This paper aims at providing an account of juridical acts that forms a suitable starting point for the creation of computational systems that deal with juridical acts. The paper is divided into two parts. This second part of the paper deals in some detail with the operation of juridical acts. Topics dealt with include: power and competence, capacity, form requirements, partial validity, avoidance and representation.

In 1880, when Oliver Wendell Holmes (later to be a Justice of the U.S. Supreme Court) criticized the logical theology of law articulated by Christopher Columbus Langdell (the first Dean of Harvard Law School), neither Holmes nor Langdell was aware of the revolution in logic that had begun, the year before, with Frege's Begriffsschrift. But there is an important element of truth in Holmes's insistence that a legal system cannot be adequately understood as a system of axioms and corollaries; and (...) this element of truth is not obviated by the more powerful logical techniques that are now available. There are numerous contexts in which philosophers and others use model-theoretic methods in assessing the validity of ordinary arguments; consider, for example, the use of models built upon 'possible worlds' in examinations of modal arguments. But the relevant uses of model-theoretic techniques may seem to assume controversial semantic or metaphysical accounts of ordinary concepts. So, numerous philosophers have suggested that standard uses of model-theoretic methods in assessing the validity of modal arguments commit one to accepting that modal claims are to (...) be analysed in terms of possible worlds. The paper provides a very general account of how uses of model-theoretic methods in demonstrating facts about validity and invalidity may in fact often be uncoupled from controversial semantic or metaphysical theses, applying the resulting techniques to some modal cases in particular. The Idea behind Tarski's Definition of Truth. In Tarski's presentations of his truth-definition, the steps of the construction are not sufficiently explained. It is not clear, on what general strategy the construction is based, what the fundamental ideas are, how some crucial steps work, and especially how the transition from the definition of satisfaction to the definition of truth should be understood. The paper shows that the account given in the model-theoretic literature, which is supported by Tarski's lemmata A and (...) B, is unsatisfactory, because Tarski's notion of truth can't be interpreted as ‘truth independent of the assignment of values to the variables’. Moreover, a satisfactory account of all the crucial steps is given. (shrink)

My paper takes issue both with the standard view that the Tractatus contains a correspondence theory and with recent suggestions that it features a deflationary or semantic theory. Standard correspondence interpretations are mistaken, because they treat the isomorphism between a sentence and what it depicts as a sufficient condition of truth rather than of sense. The semantic/deflationary interpretation ignores passages that suggest some kind of correspondence theory. The official theory of truth in the Tractatus is an obtainment theory – a (...) sentence is true iff the state of affairs it depicts obtains. This theory differs from deflationary theories in that it involves an ontology of states of affairs/facts; and it can be transformed into a type of correspondence theory: a sentence is true iff it corresponds to, i.e. depicts an obtaining state of affairs (fact). Admittedly, unlike correspondence theories as commonly portrayed, this account does not involve a genuinely truth-making relation. It features a relation of correspondence, yet it is that of depicting, between a meaningful sentence and its sense – a possible state of affairs. What makes for truth is not that relation, but the obtaining of the depicted state of affairs. This does not disqualify the Tractatus from holding a correspondence theory, however, since the correspondence theories of Moore and Russell are committed to a similar position. Alternatively, the obtainment theory can be seen as a synthesis of correspondence, semantic and deflationary approaches. It does justice to the idea that what is true depends solely on what is the case, and it combines a semantic explanation of the relation between a sentence and what it says with a deflationary account of the agreement between what the sentence says and what obtains or is the case if it is true. We forward an epistemological perspective regarding non-classical logics which restores the universality of logic in accordance with the thesis of global pluralism. In this perspective every non-classical truth-theory is actually a theory of some metalinguistic concept which does not coincide with the concept of truth (described by Tarski's truth theory). We intend to apply this point of view to Quantum Logic (QL) in order to prove that its structure properties derive from properties of the metalinguistic concept of testability in Quantum (...) Physics. To this end we construct a classical language L cand endow it with a classical effective interpretation which is partially inspired by the Ludwig approach to the foundations of Quantum Mechanics. Then we select two subsets of formulas in L cwhich can be considered testable because of their interpretation and we show that these subsets have the structure properties of Quantum Logics because of Quantum Mechanical axioms, as desired. Finally we comment on some relevant consequences of our approach (in particular, the fact that no non-classical logic is strictly needed in Quantum Physics). (shrink)

This paper gives an account of Anderson and Belnap’s selection criteria for an adequate theory of entailment. The criteria are grouped into three categories: criteria pertaining to modality, those pertaining to relevance, and those related to expressive strength. The leitmotif of both this paper and its prequel is the relevant legitimacy of disjunctive syllogism. Relevant logics are commonly held to be paraconsistent logics. It is shown in this paper, however, that both E and R can be extended to explosive logics (...) which satisfy all of Anderson and Belnap’s selection criteria, provided the truth-constant known as the Ackermann constant is available. One of the selection criteria related to expressive strength is having an “enthymematic” conditional for which a deduction theorem holds. I argue that this allows for a new interpretation of Anderson and Belnap’s take on logical consequence, namely as committing them to pluralism about logical consequence. (shrink)

What does it take for two logics to be mere notational variants? The present paper proposes a variety of different ways of cashing out notational variance, in particular isolating a constraint on any reasonable account of notational variance which makes plausible that the only kinds of translations which can witness notational variance are what are sometimes called definitional translations.

Both the traditional Aristotelian and modern symbolic approaches to logic have seen logic in terms of discrete symbol processing. Yet there are several kinds of argument whose validity depends on some topological notion of continuous variation, which is not well captured by discrete symbols. Examples include extrapolation and slippery slope arguments, sorites, fuzzy logic, and those involving closeness of possible worlds. It is argued that the natural first attempts to analyze these notions and explain their relation to reasoning fail, so (...) that ignorance of their nature is profound. (shrink)

In this paper I argue that pluralism at the level of logical systems requires a certain monism at the meta-logical level, and so, in a sense, there cannot be pluralism all the way down. The adequate alternative logical systems bottom out in a shared basic meta-logic, and as such, logical pluralism is limited. I argue that the content of this basic meta-logic must include the analogue of logical rules Modus Ponens and Universal Instantiation. I show this through a detailed analysis (...) of the ‘adoption problem’, which manifests something special about MP and UI. It appears that MP and UI underwrite the very nature of a logical rule of inference, due to all rules of inference being conditional and universal in their structure. As such, all logical rules presuppose MP and UI, making MP and UI self-governing, basic, unadoptable, and required in the meta-logic for the adequacy of any logical system. (shrink)

This paper offers a framework for extending Arnon Avron and Iddo Lev’s non-deterministic semantics to quantified predicate logic with the intent of resolving several problems and limitations of Avron and Anna Zamansky’s approach. By employing a broadly Fregean picture of logic, the framework described in this paper has the benefits of permitting quantifiers more general than Walter Carnielli’s distribution quantifiers and yielding a well-behaved model theory. This approach is purely objectual and yields the semantical equivalence of both α-equivalent formulae and (...) formulae differing only by codenotative terms. Finally, we make a brief excursion into non-deterministic model theory, proving a strong Łoś’ Theorem and compactness for all finitely-valued, non-deterministic logics whose quantifiers have intensions describable in a first order metalanguage. According to tradition, logic is normative for reasoning. According to many contemporary philosophers of logic, there is more than one correct logic. What is the relationship between these two strands of thought? This paper makes two claims. First, logic is doubly normative for reasoning because, in addition to constraining the combinations of beliefs that we may have, logic also constrains the methods by which we may form them. Second, given that logic is doubly normative for reasoning, a wide array of (...) logical pluralisms are inconsistent with the normativity of logic as they entail contradictory claims about how agents ought to reason. A pos isepistemologically sustained in its claim forscientific status by a line of demarcation orlod. A lod is supported by truthclaims based on various forms ofcorrespondence. As these forms have beeninterrogated and abandoned, correspondence hasgiven way to coherentism and finally to testsof falsification. As falsification has shownto contain serious flaws when compared to theactual (...) history of scientific discoveries, theentire project of a distinct and unitaryfield known as educational administration isseriously cast into doubt. Contemporaryexaminations in educational administrationdiscourse show that even when the lod hasbeen undermined by epistemological shifts, theinitial pos has remained to supportclaims regarding the project of a ``science ofleadership.'' The analysis contained in thisarticle show, however, that when claims of thelod are demonstrably unsustainable, theinitial pos must be similarly abandoned. With that collapse the concept of a fieldis likewise effaced. The epistemologicalalternative is to envision fields ofstudy which do not require a lod, excepton a longitudinal basis to ascertain whether aresearch program shaped and sustained by it isprogressive or regressive. In short, there areno aprori meta-criteria to separate sciencefrom non-science in educationaladministration. (shrink)

Starting from a concept of reasonableness as well-consideredness, it is discussed in what way science could serve as a model for reasonable argumentation. It turns out that in order to be reasonable two requirements have to be fulfilled. The argumentation should comply with rules which are both problem-valid and intersubjectively valid. Geometrical and anthropological perspectives don't meet these criteria, but a critical perspective does. It is explained that a pragma-dialectical approach to argumentation which agrees with this critical perspective is indeed (...) problem-valid and that strong pragmatic and utilitarian arguments can be given for its intersubjective validity. Thus, conventional validity is promoted for a code of conduct for discussants who want to resolve their disputes reasonably by way of a critical discussion. (shrink)

To save antirealism from Fitch's Paradox, Tennant has proposed to restrict the scope of the antirealist principle that all truths are knowable to truths that can be consistently assumed to be known. Although the proposal solves the paradox, it has been accused of doing so in an ad hoc manner. This paper argues that, first, for all Tennant has shown, the accusation is just; second, a restriction of the antirealist principle apparently weaker than Tennat's yields a non-ad hoc solution to (...) Fitch's Paradox; and third, the alternative is only apparently weaker than, and even provably equivalent to, Tennant's. It is thereby shown that the latter is not ad hoc after all. (shrink)

Logical nihilism is the view that the relation of logical consequence is empty: there are counterexamples to any putative logical law. In this paper, I argue that the nihilist threat is illusory. The nihilistic arguments do not work. Moreover, the entire project is based on a misguided interpretation of the generality of logic.

John Cook Wilson (1849–1915) was Wykeham Professor of Logic at New College, Oxford and the founder of ‘Oxford Realism’, a philosophical movement that flourished at Oxford during the first decades of the 20th century. Although trained as a classicist and a mathematician, his most important contribution was to the theory of knowledge, where he argued that knowledge is factive and not definable in terms of belief, and he criticized ‘hybrid’ and ‘externalist’ accounts. He also argued for direct realism in perception, (...) criticizing both empiricism and idealism, and argued for a moderate nominalist view of universals as being in rebus and only ‘apprehended’ by their particulars. His influence helped swaying Oxford away from idealism and, through figures such as H. A. Prichard, Gilbert Ryle, or J. L. Austin, his ideas were also to some extent at the origin of ‘moral intuitionism’ and ‘ordinary language philosophy’ which defined much of Oxford philosophy until the second half of the twentieth-century. Nevertheless, his name and legacy were all but forgotten for generations after World War II. Still, his views on knowledge are with us today, being in part at work in the writings of philosophers as diverse as John McDowell, Charles Travis, and Timothy Williamson. (shrink)

Logical monism is the view that there is ‘One True Logic’. This is the default position, against which pluralists react. If there were not ‘One True Logic’, it is hard to see how there could be one true theory of anything. A theory is closed under a logic! But what is logical monism? In this article, I consider semantic, logical, modal, scientific, and metaphysical proposals. I argue that, on no ‘factualist’ analysis (according to which ‘there is One True Logic’ expresses (...) a factual claim, rather than an attitude like approval), does the doctrine have both metaphysical and methodological import. Metaphysically, logics abound. Methodologically, what to infer from what is not settled by the facts, even the normative ones. I conclude that the only interesting sense in which there could be One True Logic is noncognitive. The same may be true of monism about normative areas, like moral, epistemic, and prudential ones, generally. (shrink)

The paper analyses economic evaluations by distinguishing evaluative statements from actual value judgments. From this basis, it compares four solutions to the value neutrality problem in economics. After rebutting the strong theses about neutrality (normative economics is illegitimate) and non-neutrality (the social sciences are value-impregnated), the paper settles the case between the weak neutrality thesis (common in welfare economics) and a novel, weak non-neutrality thesis that extends the realm of normative economics more widely than the other weak thesis does.

The Linda paradox is a key topic in current debates on the rationality of human reasoning and its limitations. We present a novel analysis of this paradox, based on the notion of verisimilitude as studied in the philosophy of science. The comparison with an alternative analysis based on probabilistic confirmation suggests how to overcome some problems of our account by introducing an adequately defined notion of verisimilitudinarian confirmation.

Languages involving modalities and languages involving vagueness have each been thoroughly studied. On the other hand, virtually nothing has been said about the interaction of modality and vagueness. This paper aims to start filling that gap. Section 1 is a discussion of various possible sources of vague modality. Section 2 puts forward a model theory for a quantified language with operators for modality and vagueness. The model theory is followed by a discussion of the resulting logic. Tarski’s pioneering work on truth has been thought by some to motivate a robust, correspondence-style theory of truth, and by others to motivate a deflationary attitude toward truth. I argue that Tarski’s work suggests neither; if it motivates any contemporary theory of truth, it motivates conceptual primitivism, the view that truth is a fundamental, indefinable concept. After outlining conceptual primitivism and Tarski’s theory of truth, I show how the two approaches to truth share much in common. While Tarski does not (...) explicitly accept primitivism, the view is open to him, and fits better with his formal work on truth than do correspondence or deflationary theories. Primitivists, in turn, may rely on Tarski’s insights in motivating their own perspective on truth. I conclude by showing how viewing Tarski through the primitivist lens provides a fresh response to some familiar charges from Putnam and Etchemendy. (shrink)

In this note I present a solution to Kripkenstein’s paradox, based on a very simple argument: (1) natural language and rule-following are empirical phenomena; (2) no case has been described, in real life, of a person who behaves as Wittgenstein’s or Kripke’s fictional character; (3) therefore, the discussion of such a case is completely devoid of interest. I lay out the example of a ‘Kripkensteinian apple’, which has a normal weight on even days and is weightless on odd days, in (...) order to highlight the contrast between a genuinely empirical perspective, such as that of physics, and the logical-analytical perspective, under which Kripkenstein’s paradox has attracted so much attention. Teorija se nadovezuje na neka gledišta Putnama i Goodmana, no razvija ta gledišta tvrdeći kako se istina sastoji u tome da se iskaz podudara s jednim od sljedećih parametara ili s više njih: kriterij interne konsistentnosti; osjetilni podaci; podaci iz pamćenja; ne-verbalizirana vjerovanja; drugi dijelovi diskursa. Opća kognitivna struktura, koja, prema Rayu Jackendoffu, služi kao točka konvergencije za značenje preneseno jezikom, pozadinsko znanje, opažanje, zaključivanje, itd., identificira se kao medij podudaranja (...) koje rezultira kognitivnim učinkom: »to je istina«. Teorija također tvrdi kako je istina pojam-obitelj, obuhvaćajući različite vrste istine. Ukazuje se na to da istina ima normativnu dimenziju, koja se obrazlaže kao mogućnost izazova tvrdnjama koje pretendiraju na istinitost, što pak pretpostavlja regulativni ideal univerzalne ljudske racionalnosti. The aim of this paper is to clarify the truth-functional interpretation of the logical connective of the material implication. The importance of such clarification lies in the fact that it allows avoiding the supposed paradoxes introduced by C. I. Lewis (1918). I argue that an adequate understanding of the history and purposes of logic is enough to dissolve them away. The defense is based on an exposition of propositional compositionalism. To compare, I also present Stalnaker’s (1968) alternative that seeks to (...) explain the implicit concept of conditionality of conditionals assertions. In order to reinforce my aim I expound the twelve different meanings of ‘implication’ stated by Corcoran (1993) in order to hold that a proper understanding of these meanings allows us to avoid ambiguities and confusions. Finally, I expect to show that despite the possible alternatives, compositionalism is still the best explanation for the truth-functionality account of logical connectives. (shrink)
