This article introduces a new formulation of the interest theory of rights. The focus is on ‘Bentham’s test’, which was devised by Matthew Kramer to limit the expansiveness of the interest theory. According to the test, a party holds a right correlative to a duty only if that party stands to undergo a development that is typically detrimental if the duty is breached. The article shows how the entire interest theory can be reformulated in terms of the test. The article (...) then focuses on a further strength of the interest theory, brought to the fore by the new formulation. In any Western legal system, the tortious maltreatment of a child or a mentally disabled individual results in a compensatory duty. The interest theory can account for such duties in a simple and elegant way. The will theory, on the other hand, struggles to explain such compensatory duties unless it abandons some of its main tenets. (shrink)

We describe (essential features and an axiomatization of) a new metamathematical (cognitive) ability, i.e., functional conceptual substratum, used implicitly in the generation of several mathematical proofs and definitions, and playing a fundamental role in Artificial Mathematical Intelligence (or Cognitive-computational metamathematics). Furthermore, we present an initial (first-order) formalization of this mechanism together with its characterizing relation with classic notions like primitive positive definability and Diophantiveness. Additionally, we analyze the semantic variability of functional conceptual substratum when small syntactic modifications are done. Finally, (...) we describe cognitively natural inference rules for (mathematical) definitions inspired by functional conceptual substratum and we show that they are sound and complete w.r.t.\ standard calculi. I think the basic intuition behind textualism correct – that the meaning of a law is fixed by referencing the meaning of its words according to the meaning common to the law’s ratifiers. However, even if true, it does not follow that interpretation of a law goes through the original ratifiers. Rather, a citizenry continually ratifies the laws to which it subjects itself, and as the meanings of those words change over time, so will those laws. Concerning, say, the U.S. (...) Constitution, though the text may be very nearly the same now as in the 18th century, a different constitution is in effect. (shrink)

The Article analyzes the notion of legal “thinghood” in the context of the person–thing bifurcation. In legal scholarship, there are numerous assumptions pertaining to this definition that are often not spelled out. In addition, one’s chosen definition of “thing” is often simply taken to be the correct one. The Article scrutinizes these assumptions and definitions. First, a brief history of the bifurcation is offered. Second, three possible definitions of “legal thing” are examined: Things as nonpersons, things as rights and duties, (...) and things as property. The first two definitions are rejected as not being very interesting or serving any heuristic function. Conversely, understanding legal things as property is meaningful, useful, and helps to understand what it means to say that animals are legally things. Defining things as property has certain rather important implications, which are analyzed at the end of the Article. For instance, not everything needs to be either a person or a thing: The historical institution of outlawry involved treating individuals neither as legal persons nor as legal things. One must conclude that the person–thing bifurcation is less fundamental than is often assumed. (shrink)

We argue for the possibility of validating the presence of consciousness in another person from a perspective that blends both, a third-person approach of coming close to, observing, and understanding the other; and a first-person assessment of how the experience of the other feels like. For this, we will need to explain how the line between the third-person and first-person approaches is blurred in some methodological approaches. We rest our position largely on the back of some seminal conclusions of the (...) meditations of Ren\'e Descartes and other theories concerning consciousness like Chalmers' naturalistic dualism and, to some secondary extent on Integrated Information Theory (IIT). Additionally, we describe fundamental contextual principles already developed in the literature and the arts (like Stanivlaski's Acting System), and then we use them for setting a suitable methodology that we feel can be used to validate the presence of others' conscious experiences in one's consciousness (at suitable periods of spacetime). Finally, we give general methodological guidelines for the construction of the concrete experiment and we explore very briefly the potential implications of this kind of research in other academic and non-academic settings. We approach the notion of general (global) human intelligence as a prominently multifaceted concept which can be tested in at least seventy specific scenarios. We say that an agent has Artificial Global Intelligence (AGLI), if it is able to perform in an intelligent manner for at least the collection of tasks defining the former scenarios. In particular, based on Gartner's multiple intelligences theory, we describe the design of a concrete test for AGLI made in such a way that an ‘average’ (...) young human being should, per diffinitionem, pass it. We compare our holistic test with several highly representative human and artificial intelligence tests for deducing that our AGLI test is the one with the broader scope of the whole range of intelligence. However, we claim as a plausible hypothesis and based on the wide thematic spectrum of the test that the most outstanding inventions of AI currently available are far from getting a high score on it. Finally, we open a discussion about the fact that, although there are artificial agents being able to simulate intelligent behaviour at a perfect level for several local tasks, this seems not to be the case for AGLI. This would imply, in particular, a kind of practical implausibility of the notion of intelligence explosion coming from philosophy of AI. (shrink)

We present a multidisciplinary, universal a pragmatic theory of causation based explicitly on five methodological causal seminal dimensions. The first one is called formal-mathematical-idealist theory and emerges as a meta-conceptual fusion of several existing causal theories. The second one is essentially based on a global, scientific and technical perspective. In fact, this can be considered as a meta-dimension encompassing a huge number of academic disciplines. The third dimension arises once more as combination of former approaches having the mind and its (...) laws as the central paradigm. The fourth one is structurally related with our subjective phenomenological world and its objective impact on the external universe. And, finally, the fifth dimension is closely related with the first one, but more oriented toward the global implicit purpose of the universe and what this implies causally on the events in nature. The boundless nature of the natural numbers imposes paradoxically a high formal bound to the use of standard artificial computer programs for solving conceptually challenged problems in number theory. In the context of the new cognitive foundations for mathematics' and physics' program immersed in the setting of artificial mathematical intelligence, we proposed a refined numerical system, called the physical numbers, preserving most of the essential intuitions of the natural numbers. Even more, this new numerical structure additionally possesses the property of (...) being a bounded object allowing us to work with quite similar axioms like the classic Peano axioms, but in a finite environment and with an enriched physical dimension. Finally, we present several enlightening examples and we conclude that the physical numbers provide a natural formal setting for approaching classic problems in number theory from a more hybrid perspective, i.e. with a potential participation in the generation of solutions, not only of working mathematicians but also of more sophisticated artificial interactive (mathematical) intelligent agents (within the context of cognitive-computational metamathematics or artificial mathematical intelligence) and more controlled by physically-inspired principles. Finally, this paper addresses a highly new, bottom-up and paradigm-shifting approach to the foundations of physics: One should refine and improve the conceptual formal setting of the language that we use for understanding physical phenomena (e.g. the mathematical grounding concepts and theories) for being able to understand better more subtle and complex physical phenomena. As a national ideology, Pancasila has formal quality, but it is also part of the material aspects that shapes perspectives that drives national policies through the process of consensus. The open and ambiguous character of Pancasila allows a wide space for social and political interpretation, and therefore is open to critique and reformation through reinterpretations of its meaning. An examination of the ethics of the socio-political application of Pancasila is crucial in the current national climate, and these ethical valuations are (...) formed through public discussions and debates on the meaning of Pancasila. Using data drawn from mass media. In this paper, I will examine the Government Regulation on Law (Perppu No. 2/2017) as an example of how these political ethics develop through the discussion of the meaning of Pancasila. Second, I'll highlight how the space for interpretation of the meaning of Pancasila determines how the public, government and oppositional coalitions evaluate the pro and contra approaches to translating the ideology into practice. Third, in examining the process of socio-political consensus as a necessity in the democratic life of Indonesia, this paper will position the discursive deployments of Pancasila in the ethical and political considerations that stem from the practical application of these discourses of Pancasila. In this short paper I will introduce an idea which, I will argue, presents a fundamental additional challenge to the machine consciousness community. The idea takes the questions surrounding phenomenology, qualia and phenomenality one step further into the realm of intersubjectivity but with a twist, and the twist is this: that an agent’s intersubjective experience is deeply felt and necessarily co-affective; it is enkinaesthetic, and only through enkinaesthetic awareness can we establish the affective enfolding which enables first the perturbation, and (...) then the balance and counter-balance, the attunement and co-ordination of whole-body interaction through reciprocal adaptation. Linda Zagzebski’s book on epistemic authority is an impressive and stimulating treatment of an important topic. 1 I admire the way she manages to combine imagination, originality and argumentative control. Her work has the further considerable merit of bringing analytic thinking and abstract theory to bear upon areas of concrete human concern, such as the attitudes one should have towards moral and religious authority. The book is stimulating in a way good philosophy should be -- provoking both disagreement and emulation. (...) I agree with much of what she says, and have been instructed by it, but it will be of more interest and relevance here if I concentrate upon areas of disagreement. Perhaps they are better seen as areas, at least some of them, where her emphases suggest a position that seems to me untenable, but that she may not really intend. In that event, I will be happy to have provoked a clarification or the dispelling of my misunderstanding. My focus will be upon problems in her account of communal authority and autonomy, especially with respect to religious and political authority. Here my worry is that she places too much trust in trust and not enough in what I call selective mistrust. (shrink)

My aim in this paper is to go some way towards showing that the maintenance of hard and fast dichotomies, like those between mind and body, and the real and the virtual, is untenable, and that technological advance cannot occur with being cognisant of its reciprocal ethical implications. In their place I will present a softer enactivist ontology through which I examine the nature of our engagement with technology in general and with virtual realities in particular. This softer ontology is (...) one to which I will commit Kant, and from which, I will show, certain critical moral and emotional consequences arise. It is my contention that Kant’s logical subject is necessarily embedded in the world and that Kant, himself, would be content with this view as an expression of his inspired response to the ‘‘scandal to philosophy... that the existence of things outside us... must be accepted merely on faith’’ [Bxl]. In keeping with his arguments for the a priori framing of intuition, the a priori structuring of experience through the spontaneous application of the categories, the synthesis of the experiential manifold, and the necessity of a unity of apperception, I will present an enactivist account of agency in the world, and argue that it is our embodied and embedded kinaesthetic engagement in our world which makes possible the syntheses of apprehension, reproduction and recognition, and which, in turn, make possible the activity of the reproductive or creative imagination. In dem Buch ‘Rationalität in der Angewandten Ethik’, in dem sich verschiedene Autoren die Aufgabe gestellt haben, diese Umstände in das Licht der Betrachtung zu rücken, finden wir Fragen darüber, wie “Moral”, “Angewandte Ethik” und “Vernunft” (auch in der Anwendung) zu verstehen und zu vereinen sind.

This article addresses the sensitive topic of human rights issues in Indonesia through a Kantian analysis. Cases of human rights violations are a common occurrence in Indonesia. Presently, human rights violations in the country are assessed from historical and legal perspectives. However, there is little commitment or willingness on the part of the Indonesian government to protect and defend the principles of human rights. This article is attempts to utilize arguments from political philosophy that can contextualize the protection and implementation (...) of human rights in Indonesia, through an analysis of the concept of social contract in Immanuel Kant’s political philosophy. According to Kant, freedom and equality are natural rights. This article demonstrates that Kant's social contract theory is linear with his formal moral philosophy. In his explanation, ‘contract’ is unified will. Therefore, the Indonesian state with its power is responsible to implement the will of the public to ensure order and rule of law and to protect the rights and freedom of each individual. (shrink)

The study aimed to identify the role of administrative procedures and systems in enhancing the performance of the educational institutions in the Islamic University in Gaza. To achieve the research objectives, the researchers used the analytical descriptive approach to collect information. The researchers used the questionnaire distributed to three categories of employees at the Islamic University (senior management, faculty members, their assistants and members of the administrative board). A random sample of 314 employees was selected and 276 questionnaires were retrieved (...) with a recovery rate of 88.1%. The Statistical Analysis Program (SPSS) was used to enter process and analyze data. The results of the research showed a positive role for the administrative procedures and systems in enhancing the performance of the Islamic University from the point of view of the members (senior management, teaching staff and their assistants and the administrative body), where the relative weight of all the paragraphs (73.728%). The analysis of the results revealed that the administrative procedures at the Islamic University in Gaza are used to an acceptable degree. The relative weight of all the paragraphs is 70%. This indicates a relationship between administrative procedures and regulations and the performance of the Islamic University in the Gaza Strip. The study found that there was a good degree of approval from the sample regarding the administrative procedures and their relationship to the job performance. There exist a sufficient degree of powers to the deans and department managers to carry out their tasks, with the use of plans as control tools. And that there are rules and procedures provided for decision-making in the University Council. It also has full powers to manage the university to improve the teaching and learning environment. The researchers also recommended a number of recommendations, including the need to follow up on the procedures and systems of management and update them continuously in the light of changes that may occur and to ensure the existence of a strong system of electronic information systems within the university. There is a need to provide mechanisms for obtaining information about the surrounding external environment, and effective mechanisms to provide managers with the necessary information in a timely manner. The importance of providing channels of communication that enables staff to communicate information about any violations and breaches. The study also recommended the follow-up, review, procedures and administrative systems, and work to modify them in line with the mission of the university and the objectives that the university seeks to reach. Social participation requires certain abilities: communication with other members of society; social understanding which enables planning ahead and dealing with novel circumstances; and a theory of mind which makes it possible to anticipate the mental state of another. In childhood play we learn how to pretend, how to put ourselves in the minds of others, how to imagine what others are thinking and how to attribute false beliefs to them. Without this ability we would be unable to deceive and detect (...) deception in the actions of others, and our ability to interact within our social group would be greatly impaired. In this paper I claim that the capacity for deception is necessary for a theory of mind, and a theory of mind is necessary for complex social interaction. (shrink)

Hillel Steiner has recently attacked the notion of inalienable rights, basing some of his arguments on the Hohfeldian analysis to show that infinite arrays of legal positions would not be associated with any inalienable rights. This essay addresses the nature of the Hohfeldian infinity: the main argument is that what Steiner claims to be an infinite regress is actually a wholly unproblematic form of infinite recursion. First, the nature of the Hohfeldian recursion is demonstrated. It is shown that infinite recursions (...) of legal positions ensue regardless of whether inalienable rights exist or not. Second, the alleged problems that this might pose for the analysis are discussed. The conclusion is that one should not worry about the recursion as long as one understands correctly the role of the Hohfeldian analysis in normative reasoning. (shrink)

The concept of instantiation is realized differently across a variety of metaphysical theories. A certain realization of the concept in a given theory depends on what roles are specified and associated with the concept and its corresponding term as well as what entities are suited to fill those roles. In this paper, the classic realization of the concept of instantiation in a one-category ontology of abstract particulars or tropes is articulated in a novel way and defended against unaddressed objections.

Recent research has relied on trolley-type sacrificial moral dilemmas to study utilitarian versus nonutili- tarian modes of moral decision-making. This research has generated important insights into people’s attitudes toward instrumental harm—that is, the sacrifice of an individual to save a greater number. But this approach also has serious limitations. Most notably, it ignores the positive, altruistic core of utilitarianism, which is characterized by impartial concern for the well-being of everyone, whether near or far. Here, we develop, refine, and validate a (...) new scale—the Oxford Utilitarianism Scale—to dissociate individual differences in the ‘negative’ (permissive attitude toward instrumental harm) and ‘positive’ (impartial concern for the greater good) dimensions of utilitarian thinking as manifested in the general population. We show that these are two independent dimensions of proto-utilitarian tendencies in the lay population, each exhibiting a distinct psychological profile. Empathic concern, identification with the whole of humanity, and concern for future generations were positively associated with impartial beneficence but negatively associated with instrumental harm; and although instrumental harm was associated with subclinical psychopathy, impartial beneficence was associated with higher religiosity. Importantly, although these two dimensions were independent in the lay population, they were closely associated in a sample of moral philosophers. Acknowledging this dissociation between the instrumental harm and impartial beneficence components of utilitarian thinking in ordinary people can clarify existing debates about the nature of moral psychology and its relation to moral philosophy as well as generate fruitful avenues for further research. Transoral laser microsurgery applies to the piecemeal removal of malignant tumours of the upper aerodigestive tract using the CO2 laser under the operating microscope. This method of surgery is being increasingly popularised as a single modality treatment of choice in early laryngeal cancers (T1 and T2) and occasionally in the more advanced forms of the disease (T3 and T4), predomi- nantly within the supraglottis. Thomas Kuhn, the American physicist turned philosopher and historian of science, coined the phrase ‘paradigm shift’ in (...) his groundbreaking book The Structure of Scientific Revolutions. He argued that the arrival of the new and often incompatible idea forms the core of a new paradigm, the birth of an entirely new way of thinking. This article discusses whether Steiner and col- leagues truly brought about a paradigm shift in oncological surgery. By rejecting the principle of en block resection and by replacing it with the belief that not only is it oncologically safe to cut through the substance of the tumour but in doing so one can actually achieve better results, Steiner was able to truly revolutionise the man- agement of laryngeal cancer. Even though within this article the repercussions of his insight are limited to the upper aerodigestive tract oncological surgery, his willingness to question other peoples’ dogma makes his contribution truly a genuine paradigm shift. Biodiversity loss is an immense ecological crisis of our time. But while “biodiversity” has become a buzzword in media and policy, conservationists have found it difficult to build a common understanding on the nature and severity of biodiversity loss and the means to tackle it. Perhaps surprisingly, many biologists and philosophers have proposed that biodiversity might be best defended with reference to its aesthetic value. This article explores whether aesthetic values could provide strong support for biodiversity conservation. By exploring the (...) question from the viewpoints of species diversity, ecosystem diversity, and genetic diversity, we argue that there is a mismatch between apparent and real biodiversity and that aesthetics can, at best, give only limited support for biodiversity conservation. In Wollstonecraft’s early writings, she articulates the foundational theological and philosophical principles that would underpin her work throughout her career. One difference between her early and later work lies in the way that the values to which she refers are combined. Whereas Wollstonecraft at first appeals to the separate ideals of independence, equality, and virtue, from the 1790s onwards she integrates these into a characteristic republican framework that was in common use amongst dissenting theorists at the time. The set of (...) values on which Wollstonecraft draws, and the version of the republican framework that she develops, closely resemble those of Richard Price with whose work she was familiar. Examining the structural similarities between their respective models, I argue, gives us an insight into the systematic manner of aspects of Wollstonecraft’s own thought. It also allows us to see how Wollstonecraft goes beyond the republicanism of Price and others as she develops her own feminist solutions to the problems of structural domination. (shrink)

This paper explores two related questions in late Athenian and Alexandrian Neoplatonism. First, how can a philosopher contemplate the eternal Forms while engaging in practical agency in the world? Second, do Neoplatonists provide a consistent account of the philosopher’s progress through the ‘stages of virtue’ (βαθμοί τῶν ἀρετῶν), the conceptual structure that underpins late antique philosophical curricula and hagiography? These questions interact, I suggest, because later Platonists appeal to the stages of virtue and divine maniai (βαθμοί τῶν μανίων) to explain (...) the philosopher’s ability to alternate gracefully between contemplation and embodied agency, and even to engage in both activities at the same moment. I argue that apparently contradictory evidence for the highest stages of virtue can be reconciled satisfactorily, shedding light on two models of ethical and perceptual transformation that are consistent throughout later Neoplatonism. In the first, 'painterly' model, we alternate between a vision of the paradigmatic model and its expression in the media of place and time; in the second, 'dancerly' model, we contemplate in action all at once, like a dancer moving to the music. We investigate the causal manipulability hypothesis, according to which what partly explains (a) why people tend to prefer negative events to be in their further future rather than their nearer future and positive events to be in their nearer future rather than their further future and (b) why people tend to prefer that negative events be located in their past not their future and that positive events be located in their future not their past, is that people tend to discount (...) the value of events they are less able causally to manipulate. If people discount the value of events they are less able to causally manipulate, then since often temporally nearer future events are more causally manipulable than further ones, and since future events are manipulable whereas past ones aren’t, this could explain both (a) and (b). In turn, if the causal manipulability hypothesis is correct, this might suggest that insofar as people’s preferences are explained in this manner, those preferences are rationally permissible, since relative causal manipulability is normatively relevant. Thus, ascertaining whether the causal manipulability hypothesis is true may shed light on the normative status of such preferences. We investigate the cognitively mediated version of the causal manipulability hypothesis, according to which people’s consciously held beliefs about the relative causal manipulability of events explains (a) and (b). Contrary to expectations, we found no evidence in favour of this view. We suggest that either relative causal manipulability plays an explanatory role, but one that is not cognitively mediated, or that it does not play any role, even if it is sometimes associated with other factors, such as probability, that may play a role in explaining some time biased preferences. Samuel Alexander was a central figure of the new wave of realism that swept across the English-speaking world in the early twentieth century. His Space, Time, and Deity (1920a, 1920b) was taken to be the official statement of realism as a metaphysical system. But many historians of philosophy are quick to point out the idealist streak in Alexander’s thought. After all, as a student he was trained at Oxford in the late 1870s and early 1880s as British Idealism was beginning (...) to flourish. This naturally had some effect on his philosophical outlook and it is said that his early work is overtly idealist. In this paper I examine his neglected and understudied reactions to British Idealism in the 1880s. I argue that Alexander was not an idealist during this period and should not be considered as part of the British Idealist tradition, philosophically speaking. (shrink)

Edward Stuart Russell (1887–1954) was a central figure in the philosophy of biology during the first half of the twentieth century. Although he worked as a government fisheries scientist for much of his life, he still managed to establish himself as one of the most prominent biological theorists of his time. The views he developed, which were antireductionistic, organism-centred, and teleological, challenged the prevailing mechanistic orthodoxy. His book 'The Interpretation of Development and Heredity' (1930) provides one of themost incisive critiques (...) of the chromosomal theory of the gene ever published, and it has acquired a renewed relevance in light of recent empirical findings. Russell’s interest in the theoretical problems of biology is as much historical as philosophical, and many of his works, particularly his first book 'Form and Function' (1916), are still regarded today as landmark contributions to the history of biological thought. ‘Gender disappointment’ is regularly reported by those whose child’s sex does not match the sex that they, the parent, desired. With symptoms ranging from mere fleeting sadness to documented cases of serious depression, alienation from one’s child, and emotional suffering, it is clear that so-called ‘gender disappointment’ is a serious issue, that has, as yet, seen little philosophical attention (though see Hendl and Browne 2020). In this chapter I explore gender disappointment, not from the perspective of a parent who ended (...) up with the child of the wrong sex at birth, but rather, from the perspective of a different kind of gender disappointment: the transgender person who grew up and only then disappointed their parents by turning out to be the ‘wrong’ gender. This perspective, I argue, reveals a great deal about the shared gender essentialism at the heart of patriarchal and cissexist ideology. Moreover, I will argue that it reveals the underlying propertarian relationship of parents to their children under contemporary capitalism – a troubling relationship that legitimates the treatment of children as objects to be designed and controlled as commodities at the whims of parents. In this way I disagree with Whyman when he writes that “a preference for having a child of one sex over the other should be considered one of those irrational things of which some sense can nevertheless be made – like aesthetic taste” (Whyman 2021, 113-114). I argue, to the contrary, that the desire for a child of one particular gender is not akin to a mere unproblematic aesthetic preference. Instead, and following the rich feminist tradition of thinking about the patriarchal origins of sexual desire, I argue that we must see these desires as troubling reflections of dominant patriarchal and cissexist ideology, underwritten by a particular neoliberal capitalist mode of production. Empirical evidence shows that people have multiple time-biases. One is near-bias, another is future-bias, and a third is present-bias. Philosophers are concerned with the normative status of these time-biases. They have argued that, at least in part, the normative status of these biases depends on the extent to which they tend to promote, or frustrate, wellbeing, where “wellbeing” is taken to be of fundamental value. Since near-bias is thought to be associated with impulsivity, lack of self-control, and poor long-term health (...) and financial outcomes, it has often been supposed that it is associated with lower wellbeing. On those grounds, philosophers have argued that near-bias is rationally impermissible. By contrast, philosophical views about the normative status of future-bias have been mixed, with some arguing that future-bias is impermissible because, they think, it frustrates wellbeing, and others arguing that it is at least permissible (and perhaps obligatory) because it is the product of mechanisms whose functioning can be expected to promote wellbeing. However, to date there are no studies that have directly probed how time-biases correlate with wellbeing. Since it's not a settled matter which psychological mechanisms underlie time-biases, it is not uncontroversial which things serve as proxies for these preferences. We directly empirically investigate the connection between time-biases and measures of wellbeing, to see which of these biases is associated with promoting, or frustrating wellbeing. Contrary to expectation, we found no evidence that near-bias or present-bias are associated with frustrating wellbeing on any of the constructs we measured. On the other hand, and contrary to what some philosophers have supposed, we found that future-bias was associated with higher measures of wellbeing on several measures. We consider the implications of these findings for the evaluation of the normative status of these time biases. (shrink)

abstract: Richard T. Greener was the first Black graduate of Harvard College in 1870, and he served briefly as a professor of philosophy at the University of South Carolina from 1873 to 1877. Historians and biographers have uncovered many of the facts of his unusual life, but to date his philosophy has remained unappreciated. This essay reconstructs his philosophy from published and archival sources, evaluating it in relationship to the work of his better-known mentor, Frederick Douglass. I argue that Greener’s (...) account of Reconstruction politics, especially his arguments on land redistribution, race, and Black intellectual history, possess notable advantages over Douglass’s views. Of particular importance is that he defended a more robust republican state than did his hero, while rejecting the originalism and constitutionalism that characterize Douglass’s liberalism. (shrink)

Joseph HenryWoodger (1894–1981) was one of the foremost theoretical biologists of the twentieth century. Starting out his career as an experimental embryologist and cytologist, Woodger became increasingly interested in the conceptual foundations of biology. Eventually, he abandoned all empirical research so that he could devote himself fully to studying the structure of biological theories. Perhaps his major accomplishment was the 500-page treatise 'Biological Principles: A Critical Study' (1929), which systematically investigated the epistemological basis of biological knowledge through an analysis of (...) its central concepts. Today, he is mostly remembered for his audacious monograph 'The Axiomatic Method in Biology' (1937), which remains the most ambitious attempt to reformulate the propositions of biology (especially genetics, embryology, and taxonomy) using the tools of symbolic logic and pure mathematics. Woodger is also known for establishing the Theoretical Biology Club, and for introducing the ‘Bauplan’ concept into Anglophone biology. The insect Terpandrus Woodgeri (Woodger’s Gumleaf Katydid) is named in his honour. (shrink)

The study aimed to identify the relationship between correcting the deviations in the measurement of performance and achieving the objectives of control and the performance of the job at the Islamic University in the Gaza Strip. To achieve the objectives of the research, the researchers used the descriptive analytical approach to collect information. The questionnaire consisted of (20) statements distributed to three categories of employees of the Islamic University (senior management, faculty members, their assistants and members of the administrative board). (...) A random sample of 314 employees was selected and 276 responses were retrieved with a recovery rate of 88.1%. The Statistical Analysis Program (SPSS) was used to enter, process, and analyze the data. The results of the study showed a positive relationship between correcting deviations in performance measurement and achieving the control objectives represented by the functional performance in the Islamic University from the point of view of the members (senior management, faculty and their assistants, and the administrative board), where the relative weight of all the paragraphs was (74.25%). The study recommended the need to ensure that the actual performance of the planned performance is matched and decisions are taken to correct the serious deviations and take the necessary measures in terms of retraining and change in regulations, wages and bonuses and punishment of the culprit, neglect and negligence by mistake. Error Management Theory (EMT) suggests that cognitive adaptations evolve to minimize the cost of false negative and false positive errors in detections of consequential environmental conditions. These adaptations manifest as biases tailored to specific environmental conditions. This paper proposes that the same selection pressure fostered the evolution of a self-biasing ability, allowing us to minimize such costs based on experience and culturally transmitted information. The research indicates that this ability specifically applies to productions of belief or doubt about the existence (...) of an environmental condition that is not adequately perceptible to the senses, e.g., doubt that the man is being honest. A model of this self-biasing process, rooted in signal detection theory, is developed and its explanatory reach is demonstrated through many diverse examples from epistemological and social psychological literatures. These examples feature an evidentiary standard for belief that appears too high or low, or seems to have modulated. This study aims to correct and to significantly enhance EMT by introducing this evolved self-biasing ability. (shrink)

In his Encomium of Helen and On Not Being, Gorgias of Leontinoi discusses the nature and function of speech more extensively than any other surviving author before Plato. His discussions are not only surprising in the way they characterize the power of logos and its effects on a listener but also in how the two descriptions of speech seem to contradict one another. In the Helen, Gorgias claims that logos is a very powerful entity, capable of affecting a listener in (...) whatever way it wants. In On Not-Being, he makes the very different (but no less exaggerated) claim that logos is a non-entity, incapable of referring to anything other than itself. In this essay I show how these apparently contradictory accounts might be brought into harmony with one another.2 In the first part I address some of the interpretive difficulties with the text of Gorgias’s On Not Being (henceforth ONB) and the role that irony plays in the work. In particular I argue (as others have before) that Gorgias’s remarks about the impotency of speech are not meant to be taken seriously. Instead, they are aimed more squarely at raising questions about how exactly speech is thought to function and, more specifically, how linguistic reference works—i.e., how words somehow correspond to things, on one level, and to our ideas about things, on another. In the second and third parts of this paper, I illustrate how Gorgias’s concern with linguistic reference in ONB goes on to inform his notion of logos in the Encomium of Helen. I point specifically to evidence found in an important and often overlooked exit clause at the close of ONB regarding the difference between words and things. There, Gorgias insists that if words manifest meaning at all, they must appeal to their own sort of sense organ. In the Helen, he draws on the concepts of soul (psychē) and opinion (doxa) in order to construct this alternative, psychagogic account in which utterances are actually apprehended in ways akin to sense perception. Whether or not one is convinced by Gorgias’s alternative account of how speech works, the description he gives of logos does notionally circumvent the problem of linguistic reference and, in doing so, pushes one to think beyond the potentially constrictive framework of nomen et nominatum. I argue that, when read in this way, these two early discussions of logos represent a unified progression of serious thought about how speech works. (shrink)

The Protein Ontology (PRO; http://proconsortium.org) formally defines protein entities and explicitly represents their major forms and interrelations. Protein entities represented in PRO corresponding to single amino acid chains are categorized by level of specificity into family, gene, sequence and modification metaclasses, and there is a separate metaclass for protein complexes. All metaclasses also have organism-specific derivatives. PRO complements established sequence databases such as UniProtKB, and interoperates with other biomedical and biological ontologies such as the Gene Ontology (GO). PRO relates to (...) UniProtKB in that PRO’s organism-specific classes of proteins encoded by a specific gene correspond to entities documented in UniProtKB entries. PRO relates to the GO in that PRO’s representations of organism-specific protein complexes are subclasses of the organism-agnostic protein complex terms in the GO Cellular Component Ontology. The past few years have seen growth and changes to the PRO, as well as new points of access to the data and new applications of PRO in immunology and proteomics. The study aimed to identify the level of promotion of entrepreneurship in the technical colleges in Palestine. The analytical descriptive method was used in the study. A questionnaire of 41 items was randomly distributed to the technical colleges in the Gaza Strip. The random sample consisted of (275) employees from the mentioned colleges, and the response rate were (74.5%). The results of the study showed that the technical colleges achieved a high level of promotion of entrepreneurship with a relative weight (...) of 73.45%. The results of the study showed that there is a high level of promotion of entrepreneurship (risk, preparedness, proactive competition, innovation orientation) in the technical colleges in Gaza Strip. The field of competition came in first place with a relative weight of 76.65%. In the second place came the field (the trend towards innovation) and relative weight (74.96%). In the third place came the field of pre-emptive preparedness with a relative weight of 74.07%. In the fourth and last place came the field of risk and a relative weight of 68.39%. The results confirmed that there are statistically significant differences in the promotion of entrepreneurship in the technical colleges in Gaza Strip due to the college variable in favor of UCAS. The results confirmed that there is no statistically significant relationship in the promotion of entrepreneurship in technical colleges in Gaza Strip due to the variable level of employment. The researchers suggest a set of recommendations, the most important of which is to draw the attention of the technical colleges to the importance of promoting entrepreneurship, because of their role in reducing the problem of unemployment, the importance of linking technical education and promoting entrepreneurship to the Palestinian society in general and Gaza Strip in particular. The importance of urging decision-makers in technical colleges to promote interest in leadership and to put their own courses in all technical education programs in these colleges, as well as enhancing the technical, technological and technical capabilities of technical education and keeping pace with the latest international standards by providing the necessary material resources. There is a need to urge researchers to conduct further studies of the future which deal with the same variables of the current study in the field of entrepreneurship and applied to other sectors. Sometimes it is not one’s place to blame or forgive. This phenomenon is captured under the philosophical notion of standing. However, there is an asymmetry to be explained here. One can successfully blame, even if one lacks the standing to do so. Yet, one cannot successfully forgive if one lacks the standing to do so. In this article we explain this asymmetry. We argue that a complete explanation depends on not only a difference in the natures of the standing to (...) blame and forgive but also a difference in the natures of blame and forgiveness themselves. The aim of this collection is to create a curated set of key German source texts from the eighteenth-century life sciences devoted to theories of generation, heredity, and race. The criteria for inclusion stem from our sense that there is an argument to be made for connecting three domains of inquiry that have heretofore remained mostly distinct in both their presentation and scholarly analysis: i) life science debates regarding generation and embryogenesis, ii) emerging philosophical and anthropological theories regarding the nature (...) of racial typology, and iii) the role of empire in supplying the ethnographic materials in use as evidence for the various investigations and theories being proposed. The Key Texts volume thus has three sections. The first section is devoted to selections from theorists working to create an account of the processes guiding generation and embryogenetic development. Given that at the time there were few ways to definitively prove that babies received contributions from both parents in their creation, mixed-race children became increasingly valuable sources of evidence for those insisting on joint inheritance. Although this sets up the second section of the volume—since one can trace a clear facet of racial biometric science out of this original set of enquiries—the bulk of section two is devoted to the many different accounts created at the time to understand and delineate racial differences. The third section is focused on ‘race and empire’ in order to situate the scientific texts of the previous sections in their socio-historical context. By including these pieces, it is our aim to remind readers that scientific curiosity over the nature and origin of racial diversity did not develop in a vacuum but indeed existed in full knowledge of the exploitation and dispossession of human beings. The ‘materials’ for this research program were in many cases either directly taken from black and brown human beings caught up in Europe’s colonial projects or were provided by the data gathered during large-scale voyages of exploration. The material basis of this type of research was rarely reflected upon by any of the theorists in sections one and two of the volume, a fact that has led many historians of science to focus on these theories without attention to the socio-historical context; we are deliberately trying to avoid this and indeed to deepen our own readers’ appreciation of the fact. A key question in the philosophy of logic is how we have epistemic justification for claims about logical entailment (assuming we have such justification at all). Justification holism asserts that claims of logical entailment can only be justified in the context of an entire logical theory, e.g., classical, intuitionistic, paraconsistent, paracomplete etc. According to holism, claims of logical entailment cannot be atomistically justified as isolated statements, independently of theory choice. At present there is a developing interest in—and endorsement of—justification holism (...) due to the revival of an abductivist approach to the epistemology of logic. This paper presents an argument against holism by establishing a foundational entailment-sentence of deduction which is justified independently of theory choice and outside the context of a whole logical theory. In this paper I examine Grace A. de Laguna’s theory of universals in its historical context and in relation to contemporary debates in analytic metaphysics. I explain the central features of her theory, arguing that her theory should be classified as a form of immanent realism and as a powers ontology. I then show in what ways her theory affords a theory of modality in terms of potentialities and discuss some of its consequences along the way.

The aim of the research is to shed light on the nature of the organizational structure prevailing in Palestinian governmental universities and to identify the most important differences in the perceptions of employees of the organizational structure in the Palestinian governmental universities according to the demographic and organizational variables. The researchers used the descriptive analytical method, through a questionnaire randomly distributed to the sample of the employees of Al-Aqsa University. The study was conducted on a sample of (80) administrative staff (...) from Al-Aqsa University. The study found that there is a moderate degree of satisfaction with the nature of the organizational structure prevailing in the Palestinian governmental universities from the point of view of the administrative staff, with a percentage of (63.11%). The absence of differences between the sample according to the gender variable in their perception of the nature of the organizational structure prevailing at Al-Aqsa University, the absence of differences in their perception of the nature of the organizational structure depending on the age variable. There are statistical significance differences in the perception of the elements of the organizational climate depending on the variable of scientific qualification in their perception of the nature of the organizational structure in favor of holders of a bachelor's degree, the absence of differences in their perception of the nature of the organizational structure depending on the variable years of service, and the absence of differences in their perception of the nature of the organizational structure depending on the variable level of career (Director, Head of Department, and Administrative Officer). The study reached a number of recommendations, the most important of which is that the management of the Palestinian governmental universities in general and Al-Aqsa University in particular should be given special attention to the organizational structure and modified in a way that achieves the goals of the university and the aspirations of the employees. The universities should have the opportunity to participate in the restructuring of the organizational structure, the importance of solving the problems of employees and giving them the opportunity to contribute to solving their own problems, and the need to use the method of rotation of employees and periodically. The article describes the seven characteristics that should identify a Jesuit university nowadays: 1) Pedagogical practices at Jesuit universities should promote authentic dialog and reconciliation; 2) Pedagogical practices at Jesuit universities should promote human excellence in every aspect of human life; 3) Pedagogical practices at Jesuit universities should promote exploration and discovery focused on and among disciplines; 4) Programs and practices at Jesuit universities should promote exploration and intercultural appreciation; 5) Jesuit universities should contribute both in theory and in practice (...) to the promotion of justice in society as a whole and within society’s various institutions; 6) A Jesuit classroom should promote the construction of a global vision in students and professors; and 7) Internships and programs at Jesuit universities should promote authentic spiritual growth and faith development. Based on the key approaches of the Ignatian Pedagogical Paradigm (ipp) and having in view that this is not a prefabricated model ready to be applied, its particularities in higher education are contextualized in light of the reflections of the Society General Superiors. The characteristics or identifiers presented motivate educational institutions to build an identity that responds to a long tradition of Jesuit education and a constant renewal of their commitment to form leaders to heal a broken world. A cognitive ethnography of how bioengineering scientists create innovative modeling methods. In this first full-scale, long-term cognitive ethnography by a philosopher of science, Nancy J. Nersessian offers an account of how scientists at the interdisciplinary frontiers of bioengineering create novel problem-solving methods. Bioengineering scientists model complex dynamical biological systems using concepts, methods, materials, and other resources drawn primarily from engineering. They aim to understand these systems sufficiently to control or intervene in them. What Nersessian examines here is how cutting-edge bioengineering (...) scientists integrate the cognitive, social, material, and cultural dimensions of practice. Her findings and conclusions have broad implications for researchers in philosophy, science studies, cognitive science, and interdisciplinary studies, as well as scientists, educators, policy makers, and funding agencies. In studying the epistemic practices of scientists, Nersessian pushes the boundaries of the philosophy of science and cognitive science into areas not ventured before. She recounts a decades-long, wide-ranging, and richly detailed investigation of the innovative interdisciplinary modeling practices of bioengineering researchers in four university laboratories. She argues and demonstrates that the methods of cognitive ethnography and qualitative data analysis, placed in the framework of distributed cognition, provide the tools for a philosophical analysis of how scientific discoveries arise from complex systems in which the cognitive, social, material, and cultural dimensions of problem-solving are integrated into the epistemic practices of scientists. Specifically, she looks at how interdisciplinary environments shape problem-solving. Although Nersessian’s case material is drawn from the bioengineering sciences, her analytic framework and methodological approach are directly applicable to scientific research in a broader, more general sense, as well. The researchers also recommended a number of recommendations, most notably the provision of an appropriate level of the elements of the control systems today through the modernization and continuous development of performance measures and the need to provide the physical and financial resources necessary to continue the development and achievement within the university, to expand the development of technology in the various activities of the university through the construction of a complete and integrated system to support supervision systems in the university to suit the size of the university. A graph-theoretic account of logics is explored based on the general notion of m-graph (that is, a graph where each edge can have a finite sequence of nodes as source). Signatures, interpretation structures and deduction systems are seen as m-graphs. After defining a category freely generated by a m-graph, formulas and expressions in general can be seen as morphisms. Moreover, derivations involving rule instantiation are also morphisms. Soundness and completeness theorems are proved. As a consequence of the generality of the (...) approach our results apply to very different logics encompassing, among others, substructural logics as well as logics with nondeterministic semantics, and subsume all logics endowed with an algebraic semantics. Trope theory is a leading metaphysical theory in analytic ontology. One of its classic statements is found in the work of Donald C. Williams who argued that tropes qua abstract particulars are the very alphabet of being. The concept of an abstract particular has been repeatedly attacked in the literature. Opponents and proponents of trope theory alike have levelled their criticisms at the abstractness of tropes and the associated act of abstraction. In this paper I defend the concept of a (...) trope qua abstract particular by rejecting arguments that purport to show that tropes should not be understood as abstract and by arguing that the abstractness of tropes plays an indispensable role in one of our more promising trope-theoretic analyses of universals and of concrete objects. The study aimed to identify the reality of technical education in Palestine. The analytical descriptive method was used in the study. A questionnaire which consisted of 41 paragraphs was distributed randomly to the technical colleges in Gaza Strip. The results showed a high degree of approval for the dimensions of technical education with a relative weight of 76.07%. The ranking and relative weight was as (...) follows: Technical education institutions: 79.51%, graduates of technical education 75.75%, Labor market and local community 72.96%. The researchers propose a number of recommendations, the most important of which is: the need to pay attention to technical education in line with the National Strategic Plan for Higher Education by moving towards technical education. The importance of offering special courses in all technical education programs in these colleges. The study aimed to identify the creative environment of the technical colleges operating in Gaza Strip. The analytical descriptive method was used through a questionnaire which was randomly distributed to 289 employees of the technical colleges in Gaza Strip with a total number of (1168) employees and a response rate equal to (79.2%) of the sample study. The results confirmed the existence of a high degree of approval for the dimensions of the creative environment with a relative weight of (75.19%) (...) according to the perspective of the employees of the technical colleges in Gaza Strip. The results of the study showed a high level of creative environment (fluency, flexibility, originality, sensitivity to problems) in the technical colleges in Gaza Strip, where the field (fluency) ranked first and relative weight (76.86%), in the second place came the area (sense of problems) and relative weight (74.89%). The field of elasticity came in third place with a relative weight of (74.59%). Finally, the field of originality came in fourth and final rank with a relative weight of (74.41%). The results showed that there are differences between the technical colleges in the principles of the creative environment in all fields and the overall degree except for the field of flexibility. The most available colleges in these principles were the university college of applied sciences, and that was the least of the Faculty of Al-Aqsa Society. The results showed that there were differences according to the age variable in the areas of creative environment only in the sense of problems for age groups (less than 30 years) and (from 40 to 50 years). The researchers suggested a number of recommendations, the need to enhance the dimensions of the creative environment in technical colleges by working to improve the faculties of fluency, flexibility, originality and sensitivity to problems. The need to work on continuity and improve aspects of the creative environment of the colleges and the creation of new and innovative ways to support and develop and support these aspects combined. Necessity of technical colleges to continue to develop the creative environment (fluency, flexibility, originality, sensitivity to problems) for employees by engaging them in specialized training courses for creative thinking and problem solving. Developing work procedures with new innovative methods that will accomplish the various tasks quickly and accurately, and provide the effort, time and costs. The researchers urged more future studies that address the same variables of the current study in the field of creative environment and applied to other sectors. (shrink)
