  1. Alexis de Tocqueville’s Citizenship: A Model of Collective Virtue (unofficial draft).Maura Priest - forthcoming - In Peter J. Boettke and Adam Martin (ed.), The Political Economy of Alexis de Tocqueville.
In this chapter I argue that Alexis de Tocqueville describes the virtue of citizenship in a way that is relevant to contemporary virtue ethics. He explains how a group can possess a virtue that is distinct from the virtue of individual members of the group. (this is an unofficial draft).

  2. On Law as Poetry: Shelley and Tocqueville.Joshua M. Hall - forthcoming - South African Journal of Philosophy 3 (40).
Consonant with the ongoing “aesthetic turn” in legal scholarship, this article pursues a new conception of law as poetry. Gestures in this law-as-poetry direction appear in all three main schools in the philosophy of law’s history, as follows. First, natural law sees law as divinely-inspired prophetic poetry. Second, positive law sees the law as a creative human positing (from poetry’s poesis). And third, critical legal theory sees these posited laws as calcified prose prisons, vulnerable to poetic liberation. My first two (...)

  4. What Has Athens to Do with Rome? Tocqueville and the New Republicanism.Alexander Jech - 2017 - American Political Thought 6 (4):550-573.
The recent debate over “republican” conceptions of freedom as non-domination has re- invigorated philosophical discussions of freedom. However, “neo-Roman” republicanism, which has been characterized as republicanism that respects equality, has largely ignored the work of Alexis de Tocqueville, although he too took his task to be crafting a republicanism suited to equality. I therefore provide a philosophical treatment of the heart of Tocqueville’s republicanism, including an analysis of his conception of freedom as freedom in combined action and a (...)

For Alexis de Tocqueville, a faithful son of the Enlightenment, the priority given to the individual in the pursuit of truth represents the starting point of an inexorable march of equality towards individual autonomy. In other words, in agreement with the historicist movements of the 19th Century, Tocqueville interprets history as a dialectical progress: History understood as progress in the Hegelian sense, whose becoming unfolds in virtue of a steady and unalterable progress towards a better society-civilization as a (...)

[from the publisher's website] Questions about the existence and attributes of God form the subject matter of natural theology, which seeks to gain knowledge of the divine by relying on reason and experience of the world. Arguments in natural theology rely largely on intuitions and inferences that seem natural to us, occurring spontaneously—at the sight of a beautiful landscape, perhaps, or in wonderment at the complexity of the cosmos—even to a nonphilosopher. In this book, Helen De Cruz and Johan De (...)

Speculative fiction, such as science fiction and fantasy, has a unique epistemic value. We examine similarities and differences between speculative fiction and philosophical thought experiments in terms of how they are cognitively processed. They are similar in their reliance on mental prospection, but dissimilar in that fiction is better able to draw in readers (transportation) and elicit emotional responses. By its use of longer, emotionally poignant narratives and seemingly irrelevant details, speculative fiction allows for a better appraisal of the consequences (...)

In this chapter we give an overview of current and historical conceptions of the nature of obsessions and compulsions. We discuss some open questions pertaining to the primacy of the affective, volitional or affective nature of obsessive-compulsive disorder (OCD). Furthermore, we add some phenomenological suggestions of our own. In particular, we point to the patients’ need for absolute certainty and the lack of trust underlying this need. Building on insights from Wittgenstein, we argue that the kind of certainty the patients (...)

Perplexity is an epistemic emotion with deep philosophical significance. In ancient Greek philosophy, it is identified as a catalyst for philosophical progress and personal philosophical transformation. In psychological terms, perplexity is the phenomenological sense of lacking immersion in the world, a state of puzzlement and alienation from one’s everyday surroundings. What could make such an emotion philosophically useful? To answer this question, I examine the role of perplexity in Jane Addams’s political theory and ethics. Addams, a social reformer and American (...)

My aim in this chapter is to explore an analogy between logic and ethics, as Wittgenstein understands them in the Tractatus. First, I argue that Wittgenstein regards logic as a condition of the possibility of meaning, in the sense that logic makes meaningful language and thought possible. Second, I ask why Wittgenstein calls both logic and ethics ‘transcendental’. I suggest that, while logic is a condition of the possibility of semantic meaning, ethics is a condition of the possibility of existential (...)

If there is an area of discourse in which disagreement is virtually absent, it is mathematics. After all, mathematicians justify their claims with deductive proofs: arguments that entail their conclusions. But is mathematics really exceptional in this respect? Looking at the history and practice of mathematics, we soon realize that it is not. First, deductive arguments must start somewhere. How should we choose the starting points (i.e., the axioms)? Second, mathematicians, like the rest of us, are fallible. Their ability to (...)

Giacomo Leopardi, a major Italian poet of the nineteenth century, was also an expert in evil to whom Schopenhauer referred as a “spiritual brother.” Leopardi wrote: “Everything is evil. That is to say, everything that is, is evil; that each thing exists is an evil; each thing exists only for an evil end; existence is an evil.” These and other thoughts are collected in the Zibaldone, a massive collage of heterogeneous writings published posthumously. A subset of these modifications is the developmental niche, which concerns ecological, epistemic, social and symbolic legacies inherited by organisms as resources that scaffold their developmental processes. Since in this theory development is a situated process that takes place in a culturally structured environment, we may reasonably ask if implicit cultural biases may, in some cases, be responsible for maladaptive developmental niches. 43. Husserl, Heidegger, and the Task of a Phenomenology of Justice.
The article investigates the Husserl-Heidegger relationship, beyond their historical contributions to both phenomenology and hermeneutics as new methods in philosophy, by articulating ontology and subjectivity through asemantic, linguistic paradigm, so as to delineate the task of a phenomenology (...)

  44. A Wittgensteinian Account of Free Will and Moral Responsibility.Stefan Rummens & Benjamin De Mesel - 2023 - In Cecilie Eriksen, Julia Hermann, Neil O'Hara & Nigel Pleasants (eds.), Philosophical perspectives on moral certainty. New York, NY: Routledge. pp. 132-155.
In this chapter we deal with the challenge to the existence of free will and moral responsibility that is raised by the threat of determinism from a Wittgensteinian perspective. Our argument starts by briefly recapitulating Wittgenstein’s analysis of the practice of doubt in On Certainty. We subsequently turn to the problem of free will. We argue that the existence of free will is a basic certainty and that the thesis of determinism fails to cast doubt on it. We thereby make (...)

Childhood looms large in our understanding of human life as it is a phase through which all adults have passed. Childhood is foundational to the development of selfhood, the formation of interests, values and skills and to the lifespan as a whole. Understanding what it is like to be a child, and what differences childhood makes, are essential for any broader understanding of the human condition. The Routledge Handbook of the Philosophy of Childhood and Children is an outstanding reference source (...)

  49. The Relevance of Cosmopolitanism for Moral Education.Michael S. Merry & Doret J. de Ruyter - 2011 - Journal of Moral Education 40 (1):1-18.
In this article we defend a moral conception of cosmopolitanism and its relevance for moral education. Our moral conception of cosmopolitanism presumes that persons possess an inherent dignity in the Kantian sense and therefore they should be recognised as ends‐in‐themselves. We argue that cosmopolitan ideals can inspire moral educators to awaken and cultivate in their pupils an orientation and inclination to struggle against injustice. Moral cosmopolitanism, in other words, should more explicitly inform the work that moral educators do. Real‐world constraints (...)
