Scientific inquiry takes onward course from the point where previous scientists had reached. But philosophical analysis initiates from scratch. Philosophy questions everything and chooses starting point for itself after having ruled out all the unsubstantiated and doubtful elements of the topic under study. Secondly, known realities must make sense. If a theory is officially 'counterintuitive', then either it is mere fiction or at the most; a distorted form of truth. This book's analysis is based on the philosophical principle that knowledge (...) is empirical and does not arise magically in absence of observational grounds. With philosophical approach, it was doubtful to accept that Georges Lemaître already knew Hubble's law in year 1927 that was yet to be found by Edwin Hubble in year 1929. Therefore this book started with denial of the claim that Lemaître already knew this law. But analysis of section I.III forced author to look the matter from original source and it came to surface that Lemaître knew this law in year 1927. But contrary to mainstream claim, Lemaître had not derived that law from general relativity (GR) equations rather had deduced from a method given by Hubble himself. Whereas whole case of the Big Bang Theory rests on misleading claim that Lemaître had derived this law solely from GR equations. The basis of this claim happened to be a manipulated translation (1931) of Lemaître's original 1927 article. People regard Big Bang Theory as truth because authoritative sources deceived them by presenting a manipulated translation in year 1931. This book is a philosophical analysis of original papers of Alexander Friedmann (1922), Georges Lemaître (1927), Edwin Hubble (1929) and Albert Einstein (1917) thus covers actual roots and origins of the Big Bang Model. In this book, only the core elements of the Big Bang Model i.e. 'Expansion of Universe' and 'CMBR' are covered. It has been sufficiently shown that 'expansion' is an illusion whereas CMBR is a proof that we live in a non-expanding infinite universe. If these two core elements of the standard Big Bang Model are precisely refuted then there is nothing crucial left with the standard model. For readers of this book at least, Big Bang Theory shall become a story of past mistakes. Author is not an authoritative source on science topics therefore readers must download all the above mentioned original papers and check all the points outlined in this book from relevant original papers. Unlike reading from an authoritative source that makes readers relaxed and careless but enables authorities to deceive them in worst way possible, this book requires readers to remain alert on all the points discussed in the book and verify everything from original sources whose links are given at the end of this description and also provided in footnotes section of the book. This book is not a judgment of the topic rather it is like a case presented by an advocate while readers are the judges. Readers are required to apply their own critical judgment to conclude the matter by themselves. In this paper I propose an interpretation of classical statistical mechanics that centers on taking seriously the idea that probability measures represent complete states of statistical mechanical systems. I show how this leads naturally to the idea that the stochasticity of statistical mechanics is associated directly with the observables of the theory rather than with the microstates (as traditional accounts would have it). The usual assumption that microstates are representationally significant in the theory is therefore dispensable, a consequence which (...) suggests interesting possibilities for developing non-equilibrium statistical mechanics and investigating inter-theoretic answers to the foundational questions of statistical mechanics. This essay analyzes two diverse interpretations of Christian love in the writings of Søren Kierkegaard and Josiah Royce. Through the comparison of these two positions, I attempt to show not only the embeddedness of a conception of love in an entire theological vision but its usefulness as a lens for examining that position. I argue that Kierkegaard's interpretation of love tends to foster social inequality, a tendency rooted in his basic ontology. The Roycean view of love, resting upon a (...) radically different ontology, avoids such problematic ethical implications. (shrink)

Philosophers, and students of philosophy, are often advised to interpret other philosophers charitably. In this paper, I present an alternative to interpreting charitably. I call it “the simple-model technique” and use H.L.A. Hart responding to John Rawls to illustrate it.

The Schwarzschild solution (Schwarzschild, 1915/16) to Einstein’s General Theory of Relativity (GTR) is accepted in theoretical physics as the unique solution to GTR for a central-mass system. In this paper I propose an alternative solution to GTR, and argue it is both logically consistent and empirically realistic as a theory of gravity. This solution is here called K-gravity. The introduction explains the basic concept. The central sections go through the technical detail, defining the basic solution for the geometric tensor, (...) the Christoffel symbols, Ricci tensor, Ricci scalar, Einstein tensor, stress-energy tensor and density-pressure for the system. The density is integrated, and some consistency properties are demonstrated. A notable feature is the disappearance of the event horizon singularity, i.e. there are no black holes. So far this is for a single central mass. A generalization of the solution for multiple masses is then proposed. This is required to support K-gravity as a viable general interpretation of gravity. Then the question of empirical tests is discussed. It is argued that current observational data is almost but not quite sufficient to verify or falsify K-gravity. The Pioneer spacecraft trajectory data is of particular interest, as this is capable of providing a test; but the data (which originally showed anomalies that match K-gravity) is now uncertain. A new and very practical experiment is proposed to settle the matter. This would provide a novel test of GTR, and a novel test of the cause of the Pioneer anomalies. In conclusion, K-gravity has extensive ramifications for gravitational physics and for the philosophy of GTR and space-time. (shrink)

In a beautiful recent essay, the philosopher Walter Sinnott-Armstrong explains the reasons for his departure from evangelical Christianity, the religious culture in which he was brought up. Sinnot-Armstrong contrasts the interpretive methods used by good philosophers and fundamentalist believers: Good philosophers face objections and uncertainties. They follow where arguments lead, even when their conclusions are surprising and disturbing. Intellectual honesty is also required of scholars who interpret philosophical texts. If I had distorted Kant’s view to make him reach a conclusion (...) that I preferred, then my philosophy professor would have failed me. The contrast with religious reasoning is stark. My Christian friends seemed happy to hide serious problems in the Bible and in their arguments. They preferred comfort to intellectual honesty. I couldn’t. To what extent can we, historians of philosophy, claim the virtue of intellectual honesty? Speaking frankly, I do not find the practice criticized by Sinnot-Armstrong’s philosophy professor rare or unusual at all. We very frequently distort the views of past philosophers in order to reach the conclusions we prefer. We just call it “Charitable Interpretation.” In this essay, I discuss and criticize the logic behind so-called charitable interpretations in the history of philosophy. This phenomenon is ubiquitous and is not at all restricted to a particular philosophical strand or ideology. Analytic philosophers and post-modernists, Marxists, liberals, secularists, and fundamentalists, we all engage in the very same domestication project. Even more disturbing than the sheer ideological pervasiveness of this phenomenon is the fact that, on many occasions, superb philosophers and historians take part in this fairly childish endeavor. In the first part of this essay, I discuss the general logic of charitable interpretations in the history of philosophy, mostly by addressing discussions in metaphysics and epistemology. In the second part, I focus on the somewhat less noticed use of charitable interpretations in the study of political philosophy, and point out the quintessential role ideology plays in these discussions. In both parts, I concentrate mostly on the interpretation of Spinoza’s thought. I do so not because I have special fondness for Spinoza (“guilty as charged,” I admit), but because Spinoza is such a beast (and may I add, an enchanting beast) and attracts a disproportionate share of the domestication efforts from historians and philosophers of all creeds and persuasions. In the third and final part of the paper, I will begin to outline an alternative methodology, which suggests that past philosophers can be most relevant to our current philosophical discussion, to the extent that they provide us with well-motivated challenges to our common-sense beliefs. Such challenges have the invaluable virtue of being able to undermine our most fundamental and secure beliefs, and force us to engage with the most fundamental questions. This is a defense of Kant against the allegedly neglected alternative in his formulation of transcendental idealism. What sets it apart from the contributions of others who have spoken for Kant in this regard is the construction of a general interpretive framework — a reconstruction of the one Kant provides for transcendental idealism — as opposed to the development of an ad hoc defensive strategy for refuting the charges. Hence, comprehensive clarification instead of pointed rebuttal. The difference is between (...) focusing on the text and focusing on the problem. No doubt, doing both is not only possible but also required, as the problem is supposed to be in the text, but the point is that it is not there, and further, that we need not go anywhere else to show that it is not there. Thus, the approach is constructive rather than defensive, or more accurately, constructive as well as defensive. And the construction rests on what Kant actually said rather than on what he might have meant or on what he should have said instead. (shrink)

In this paper, I discuss Hud Hudson's compatibilistic interpretation of Kant's theory of free will, which is based on Davidson's anomalous monism. I sketch an alternative interpretation of my own, an incompatibilistic interpretation according to which agents qua noumena are responsible for the particular causal laws which determine the actions of agents qua phenomena. Hudson's interpretation should be attractive to philosophers who value Kant's epistemology and ethics, but insist on a deflationary reading of things in (...) themselves. It is in an incompatibilist interpretation of Kant's theory of free will that a "positive" conception of noumena is at its most important. If a compatibilistic interpretation is acceptable, one might suppose that we can do without a "positive" conception of noumena throughout Kant's philosophy. I demonstrate, however, that there are central elements of Kant's theory of free will that cannot be accommodated within Hudson's interpretation. (shrink)

In a previous paper we outlined a series of historical touchpoints between classical aether theories and modern theoretical physics which showed a shared conceptual lineage for the modern tools and methods of the most common interpretations and fluid based “Hydrodynamic” treatments of an electromagnetic medium. It was proposed that, though the weight of modern experimentation leaves an extremely narrow and convoluted window for even a reconceptualization of a medium, all of modern physics recognizes a plethora of behaviors and attributes for (...) free space and these physics are interchangeable with modern methods for treating superfluid-like continuums. Thus the mathematical equivalence of the methods do not comprise alternative physics but an alternative interpretation of the same physics. Though many individual components describing a “neo-aether” or “quintessence” are available, an overarching structural outline of how these tools can work together to provide an alternative working overview of modern physics has remained undefined. This paper will propose a set of introductory concepts in the first outline of a toy model which will later connect the alternative tools and conceptualizations with their modern counterparts. This introductory paper provides the simpler “100-miles out” overview of the whole of physics from this perspective, in an easily comprehensible, familiar and intuitive, informal dialog fashion. While this paper grants the largest and loosest introductory overview, subsequent papers in this series will address the finite connections between modern physics and this hydrodynamic view. In this paper, I develop a quasi-transcendental argument to justify Kant’s infamous claim “man is evil by nature.” The cornerstone of my reconstruction lies in drawing a systematic distinction between the seemingly identical concepts of “evil disposition” (böseGesinnung) and “propensity to evil” (Hang zumBösen). The former, I argue, Kant reserves to describe the fundamental moral outlook of a single individual; the latter, the moral orientation of the whole species. Moreover, the appellative “evil” ranges over two different types of moral failure: (...) while an “evil disposition” is a failure to realize the good (i.e., to adopt the motive of duty as limiting condition for all one’s desires), an “evil propensity” is a failure to realize the highest good (i.e., to engage in the collective project of transforming the legal order into an ethical community). This correlation between units of moral analysis and types of obligation suggests a way to offer a deduction of the universal propensity on behalf of Kant. It consists in tracing the source of radical evil to the same subjective necessity that gives rise to the doctrine of the highest good. For, at the basis of Kant’s two doctrines lies the same natural dialectic between happiness and morality. While the highest good brings about the critically acceptable resolution of this dialectic, the propensity to evil perpetuates and aggravates it. Instead of connecting happiness and morality in an objective relation, the human will subordinatesmorality to the pursuit of happiness according to the subjective order of association. If this reading is correct, it would explain why prior attempts at a transcendental deduction have failed: interpreters have looked for the key to the deduction in the body of Kant’s text, where it is not to be found, for it is tucked, instead, in the Preface to the first edition. In “Radical Interpretation” (1974), David Lewis asked: by what constraints, and to what extent, do the non-intentional, physical facts about Karl determine the intentional facts about him? There are two popular approaches: the reductive externalist program and the phenomenal intentionality program. I argue against both approaches. Then I sketch an alternative multistage account incorporating ideas from both camps. If we start with Karl's conscious experiences, we can appeal to Lewisian ideas to explain his other intentional states. We put forward a new, ‘coherentist’ account of quantum entanglement, according to which entangled systems are characterized by symmetric relations of ontological dependence among the component particles. We compare this coherentist viewpoint with the two most popular alternatives currently on offer—structuralism and holism—and argue that it is essentially different from, and preferable to, both. In the course of this article, we point out how coherentism might be extended beyond the case of entanglement and further articulated.

Jonathan Lear argues that the established purgation, purification, and cognitive stimulation interpretations of Aristotle’s concepts of catharsis and tragic pleasure are off the mark. In response, Lear defends an anti-cognitivist account, arguing that it is the pleasure associated with imaginatively “living life to the full” and yet hazarding nothing of importance that captures Aristotle’s understanding of catharsis and tragic pleasure. This analysis reveals that Aristotle’s account of imagination in conjunction with his understanding of both specific intellectual virtues and rational emotions (...) of an educated citizen not only tells against Lear’s anti-cognitivist construal, but also divulges an alternative cognitive stimulation reading. In Nicomachean Ethics 1. 7, Aristotle gives a definition of the human good, and he does so by means of the “ ergon argument.” I clear the way for a new interpretation of this argument by arguing that Aristotle does not think that the ergon of something is always the proper activity of that thing. Though he has a single concept of an ergon, Aristotle identifies the ergon of an X as an activity in some cases but a product (...) in others, depending on the sort of thing the X is—for while the ergon of the eye is seeing, the ergon of a sculptor is a sculpture. This alternative interpretation of Aristotle’s concept of an ergon allows the key explanatory middle term of the ergon argument to be what, I argue, it ought to be: “the best achievement of a human.”. We present an alternative to the Copenhagen interpretation of the formalism of nonrelativistic quantum mechanics. The basic difference is that the new inter- pretation is formulated in the language of epistemological realism. It involves a change in some basic physical concepts. Elementary particles are considered as extended objects and nonlocal effects are included. The role of the new concepts in the problems of measurement and of the Einstein-Podolsky-Rosen correlations is described. In a recent work, Walter Carnielli and Abilio Rodrigues present an epistemically motivated interpretation of paraconsistent logic. In their view, when there is conflicting evidence with regard to a proposition A (i.e. when there is both evidence in favor of A and evidence in favor of ￢A) both A and ￢A should be accepted without thereby accepting any proposition B whatsoever. Hence, reasoning within their system intends to mirror, and thus, should be constrained by, the way in which we (...) reason about evidence. In this article we will thoroughly discuss their position and suggest some ways in which this project can be further developed. The aim of the paper is twofold. On the one hand, we will present some philosophical critiques to the specific epistemic interpretation of paraconsistent logic proposed by Carnielli & Rodrigues. First, we will contend that Carnielli & Rodrigues’s interpretation implies a thesis about what evidence rationally justifies to accept or believe, called Extreme Permissivism, which is controversial among epistemologists. Second, we will argue that what agents should do, from an epistemic point of view, when faced with conflicting evidence, is to suspend judgment. On the other hand, despite these criticisms we do not believe that the epistemological motivation put forward by Carnielli & Rodrigues is entirely wrong. In the last section, we offer an alternative way in which one might account for the epistemic rationality of accepting contradictions and, thus, for an epistemic understanding of paraconsistency, which leads us to discuss the notion of diachronic epistemic rationality. This paper connects the hard problem of consciousness to the interpretation of quantum mechanics. It shows that constitutive Russellian pan(proto)psychism (CRP) is compatible with Everett’s relative-state (RS) interpretation. Despite targeting different problems, CRP and RS are related, for they both establish symmetry between micro- and macrosystems, and both call for a deflationary account of Subject. The paper starts from formal arguments that demonstrate the incompatibility of CRP with alternative interpretations of quantum mechanics, followed by showing that RS (...) entails Russellian pan(proto)psychism. Therefore, CRP and RS are mutually supportive. It then provides a unified ontological picture by combining CRP and RS. The challenge faced by CRP, the combination problem, can be resolved by adopting a RS version of quantum mechanics. Technically, this is achieved by a co-consciousness relation capable of explaining the difference between first-person and third-person perspectives. The hierarchical structure of the relation removes any concern on the structural mismatch between the physical and the phenomenal. (shrink)

Standard interpretations of Descartes' work, especially those inspired by analytic philosophy, assume the syllogism and Principia Mathematica's artificial language are appropriate tools for interpreting Cartesianism, particularly the ontological argument. The dissertation shows technical problems arise when those logics are used for that purpose. An intentianal interpretation along Meinongian lines is proposed, as an alternative to deductive exegeses. This interpretation is developed after arguing that Russell did not identify what I call "the epistemic use" of Meinong's theory of (...) objects. The proposed interpretation is nonlogical in the sense that intentionality alone, not deductive arguments, explains the cogito and res cogitans' belief in god's existence. God is the only one of res cogitan's intentionalia in which existence is analytically included; thus, there is no need for an ontological argument. Such an interpretation is consistent with Descartes' rejection of syllogistics as a truth-discovering tool and provides a framework to evaluate Cartesianism and Kant's criticism of it. Moreover, some problems afflicting logico-deductive readings cannot arise in this interpretation. (shrink)

This article re-examines the theoretical basis for environmental and heritage interpretation in tourist settings in the light of hermeneutic philosophy. It notes that the pioneering vision of heritage interpretation formulated by Freeman Tilden envisaged a broadly educational, ethically informed and transformative art. By contrast, current cognitive psychological attempts to reduce interpretation to the monological transmission of information, targeting universal but individuated cognitive structures, are found to be wanting. Despite growing signs of diversity, this information processing approach to (...) interpretation remains dominant. The article then presents the alternative paradigm of hermeneutics through the works of Schleiermacher, Dilthey, Heidegger and Gadamer, to provide a broader interpretation of interpretation. This not only captures the essence of Tilden’s definition but construes heritage interpretation as a more inclusive, culturally situated, critically reflexive and dialogical practice. (shrink)

The chapter considers two semantic issues concerning will-sentences: Stalnaker’s Asymmetry and modal subordination in Karttunen-type discourses. The former points to a distinction between will and modal verbs, seeming to show that will does not license non-specific indefinites. The latter, conversely, suggests that will-sentences involve some kind of modality. To account for the data, the chapter proposes that will is semantically a tense, hence it doesn’t contribute a quantifier over modal alternatives; a modal feature, however, is introduced in the interpretation (...) of a will-sentence through a supervaluational strategy universally quantifying over possible futures. That this is not part of will’s lexical semantics is shown to have consequences that ultimately contribute to explain Stalnaker’s Asymmetry. Furthermore, that a modal quantification is present in the interpretation of a will-sentence is shown to imply the availability of modal subordination in Karttunen-type discourses. (shrink)

Context is a concept used by philosophers and scientists with many different definitions. Since Dummett we speak of "context principle" in Frege and Wittgenstein: "an expression has a meaning only in the context of a sentence". The context principle finds an extension in some of Wittgenstein's ideas, especially in his famous passage where he says that "to understand a sentence is to understand a language". Given that Wittgenstein believes that "the" language does not exist but only language games exist, we (...) should conclude that he is speaking of the need to consider any sentence always in the context of a language game1. This general attitude is certainly attuned with the contemporary tendency to place contextual restrictions to the interpretations of our sentences. However we find so many kinds and forms of restrictions that this general attitude is not enough to give us a viable tool to find an order in the web of so many different theories of context. To look for an order or, at least a clarification, we may start with two contrasting paradigms of theories: the "objective" theory of contexts, where context is a set of features of the world, and the "subjective" theories of context, where context is the cognitive background of a speaker or agent in respect to a situation2. We have here not only two different ways of using the term "context" but also two different conceptions of semantics and philosophy. The different conceptions are normally associated, respectively, with the classical paradigm of model theoretic semantics (Kaplan, Lewis Stalnaker) on one hand and with the A.I. paradigm (McCarthy, Buvac, Giunchiglia) on the other hand. For sake of simplicity I will restrict my attention3 mainly to Kaplan 1989 and to McCarthy 1993 and Giunchiglia 1993. After providing a brief overview of the economic theory of judicial decisions this paper presents an argument for why not only the economic theory of judicial decisions, but also the rational approach in general, most often fails in explaining decision-making. Work done within the research program of New Institutionalism is presented as a possible alternative. Within this research program judicial activity is conceptualized as the activity of "interpreting the rules of the game", i.e. the institutions that frame the economic (...) and political interaction in a society. Such a conceptualization of judicial interpretation and judicial decision-making would have to depart from rational choice modes of reasoning, and should instead focus on how human beings actually reason, learn and choose drawing from research in cognitive science. For Anaxagoras, both before the beginning of the world and in the present, “all is together” and “everything is in everything.” Various modern interpretations abound regarding the identity of this “mixture.” It has been explained as an aggregation of particles or as a continuous “fusion” of different sorts of ingredients. However—even though they are not usually recognized as a distinct group—there are a number of other scholars who, without seemingly knowing each other, have offered a different interpreta- tion: Anaxagoras’ mixture (...) as an “interpenetration” of different ingredients, which are as far-extended as the whole mixture is. As a result, there are different entities occupying the same place at the same time. This explanation assigns to Anaxagoras the same model of mixture which was later used by the Stoics. Four different interpretations of measurement are distinguished that are compatible with the formal frame of the representational theory of measurement: (1) the classical interpretation, the additive, (3) the operationalis, (4) the correlative one.

This essay presents an alternative to contemporary substantivalist and relationist interpretations of quantum gravity hypotheses by means of an historical comparison with the ontology of space in the seventeenth century. Utilizing differences in the spatial geometry between the foundational theory and the theory derived from the foundational, in conjunction with nominalism and platonism, it will be argued that there are crucial similarities between seventeenth century and contemporary theories of space, and that these similarities reveal a host of underlying conceptual (...) issues that the substantival/relational dichotomy fails to distinguish. Despite his impressive influence on nineteenth-century philosophy, F. A. Trendelenburg's own philosophy has been largely ignored. However, among Kant scholars, Trendelenburg has always been remembered for his feud with Kuno Fischer over the subjectivity of space and time in Kant's philosophy. The topic of the dispute, now frequently referred to as the ?Neglected Alternative? objection, has become a prominent issue in contemporary discussions and interpretations of Kant's view of space and time. The Neglected Alternative contends that Kant unjustifiably (...) moves from the claim that we have a priori intuitions of space and time to the sceptical conclusion that space and time are exclusively subjective. Most current discussions trace the objection back to Trendelenburg and often use him to motivate the objection. However, to date Trendelenburg's actual arguments and reasons for rejecting the Kantian view of space and time have not been sufficiently uncovered; my goal here is to fill this lacuna. By better understanding what Trendelenburg actually argued, we will be in a better position to assess whether the Neglected Alternative objection against Kant is successful. But in addition, Trendelenburg's own system is of independent philosophical interest, and my work here will shed light on one part of it. (shrink)

Everettian quantum mechanics tells us that the fundamental dynamics of the universe are deterministic. So what are the `probabilities' that the Born rule describes? One popular answer has been to treat these probabilities as rational credences. A recent alternative, Isaac Wilhelm's centered Everett Interpretation (CEI), takes the Born probabilities to be centered chances: the objective chances that some centered propositions are true. Thus, the CEI challenges the `orthodox assumption’ that fundamental physical laws concern only uncentered facts. I provide (...) three arguments against the centered Everett Interpretation. First, I argue that the CEI is in apparent tension with a significant motivation for adopting Everettian quantum mechanics: rejecting the attribution of special significance to observers or agents in fundamental physics. I suggest the CEI can avoid this tension, but only at the cost of sacrificing its central claim that there are objective chances in an Everettian multiverse. My second argument concerns the CEI’s claim that the centered Born rule is a fundamental physical law. I provide two plausible notions of fundamentality for physical laws, and I argue that the centered Born rule satisfies neither. My final argument is that the CEI’s branch-relative laws cannot explain or constrain an agent’s rational credences in the way that the CEI claims. (shrink)

It is widely accepted among medical ethicists that competence is a necessary condition for informed consent. In this view, if a patient is incompetent to make a particular treatment decision, the decision must be based on an advance directive or made by a substitute decision-maker on behalf of the patient. We call this the competence model. According to a recent report of the United Nations (UN) High Commissioner for Human Rights, article 12 of the UN Convention on the Rights of (...) Persons with Disabilities (CRPD) presents a wholesale rejection of the competence model. The High Commissioner here adopts the interpretation of article 12 proposed by the Committee on the Rights of Persons with Disabilities. On this interpretation, CRPD article 12 renders it impermissible to deny persons with mental disabilities the right to make treatment decisions on the basis of impaired decision-making capacity and demands the replacement of all regimes of substitute decision-making by supported decision-making. In this paper, we explicate six adverse consequences of CRPD article 12 for persons with mental disabilities and propose an alternative way forward. By significantly diminishing the role intentions play in communication, in Imagination and Convention Lepore and Stone attempt to overthrow the Gricean paradigm which prevails in the philosophy of language. The approach they propose is attractive to theorists of legal interpretations for many reasons. Primary among these is that the more general dispute in the philosophy of language between Griceans and non-Griceans mirrors the dispute between intentionalists and non-intentionalists in legal interpretation. The ideas proposed in Imagination and Convention naturally support (...) the non-intentionalist camp, which makes them unique in the contemporary philosophy of language.In this paper I argue that despite an almost universal acceptance for the Gricean paradigm in legal interpretation, a strong, externalist approach to language, one in which interpretation is based on conventions, not intentions, better reflects the nature of legal language. The latter functions in societies as a written, public discourse to which many individuals contribute; the number of contributions renders the identification of individual intentions impossible, making it badly suited to a Gricean, intention-based analysis. Lepore and Stone’s discourse-based, non-Gricean alternative provides a better tool for the theorist of legal interpretation to analyse legal language. In what follows, I first present an overview of the disputes in legal interpretation that may be affected by Imagination and Convention. In the second section, I analyze several of Lepore and Stone’s theses and apply them to issues in legal interpretation, paying particular attention to their concept of “direct intentionalism.” In the last section, I outline some proposals for finishing the anti-Gricean revolution, which involves Ruth Millikan’s idea of conventions as lineages. The professional situation is considered a major interface of practicum training, here conceived as a School of conjunction, a school where one learns to make links, a foundation for the engineering of professionalization. The notion of situation is here developed based on the study of a data corpus elaborated during an experience with a practicum training model centred on writing and the construction of the professional situation by a subject-actor-author of the situation, in interaction with others, in the context of (...) nurse training. The analysis and interpretation of data brings to light a complex and unique unit, constructed in the space-time of a professional practice, a process during which several states succeed one another. The critical moment in action characterizes this unit; it is central to the process, mobilizing reflection in action, internal deliberation, and action-related decision. La situation professionnelle est identifiée comme interface majeure de la formation en alternance conçue ici comme une Ecole de la conjonction, une école où l’on apprend à relier, fondement d’une ingénierie de professionnalisation. La notion de situation est approfondie à partir de l’étude d’un corpus de données constitué au fil de l’expérimentation d’un modèle de formation en alternance centrée sur l’écriture et la construction de la situation professionnelle par un sujet-acteur-auteur de la situation, en interaction avec autrui, dans le contexte de la formation en soins infirmiers. In ordinary language, in the medical sciences, and in the overlap between them, we frequently make claims which imply that we might have had different gametic origins from the ones we actually have. Such statements seem intuitively true and coherent. But they counterfactually ascribe different DNA to their referents and therefore contradict material-origin essentialism, which Kripke and his followers argue is intuitively obvious. In this paper I argue, using examples from ordinary language and from philosophy of medicine and bioethics, that (...) statements which attribute alternative material origins to their referents are useful, common in political and medical reasoning, and in many cases best interpreted literally. So we must replace the doctrine of material-origin essentialism with one that can make sense of ordinary discourse and the language of the medical sciences. I propose an anti-essentialist account of such counterfactuals according to which individuals’ modal properties are relative to a given inquiry. (shrink)

Within the context of the Quine–Putnam indispensability argument, one discussion about the status of mathematics is concerned with the ‘Enhanced Indispensability Argument’, which makes explicit in what way mathematics is supposed to be indispensable in science, namely explanatory. If there are genuine mathematical explanations of empirical phenomena, an argument for mathematical platonism could be extracted by using inference to the best explanation. The best explanation of the primeness of the life cycles of Periodical Cicadas is genuinely mathematical, according to Baker (...) :223–238, 2005; Br J Philos Sci 60:611–633, 2009). Furthermore, the result is then also used to strengthen the platonist position :779–793, 2017a). We pick up the circularity problem brought up by Leng Mathematical reasoning, heuristics and the development of mathematics, King’s College Publications, London, pp 167–189, 2005) and Bangu :13–20, 2008). We will argue that Baker’s attempt to solve this problem fails, if Hume’s Principle is analytic. We will also provide the opponent of the Enhanced Indispensability Argument with the so-called ‘interpretability strategy’, which can be used to come up with alternative explanations in case Hume’s Principle is non-analytic. The predominant interpretation of Wittgenstein's later remarks on religion takes him to hold that all religious utterances are non-scientific, and to hold that the way to show that religious utterances are non-scientific is to identify and characterise the grammatical rules governing their use. This paper claims that though this does capture one strand of Wittgenstein's later thought on religion, there is an alternative strand of that thought which is quite different and more nuanced. In this alternative strand (...) Wittgenstein stresses that religious utterances and beliefs can come in both scientific and non-scientific varieties. More than that, he claims that the grammar of religious utterances, and the logic of religious beliefs, is often complex – in that individual utterances and beliefs will often be mixed between, indeterminate between, or fluid between being scientific and being non-scientific. This complexity means that it will often be unhelpful to try to pin down one particular grammar or logic for a given utterance or belief. Wittgenstein therefore suggests a new method of grammatical and logical investigation, which is less likely to distort complex grammars or logics by being overly simplistic or rigid. This method is to use simple examples of utterances and beliefs as objects of comparison, so as to illuminate the different aspects of the more complex actual utterances and beliefs under examination. This alternative strand in Wittgenstein's later remarks on religion is a manifestation of a broader strand of Wittgenstein's later thought as a whole, which was first described by Friedrich Waismann, and later developed by Gordon Baker and Oskari Kuusela. The paper concludes by providing examples of religious beliefs which are logically mixed, indeterminate, and fluid, and showing how simple objects of comparison can be used to illuminate them. The analysis method and paradigm of film have become a controversial topic in the data-driven era. Film, is not only an attractive industry that can achieve filmmakers’ imagination but has become a perfect stimulus to understand human being’s mental activity. The core research in this study is to examine the impact of filmmaking experience and the role of narrative denoters from filmmakers’ construction to audiences’ interpretation. Based on previous studies and integrating cognitive approaches, the thesis re-explores the nature and (...) essence of film and proposes an alternative term - narrative denoter - which can be used as the indication of message exchanging between filmmakers and audiences. Using a released film that has a complete story to do the experiment, this study investigates the relationship between major, film interpretations, event segmentation, and audience’s preference. The result showed that filmmaking experience does not impact the interpretation of film; however the identification of the narrative denoter played an important role in film perception and cognition; apart from these, the audience’s preference did not correlate with film interpretation. With respect to this result, the narrative denoter can be indicator to demonstrate the message transitions from filmmaker to audience. Suggestions were made for future cognitive film studies on using the narrative denoters as a new analysis unit. (shrink)

The article presents J. Kmita’s methodological interpretation of selected cognitive methods used by K. Marx. Those methods were (and I believe they still are) significant for the social sciences and the humanities, even a century after they had been developed. J Kmita’s interpretation reveals specificity of epistemic procedures carried out by the author of “Capital” and emphasizes contemporary actuality of Marx’s epistemological ideas. To achieve that aim, Kmita refers to the concepts established in the field of philosophy of (...) science of his time. According to J. Kmita, the attractiveness of Marx’s approach lies in the opportunity to develop a methodological interpretation of Marx philosophy, which in turn enables the formation of a unique theory of science development, alternative to those provided by logical positivism, falsificationism, neopragmatism or sociology of knowledge. Such theory would combine the perspective of sociology of knowledge with an epistemological approach to the development of science. (shrink)

Next year, there will be a 100-year celebration of quantum mechanics, but there is no consensus on the interpretation of this theory. This reprint presents recent works on one of the most intriguing interpretations, the many-worlds interpretation, presented at a workshop in October 2022 at Tel Aviv University. The many-worlds interpretation solves the measurement problem, avoids action at a distance and indeterminism, and does not contradict empirical evidence. The main question discussed in the workshop was as follows: (...) why is it not in the consensus? Major issues such as preferred basis, the meaning of probability, non-locality, and alternative approaches were discussed, which are increasingly drawing attention in physics and philosophy. The contributions demonstrated a striking diversity in understanding the basic concepts. What are the worlds in the many-worlds interpretation? Do the worlds diverge or split? Is probability objective or subjective, or is it just an illusion? Can we avoid the non-separability of quantum mechanics? Many questions were raised and significant progress in understanding was achieved, but the papers showed that consensus is still far away. This reprint describes the current status of the research and will be invaluable for physicists and philosophers who want to resolve the long-standing problem of the interpretation of quantum mechanics. Beck presents an outline of the procedure of bootstrapping of integer concepts, with the purpose of explicating the account of Carey. According to that theory, integer concepts are acquired through a process of inductive and analogous reasoning based on the object tracking system, which allows individuating objects in a parallel fashion. Discussing the bootstrapping theory, Beck dismisses what he calls the "deviant-interpretation challenge"—the possibility that the bootstrapped integer sequence does not follow a linear progression after some point—as being general (...) to any account of inductive learning. While the account of Carey and Beck focuses on the OTS, in this paper I want to reconsider the importance of another empirically well-established cognitive core system for treating numerosities, namely the approximate number system. Since the ANS-based account offers a potential alternative for integer concept acquisition, I show that it provides a good reason to revisit the deviant-interpretation challenge. Finally, I will present a hybrid OTS-ANS model as the foundation of integer concept acquisition and the framework of enculturation as a solution to the challenge. (shrink)

Comparative religion scholar Thomas Berry’s influential concept of “Earth jurisprudence” has been helpfully elaborated in three principal books. My first section identifies four of their common themes, deriving therefrom an implicit narrative: (1) the basis of ecology is autopoiesis, which (2) originally generated human communities and Indigenous vernacular laws, which were (3) later reasserted by forest defenders who fought to create the Magna Carta’s “Charter of the Forest,” which is (4) now championed globally by the Indian physicist and eco-activist Vandana (...) Shiva’s Earth Democracy movement. My next three sections identify mutually exclusive elements of the three books, deriving the following alternative narrative: self-conscious new dancing rituals (Cullinan) could empower an historically informed reconstruction of private property (Burdon) via commons-based vernacular law (Weston and Bollier). And my conclusion offers one template for such a strategy, namely a new environmental variation on my dancing-poetic conception of legal justice, christened “emerald star-law.”. (shrink)

It is argued that those who defend the Everett, or ‘many-worlds’, interpretation of quantum mechanics should embrace what we call the general quantum theory of open systems (GT) as the proper framework in which to conduct foundational and philosophical investigations in quantum physics. GT is a wider dynamical framework than its alternative, standard quantum theory (ST). This is true even though GT makes no modifications to the quantum formalism. GT rather takes a different view, what we call the (...) open systems view, of the formalism; i.e., in GT, the dynamics of systems whose physical states are fundamentally represented by density operators are represented as fundamentally open as specified by an in general non-unitary dynamical map. This includes, in principle, the dynamics of the universe as a whole. We argue that the more general dynamics describable in GT can be physically motivated, that there is as much prima facie empirical support for GT as there is for ST, and that GT could be fully in the spirit of the Everett interpretation—that there might, in short, be little reason for an Everettian not to embrace the more general theoretical landscape that GT allows one to explore. Nonindexical Context-Dependence and the Interpretation as Abduction Approach Inclusive nonindexical context-dependence occurs when the preferred interpretation of an utterance implies its lexically-derived meaning. It is argued that the corresponding processes of free or lexically mandated enrichment can be modeled as abductive inference. A form of abduction is implemented in Simple Type Theory on the basis of a notion of plausibility, which is in turn regarded a preference relation over possible worlds. Since a preordering of doxastic alternatives taken for (...) itself only amounts to a relatively vacuous ad hoc model, it needs to be combined with a rational way of learning from new evidence. Lexicographic upgrade is implemented as an example of how an agent might revise his plausibility ordering in light of new evidence. Various examples are given how this apparatus may be used to model the contextual resolution of context-dependent or semantically incomplete utterances. The described form of abduction is limited and merely serves as a proof of concept, but the idea in general has good potential as one among many ways to build a bridge between semantics and pragmatics since inclusive context-dependence is ubiquitous. This paper discusses the possibility of a metaphysical event theory that incorporates the concept of hope as a disposition. Hope is interp- reted as an expectation regarding future events while representing certain manifestations expected to occur in certain future events. In this sense, for ontologies that deny change or claim that its degree is purely fundamental, hope is a redundant concept in a metaphysical context. Additionally, in a world governed by fatalism or theological determinism it is meaningless to hope for (...) an alternative result. These two interpretations are compatible with a form of Stoicism as they depict a world where hope is redundant. To make hope more meaningful within the framework of event theory, we can propose an alternative view in which hope is considered not merely a psychological pheno- menon but also related and more active to metaphysical events. To strengthen this relation, we will change our perspective on our feature ontology and argue that what is hoped for can exist as a dispositional property that is realized as a particular consequence of an event, when it encounters certain stimuli. In examining the relationship between hope and event theory from different ontological perspectives, the first two view hope as a redundant concept for event theories. In contrast, the third perspective reinterprets hope as a disposition, making it more significant for a fundamental ontology. (shrink)

This chapter has two goals. First, I will present an interpretation of Kant’s mature account of punishment, which includes a strong commitment to retributivism. Second, I will sketch a non-retributive, “ideal abolitionist” alternative, which appeals to a version of original position deliberation in which we choose the principles of punishment on the assumption that we are as likely to end up among the punished as we are to end up among those protected by the institution of punishment. This (...) is radical relative to Kant’s mature theory of punishment, but arguably it conforms better to the spirit of Kant’s first Critique remarks on imputation and punishment than his mature theory does. In this article, I offer the figure of the snake-bridge as (a) the coiled central metaphor in Gloria Anzaldúa’s masterpiece, Borderlands/La Frontera, (b) the interpretive bridge connecting the early (This Bridge Called My Back) middle (Borderlands) and late (Light in the Dark) periods of her oeuvre, and (c) an alternate unifying metaphor to mestizaje. My first section offers a close reading of Borderlands, locating snake-bridge in the east-west snake of the Rio Grande that queer Chicana borderlanders cross north and south (...) like snakes, while wrestling earthward with snake demons and skyward with snake goddesses. And my second section autopsies the dismembered snake-bridge in Light in the Dark, calling for a healing thereof in pursuit of a coalitional social justice politics that preserves the strengths of mestizaje without its dangers. In Van Cleve's "Problems from Kant," it is suggested that his interpretation of Kant's metaphysics resolves the problem of "The Neglected Alternative"--the worry that Kant failed to consider that space and time, while perhaps necessary for sensible intuition, could also be objectively real in-themselves. However, it is far from clear how Van Cleve is supposed to have solved this objection. This paper examines why Van Cleve might have thought the problem resolved on his view, and argues that there (...) is no reason to think the problem has in fact been resolved. (shrink)

This thesis inquires what it means to interpret non-relativistic quantum mechanics (QM), and the philosophical limits of this interpretation. In pursuit of a scientific-realist stance, a metametaphysical method is expanded and applied to evaluate rival interpretations of QM, based on the conceptual distinction between ontology and metaphysics, for objective theory choice in metaphysical discussions relating to QM. Three cases are examined, in which this metametaphysical method succeeds in indicating what are the wrong alternatives to interpret QM in metaphysical terms. (...) The first two cases failed in doing so due to different kinds of underdetermination. In the third case, unlike underdetermination, where there are many choices to be made, a “null-determination” is proposed where there may be no metaphysical choices in the available metaphysical literature. Considering what has been discussed, an agnostic philosophic position is adopted concerning the possibility of interpreting QM from a scientific-realistic point of view. (shrink)

I offer an interpretation and defense of John Dewey’s notion of “democratic experiments,” which involve testing moral beliefs through the experience of acting on them on a social scale. Such testing is crucial, I argue, because our social norms and institutions fundamentally shape the relationships through which we develop emotional responses that represent the morally significant concerns of others. Improving those responses therefore depends on deliberate alterations of our social environment.
