus is on ‘Bentham’s test’, which was devised by Matthew Kramer to limit the expansiveness of the interest theory. According to the test, a party holds a right correlative to a duty only if that party stands to undergo a development that is typically detrimental if the duty is breached. The article shows how the entire interest theory can be reformulated in terms of the test. The article (...) then focuses on a further strength of the interest theory, brought to the fore by the new formulation. In any Western legal system, the tortious maltreatment of a child or a mentally disabled individual results in a compensatory duty. The interest theory can account for such duties in a simple and elegant way. The will theory, on the other hand, struggles to explain such compensatory duties unless it abandons some of its main tenets. (shrink)

The Article analyzes the notion of legal “thinghood” in the context of the person–thing bifurcation. In legal scholarship, there are numerous assumptions pertaining to this definition that are often not spelled out. In addition, one’s chosen definition of “thing” is often simply taken to be the correct one. The Article scrutinizes these assumptions and definitions. First, a brief history of the bifurcation is offered. Second, three possible definitions of “legal thing” are examined: Things as nonpersons, things as rights and duties, (...) and things as property. The first two definitions are rejected as not being very interesting or serving any heuristic function. Conversely, understanding legal things as property is meaningful, useful, and helps to understand what it means to say that animals are legally things. Defining things as property has certain rather important implications, which are analyzed at the end of the Article. For instance, not everything needs to be either a person or a thing: The historical institution of outlawry involved treating individuals neither as legal persons nor as legal things. One must conclude that the person–thing bifurcation is less fundamental than is often assumed. (shrink)

Hillel Steiner has recently attacked the notion of inalienable rights, basing some of his arguments on the Hohfeldian analysis to show that infinite arrays of legal positions would not be associated with any inalienable rights. This essay addresses the nature of the Hohfeldian infinity: the main argument is that what Steiner claims to be an infinite regress is actually a wholly unproblematic form of infinite recursion. First, the nature of the Hohfeldian recursion is demonstrated. It is shown that infinite recursions (...) of legal positions ensue regardless of whether inalienable rights exist or not. Second, the alleged problems that this might pose for the analysis are discussed. The conclusion is that one should not worry about the recursion as long as one understands correctly the role of the Hohfeldian analysis in normative reasoning. (shrink)

It has been debated whether the so-called attention economy, in which the attention of agents is measured and sold, jeopardizes something of value. One strand of this discussion has focused on so-called attention rights, asking: should attention be legally protected, either by introducing novel rights or by extending the scope of pre-existing rights? In this paper, however, in order to further this discussion, we ask: How is attention already protected legally? In what situations does a person have the right to (...) attention under current law? -/- Unlike (Chomanski, Neuroethics 16:1–11, 2023), who discusses an overall right to attention, or (Puri, Rutgers Law Record 48:206–221, 2021), who discusses an overall right to attentional privacy, in this paper we focus on two types of situations in which a person’s attention is already protected by legal regulation. Sustained attention-requiring tasks can be jeopardized by distractions whereas attentiveness to certain kind of stimuli can be jeopardized by immersive stimuli. That is why distractions are regulated in situations where an agent has what we call a concentration right and immersive stimuli are regulated in situations where an agent has what we call a duty to be attentive. The further analysis of these situations provides an understanding of the legal means by which attention is already regulated, which can be helpful when thinking about how it should be regulated in the future. In this chapter I focus on two problems facing immigration systems around the world, and Australia in particular. The topics addressed are chosen because each one involves important fundamental rights and because significant improvement in these areas is possible even if each state acts alone, without significant coordination with others. First, I examine refugee programmes, focussing specifically on the ‘two- tier’ refugee programmes pioneered by Australia with the introduction of Temporary Protection Visas by the Howard Government in 1999. Next, I (...) look at recent declines in refugee resettlement schemes from already stingy levels and, in relation to Australia in particular, I show how the tying of resettlement numbers to the number of affirmative asylum claims granted is both wrong- headed and counterproductive. The second area of immigration policy explored is family migration, another area where immigration systems around the world have been moving in the wrong direction, often via less than transparent administrative processes. Australia is no exception. While Australia’s family migration system is reasonably good on its face, in practice there are several factors which make the programme significantly less than satisfactory from the perspective of protecting the basic rights of migrants and, arguably more importantly, citizens. These problems can and should be fixed in straightforward ways, and since doing so would be more just, would have few— if any— significant negative consequences, and in fact would have a number of clear benefits, those changes should be made. No entanto, analisando passagens de outros tratados do autor, é possível concluir que há algo comum que perpassa as diversas considerações acerca de seu método, a saber: que o ponto de partida de toda investigação é dado pelo que é mais cognoscível a nós, e todo o procedimento de investigação visa chegar ao que é mais cognoscível em si mesmo – o conhecimento estrito (...) do objeto, que inclui compreender suas causas. O objetivo deste trabalho é tentar compreender como esse procedimento acontece na investigação moral, que opera no âmbito do discurso e, portanto, das definições. Para isso, pretendemos analisar como acontece a passagem da análise do que é dado na experiência em direção ao conhecimento de suas causas, que é próprio de outros tratados aristotélicos, para a análise das opiniões vagas e imprecisas em direção às definições estritas com as quais a Ethica Eudemia pretende operar. We describe (essential features and an axiomatization of) a new metamathematical (cognitive) ability, i.e., functional conceptual substratum, used implicitly in the generation of several mathematical proofs and definitions, and playing a fundamental role in Artificial Mathematical Intelligence (or Cognitive-computational metamathematics). Furthermore, we present an initial (first-order) formalization of this mechanism together with its characterizing relation with classic notions like primitive positive definability and Diophantiveness. Additionally, we analyze the semantic variability of functional conceptual substratum when small syntactic modifications are done. Finally, (...) we describe cognitively natural inference rules for (mathematical) definitions inspired by functional conceptual substratum and we show that they are sound and complete w.r.t.\ standard calculi. We argue for the possibility of validating the presence of consciousness in another person from a perspective that blends both, a third-person approach of coming close to, observing, and understanding the other; and a first-person assessment of how the experience of the other feels like. For this, we will need to explain how the line between the third-person and first-person approaches is blurred in some methodological approaches. We rest our position largely on the back of some seminal conclusions of the (...) meditations of Ren\'e Descartes and other theories concerning consciousness like Chalmers' naturalistic dualism and, to some secondary extent on Integrated Information Theory (IIT). Additionally, we describe fundamental contextual principles already developed in the literature and the arts (like Stanivlaski's Acting System), and then we use them for setting a suitable methodology that we feel can be used to validate the presence of others' conscious experiences in one's consciousness (at suitable periods of spacetime). Finally, we give general methodological guidelines for the construction of the concrete experiment and we explore very briefly the potential implications of this kind of research in other academic and non-academic settings. We present a multidisciplinary, universal a pragmatic theory of causation based explicitly on five methodological causal seminal dimensions. The first one is called formal-mathematical-idealist theory and emerges as a meta-conceptual fusion of several existing causal theories. The second one is essentially based on a global, scientific and technical perspective. In fact, this can be considered as a meta-dimension encompassing a huge number of academic disciplines. The third dimension arises once more as combination of former approaches having the mind and its (...) laws as the central paradigm. The fourth one is structurally related with our subjective phenomenological world and its objective impact on the external universe. And, finally, the fifth dimension is closely related with the first one, but more oriented toward the global implicit purpose of the universe and what this implies causally on the events in nature. We give several concrete examples elucidating the explanatory range of our theory. (shrink)

The boundless nature of the natural numbers imposes paradoxically a high formal bound to the use of standard artificial computer programs for solving conceptually challenged problems in number theory. In the context of the new cognitive foundations for mathematics' and physics' program immersed in the setting of artificial mathematical intelligence, we proposed a refined numerical system, called the physical numbers, preserving most of the essential intuitions of the natural numbers. Even more, this new numerical structure additionally possesses the property of (...) being a bounded object allowing us to work with quite similar axioms like the classic Peano axioms, but in a finite environment and with an enriched physical dimension. Finally, we present several enlightening examples and we conclude that the physical numbers provide a natural formal setting for approaching classic problems in number theory from a more hybrid perspective, i.e. with a potential participation in the generation of solutions, not only of working mathematicians but also of more sophisticated artificial interactive (mathematical) intelligent agents (within the context of cognitive-computational metamathematics or artificial mathematical intelligence) and more controlled by physically-inspired principles. Finally, this paper addresses a highly new, bottom-up and paradigm-shifting approach to the foundations of physics: One should refine and improve the conceptual formal setting of the language that we use for understanding physical phenomena (e.g. the mathematical grounding concepts and theories) for being able to understand better more subtle and complex physical phenomena. We approach the notion of general (global) human intelligence as a prominently multifaceted concept which can be tested in at least seventy specific scenarios. We say that an agent has Artificial Global Intelligence (AGLI), if it is able to perform in an intelligent manner for at least the collection of tasks defining the former scenarios. In particular, based on Gartner's multiple intelligences theory, we describe the design of a concrete test for AGLI made in such a way that an ‘average’ (...) young human being should, per diffinitionem, pass it. We compare our holistic test with several highly representative human and artificial intelligence tests for deducing that our AGLI test is the one with the broader scope of the whole range of intelligence. However, we claim as a plausible hypothesis and based on the wide thematic spectrum of the test that the most outstanding inventions of AI currently available are far from getting a high score on it. Finally, we open a discussion about the fact that, although there are artificial agents being able to simulate intelligent behaviour at a perfect level for several local tasks, this seems not to be the case for AGLI. This would imply, in particular, a kind of practical implausibility of the notion of intelligence explosion coming from philosophy of AI. (shrink)

I think the basic intuition behind textualism correct – that the meaning of a law is fixed by referencing the meaning of its words according to the meaning common to the law’s ratifiers. However, even if true, it does not follow that interpretation of a law goes through the original ratifiers. Rather, a citizenry continually ratifies the laws to which it subjects itself, and as the meanings of those words change over time, so will those laws. Concerning, say, the U.S. (...) Constitution, though the text may be very nearly the same now as in the 18th century, a different constitution is in effect. (shrink)

In this short paper I will introduce an idea which, I will argue, presents a fundamental additional challenge to the machine consciousness community. The idea takes the questions surrounding phenomenology, qualia and phenomenality one step further into the realm of intersubjectivity but with a twist, and the twist is this: that an agent’s intersubjective experience is deeply felt and necessarily co-affective; it is enkinaesthetic, and only through enkinaesthetic awareness can we establish the affective enfolding which enables first the perturbation, and (...) then the balance and counter-balance, the attunement and co-ordination of whole-body interaction through reciprocal adaptation. Linda Zagzebski’s book on epistemic authority is an impressive and stimulating treatment of an important topic. 1 I admire the way she manages to combine imagination, originality and argumentative control. Her work has the further considerable merit of bringing analytic thinking and abstract theory to bear upon areas of concrete human concern, such as the attitudes one should have towards moral and religious authority. The book is stimulating in a way good philosophy should be -- provoking both disagreement and emulation. (...) I agree with much of what she says, and have been instructed by it, but it will be of more interest and relevance here if I concentrate upon areas of disagreement. Perhaps they are better seen as areas, at least some of them, where her emphases suggest a position that seems to me untenable, but that she may not really intend. In that event, I will be happy to have provoked a clarification or the dispelling of my misunderstanding. My focus will be upon problems in her account of communal authority and autonomy, especially with respect to religious and political authority. Here my worry is that she places too much trust in trust and not enough in what I call selective mistrust. (shrink)

In dem Buch ‘Rationalität in der Angewandten Ethik’, in dem sich verschiedene Autoren die Aufgabe gestellt haben, diese Umstände in das Licht der Betrachtung zu rücken, finden wir Fragen darüber, wie “Moral”, “Angewandte Ethik” und “Vernunft” (auch in der Anwendung) zu verstehen und zu vereinen sind.

PREMISSA No século XIX, ocorreram transformações impulsionadas pela emergência de novas fontes energéticas (água e petróleo), por novos ramos industriais e pela alteração profunda nos processos produtivos, com a introdução de novas máquinas e equipamentos. Depois de 300 anos de exploração por parte das nações europeias, iniciou -se, principalmente nas colônias latino-americanas, um processo intenso de lutas pela independência. É no século XIX, já com a consolidação do sistema capitalista na Europa, que se encontra a herança intelectual mais próxima da (...) qual surgirá a Sociologia como ciência particular. No início desse século, as ideias do Conde de Saint-Simon (1760-1825), de Georg Wilhelm Friedrich Hegel (1770-1831), de David Ricardo (1772-1823) e de Charles Darwin (1809-1882), entre outros, foram o elo para que Alexis de Tocqueville (1805-1859), Auguste Comte (1798-1857), Karl Marx (1818 -1883) e Herbert Spencer (1820-1903), entre outros, desenvolvessem reflexões sobre a sociedade de seu tempo. Auguste Comte e Karl Marx foram os pensadores que lançaram as bases do pensamento sociológico e de duas grandes tradições – a positivista e a socialista – que muito influenciaram o desenvolvimento da Sociologia no Brasil. 1 AUGUSTE COMTE E A TRADIÇÃO POSITIVISTA Isidore Auguste Marie François Xavier Comte nasceu em Montpellier, na França, em 19 de janeiro de 1798. Com 16 anos de idade, ingressou na Escola Politécnica de Paris, fato que teria significativa influência na orientação posterior de seu pensamento. De 1817 a 1824, foi secretário do Conde de Saint-Simon. Comte declarou que, com Saint -Simon, aprendeu muitas coisas que jamais encontraria nos livros e que, no pouco tempo em que conviveu com o conde, fez mais progressos do que faria em muitos anos, se estivesse sozinho. Toda a obra de Comte está permeada pelos acontecimentos que ocorreram após a Revolução Francesa de 1789. Ele defendeu parte dos princípios revolucionários e criticou a restauração da monarquia, preocupando-se fundamentalmente em reorganizar a sociedade, que, no seu entender, estava em ebulição e mergulhada no caos. Para Comte, a desordem e a anarquia imperavam em virtude da confusão de princípios (metafísicos e teológicos), que não se adequavam à sociedade industrial em expansão. Era, portanto, necessário superar esse estado de coisas, usando a razão como fundamento da nova sociedade. Propôs, então, a mudança da sociedade por meio da reforma intelectual plena das pessoas. De acordo com o pensador, com a modificação do pensamento humano, por meio do método científico, que ele chamava de “filosofia positiva”, haveria uma reforma das instituições. Com a proposta do estudo da sociedade por meio da análise de seus processos e estruturas, e da reforma prática das instituições, Comte criou uma nova ciência, à qual deu o nome de “física social”, passando a chamá-la posteriormente de Sociologia. A Sociologia representava, para Comte, o coroamento da evolução do conhecimento, mediante o emprego de métodos utilizados por outras ciências, que buscavam conhecer os fenômenos constantes e repetitivos da natureza: a observação, a experimentação, a comparação e a classificação. De acordo com esse pensador, a Sociologia, como as ciências naturais, deve sempre procurar a reconciliação entre os aspectos estáticos e os dinâmicos do mundo natural ou, no caso da sociedade humana, entre a ordem e o progresso. O lema da “filosofia positiva” proposta por Comte era “conhecer para prever, prever para prover”, ou seja, o conhecimento é necessário para fazer previsões e também para solucionar possíveis problemas. A influência de Comte no desenvolvimento da Sociologia foi marcante, sobretudo, na escola francesa, evidenciando-se em Émile Durkheim e seus contemporâneos e seguidores. Seu pensamento esteve presente em muitas das tentativas de criar tipologias para explicar a sociedade. Suas principais obras são: Curso de filosofia positiva (1830-1842), Discurso sobre o espírito positivo (1848), Catecismo positivista (1852) e Sistema de política positiva (1854). Para concluirmos, Comte explanava que para a superação da anarquia reinante na nova sociedade industrial, a filosofia positivista defendia a subordinação do progresso à ordem. O mesmo era contra o retorno de Luís XVIII ao trono: em sua concepção, a sociedade industrial que emergia requeria um governo fundado na razão. 2 A TRADIÇÃO SOCIALISTA: KARL MARX E FRIEDRICH ENGELS Karl Heinrich Marx nasceu em Tréveris, na antiga Prússia, hoje Alemanha, em 1818 e, em 1830, ingressou no Liceu Friedrich Wilhelm, nessa mesma cidade. Anos depois, foi cursar Direito na Universidade de Bonn, transferindo-se para Berlim em seguida. Pouco a pouco, entretanto, seus interesses migraram para a Filosofia, área na qual defendeu, em 1841, a tese de doutorado A diferença da filosofia da natureza em Demócrito e Epicuro. Sua vida universitária foi marcada pelo debate político e intelectual influenciado pelo pensamento de Ludwig Feuerbach (1804-1872) e, principalmente, pelo de Georg Wilhelm Friedrich Hegel (1770- 1831). Friedrich Engels (1820-1895) nasceu em Barmen (Renânia), na antiga Prússia, hoje Alemanha, filho mais velho de um rico industrial do ramo têxtil. Terminou sua formação secundária em 1837 e a partir de então sua formação intelectual foi por conta própria (autodidata), com alguns cursos universitários esparsos e de curta duração. Desde cedo começou a trabalhar nas empresas de seu pai e foi nessa condição que se deslocou para Bremen por três anos e depois foi enviado pelos pais a Manchester, na Inglaterra, onde trabalhou nas fábricas da família. Engels ficou impressionado com a miséria na qual viviam os trabalhadores das fábricas inglesas. Os dois, Marx e Engels, se encontraram em 1842, quando Marx passou a escrever para A Gazeta Renana, jornal da província de Colônia, do qual Engels era colaborador e mais tarde editor-chefe. O jornal, que criticava o poder prussiano, foi fechado em 1843, e Marx se viu desempregado. Ao perder o emprego, mudou-se para Paris, na França. Ali escreveu, em 1844, os Manuscritos econômico-filosóficos (só publicados em 1932) e, junto com F. Engels, o livro A sagrada família. Por sua vez, F. Engels, em 1844, decidiu voltar para a Alemanha, onde publicou, em 1845, A situação da classe trabalhadora na Inglaterra. Entre 1845 e 1847, Marx exilou-se em Bruxelas, na Bélgica, onde escreveu A ideologia alemã (em parceria com Friedrich Engels) e Miséria da filosofia (1847), obra na qual criticou o filósofo Pierre-Joseph Proudhon (1809-1865). Em 1848, ainda na Bélgica, a parceria com Engels se solidificou ao escreverem juntos o livreto O Manifesto Comunista. Em 1848, Marx foi expulso da Bélgica e retornou a Colônia, na Alemanha (Prússia), sempre pensando na possibilidade de uma mudança estrutural em sua terra natal. Isso, entretanto, não aconteceu e Marx foi expulso da Alemanha em 1849, ano em que migrou para Londres, na Inglaterra, onde permaneceu até o fim da vida. Lá escreveu O 18 Brumário de Luís Bonaparte (1852), sua mais importante obra de reflexão sobre a vida política europeia do século XIX, desenvolveu pesquisas e concluiu seu maior trabalho: O capital: crítica da economia política. O primeiro volume dessa obra foi publicado em 1867; os outros três, em 1885, 1894 e 1905, após a morte de Marx, revisados por F. Engels. 2.1 O contexto histórico e a obra de Marx e Engels Para situar a obra de Marx e Engels, é necessário conhecer um pouco do que acontecia em meados do século XIX. Com as transformações que ocorriam no mundo ocidental, principalmente na esfera da produção industrial, houve um crescimento expressivo no número de trabalhadores industriais urbanos, com uma consequência evidente: precariedade da vida dos operários nas cidades. As condições de trabalho no interior das fábricas eram péssimas. Os empregados eram superexplorados, alimentavam-se mal e trabalhavam em ambientes insalubres. Para enfrentar essa situação e tentar modificá-la, os trabalhadores passaram a se organizar em associações e sindicatos e a promover movimentos de reivindicação. Desenvolveu-se, então, uma discussão das condições sociais, políticas e econômicas para se definirem as possibilidades de intervenção nessa realidade. Desde o início do século XIX, muitos pensadores discutiram essas questões, nas perspectivas socialista e anarquista. Na Inglaterra podem ser citados, entre outros: William Godwin (1756-1836), Thomas Spence (1750-1814), Thomas Paine (1737-1809), Robert Owen (1771-1858) e Thomas Hodgkin (1787-1866). Na França, destacaram-se Étienne Cabet (1788- 1856), Flora Tristan (1803-1844), Charles Fourier (1772-1837) e Pierre-Joseph Proudhon (1809-1865). Marx e Engels levaram em conta esses pensadores, debatendo com alguns contemporâneos e criticando-os. Além disso, incorporaram a tradição da economia clássica inglesa, presente principalmente nas obras de Adam Smith e de David Ricardo. Pode-se dizer, portanto, que Marx e Engels desenvolveram seu trabalho com base na análise crítica da economia política inglesa, do socialismo utópico francês e da filosofia alemã. Esses dois autores não buscavam definir uma ciência específica para estudar a sociedade (como a Sociologia, para Auguste Comte) ou situar seu trabalho em um campo científico particular. Em alguns escritos, Marx afirmou que a História seria a ciência que mais se aproximava de suas preocupações, por abarcar as múltiplas dimensões da sociedade, a qual deveria ser analisada na totalidade, não havendo uma separação rígida entre os aspectos sociais, econômicos, políticos, ideológicos, religiosos, culturais etc. O objetivo de Marx e Engels era estudar criticamente a sociedade capitalista com base em seus princípios constitutivos e em seu desenvolvimento, visando dotar a classe trabalhadora de uma análise política da sociedade de seu tempo. Assim, a tradição socialista nascida da luta dos trabalhadores, muitos anos antes e em situações diferentes, tem como expressão intelectual o pensamento de Karl Marx e Friedrich Engels. Para entender as concepções fundamentais de Marx e Engels é necessário fazer a conexão entre as lutas da classe trabalhadora, suas aspirações e as ideias revolucionárias que estavam presentes no século XIX na Europa. Para eles, o conhecimento científico da realidade só tem sentido quando visa à transformação dessa mesma realidade. A separação entre teoria e prática não é discutida, pois a “verdade histórica” não é algo abstrato e que se define teoricamente; sua verificação está na prática. Apesar de haver algumas diferenças em seus escritos, os elementos essenciais do pensamento de Marx e Engels podem ser assim sintetizados: • historicidade das ações humanas – crítica ao idealismo alemão; • divisão social do trabalho e o surgimento das classes sociais – a luta de classes; • o fetichismo da mercadoria e o processo de alienação; • crítica à economia política e ao capitalismo; • transformação social e revolução; • utopia – sociedade comunista. A obra desses dois autores é muito vasta e não ficou vinculada estritamente aos movimentos sociais dos trabalhadores. Pouco a pouco foi introduzida nas universidades como parte do estudo em diferentes áreas do conhecimento. Estudiosos de Filosofia, Sociologia, Ciência Política, Economia, História e Geografia, entre outras áreas, foram influenciados por ela. Na Sociologia, como afirma Irving M. Zeitlin, no livro Ideología y teoría sociológica, tanto Max Weber quanto Émile Durkheim fizeram, em suas obras, um debate com as ideias de Karl Marx. Pelas análises da sociedade capitalista de seu tempo e a repercussão que tiveram em todo o mundo, principalmente no século XX, nos movimentos sociais e nas universidades, Marx e Engels são considerados autores clássicos da Sociologia. No campo dessa disciplina, porém, o pensamento deles ficou um pouco restrito, pois perdeu aquela relação entre teoria e prática (práxis), ou seja, entre a análise crítica e a prática revolucionária. Essa relação esteve presente, por exemplo, na vida e na obra dos russos Vladimir Ilitch Ulianov, conhecido como Lênin (1870-1924), e Leon D. As a national ideology, Pancasila has formal quality, but it is also part of the material aspects that shapes perspectives that drives national policies through the process of consensus. The open and ambiguous character of Pancasila allows a wide space for social and political interpretation, and therefore is open to critique and reformation through reinterpretations of its meaning. An examination of the ethics of the socio-political application of Pancasila is crucial in the current national climate, and these ethical valuations are (...) formed through public discussions and debates on the meaning of Pancasila. Using data drawn from mass media. In this paper, I will examine the Government Regulation on Law (Perppu No. 2/2017) as an example of how these political ethics develop through the discussion of the meaning of Pancasila. Second, I'll highlight how the space for interpretation of the meaning of Pancasila determines how the public, government and oppositional coalitions evaluate the pro and contra approaches to translating the ideology into practice. Third, in examining the process of socio-political consensus as a necessity in the democratic life of Indonesia, this paper will position the discursive deployments of Pancasila in the ethical and political considerations that stem from the practical application of these discourses of Pancasila. My aim in this paper is to go some way towards showing that the maintenance of hard and fast dichotomies, like those between mind and body, and the real and the virtual, is untenable, and that technological advance cannot occur with being cognisant of its reciprocal ethical implications. In their place I will present a softer enactivist ontology through which I examine the nature of our engagement with technology in general and with virtual realities in particular. This softer ontology is (...) one to which I will commit Kant, and from which, I will show, certain critical moral and emotional consequences arise. It is my contention that Kant’s logical subject is necessarily embedded in the world and that Kant, himself, would be content with this view as an expression of his inspired response to the ‘‘scandal to philosophy... that the existence of things outside us... must be accepted merely on faith’’ [Bxl]. In keeping with his arguments for the a priori framing of intuition, the a priori structuring of experience through the spontaneous application of the categories, the synthesis of the experiential manifold, and the necessity of a unity of apperception, I will present an enactivist account of agency in the world, and argue that it is our embodied and embedded kinaesthetic engagement in our world which makes possible the syntheses of apprehension, reproduction and recognition, and which, in turn, make possible the activity of the reproductive or creative imagination. This article addresses the sensitive topic of human rights issues in Indonesia through a Kantian analysis. Cases of human rights violations are a common occurrence in Indonesia. Presently, human rights violations in the country are assessed from historical and legal perspectives. However, there is little commitment or willingness on the part of the Indonesian government to protect and defend the principles of human rights. This article is attempts to utilize arguments from political philosophy that can contextualize the protection and implementation (...) of human rights in Indonesia, through an analysis of the concept of social contract in Immanuel Kant’s political philosophy. According to Kant, freedom and equality are natural rights. This article demonstrates that Kant's social contract theory is linear with his formal moral philosophy. In his explanation, ‘contract’ is unified will. Therefore, the Indonesian state with its power is responsible to implement the will of the public to ensure order and rule of law and to protect the rights and freedom of each individual. (shrink)

Social participation requires certain abilities: communication with other members of society; social understanding which enables planning ahead and dealing with novel circumstances; and a theory of mind which makes it possible to anticipate the mental state of another. In childhood play we learn how to pretend, how to put ourselves in the minds of others, how to imagine what others are thinking and how to attribute false beliefs to them. Without this ability we would be unable to deceive and detect (...) deception in the actions of others, and our ability to interact within our social group would be greatly impaired. In this paper I claim that the capacity for deception is necessary for a theory of mind, and a theory of mind is necessary for complex social interaction. (shrink)

In Examination of McTaggart's Philosophy, C.D. Broad advanced a distinctive ontology of things and processes. He argues that neither things nor processes are reduced to each other but instead are reduced to some further kind of entity: “absolute process.” This paper will present Broad's theory of absolute processes and argue that they are best understood as tropes by developing a version of Donald C. Williams's trope ontology. This process ontology of tropes is then defended against objections in the contemporary metaphysics (...) literature. (shrink)

In the ontology of music the Aristotelian theory of musical works is the view that musical works are immanent universals. The Aristotelian theory (hereafter Musical Aristotelianism) is an attractive and serviceable hypothesis. However, it is overlooked as a genuine competitor to the more well-known theories of Musical Platonism and nominalism. Worse still, there is no detailed account in the literature of the nature of the universals that the Aristotelian identifies musical works with. In this paper, I argue that the best (...) version of Musical Aristotelianism identifies musical works with structural universals. I first motivate the view by outlining its explanatory benefits. I then argue that Musical Aristotelianism is preferable to Musical Platonism and present a novel account of musical works as structural universals by developing D. M. Armstrong’s theory of structural universals. I discuss the consequences of Musical Aristotelianism with respect to on-going issues in debates about musical works and defend the view against an influential objection, concluding that Musical Aristotelianism is a genuine competitor in debates about the nature of musical works. This paper introduces the reconstitutor as a comprehensive unit of heredity within the context of evolutionary research. A reconstitutor is the structure resulting from a set of relationships between different elements or processes that are actively involved in the recreation of a specific phenotypic variant in each generation regardless of the biomolecular basis of the elements or whether they stand in a continuous line of ancestry. Firstly, we justify the necessity of introducing the reconstitutor by showing the limitations of other (...) evolutionary conceptions of the unit of heredity, such as the replicator, the reproducer, and the Darwinian individual. We argue that these conceptions are based on the requirement of lineage formation, which we argue to be unnecessary for the existence of evolutionary heredity. In the second part, we introduce the reconstitutor, which we base on the concept of Stability of Traits, and illustrate how it covers cases of hereditary phenomena not covered by the previous accounts. Secondly, we illustrate how the reconstitutor could serve as a platform to rethink ecological inheritance and other forms of inheritance that have been recently introduced under the song/singer model of evolution. Samuel Alexander was a central figure of the new wave of realism that swept across the English-speaking world in the early twentieth century. His Space, Time, and Deity (1920a, 1920b) was taken to be the official statement of realism as a metaphysical system. But many historians of philosophy are quick to point out the idealist streak in Alexander’s thought. After all, as a student he was trained at Oxford in the late 1870s and early 1880s as British Idealism was beginning (...) to flourish. This naturally had some effect on his philosophical outlook and it is said that his early work is overtly idealist. In this paper I examine his neglected and understudied reactions to British Idealism in the 1880s. I argue that Alexander was not an idealist during this period and should not be considered as part of the British Idealist tradition, philosophically speaking. (shrink)

According to reductive intellectualists about knowledge-how :147–190, 2008; Philos Phenomenol Res 78:439–467, 2009) knowledge-how is a kind of knowledge-that. To the extent that this is right, then insofar as we might conceive of ways knowledge could be extended with reference to active externalist :7–19, 1998; Clark in Supersizing the mind: embodiment, action, and cognitive extension: embodiment, action, and cognitive extension. Oxford University Press, Oxford, 2008) approaches in the philosophy of mind, we should expect no interesting difference between the two. However, (...) insofar as anti-intellectualist approaches to knowledge-how are a viable option, there is an overlooked issue of how knowledge-how might be extended, via active externalism, in ways very differently from knowledge-that. This paper explores this overlooked space, and in doing so, illustrates how a novel form of extended knowledge-how emerges from a pairing of active externalism in the philosophy of mind with anti-intellectualism in the theory of knowledge. Crucial to our argument will be a new way of thinking about the extended mind thesis, as it pertains to the kinds of state one is in when one knows how to do something, and how this state connects with non-accidentally successful performance. The harmonious free play of the imagination and understanding is at the heart of Kant’s account of beauty in the Critique of the Power of Judgement, but interpreters have long struggled to determine what Kant means when he claims the faculties are in a state of free play. In this article, I develop an interpretation of the free play of the faculties in terms of the freedom of attention. By appealing to the different way that we attend to objects in (...) aesthetic experience, we can explain how the faculties are free, even when the subject already possesses a concept of the object and is bound to the determinate form of the object in perception. In this paper, I examine the role of attention in Kant’s aesthetic theory in the Critique of the Power of Judgment. While broadly Kantian aestheticians have defended the claim that there is a distinct way that we attend to objects in aesthetic experience, Kant himself is not usually acknowledged as offering an account of aesthetic attention. On the basis of Kant’s more general account of attention in other texts and his remarks on attention in the Critique of the Power of (...) Judgment, I reconstruct Kant’s account of aesthetic attention. On this account, aesthetic attention is simultaneously directed at the form of an object and at the judging subject’s own mental states as she attends to the object. In the experience of beauty, we specifically attend to the harmonious relation between the faculties of imagination and understanding. (shrink)

Standard decision theory has trouble handling cases involving acts without finite expected values. This paper has two aims. First, building on earlier work by Colyvan (2008), Easwaran (2014), and Lauwers and Vallentyne (2016), it develops a proposal for dealing with such cases, Difference Minimizing Theory. Difference Minimizing Theory provides satisfactory verdicts in a broader range of cases than its predecessors. And it vindicates two highly plausible principles of standard decision theory, Stochastic Equivalence and Stochastic Dominance. The second aim is to (...) assess some recent arguments against Stochastic Equivalence and Stochastic Dominance. If successful, these arguments refute Difference Minimizing Theory. In this paper I examine Grace A. de Laguna’s theory of universals in its historical context and in relation to contemporary debates in analytic metaphysics. I explain the central features of her theory, arguing that her theory should be classified as a form of immanent realism and as a powers ontology. I then show in what ways her theory affords a theory of modality in terms of potentialities and discuss some of its consequences along the way.

This chapter argues that scientific and philosophical progress in our understanding of the living world requires that we abandon a metaphysics of things in favour of one centred on processes. We identify three main empirical motivations for adopting a process ontology in biology: metabolic turnover, life cycles, and ecological interdependence. We show how taking a processual stance in the philosophy of biology enables us to ground existing critiques of essentialism, reductionism, and mechanicism, all of which have traditionally been associated with (...) substance ontology. We illustrate the consequences of embracing an ontology of processes in biology by considering some of its implications for physiology, genetics, evolution, and medicine. And we attempt to locate the subsequent chapters of the book in relation to the position we defend. (shrink)

Truthmaker monism is the view that the one and only truthmaker is the world. Despite its unpopularity, this view has recently received an admirable defence by Schaffer :307–324, 2010b). Its main defect, I argue, is that it omits partial truthmakers. If we omit partial truthmakers, we lose the intimate connection between a truth and its truthmaker. I further argue that the notion of a minimal truthmaker should be the key notion that plays the role of constraining ontology and that truthmaker (...) monism is not necessary for an appropriate solution to the problem of finding truthmakers for negative truths. I conclude that we should reject truthmaker monism once and for all. (shrink)

O método é, portanto, um "caminho por meio do qual" chegamos a um fim, atingimos determinado objetivo. -/- Vejamos qual é o desafio para o professor (...) estabelecer seu método, tendo em vista os fins pedagógicos do ensino de filosofia. Comecemos comparando a metodologia do filósofo com a do cientista, para constatarmos uma diferença fundamental: os cientistas procuram manter certa '"cumplicidade metodológica", caracterizada pelo que se chamou de paradigma, um modelo comum a todos os cientistas de um determinado campo do saber, durante um período do tempo; já os filósofos não são unânimes quanto às regras do método, de modo que os caminhos percorridos por eles são diferentes, como percebemos no contato com o pensamento de Platão, Descartes, Espinosa, Hegel, Husserl, para citar apenas alguns. -/- Ao escolher o programa das aulas com o conteúdo a ser discutido em cada ano do curso, ocorre algo semelhante: nas disciplinas das áreas de matemática e ciências da natureza, por exemplo, o campo do saber é aceito pela comunidade científica, o que orienta o professor dessas disciplinas na composição daquele conteúdo. Já para a aula de filosofia, existe mais flexibilidade de escolha tanto do conteúdo como da metodologia empregada. -/- A diferença entre o ensino das demais disciplinas e o ensino da filosofia nos coloca a seguinte questão: "Se não existe um método único para orientar os filósofos - já que não há uma filosofia, mas filosofias qual o sentido, aqui, de buscar um método para ensinar a filosofar?". De fato, o professor-filósofo possui sua visão de mundo, como todo ser humano integrado a seu tempo, ciente dos problemas éticos e políticos diante dos quais toma partido. Nesse sentido, ele teria também o seu próprio método, acrescido esse fato ao conhecimento que o professor dispõe de história da filosofia. -/- Contudo, pode-se reavaliar essa objeção se destacarmos a possibilidade de alternativas metodológicas que poderão enriquecer a atividade pedagógica. -/- 1. Riscos de instrumentalizar a filosofia -/- O compromisso do professor com o exercício do filosofar decorre de não ser o seu objetivo encaminhar os alunos na direção "certa" ou "guiá-los como um farol" para que "não se extraviem". A aula de filosofia cria um espaço de discussão de conceitos, exposição plural de ideias e problematização para que permita aos educandos desenvolverem as competências necessárias para pensar por conta própria, ou seja, para a autonomia intelectual. -/- Qual seria, então, o objeto do ensino de filosofia no ensino médio? Dizendo de outra forma, a aula de filosofia teria objetivos além do próprio filosofar? -/- Vejamos alguns exemplos de risco de instrumentalização da filosofia. -/- 1.1 O ensino de filosofia é neutro? -/- Trata-se de uma questão metodológica indagar se seria possível a neutralidade do professor em filosofia. Podemos perguntar: "1Jm professor de filosofia cristão ou ateu, liberal ou marxista, platônico ou nietzschiano pode ou não repercutir nas aulas sua formação e suas preferências?". -/- É ilusório imaginar a total neutralidade nesse campo. Podemos destacar na formação do professor-educador três aspectos importantes: -/- • qualificação: o professor precisa adquirir os conhecimentos indispensáveis ao ensino de um conteúdo específico; -/- • formação pedagógica: a atividade educativa supera os níveis do senso comum para se tornar uma atividade sistematizada; -/- • formação ética e política: o professor educa com base em valores. -/- Assim diz o professor Antônio Joaquim Severino, a propósito da formação de todo e qualquer educador: -/- Sem dúvida, um curso de formação de educadores pressupõe necessariamente um mínimo de habilitação técnica, fundada n um campo de conhecimentos científicos. [...] Também ao educador, como a qualquer outro profissional, impõe-se a exigência da competência, entendida como domínio de conteúdos, dos métodos, das técnicas especializadas relativas à área dos conhecimentos educacionais. [...] -/- Mas, sem prejuízo deste compromisso com a competência, os cursos de formação de educadores têm que assumir um outro compromisso: o de dar sólida formação política, mediante adequada conscientização dos aspectos políticos, económicos e sociais da realidade histórica em que se desenvolvem os processos educacionais nos quais atuará o futuro educador. [...] Todo projeto educacional será necessariamente um projeto politico e não há como evitá-lo. A educação, como qualquer outra atividade humana, não é um processo neutro. Ao contrário, é salutar oferecer um leque maior de concepções filosóficas. -/- Não nos referimos, no entanto, a uma "assepsia" pela qual os alunos não tenham acesso às posições assumidas pelo professor. Evitar a parcialidade em temas socialmente controversos não significa abster-se de opinar, desde que sua posição esteja ancorada em argumentações firmadas na sua experiência com a história da filosofia e aberta ao debate plural. -/- Com essas ponderações, não se pretende indicar regras de conduta ao professor, mas apenas acenar com a necessidade de refletir sobre alternativas entre parcialidade e neutralidade do ensino a fim de não instrumentalizar a filosofia. -/- 1.2 A filosofia “ensina” cidadania? -/- Uma polêmica despertada pelo artigo 2° da LDB de 1996 nos ajuda a refletir um pouco mais sobre o tema do risco da instrumentalização da filosofia: -/- A educação, dever da família e do Estado, inspirada nos princípios de liberdade e nos ideais de solidariedade humana, tem por finalidade o pleno desenvolvimento do educando, seu preparo para o exercício da cidadania e sua qualificação para o trabalho (BRASIL, 1996). -/- No que se refere ao ensino de filosofia, a pergunta é a seguinte: "Pode-se dizer que um dos objetivos da filosofia no ensino médio é ensinar cidadania?". Esse questionamento não visa negar a importância de educar para a cidadania, mas convém saber como fazê-lo. -/- Posicionando-se sobre esse debate, vejamos o que diz o documento do MEC Orientações Curriculares para o Ensino Médio, elaborado em 2006: -/- Independentemente, neste momento, de qualquer avaliação acerca da concepção que se apresenta na legislação, cabe ressaltar, em primeiro lugar, que seria criticável tentar justificar a filosofia apenas por sua contribuição como um instrumental para a cidadania. Mesmo que pudesse fazê-lo, ela nunca deveria ser limitada a isso. Muito mais amplo é, por exemplo, seu papel no processo de formação geral dos jovens (BRASIL, 2006, p. 25-26). -/- Após ressaltar que preparar para a cidadania é "um papel do conjunto das disciplinas e da política pública voltada para essa etapa da formação", lemos na mesma página do referido documento: -/- A pergunta que se coloca é: qual a contribuição especifica da filosofia em relação ao exercício da cidadania para essa etapa da formação? A resposta a essa questão destaca o papel peculiar da filosofia no desenvolvimento da competência geral de fala, leitura e escrita — competência aqui compreendida de um modo bastante especial e ligada à natureza argumentativa da filosofia e à sua tradição histórica. [realce nosso] Cabe, então, especificamente à filosofia, a capacidade de análise, de reconstrução racional e de crítica a partir da compreensão de que tomar posições diante de textos propostos de qualquer tipo (tanto textos filosóficos quanto textos não filosóficos e formações discursivas não explicitadas em textos) e emitir opiniões acerca deles é um pressuposto indispensável para o exercício da cidadania (BRASIL, 2006, p. 25-26). -/- A educação para a cidadania, portanto, não se reduz necessariamente à leitura de textos específicos sobre cidadania, embora estes não sejam desconsiderados. If science fiction is a genre, then attempts to think about the nature of science fiction will be affected by one’s understanding of what genres are. I shall examine two approaches to genre, one dominant but inadequate, the other better, but only occasionally making itself seen. I shall then discuss several important, interrelated issues, focusing particularly on science fiction : what it is for a work to belong to a genre, the semantics of genre names, the validity of attempts to (...) define genres, and the connections between genre and normativity. One important but neglected clue to the nature of genres lies in the kinds of disagreements they generate over the assignment of works to genres. I conclude by explaining why these disagreements tell us something about the nature of genres, and discussing in some detail two famous cases of disagreement about whether some work or works are science fiction. Trope theory is a leading metaphysical theory in analytic ontology. One of its classic statements is found in the work of Donald C. Williams who argued that tropes qua abstract particulars are the very alphabet of being. The concept of an abstract particular has been repeatedly attacked in the literature. Opponents and proponents of trope theory alike have levelled their criticisms at the abstractness of tropes and the associated act of abstraction. In this paper I defend the concept of a (...) trope qua abstract particular by rejecting arguments that purport to show that tropes should not be understood as abstract and by arguing that the abstractness of tropes plays an indispensable role in one of our more promising trope-theoretic analyses of universals and of concrete objects. This pair of articles provides a critical commentary on contemporary approaches to statistical mechanical probabilities. These articles focus on the two ways of understanding these probabilities that have received the most attention in the recent literature: the epistemic indifference approach, and the Lewis-style regularity approach. These articles describe these approaches, highlight the main points of contention, and make some attempts to advance the discussion. Purpose Prescription stimulant use as “cognitive enhancers” has been described among undergraduate college students. However, the use of prescription stimulants among future health care professionals is not well characterized. This study was designed to determine the prevalence of prescription stimulant misuse among students at an academic health sciences center. -/- Method Electronic surveys were e-mailed to 621 medical, pharmacy, and respiratory therapy students at East Tennessee State University for four consecutive weeks in fall 2011. Completing the survey was voluntary and (...) anonymous. Surveys asked about reasons for, frequency of, and side effects of nonprescription misuse of prescription stimulants. Given the sensitive material, an opportunity to win one of ten $50 gift cards was used as an incentive. -/- Results Three hundred seventy-two (59.9%) students completed the survey from three disciplines (47.6% medical, 70.5% pharmacy, and 57.6% respiratory therapy). Overall, 11.3% of responders admitted to misusing prescription stimulants. There was more misuse by respiratory therapy students, although this was not statistically significant (10.9% medicine, 9.7% pharmacy, 26.3% respiratory therapy; P = .087). Reasons for prescription stimulant misuse included to enhance alertness/ energy (65.9%), to improve academic performance (56.7%), to experiment (18.2%), and to use recreationally/get high (4.5%). -/- Conclusions Prescription stimulant misuse was prevalent among participating students, but further research is needed to describe prevalence among future health care workers more generally. The implications and consequences of such misuse require further study across professions with emphasis on investigating issues of academic dishonesty (e.g., “cognitive enhancement”), educational quality, and patient safety or health care quality. Background: Broccoli is an edible green plant in the cabbage family (family Brassicaceae, genus Brassica) whose large flowering head, stalk and small associated leaves are eaten as a vegetable. A leaf of Broccoli might be affected of Several Diseases descriped in this paper . When symptoms is encountered, it requires some kind of medical care. If appropriate Survival of Broccoli Diseases is not taken quickly, it can lead to Broccoli to die . Objectives: The main goal of this expert system (...) is to get the appropriate diagnosis of disease and the correct treatment. Methods: In this paper the design of the proposed Expert System which was produced to help Farmers in diagnosing many of the broccoli diseases such as : Damping Off,Club root of crucifers or Finger and toe disease,Alternaria leaf spot,Black rot,Downy mildew, and White rust. It is intuitive that circumstantial ignorance, even when culpable, can mitigate blameworthiness for morally wrong behavior. In this paper I suggest an explanation of why this is so. The explanation offered is that an agent’s degree of blameworthiness for some action depends at least in part upon the quality of will expressed in that action, and that an agent’s level of awareness when performing a morally wrong action can make a difference to the quality of will that is expressed in (...) it. This explanation makes use of Holly Smith’s distinction between benighting and benighted actions as well as a notion developed here called “capture.”. (shrink)

In the early twentieth century, many philosophers in America thought that time should be taken seriously in one way or another. George P. Adams (1882-1961) argued that the past, present and future are all real but only the present is actual. I call this theory ‘actualist eternalism’. In this paper, I articulate his novel brand of eternalism as one piece of his metaphysical system and I explain how he argued for the view in light of the best explanations of temporal (...) experience and the present. I argue that his exploitation of analogies between time and modality offer some lessons for current debates about time such as the importance of providing a temporal epistemology. I also extract what I call the temporal boundary problem and argue that it gives rise to an unaddressed challenge for presentists and growing block theorists. (shrink)

Most of us spend a significant portion of our lives learning, practising, and performing a wide range of skills. Many of us also have a great amount of control over which skills we learn and develop. From choices as significant as career pursuits to those as minor as how we spend our weeknight leisure time, we exercise a great amount of agency over what we know and what we can do. In this paper we argue, using a framework first developed (...) by Carbonell (2013) that in many real-world circumstances we have moral obligations to develop some skills rather than others. This pair of articles provides a critical commentary on contemporary approaches to statistical mechanical probabilities. These articles focus on the two ways of understanding these probabilities that have received the most attention in the recent literature: the epistemic indifference approach, and the Lewis-style regularity approach. These articles describe these approaches, highlight the main points of contention, and make some attempts to advance the discussion. The second of these articles discusses the regularity approach to statistical mechanical probabilities, and describes some areas (...) where further research is needed. (shrink)

David Lewis objected to theories that posit necessary connections between distinct entities and to theories that involve a magical grasping of their primitives. In On the Plurality of Worlds, Lewis objected to nondescript ersatzism on these grounds. The literature contains several reconstructions of Lewis’ critique of nondescript ersatzism but none of these interpretations adequately address his main argument because they fail to see that Lewis’ critique is based on broader methodological considerations. I argue that a closer look at his methodology (...) reveals the broader objection he presented against nondescript ersatzism. This objection, I further argue, remains a challenge for the ersatzer who posits structure-less entities as possible worlds. (shrink)

Investigation of neural and cognitive processes underlying individual variation in moral preferences is underway, with notable similarities emerging between moral- and risk-based decision-making. Here we specifically assessed moral distributive justice preferences and non-moral financial gambling preferences in the same individuals, and report an association between these seemingly disparate forms of decision-making. Moreover, we find this association between distributive justice and risky decision-making exists primarily when the latter is assessed with the Iowa Gambling Task. These findings are consistent with neuroimaging studies (...) of brain function during moral and risky decision-making. This research also constitutes the first replication of a novel experimental measure of distributive justice decision-making, for which individual variation in performance was found. Further examination of decision-making processes across different contexts may lead to an improved understanding of the factors affecting moral behaviour. (shrink)

While epistemic democrats have claimed that majority rule recruits the wisdom of the crowd to identify correct answers to political problems, the conjecture remains abstract. This article illustrates how majority rule leverages the epistemic capacity of the electorate to practically enhance the instrumental value of elections. To do so, we identify a set of sufficient conditions that effect such a majority rule mechanism, even when the decision in question is multidimensional. We then look to the case of sociotropic economic voting (...) in US presidential elections to provide empirical tractability for these conditions. We find that absent such an epistemic capacity a number of presidential elections might well have been decided differently. By generating clear conditions for the plausibility of claims made by epistemic democrats, and demonstrating their correspondence to empirical data, this article strengthens the broader instrumental grounds recommending democracy. This paper addresses several questions related to the nature, production, and use of animal-human (a-h) chimeras. At the heart of the issue is whether certain types of a-h chimeras should be brought into existence, and, if they are, how we should treat such creatures. In our current research environment, we recognize a dichotomy between research involving nonhuman animal subjects and research involving human subjects, and the classification of a research protocol into one of these categories will trigger different ethical standards (...) as to the moral permissibility of the research in question. Are a-h chimeras entitled to the more restrictive and protective ethical standards applied to human research subjects? We elucidate an Aristotelian-Thomistic metaphysical framework in which to argue how such chimeras ought to be defined ontologically. We then examine when the creation of, and experimentation upon, certain types of a-h chimeras may be morally permissible. (shrink)
