Ormanlarımızı kesiyor, tatlı su akiferlerimizi tüketiyor ve hayati önem taşıyan topraklarımızı kaybediyoruz. Okyanuslarımızdaki yaşamı sıyırıp yerine yüz milyonlarca ton plastik atık koyuyoruz. Çevremizi toksik endüstriyel kimyasallarla dolduruyoruz. Kirliliğimiz, kıtalardaki yaşamın dokusunu parçalayan ısı dalgalarına, kuraklıklara ve vahşi yangınlara neden olan iklim değişikliğini tetikliyor. Ve dünyaya yeni nesiller getiriyoruz, onurlu bir varoluşun kaynaklarına erişmeye ihtiyaç duyan milyonlarca insan. Hayata yönelik tehditlerin kapsamı ve genişliği her geçen gün artmaktadır. Nous enlevons la vie de nos océans et la remplaçons par des centaines de millions de tonnes de déchets plastiques. Nous inondons notre environnement de produits chimiques industriels toxiques. Notre pollution est à l'origine du changement climatique qui provoque des vagues de chaleur, des sécheresses et des incendies de forêt qui (...) déchirent le tissu de la vie sur les continents. Et nous mettons au monde de nouvelles générations, des millions qui ont besoin d'accéder aux ressources d'une existence digne. La portée et l'ampleur des menaces à la vie augmentent jour après jour. Ce n'est pas un mode de développement durable. La cause profonde de nos maux provient d'une façon de penser erronée. Qu'est-ce que cela signifie exactement? cela signifie que nous nous considérons principalement comme des êtres matériels, tout en niant notre nature spirituelle. THOMPSON University of St. Thomas St. Paul, Minnesota Introduction I N HIS Three Rival Versions of Moral Enquiry1 Alasdair Macintyre continues (with certain modifications) in a similar trajectory established in two earlier works, After Virtue and Whose Justice? Which Rationality? Against postEnlightenment portraits of moral reasoning, he consistently defends a conception of practical rationality which entails the (...) recognition of tradition, authority, and narrative as constitutive components of any rationally determined moral enquiry. Despite the consistent appeal to tradition, there is a significant development within Macintyre's reflections regarding the pre-eminent resources we are to draw upon. At the end of After Virtue we are asked to await a "doubtless very different" St. Benedict. In Whose Justice? Which Rationality? the Thomistic tradition emerges as the superior form of moral enquiry. While Thomism maintains a pre-eminence in Three Rival Versions of Moral Enquiry, I suggest that there is an increasingly Augustinian element emerging within his analysis and that this dimension underlies Macintyre's efforts in ways not previously specified. THOMPSON That Augustine figures in Macintyre's reception of the Thomistic tradition is not necessarily striking, for part of what fuels Macintyre's increasing enthusiasm for St. Thomas is precisely the latter's capacity to draw upon the best of the Augustinian tradition of enquiry. Beyond what Macintyre himself has overtly recognized as Augustine's contribution to the thought of St. Thomas, however, I suggest that elements of Augustine's thought directly influence much of Macintyre 's own attempts at restoring a kind of tradition-guided enquiry. This Augustinian strain, moreover, not only serves to highlight features of Macintyre's analysis of Thomism, but also brings to light certain theological presuppositions essential to the kind of moral enquiry Macintyre hopes to retrieve. The character of Macintyre's narrative, then, leads us to St. Augustine. In After Virtue it is largely the Aristotelian tradition of enquiry which he defends against rival post-Enlightenment theories of morality. He argues that the analytic, linguistic, and phenomenological tools brought to bear upon the task of formulating a coherent conception of the moral life and moral enquiry have failed miserably, principally for two reasons. The first is that such contemporary efforts have neglected to realize that moral enquiry is embedded in a broader context of social practices, practices which are inevitably historically conditioned; thus a failure to recognize the historically situated character of moral enquiry distorts that account. The second reason is related to the first in that failure to acknowledge the historical character of such enquiry has resulted in a failure to recognize that much of our contemporary terms and tools of moral analysis are remnants from previous contexts of enquiry which are no longer mutually agreed upon nor recognized as relevant.' What has been lost, among other things, is the teleological metaphysics which serves as the context for nearly two millennia in the West. A xurisprudencia constitucional española (STC 37/2011, de 28 de marzo, entre outras) ten establecido como fundamento do consentimento informado o dereito á integridade física e moral (art. 15 CE). O Tribunal Constitucional configura o consentimento informado como un deber de abstención do profesional sanitario, é dicir, como unha negación da competencia do profesional sanitario na terminoloxía de Hohfeld. Así pois, o consentimento informado queda conformado como un dereito negativo ou de defensa, polo que concibilo como liberdade xurídica ou facultade de (...) autodeterminación positiva esixiría a revisión do seu fundamento constitucional. O presente artigo pretende precisamente revisar a natureza iusfundamental do consentimento informado a partir da obra de W.N. Hohfeld e Robert Alexy. (shrink)

Jellinek define “estatus” como la “relación con el Estado que califica al individuo”. Su teoría distingue cuatro tipos: pasivo o subiectionis, negativo o libertatis, positivo o civitatis y activo o de la ciudadanía activa. Al margen de las polémicas sobre su vigencia, se pretende relacionar la aportación de Jellinek con la concepción del consentimiento informado del Tribunal Constitucional español, quien lo ha definido como deber de abstención de los profesionales sanitarios (STC 37/2011, de 28 de marzo, entre otras), es decir, (...) como una negación de su competencia en la terminología de Hohfeld, o como un derecho de defensa. Debido a la adecuación de su estructura al contenido del consentimiento informado, el análisis se centrará en los estatus negativo y positivo. PREMISSA No século XIX, ocorreram transformações impulsionadas pela emergência de novas fontes energéticas (água e petróleo), por novos ramos industriais e pela alteração profunda nos processos produtivos, com a introdução de novas máquinas e equipamentos. Depois de 300 anos de exploração por parte das nações europeias, iniciou -se, principalmente nas colônias latino-americanas, um processo intenso de lutas pela independência. É no século XIX, já com a consolidação do sistema capitalista na Europa, que se encontra a herança intelectual mais próxima da (...) qual surgirá a Sociologia como ciência particular. No início desse século, as ideias do Conde de Saint-Simon (1760-1825), de Georg Wilhelm Friedrich Hegel (1770-1831), de David Ricardo (1772-1823) e de Charles Darwin (1809-1882), entre outros, foram o elo para que Alexis de Tocqueville (1805-1859), Auguste Comte (1798-1857), Karl Marx (1818 -1883) e Herbert Spencer (1820-1903), entre outros, desenvolvessem reflexões sobre a sociedade de seu tempo. Auguste Comte e Karl Marx foram os pensadores que lançaram as bases do pensamento sociológico e de duas grandes tradições – a positivista e a socialista – que muito influenciaram o desenvolvimento da Sociologia no Brasil. 1 AUGUSTE COMTE E A TRADIÇÃO POSITIVISTA Isidore Auguste Marie François Xavier Comte nasceu em Montpellier, na França, em 19 de janeiro de 1798. Com 16 anos de idade, ingressou na Escola Politécnica de Paris, fato que teria significativa influência na orientação posterior de seu pensamento. De 1817 a 1824, foi secretário do Conde de Saint-Simon. Comte declarou que, com Saint -Simon, aprendeu muitas coisas que jamais encontraria nos livros e que, no pouco tempo em que conviveu com o conde, fez mais progressos do que faria em muitos anos, se estivesse sozinho. Toda a obra de Comte está permeada pelos acontecimentos que ocorreram após a Revolução Francesa de 1789. Ele defendeu parte dos princípios revolucionários e criticou a restauração da monarquia, preocupando-se fundamentalmente em reorganizar a sociedade, que, no seu entender, estava em ebulição e mergulhada no caos. Para Comte, a desordem e a anarquia imperavam em virtude da confusão de princípios (metafísicos e teológicos), que não se adequavam à sociedade industrial em expansão. Era, portanto, necessário superar esse estado de coisas, usando a razão como fundamento da nova sociedade. Propôs, então, a mudança da sociedade por meio da reforma intelectual plena das pessoas. De acordo com o pensador, com a modificação do pensamento humano, por meio do método científico, que ele chamava de “filosofia positiva”, haveria uma reforma das instituições. Com a proposta do estudo da sociedade por meio da análise de seus processos e estruturas, e da reforma prática das instituições, Comte criou uma nova ciência, à qual deu o nome de “física social”, passando a chamá-la posteriormente de Sociologia. A Sociologia representava, para Comte, o coroamento da evolução do conhecimento, mediante o emprego de métodos utilizados por outras ciências, que buscavam conhecer os fenômenos constantes e repetitivos da natureza: a observação, a experimentação, a comparação e a classificação. De acordo com esse pensador, a Sociologia, como as ciências naturais, deve sempre procurar a reconciliação entre os aspectos estáticos e os dinâmicos do mundo natural ou, no caso da sociedade humana, entre a ordem e o progresso. O lema da “filosofia positiva” proposta por Comte era “conhecer para prever, prever para prover”, ou seja, o conhecimento é necessário para fazer previsões e também para solucionar possíveis problemas. A influência de Comte no desenvolvimento da Sociologia foi marcante, sobretudo, na escola francesa, evidenciando-se em Émile Durkheim e seus contemporâneos e seguidores. Seu pensamento esteve presente em muitas das tentativas de criar tipologias para explicar a sociedade. Suas principais obras são: Curso de filosofia positiva (1830-1842), Discurso sobre o espírito positivo (1848), Catecismo positivista (1852) e Sistema de política positiva (1854). Para concluirmos, Comte explanava que para a superação da anarquia reinante na nova sociedade industrial, a filosofia positivista defendia a subordinação do progresso à ordem. O mesmo era contra o retorno de Luís XVIII ao trono: em sua concepção, a sociedade industrial que emergia requeria um governo fundado na razão. 2 A TRADIÇÃO SOCIALISTA: KARL MARX E FRIEDRICH ENGELS Karl Heinrich Marx nasceu em Tréveris, na antiga Prússia, hoje Alemanha, em 1818 e, em 1830, ingressou no Liceu Friedrich Wilhelm, nessa mesma cidade. Anos depois, foi cursar Direito na Universidade de Bonn, transferindo-se para Berlim em seguida. Pouco a pouco, entretanto, seus interesses migraram para a Filosofia, área na qual defendeu, em 1841, a tese de doutorado A diferença da filosofia da natureza em Demócrito e Epicuro. Sua vida universitária foi marcada pelo debate político e intelectual influenciado pelo pensamento de Ludwig Feuerbach (1804-1872) e, principalmente, pelo de Georg Wilhelm Friedrich Hegel (1770- 1831). Friedrich Engels (1820-1895) nasceu em Barmen (Renânia), na antiga Prússia, hoje Alemanha, filho mais velho de um rico industrial do ramo têxtil. Terminou sua formação secundária em 1837 e a partir de então sua formação intelectual foi por conta própria (autodidata), com alguns cursos universitários esparsos e de curta duração. Desde cedo começou a trabalhar nas empresas de seu pai e foi nessa condição que se deslocou para Bremen por três anos e depois foi enviado pelos pais a Manchester, na Inglaterra, onde trabalhou nas fábricas da família. Engels ficou impressionado com a miséria na qual viviam os trabalhadores das fábricas inglesas. Os dois, Marx e Engels, se encontraram em 1842, quando Marx passou a escrever para A Gazeta Renana, jornal da província de Colônia, do qual Engels era colaborador e mais tarde editor-chefe. O jornal, que criticava o poder prussiano, foi fechado em 1843, e Marx se viu desempregado. Ao perder o emprego, mudou-se para Paris, na França. Ali escreveu, em 1844, os Manuscritos econômico-filosóficos (só publicados em 1932) e, junto com F. Engels, o livro A sagrada família. Por sua vez, F. Engels, em 1844, decidiu voltar para a Alemanha, onde publicou, em 1845, A situação da classe trabalhadora na Inglaterra. Entre 1845 e 1847, Marx exilou-se em Bruxelas, na Bélgica, onde escreveu A ideologia alemã (em parceria com Friedrich Engels) e Miséria da filosofia (1847), obra na qual criticou o filósofo Pierre-Joseph Proudhon (1809-1865). Em 1848, ainda na Bélgica, a parceria com Engels se solidificou ao escreverem juntos o livreto O Manifesto Comunista. Em 1848, Marx foi expulso da Bélgica e retornou a Colônia, na Alemanha (Prússia), sempre pensando na possibilidade de uma mudança estrutural em sua terra natal. Isso, entretanto, não aconteceu e Marx foi expulso da Alemanha em 1849, ano em que migrou para Londres, na Inglaterra, onde permaneceu até o fim da vida. Lá escreveu O 18 Brumário de Luís Bonaparte (1852), sua mais importante obra de reflexão sobre a vida política europeia do século XIX, desenvolveu pesquisas e concluiu seu maior trabalho: O capital: crítica da economia política. O primeiro volume dessa obra foi publicado em 1867; os outros três, em 1885, 1894 e 1905, após a morte de Marx, revisados por F. Engels. 2.1 O contexto histórico e a obra de Marx e Engels Para situar a obra de Marx e Engels, é necessário conhecer um pouco do que acontecia em meados do século XIX. Com as transformações que ocorriam no mundo ocidental, principalmente na esfera da produção industrial, houve um crescimento expressivo no número de trabalhadores industriais urbanos, com uma consequência evidente: precariedade da vida dos operários nas cidades. As condições de trabalho no interior das fábricas eram péssimas. Os empregados eram superexplorados, alimentavam-se mal e trabalhavam em ambientes insalubres. Para enfrentar essa situação e tentar modificá-la, os trabalhadores passaram a se organizar em associações e sindicatos e a promover movimentos de reivindicação. Desenvolveu-se, então, uma discussão das condições sociais, políticas e econômicas para se definirem as possibilidades de intervenção nessa realidade. Desde o início do século XIX, muitos pensadores discutiram essas questões, nas perspectivas socialista e anarquista. Na Inglaterra podem ser citados, entre outros: William Godwin (1756-1836), Thomas Spence (1750-1814), Thomas Paine (1737-1809), Robert Owen (1771-1858) e Thomas Hodgkin (1787-1866). Na França, destacaram-se Étienne Cabet (1788- 1856), Flora Tristan (1803-1844), Charles Fourier (1772-1837) e Pierre-Joseph Proudhon (1809-1865). Marx e Engels levaram em conta esses pensadores, debatendo com alguns contemporâneos e criticando-os. Além disso, incorporaram a tradição da economia clássica inglesa, presente principalmente nas obras de Adam Smith e de David Ricardo. Pode-se dizer, portanto, que Marx e Engels desenvolveram seu trabalho com base na análise crítica da economia política inglesa, do socialismo utópico francês e da filosofia alemã. Esses dois autores não buscavam definir uma ciência específica para estudar a sociedade (como a Sociologia, para Auguste Comte) ou situar seu trabalho em um campo científico particular. Em alguns escritos, Marx afirmou que a História seria a ciência que mais se aproximava de suas preocupações, por abarcar as múltiplas dimensões da sociedade, a qual deveria ser analisada na totalidade, não havendo uma separação rígida entre os aspectos sociais, econômicos, políticos, ideológicos, religiosos, culturais etc. O objetivo de Marx e Engels era estudar criticamente a sociedade capitalista com base em seus princípios constitutivos e em seu desenvolvimento, visando dotar a classe trabalhadora de uma análise política da sociedade de seu tempo. Assim, a tradição socialista nascida da luta dos trabalhadores, muitos anos antes e em situações diferentes, tem como expressão intelectual o pensamento de Karl Marx e Friedrich Engels. Para entender as concepções fundamentais de Marx e Engels é necessário fazer a conexão entre as lutas da classe trabalhadora, suas aspirações e as ideias revolucionárias que estavam presentes no século XIX na Europa. Para eles, o conhecimento científico da realidade só tem sentido quando visa à transformação dessa mesma realidade. A separação entre teoria e prática não é discutida, pois a “verdade histórica” não é algo abstrato e que se define teoricamente; sua verificação está na prática. Apesar de haver algumas diferenças em seus escritos, os elementos essenciais do pensamento de Marx e Engels podem ser assim sintetizados: • historicidade das ações humanas – crítica ao idealismo alemão; • divisão social do trabalho e o surgimento das classes sociais – a luta de classes; • o fetichismo da mercadoria e o processo de alienação; • crítica à economia política e ao capitalismo; • transformação social e revolução; • utopia – sociedade comunista. A obra desses dois autores é muito vasta e não ficou vinculada estritamente aos movimentos sociais dos trabalhadores. Pouco a pouco foi introduzida nas universidades como parte do estudo em diferentes áreas do conhecimento. Estudiosos de Filosofia, Sociologia, Ciência Política, Economia, História e Geografia, entre outras áreas, foram influenciados por ela. Na Sociologia, como afirma Irving M. Zeitlin, no livro Ideología y teoría sociológica, tanto Max Weber quanto Émile Durkheim fizeram, em suas obras, um debate com as ideias de Karl Marx. Pelas análises da sociedade capitalista de seu tempo e a repercussão que tiveram em todo o mundo, principalmente no século XX, nos movimentos sociais e nas universidades, Marx e Engels são considerados autores clássicos da Sociologia. No campo dessa disciplina, porém, o pensamento deles ficou um pouco restrito, pois perdeu aquela relação entre teoria e prática (práxis), ou seja, entre a análise crítica e a prática revolucionária. Essa relação esteve presente, por exemplo, na vida e na obra dos russos Vladimir Ilitch Ulianov, conhecido como Lênin (1870-1924), e Leon D. Bronstein, conhecido como Trotsky (1879-1940), da alemã Rosa Luxemburgo (1871-1919) e do italiano Antonio Gramsci (1891- 1937), que tiveram significativa influência no movimento operário do século XX. Com base no trabalho de Marx e Engels, muitos autores desenvolveram estudos acadêmicos em vários campos do conhecimento. At a time like ours when many African governments have failed in national develop ment, especially in their ability to improve the social welfare of her people through th e provision of social amenities like quality education, portable water, transportation, good roads, good medical amenities, security of lives and property, basic infrastructur e, etc., this work employs Igwebuike philosophy, another African category, as a framewor k for Africa’s development. It develops a model of development which is inclusive and wholistic, and traces Africa’s problem of underdevelopment to the employment of no n-inclusive political and economic institutions. Gödel’s views on time echoed this distinction, suggesting that our perception of time might be a phenomenon shaped by the limitations of human cognition, while the true nature of time (the noumenal aspect) might be far more complex and non-linear. Hier sind einige Gedanken und Überlegungen, die uns helfen, den Zustand zu erreichen, in dem wir eine positive Antwort geben können. -/- Zurückblicken, um nach (...) vorne zu sehen -/- Dies wird nicht das erste Mal in der Geschichte sein, dass für die Menschheit eine Periode der Transformation auf globaler Ebene angebrochen ist. Der Wissenschaftsphilosoph Holmes Rolston wies darauf hin, dass unsere „große Geschichte“ drei solcher Transformationen umfasst – wahre „Urknalle“.1 Die erste war der physische Urknall, der vermutlich vor etwa 13,8 Milliarden Jahren stattfand. Es gebar das manifeste Universum mit seinen Quantenteilchen, vielfältigen Arten von Energien und Milliarden von Galaxien. Es führte zur Bildung von Sonnensystemen mit Sonnen und Planeten und Energieflüssen, die die Entwicklung von lebenden (glücklich gelegenen) Planeten ermöglichen, die aktive Sonnen umkreisen. Eine weitere grundlegende Transformation – ein „zweiter Urknall“ – war die Entstehung lebender Organismen in den komplexen Systemen, die sich auf der Erde und vermutlich auch auf anderen Planeten entwickelt haben. Es wird angenommen, dass diese Transformation vor etwa 3,8 Milliarden Jahren stattgefunden hat. Es begann mit der Entstehung einzelliger Prokaryoten in der Ursuppe, die die Oberfläche des Planeten bedeckte. Der „dritte Urknall“ soll vor etwa 120.000 Jahren stattgefunden haben. Es hat das Bewusstsein unserer Spezies grundlegend verändert – „entwickelt“. Homo soll sapiens geworden sein. Zu den evolutionären Vorteilen des weiterentwickelten Bewusstseins gehörte eine flexiblere und schnellere Form der Kommunikation. Die Kommunikation war nicht mehr auf halbautomatische Reaktionen beschränkt, die durch wiederkehrende Bedingungen und Ereignisse ausgelöst wurden; Anstatt sich auf Zeichen zu beschränken, basierte die menschliche Kommunikation auf einvernehmlich entwickelten Symbolen. -/- Die Entwicklung der Symbolsprache war ein großer Sprung. Einerseits brachte es soziale Strukturen hervor, die auf kollektiv erworbener Bedeutung beruhten, und andererseits produzierte es verbesserte manipulative Fähigkeiten. Gesellschaften könnten sich auf der Grundlage gemeinsamer Kulturen entwickeln, die mächtige Technologien einsetzen. Homo sapiens begann andere Arten zu dominieren und wurde zu einem Schlüsselfaktor in der Evolution des Lebens in der Biosphäre. Der dritte Urknall erzeugte eine Explosion der menschlichen Bevölkerung, aber er brachte nicht die Weisheit hervor, die sicherstellen würde, dass die erweiterte Bevölkerung das Gleichgewicht aufrechterhalten könnte, das für das Gedeihen des Lebens auf diesem Planeten unerlässlich ist. Diese Gleichgewichte wurden immer mehr beeinträchtigt. Wir haben uns von der natürlichen Welt getrennt und müssen zurückkommen – nicht um Wilde und „Primitive“ zu werden, sondern Wesen, die auf die Welt um sie herum eingestimmt sind, die im Einklang mit den Rhythmen und Gleichgewichten der Natur leben und kompatibel erschaffen und nachhaltige eigene Rhythmen und Balancen. Wir sind nicht mehr auf die Rhythmen und Balancen der Natur ausgerichtet. Obwohl wir durch unsere biologische Evolution in diese Rhythmen und Balancen „eingebaut“ sind, haben wir unsere eigenen künstlichen Rhythmen und gefährlichen Balancen geschaffen, die die natürlichen Rhythmen ignorieren und oft mit ihnen in Konflikt stehen. Mit der Sonne aufzugehen und sich mit der Sonne zurückzuziehen bedeutet, sich an den zirkadianen 24-Stunden-Rhythmus anzupassen, der durch die Bewegung der Erde um die Sonne geschaffen wurde, und die sogenannten primitiven Menschen leben immer noch in Harmonie damit, und das tun die meisten auch die restlichen indigenen und traditionellen Kulturen. Aber moderne Menschen missachten die Rhythmen und Gleichgewichte der Natur und glauben, dass sie sie ersetzen können, indem sie Lichter und andere künstliche Annehmlichkeiten mit dem Umlegen eines Schalters ein- und ausschalten. Doch der menschliche Körper passt sich nicht den künstlichen Rhythmen an, und wir leiden unter den Folgen. -/- 3Die Wirksamkeit des Immunsystems ist beeinträchtigt, und trotz einer Flut von biochemischen Medikamenten breiten sich Krankheiten aus. Moderne Bevölkerungen sind Stadtbewohner und haben nur begrenzten Kontakt mit der Natur. Sie leben in einer künstlichen Welt und denken, dass es die reale Welt ist. Sie halten sich anderen Lebensformen überlegen und glauben, die Natur nach Belieben beherrschen zu können. Noch vor fünfzig Jahren musste die Tierintelligenzforscherin Jane Goodall gegen die damals noch vorherrschende Überzeugung ankämpfen, dass ChiMenschen sind biochemische Reiz-Reaktions-Mechanismen, keine lebenden und fühlenden Wesen. Heute erkennen wir, dass nicht nur höhere Säugetiere, alle lebenden Organismen und sogar Bäume und Pflanzen sensible Lebewesen sind und sich in dieser Hinsicht nicht grundlegend von uns unterscheiden. Es liegt im besten Interesse unseres körperlichen und geistigen Wohlbefindens, dass wir diese Missverständnisse und fehlerhaften Verhaltensweisen korrigieren. Wenn wir dies tun, gewinnen wir unsere natürliche Gesundheit und Vitalität zurück. Die heilende Wirkung natürlicher Substanzen und Lebensweisen war schon in der Antike Heilern und Weisen bekannt. Seit Hippokrates, der als Vater der modernen Medizin gilt, suchen Mediziner nach Substanzen und Methoden, die das Gleichgewicht und die Verbindung zwischen Mensch und Natur wiederherstellen. Heute wird dieser Anspruch überschattet von einer oft kommerziell motivierten Abhängigkeit von synthetischen Substanzen und naturverachtenden Praktiken. Die Szene ist nicht nur negativ: Wie wir sehen werden, gibt es positive Entwicklungen in allen Bereichen des menschlichen Strebens, einschließlich Heilung und Medizin. Die Verbindung mit der Natur ist ein Hauptziel der alternativen Heilmethoden, die als Informations- und Energiemedizin bekannt sind. Diese Form der Heilung erlebt in verschiedenen Teilen der Welt, vor allem im Orient, eine Renaissance. Shirin yoku, die japanische Kunst des Waldbadens, ist ein Paradebeispiel. Um es zu praktizieren, müssen wir in einen Wald gehen und uns auf seine Rhythmen und Energien eingestimmt fühlen – den Wind durch die Blätter rauschen hören, das Lichtspiel auf der Oberfläche eines Teichs spüren, mit den Wolken schweben, wenn sie sich durch den Himmel bewegen. Psychotherapeuten finden, dass sogar die Geräusche der Natur, das Zwitschern der Vögel, das Rauschen der Bäche heilend wirken. Einfach in einem Wald zu sein oder neben einem Baum zu stehen, beruhigt und heilt das Nervensystem. Eine weitere wesentliche Aufgabe ist es, positive Entwicklungen in der Gesellschaft zu erkennen und daran anzuknüpfen. -/- Es gibt positive Entwicklungen in der Gesellschaft, und es gibt gesunde, lebensspendende und erhaltende Prozesse in der Natur. Wir könnten wieder in die Natur eintauchen und an positiven Entwicklungen in der Gesellschaft teilhaben. Und doch gelingt uns das nicht. Wir beschreiten einen Weg, der eher zum Zusammenbruch als zum Durchbruch führt. Wir müssen überdenken, wie wir gehen, und vor allem, wohin wir gehen. Wir sind eine von mehr als hundert Millionen Arten in der Biosphäre, wobei jede Art Millionen und in einigen Fällen Milliarden von Individuen umfasst. Unter all diesen Arten und Individuen befinden wir uns in einer privilegierten Position: Wir haben ein hoch entwickeltes Gehirn und Bewusstsein. Dies ermöglicht uns zu fragen, wer wir sind, was die Welt ist und wie wir in der Welt leben können und sollen. Ein fortgeschrittenes Bewusstsein ist eine einzigartige Ressource, und wir machen keinen guten Gebrauch davon. Wir stellen nicht die richtigen Fragen und suchen nicht nach den richtigen Antworten, sondern gehen einfach vorwärts und vertrauen auf das Glück. Wir haben unsere Zahl erhöht, aber nicht die Vorteile, die unser Bewusstsein denen verleihen könnte, die wir in die Welt bringen. Dennoch könnten wir die Lektionen lernen und unsere Wege korrigieren. Wir sind durchaus in der Lage, auf diesem Planeten zu leben, ohne das Gleichgewicht und die Ressourcen zu zerstören, die für ein gesundes Leben für uns und andere Arten erforderlich sind. Keine Spezies müsste dezimiert, unterworfen oder zum Aussterben getrieben werden, um uns am Leben zu erhalten. Wir könnten nachhaltig leben, mit anderen Arten koexistieren und die Grenzen des Lebens auf dem Planeten respektieren. Wir könnten die Verfügbarkeit lebenswichtiger Ressourcen für alle Menschen und Bevölkerungsgruppen sicherstellen. Dennoch treiben wir unzählige Arten zum Aussterben und schädigen die gemeinsame Umwelt. Die bloße Tatsache, dass wir es geschafft haben, als biologische Spezies fünf Millionen Jahre und als bewusste Spezies fünfzigtausend Jahre zu überleben, ist ein Beweis dafür, dass unsere grundlegende Natur nicht das Problem ist. Es ist nicht die Masse der menschlichen Bevölkerung, die dafür verantwortlich ist, zu einer Geißel des Lebens auf dem Planeten zu werden, sondern nur ein Teil. Die Frage ist, warum dieses Segment unhaltbare und jetzt kritische Bedingungen für geschaffen hat die höheren Formen des Lebens auf der Erde? Und kann es sich rechtzeitig ändern und transformieren, um eine große Katastrophe zu vermeiden? Theologische und mystische Annahmen wurden manchmal als Grund dafür angeführt, dass wir zu dem wurden, was wir sind, aber unser Verhalten göttlichen oder anderen transzendenten Ursachen zuzuschreiben, ist nicht die Antwort. Wir sind weder Engel noch Teufel. Wir wurden zur Geißel, zu der wir unbeabsichtigt geworden sind. Zu Beginn des Neolithikums begann ein Teil der Menschheit, die Ressourcen des Planeten ohne Rücksicht auf irgendetwas und irgendjemanden zu nutzen und sich nur darauf zu konzentrieren, seinen eigenen Komfort und seine eigene Macht zu verbessern. Auf einem endlichen und voneinander abhängigen Planeten führte dies zu unausgewogenen und unhaltbaren Bedingungen. Der egozentrische Umgang mit Ressourcen hat das Netz des Lebens beschädigt. Die menschliche Spezies wurde zu einer Bedrohung für alles Leben auf dem Planeten und auch für sich selbst: Die Gesundheit des Netzes des Lebens ist eine Vorbedingung für die Gesundheit der dort lebenden Spezies. Dies ist eine relativ junge Erkenntnis. Jahrtausendelang gingen die Menschen ihren Daseinsaufgaben nach, ohne sich bewusst zu sein, dass die unreflektierte Verfolgung ihrer eigenen Interessen um sie herum zum Fluch des Lebens wird. -/- Wir sind zu einem Fluch für das Leben auf diesem Planeten geworden; Wir haben die Welt zu einem Spielzeugladen gemacht, in dem wir die leistungsstarken Spielzeuge bauen, die unseren wahrgenommenen Interessen dienen. Wir spielen mit unseren Spielsachen unabhängig davon, ob sie wirklich unseren Bedürfnissen dienen, und ohne Rücksicht auf die Bedürfnisse anderer. Wir setzen die Energie des Atoms frei und nutzen sie, um Systeme anzutreiben, die unsere Bedürfnisse befriedigen. Wir leiten Elektronenströme in integrierte Schaltkreise und verwenden die Schaltkreise, um die Technologien zu beherrschen, die unseren Anforderungen an Kommunikation und Information dienen. Wir spielen im globalen Spielzeugladen ohne Rücksicht auf die Folgen für andere und für den gesamten Laden. Dies ist ein kurzsichtiges und gefährliches Verhalten. Ihre unvorhergesehenen „Nebenwirkungen“ sind zu einer Bedrohung für alles Leben auf dem Planeten geworden, einschließlich unseres eigenen. -/- Vorwärts gehen. -/- Wir sind an der Schwelle des vierten Urknalls angekommen. Es wird eine neue Phase in der Amtszeit der Menschheit auf dem Planeten auslösen und nicht das Ende dieser Amtszeit. Es ist an der Zeit, die Lehren aus der Geschichte zu ziehen – zurückzublicken, um nach vorne zu sehen. Das Überleben einer fortgeschrittenen Spezies und die Zukunft des Lebensnetzes auf diesem Planeten liegt in unseren Händen. Noch nie waren so viele von der Weisheit so weniger abhängig. Wir müssen erwachen – um erwachsen zu werden. Die Kraft des Bewusstseins zu nutzen, die in unseren Händen liegt. I defend social media’s potential to support Aristotelian virtue friendship against a variety of objections. I begin with Aristotle’s claim that the foundation of the best friendships is a shared life. Friends share the distinctively human and valuable components of their lives, especially reasoning together by sharing conversation and thoughts, and communal engagement in valued activities. Although some have charged that shared living is not possible between friends who interact through digital social media, I argue that social media preserves the (...) relevantly human and valuable portions of life, especially reasoning, play, and exchange of ideas. I then consider several criticisms of social media’s potential to host friendships, and refute or weaken the force of these objections, using this conception of a distinctively human shared life. I conclude that we should use the shared life to evaluate features of specific social media and norms for users’ conduct. (shrink)

It is commonly assumed that grounding relations are asymmetric. Here I develop and argue for a theory of metaphysical structure that takes grounding to be nonsymmetric rather than asymmetric. Even without infinite descending chains of dependence, it might be that every entity is grounded in some other entity. Having first addressed an immediate objection to the position under discussion, I introduce two examples of symmetric grounding. I give three arguments for the view that grounding is nonsymmetric (I call this view (...) ‘metaphysical interdependence’). These arguments are: (i) that metaphysical interdependence is the only theory able to reconcile competing intuitions about grounding; (ii) that it is the only theory consistent with both ‘gunk’ and ‘junk’; and (iii) that offers a satisfactory solution to the problem concerning whether or not grounding is itself grounded. Digital records, from chat transcripts to social media posts, are being used to create chatbots that recreate the conversational style of deceased individuals. Some maintain that this is merely a new form of digital memorial, while others argue that they pose a variety of moral hazards. To resolve this, I turn to classical Chinese philosophy to make use of a debate over the ethics of funerals and mourning. This ancient argument includes much of interest for the contemporary issue at hand, (...) including the use of impersonators of the dead to help the bereaved to deal well with their grief. I connect this historical discussion with a modern trend in clinical psychology that reframes therapeutic interventions with bereaved individuals. The trend directs practitioners away from facilitating detachment and toward affirming continuing bonds. I conclude that these chatbots can offer an important source of support to mourners, but also discuss parameters and features of social context that will be important to avoid the moral hazards identified by sceptics. Attempts to elucidate grounding are often made by connecting grounding to metaphysical explanation, but the notion of metaphysical explanation is itself opaque, and has received little attention in the literature. We can appeal to theories of explanation in the philosophy of science to give us a characterization of metaphysical explanation, but this reveals a tension between three theses: that grounding relations are objective and mind-independent; that there are pragmatic elements to metaphysical explanation; and that grounding and metaphysical explanation share a (...) close connection. Holding fixed the mind-independence of grounding, I show that neither horn of the resultant dilemma can be blunted. Consequently, we should reject the assumption that grounding relations are mind-independent. (shrink)

Ludwig Wittgenstein, one of the most influential philosophers of the 20th century, made significant contributions to the philosophy of language. His work is often divided into two periods: early and later Wittgenstein. The concept of the logic of language is central to both, though his understanding of it evolved significantly over time. Wittgenstein's exploration of the logic of language fundamentally reshaped our understanding of how language relates to the world. His early work provided a foundation for logical positivism and analytic (...) philosophy, while his later work opened new avenues for understanding the complexities of human communication. Together, these contributions offer a rich and nuanced perspective on the nature of language, meaning, and human interaction. In his early work, the "Tractatus Logico-Philosophicus," Wittgenstein aimed to establish a clear relationship between language and reality. He believed that language mirrors the world through logical structures, which he referred to as "logical form." According to early Wittgenstein, the world consists of facts, not things, and language's primary function is to represent these facts. Wittgenstein’s "Philosophical Investigations" presents a radical shift from his earlier work and offers a deep and nuanced understanding of language and its role in human life. By focusing on the practical uses of language and the various contexts in which it operates, Wittgenstein dissolves many traditional philosophical problems and opens up new ways of thinking about meaning, communication, and the nature of reality. Caregiving robots are often lauded for their potential to assist with geriatric care. While seniors can be wise and mature, possessing valuable life experience, they can also present a variety of ethical challenges, from prevalence of racism and sexism, to troubled relationships, histories of abusive behavior, and aggression, mood swings and impulsive behavior associated with cognitive decline. I draw on Confucian ethics, especially the concept of filial piety, to address these issues. Confucian scholars have developed a rich set of theoretical (...) resources for dealing with beloved but imperfect elders, and navigating the challenges of supporting seniors whose ethical commitments are unreliable. These resources provide a way to reconcile two important but conflicting desiderata: to value and care for seniors, but also to clear-mindedly deal with their moral shortcomings. In particular, they articulate a duty to remonstrate with our elders when they err. Confucian filial piety can helpfully inform robot design and use in geriatric care. They can be used to strengthen and protect emotional connections in important relationships, but should not be used to reinforce patient preferences when doing so damages relationships or their ability to act morally. Rather than conceive of patient wellbeing as in tension with moral behavior, and care as a burden for caregivers, not a source of value and meaning, Confucian accounts of filial piety help identify both new areas of concern and new potential in the development of caregiving technologies, ones which see these goods as complementary. Albert Camus, a French-Algerian writer and philosopher, is renowned for his unique contribution to the philosophical realm, particularly through his exploration of the Absurd. His philosophy is often associated with existentialism, despite his own rejection of the label. Camus’ works delve into the human condition and the search for meaning in a seemingly indifferent universe. The Absurd and the Search for Meaning At the heart of Camus’ philosophy is the concept of the Absurd, which arises from the conflict between the (...) human desire for significance, order, and clarity on one hand, and the silent, irrational, and indifferent world on the other1. This tension is a fundamental aspect of the human experience, as individuals continually seek purpose in life despite the universe’s lack of inherent meaning. Revolt as a Response to the Absurd Camus argues that the appropriate response to the Absurd is not suicide or despair, but rather revolt. This revolt is a persistent and courageous confrontation with the Absurd, and it involves a refusal to succumb to nihilism, a rejection of false hopes, and the continuous quest for meaning1. It is through this act of revolt that individuals affirm their own existence and derive a sense of personal freedom and identity. Camus’ Literary Expression of Philosophy Camus’ philosophical ideas are intricately woven into his literary works. Novels such as “The Stranger” (L’Étranger), “The Plague” (La Peste), and “The Fall” (La Chute) not only tell compelling stories but also serve as vehicles for his philosophical thought. In “The Myth of Sisyphus,” Camus uses the Greek mythological figure Sisyphus, condemned to eternally roll a boulder up a hill only for it to roll back down, as a metaphor for the human condition. Sisyphus, aware of his futile task, chooses to embrace his labor, thus embodying the spirit of revolt and finding happiness in the struggle itself. -/- . (shrink)

Must the best friends necessarily be good people? On the one hand, as Aristotle puts it, ‘people think that the same people are good and also friends’. But on the other hand, friendship sometimes seems to require that one behave badly. For example, a normally honest person might lie to corroborate a friend's story. What I will call closeness, which I take to include sensitivity to friends' subjective values and concerns as well as an inclination to take their subjective interests (...) as reasons for action, is characteristic of friendship. But this seems to require that good friends should be morally flexible, more so than is compatible with a virtuous character. This would imply tension between ideals of friendship and ideals of character. But there is an important connection between virtue and friendship which arises precisely from friends' closeness, when concern for wellbeing, another important feature of friendship, is also taken into account. This helps mitigate the tension and shows how friendship and virtue are interconnected. The connection in turn provides friendship-based reason to think the best friends must be good people, even though concerns of friendship may occasionally clash with other moral concerns. (shrink)

The status and functioning of shame is contested in moral psychology. In much of anglophone philosophy and psychology, it is presumed to be largely destructive, while in Confucian philosophy and many East Asian communities, it is positively associated with moral development. Recent work in human-robot interaction offers a unique opportunity to investigate how shame functions while controlling for confounding variables of interpersonal interaction. One research program suggests a Confucian strategy for using robots to rebuke participants, but results from experiments with (...) educational technologies imply a different and potentially opposing account of shame’s role in personal development. By digging deeper into the details of Confucian theorizing about shame, I identify a unifying explanation for these apparently conflicting results. I conclude by offering suggestions for future empirical research in human-robot interactions to further investigate shame’s role in moral development. (shrink)

There are two basic views concerning the relationship between constitutional rights and proportionality analysis. The first maintains that there exists a necessary connection between constitutional rights and proportionality, the second argues that the question of whether constitutional rights and proportionality are connected depends on what the framers of the constitution have actually decided, that is, on positive law. The first thesis may be termed ‘necessity thesis’, the second ‘contingency thesis’. According to the necessity thesis, the legitimacy of proportionality analysis is (...) a question of the nature of constitutional rights, according to the contingency thesis, it is a question of interpretation. This paper explores a middle way between realism and eliminativism about grounding. Grounding-talk is intelligible and useful, but it fails to pick out grounding relations that exist or obtain in reality. Instead, grounding-talk allows us to convey facts about what metaphysically explains what, and about the worldly dependence relations that give rise to those explanations.

Feminized AIs designed for in-home verbal assistance are often subjected to gendered verbal abuse by their users. I survey a variety of features contributing to this phenomenon—from financial incentives for businesses to build products likely to provoke gendered abuse, to the impact of such behavior on household members—and identify a potential worry for attempts to criticize the phenomenon; while critics may be tempted to argue that engaging in gendered abuse of AI increases the chances that one will direct this abuse (...) toward human beings, the recent history of attempts to connect video game violence to real-world aggression suggests that things may not be so simple. I turn to Confucian discussions of the role of ritualized social interactions both to better understand the roots of the problem and to investigate potential strategies for improvement, given a complex interplay between designers and device users. I argue that designers must grapple with the entrenched sexism in our society, at the expense of “smooth” and “seamless” user interfaces, in order to intentionally disrupt entrenched but harmful patterns of interaction, but that doing so is both consistent with and recommended by Confucian accounts of social rituals. The perfectly natural properties and relations are special—they are all and only those that "carve nature at its joints." They act as reference magnets, form a minimal supervenience base, figure in fundamental physics and in the laws of nature, and never divide duplicates within or between worlds. If the perfectly natural properties are the (metaphysically) important ones, we should expect being a perfectly natural property to itself be one of the (perfectly) natural properties. Zhuangzi suggests that death is a transformation that we commonly and mistakenly think means the end of someone but really just marks a new phase of existence. This metaphysical thesis is presented at several points in the text as an explanation of distinctively Daoist responses to death and loss. Some take a Daoist response to death, as presented by Zhuangzi, to indicate dual perspectives on friendship and death. But I argue that the metaphysical view sketched above is consistent with a (...) unified perspective, allowing the Daoist to enjoy deep friendships without risking some potential for grief typically associated with strong attachment. However, it leaves the Daoist best suited to friendships with those who endorse the same metaphysics. Furthermore, while the grief associated with the death of a friend is somewhat mitigated, the Daoist has reason to mourn even given this thesis. (shrink)

The use of AI algorithms in criminal trials has been the subject of very lively ethical and legal debates recently. While there are concerns over the lack of accuracy and the harmful biases that certain algorithms display, new algorithms seem more promising and might lead to more accurate legal decisions. Algorithms seem especially relevant for bail decisions, because such decisions involve statistical data to which human reasoners struggle to give adequate weight. While getting the right legal outcome is a strong (...) desideratum of criminal trials, advocates of the relational theory of procedural justice give us good reason to think that fairness and perceived fairness of legal procedures have a value that is independent from the outcome. According to this literature, one key aspect of fairness is trustworthiness. In this paper, I argue that using certain algorithms to assist bail decisions could increase three diferent aspects of judges’ trustworthiness: (1) actual trustworthiness, (2) rich trustworthiness, and (3) perceived trustworthiness. The reason for physics’ failure to find a final theory of the universe is examined. Problems identified are: the lack of unequivocal definitions for its fundamental elements (time, length, mass, electric charge, energy, work, matter-waves); the danger of relying too much on mathematics for solutions; especially as philosophical arguments conclude the universe cannot have a mathematical basis. It does not even need the concept of number to exist. Numbers and mathematics are human inventions arising from the human predilection for measurement. (...) Following Aristotle, a single fundamental cause is proposed to explore the efficacy of using pure non-mathematical philosophy to explain the universe, contrary to current quantum physical views. The cause is taken as Time, which is then defined, surprisingly leading automatically to a definition of a three-dimensional space answering the question into what can a universe be placed (space before space seems non-sensical). This enables the philosophical arguments to derive a universal rule giving clear-cut descriptions (definitions) of force (both gravitational and electromagnetic), motion, energy, and particles. The formation of atomic nuclei and atomic properties together with an unexpected role for neutrinos follow. In particular, a Popper-test can be prepared by introducing the concept of measurement to allow the philosophy arguments to be tested in another discipline - mathematics. The solution agrees with human physical observations to a remarkable degree of accuracy, automatically explaining and predicting values for Planck’s and the fine-structure constants. Although mathematical, it is included as confirming the efficacy of philosophy in attaining a final theory. (shrink)

Proprioception, a sense of bodily position and movement, is rarely the focus of conscious experience. If we are ordinarily conscious of proprioception, we seem only peripherally so. Thus, evidence that proprioception is present in the periphery of at least some conscious experiences seems to be good evidence that conscious experience is fairly rich. Anosognosia for paralysis is a denial of paralysis of one's limbs, usually in the wake of brain damage from stroke. Because anosognosic patients overlook their paralysis, anosognosia seems (...) be a counter-example to the claim that proprioception exists in the periphery of conscious experience. However, careful consideration of the data shows that anosognosia makes a poor counterexample to a rich theory of consciousness. Thus, we retain reason to believe that proprioception exists in the periphery of conscious experience, and so to conclude that conscious experience is relatively rich. (shrink)

Greatly aided by an information age in which protesting laborers in a remote offshore outpost can capture front page headlines around the globe, theSarbanes-Oxley Act of 2002 (SARBOX) has made corporate transparency the linchpin for good corporate governance. Under a SARBOX-enhancedregulatory framework, publicly traded corporations are required to rapidly disclose material changes in their financial conditions or operations—changes such as impairments to goodwill, a trademark, or some other intangible corporate asset. Especially challenging for multinational corporations (MNCs) with far-flung corporate empires (...) is the need to stay abreast of the ebb and flow of goodwill, at a time when transnational human rights groups are aggressively mobilizing world opinion against the sweatshop labor conditions that abound at the offshore production sites favored by MNCs. The author explains why the convergence of a digital age of free-flowing information and the advent of SARBOX, a legislative enactment of paraenetic design, is causing the boards of MNCs to more critically evaluate the long-term costs of their offshore operations. Despite the initial promise of social media platforms as a means of facilitating discourse on matters of civic discourse, in practice it has turned out to impair fruitful conversation on civic issues by a number of means. From self-isolation into echo chambers, to algorithmically supported filter bubbles, to widespread failure to engage politically owing to psychological phenomena like the ‘spiral of silence’, a variety of factors have been blamed. I argue that extant accounts overlook the importance of interpersonal relationships to (...) sustaining quality civic discourse on social media. Drawing on an Aristotelian account of friendship with an emphasis on the value of interpersonal difference plus the influence of interactions on individual character, I argue that a common scapegoat for the failure of civic discourse online—the variety of “unfriend” disconnection tools offered on various platforms—actually show promise at promoting better-quality civic conversation and overcoming the obstacles present on social media platforms. Teaching a compulsory, large-scale Philosophy of Economics (PoE) course to economics students presents distinct challenges. Instructors face a heterogeneous student body with varying levels of interest in the topics, diverse occupational goals and a limited philosophical background. Unlike elective courses, for which students self-select based on interest, a compulsory course entails motivating disengaged students and managing their expectations. We put forward the case for a student-oriented approach to teaching PoE, emphasising four key strategies: recognising students’ limited philosophical knowledge, demonstrating the (...) relevance of PoE to their professional and personal lives, using real-world problems to engage them and avoiding the oversimplification of topics. We argue that PoE instruction should account for the distinct characteristics of economics students, moving beyond a supply-driven approach. Our suggestions aim to enhance student engagement and provide practical guidance for instructors navigating the challenges of teaching PoE at scale. (shrink)

In Gaudium et Spes, the Catholic Church describes marital discernment as the married couple’s “common reflection and effort… [that] involves a consideration of their own good and the good of their children” and also as “an estimation of the good of the family… [that necessitates] prudent reflection and common decision.” With this description, we can say that the Catholic Church expects and desires married couples to resolve marital and family conflicts by coming together in discernment. And yet, how should married (...) couples discern? How should they exercise marital discernment? Since one cannot just go on discerning blindly without minding some rules, without following some basic steps, Ricoeur would emphasize that “discernment calls for a hermeneutics.” But how should hermeneutics be integrated into the process of marital discernment? This paper makes an attempt to integrate hermeneutics into the process of marital discernment by drawing some key principles from Paul Ricoeur’s hermeneutic phenomenology and Karol Wojtyła’s phenomenology of spousal love. In so doing, this paper considers how the dynamics of marital discernment can be rendered more balanced, and hence more effective, in attaining conflict resolution within the family. (shrink)

This paper asks whether a Nietzschean defense of the Christian valuation of human life is tenable. Nietzsche has long been noted for his anti-Christian stance in his writings. Despite his candid revulsion and antipathy towards Christianity, however, there are scholars who argue that Nietzsche is a “Christian,” because we can actually find a good number of Nietzschean ideas that coincide with the teachings of the Christian faith. Foremost of these ideas is Nietzsche’s insistence that life must be affirmed and valued (...) at all times — a position that perfectly resonates with the Christian doctrine on the value of human life. For this reason, in this paper, I aim to examine whether a Nietzschean defense of the Christian valuation of human life is tenable, given that Nietzsche’s writings abound with direct and scathing attacks against Christianity. El presente artículo analiza la etapa denominada arqueológica de Michel Foucault. Puntualizando principalmente cómo en esta etapa es entendido el concepto de libertad desde la noción foucaultiana de discurso. Se aborda, en este sentido, la etapa arqueológica de Foucault desde tres áreas. La primera, nos habla de cómo se erige lo diferente, lo anormal. La segunda, expone cómo se construye lo aparente, lo indiscutible. Por último, a partir de un marco teórico previamente expuesto, reflexionamos respecto del concepto de libertad.

Many academics and researchers who publish scholarly articles on Plato’s philosophy of education claim that the ultimate educational goal for Plato is simply the acquisition of virtues. While such a claim may not be entirely incorrect, it is nevertheless substantially wanting; for although the acquisition of virtue is no doubt paramount, for Plato it primarily serves as a means to another end. In this paper, I aim to show that, for Plato, the final summit of all educational enterprise is not (...) really to become virtuous but rather to attain the state of becoming like God, and that is, homoiōsis theōi. -/- . The contemporary philosophy of science (epistemology) featuring K.Popper, T.Kuhn, I.Lakatos, P.Feyerabend, Hanson among others, has exercised a decisive critique to the dominant views of the positivist and neo-positivist model of knowledge and has in fact undermined its credibility.

Prvo drži da postoji nužna veza između ustavnih prava i proporcionalnosti; drugo tvrdi da pitanje o tome da li su ustavna prava i proporcionalnost povezani zavisi od toga šta su ustavotvorci zapravo odlučili, tj. zavisi od pozitivnog prava. Prva teza se može označiti kao “teza o nužnosti”, druga se može označiti kao “teza o kontingentnosti.” Prema tezi o nužnosti, legitimnost proporcionalnosti je pitanje prirode ustavnih prava, dok je prema tezi (...) o kontingentnosti legitimnost proporcionalnosti pitanje tumačenja.
