One of the fundamental problems in the philosophy of psychology is to determine the relation between personal and subpersonal explanations of human behavior. The problem of determining the relation between the personal and subpersonal levels is called the “interface problem”. This paper has two goals. The first is to introduce the domestic reader to the interface problem from the perspective of the philosophy of psychology. The second goal is to show that insufficient focus on the interface problem and its potential (...) solutions can lead to uncritical and fallacious reasoning that can have significant consequences for particular debates in philosophy of medicine and philosophy of law. Dva su osnovna shvatanja odnosa između ustavnih prava i analize proporcionalnosti. Prvo drži da postoji nužna veza između ustavnih prava i proporcionalnosti; drugo tvrdi da pitanje o tome da li su ustavna prava i proporcionalnost povezani zavisi od toga šta su ustavotvorci zapravo odlučili, tj. zavisi od pozitivnog prava. Prva teza se može označiti kao “teza o nužnosti”, druga se može označiti kao “teza o kontingentnosti.” Prema tezi o nužnosti, legitimnost proporcionalnosti je pitanje prirode ustavnih (...) class='Hi'>prava, dok je prema tezi o kontingentnosti legitimnost proporcionalnosti pitanje tumačenja. Ovaj rad se bavi metodološkim aspektima obnovljenih pravno-filozofskih nastojanja da se preispita pojam međunarodnog prava. Posle kratkog osvrta na istoriju pravne filozofije i ključne tačke Hartovog i Kelzenovog pozitivističkog stanovišta, u radu se dalje ispituje na koji način se savremene pravne teorije, kako u pozitivističkoj, tako i u ne-pozitivističkoj tradiciji, bave međunarodnim pravom. Poslednji deo rada predstavlja pokušaj da se skiciraju određene smernice za novi početak u filozofskoj obradi međunarodnog prava. Prvo, istorija rasprava u ovoj oblasti svedoči o (...) tome da su metodološki pravni teoretičari u pravu kada tvrde da nam utvrđivanje odgovarajućeg metoda pomaže u odgovoru na pitanje šta je pravo. Drugo, imajući na umu stalno promenjivu prirodu međunarodnog prava, odgovarajući metodološki pristup zahteva „evolucionarnu epistemologiju“ (D’Amato), koja teško da se može nazvati obeležjem analitičke jurisprudencije. The book provides an overview of the contemporary discussion of the mind-body problem. This discussion takes its modern form during the 17th century in the works of René Descartes. The book covers the most important points of view in modern philosophy of mind. Different forms and transformations of philosophy in the modern world are analyzed according to the view of the Croatian philosopher Vanja Sutlić (1925-1989). A key aspect is the "realization of philosophy" in "work science", which encompasses the entire "world of work" established in modern times. This universal and real science is also an important precondition for "historical thinking". The uniformity of this science, problematized by Sutlić, can be found today in refined logical and semantic structures, which allow for a renewed (...) and richer articulation of philosophical concepts than was traditionally possible. Tomus II.p.251) in Ars Magna Sciendi sive (...) Combinatoria by Athanasius Kircher (1669), in analytical combinatorics based in Leibniz's dissertation Ars Combinatoria (1666), where language is understood as a lingua characteristica and as a calculus ratiocinator, in the combinatorics of classes that have the meanings 1 or 0 given in the idea of Boolean functions (1854), in Frege's work Begriffschrift, eine der arithmeticeschen nachgebildete Fomelsprache des reinen Denkens (Concept letter, the language of formulas of pure thought made according to the model in arithmetical language), in Cantor's study of set theory / Grundlagen einer allgemeinen Mannigfaltigkeitstheorie (1883) and up to algorithms of fuzzy logic as a "means of approximate thinking that is in the human prior" (Zadeh, 1990) and fuzzy linguistics in computer semantics (Burghard B. Kako u svakodnevnom životu, tako i u pravu većinu ljudi smatramo odgovornim za postupke pretpostavljajući da su to njihovi postupci u smislu da nad njima imaju kontrolu. Pretpostavka koja dominira tradicionalnim filozofskim raspravama o moralnoj odgovornosti i teorijama kazne jeste da se osoba smatra moralno (pravno) odgovornom za počinjeni postupak ako taj postupak zavisi od nje na takav način da bi zaslužila osudu (kaznu) odnosno pohvalu (nagradu). Izazov koji prirodne nauke postavljaju pred ovakvo razumevanje moralne odgovornosti ne zaustavlja se na (...) klasičnoj mehanici već svoj novi, kompleksniji oblik zadobija pojavom kvantne mehanike, ali i razvojem neuronauke i psihologije. Relevantnost istraživanja prirodnih nauka za filozofske probleme objašnjavamo činjenicom da su drugu polovinu XX veka obeležila naturalistička metafizička i epistemološka nastojanja. Na ovaj način je otvoreno novo poglavlje odnosa filozofije i prirodnih nauka, a mi ga u ovom radu ispitujemo kroz razmatranje problema kompatibilnosti determinizma i moralne odgovornosti. Cilj rada je da ispitivanjem kako empirijskih argumenata kojima se u pitanje dovodi moralna odgovornost, tako i filozofskih argumenata koji figuriraju u ovim diskusijama ukažemo da rezultati naučnih istraživanja mogu biti plodonosni u kontekstu rasprava o slobodi volje, moralne odgovornosti i teorija kazne, isključivo ako na adekvatan način komuniciraju sa rezultatima filozofskih istraživanja zasnovanim na primeni filozofskih metoda poput metoda pojmovne analize. Neuro-ethics is probablу fastest growing part of applied ethics. The main thesis is that certain natural processes in brain and nerves produce certain moral, and immoral, behaviors. All these processes can be explained causally, and (if this is so) neuro-ethics might be the final result of neuroscience. There are some metaphysical and ethical pitfalls to be considered, however, like the (incorrect) conflation of causal explanation and rational justification in defining values, not only non-moral values but moral values as well. Certainly, (...) the knowledge of how neurological processes function could help to enhance the quality of human life, not only in coping with defects but also in improving the so-called "normal life." This implies that neuroethics is instrumental, dealing with values which are instrumental as well. However, neuroethics, it seems, aspires to go further than that: to explain how goals come into existence and what their articulation should look like. All of this should be causally explained, or at least explainable; and the main focus of the paper is an analysis of this aspiration. The analysis refers to some important distinctions like the distinction between causes and reasons, explanation and justification, or the one between means and ends. At the end of the paper there is a section about applications, where some of the benefits and risks are summarily indicated, with a conclusion that neuroethics surely might help in advancing the overall quality of human life, individual and social. Lidská práva jsou v současné době předmětem řady komplexních otázek, které jsou politické, sociální či právní povahy. Abychom na otázky mohli smysluplně odpovídat, musíme brát ohled i na obecnější filosofické souvislosti a mít jasnější představu o tom, co lidská práva jsou a na jakých základech stojí. V předkládaném textu si klademe otázku, zdali máme v současné době k dispozici plně filosoficky fundovanou koncepci založení a legitimizace lidských práv. Předkládáme postupně různé současné přístupy, které jsou kandidáty na řešení tohoto problému a (...) přinášíme jejich kritické zhodnocení. Východiskem je pro nás představa lidských práv jako evidentních pravd a od ní odvozené přístupy zakládající je na racionální či emocionální evidenci. Dále se věnujeme možnosti náboženského založení lidských práv, přístupům přirozenoprávním, utilitaristickým a koncepcím vycházejícím z pojmu důstojnosti. Stručně jsou zmíněny i některé další související teorie a historický kontext analyzovaných pojetí. V závěru na položenou otázku odpovídáme, že zcela uspokojivá filosofická teorie lidských práv stále není k dispozici, a přinášíme také vlastní doporučení pro řešení předložených problémů zkoumaných teorií. Rad se sastoji od dva dijela. U prvom dijelu, tragom prethodnih istraživanja, prvenstveno Petrovićevih i Marottijevih, ispitujem sadržaj i primjenu temeljnog filozofijskog pojmovlja zasnovanoga na riječi i pojmu biti, pri čemu je glavna primijenjena strategija filozofijsko tumačenje mišljenja tvorenog putem mehanizama hrvatskoga jezika. U drugom dijelu, tragom Veljakovih istraživanja o metafizičkim utvarama, ispitujem opasnosti usvajanja moguće nepotpuno razumljenog pojmovlja pomoću kojega oblikujemo predodžbe o (društvenoj) zbilji i po njoj djelujemo. Sidrište je razmatranja problem hipostaze jednoga, a u dijalogu s Veljakovim (...) razmatranjima hipostaziranja partikularnih bića nastojim raščistiti polazišno mjesto za mišljenje promjena u odnosu prema zbilji opstojanja. Kako je moguće baviti se Platonom danas, ukoliko je filozofija „svoje vreme obuhvaćeno mislima“? Autor Platonovom delu ne pristupa kao dogmatskom štivu, već kao tekstu prožetom paradoksima, koje izmiče svakom unapred pripremljenom, šematizovanom modelu čitanja. Obratiti se Platonu kao filozofskoj paradigmi isplativo je ukoliko filozofi koji progovaraju iz dubine vremena mogu nešto važno da nam saopšte i ukoliko smo kadri da im postavimo autentično pitanje. Zato filozofi moraju imati dah delfskog ronioca, jer biser se ne nalazi u svakoj školjci. (...) Knjiga Iz Platonove filozofije ulazi u red značajnih knjiga posvećenih Platonovoj filozofiji. Veći deo knjige je objavljen u časopisima od svetskog ugleda (na nemačkom i engleskom jeziku). Time je njen kvalitet potvrđen recenzijama koje su nastale van domaćih koterija, a delo se samerilo sa aktuelnim pristupima Platonu. Knjiga se bavi problemima koji su formulisani u drugoj polovini prošlog veka (napisano i nenapisano učenje), preko naizgled klasičnih tema (dvostruki paradoks, utemeljenje istorijskog i političkog, eros), do tekstova koji pogađaju fenomen aktuelnosti Platonove teorije i prakse (problemi kongitivne dispozicije i bioetike u Platonovoj filozofiji). Ispred nas je Platon u dijalogu sa filozofskim strujanjima s kraja dvadesetog i početkom ovog veka. Za Irinu Deretić smisao filozofskog dijaloga leži u procenjivanju i odmeravanju stanovišta u raspravi, kako bi se vlastito stanovište preciznije artikulisalo. Ne radi se o utopijskoj komunikativnoj zajednici - već o karakteru filozofskog dijaloga, koji je upućen na unutrašnji, a ne na spoljašnji agon. Platon iz sasvim nesofističkih razloga preuzima metodu sofista kada „slabiju stvar čini jačom“. Tome je suprotna eristička (ne)kultura, u kojoj strasti imaju prevagu na davanjem bilo kakvih, „a kamoli valjanih razloga“, piše Irina Deretić. Iz problematičnosti jezika i sučeljavanja sa bliskim granicama pojmljivosti, ne mora da proizađe i slabost logosa. Naprotiv, snaga logosa je obrnuto proporcionalna sposobnošću da se odredi njegova nemoć. Granicu Platonove misli Irina Deretić jezgrovito formuliše: „Platonov jezik je sav okrenut biću, i usmeren je na saznajno ovladavanje njime. Snaga argumenta učesnika u Platonovim razgovorima upravo se sastoji u njihovoj sposobnosti da tačno pogode stvarnost na koju se odnose i koju nastoje da izraze“. Ali to vodi oblikovanju samog karaktera dijaloga: sagovornici se podređuju vođstvu „same stvari“ mišljenja. Međutim, logos nije svemoćan, i inače, a pogotovo ne za Platona. Irina Deretić insistira na autentičnom smislu nemoći logosa kao racionalnog diskursa, koji se pokazuje na odlučujućim mestima, tamo gde njegove refleksije o idejama, posebno o Ideji Dobra bivaju suočene sa granicama njihove saznatljivosti i saopštivosti. Napokon, Platonova okrenutost biću nije dovela do teorije adekvatnosti između bića i jezika, nego do isticanja paradoksa i metafore. A šta je iza njihovog vela - ništa, ili su oni, naprotiv, konstitutivni za biće, da li uopšte može biti odlučeno? U skladu sa filozofskim vjeruju Nikolaja Berđajeva, može se formulisati karakteristika ove važne i lepe knjige: Iz dubine vremena izvire sposobnost da se filozofski misli, a to onda nije u koliziji sa aktuelnim „primenama“ filozofske refleksije. Ovaj rad istražuje relevantnost filozofije Frane Petrića za suvremene debate unutar filozofije uma i metafizike, s posebnim naglaskom na panpsihizam i kozmopsihizam. Ove teorije svijesti, koje ponovno privlače pažnju u akademskim krugovima, smatraju svijest sveprisutnim svojstvom temeljne razine stvarnosti. U skladu s time, rad proučava Petrićevo shvaćanje kozmosa kao temelja stvarnosti, koji posjeduje dušu ili svijest te kako pojedinačna bića nasljeđuju svijest od kozmosa. Uspoređuju se Petrićeve ideje sa suvremenim argumentima za panpsihizam, a posebice se analizira kako njegovo razumijevanje duše (...) odgovara recentnim teorijama o intrinzičnoj prirodi i emergenciji svijesti. Istražuje se također kako se Petrićeva filozofija odnosi na suvremene rasprave kroz prizmu njegove kritike Aristotelove koncepcije znanosti o biću kao biću. Izlažu se argumenti u prilog originalnom tumačenju Petrićeve filozofije. Glavna teza rada jest da je Petrića točnije okarakterizirati kao kozmopsihista, unatoč tome što je uveo pojam panpsihizam. Rad koristi spekulativnu interpretaciju Petrićeve misli, koja apstrahira od nekih (neo)platoničkih elemenata i modernizira jezik, s ciljem pokazivanja kako može dovesti do novih uvida u filozofiji uma i metafizici te potaknuti daljnje istraživanje. Ovaj je zbornik nastao kao rezultat istraživanja provedenog unutar istoimenoga znanstveno-istraživačkoga projekta na kojemu su urednici istovremeno bili i glavni istraživači, a ostali autori članovi istraživačke skupine. Kao svjedoci različitih vrsta otklona od prevladavajućeg, uobičajenoga, normalnoga, pozitivnog ili ponašanja koje se karakterizira kao asocijalno, zapitali smo se – što postojeće čini normom, treba li odstupanje od norme nužno smatrati devijacijom i kakvi su poželjni društveni odgovori na odstupanja od normi. Često se smatra ispravnim upravo ono što je prevladavajuće, a ono (...) što predstavlja otklon označava se kao devijacija u negativnome značenju onoga što nije ispravno, nije posve ispravno, ili čak onoga što treba sankcionirati. Naš je početni stav bio da ono što prevladava ne smije biti neupitna norma, kao što ni ono što je otklon nije po automatizmu devijacija. Međutim, ne smatramo ni da prevladavajuću normu, samom tom činjenicom što je prevladavajuća, nužno treba kritizirati te da je svaki otklon po sebi poželjan. Cilj našeg istraživanja bio je istražiti različite oblike deficita i devijacijau u domeni formiranja vjerovanja individualnih, grupnih, kolektivnih i institucijskih epistemičkih aktera (socijalna epistemologija) i u domeni društvenog i institucijskoga djelovanja (filozofija politike i filozofija psihijatrije). Nastavno na to, pokušali smo identificirati vrijednosti postojećih normi, koliko odgovaraju poželjnim vrijednostima te koji su poželjni društveni odgovori na otklone od normi. (shrink)

U ovom radu dat je kratak pregled osnivanja Instituta za filozofiju i drustvenu teoriju kao institucionalne osnove za postanak i izlazenje casopisa Filozofija i drustvo. On je prvobitno, 1987. godine, poceo da izlazi kao zbornik, jednom godisnje, da bi od 2005. postao casopis, sa ritmom publiciranja tri puta godisnje, a od 2011. izlazi kvartalno. Takodje je dat i pregled svih tematskih celina, i to do kraja 2012. godine. Analiziran je detaljno jedan broj FiD-a, kao vazan dokument za promenu drustvene (...) atmosfere u negdanjoj Jugoslaviji i sa nagovestajima njenog raspada: naucni skup je odrzan 2. i 3. jula 1991. Centralno pitanje koje se postavlja u ovom radu jeste da li je i na koji način moguće odbraniti Kantov pojam transcendentalne slobode. U cilju pružanja odgovora na ovo pitanje ispituje se argument treće antinomije, kao i primena rešenja -/- ove antinomije na sferu ljudskog delanja. Uporednom analizom najzastupljenijih in- -/- terpretacija Kantove pozicije, dolazi se do zaključka da je ideja transcendentalne -/- slobode plauzibilna, ali samo ukoliko prihvatimo osnovne pojmove na kojima počiva -/- Kantova filozofija, na prvom mestu doktrinu (...) transcendentalnog idealizma, i ukoliko -/- na adekvatan način interpretiramo argumente koje nam Kant pruža. Konfucije, kao tipičan „akozmički” mislitelj, odbija govoriti o kozmološkim temama, kao što su „Put neba”. Ipak, čini se da neka njegova učenja, osobito ona koja se tiču praktične filozofije, imaju određenu kozmološku pozadinu. Ovdje se otvara pitanje: uključuje li Konfucije u svoje učenje kozmološke koncepcije, iako o njima nikada nije otvoreno raspravljao? Postoje li kozmološke pretpostavke/utemeljenje Konfucijeve praktične mudrosti? Slijedeći ta pitanja ovaj rad, analizirajući zbirku Konfucijevih izreka Analekti, razmatra kozmološku dimenziju Konfucijeve praktične filozofije. -/- .

Esej "Stoljeće rearanžiranja: nanoznanost i globalno društvo", dovodi u vezu modernu znanost (nanoznanost) i moderno društvo (globalno društvo) kroz odnos nanotehnologizacije i globalizacije kao najvažnijih procesa jedne mreže fenomena koji se dotiču na području tehničkih i društvenih znanosti. Autor karakterizira 21. stoljeće kao stoljeće rearanžiranja u kojem znanost i filozofija funkcioniraju sa zajedničke osnove koja je holistička i pragmatička. Komparacijom novih tehničkih metoda u znanostima o materijalima i novih procesa u društvenoj ontologiji autor stavlja u odnos dva pristupa i (...) dvije skale identifikacije i reprezentacije: nanoskalu na području zananosti ο materijalima i globalnu skalu na području znanosti ο društvenim odnosima. Tehničke znanosti u formi nanoznanosti orijentirane su na stvaranje nove infrastrukturne paradigme: "ambijenta inteligentnog prostora" vođenog idejom "svi-u-digitalnom-svijetu". Društvene znanosti, koje sudjeluju na planu integracije i globalizacije, orijentirane su na stvaranje nove transnacionalne i spekulativne paradigme: "mobilnog hiper-prostora za internacionalno poslovanje" vođene idejom "svi-u-demokratskom-svijetu". Obje vrste znanosti proizvode istu vrstu nevidljive ontologije koja je dostupna samo virtualnoj identifikaciji i reprezentaciji zasnovanoj na osmišljavanju, stvaranju i proizvodnji programibilne supstancije i programibilnog identiteta. One produciraju identičnost / uniformnost u funkcionalnom operiranju tehničkim sredstvima i političkim principima. U sintagmi "društvo zasnovano na znanju" termin "znanje" ima značenje "znanje proizvodnje, znanje upotrebe i znanje operiranja pametnim (programibilnim) materijalima i pametnim (programibilnim) identitetom". U "D&D svijetu" (digitalnom & demokratskom svijetu) svi ljudi moraju znati upotrebljavati tehnološki mikro-svijet i politički makro-svijet kako bi postigli isti cilj: kontrolu nad prirodom i društvom. Nevidljivost ili iščezavanje realnih stvari, realnih sredstava komunikacije i realnih društvenih odnosa, jeste novo tehničko i ideološko sredstvo stvaranja "novog čarobnog svijeta". (shrink)

Law is traditionally related to the practice of command and hierarchy. It seems that a legal rule should immediately establish a relation between a superior and an inferior. This hierarchical and authoritharian view might however be challenged once the phenomenology of the rule is considered from the internal point of view, that is, from the stance of those that can be said to “use” rather than to “suffer” the rules themselves. A practice oriented approach could in this way open up (...) a more liberal, and also somehow less parochial and ideological, road for legal theory. This is – it is argued in the paper – the programme, or better, the promise we can find in Herbert Hart’s main work, The Concept of Law. The article tries to render this promise more transparent while, nonetheless, not eschewing the blind sides of its narrative and argumentative strategy. (shrink)

Teza o "neskrivljenom neznanju" je instrument u okviru teorije pravednog rata koja sluzi da se moralno opravda ucesce u ratu za pripadnike one strane koja je porazena; uslovi za neskrivljenost su da su porazeni borci iskreno verovali da brane pravednu stvar i da su takodje iskreno verovali da imaju nekih izgleda da pobede. Bez ovog instrumenta teorija pravednog rata, jedna teorija koja opravdava rat preko pravednog uzroka rata, bi porazenoj strani narocito ako je slabija, morala da unapred pripise krivicu sto (...) je uopste usla u rat. Medjutim, u savremenoj situaciji rasirene kriminalizacije rata sam pojam rata se menja i postaje izuzetno neodredjen. Kako ratovi postaju sve vise i vise "asimetricni", pre svega u snazi sukobljenih strana, cini se da se teorija pravednog rata suocava sa teskocom da u svoje okvire uopste situira "neskrivljeno neznanje", ali to povlaci teskocu te teorije da pokaze da pravda ide sa pobedom, otvarajuci tako pitanje artikulacije pravednog mira. After a short historical survey of philosophical views on property, the article contains an analysis of the argument which justifies property by referring to the universal respect due to anyone’s right to use any thing for any purpose. The capacity of freedom as a specific causal power in real world is dependent on the possibility (...) of using things as means. However, without a real prospect to finish the process of realization of set goals, this causal power would not be real. Property is a scheme within which this prospect becomes a real possibility. Property is thus a condition of effective successful purposeful agency. In property the normative position of all others, besides the owner, has been changed, as they do not have the right to use things possessed for their ends, although they have a right to use any non-possessed thing as a means for whichever end they might set. As a right, property entails, first, the obligation to respect the fact of any established possession, and, second, an obligation to accept and recognize the established possession as ownership, which does not depend on the fact of factual physical control of the property. Ownership is therefore a guarantee of future possession. For this to be established there is a need for an explicit recognition from all others; however this recognition is normatively necessary for everybody, as no-one has a right to withdraw the recognition of a legitimate right to property. This comes from the ontological and axiological difference between persons and things: persons have a right to use and possess unpossessed things as means for realization of ends they set. (shrink)

This article focuses on issues relating to legal normativity, emphasizing the way these matters have been elaborated in the works of Kelsen and Hart and later commentators on their theories. First, in Section 2, the author offers a view regarding the nature of law and legal normativity focusing on Kelsen's work (at least one reasonable reading of it). The argument is that the Basic Norm is presupposed when a citizen chooses to read the actions of legal officials in a normative (...) way. In this Kelsenian approach, all normative systems are structurally and logically similar, but each normative system is independent of every other system – thus, law is, in this sense, conceptually separate from morality. Second, in Section 3, the author turns to Hart's theory, analyzing the extent to which his approach views legal normativity as sui generis. This approach raises questions regarding what has become a consensus view in contemporary jurisprudence: that law makes moral claims. The author shows how a more deflationary (and less morally-flavored) understanding of the nature of law is tenable, and may, in fact, work better than current conventional (morality-focused) understandings. In this response to eight commentaries on my article “Kelsen, Hart, and legal normativity” I clarify some points in my original analysis and agree with some comments regarding work that still needs to be done. In particular, I attempt to distinguish my position from both Berkeleyan idealism and mere subjective perception. I agree with the commentators who urge that more must be done to analyze the nature of normativity in general, and legal normativity in particular.

The subject of this paper is Charles Morris’ semiotic theory that has as one of its major projects the unification of all sciences of signs. However, since the above project has proven to be unsuccessful, we will try to examine here the reasons that led to this. Accordingly, we will argue that to transcend the particularities of individual disciplines that he wanted to unify, Morris had to make certain ontological assumptions, instead of theoretical and methodological ones, that they could share. However, because the 'sign' as an ontological category could in our view only be established if we follow the principles of the pragmatic philosophical tradition, we will try to show that the reasons for this failure should be primarily sought in different effects that consistent application of the pragmatic principles has in each of them (primarily in linguistics and the philosophy of language). On the other hand, this should enable us to draw several important conclusions regarding Morris’ project: namely, that his failure does not have to mean giving up semiotics as a potentially key discipline in approaching some fundamental philosophical problems, but also that it would demand return to the original semiotics developed in Peirce’s works. Reasoning by default is a relevant aspect of everyday life that has traditionally attracted the attention of many fields of research, from psychology to the philosophy of logic, from economics to artificial intelligence. Also in the field of law, default reasoning is widely used by lawyers, judges and other legal decision-makers. In this paper, a philosopher of language (Carlo Penco) and a philosopher of law (Damiano Canale) attempt to explore some uses of default reasoning that are scarcely considered by legal (...) theory. In particular, the dialogue dwells on the notion of literal meaning, witness testimony, and the problem of disagreement among experts in legal proceedings. The paper is intended as a sort of brain storming useful to identify new lines of research straddling philosophy of law, cognitive psychology and philosophy of language. (shrink)

The chapter explores the ways in which philosophical thinking about public reason and public justification can shed light on some deep issues regarding the legitimacy or purpose of law, as well as shallower yet no less important questions of constitutional engineering and institutional desing.

This essay focuses on the logic of the aesthetic argument used in the eighteenth century as a conceptual tool for formulating the modern concept of “(fine) art(s).” The essay also examines the main developments in the history of the art of modernity which were initiated from the way the “nature” of art was conceived in early modern aesthetics. The author claims that the formulation of the “aesthetic nature” of art led to the process of the gradual disappearance of all of (...) the formal elements that had previously characterized the visual arts; the result was “emptiness” or “nothingness” as art. The author refers to this process in terms of “vanishing acts” that allow for the formulation of an aesthetics of absence in connection to twentieth-century art (complementing the Ästhetik der Absenz, formulated in German art theory). The author also briefly addresses the consequences that these processes have for the way contemporary art, and art world operate. (shrink)

While most discussions of corruption focus on administration, institutions, the law and public policy, little attention in the debate about societal reform is paid to the “internalities” of anti-corruption efforts, specifically to character-formation and issues of personal and corporate integrity. While the word “integrity” is frequently mentioned as the goal to be achieved through institutional reforms, even in criminal prosecutions, the specifically philosophical aspects of character-formation and the development of corporate and individual virtues in a rational and systematic way tend (...) to be neglected. This paper focuses on the “internalities” of anti-corruption work with special emphasis on the pre-requisites that need to be ensured on behalf of the social elites in order for proper individual and collective character- formation to take place throughout the society. The author argues that a systematic pursuit of socially recognised virtues, both those pertaining to society as a whole and those specific to particular professions and social groups, is the most comprehensive and strategically justified way of pursuing anti-corruption policy, while institutional and penal policies can only serve an auxiliary role. The pursuit of institutional and criminal justice policies against corruption in a society that is subject to increasing relativism with regard to values and morality is at best ineffective, and at worst socially destructive. Thus the paper suggests a re-examination of the social discourse on the level of what the author calls “value strategy” and the gradual building of a plan to create and solidify specifically designed features of “corporate character” for key sectors of the society. This approach can serve as the main long-term strategy to improve the public profile of integrity and reinforce morality in both the public and civil sectors. (shrink)

After analyzing Grotius’ formulation of the state of nature and natural law, social contract and international law, the author places emphasis on two insights. First, that a certain heuristic principle plays a central role in Grotius’ argument - the analogy between individuals and states in the state of nature. Second, his firm belief that within the international framework the protection of natural law of people and communities comes before respect for state sovereignty. The author will argue that morally unacceptable implications (...) of these characteristics of Grotius’ theory, when we take into account the way in which he defines the rights of punishment and property, are in fact legitimation of interventionism and colonialism. The author will also argue that Grotius initiated an influential tradition in international law, characterized by a lack of clear boundaries between legal and moral norms. (shrink)

It is now common knowledge that being political is not a human privilege for him: bees, wasps, ants and cranes are other political species. Although they are not the only political animals, human beings, for Aristotle, are still more political than the other political animals. The present article investigates the precise sense of this comparison; and it claims that the higher degree of human politicalness is not to be explained (...) by reference to those exclusively human features like having capacity for speech and moral perception. This paper introduces and addresses fresh perspectives in the engagement between Hegel and his postmodern critics and detractors. The first part of the paper examines some of the central discussions on postmodernity, specifically in the works of Lyotard and Habermas, and how they, in different ways, reengage Hegel. The second part focuses on Vattimo’s deployment of the concept of the postmodern credo as a way of returning to Hegel’s own interrogation of modern belief. The paper shows that the common thread (...) linking the modernity of Hegel with the “postmodern moment” remains belief, and in particular, belief in belief itself. [From Euthanasia to Infanticide] The paper revisits the recent controversy over Dr. Mitlőhner’s defense of infanticide, published in this journal. In section 1, I point out the weaknesses of Mitlőhner’s paper. In sections 2 and 3 I turn to the most sophisticated defense of infanticide on offer today, that of Peter Singer’s. Section 2 sums up Singer’s description of the medical practice as already having abandoned the traditional ethic of equal value of all human lives, which motivates ethical revisionism. However, (...) an explicit justification of a revision is necessary. This is the job of Singer’s Replacement Argument, examined in section 3. I argue that this justification of infanticide in completely impersonal terms fails. In section 4, I reject it in favor of Ronald Dworkin’s distinction between experiential interests, possessed by infants, and critical interests that develop later. Hence, neonatal euthanasia can sometimes be justified in terms of a newborn‘s own interests (presumably, to relieve its suffering), not in impersonal terms. The only exception is those infants that lack any capacity for cognitive activity whatsoever, and who thus lack even experiential interests. It is an open question whether their “life” differs from death, and whether by killing them we perform infanticide. (shrink)

The radical redefinition of the landscape of physics that followed the contributions of Niels Bohr and Werner Heisenberg at the start of the 20th century led to plethora [of] new perspectives on age-old metaphysical questions on determinism and the nature of reality. The main contention of this article is that the work of Gilbert Simondon - whose magnum opus possesses a scope uniting the most basic philosophical concerns with the most recent breakthroughs in natural sciences - is highly relevant for (...) an adequate understanding of the split between determinism and indeterminism, as well as the underlying presuppositions which have driven some influential contributions to this topic. To this end, the article shows that the more deterministic interpretation of quantum mechanics offered by David Bohm and Louis de Broglie proves to be a valuable reference point for a more precise use and understanding of Simondon'ss transductive logic - especially when its philosophical lapses are considered closely. Finally, following the considerations of both thinkers, we aim at a more precise reconsideration of the stakes of indeterminism in modern physics, as well as a restructuration of what is often understood as a polarization. Tema rada su dva tipa emergencije unutar razumevanja bioloških entiteta: a) epistemološka i b) ontološka emergencija. Iako postoji obimna literatura posvećena ovom pojmu (njegovim tipovima, čak i vrstama), tvrdimo da se pojam ontološke emergencije najčešće pogrešno primenjuje u naučnim i filozofskim objašnjenjima kompleksnih sistema, stoga ga formulišemo na drugačiji način. Da bismo istakli u čemu je distinktivno svojstvo jednog tipa u odnosu na drugi, i time dali doprinos boljem razumevanju kompleksnosti biosfere, za tip a) koristimo konvencionalno prihvaćen model za reprezentovanje (...) genetičkih regulatornih mreža, dok za tip b) obrazlažemo zašto treba da bude predstavljen egzaptacijama. Cilj naše analize je da ukaže, polazeći od osnovnih pretpostavki sistemske biologije, na koji način pojam emergencije ima značajno mesto u današnjoj filozofiji nauke i teorijskoj biologiji. (shrink)

Die messianische Idee im neuzeitlichen Judaismus erörternd, fokussiert sich der Autor auf die Sabbataier-Bewegung. Er untersucht die gesellschaftlich-geschictlichen und psychologischen Gründe, welche die massenhafte Akzeptanz Sabbatai Zewis als Messias ermöglicht haben, wie auch das Verharren in dieser Überzeugung nachdem er große Erwartungen enttäuscht hatte, indem er unerwartet zum Islam übertrat. Der junge Rabbiner Nathan aus Gaza hat, sich auf Lurias Kabbale verlassend, nicht nur das jüdische Volk überzeugt, dass Sabbatai Zewi der langerwartete Messias ist, sondern auch eine theoretische Rechtfertigung seines (...) angeblich nur scheinbaren Verrats gegeben. Die Rechtfertigung des anstößigen Verhaltens Sabbatai Zewis, welcher eine manisch-depressive Person war, führte unter extremen Sabbataiern zur Überzeugung von der Heiligkeit der Sünde, wodurch die messianische Idee im neuzeitlichen Judaismus bis zur äußersten Groteskheit verzerrt wurde. This article examines Machiavelli’s image of humanity. It argues against the prevailing views that characterize it either as pessimistic or optimistic and defends the thesis that the Florentine has a realist image of humanity. Machiavelli is a psychological egoist who conceives of man as a being whose actions are motivated by his drives, appetites, and passions, which lead him often to immoral behavior. Man’s main drives are “ambition” (ambizione) and “avarice” (avarizia). This article also investigates Machiavelli’s concept of nature and (...) shows that, for him, the constancy of human nature is the central premise that makes the scientific analysis of politics possible. Despite the fact that human drives and capabilities are the same at all times, good laws, military training, and religion allow man to be changed and educated toward “virtue” (virtù). To make such changes in man, however, presupposes a good legal and political order. Machiavelli justifies the state because of its capacity to reshape human nature and to improve man. The state is not only a coercive power but a moral institution. This leads to the conclusion that Machiavelli does not separate politics from morality as most scholars claim. (shrink)

Ruđer Bošković's (Rogerius Joseph Boscovich, 1711-1787) induction is described as a reasoning procedure that combines abductive, generalizing and deductive forms of inference. According to Bošković, the application of inductive reasoning extends beyond natural science. Bošković's critique of the use of the principle of sufficient reason is discussed, and constructive rules of Bošković's inductive logic are proposed from the standpoint of contemporary justification logic. To that end, justification logic could be extended with Bošković's typology of reasons. The first beginnings of modern logic in Croatia are recognizable as early as in the middle of the 19th century in Vatroslav Bertić. At the turn of the 20th century, Albin Nagy, who was teaching in Italy, made contributions to algebraic logic and to the philosophy of logic. At that time, a distinctive author Mate Meršić stood out, also working on algebraic logic. In the Croatian academic philosophy, until the publication of Gajo Petrović's textbook (1964) and the contributions by Heda (...) Festini, a critical or indifferent attitude toward modern logic prevailed. The first comprehensive modern logic textbook in Croatian was written by mathematician Vladimir Devidé (1964), known, for example, for his axiomatizations of natural numbers and classical propositional logic. In the Croatian philosophy of the 1980s and 1990s, influential logicians are Goran Švob and mathematician Zvonimir Šikić. At the turn of the 21st century, logical investigations are being intensified and extended to various branches of the contemporary logic. (shrink)

It can be said that Rousseau is one of the most acute thinkers of the corruption of civilisation. In fact, the Second Discourse and the Essay on the Origins of Languages could be read as elaborate analyses of advancing social and cultural decline inasmuch as mankind is continually moving away from the original state of natural innocence. But Rousseau’s idea of corruption is not straightforward. I try to show that in the Essay, Rousseau emphasizes the natural causes for corruption. I (...) argue that an opposition between necessity and contingency, which more accurately represents the two modes operating in Rousseau’s doctrine, should replace the standard nature/culture divide. The contingency of natural catastrophes is found to be ultimately responsible for the corruption in the social realm, which is therefore largely driven by natural causes. (shrink)

In this paper I will discuss a recent attempt of justifying democracy and its authority. It pertains to recently published papers by Niko Kolodny, which complement each other and taken together practically assume a form of a monograph. It could be said that Kolodny's approach is a non-standard one given that he avoids typical ways of justifying democracy. Namely, when a justification of democracy is concerned, Kolodny maintains that it is necessary to offer a kind of an independent justification. It (...) is not so much that he insists that the usual approaches are wrong as much as that an independent justification is necessary in order to discern what it is that gives them their significance. Kolodny's independent justification of democracy is based on the idea of social equality. In this paper I will try to reconstruct and critically assess Kolodny's approach by paying special attention to the question of democratic authority. (shrink)

I will argue that accounts of mineness and pre-reflective self-awareness can be helpful to panpsychists in solving the combination problems. A common strategy in answering the subject combination problem in panpsychism is to deflate the subject, eliminating or reducing subjects to experience. Many modern panpsychist theories are deflationist or endorse deflationist accounts of subjects, such as Parfit’s reductionism of personal identity and G. Strawson’s identity view. To see if there can be deflation we need to understand what the subject/self is. (...) One aspect of consciousness left unexplored and unappreciated by panpsychist theories is pre-reflective self-consciousness/self-awareness. Theories of the self, inspired by phenomenology, that are serious about subjectivity, could be of use in arguing against the deflationary reductionism of the experiencing subject. These theories show that there is more to the subject of experience than just its experiences (qualities). Even without arguing for any precise account of the nature of the self, it can be shown what phenomenology of subjective character of consciousness and pre-reflective self-awareness contributes to the combination problem debate. In order to defend mental explanations dualists may appeal to dispositions (powers). By accepting a powers theory of causation, a dualist can more plausibly defend mental explanations that are given independently of physical explanations. Accepting a power-based theory still comes with a price. Absences and double preventers are not causes in a powers theory, and solutions based on them can only defend their explanatory relevance in mental explanations. There is still a chance that such mental explanations can be causal explanations, (...) though they do not refer to real causes. (shrink)
