The purpose of this paper is to perform an ethical reflection linked to principles that contribute for the human growth and accomplishment, as well as the aesthetic on the perception of the sensitive, reverberated by sensations and feelings emerging from athletes. English Abstract: Through the presentation of the history of social justice in global constitutional discourse, this article aims to demonstrate that, although in Colombia there is not a constitutionalized purpose or principle of social justice, as in other countries, the modern notion of distributive justice, also called social justice today, is implicit in the Constitution of 1991 because it enshrined as mandatory rules the three main elements of its meaning at the time of its promulgation: the principle of social rule (...) of law, the principle of human dignity and the right to a material equality. Thus, in Colombia social justice must not be understood in the Aristotelian sense of distributive justice but in accordance with these three elements, and can only be achieved if they are fulfilled. -/- Spanish Abstract: Mediante la presentación de la historia de la justicia social en el discurso constitucional global, este artículo pretende demostrar que, a pesar de no existir en Colombia, como en otros países, un valor o principio constitucional de justicia social, la noción moderna de justicia distributiva, también llamada hoy justicia social, se encuentra implícita en la Constitución de 1991 porque esta consagró como normas obligatorias los tres elementos principales de su significado en el tiempo en el que fue promulgada: el principio de Estado Social de Derecho, el principio de dignidad humana y el derecho a una igualdad material. Spanish Abstract: A partir de un análisis desde la historia del derecho, este artículo de investigación busca demostrar la existencia de un significado de justicia social en el discurso jurídico transnacional actual que se resume en la garantía de estos tres elementos: Estado Social de Derecho, dignidad humana e igualdad de oportunidades. Con esto, se pretende superar el simple estudio de teorías de filósofos de moda como John Rawls a la hora de abordar el problema de cómo entender y materializar (...) la justicia social, particularmente, en el plano constitucional. Finalmente, con la ayuda de algunos breves estudios de caso, se espera proveer un marco mínimo útil para entender cómo la justicia social puede lograrse a través del derecho. -/- English Abstract: Based on an analysis from legal history, this paper seeks to prove the existence of a meaning of social justice in the current transnational legal discourse that can be synthetized in the warranty of these three elements: Social Rule of Law, human dignity, and equal opportunities. Thus, it aims to overcome the mere study of theories of justice drawn up by trendy philosophers like John Ralws when addressing the problem on how to understand and achieve social justice, specially, in constitutional law. Esta investigación retoma la obra de Gabriel García Márquez, Noticia de un secuestro (1996), con la volición de cuestionar la idea de Estado nación que está inmersa en el libro. Para ello, es necesario entender que la naturaleza del texto exige un conocimiento amplio al lector o al intérprete, puesto que su contenido revela datos multidisciplinarios. Además, es insoslayable realizar un análisis discursivo de la historia de ese contexto y cotejar con pasajes del mismo libro. Para facilitar esta labor, la (...) extrapolación de conceptos del teórico Luis Rodríguez Manzanera será de utilidad, ya que él despliega definiciones de Criminología, un tema frecuente en la obra. Verbigracia, la macrocriminalidad, una noción que él postula, permite que se comprenda la complexión del periodo histórico finisecular del siglo XX en Colombia, etapa que le corresponde a Noticia de un secuestro. Por otro lado, es menester dilucidar que este estudio no se reduce a lo literario, lo histórico y lo criminológico, sino que abarca distintas disciplinas, por lo que la exigencia en la consolidación epistemológica e interpretativa estará demostrada consuetudinariamente, sin obviar la inmanencia de la obra. Este tipo de análisis interdisciplinarios ya ha sido trabajado desde los Estudios Culturales, tal como se constata en las investigaciones de Richard Johnson (2000) o Néstor García Canclini (1997). De igual modo, el intento de establecer lineamientos y conexiones entre disciplinas como las de Literatura y Derecho ya ha sido desarrollado por Stanley Fish (1986), Faustino Martínez (2005), Carlos Pérez (2006) y Denise Schalet (2014). A diferencia de estos abordajes ya estudiados, el objetivo de esta investigación es detectar y fundamentar cómo se articula una propuesta ideológica desde una configuración que reanuda elementos históricos y literarios. En específico, lo que se busca es argumentar por qué fracasó implícitamente un proyecto sociopolítico de democracia y progreso, a partir de un panorama de violencia, narcoterrorismo, corrupción, negociaciones ilícitas, transgresión a los derechos humanos e inseguridad ciudadana. Con todo ello, esta tesis de maestría terminará siendo fructuosa para análisis postremos de discursos que tienen como esencia un soporte multidisciplinario. (shrink)

INTRODUÇÃO A técnica da inseminação artificial tornou possível aumentar o impacto na descendência de touros geneticamente superiores em termos de produção láctea das filhas. Com a transferência de embriões é possível aumentar o impacto da fêmea sobre (...) a população das filhas. A transferência de embriões data de 1890, ano em que Heape obteve o nascimento de coelhos transferindo ovócitos fecundados de uma fêmea para outra. A partir de 1930, é repetida uma série de experiências para desenvolver a técnica e aplicá-la em ovinos, caprinos (1934) e bovinos (1951) como espécies mais idôneas para a reprodução. A Inglaterra e os Estados Unidos estabeleceram as bases para o comércio de embriões durante os anos sessenta e setenta. De forma resumida, a transferência de embriões implica na estimulação da produção de ovócitos mediante a aplicação de hormônios: cerca de 6-8 dias após a cobrição dessas fêmeas ou da sua inseminação artificial, os óvulos fertilizados são extraídos dos órgãos genitais da fêmea doadora por perfusão ou lavagem com soluções biológicas controladas e testadas, originando-se uma deposição dos gametas fecundados nas fêmeas receptoras que serão encarregadas de levar adiante a gestação e o parto sem influência sobre as produções do novo indivíduo. 2. MANEJO DAS FÊMEAS DOADORAS É relativamente fácil obter um embrião, uma vez que pode origina-se a partir do cio natural das vacas cíclicas. No entanto, a fim de otimizar a técnica, o normal é «superovular» a fêmea doadora e obter um número superior de gametas fecundadas após cada lavagem ou perfusão das genitais. A maioria das fêmeas doadoras são tratadas com gonadotrofinas (PMSG) ou com hormônios estimuladores da foliculogênese (FSH). Estes hormônios invertem a atresia normal de folículos permitindo uma maturação, que em condições normais não se realizaria. O mecanismo exato do funcionamento destas hormonas não é totalmente claro. A superovulação multiplica por um fator de 10 o número de ovócitos recuperados no caso das vacas, ovelhas e cabras, mas apenas por um fator 2 ou 3 no caso das porcas. Existe um acordo geral sobre a utilização das gonadotrofinas; a PMSG deve ser aplicada durante a transição da fase luteica para a folicular, ou seja, no 16º dia do ciclo. As doses de gonadotrofinas variam entre 1500 e 3000 UI em bovinos, aumentando a resposta e a variabilidade individual com o aumento da dose. A resposta ao tratamento varia de acordo em função de diversos fatores. Neste contexto, merecem especial atenção a espécie, a raça, a época e a conformação corporal do animal, bem como o lote de fabricação da preparação hormonal (quadro 7.1). Estudos demonstram que, nos bovinos, as raças de corte respondem melhor ao tratamento do que as raças leiteiras. O FSH também é utilizado para superovulação em várias espécies. Nos ovinos, injetam-se 2 mg desta hormona 12 horas antes da retirada das esponjas, aplicando-se mais três injeções, com um intervalo de 12 horas, até 24 horas após a retirada das esponjas, o que corresponde a um total de 8 mg de FSH injetados por tratamento e animal. Às vezes, e dependendo do país, existem dificuldades para a obtenção desse hormônio em condições de pureza adequada para que o tratamento proporcione o resultado esperado. Nas vacas dadoras devem ter passado mais de 50 dias após o último parto: também ser animais cíclicos, encontrar-se num nível nutricional elevado e em aumento, sem deficiências especificas alimentares. Existe uma indicação de suplementação das fêmeas doadoras com minerais essenciais antes do tratamento. 3. OBTENÇÃO DE EMBRIÕES Uma vez as fêmeas doadoras inseminadas, entre o sexto e o oitavo dia, procede-se a coleta dos embriões. Para isso, atualmente se utilizam cateteres de obtenção transcervical (tipo Foley, Rusch. etc.) munidos de uma bola insuflável na sua extremidade que permite criar um compartimento estanque na parte distal do córneo uterino e proceder ao arrasto dos embriões ali localizados. Para obter esta «lavagem» utiliza-se uma solução aquosa tamponada: o meio mais frequentemente utilizado é o tampão fosfato salino (PBS: pH = 7; PO = 280 - 290 mOsm/kg) suplementado com antibióticos e proteínas. Depois de recuperado o meio de lavagem, os embriões devem ser isolados do volume total, avaliados segundo critérios do Manual da Sociedade Internacional de Transferência de Embriões de acordo com seu estado de desenvolvimento. Código numérico para determinar o grau de desenvolvimento embrionário: N° 1: ovócito não fertilizado ou embrião de uma célula (1 dia). N° 2: Identifica embriões com 2 a 16 células (2-4 dias). N° 3: Identifica mórulas adiantadas (5-6 dias). N° 4: Identifica mórulas compactas de 6 dias de idade. N° 5: blastocisto adiantado (7 dias). N° 6: blastocisto (7-8 dias). N° 7: blastocisto expandido (8-9 dias). N° 8: blastocisto eclodido (9 dias) a partir do nono ou décimo dia o blastocisto já está fora da zona pelúcida. Além da classificação por estado de desenvolvimento, a referida Sociedade Internacional estabeleceu uma categorização dos embriões com base na qualidade dos mesmos. Assim os denomina: 1: excelente; 2: bom; 3: regular; 4: degenerado. Segundo as investigações de diversos autores especialistas no tema não devem ser transferidos embriões que não tenham sido classificados como excelentes ou bons. A obtenção dos embriões pode ser realizada em uma clínica, em unidades móveis especializadas, ou na própria fazenda. Em todo o caso, a doadora não deve apresentar quaisquer sintomas clínicos de doença, sendo esta responsabilidade direta do veterinário. O rebanho de onde provém a doadora deve estar livre de medidas cautelares sanitárias. Os técnicos devem estar adequadamente limpos e preparados para esta atuação, em um lugar tranquilo e que permita a colocação de equipamentos e material em condições limpas e seguras. 4. TÉCNICAS DE TRANSFERÊNCIA DE EMBRIÕES Recomenda-se que os embriões sejam transferidos o mais rápido possível depois da recuperação. A fêmea receptora deve apresentar um ambiente uterino o mais semelhante possível ao da fêmea doadora. Isto quer dizer que a receptora também será mantida num sistema de sincronização para que coincida o mais possível o estágio de desenvolvimento embrionário com seu correspondente estado uterino. A margem de assincronia para evitar efeitos indesejáveis é de ± 24 horas. Os métodos hormonais de sincronização são análogos aos das doadoras. As técnicas para a deposição dos embriões no seu novo habitat podem ser igualmente cirúrgicas e não cirúrgicas, mas devido aos problemas do uso de anestésicos em técnicas cirúrgicas, as transferências foram direcionadas para modelos não-cirúrgicos ou transcervicais. Este método é baseado na utilização do colo uterino de forma análoga como é realizada na inseminação artificial. Devido às relações entre o embrião e o ovário, as porcentagens de fertilidade são aumentadas ao serem depositadas no corno ipsilateral no ovário que se encontra ativo. A utilização desta técnica implica na obtenção de mais fêmeas gestantes. O uso de novilhas como fêmeas receptoras aumenta também a taxa de gestações a partir de uma maior facilidade de manejo, uniformidade na resposta hormonal e um custo mais baixo. O fator humano ou habilidade do técnico que realiza esta técnica também constitui um fator que influencia decisivamente no êxito da transferência, encontrando-se variações de 20 a 60% devidas a este fator. 5. CONTROLES SANITÁRIOS Com a utilização da inseminação artificial, verificou-se que, embora as tecnologias reprodutivas colaborativas fossem mais avançadas em termos de técnicas destinadas a aumentar a produtividade individual, da mesma forma, podem constituir um perigo de contaminação e de dispersão de doenças estrangeiras para o grupo ou rebanho para onde são transferidos os novos genes. Neste contexto, a transferência embrionária (TE) deve realizar-se tendo em conta os riscos que pode implicar uma manipulação inadequada. Uma vez mais, a Sociedade Internacional (IETS) na Reunião Regional da OIE (Oficina Internacional de Epizootias) estabeleceu as normas em 1985 para que a TE pudesse ser utilizada como meio para controle de doenças na pecuária. Para que a utilização da TE se realize sem risco para a saúde, é necessário ter em conta um certo número de regras e condições específicas que evitem os riscos de contaminação. O embrião está separado do meio externo por três barreiras de proteção: o corpo da mãe, o útero por si só e a terceira, e mais importante, pela zona pelúcida, a qual nos animais domésticos tem demonstrado ser totalmente impermeável a qualquer elemento patogênico, desde que fique intacta. Portanto, o risco de contaminação dos embriões pode vir por duas vias diferentes: a) Fatores extrínsecos - por invasão dos agentes patogênicos na cavidade uterina principalmente. Isto está relacionado com o estado sanitário médio do país, região ou rebanho de origem. b) Fatores intrínsecos - Segundo Thibier podemos considerar diferentes fontes potenciais de contaminação, que segundo o risco sanitário se classificam nas seguintes ordens: 1° Zigoto. 2° Penetração. 3° Absorção. 4° Armazenamento. 5° Exame. 6° Transferência. Os esforços para que os embriões se tornem livres de contaminação devem ser semelhantes aos que são efetuados com os animais vivos e com as doses seminais. O momento mais perigoso encontra-se entre a coleta das células fecundadas e a sua deposição, após seu exame, no trato reprodutivo da receptora. As condições em que o referido processo deve ser realizado encontram-se detalhadas no manual da Sociedade Internacional de Transferência de Embriões (IETS). 6. REGRAS DA IETS A transferência de embriões é a via mais segura para a troca de genes. No entanto, os técnicos devem esforçar-se por manter todas as regras e normas sanitárias para que a coleta e a manipulação dos embriões se realizem sob condições de absoluta garantia higiênica e sanitária. A transferência embrionária implica, pela primeira vez na história da medicina veterinária, que a vigilância sanitária não se aplica estritamente ao animal, uma vez que, na sua fase "in vitro", está inteiramente sob o controle do técnico. Por conseguinte, não haverá futuro para este tipo de biotecnologia se, paralelamente, não houver um elevado nível de garantia de que não «servirá» para não disseminar ou difundir doenças. As conclusões da Sociedade Internacional de Transferência de Embriões (IETS) na sua reunião anual de 14 de Janeiro de 1992 estabelecem, tendo em conta a revisão efetuada em 1991 pela Subdireção de Investigação e pelo Comitê de Importação e Exportação, uma classificação das doenças. Esta classificação corresponde às seguintes categorias: Categoria 1 - Doenças ou agentes de doenças para as quais foram recolhidas provas suficientes para afirmar que o risco de transmissão é negligenciável, desde que os embriões sejam corretamente manipulados entre a coleta e a transferência: a) Leucose bovina enzoótica. b) Febre aftosa (bovinos). c) Língua azul (bovinos). d) Brucelose bovina. e) Rintraqueíte infecciosa bovina. f) Doença de Aujeszky. Categoria 2 - Doenças para as quais foram recolhidas provas substanciais que indicam que o risco de transmissão é insignificante, desde que os embriões sejam corretamente manipulados entre a coleta e a transferência, mas para as quais é necessário verificar os dados existentes através de novas transferências: a) Peste suína clássica. Categoria 3 - Doenças ou agentes de doenças para as quais os resultados preliminares indicam que o risco de transmissão é insignificante, desde que os embriões sejam corretamente manipulados, entre a coleta e a transferência, mas para os quais essas verificações preliminares devem ser corroboradas por dados experimentais complementares "in vitro" e "in vivo": a) Peste bovina. b) Diarreia viral bovina. c) Língua azul (ovinos). d) Febre aftosa (suínos, ovelhas e cabras). e) Campylobacter fetus (ovinos). f) Doença vesicular do porco. g) Peste suína africana. h) Prurido lombar (ovinos). i) Haemophilus somnus. Categoria 4 - Doenças ou agentes de doenças que foram ou são objeto de trabalhos preliminares: a) Vírus Akabane (bovino). b) Estomatite vesicular (bovinos e suínos). c) Chlamydia psittaci (bovinos e suínos). d) Ureaplasma/micoplasmose (bovinos e caprinos). e) Maedi-visna (ovino). f) Adenomatosa pulmonar (ovino). g) Prurido lombar (caprinos). h) Língua azul (caprinos). i) Artrite e encefalite caprina. j) Parvovírus (suíno). k) Enterovírus (bovinos e suínos). I) Leptospirose (suíno). m) Herpesvírus 4 dos bovinos. n) Mycobacterium paratuberculose (bovinos). o) brucelose ovina. p) Doença de Border (ovinos). q) Vírus parainfluenza 3 (bovinos). r) Agente da encefalopatia espongiforme bovina. É interessante salientar que apenas seis doenças estão incluídas na categoria 1 (a mais segura). Isso não significa que as outras doenças tenham um risco maior, apenas indica que o risco de transmissão das doenças da categoria 1 é irrelevante, estatisticamente falando. É importante assinalar que as doenças mais importantes dos bovinos se situam na categoria 1. Isto significa que a incidência do embrião patogênico nos bovinos parece ser perfeitamente controlável, desde que sejam adotadas metodologias adequadas. Isto serve também como linha de defesa adicional para que o técnico centre sua atenção e cuidados entre a fase de obtenção e a de transferência. 7. SITUAÇÃO ATUAL DA TRANSFERÊNCIA DE EMBRIÕES ANIMAIS NO BRASIL O Brasil é um dos grandes responsáveis mundiais pela implantação da tecnologia na reprodução animal, sendo assim, o país conseguiu inserir-se no mercado internacional como um dos maiores produtores de embriões in vivo e in vitro. Nas últimas duas décadas, especialmente entre os anos de 1997 e 2017 o país passou por importantes transformações nesse segmento, dentre essas transformações vale destacar a posição relativa do Brasil no contexto mundial. O Brasil passou de referência regional, nos anos 1990, para se tornar o maior produtor mundial de embriões entre os anos 2012 e 2013, sendo líder no uso e na produção de embriões in vitro. Os primeiros registros da TE produzidos in vivo no Brasil datam da década de 1980, e uma década depois o país já tornara-se referência e detinha um mercado consolidado de produção e TE na espécie bovina. Não obstante, no ano de 1997 o país ainda era referência apenas no contexto regional, detendo 68,3% dos embriões transferidos na América Latina, esse percentual corresponde a 24.085 embriões de um total de 35.254 produzidos na América Latina. Esse percentual regional representa apenas 6,6% de toda a produção mundial de embriões in vivo, que produziu, em 1997, 360.656 embriões in vivo. Nos últimos anos, o mercado de embriões, principalmente o bovino, teve retração moderada de -2,5% ao ano entre 2003 e 2018, porém essa retração contrasta com o ligeiro crescimento observado a partir dos anos 2000 conforme figura 1: Figura 1: Produção de embriões bovinos no Brasil no período 1996-2018, total e por tecnologia adotada (in vivo[IVD] ou in vitro [IVP]). Em 2018, o mercado de embriões bovinos manteve-se inalterado se compararmos com os três anos anteriores, houve reduções nós segmentos de corte, leite e no total comparado ao ano de 2017. Em 2014, a produção de embriões para melhoramento do gado leiteiro teve seu ápice, porém de lá para cá esse mercado manteve-se estagnado como demonstra a tabela 2. Tabela 2: Produção de embriões bovinos no Brasil em 2018, estratificada por segmento e por tecnologia adotada (in vivo ou in vitro). 7.1 Crise, economia e mercado de embriões A indústria de embriões reflete, em maior ou menor grau, o momento da economia brasileira. Apesar do segmento agropecuário ser um setor em constante crescimento no país, ao qual, sem dúvidas, em meio a inúmeras crises mantém-se em constante crescimento. Porém vale ressaltar que esse mercado é emergente e está refletido em paralelo com os bens produzidos pelo país, como demonstra a figura 2. Figura 2: Produção de embriões bovinos e variação no produto interno bruto (PIB) no Brasil, no período 1996-2018. Cada vez mais o setor agropecuário do Brasil investe em novas tecnologias que maximizem o mercado e que melhore a produção dos animais seja no segmento corte ou leite. Segundo a OCDE, 1997, essa indústria da produção de embriões é um conjunto de novas técnicas e processos, frutos do desenvolvimento técnico-científico, que chega ao mercado e - o mais importante - o transforma. Logo, todas essas técnicas e biotecnologias visam, além da alta produção e do lucro, o melhoramento e a suplementação alimentícia da população mundial que está em crescente avanço. A evolução da tecnologia embrionária no país, seja para o melhoramento dos equinos para os esportes como as vaquejadas, hipismo, corridas, etc., onde são investidos tempo, dedicação e dinheiro para formar um novo animal que apresente força, conformação, conversão alimentar e que custa milhões, em muitos casos, não só dos equinos, mas também dos caprinos, ovinos, suínos e até mesmo os bovinos onde o mercado da TE é mais presente e aquecida, venceu os estigmas do “modismo” e o chamado “elitismo”, porém deve enfrentar novos desafios, em especial num contexto de forte concentração do mercado de genética e de concorrência globalizada. Mesmo com todos esses avanços e retrocessos, essa relativização dos números demonstra que um percentual bastante reduzido das fêmeas bovinas que estão em idade reprodutiva é utilizado para a técnica da transferência de embriões, e que o mercado brasileiro ainda tem um grande potencial de crescimento no setor de produção in vivo e in vitro. 8. RESUMO E PRIMEIRAS CONCLUSÕES Ao longo deste trabalho pretendi realizar uma revisão sumária sobre um tema de grande importância presente, e sobretudo futura; referir-me à transferência embrionária. Atualmente, esta técnica atingiu um grau notável de penetração, a nível prático, no gado leiteiro. No entanto, num futuro mais ou menos longínquo, não temos dúvidas quanto a esta técnica, pelas vantagens indubitáveis que apresenta a nível de avanço genético, que será aplicada em outras espécies úteis ao homem. Na minha exposição, tentei dar especial ênfase a dois aspectos: as técnicas de transferência, incluindo as normas IETS e os controles sanitários a serem efetuados. The complex world of thought and sensitivity in the sphere of contemporary art has entailed the revision and exclusion of disciplines aimed at providing a model to explain and conceptualize reality. Art history, as one such discipline, has had many of its contributions questioned from Gombrich’s epistemological reformulation to the postmodern discourses, which extol the death of the author, the post-structuralist idea of tradition as a textual phenomenon, and the declaration of the death of history as a consequence of the (...) hybridization of disciplines and of other bran- ches of human knowledge. Nevertheless, it can be demonstrated that proposals as those by Julius von Schlosser and Giulio Carlo Argan enclose reflections and methodological aspects which can help us face the task of understanding and visualizing the mediating role of historians in the culture of sensitivity, and the art modulations that have resulted from the blows of history and that, in turn, have shaped both art and art history into what they are or can be to us today. Pérez Carballo adopts an epistemic utility theory picture of epistemic norms where epistemic utility functions measure the value of degrees of belief, and rationality consists in maximizing expected epistemic utility. Within this framework he seeks to show that we can make sense of the intuitive idea that some true beliefs—say true beliefs about botany—are more valuable than other true beliefs—say true beliefs about the precise number of plants in North Dakota. To do so, however, Pérez Carballo argues that (...) we must think of the value of epistemic states as consisting in more than simply accuracy. Laura Specker Sullivan (2022) makes a fairly compelling case for the value of the perspectives of Buddhist practitioners in neuroethics. In this study, Tibetan Buddhist monks have been asked, among other things, whether consciousness, in brain-injured patients in a minimally conscious state, entails a duty to preserve life. In our view, some of the participants’ responses could be used to inform the bioethical debate on death determination.

In this paper, we propose an account of metaphor identification on the basis of contextual coherence. In doing so, we build on previous work by Nicholas Asher and Alex Lascarides that appeals to rhetorical relations in order to explain discourse structure and the constraints on the interpretation of metaphor that follow from it. Applying this general idea to our problem, we will show that rhetorical relations are sometimes insufficient and sometimes inadequate for deciding whether a given utterance is a case (...) of metaphor. They are insufficient, since rhetorical relations fall short at times of providing a basis for disambiguating between literal and metaphorical interpretations. In such cases, contextual information other than previous discourse needs to enter the picture. To this effect, we bring the idea of external consistency into play. Beyond that, though, we will argue that rhetorical relations are sometimes inadequate to account for coherence, if conceived as relations among sentences only. The reason is that extra-linguistic elements of the situation in which the sentence is uttered may be crucial for getting at the preferred interpretation. To account for these cases, we allow rhetorical relations to connect both with previous discourse and with extra-linguistic situations. In our final refinement of the notion of contextual coherence, we forfeit any appeal to rhetorical relations in favour of Questions Under Discussion (QUD). We defend the view that this account does not only explain the same sort of cases. What is more, it solves the issue of metaphor identification in impoverished contexts. (shrink)

The philosophical conception of mechanistic explanation is grounded on a limited number of canonical examples. These examples provide an overly narrow view of contemporary scientific practice, because they do not reflect the extent to which the heuristic strategies and descriptive practices that contribute to mechanistic explanation have evolved beyond the well-known methods of decomposition, localization, and pictorial representation. Recent examples from evolutionary robotics and network approaches to biology and neuroscience demonstrate the increasingly important role played by computer simulations and mathematical (...) representations in the epistemic practices of mechanism discovery and mechanism description. These examples also indicate that the scope of mechanistic explanation must be re-examined: With new and increasingly powerful methods of discovery and description comes the possibility of describing mechanisms far more complex than traditionally assumed. The article addresses his main contributions, with special attention to the Aufsätze zur Ethik and its connection to The Idea of the Holy. Against the idea that Otto is unable to develop an ethics without giving up some fundamental positions of The Idea of the Holy, the article argues in favor of their agreement with his ethical writings, on the basis of the thesis that not (...) everything we know is a form of knowledge (wissen), in the sense of intellectual representation. The notion of a correct appreciation of nature, like the one put forward in Carlson’s environmental account, has been rejected by many other authors in the aesthetics of the natural environment. Their critics challenge the idea that only scientific cat- egories can ground the aesthetic appreciation of nature as nature, and they hold that there is not a correct way of appreciating nature. However, they may share with Carlson the idea of correctness under an objectivist paradigm of aesthetic appreciation, according (...) to which correctness means the adequation of the experi- ence to properties of the object. My aim in the article is to claim that it is necessary to endorse an aesthetic standard of correctness that takes into consideration the subjective character of aesthetic appreciation. An aesthetic standard of correct- ness implies universal assent, or validity for everyone in Kantian terms, in place of an objectivist notion. This notion of correctness permits the inclusion of expressive perception of nature as an essential form of aesthetic appreciation. (shrink)

este trabajo aborda tres aspectos fundamentales del método filosófico de Edith Stein. En primer lugar, se alude a las cosas mismas como el punto de partida del filosofar de esta autora. En segundo lugar, se considera el aspecto que constituye uno de los aportes fundamentales del método fenomenológico y que es claramente reconocible en nuestra autora, a saber, el haber puesto de manifiesto la imposibilidad de hacer filosofía primera sin tomar en cuenta la vida consciente ante la que todas las (...) cosas se abren. En tercer lugar, se remite a la individualidad de la persona como un aspecto de la antropología de Stein especialmente relevante. Al final del análisis de cada uno de estos tres aspectos metodológicos se intenta mostrar en qué sentido éstos pueden ser de relevancia para emprender el camino hacia la pregunta por la mujer. Background: Several countries have recently changed their model of consent for organ donation from opt-in to opt-out. We undertook a systematic review to determine public knowledge and attitudes towards these models in Europe. Methods: Six databases were explored between 1 January 2008 and 15 December 2017. We selected empirical studies addressing either knowledge or attitudes towards the systems of consent for deceased organ donation by lay people in Europe, including students. Study selection, data extraction, and quality assessment were conducted by (...) two or more reviewers independently. Findings: Awareness of the consent model was lower in opt-out countries than in opt-in countries. A majority of the public agrees with opt-in, regardless of the law in their own country. There are ambivalent attitudes regarding the opt-out system. The public tend to prefer opt-in and mandatory choice over opt-out when several options are offered. Interpretation: The assumption that people in opt-out countries are aware of the legal requirements to be excluded from the pool of potential donors is not supported by the results of this review. This is a concern, since ignorance hinders people's autonomy regarding organ donation decision-making. Higher awareness of consent model in opt-in countries may reflect greater efforts to inform the public through campaigns to motivate donation. Legal moves towards opt-out are at odds with people's expressed preferences. Main limitations of this review are the lack of data from some countries, study population heterogeneity, and methodological shortcomings. (shrink)

Marcus William Hunt argues that when co-parents disagree over whether to raise their child (or children) as a vegan, they should reach a compromise as a gift given by one parent to the other out of respect for his or her authority. Josh Millburn contends that Hunt’s proposal of parental compromise over veganism is unacceptable on the ground that it overlooks respect for animal rights, which bars compromising. However, he contemplates the possibility of parental compromise over ‘unusual eating,’ of animal-based (...) foods obtained without the violation of animal rights. I argue for zero parental compromise, rejecting a rights-oriented approach, and propose a policy that an ethical vegan parent and a non-vegan co-parent should follow to determine how to raise their children. One challenge faced by aesthetics is the development of an account able to trace out the continuities and discontinuities between general experience and aesthetic experiences. Regarding this issue, in this paper, I present an enactive model of some raw cognitive dynamics that might drive the progressive emergence of aesthetic experiences from the stream of general experience. The framework is based on specific aspects of John Dewey’s pragmatist philosophy and embodied aesthetic theories, while also taking into account research in ecological psychology, (...) cognitive sciences, and dynamic systems theory. The model focuses on dynamically relevant nodes at the pre-reflective and the reflective side of experience that would work as nested rhythmic constraints at different cognitive timescales with the potential to shunt experiences toward the aesthetic in everyday situations. My proposal constitutes a way to explore aesthetic experiences from an enactive perspective that regards them as transformative events in which cognitive processes entrain and are entrained by changes taking place in the environment, the brain, and the body. According to an influential view, when it comes to representing reality, some words are better suited for the job than others. This is elitism. There is reason to believe that the set of the best, or elite, words should not be redundant or arbitrary. However, we are often forced to choose between these two theoretical vices, especially in cases involving theories that seem to be mere notational variants. This is the riddle of redundancy: both redundancy and arbitrariness are vicious, but (...) there are cases in which one must be picked. Logical realists admit that there are some logical constants among the elite words. This leads to awkward questions, such as which among conjunction and disjunction is elite. In this paper, I show how the riddle of redundancy arises for logical realists, and offer a solution. This approach requires us to change how we represent negation. Instead of using some particular symbol, we represent negation by flipping formulae over the horizontal axis. (shrink)

This paper tries to introduce the main elements of Alexander Pfänder´s thought. Pfänder was one of the most prominent phenomenologists. He wrote many books on different philosophical topics such as Logic, Ethics, Epistemology, etc. Here one pays special attention to his way of considering Logic and his special comprehension of phenomenological method.

The field of Latin American philosophy has established itself as a relevant subfield of philosophical inquiry. However, there might be good reasons to consider that our focus on the subfield could have distracted us from considering another subfield that, although it might share some geographical proximity, does not share the same historical basic elements. In this paper, I argue for a possible and meaningful conceptual difference between Latin American Philosophy and Indigenous philosophy produced in Latin America. First, I raise what (...) I call Mariátegui’s Solidarity Challenge to show that there might be some neglectful treatment of the philosophical views of different Indigenous groups. I then depart from Mariátegui and engage in a critical exercise to show that even he would be guilty of failing in his own solidarity demands. I follow that by drawing out some implications of the argument. I first sketch how this differentiation would play out against the political project of “Mestizaje,” a project that seems to inform some of the Latin American philosophical tradition. I then speculate about the kinds of duties that the field of Latin American philosophy might have towards the field of Indigenous Philosophy produced in Latin America. (shrink)

The classification of preserved hypothalamic activity in brain death and brainstem death as functional or non-functional has become a subject of debate. While proponents of the neurological criterion claim that these activities lack functional significance (Shemie et al. 2014), Nair-Collins and Joffe (2023) argue for their functional physiological role. However, the interpretation of the term "function" within the medico-legal framework, where death is characterized by the irreversible cessation of all brain functions, remains unclear. -/- My intention here is not to (...) engage in a debate over the validity of different viewpoints regarding the functional significance of preserved activities in the hypothalamus or the heart. Rather, I aim to highlight the critical importance of exploring and defining the concept of function in medicine, which currently lacks clarity. My point is that, whatever our position in the brain death debate, reaching a consensus on this conceptual matter would minimize misunderstandings and establish a robust foundation for further insightful analysis. This paper explores the scope and limits of rational consensus through mutual respect, with the primary focus on the best known formal model of consensus: the Lehrer–Wagner model. We consider various arguments against the rationality of the Lehrer–Wagner model as a model of consensus about factual matters. We conclude that models such as this face problems in achieving rational consensus on disagreements about unknown factual matters, but that they hold considerable promise as models of how to rationally resolve non-factual disagreements.

Social ontology focuses on questions about the reality of human categories. The typical examples are gender and race. Common questions about them are: Do they exist? What is their nature? Do they exist in the best possible way? Meanwhile, the philosophy of psychiatry has been discussing the reality of psychopathology, what is the best way to classify mental disorders, and whether it is possible to define them without normative vocabulary. I think there is something not only strange but inadequate about (...) these discussions being held apart. Particularly, I hold that by being held separately these discussions are philosophically incomplete. In this paper, I argue that these debates are parallel in crucial aspects, but more importantly that they can benefit from each other if they start a dialogue. I suggest some paths we can take to start fruitful discussions and offer examples of the kind of outcomes we can expect. However, my main contribution is to sketch a common framework to map current discussions, make comparisons between them, and, more importantly, guide new research. (shrink)

The project of growing meat artificially represents for some the next best thing to humanity. If successful, it could be the solution to several problems, such as feed- ing a growing global population while reducing the environmental impact of raising animals for food and, of course, reducing the amount and degree of animal cruelty and suffering that is involved in animal farming. In this paper, I argue that the issue of the morality of such a project has been framed only (...) in terms of the best conse- quences for the environment, animals, and humans, or in terms of deontic princi- ples. I argue that to appreciate how deep and difficult this issue is, it is necessary to consider it in terms of a virtue-oriented approach. Such an approach will reveal aspects that are not apparent, not contemplated by typical approaches, but are essen- tial to our understanding of the morality of lab-grown meat. As I argue, evaluating the issue from a virtue-oriented perspective suggests that the project of in vitro meat should not be supported because it stems from unvirtuous motivations. (shrink)

20th century physics has revealed a pervasive relational aspect of the physical world. This fact is relevant in view of some of the motivations for panpsychism. In facts, it may be seen as a vindication of the panpsychist idea of a monist continuity where some aspects of the consciousness’ perspectivalism are universal. But this same fact undermines the motivations for genuine forms of panpsychism.

Many moral philosophers have criticized intensive animal farming because it can be harmful to the environment, it causes pain and misery to a large number of animals, and furthermore eating meat and animal-based products can be unhealthful. The issue of industrially farmed animals has become one of the most pressing ethical questions of our time. On the one hand, utilitarians have argued that we should become vegetarians or vegans because the practices of raising animals for food are immoral since they (...) minimize the overall happiness. Deontologists, on the other hand, have argued that the practices of raising animals for food are immoral because animals have certain rights and we have duties toward them. Some virtue ethicists remain unconvinced of deontic and consequentialist arguments against the exploitation of animals and suggest that a virtue-based approach is better equipped to show what is immoral about raising and using animals for food, and what is virtuous about ethical veganism. A lo largo de la tradición psicopatológica, incluso de la pre-fenomenológica, se encuentra la categorización del delirio como creencia. Jaspers asumió ese uso y lo fundó fenomenológico-existencialmente, definiendo su carácter de convicción. El concepto de creencia ha tenido un largo recorrido dentro de la historia del pensamiento, aunque recientemente se ha intensificado el debate acerca de la visión doxástica del delirio. En virtud de lo ya mencionado, en el presente artículo presentamos un análisis conceptual de la creencia, con el objetivo (...) de identificar de manera precisa los aspectos esenciales que permiten al delirio definirse según ella. De esta manera, se discutirán algunas de las principales incursiones realizadas en el concepto desde la antigüedad periplatónica hasta José Ortega y Gasset, remarcando en cada pensador las directrices esenciales de su aproximación a la creencia. A su vez, introducir al filósofo español al debate psicopatológico permitirá incluir en la discusión dos aspectos importantes que creemos pueden ser fructíferos para la discusión filosófica sobre el delirio: la diferencia entre ideas y creencias, y la vitalidad de estas últimas. Finalmente, hacemos referencia al actual debate pro- y antidoxástico, haciendo hincapié en la necesidad de considerar la amplitud del concepto de creencia en su genealogía histórica. Con base en ello estaríamos en condición de acercarnos a la visión doxástica moderada que han defendido autoras como Lisa Bortolotti. (shrink)

50 years after its introduction, brain death remains controversial among scholars. The debates focus on one question: is brain death a good criterion for determining death? This question has been answered from various perspectives: medical, metaphysical, ethical, and legal or political. Most authors either defend the criterion as it is, propose some minor or major revisions, or advocate abandoning it and finding better solutions to the problems that brain death was intended to solve when it was introduced. Here I plead (...) for a different approach that has been overlooked in the literature: the philosophy of science approach. Some scholars claim that human death is a matter of fact, a biological phenomenon whose occurrence can be determined empirically, based on science. We should take this claim seriously, whether we agree with it or not. The question is: how do we know that human death is a scientific matter of fact? Taking the philosophy of science approach means, among other things, examining how the determination of human death became an object of scientific inquiry, exploring the nature of the brain death criterion itself, and analysing the meaning of its core concepts such as “irreversibility” and “functions”. Objectives To increase postmortem organ donation rates, several countries are adopting an opt-out (presumed consent) policy, meaning that individuals are deemed donors unless they expressly refused so. Although opt-out countries tend to have higher donation rates, there is no conclusive evidence that this is caused by the policy itself. The main objective of this study is to better assess the direct impact of consent policy defaults per se on deceased organ recovery rates when considering the role of the family in (...) the decision-making process. This study does not take into account any indirect effects of defaults, such as potential psychological and behavioural effects on individuals and their relatives. -/- Design Based on previous work regarding consent policies, we created a conceptual model of the decision-making process for deceased organ recovery that included any scenario that could be directly influenced by opt-in or opt-out policies. We then applied this model to internationally published data of the consent process to determine how frequently policy defaults could apply. -/- Main outcome measures We measure the direct impact that opt-in and opt-out policies have per se on deceased organ recovery. -/- Results Our analysis shows that opt-in and opt-out have strictly identical outcomes in eight out of nine situations. They only differ when neither the deceased nor the family have expressed a preference and defaults therefore apply. The direct impact of consent policy defaults is typically circumscribed to a range of 0%–5% of all opportunities for organ recovery. Our study also shows that the intervention of the family improves organ retrieval under opt-in but hinders it under opt-out. -/- Conclusions This study may warn policy makers that, by emphasising the need to introduce presumed consent to increase organ recovery rates, they might be overestimating the influence of the default and underestimating the power granted to families. En metafísica contemporánea, es común trabajar bajo una metodología basada en virtudes teóricas. En caso de disputa, esta metodología nos aconseja elegir la teoría que mejor satisfaga las virtudes teóricas estándar: precisión empírica, fecundidad, poder unificador, consistencia y simplicidad. Sin embargo, no hay consenso sobre cómo deben frasearse tales virtudes, ni sobre cómo ponderarlas. Aquí me concentraré en ofrecer razones a favor de una manera de frasear el principio de parsimonia ideológica, una especie de simplicidad. The Uniform Determination of Death Act (UDDA) provides that “an individual who has sustained either (1) irreversible cessation of circulatory and respiratory functions or (2) irreversible cessation of all functions of the entire brain, including the brain stem, is dead.” We show that the UDDA contains two conflicting interpretations of the phrase “cessation of functions.” By one interpretation, what matters for the determination of death is the cessation of spontaneous functions only, regardless of their generation by artificial means. By the (...) other, what matters is the cessation of both spontaneous and artificially supported functions. Because each UDDA criterion uses a different interpretation, the law is conceptually inconsistent. A single consistent interpretation would lead to the conclusion that conscious individuals whose respiratory and circulatory functions are artificially supported are actually dead, or that individuals whose brain is entirely and irreversibly destroyed may be alive. This dissertation focuses on teleology and functions in biology. More precisely, it focuses on the scientific legitimacy of teleofunctional attributions and explanations in biology. It belongs to a multi-faceted debate that can be traced back to at least the 1970s. One aspect of the debate concerns the naturalization of functions. Most authors try to reduce, translate or explain functions and teleology in terms of efficient causes so that they find their place in the framework of the natural sciences. Our approach (...) here is radically different, as we question the premise that teleological explanations are disguised causal explanations. On the contrary, we defend that they are acceptable in natural sciences and in biology in particular. We challenge the idea that teleological explanations are immature causal explanations, as well as the idea that teleology and functions are some sort of intentional explanations. We therefore reject the accusations of anthropomorphism, vitalism and finalism. On the contrary, we defend that teleology, causality and intentionality correspond to different, autonomous and complementary modes of representation of the outside world. -/- ———[FRANÇAIS]——— -/- Ce travail de thèse porte sur la téléologie et les fonctions en biologie. Plus précisément, il porte sur la légitimité scientifique des attributions et des explications téléofonctionnelles en biologie. Il s’inscrit dans le cadre d’un débat à plusieurs facettes que l’on peut faire remonter au moins jusqu’aux années 1970 et qui est encore très actif aujourd’hui. L’un des aspects du débat porte sur la naturalisation des fonctions, c’est-à-dire sur la manière de les réduire, de les traduire ou de les expliciter en termes de causes efficientes de sorte qu’elles trouvent leur place dans le cadre des sciences de la nature. Notre approche ici est radicalement différente, car nous remettons en question la prémisse selon laquelle les explications téléologiques seraient des explications causales déguisées. Nous défendons au contraire qu’elles sont acceptables en tant que telles aussi bien de façon générale que dans le domaine scientifique et en particulier en biologie. De façon générale, nous remettons en question l’idée selon laquelle la pensée téléologique serait une pensée causale immature, ainsi que sa dépendance présumée vis-à-vis de la psychologie, c’est-à-dire de l’intentionnalité. Nous rejetons donc les accusations d’anthropomorphisme, de vitalisme et de finalisme formulées contre elle. El arte no es solamente una fuente inagotable de goce estético, es además una huella, una evidencia de nuestro pasado histórico. A partir del arte es posible remitirnos a nuestra raíz cultural, y es por eso que la obra artística constituye una parte importante del patrimonio de un pueblo. Es evidente el estrecho vínculo entre el patrimonio artístico y la identidad cultural; por eso es importante dar un justo valor a ese patrimonio que, a su vez, se reflejará en la (...) consolidación de una identidad propia. De esas expresiones tomamos únicamente las de la arquitectura de algunas iglesias barrocas. En ellas podemos notar una serie de variables del mestizaje cultural. La arquitectura del barroco novohispano, como uno de los lenguajes del arte, generó una reflexión sobre la identidad del individuo iberoamericano. (shrink)

According to the Principle of Alternative Possibilities, an agent is morally responsible for an action of hers only if she could have done otherwise. The notion of a robust alternative plays a prominent role in recent attacks on PAP based on so-called Frankfurt cases. In this paper I defend the truth of PAP for blameworthy actions against Frankfurt cases recently proposed by Derk Pereboom and David Widerker. My defence rests on some intuitively plausible principles that yield a new understanding of (...) the concept of a robust alternative. I will leave aside whether PAP also holds for praiseworthy actions -/- Según el Principio de Posibilidades Alternativas, un agente es moralmente responsable de una acción sólo si hubiera podido actuar de otro modo. La noción de alternativa robusta desempeña un papel prominente en ataques recientes al PPA basados en los llamados casos Frankfurt. En este artículo defiendo el PPA para la culpabilidad moral frente a casos Frankfurt propuestos recientemente por Derk Pereboom y David Widerker. Mi defensa descansa en algunos principios intuitivamente plausibles que dan lugar a una comprensión nueva del concepto de alternativa robusta. Is the boundary between the normal and the pathological real or fiction? Are health and disease just a matter of fact or are they value-laden? Here we present some examples of how alleged diseases can be invented and propagated by the industry (disease mongering) or by the methodology of medical science itself. We show that the boundary between health and disease is blurred and depends on individual and social representations, culture relative ways of categorising things and people, and by the (...) society’s degree of medicalisation. However, we do not mean that it is not real, rather that it is more complex than expected, as the subjectivity of social constructions and individual experiences makes them no less real. Finally, we conclude that health and disease belong to both objective and subjective kinds of reality, so the fictional can be real. (shrink)

Some metaphysicians believe that metaphysical modality is explainable by the essences of objects. In §II, I spell out the definitional view of essence, and in §III, a working notion of metaphysical explanation. Then, in §IV, I consider and reject five natural ways to explain necessity by essence: in terms of the principle that essential properties can't change, in terms of the supposed obviousness of the necessity of essential truth, in terms of the logical necessity of definitions, in terms of Fine's (...) logic of essence, and in terms of the theory of real definitions. I will conclude that the present evidence favours rejecting the hypothesis that modality is explainable by essence. (shrink)

In this work we argue that there is no strong demarcation between pure and applied mathematics. We show this first by stressing non-deductive components within pure mathematics, like axiomatization and theory-building in general. We also stress the “purer” components of applied mathematics, like the theory of the models that are concerned with practical purposes. We further show that some mathematical theories can be viewed through either a pure or applied lens. These different lenses are tied to different communities, which endorse (...) different evaluative standards for theories. We evaluate the distinction between pure and applied mathematics from a late Wittgensteinian perspective. We note that the classical exegesis of the later Wittgenstein’s philosophy of mathematics, due to Maddy, leads to a clear-cut but misguided demarcation. We then turn our attention to a more niche interpretation of Wittgenstein by Dawson, which captures aspects of the aforementioned distinction more accurately. Building on this newer, maverick interpretation of the later Wittgenstein’s philosophy of mathematics, and endorsing an extended notion of meaning as use which includes social, mundane uses, we elaborate a fuzzy, but more realistic, demarcation. This demarcation, relying on family resemblance, is based on how direct and intended technical applications are, the kind of evaluative standards featured, and the range of rhetorical purposes at stake. Epistemic Utility Theory is often identified with the project of *axiology-first epistemology*—the project of vindicating norms of epistemic rationality purely in terms of epistemic value. One of the central goals of axiology-first epistemology is to provide a justification of the central norm of Bayesian epistemology, Probabilism. The first part of this paper presents a new challenge to axiology first epistemology: I argue that in order to justify Probabilism in purely axiological terms, proponents of axiology first epistemology need to justify a (...) claim about epistemic value—what I label ‘Downwards Propriety’—much stronger than any they have offered justification. The second part of this paper offers an argument that this challenge cannot be met: that there is no hope for providing a purely axiological justification of Downwards Propriety, at least given widely accepted assumptions about epistemic value. This paper is a critical comment on an article of David Widerker which also appeared in the Journal of Philosophy. In this article, Wideker held, against positions previously defended by him, that in was possible to design effective counterexamples, in the line initiated by Harry Frankfurt in 1969, to the so-called “Principle of Alternative Possibilities”. The core of my criticism of Widerker is to deny that agents, in his putative counterexamples, are morally responsible for their decisions, owing to the fact (...) they are not able to respond appropriately to moral reasons. Como todo sistema, uma filosofia sistemática se define por um conjunto de elementos que se compõem e se alinham de modo a conferir a ele uma coerência. O presente artigo pretende demonstrar como o conjunto da filosofia de Deleuze confere uma organicidade e verosimilhança a seu sistema de pensamento a partir da articulação entre (...) a imanência, o acontecimento e o conceito. Esta tríade atravessa todo o seu trabalho e irá caracterizar aquilo que Deleuze chama de heterogênese; uma tentativa de fazer com que a filosofia se desprenda dos estados de coisas e vá na direção das intensidades, levando o pensamento ao limite e à máxima potência. Queremos demonstrar o modo como Deleuze opera em seu sistema de forma a associar e criar aproximações entre elementos mais ou menos heterogêneos, ora criando zonas de aproximação, ora provocando afastamentos. In this article I will begin by discussing recent criticism, by Mauro Antonelli and Werner Sauer, of the ontological interpretation of Franz Brentano’s concept of intentionality, as formulated by i.a. Roderick Chisholm. I will then outline some apparent inconsistencies of the positions advocated by Antonelli and Sauer with Brentano’s formulations of his theory in several works and lectures. This new evaluation of (unpublished) sources will then lead to a sketch of a new approach to Brentano’s theory of intentionality. Specifically, it (...) will be argued that the notion of “intentional object” is inherently and un- avoidably ambiguous in every act of external perception, due to the fact that we can only have improper intentions directed at the external world. Abstract Nowadays, there is a deep and widespread feeling of discomfort among academics due to the psychological and labor pressures that universities exert upon their researchers by demanding endless publications. In this paper, I offer numerous pieces of evidence of this crisis, which affects primarily those who inhabit academic ecologies. First, I argue that it is convenient to understand the current situation as an expression of technologies and individual apparatuses shaped by subjectivizing ideologies, and mechanisms of exclusion, stigmatization, and replacement. (...) Second, I examine two proposals against the crisis produced by the pace of academic production framed by the Slow movement. Lastly, after making explicit some of the assumptions that undergird the university’s epistemological machine, I propose to complement Ulmer and Mountz’s project with two suggestions. On the one hand, I extend an invitation to reflect on and with students as a means to redirect the university’s teleology. On the other hand, I suggest incorporating an ontogogic approach as a resistance apparatus against the pressure from the university’s production machine. The article’s point of departure is anti-dicotonegative because it is based on a summative approach rather than in an agonistic procedure. In other words, I propose two additional tools that can be put to the test to contribute to solving the university publication crisis. (shrink)

On a view implicitly endorsed by many, a concept is epistemically better than another if and because it does a better job at ‘carving at the joints', or if the property corresponding to it is ‘more natural' than the one corresponding to another. This chapter offers an argument against this seemingly plausible thought, starting from three key observations about the way we use and evaluate concepts from en epistemic perspective: that we look for concepts that play a role in explanations (...) of things that cry out for explanation; that we evaluate not only ‘empirical' concepts, but also mathematical and perhaps moral concepts from an epistemic perspective; and that there is much more complexity to the concept/property relation than the natural thought seems to presuppose. These observations, it is argued, rule out giving a theory of conceptual evaluation that is a corollary of a metaphysical ranking of the relevant properties. -/- conceptual ethics, explanation, naturalness, epistemic value, concept/property, semantic internalism. With millions of animals brought into existence and raised for food every year, their negative impact upon the environment and the staggering growth in the number of chronic diseases caused by meat and dairy diets make a global move toward ethical veganism imperative. Typi-cally, utilitarians and deontologists have led this discussion. The purpose of this paper is to pro-pose a virtuous approach to ethical veganism. Virtue ethics can be used to construct a defense of ethical veganism by relying on the (...) virtues of compassion and fairness. Exercising these values in our relations with animals involves acknowledging their moral value, thus seeing that they are not our property or our food. It is important to emphasize that this argument applies only to well-developed societies that need not rely upon animals as sources of food, clothing, and various by-products. (shrink)

The topic of this article is consciousness and, in it, I will theorize what consciousness is like and where it arises from. The work began to emerge and develop over time starting from my belief that consciousness is a physical self-referential phenomenon; thus, my attention was focused on the research for a self-referential process. I was confident that I could satisfy my curiosity through the reductionist method adopted by science. Unfortunately, neuroscientists and philosophers of mind realized that the attempts to (...) explain consciousness with this method have all proved inconclusive. For this reason, they are now trying to address the problem of consciousness with non-reductionist methods. As for me, I have always remained faithful to reductionism, but with the conviction that quantum mechanics, even though capable of making predictions with an extraordinary degree of accuracy, is a theory founded on wrong concepts. Thus, surprisingly, I have found a solution to the mystery of consciousness, perceiving a way to explain what it is like at its fundamental level in the field of quantum mechanics and, particularly, in one of its counterintuitive and generally less debated aspects among physicists today, but which aroused great interest in me: I am referring to the spin of the electron that will be described in this paper as a self-interacting process. This paper will also offer a rational explanation of the results obtainable in all experiments for measuring the spin of electrons through Stern-Gerlach magnets. In addition, my theory of consciousness is susceptible to experimental control. (shrink)

Constituting the object or content of New Testament preaching, salvation is made available by the kerygma as a proclamation of the Gospel that concludes God’s saving act and implies an exhortation to conversion that is based on the person and work of Jesus as Christ and Lord and Son of God and the soteriological facts of his death and resurrec-tion. In this way, Prof. Luiz Carlos Mariano Da Rosa, faced with the issue involving the primacy of either the historical-Christological (...) tradition or the pneumatic-Christological preaching, points out that preaching converges to kerygmatic communication as a public announcement in relation to the promise and claims of the salvific event, converging to a tradition that witnesses salvific processes based on faith, constituting the Gospel as a pneumatic-kerygmatic tradition. Thus, the article focuses on the Christological kerygma as an event that encloses God as loquitur in Barth, which consists of an announcement involving an event yet to be realized (Ankündigung) in a process that presupposes that God speaks through a relationship that attributes to the human the function of announ-cing (Ankündigen) such a situation. Overriding the meaning that the kerygma of Jesus as the Messiah contains as content that imposes itself on the Old Testament tradition under the meaning of an additional ethical-religious and literary-theological value, the proclamation, according to Bultmann, constitutes the primary and basic that gives its character both in relation to ancient tradition and in relation to the preaching of Jesus in a process that maintains the entire past under another interpretative principle. In this way, overriding historical phenomena and their mere description, Bultmann elaborates a theological-philosophical construction that, through the use of scientific thought and the establishment of an existential interpretation, ends the claim of highlighting the true meaning of the message, converging on the borders that expose the current situation of human beings and the need for faith as decision and obedience. Abstract: This paper is a response to Park Seungbae’s article, “Defence of Cultural Relativism”. Some of the typical criticisms of moral relativism are the following: moral relativism is erroneously committed to the principle of tolerance, which is a universal principle; there are a number of objective moral rules; a moral relativist must admit that Hitler was right, which is absurd; a moral relativist must deny, in the face of evidence, that moral progress is possible; and, since every individual belongs to (...) multiple cultures at once, the concept of moral relativism is vague. Park argues that such contentions do not affect moral relativism and that the moral relativist may respond that the value of tolerance, Hitler’s actions, and the concept of culture are themselves relative. In what follows, I show that Park’s adroit strategy is unsuc-cessful. Consequently, moral relativism is incoherent. (shrink)
