Le déficit d’explicabilité des techniques d’apprentissage machine (AM) pose des problèmes opérationnels, juridiques et éthiques. Un des principaux objectifs de notre projet est de fournir des explications éthiques des sorties générées par une application fondée sur de l’AM, considérée comme une boîte noire. La première étape de ce projet, présentée dans cet article, consiste à montrer que la validation de ces boîtes noires diffère épistémologiquement de celle mise en place dans le cadre d’une modélisation mathématique et causale d’un phénomène physique. (...) La différence majeure est qu’une méthode d’AM ne prétend pas représenter une causalité entre les paramètres d’entrées, qui peuvent être de plus de haute dimensionnalité, et ceux de sortie. Nous montrons dans cet article l’intérêt de mettre en œuvre les distinctions épistémologiques entre les différentes fonctions épistémiques d’un modèle, d’une part, et entre la fonction épistémique et l’usage d’un modèle, d’autre part. Je soutiens que la prise en compte de Lotze dans la genèse de la phénoménologie du jeune Husserl fournit de nouveaux éléments qui supportent la lecture frégéenne de la phénoménologie. Pour ce faire, je vais d’abord retracer l’origine lozéenne des questions épistémologiques issues du développement de la nouvelle psychologie et de la logique au milieu du XIXe siècle en Allemagne et j’insisterai sur l’apport de trois de ses étudiants prestigieux; je montrerai ensuite que Husserl a acquis sa connaissance de cette (...) problématique via sa fréquentation de Brentano et de Stumpf; je me pencherai ensuite sur la tournant antipsychologiste de Husserl au milieu des années 1890 et examinerai brièvement un manuscrit de Husserl intitulé « Microcosmos » qui date de cette même période et qui montre clairement l’apport de la logique de Lotze dans ce tournant antipsychologiste; j’examinerai enfin brièvement l’apport de Lotze dans la critique que Husserl adresse au psychologisme logique dans ses Prolégomènes. Je conclurai avec quelques remarques sur l’importance de Lotze dans la phénoménologie de Husserl après la publication des Recherches logiques. (shrink)

Mon objectif dans cette étude est de montrer l'influence que la philosophie positive d'Auguste Comte a exercée sur la pensée du jeune Brentano durant la période de Würzburg (1866-1874). J'examine d'abord quelques-uns des facteurs qui ont amené Brentano à s'intéresser à la philosophie de Comte et je résume, dans un deuxième temps, les grandes lignes de l'article de Brentano sur Comte dont la version française est reproduite dans ce numéro. Dans la troisième partie de cette étude, je commente brièvement quelques (...) passages de la Psychologie d'un point de vue empirique où Brentano discute de thèmes comtiens. Je conclue cette étude par quelques remarques sur les traces laissées par le positivisme de Comte dans l'œuvre de Brentano. (shrink)

Introduction au numéro spécial de la Revue philosophique de la France et de l'étranger en hommage au centenaire de la mort de Franz Brentano.

This study seeks to trace the boundaries of the sign in the phenomenological tradition of Edmund Husserl. The approach adopted here is largely historical and has no other ambition that to identify those questions that pertain to the sign and have been of interest for phenomenology. The article is divided in four parts : the first examines an essay from 1890 entitled Semiotik and situates it in the context of the young Husserl's work in the philosophy of mathematics ; the (...) second part concerns the first section of the Logical Investigations ; the third one seeks to account for the changes that testify to the evolution of Husserl's thinking regarding the sign between the Logical Investigations (1900-01) and "Origins of Geometry" (1936) ; the last part considers the contribution of post-Husserlian phenomenology, from Martin Heidegger to Merleau-Ponty and beyond, to semiotics. -/- Résumé. Notre étude vise à délimiter l'espace dans lequel la question du signe s'est posée à la tradition phénoménologique depuis Edmund Husserl. Cette étude est largement historique et elle n'a d'autres ambitions que d'identifier certains aspects de la question du signe qui ont suscité l'intérêt de la phénoménologie. Je me propose de réfléchir ici sur la place de plus en plus importante qu’occupe la psychologie intentionnelle dans la phénoménologie transcendantale de Husserl à partir du milieu des années 1920. Pour ce faire, je commencerai par fournir quelques indications que l’on retrouve dans plusieurs textes appartenant à la dernière période de Freiburg sur ce qu’on pourrait appeler une réhabilitation de la psychologie au sein de la phénoménologie transcendantale et le projet d’une psychologie eidétique ; dans la deuxième partie, je (...) présente l’arrière-plan de cette problématique en rappelant la définition de la phénoménologie des Recherches logiques dans les termes de Brentano d’une psychologie descriptive et en rappelant les motifs qui ont amené Husserl, après la publication de cet ouvrage, à se dissocier nettement de cette définition. Je me demande ensuite ce qui motive ce nouvel intérêt de Husserl pour la psychologie dans la dernière version de sa phénoménologie et j’avance trois des facteurs qui me semblent justifier la réhabilitation, sur le tard, de la psychologie intentionnelle dans la phénoménologie : l’identification partielle de la phénoménologie avec la psychologie eidétique, le parallélisme entre les dimensions psychologique et philosophique de la phénoménologie et enfin la critique de la voie cartésienne et l’adoption de la voie psychologique de la réduction. Cette réhabilitation de la psychologie dans le giron de la phénoménologie soulève deux questions importantes dont je traiterai brièvement dans la dernière partie de cette étude. La première porte sur une version du psychologisme qu’il appelle, sur le tard, le psychologisme transcendantal ; la deuxième concerne les nombreuses références à Brentano durant cette période et elle porte sur la dette de cette version de la phénoménologie à l’égard de Brentano. I defend a one category ontology: an ontology that denies that we need more than one fundamental category to support the ontological structure of the world. Categorical fundamentality is understood in terms of the metaphysically prior, as that in which everything else in the world consists. One category ontologies are deeply appealing, because their ontological simplicity gives them an unmatched elegance and spareness. I’m a fan of a one category ontology that collapses the distinction between particular and property, replacing it (...) with a single fundamental category of intrinsic characters or qualities. We may describe the qualities as qualitative charactersor as modes, perhaps on the model of Aristotelian qualitative (nonsubstantial) kinds, and I will use the term “properties” interchangeably with “qualities”. The qualities are repeatable and reasonably sparse, although, as I discuss in section 2.6, there are empirical reasons that may suggest, depending on one’s preferred fundamental physical theory, that they include irreducibly intensive qualities. There are no uninstantiated qualities. I also assume that the fundamental qualitative natures are intrinsic, although physics may ultimately suggest that some of them are extrinsic. On my view, matter, concrete objects, abstract objects, and perhaps even spacetime are constructed from mereological fusions of qualities, so the world is simply a vast mixture of qualities, including polyadic properties (i.e., relations). This means that everything there is, including concrete objects like persons or stars, is a quality, a qualitative fusion, or a portion of the extended qualitative fusion that is the worldwhole. I call my view mereological bundle theory. (shrink)

The most common way of dealing with the fear of death is denying death. Such denial can take two and only two forms: strategy 1 denies the finality of death; strategy 2 denies the reality of the dying subject. Most religions opt for strategy 1, but Buddhism seems to be an example of the 2nd. All variants of strategy 1 fail, however, and a closer look at the main Buddhist argument reveals that Buddhism in fact does not follow strategy 2. (...) Moreover, there is no other theory that does, and neither can there be. This means that there is no tenable theory that denies death. There may be no universally psychologically acceptable alternative, however, which would mean that if denying death is incoherent, this is an unavoidable incoherence. (shrink)

This paper asks whether prisoners should have access to Pell Grants, for which they are currently ineligible. In the first section, the author considers philosophical arguments relating to the present ban by examining traditional concerns of deterrence, rehabilitation, and retribution. The second section explores two arguments against a more inclusive Pell Grant policy. In the third section the author argues that restoring higher education grants to prisoners is compelling, especially when one considers issues of race and class. The paper concludes (...) by using Erich Fromm’s social theory to call into question the justice, ethics, and rationality of those societies that normalize mass incarceration. (shrink)

Politics, Philosophy & Economics, Volume 21, Issue 2, Page 165-189, May 2022. It is generally acknowledged that a certain amount of state intervention in health and health care is needed to address the significant market failures in these sectors; however, it is also thought that the primary rationale for state involvement in health must lie elsewhere, for example in an egalitarian commitment to equalizing access to health care for all citizens. This paper argues that a complete theory of justice (...) in health can be derived from a commitment to correcting market failure, or in other words promoting Pareto-efficiency, in the domain of health. This approach can address familiar problems around access to care, as well as problems related to resource allocation and rationing, the control of health care costs, and the foundations of public health. Egalitarian theories of justice in health cannot make sense of the depth and pervasiveness of state involvement in health and health care; only a theory rooted in the need to correct market failure can. Two problems are considered here. One relates to who has moral status, and the other relates to who has moral responsibility. The criteria for mattering morally have long been disputed, and many humans and nonhuman animals have been considered “marginal cases,” on the contested edges of moral considerability and concern. The marginalization of humans and other species is frequently the pretext for denying their rights, including the rights to health care, to reproductive freedom, and to bodily autonomy. There is broad (...) agreement across cultural and philosophical traditions about the capacities and responsibilities of moral agents. I propose an inclusive and expansive way of thinking about moral status, situating it not in the characteristics or capacities of individuals, but in the responsibilities and obligations of moral agents. Moral agents, under this view, are not privileged or entitled to special treatment but rather have responsibilities. I approach this by considering some African communitarian conceptions of moral status and moral agency. I propose that moral agency can also be more expansive and include not just individual moral agents but collective entities that have some of the traits of moral agents: power, freedom, and the capacity to recognize and act on the demands of morality and acknowledge and respect the rights of others. Expanding who and what is a moral agent correspondingly extends moral responsibility for respecting rights and fostering the conditions for the health and well-being of humans and animals onto the collective entities who uniquely have the capacity to attend to global-scale health threats such as pandemics and human-caused climate change. In 1672 John Eliot, English Puritan educator and missionary to New England, published The Logick Primer: Some Logical Notions to initiate the INDIANS in the knowledge of the Rule of Reason; and to know how to make use thereof (Eliot 1672) The Logick Primer: Some Logical Notions to Initiate the INDIANS in the Knowledge of the Rule of Reason; and to Know How to Make Use Thereof, Cambridge, MA: Marmaduke Johnson]. This roughly 80 page pamphlet introduces syllogistic vocabulary and (...) reasoning so that syllogisms can be created from Biblical texts. The use of logic for proselytizing purposes is not distinctive: What is distinctive about Eliot's book is that it is bilingual, written in both English and Massachusett (Wôpanâak), an Algonquian language spoken in eastern coastal and southeastern Massachusetts. It is one of the earliest bilingual logic textbooks and it is the first, and perhaps only, textbook in an indigenous American language.In this paper, we (1) introduce John Eliot and the linguistic context he was working in; (2) introduce the contents of the Logick Primer – vocabulary, inference patterns, and applications; (3) discuss notions of ‘Puritan’ logic that inform this primer; and (4) address the importance of his work in documenting and expanding the Massachusett language and the problems that accompany his colonial approach to this work. In 2010, pitcher Armando Galarraga was denied a perfect game when umpire Jim Joyce called Jason Donald safe at first with two outs in the bottom of the 9th. In the numerous media discussions that followed, Joyce’s ‘blown’ call was commonly referred to as ‘mistaken’, ‘wrong’, or otherwise erroneous. However, this use of language makes some not uncontroversial ontological assumptions. It claims that the fact that a runner is safe or out has nothing to do with the ruling of the (...) umpire himself, but rather with some state of the universe that does not depend on the umpire for its existence. In this paper, I recast the problem as a version of Plato’s Euthyphro Dilemma and argue that the view implied by the above assertions is actually misguided. Instead, I hope to show that an alternative view – what I call ‘restricted umpire voluntarism’ – is actually more in line with the spirit of the game of baseball and is not as counterintuitive as it may appear.. Metaethical expressivism is typically characterised as the view that normative statements express desire-like attitudes instead of beliefs. However, in this paper I argue that expressivists should claim that normative statements express beliefs in normative propositions, and not merely in some deflationary sense but in a theoretically robust sense explicated by a theory of propositional attitudes. I first argue that this can be achieved by combining an interpretationist understanding of belief with a nonfactualist view of normative belief content. This results in (...) a view I call ‘interpretative expressivism’. I then argue that traditional arguments employed by expressivists that normative statements express noncognitive attitudes can just as well support the claim that normative statements express nonfactual or nonrepresentational beliefs. Finally, I argue that this view has a number of advantages to versions of expressivism that deny that normative statements express non-deflationary normative beliefs. (shrink)

The idea behind this special theme journal issue was to continue the work we have started with the INBIOSA initiative (www.inbiosa.eu) and our small inter-disciplinary scientific community. The result of this EU funded project was a white paper (Simeonov et al., 2012a) defining a new direction for future research in theoretical biology we called Integral Biomathics and a volume (Simeonov et al., 2012b) with contributions from two workshops and our first international conference in this field in 2011. The initial impulse (...) for this effort was given a year earlier by a publication of one of the guest editors of this issue (Simeonov, 2010) in this journal. This time we wish to provide a broader forum and more space to elaborate in detail some of the most interesting concepts we have encountered in our discussions, as well as to invite some new contributions of particular interest in the field. Another goal we had in mind was to collect and review as many provocative perspectives as possible on the same key topic we are interested before making a decision to follow a more focused notion that would lead to a funded research program. Therefore we welcomed the generous suggestion of Professor Denis Noble, FRS, who is also editor of this journal to prepare a special theme issue entitled: “Can biology create a profoundly new mathematics and computation?” It has taken a while to invite and collect the contributions. Most of them had a couple of revision cycles and adjustments after having been thoroughly discussed with colleagues, incl. the editors of this issue. We think that the result we have obtained at the end is a satisfactory one, since we succeeded to integrate a diversity of original, but sometimes controversial and mutually excluding concepts organized within chapters of a self-contained volume. The task of compiling all this was not easy at all. Despite our efforts to position the articles of different authors and themes in a way allowing their easy comprehension and relation to each other within the individual chapters, some of them still require a sort of introduction to dissolve possible ambiguities. This is what we are going to do in the following few paragraphs with the hope that the reader (and some of the authors) would excuse our failures. (shrink)

ABSTRACT This article examines the under-researched figure A.W. Rehberg in his exchange with Kant over the relationship between theory and practice in the philosophy of right. I argue that Rehberg raises, what I call, two problems of political matter which attempt to show that Kant's overly formal approach to political theory cannot justifiably determine political practice. The first problem is the problem of positive determinations of right, rather than merely negative prohibitions. Rehberg takes this to mean that Kant cannot determine (...) us to a specific form of constitution. I argue that Kant's innovation of intelligible property functions as a response to this critique in that it provides the possibility of synthetic propositions of right a priori. Second, Rehberg insists that an a priori system of right cannot relate to already formed historical communities. Here Kant's response comes close to agreeing with Rehberg as Kant takes prudential or historical reasoning to harmonize with the demands of a priori right in order to applied to the sensible world. Kant, in this instance, comes closer to Rehberg by denying centralized enlightened monarchy and the reliance on natural and historical development for the application of right. (shrink)

I argue via examples that there are cases in which things that are not two distinct things qualitatively differ without contradiction. In other words, there are cases in which something differs from itself. Standard responses to such cases are to divide the thing into distinct parts, or to conceive of the thing under different descriptions, or to appeal to different times, or to deny that the property had is the property lacked. I show these responses to be unsatisfactory. I then (...) gather and systematize available ways of talking about such cases with phrases like ‘insofar as’, ‘qua’, ‘to the extent that’, ‘in some respect’, etc., while paying special attention to the scope of ‘not’ when used with these phrases. This allows me to show how we can speak of self-differing without contradiction. (shrink)

Expressivists about normative thought and discourse traditionally deny that there are nondeflationary normative propositions. However, it has recently been suggested that expressivists might avoid a number of problems by providing a theory of normative propositions compatible with expressivism. This paper explores the prospects for developing an expressivist theory of propositions within the framework of cognitive act theories of propositions. First, I argue that the only extant expressivist theory of cognitive propositions—Michael Ridge's ‘ecumenical expressivist’ theory—fails to explain identity conditions for normative (...) propositions. Second, I argue that this failure motivates a general constraint—the ‘unity requirement’—that any expressivist theory of propositions must provide a unified nonrepresentational explanation of that in virtue of which propositional attitudes have the content that they have. Third, I argue that conceptual role accounts of content provide a promising framework in which to develop an expressivist theory of cognitive propositions. (shrink)

Cloud computing is considered as a new type of technology, in fact, it is an extension of the information technology's developments which are based on the pooling of resources and infrastructure to provide services depend on using the cloud, in the sense that instead of these services and resources exist on local servers or personal devices, they are gathered in the cloud and be shared on the Internet. This technology has achieved an economic success no one can deny it and (...) resorting to use it has many advantages, today it becomes known and recognized and begins to invade the libraries' area and imposes itself day by day because of the benefits afforded by using applications that have the ability to change the nature of library's services through the web hosting services which can be accessed via any internet connected device. And actually, libraries started using services provided by this technology especially in the field of digitization, indexing, supply, storage and the service of sharing and exchanging information resources in the virtual environment. For this, there is a need to conduct scientific research to find out librarians' trends and motivations about the use of cloud computing in their field of work. Where this research examines the librarians' trends towards the use of cloud computing according to the technology acceptance model (TAM). The study depended on descriptive analytical method using a questionnaire tool, and it has included all the libraries of Mentouri-Constantine1, libraries of university Abdelhamid Mehri-Constantine2, libraries of university Constantine 3, and libraries of Emir Abdelkader university of the Islamic science. And it reached a set of results including: that cloud computing is not used in a very large proportion by librarians, and they haven't a good cognitive level of its services, but in return, an interest was found by them to the cloud as a technology helps the office work implementation and the performance efficiency lifting and appreciates library services. This paper argues that it is prudentially wise to defer to groups about how they are essentially constituted and defined. After a few words situating the paper in my greater research project (§1), I articulate the kind of deference I have in mind (§2). Then I offer two conditional arguments on why it is epistemically desirable to let other people tell you how they ought to be identified (§3). The first argument is that people are owed lexical sovereignty because denying (...) it is absurd; the second is that modest skeptics ought to agree with it on the basis of some relatively anodyne and plausible epistemic considerations. Forty-two years ago, Capra published “The Tao of Physics” (Capra, 1975). In this book (page 17) he writes: “The exploration of the atomic and subatomic world in the twentieth century has …. necessitated a radical revision of many of our basic concepts” and that, unlike ‘classical’ physics, the sub-atomic and quantum “modern physics” shows resonances with Eastern thoughts and “leads us to a view of the world which is very similar to the views held by mystics of all ages (...) and traditions.“ This article stresses an analogous situation in biology with respect to a new theoretical approach for studying living systems, Integral Biomathics (IB), which also exhibits some resonances with Eastern thought. Stepping on earlier research in cybernetics1 and theoretical biology,2 IB has been developed since 2011 by over 100 scientists from a number of disciplines who have been exploring a substantial set of theoretical frameworks. From that effort, the need for a robust core model utilizing advanced mathematics and computation adequate for understanding the behavior of organisms as dynamic wholes was identified. At this end, the authors of this article have proposed WLIMES (Ehresmann and Simeonov, 2012), a formal theory for modeling living systems integrating both the Memory Evolutive Systems (Ehresmann and Vanbremeersch, 2007) and the Wandering Logic Intelligence (Simeonov, 2002b). Its principles will be recalled here with respect to their resonances to Eastern thought. (shrink)

For the sake of universalism and against totalitarianism, discursive ethics has shown with Jürgen Habermas a practical deficit by denying moral philosophy the possibility of reflecting on the alienating conditions for dialogue through a specific ethos. This article examines how Hartmut Rosa's theory of resonance can revitalise the debate on the conditions that can undermine the basis for dialogue in accelerated societies, based not on the concept of ethos, but on the concept of mode of world-relationship [Modus der Weltbeziehung].

If one can judge a society by how it treats its prisoners, one can surely judge a society by how it treats cognitively- and learning-impaired children. In the United States children with physical and cognitive impairments are subjected to higher rates of corporal punishment than are non-disabled children. Children with disabilities make up just over 13% of the student population in the U.S. yet make up over 18% of those children who receive corporal punishment. Autistic children are among the most (...) likely to receive corporal punishment. -/- Although they may deny or redescribe particular instances of corporal punishment or their use of restraints, educators defend such actions as legitimate punishment. In this paper, I assess the logic underlying the use of restraints and corporal punishment on autistic children by educators. The rationalizations for the corporal punishment or restraint of autistics stems from the educator’s desire to control the autistic children so as to end typical autistic behaviors such as rocking, repetitive verbalizations, or “flapping” but also the autistic child’s non-affective responses such as not appearing to feel remorse or shame or the absence of a verbal acknowledgement of remorse or shame. The educators assume that the autistic’s failure to exhibit the desired responses is evidence of the autistic’s moral incorrigibility and is, therefore, evidence of the appropriateness of corporal punishment. But this assumption of the incorrigibility of the autistic child is questionable. -/- Indeed accepting this incorrigibility assumption reveals two important problems. First, instructors using physical punishment on autistic children do not understand autism. Second, they are not working with a tenable conception of punishment. Any action undertaken to induce socially acceptable behaviors (whether it be the end of autistic acts or responses such as remorse) is to fail to understand what the legitimate punishment of children is about. This paper explores the possibility that Hobbesian jurisprudence is best understood as a ‘third way’ in legal theory, irreducible to classical natural law or legal positivism. I sketch two potential ‘third theories’ of law -- legal pragmatism and legal dualism -- and argue that, when considered in its broadest sense, Leviathan is best viewed as an example of legal pragmatism. I consider whether this legal pragmatist interpretation can be sustained in the examination of Leviathan’s treatment of civil law, and argue (...) that the pragmatic interpretation can only be successful if we can resolve two textual issues in that chapter. First, while Hobbes argues that law entails the existence of public (sharable) reasons, he does not adequately defend the view that the sovereign is the unique authority over such reasons in all cases, especially as far as they concern known collective emergencies. Second, Hobbes both affirms and denies that a sovereign can fail to do justice, which is paradoxical. Both problems are best resolved by legal pragmatism, though the second problem resists a fully satisfying resolution. The upshot is that, although Leviathan ought to be regarded as an episode of legal pragmatism, there are trade-offs on every reading. (shrink)

There are at least three basic phenomena that philosophers traditionally classify as paradigm cases of irrationality. In the first two cases, wishful thinking and self-deception, a person wants something to be true and therefore ignores certain relevant facts about the situation, making it appear to herself that it is, in fact, true. The third case, weakness of will, involves a person undertaking a certain action, despite taking herself to have an all-things-considered better reason not to do so. While I think (...) that Stephen Colbert's notion of "truthiness" might be able to fit the mold of each of these three kinds of irrationality, it applies most directly to cases of wishful thinking and self-deception — and it’s these two types of irrationality that I discuss extensively in this paper. As we will see, there are some troubling philosophical problems that arise regarding phenomena like self-deception. Can we conceive of a mind without body? Does, for example, the idea of the soul's immortality make sense? Certain versions of materialism deny such questions; I shall try to prove that these versions of materialism cannot be right. They fail because they cannot account for the mental vocabulary from the language of brains in the vat. Envatted expressions such as "I think", "I believe", etc., do not have to be reinterpreted when we translate them to our language; they are (...) semantically stable. By contrast, physical expressions from the vat language are semantically instable; due to Putnam's externalism they cannot be transported to our language without change. This contrast opens the way to a new understanding of what the immortality of the soul might be like: A brain in a vat (and its mental life) might survive what the brain calls "my physical body's death". A la question « quo vadis Israel ?», il est possible de répondre partiellement en juxtaposant l’été 2018, et notamment la loi fondamentale « Israël État-nation du Peuple Juif » votée le 19 juillet sous l’impulsion du gouvernement Netanyahu, et l’été 2011, où un mouvement de protestation commença le 14 juillet sur l’Avenue Rothschild à Tel Aviv, s’étendant ensuite à tout Israël et atteignant des proportions jamais connue dans le pays. Comment sommes-nous passés de l’espoir soulevé par le mouvement social (...) de 2011 qui faisait suite au Printemps arabe de Tunisie et d’Egypte, à la réaction politique implacable déployée par les différents gouvernements Netanyahu? Les quelques pages qui suivent tenteront de faire passer, ou plutôt de faire chuter le lecteur du soulèvement de l’été 2011 au changement néfaste de régime qui s’annonce avec le vote de la loi fondamentale « Israël État-nation du Peuple Juif. » L’auteur de ces lignes, témoin engagé, ne prétend pas à une étude historique de cette chute. We submit this brief in support of the Nonhuman Rights Project’s efforts to secure habeas corpus relief for the elephant named Happy. The Supreme Court, Bronx County, declined to grant habeas corpus relief and order Happy’s transfer to an elephant sanctuary, relying, in part, on previous decisions that denied habeas relief for the NhRP’s chimpanzee clients, Kiko and Tommy. Those decisions use incompatible conceptions of ‘person’ which, when properly understood, are either philosophically inadequate or, in fact, compatible with Happy’s personhood.

Denis Diderot’s thoroughly materialist metaphysics undergird prescient philosophical analyses; his forays into the field of ethics arguably tend toward what we today would class amongst the range of forward-looking alternative perspectives. It isn’t just that Diderot sketches or even defends the cutting-edge which motivates this paper, but also his use of female characters to reveal crucial insights. Anyone familiar with the prolific author’s body of work realizes that Diderot’s women are certainly not mere “pretty little things.” So it is that (...) his Pensées sur l’interprétation de la nature might seem to smack dissonantly of sexism. My intent is to dispel such a misreading by demonstrating that the Pensées are addressed to the intellectual everyman. To wit, Diderot’s “jeune homme” is both gender and age neutral. One of the central figures of philosophy of language- John Langshaw Austin, attributes principles of causation to the mere pragmatic language. Conversely, Kant tried to construct a “free human act” which is independent from any physical determination except its innate motivations via his well-known the phenomenal / noumenal distinction. That kind of Kantian metaphysical ground which addresses to the noumenal field, he obviously tries to establish this behavioral causation again by denying Austinian style pragmatic propositions or illocutionary acts. I claimed (...) that sort of duality between Austin and Kant, creates an epistemological problem with how propositions and actions relate. From a Kantian position, it (indetermination) is overlooked by Austin's propositional doctrine, without being grounded on any universal principle, but only with propositions that embraced by speech act theory. This article is devoted to analysing the ethical commitments underlying research methodology on “brain drain” and leading participants in the public debate to deny the human right of emigration for skilled persons. Here, we identify five such commitments : to consequentialism, prioritarianism and nationalism, we add sedentarism and elitism. Based on this analysis, we argue that even though the emigration of the most talented would be a loss for the country of origin, this loss is not sufficient to require that (...) migrants themselves compensate it – either by tax payments (e.g. Bhagwati’s tax proposal) or by not exercising their right to emigrate. Moreover, to interpret public investment in education as the source of migrants’ further obligations to their country is to view education rather as a source of dividends than an access to opportunity that present generations owe to futures ones. En aquest article pretenc fer una crítica al nihilisme mereològic, al·ludint que les expressions «simples agrupats en-tant-que-F» tenen unes conseqüències desastroses per als seus compromisos ontològics. Primer, explicaré què és el nihilisme mereològic -que és part de l’eliminativisme- el qual pretén negar l’existència dels objectes compostos (objectes amb parts pròpies) i l’estratègia de la paràfrasi: l’ús que fan de les expressions «simples agrupats en-tant-que-F» per referir-se als objectes ordinaris sense comprometre’s amb l’existència d’objectes compostos, però posaré l’èmfasi en aquells nihilistes (...) mereològics que pretenen explicar l’existència de les propietats emergents. Seguidament, presentaré una classe de crítiques, les de Bennett i Tallant, sobre l’ús d’aquesta estratègia per part dels nihilistes, i quina és la resposta crítica que ofereix Brenner sobre aquesta classe de crítica. Finalment, presentaré la meva crítica on mostraré que el nihilisme mereològic utilitzant l’estratègia de la paràfrasi s’està comprometent amb l’existència d’objectes compostos i que la crítica de Brenner no funciona amb la meva postura. -/- In this paper I intend to critique mereological nihilism, alluding that the expression «simples arranged F-wise» has disastrous consequences for its ontological commitments. First, I will explain what mereological nihilism is -which is part of Eliminativism- which tries to deny the existence of composite objects (objects with proper parts) and the Paraphrase Strategy: the use they make of the expression «simples arranged F-wise» to refer to ordinary objects without committing to the existence of composite objects, and I put the focus on the mereological nihilist that pretends to explain the existence of emergent properties. Second, I will present a kind of criticism, by Bennett and Tallant, of the use of this strategy by nihilism and which is the response of Brenner about this kind of criticism. Finally, I will present my criticism where I will show that nihilism by using the Paraphrase Strategy is committing itself to the existence of composite objects and that the Brenner’s critique does not work with my position. L'empiètement pragmatique ("pragmatic encroachment" en anglais) est une théorie épistémologique récente, allant à contre-courant des thèses traditionnelles selon lesquelles savoir est une affaire purement épistémique : comprenez par-là que les notions épistémiques telles que la connaissance, la justification ou la rationalité des croyances dépendent uniquement de leur relation à la vérité. Dans un chapitre intitulé "Pragmatic Encroachment and Epistemic Value" (2009) Pascal Engel discute des rapports qu'il existe entre l'empiètement pragmatique et la question de la valeur de la connaissance. Dans (...) la présentation qu'il fait de l'empiètement pragmatique comme thèse et phénomène, il explique : "[l'empiètement pragmatique] ressemble à une forme de pragmatisme, bien qu'il ne soit pas clair en quel sens cette thèse ressemble aux formes plus traditionnelles de pragmatisme" . Dans la note de bas de page qui suit cette phrase, il ajoute : "je n'examinerais pas comment la thèse de "l'empiètement pragmatique" est liée à ces formes plus traditionnelles de pragmatisme". Ces deux mentions des rapports entre l'empiètement pragmatique et le pragmatisme suggèrent que Engel soupçonne l'empiètement pragmatique d'être une forme de pragmatisme. Dans cet article, j'examinerais plus précisément cette idée et argumenterais en faveur du fait que, contrairement à ce que l'on pourrait croire, l'empiètement pragmatique n'est pas forcément une thèse pragmatiste au sens où l'entend Engel. The major objection for including mental properties, and laws, within the domain of scientific essentialism concerns phenomenal properties, and such an objection is often raised via the intuition that zombies are conceivable. However, if these properties can be individuated in terms of roles and establish nomological relations, zombies are not possible because they would be nomologically identical to us but property different, an independence that essentialism denies. If there are not nomological relations, the essentialist denies that there are phenomenal properties, (...) and we are zombie. But it seems there are phenomenal properties, so this option too should be discarded. The only option left is that phenomenal properties are categorical properties. However, I argue that this option is not viable and that these properties are better construed as dispositions, which gives physicalism a better chance to be defensible. (shrink)

This doctoral thesis was prepared in 1975-77 at Ecole des Hautes Etudes en Sciences Sociales, Paris, under the supervision of Prof. Raymond ARON. It was submitted in 1977 in fulfilment of the requirements for a Ph.D. degree in Social Sciences (Doctorat de 3e cycle en sciences sociales). The oral examination (soutenance de thèse) was held in January 1978, with the examination committee consisting of Prof. Aron, Bartoli, Boudon and Brochier. This 250 page unpublished dissertation was the first study ever (...) written in French on Karl Marx's Grundrisse - a 1857-58 manuscript preparatory to Marx's main economic work, Capital. The dissertation reviews Marx's successive projects for his economic work since the 1844 Manuscripts and then proceeds to a presentation and critical discussion of Grundrisse. The proposed interpretation explains the linkage that Marx operated in 1857-58 between Ricardo's economics and Hegel's dialectics, and it emphasizes that Marx was at that time primarily trying to reconstruct the dynamics of capitalism, without going to the stage of developing a formal theory of value and exploitation, as he will eventually do in Capital. Depuis Gintis est un économiste senior et j’ai lu certains de ses livres précédents avec intérêt, je m’attendais à un peu plus de perspicacité dans le comportement. Malheureusement, il fait les mains mortes de la sélection de groupe et la phénoménologie dans les pièces maîtresses de ses théories du comportement, et cela invalide en grande partie le travail. Pire encore, puisqu’il montre un si mauvais jugement ici, il remet en question tout son travail précédent. La tentative de ressusciter la sélection (...) de groupe par ses amis à Harvard, Nowak et Wilson, il y a quelques années, c’était l’un des principaux scandales en biologie au cours de la dernière décennie, et j’ai raconté la triste histoire dans mon article 'Altruism, Jesus and the End of the World-how the Templeton Foundation bought a Harvard Professorship and attacked Evolution, Rationality and Civilization -- A review of E.O. Wilson 'The Social Conquest of Earth' (2012) et Nowak and Highfield 'SuperCooperators' (2012).' Contrairement à Nowak, Gintis ne semble pas être motivé par le fanatisme religieux, mais par le fort désir de générer une alternative aux sombres réalités de la nature humaine, facilitée par le manque (quasi universel) de compréhension de la biologie humaine fondamentale et le slateisme vierge des scientifiques comportementaux, d’autres universitaires et du grand public. Gintis attaque à juste titre (comme il l’a fait à maintes reprises) les économistes, les sociologues et d’autres scientifiques du comportement pour ne pas avoir un cadre cohérent pour décrire le comportement. Bien sûr, le cadre nécessaire pour comprendre le comportement est évolutif. Malheureusement, il ne parvient pas à en fournir un lui-même (selon ses nombreux critiques et je suis d’accord), et la tentative de greffer le cadavre pourri de la sélection de groupe sur toutes les théories économiques et psychologiques qu’il a généré dans ses décennies de travail, n’a fait qu’invalider tout son projet. Bien que Gintis fasse un vaillant effort pour comprendre et expliquer la génétique, comme Wilson et Nowak, il est loin d’être un expert, et comme eux, le calcul l’aveugle juste aux impossibilités biologiques et bien sûr c’est la norme en science. Comme Wittgenstein l’a noté sur la première page de la culture et de la valeur « Il n’y a pas de dénomination religieuse dans laquelle l’utilisation abusive des expressions métaphysiques a été responsable de tant de péchés qu’il l’a en mathématiques. » Il a toujours été clair que un gène qui provoque un comportement qui diminue sa propre fréquence ne peut pas persister, mais c’est le cœur de la notion de sélection de groupe. En outre, il a été bien connu et souvent démontré que la sélection de groupe réduit juste à la condition physique inclusive (sélection de parents), qui, comme Dawkins l’a noté, est juste un autre nom pour l’évolution par sélection naturelle. Comme Wilson, Gintis a travaillé dans cette arène pendant environ 50 ans et n’a toujours pas compris, mais après le scandale a éclaté, il ne m’a fallu que 3 jours pour trouver, lire et comprendre le travail professionnel le plus pertinent, comme détaillé dans mon article. Il est ahurissant de se rendre compte que Gintis et Wilson n’ont pas été en mesure d’y parvenir en près d’un demi-siècle. Je discute des erreurs de sélection de groupe et de phénoménologie qui sont la norme dans le milieu universitaire comme des cas spéciaux de l’échec quasi universel de comprendre la nature humaine qui détruisent l’Amérique et le monde. Ceux qui souhaitent un cadre complet à jour pour le comportement humain de la vue moderne de deux systemes peuvent consulter mon livre 'The Logical Structure of Philosophy, Psychology, Mind and Language in Ludwig Wittgenstein and John Searle' 2nd ed (2019). Science has always strived for objectivity, for a ‘‘view from nowhere’’ that is not marred by ideology or personal preferences. That is a lofty ideal toward which perhaps it makes sense to strive, but it is hardly the reality. This collection of thirteen essays assembled by Denis R. Alexander and Ronald L. Numbers ought to give much pause to scientists and the public at large, though historians, sociologists and philosophers of science will hardly be surprised by the material covered here.

Knowing only the dreamers age and gender, we interpreted his dream from its text. Our interpretation included predictions about the dreamer's psychological issues, and about his defenses. It also identified a series of jokes within the dream which would tend to penetrate the dreamer's defenses. When we had finished our (...) 'blind' interpretation, the bringer of the dream gave us more information about the dreamer against which we tested the accuracy of our predictions.
