In the Book of Common Prayer’s Rite II version of the Eucharist, the congregation confesses, “we have sinned against you in thought, word, and deed”. According to this confession we wrong God not just by what we do and what we say, but also by what we think. The idea that we can wrong someone not just by what we do, but by what think or what we believe, is a natural one. It is the kind of wrong we feel (...) when those we love believe the worst about us. And it is one of the salient wrongs of racism and sexism. Yet it is puzzling to many philosophers how we could wrong one another by virtue of what we believe about them. This paper defends the idea that we can morally wrong one another by what we believe about them from two such puzzles. The first puzzle concerns whether we have the right sort of control over our beliefs for them to be subject to moral evaluation. And the second concerns whether moral wrongs would come into conflict with the distinctively epistemic standards that govern belief. Our answer to both puzzles is that the distinctively epistemic standards governing belief are not independent of moral considerations. This account of moral encroachment explains how epistemic norms governing belief are sensitive to the moral requirements governing belief. (shrink)

This paper compares two alternative explanations of pragmatic encroachment on knowledge (i.e., the claim that whether an agent knows that p can depend on pragmatic factors). After reviewing the evidence for such pragmatic encroachment, we ask how it is best explained, assuming it obtains. Several authors have recently argued that the best explanation is provided by a particular account of belief, which we call pragmatic credal reductivism. On this view, what it is for an agent to believe a proposition is (...) for her credence in this proposition to be above a certain threshold, a threshold that varies depending on pragmatic factors. We show that while this account of belief can provide an elegant explanation of pragmatic encroachment on knowledge, it is not alone in doing so, for an alternative account of belief, which we call the reasoning disposition account, can do so as well. And the latter account, we argue, is far more plausible than pragmatic credal reductivism, since it accords far better with a number of claims about belief that are very hard to deny. (shrink)

Traditional philosophical discussions of knowledge have focused on the epistemic status of full beliefs. In this book, Moss argues that in addition to full beliefs, credences can constitute knowledge. For instance, your .4 credence that it is raining outside can constitute knowledge, in just the same way that your full beliefs can. In addition, you can know that it might be raining, and that if it is raining then it is probably cloudy, where this knowledge is not knowledge of propositions, (...) but of probabilistic contents. -/- The notion of probabilistic content introduced in this book plays a central role not only in epistemology, but in the philosophy of mind and language as well. Just as tradition holds that you believe and assert propositions, you can believe and assert probabilistic contents. Accepting that we can believe, assert, and know probabilistic contents has significant consequences for many philosophical debates, including debates about the relationship between full belief and credence, the semantics of epistemic modals and conditionals, the contents of perceptual experience, peer disagreement, pragmatic encroachment, perceptual dogmatism, and transformative experience. In addition, accepting probabilistic knowledge can help us discredit negative evaluations of female speech, explain why merely statistical evidence is insufficient for legal proof, and identify epistemic norms violated by acts of racial profiling. Hence the central theses of this book not only help us better understand the nature of our own mental states, but also help us better understand the nature of our responsibilities to each other. The book was planned and written as a single, sustained argument. But earlier versions of a few parts of it have appeared separately. The object of this book is both to establish the existence of the paradoxes, and also to describe a non-Pascalian concept of probability in terms of which one can analyse the structure of forensic proof without giving rise to such typical signs of theoretical misfit. Neither the complementational principle for negation nor the multiplicative principle for conjunction applies (...) to the central core of any forensic proof in the Anglo-American legal system. There are currently two robust traditions in philosophy dealing with doxastic attitudes: the tradition that is concerned primarily with all-or-nothing belief, and the tradition that is concerned primarily with degree of belief or credence. This paper concerns the relationship between belief and credence for a rational agent, and is directed at those who may have hoped that the notion of belief can either be reduced to credence or eliminated altogether when characterizing the norms governing ideally rational agents. It presents a (...) puzzle which lends support to two theses. First, that there is no formal reduction of a rational agent’s beliefs to her credences, because belief and credence are each responsive to different features of a body of evidence. Second, that if our traditional understanding of our practices of holding each other responsible is correct, then belief has a distinctive role to play, even for ideally rational agents, that cannot be played by credence. Moral encroachment holds that the epistemic justification of a belief can be affected by moral factors. If the belief might wrong a person or group more evidence is required to justify the belief. Moral encroachment thereby opposes evidentialism, and kindred views, which holds that epistemic justification is determined solely by factors pertaining to evidence and truth. In this essay I explain how beliefs such as ‘that woman is probably an administrative assistant’—based on the evidence that most women employees at the (...) firm are administrative assistants—motivate moral encroachment. I then describe weaknesses of moral encroachment. Finally I explain how we can countenance the moral properties of such beliefs without endorsing moral encroachment, and I argue that the moral status of such beliefs cannot be evaluated independently from the understanding in which they are embedded. According to a captivating picture, epistemic justification is essentially a matter of epistemic or evidential likelihood. While certain problems for this view are well known, it is motivated by a very natural thought—if justification can fall short of epistemic certainty, then what else could it possibly be? In this paper I shall develop an alternative way of thinking about epistemic justification. On this conception, the difference between justification and likelihood turns out to be akin to the more widely recognised difference (...) between ceteris paribus laws and brute statistical generalisations. I go on to discuss, in light of this suggestion, issues such as classical and lottery-driven scepticism as well as the lottery and preface paradoxes. (shrink)

Subject-sensitive invariantism posits surprising connections between a person’s knowledge and features of her environment that are not paradigmatically epistemic features. But which features of a person’s environment have this distinctive connection to knowledge? Traditional defenses of subject-sensitive invariantism emphasize features that matter to the subject of the knowledge-attribution. Call this pragmatic encroachment. A more radical thesis usually goes ignored: knowledge is sensitive to moral facts, whether or not those moral facts matter to the subject. Call this moral encroachment. The law views with suspicion statistical evidence, even evidence that is probabilistically on a par with direct, individual evidence that the law is in no way suspicious of. But it has proved remarkably hard to either justify this suspicion, or to debunk it. In this paper, we connect the discussion of statistical evidence to broader epistemological discussions of similar phenomena. We highlight Sensitivity – the requirement that a belief be counterfactually sensitive to the truth in a specific way – as (...) a way of epistemically explaining the legal suspicion towards statistical evidence. Still, we do not think of this as a satisfactory vindication of the reluctance to rely on statistical evidence. Knowledge – and Sensitivity, and indeed epistemology in general – are of little, if any, legal value. Instead, we tell an incentive-based story vindicating the suspicion towards statistical evidence. We conclude by showing that the epistemological story and the incentive-based story are closely and interestingly related, and by offering initial thoughts about the role of statistical evidence in morality. In order to perform certain actions – such as incarcerating a person or revoking parental rights – the state must establish certain facts to a particular standard of proof. These standards – such as preponderance of evidence and beyond reasonable doubt – are often interpreted as likelihoods or epistemic confidences. Many theorists construe them numerically; beyond reasonable doubt, for example, is often construed as 90 to 95% confidence in the guilt of the defendant. -/- A family of influential cases suggests (...) standards of proof should not be interpreted numerically. These ‘proof paradoxes’ illustrate that purely statistical evidence can warrant high credence in a disputed fact without satisfying the relevant legal standard. Defenses of pragmatic encroachment commonly rely on two thoughts: first, that the gap between one’s strength of epistemic position on p and perfect strength sometimes makes a difference to what one is justified in doing, and second, that the higher the stakes, the harder it is to know. It is often assumed that these ideas complement each other. This chapter shows that these ideas are far from complementary. Along the way, a variety of strategies for regimenting the somewhat inchoate notion (...) of stakes are indicated, and some troubling cases for pragmatic encroachment raised. (shrink)

The reference class problem arises when we want to assign a probability to a proposition (or sentence, or event) X, which may be classified in various ways, yet its probability can change depending on how it is classified. The problem is usually regarded as one specifically for the frequentist interpretation of probability and is often considered fatal to it. I argue that versions of the classical, logical, propensity and subjectivist interpretations also fall prey to their own variants of the reference (...) class problem. Other versions of these interpretations apparently evade the problem. But I contend that they are all “no-theory” theories of probability - accounts that leave quite obscure why probability should function as a guide to life, a suitable basis for rational inference and action. The reference class problem besets those theories that are genuinely informative and that plausibly constrain our inductive reasonings and decisions. I distinguish a “metaphysical” and an “epistemological” reference class problem. I submit that we can dissolve the former problem by recognizing that probability is fundamentally a two-place notion: conditional probability is the proper primitive of probability theory. It is argued that the standard way that the criminal justice debate regarding the permissible extent of wrongful convictions is cast is fundamentally flawed. In particular, it is claimed that there is an inherent danger in focussing our attention in this debate on different ways of measuring the probabilistic likelihood of wrongful conviction and then evaluating whether these probabilities are unacceptably high. This is because such probabilistic measures are clumsy ways of capturing the level of risk involved, to the extent (...) that a defendant can be subject to an unacceptably high level of legal risk in this regard even where the relevant probabilities are very low. An alternative conception of legal risk – one that is primarily cast along modal rather than probabilistic lines – is set out which offers a much better way of framing the debate regarding what would be an acceptable level of wrongful conviction. It is further argued that with this modal conception of legal risk in play we can capture an important necessary condition that should be imposed on legal evidence, one that has application beyond the context of the criminal trial. In this paper we argue that knowledge is characteristically safe true belief. We argue that an adequate approach to epistemic luck must not be indexed to methods of belief formation, but rather to explanations for belief. This shift is problematic for several prominent approaches to the theory of knowledge, including virtue reliabilism and proper functionalism (as normally conceived). The view that knowledge is characteristically safe true belief is better able to accommodate the shift in question.

We pose and resolve several vexing decision theoretic puzzles. Some are variants of existing puzzles, such as 'Trumped' (Arntzenius and McCarthy 1997), 'Rouble trouble' (Arntzenius and Barrett 1999), 'The airtight Dutch book' (McGee 1999), and 'The two envelopes puzzle' (Broome 1995). Others are new. A unified resolution of the puzzles shows that Dutch book arguments have no force in infinite cases. It thereby provides evidence that reasonable utility functions may be unbounded and that reasonable credence functions need not be countably (...) additive. The resolution also shows that when infinitely many decisions are involved, the difference between making the decisions simultaneously and making them sequentially can be the difference between riches and ruin. Finally, the resolution reveals a new way in which the ability to make binding commitments can save perfectly rational agents from sure losses. (shrink)

You shouldn’t have done it. But you did. Against your better judgment you scrolled to the end of an article concerning the state of race relations in America and you are now reading the comments. Amongst the slurs, the get-rich-quick schemes, and the threats of physical violence, there is one comment that catches your eye. Spencer argues that although it might be “unpopular” or “politically incorrect” to say this, the evidence supports believing that the black diner in his section will (...) tip poorly. He insists that the facts don’t lie. The facts aren’t racist. In denying his claim and in believing otherwise, it is you who engages in wishful thinking. It is you who believes against the evidence. You, not Spencer, are epistemically irrational. -/- My dissertation gives an account of the moral-epistemic norms governing belief that will help us answer Spencer and the challenge he poses. We live in a society that has been shaped by racist attitudes and institutions. Given the effects of structural racism, Spencer’s belief could have considerable evidential support. Spencer notes that it might make him unpopular, but he cares about the truth and he is willing to believe the unpopular thing. But, Spencer’s belief seems racist. Spencer asks, however, how could his belief be racist if his beliefs reflect reality and are rationally justified? Moreover, how could he wrong anyone by believing what he epistemically ought to believe given the evidence? In answer, I argue that beliefs can wrong. (shrink)

Belief is not a unified phenomenon. In this paper I argue, as a number of other riters argue, that one should distinguish a variety of belief-like attitudes: believing proper - a dispositional state which can have degrees - holding true - which can occur without understanding what one believes - and accepting - a practical and contextual attitude that has a role in deliberation and in practical reasoning. Acceptance itself is not a unified attitude. I explore the various relationships and (...) differences between these doxastic attitudes, and claim that although acceptance is distinct from belief, it rests upon it, and is therefore a species of belief. When we engage in practical deliberation, we sometimes engage in careful probabilistic reasoning. At other times, we simply make flat out assumptions about how the world is or will be. A question thus arises: when, if ever, is it rationally permissible to engage in the latter, less sophisticated kind of practical deliberation? Recently, a number of authors have argued that the answer concerns whether one knows that p. Others have argued that the answer concerns whether one is justified in believing (...) that one knows that p. Against both of these, this paper argues that the answer concerns whether p is ‘practically certain’—that is, whether the actual epistemic probability that p differs from epistemic certainty that p only in ways that are irrelevant to the decision one currently faces. I distinguish two different kinds of practical stakes associated with propositions. The W-stakes track what is at stake with respect to whether the proposition is true or false. The A-stakes track what is at stake with respect to whether an agent believes the proposition. This poses a dilemma for those who claim that whether a proposition is known can depend on the stakes associated with it. Only the W-stakes reading of this view preserves intuitions about knowledge-attributions, but only the A-stakes (...) reading preserves the putative link between knowledge and practical reasoning that has motivated it. People who defend “pragmatic encroachment” about knowledge generally advocate two ideas: you can rationally act according to what you know; knowledge is harder to achieve when more is at stake. In their chapter in this volume, Charity Anderson and John Hawthorne argue that these two ideas may not fit together so well. This chapter extends Anderson and Hawthorne’s argument. By applying some standard decision theory, we can calculate a precise quantity of “how much is at stake” that does fit together (...) with knowledge and action. While this calculated quantity matches intuitions about how much is at stake in certain standard cases, in others it does not.Keywords. (shrink)

Dual-ranking act-consequentialism (DRAC) is a rather peculiar version of act-consequentialism. Unlike more traditional forms of act-consequentialism, DRAC doesn’t take the deontic status of an action to be a function of some evaluative ranking of outcomes. Rather, it takes the deontic status of an action to be a function of some non-evaluative ranking that is in turn a function of two auxiliary rankings that are evaluative. I argue that DRAC is promising in that it can accommodate certain features of commonsense morality (...) that no single-ranking version of act-consequentialism can: supererogation, agent-centered options, and the self-other asymmetry. I also defend DRAC against three objections: (1) that its dual-ranking structure is ad hoc, (2) that it denies (putatively implausibly) that it is always permissible to make self-sacrifices that don’t make things worse for others, and (3) that it violates certain axioms of expected utility theory, viz., transitivity and independence. “Pragmatic encroachers” about knowledge generally advocate two ideas: (1) you can rationally act on what you know; (2) knowledge is harder to achieve when more is at stake. Charity Anderson and John Hawthorne have recently argued that these two ideas may not fit together so well. I extend their argument by working out what “high stakes” would have to mean for the two ideas to line up, using decision theory.

In ordinary circumstances, we can assess the worth of evidence well enough without benefit of any theory; but when evidence is especially complex, ambiguous, or emotionally disturbing—as it often is in legal contexts—epistemological theory may be helpful. A legal fact-finder is asked to determine whether the proposition that the defendant is guilty, or is liable, is established to the required degree of proof by the [admissible] evidence presented; i.e., to make an epistemological appraisal. The foundherentist theory developed in Evidence and (...) Inquiry can help us understand what this means; and reveals that degrees of proof cannot be construed as mathematical probabilities: a point illustrated by comparing the advantages of a foundherentist analysis with the disadvantages of probabilistic analyses of the evidence in the Sacco and Vanzetti case (1921), and of the role of the statistical evidence in Collins (1968).
