The long republican tradition is characterized by a conception of freedom as non‐domination, which offers an alternative, both to the negative view of freedom as non‐interference and to the positive view of freedom as self‐mastery. The first part of the book traces the rise and decline of the conception, displays its many attractions and makes a case for why it should still be regarded as a central political ideal. The second part of the book looks at the sorts of political (...) and civil institutions that would be required in a society in which freedom as non‐domination is systematically fostered. It outlines the causes and policies, the constitutional and democratic forms, and the regulatory controls that a republican state ought to endorse. And it argues for a vision of the state's relation to civil society in which there is no pretence of doing without widespread civility and trust; the argument is that the state ought, at once, to foster and build on such extra‐political foundations. This chapter explores the relationship between republican democracy and justice by comparing Philip Pettit's notion of neo-republicanism with that of Immanuel Kant. It begins by describing a republican, political conception of justice as nondomination and explaining why the discourse of republicanism and that of theories of justice often remain at odds with one another. It then considers the basis of a republican conception of justice as nondomination and locates it within the principle of justification, along with Pettit's idea of autonomy (...) and respect. It also examines the notions of ‘arbitrariness’ and ‘domination’ as well as Pettit's ‘negative republicanism’ and its emphasis on legally and politically secure freedom of choice. Judicial review by constitutional courts is often presented as a necessary supplement to democracy. This book questions its effectiveness and legitimacy. Drawing on the republican tradition, Richard Bellamy argues that the democratic mechanisms of open elections between competing parties and decision-making by majority rule offer superior and sufficient methods for upholding rights and the rule of law. The absence of popular accountability renders judicial review a form of arbitrary rule which lacks the incentive structure democracy provides to ensure rulers treat (...) the ruled with equal concern and respect. Rights based judicial review undermines the constitutionality of democracy. Its counter-majoritarian bias promotes privileged against unprivileged minorities, while its legalism and focus on individual cases distort public debate. Rather than constraining democracy with written constitutions and greater judicial oversight, attention should be paid to improving democratic processes through such measures as reformed electoral systems and enhanced parliamentary scrutiny. Interest in republicanism as a political theory has burgeoned in recent years, but its implications for the understanding of law have remained largely unexplored. Legal Republicanism is the first book to offer a comprehensive, critical survey of the potential for creating republican accounts of fundamental issues in law and legal theory.

This book discusses problems of conceptual analysis as well as normative issues of vital contemporary concern.

We have two ways of talking about liberty or freedom, one in the singular, the other in the plural. We concern ourselves in the singular mode with how far someone is free to do or not to do certain things, or with how far someone is a free person or not a free person. But, equally, we concern ourselves with the plural question as to how far the person enjoys the liberties that we take to be important or basic. What (...) are those plural liberties, however? What does it take for something to count as a basic liberty? e usual approach to this question is to give a list of some presumptive basic liberties — say, those of thought, speech, and association — and then to add a gestural ‘and so on’. My aim in this paper is to do a little better in elaborating a conception of the sorts of liberties at which the ‘and so on’ gestures. I argue that the basic liberties can be usefully identifi ed as the liberties required for living the life of a free person or citizen and I spell out that requirement in three constraints, which I describe as feasible extension, personal signifi cance and equal co-enjoyment. ere are many candidate sets of basic liberties that might be proposed for protection, whether in general or for a particular society. e claim that I defend is that in order to count as a set of basic liberties, the types of choice protected under any proposal should be capable of being equally enjoyed at the same time by everyone (equal co-enj oyment), should be important in the life of normal human beings (personal signifi cance), and should not be unnecessarily restricted: they should be as extensive as the other constraints allow (feasible extension). e aim of the paper being quite limited, I abstract from many important issues. I do not provide an argument for why it is important that some set of basic liberties be protected, nor do I rate the importance of such protection against other social goals. I say nothing on how far it should be a requirement of democracy that certain sorts of liberties are entrenched—whether constitutionally or otherwise—and how far democratic process should be allowed to vary the specifi - cation and protection of basic liberties.. In response to the dominance of liberalism, some theorists have recently embraced the republican model as an attractive alternative. The overriding appeal of these moves seems to be the robust emphasis that forms of republicanism place on citizenship and civic virtue in light of what many commentators see as a decline in the social nature of modern politics. However, many of these discussions about republicanism are inconsistent and fail to capture the essence of a classical republican theory for today's complex (...) modern world. The result is that the ideals and values of classical republicanism have become diluted and misappropriated as they are utilized by both philosophers and politicians without a clear and consistent sense of their historical pedigree and their relevance to the contemporary world. Republicanism in the Modern World develops and extends the theoretical implications of a distinctive republican conception of liberty as non-domination. Building on the recent work of Quentin Skinner and Philip Pettit, Maynor explores the complex interdependent relationship between liberty as non-domination and conflict, citizenship, and civic virtue to develop a modern theory of republicanism. Maynor argues that modern republicanism, inspired and informed by classical versions, can be the basis for a renewed effort to rejuvenate the political ideals and institutions of the modern democratic nation-state. This is an intellectual biography of Gabriel Bonnot de Mably (1709-85), who emerges as a central figure in the history of republican thought in the era of the Enlightenment and the French Revolution. Although Mably, whose career as a historian and political theorist stretched from 1740 to the eve of the French Revolution, clearly played a major role in the intellectual history of his era, there has been no study of his life and thought in English for nearly seventy years. This study sets forth a different reading of Mably's thought, one that shows him to be a classical republican, in the sense this term has acquired in recent years for students of early modern political thought. Mably was the author of the most comprehensive and influential body of republican thought produced in eighteenth-century France. This article considers the connection between Milton's republicanism and his use of natural rights language. Based on Milton's understanding of man's dignity, it claims that natural rights and civic virtue are articulated consistently. Inextricably linked to his being created free, the dignity of man is central both in the description of the birth of political society and in the defence of the inalienable right to liberty against tyrannical government. Thus, while not an end in itself, civic virtue nevertheless has an (...) irreducible moral value, for being a virtuous citizen means first of all exercising one's own freedom in a way that complies with the natural dignity of man. The very idea of republican human rights, seems paradoxical. My aim in this article is to explore this disjunctive conjunction. One of the distinctive features of republican discourse, both in its civic humanist and neo-Roman variants, is the secondary status that rights are supposed to play in politics. Although the language of rights is not incommensurable with republican political thought, it is supposed to know its place. What can republican categories of political understanding offer for grappling with the challenges of (...) global politics? Many philosophical expressions of human rights today are Kantian or neo-Kantian in inspiration, and as a result they are plagued by the familiar difficulties raised by Kantian approaches to politics in general. In particular, the growing prominence of human rights discourse has led to withering attacks on the appeal to human rights without any effective means of enforcement. Does republicanism offer any resources for rethinking human rights, and in particular, addressing the concern with the often moralistic and depoliticizing nature of human rights talk today? What conception of human rights best promotes freedom as non-domination? Are our practices of human rights effective instruments for minimizing domination? (shrink)

In his most recent book, Philip Pettit presents and defends a “republican” political philosophy that stems from a tradition that includes Cicero, Machiavelli, James Harrington, Locke, Montesquieu, Rousseau, and Madison. The book provides an interpretation of what is distinctive about republicanism—namely, Pettit claims, its notion of freedom as nondomination. He sketches the history of this notion, and he argues that it entails a unique justification of certain political arrangements and the virtues of citizenship that would make those arrangements possible. Of (...) historical and philosophical interest, he stresses, is the fundamental contrast between freedom as nondomination and slavery. Joseph Priestly, for instance, invoked this contrast in defending the cause of the American Revolution, and in 1769 declared, incredibly, that if the parliament of Great Britain continued to tax the American colonies, “the colonists will be reduced to a state of as complete servitude, as any people of which there is an account in history”. Those opposed to American independence, among them Jeremy Bentham, relied instead on a Hobbesian notion of freedom as noninterference, using it to argue that the colonists were no more interfered with by the British government than were citizens of Britain. Drawing out this contrast, Pettit aims to establish that a republican view of freedom better supports the institutions of a constitutional democracy than does liberalism. His account of the distinguishing characteristics and strengths of republicanism is, however, only partially successful. Neither his case that a republican notion of freedom provides for a more solid defense of democratic institutions and constitutional protections than is available within liberalism, nor his argument that republicanism can better address “private” injustices, is convincing. Pocock has construed the concepts of civic virtue and natural right in a way that does not fit the doctrines of the authors here considered . Since the natural right bearer is conceived by those authors more as a moral subject than as a source of desires, he needs to be a virtuous citizen to be free. Likewise, since the citizen’s virtue is not determined by his political capacities but by an exercise of his liberty, it is not absurd that he can claim a natural right to change government and to resist power.
