A number of findings in the field of machine learning have given rise to questions about what it means for automated scoring- or decisionmaking systems to be fair. One center of gravity in this discussion is whether such systems ought to satisfy classification parity (which requires parity in accuracy across groups, defined by protected attributes) or calibration (which requires similar predictions to have similar meanings across groups, defined by protected attributes). Central to this discussion are impossibility results, owed to Kleinberg (...) et al. (2016), Chouldechova (2017), and Corbett-Davies et al. (2017), which show that classification parity and calibration are often incompatible. This paper aims to argue that classification parity, calibration, and a newer, interesting measure called counterfactual fairness are unsatisfactory measures of fairness, offer a general diagnosis of the failure of these measures, and sketch an alternative approach to understanding fairness in machine learning. El presente artículo explora la relación entre las ideas estéticas y las ideas políticas en la obra de Edmund Burke. In his remarks on L’Homme, La Forge aims at a rigid separation of the functions of the body from the activity of the soul. This project looks authentically Cartesian, but some critical issues reveal how difficult it is taking away any activity of the soul in sensitive experience. In the Traité de l’esprit de l’homme, La Forge explicitly limits the cognitive capability of the memory without the active presence of the mind.

While Eros has a central philosophical function in the dialogues of Plato, it all but disappears as a philosophical term in the thought of Aristotle, and is replaced by the more rational and reciprocal relation of friendship, φιλία. This essay asks what becomes of Eros in Aristotle’s thinking, whether as deity, natural or cosmic force, or mode of human relation. Drawing on the ancient epithet of Eros, Ἔρως λυσιµελής, unbinder of limbs, Aristotle’s usages of both ἔρως and λύσις (loosening, unbinding), (...) respectively are traced in their ambivalence for his fundamentally organismic philosophy, insofar as they disturb the organism’s ontological integrity. With the assistance of Kristeva’s notion of the abject, it is argued that while Aristotle’s overt stance is a polemic against eros, his principal metaphysical innovations – the recasting of ἀρχή as divine τέλος, and the separation of material and moving causes – are solutions (λύσεις) to aporias that may involve a traversal of the sublime that is also irreducibly corporeal and erotic. This article offers a conceptual framework for discussing the role of envy within processes of transitional justice. Transitional justice importantly includes the transformation of intergroup dynamics of interaction in the aftermath of societal conflicts and upheavals. Such transformation aims to realise “interactive” justice in transitional justice by reshaping belief and value systems, and by moulding emotional responses between the involved parties. A nuanced understanding of the emotions at play in intergroup antagonistic dynamics of interaction is thus essential to transitional justice. (...) Among the many emotions that we could address in such scenarios, we target envy. Envy, in its various forms, features prominently in many societal conflicts and upheavals, and has, therefore, the potential to undermine or, conversely, support just intergroup interactions. However, the ambivalent role of this emotion has been scantly analysed in the philosophical literature on transitional justice. We make a start on filling this lacuna by developing a conceptual framework which is necessary to appreciate how envy and its varieties are epistemically and practically relevant to realising interactive justice in transitional justice processes. New media (highly interactive digital technology for creating, sharing, and consuming information) affords users a great deal of control over their informational diets. As a result, many users of new media unwittingly encapsulate themselves in epistemic bubbles (epistemic structures, such as highly personalized news feeds, that leave relevant sources of information out (Nguyen forthcoming)). Epistemically paternalistic alterations to new media technologies could be made to pop at least some epistemic bubbles. We examine one such alteration that Facebook has made in (...) an effort to fight fake news and conclude that it is morally permissible. The aim of this paper is to offer a version of the so-called conversational hypothesis of the ontogenetic connection between language and mindreading (Harris 1996, 2005; Van Cleave and Gauker 2010; Hughes et al. 2006). After arguing against a particular way of understanding the hypothesis (the communicative view), I will start from the justificatory view in philosophy of social cognition (Andrews 2012; Hutto 2004; Zawidzki 2013) to make the case for the idea that the primary function of belief and desire (...) attributions is to justify and normalize deviant patterns of behaviour. Following this framework, I elaborate upon the idea that development of folk psychological skills requires the subjects to engage in conversationally mediated joint and cooperative activities in order to acquire the conceptual capacity of ascribing propositional attitudes. After presenting the general version of the hypothesis, I present several testable sub-hypotheses and some psychological studies that give empirical plausibility to the hypothesis. (shrink)

The philosophical problem that is at the origin of the principle Quod nescis quomodo fiat id non facis originates in Galen’s De foetuum formatione, (...) a work translated into Latin only in 1535. 2. Important works of early modern philosophy, such as Campanella’s Del senso delle cose e della magia, discuss Galen’s text. 3. Due to their rejection of teleology, Descartes’ physics and metaphysics are completely foreign to the Quod nescis principle. Comparing the Cartesian theory of animal-machines with the theory of animal behavior of Pierre Chanet, a philosopher who adopts the principle, confirms this claim. (shrink)

A widespread view in philosophy claims that inner speech is closely tied to human metacognitive capacities. This so-called format view of inner speech considers that talking to oneself allows humans to gain access to their own mental states by forming metarepresentation states through the rehearsal of inner utterances (section 2). The aim of this paper is to present two problems to this view (section 3) and offer an alternative view to the connection between inner speech and metacognition (section 4). This essay undertakes a reexamination of the notion of the receptacle/chōra in Plato's Timaeus, asking what its value may be to feminists seeking to understand the topology of the feminine in Western philosophy. As the source of cosmic motion as well as a restless figurality, labile and polyvocal, the receptacle/chōra offers a fecund zone of destabilization that allows for an immanent critique of ancient metaphysics. Irigaray’s engagement with Aristotelian physics provides a specific diagnosis of women’s ontological and ethical situation under Western metaphysics: Women provide place and containership to men, but have no place of their own, rendering them uncontained and abyssal. She calls for a reconfiguration of this topological imaginary as a precondition for an ethics of sexual difference. This paper returns to Aristotelian cosmological texts to further investigate the topologies of sexual difference suggested there. In an analysis both psychoanalytic and phenomenological, the paper (...) rigorously traces a teleological and oedipal narrative implicit in the structure of the Aristotelian cosmos, in which desire for the mother is superseded by love for the father. Further, the paper argues that this narrative is complicated by certain other elements in the Aristotelian text—aporias involving the notion of boundary and the relationship between space and time, the fallenness of the feminine, and the ineliminably aleatory qualities of matter. The paper concludes that such elements may provide material for disrupting this teleology of gender, opening onto not merely an ethics of sexual difference, but providing space and place for a proliferation of non-normative, queer, transgender and intersex modes of sexed and gendered subjectivity. In Aristotle’s physics and biology, matter’s capacity for spontaneous, opaque, chance deviation is named by automaton and marked with a feminine sign, while at the same time these mysterious motions are articulated, rendered knowable and predictable via the figure of ta automata, the automatic puppets. This paper traces how automaton functions in the Aristotelian text as a symptomatic crossing-point, an uncanny and chiasmatic figure in which materiality and logos, phusis, and technē, death and life, masculine and feminine, are intertwined and (...) articulated. The physician Louis de La Forge built his entire work upon the promotion, defensce, and completion of Descartes’ thought. In the course of this endeavor, he sought to refute the notion that knowledge of the mechanisms of the living body is the necessary condition for producing such mechanisms. Around the same time, Arnold Geulincx formulated the principle Quod nescis quomodo fiat id non facis, according to which an effect can only be produced only by someone who knows how it is (...) produced. Geulincx developed this principle within a Cartesian framework, and it soon became a cornerstone of arguments supporting oOccasionalism from a Cartesian perspective. La Forge instead upheld the opposite thesis, yet still on the basis of ideas drawn from Cartesian philosophy. In doing so, La Forge intended to defend Descartes’ physiology against a form of vitalism which was fueling the opposition to Cartesian science in Parisian philosophical and scientific circles, and which found a prominent champion in the physician Cureau de La Chambre. This article contributes to the debate concerning the identification of politically relevant cases of corruption in a democracy by sketching the basic traits of an original liberal theory of institutional corruption. We define this form of corruption as a deviation with respect to the role entrusted to people occupying certain institutional positions, which are crucial for the implementation of public rules, for private gain. In order to illustrate the damages that corrupt behaviour makes to liberal democratic institutions, we discuss the (...) case of health care professionals’ abuse of their right to conscientious objection to abortion services. We show that the conscience clause can be instrumentally abused to sabotage democratically established public rules and thus exert undue private influence on their implementation. In this sense, from a liberal democratic perspective, institutional corruption is problematic because it is disruptive of such fundamental liberal ideals as the impartiality of public institutions and citizens’ political equality. Misrepresentations can be innocuous or even useful, but Kant’s corollary to the formula of universal law appears to involve a pernicious one: “act as if the maxim of your action were to become by your will a universal law of nature”. Humans obviously cannot make their maxims into laws of nature, and it seems preposterous to claim that we are morally required to pretend that we can. Given that Kant was careful to eradicate pernicious misrepresentations from theoretical metaphysics, the imperative (...) to act as if I have this supernatural power has typically been treated as an embarrassment meriting apology. The wording of the corollary may be vindicated, however, by recognizing that “as if” (als ob) is a technical term both in the Critique of Pure Reason and here. It signals a modal shift from the assertoric to the problematic mode of cognition, one that is necessitated by the attempt to incorporate the natural effects of a free will into a universal moral imperative that is philosophically practical. In this paper I sketch how the modal shift makes sense of the corollary as a subjectively necessary, philosophically practical idealization of the extension of human freedom into nature, one that accurately represents a necessary parameter of moral conduct: moral ambition. In this open access book, Timothy Aylsworth and Clinton Castro draw on the deep well of Kantian ethics to argue that we have moral duties, both to ourselves and to others, to protect our autonomy from the threat posed by the problematic use of technology. The problematic use of technologies like smartphones threatens our autonomy in a variety of ways, and critics have only begun to appreciate the vast scope of this problem. In the last decade, we have seen (...) a flurry of books making “self-help” arguments about how we could live happier, more fulfilling lives if we were less addicted to our phones. I processi di transizione post-conflitto pongono questioni prominenti per l’agenda politica globale. Si pensi, per esempio, alla transizione democratica in Sud Africa dopo la fine dell’Apartheid o alla ricostruzione politica dei paesi facenti parte dell’ex-Jugoslavia all’indomani delle guerre dei Balcani. Quali principi normativi dovrebbero informare tali processi? Questa domanda è al cuore del crescente dibattito sulla “giustizia transizionale”. Questo dibattito si è concentrato principalmente sulla rettificazione delle ingiustizie occorse a causa dei torti perpetrati e subiti dalle parti coinvolte. Di conseguenza, (...) la giustizia è stata tipicamente concepita come una proprietà di esiti distributivi di diritti e opportunità. I processi di transizione post-conflitto sono giusti nella misura in cui sono in grado di condurre a tali esiti. Un simile approccio orientato agli esiti è capace di rendere conto di dimensioni morali, animate da preoccupazioni di giustizia e/o pacificazione, che dovrebbero certamente figurare nella caratterizzazione e valutazione normativa dei processi di transizione. Tuttavia, esso rischia di perdere di vista un’altra dimensione egualmente rilevante che riguarda le qualità inerenti ai processi di transizione stessi. Per illuminare questa dimensione, vorrei portare l’attenzione su di una diversa idea di giustizia che riguarda le proprietà inerenti alle interazioni tra persone; la giustizia nelle interazioni. La tesi che sosterrò è che le procedure costitutive dei processi di transizione post-conflitto non dovrebbero essere disegnate con la sola o prioritaria preoccupazione di condurre le parti a un consenso o compromesso su di un accordo capace di rettificare le ingiustizie perpetrate e subite. È anche necessario che questi processi siano strutturati in modo da consentire alle parti di reinterpretare il loro conflitto come un problema condiviso, che richiede l’instaurazione di dinamiche d’interazione cooperative capaci di realizzare forme di trattamento inerentemente giuste delle loro pretese reciproche. En esta tesis indagamos en el pensamiento de tres autores contrarrevolucionarios europeos de la primera mitad del siglo XIX (1789-1848): Edmund Burke (1729-1797), Joseph de Maistre (1753-1821) y Juan Donoso Cortés (1809-1853). A partir de un estudio de sus obras principales, destacamos las limitaciones de las caracterizaciones contemporáneas sobre el pensamiento conservador y proponemos una clasificación alternativa ajustada a los orígenes políticos de dicha corriente: la distinción entre un conservadorismo como sustantivo y un conservadorismo como adjetivo. Delineada (...) esta distinción, que funciona como hipótesis de trabajo, demostramos su capacidad heurística para conceptualizar el conservadorismo de los autores escogidos. Concluimos destacando las ventajas del punto de vista propuesto para definir a esta corriente de la teoría política y su capacidad de extenderse a otros autores, períodos y corrientes. (shrink)

It is possible today to determine, with some precision (according to the most recent studies in neuroscience and evolutionary psychology), the areas of the brain and the neural networks involved when an individual contemplates art, when feeling pleasure, or when judging about aesthetic experience. However, many questions remain open. First, the philosophical question about the subjective nature of this kind of judgments. Then, what happens in the mind (or should it be said, in the brain?) of the beholder when contemplating (...) art or judging in favor (or not) of the beauty of an object. And the ultimate question, if we have an aesthetic brain. Another issue that must be addressed is if bioart and especially neuroart can contribute to this analysis and if they can be effectively quantified as art. Thus, this brief essay seeks to provide some understanding about this questions but most importantly about the existence of an aesthetic brain, which may ultimately contribute to open doors to other problems of philosophy such as the hard brain-mind problem. This Editorial outlines recent developments in the Journal’s scope, mission and review policy. It also illustrates the range of topics addressed on the pages of Ethical Theory and Moral Practice, which is now entering its 24th year.

Heidegger tries to explain our emotional life applying three schemes: causal explanation, mental internalisation of emotions and metaphorical expression. None of the three schemes explains emotion though. Either because the causal nexus does not always occur or because objects and people in the external world are carriers of emotional agents or because language is already on a metaphorical level. Moreover, how is it possible that there are presently emotions constituting our life without our being aware of their existence? From the (...) analysis of boredom in its three varieties (“bored by X”, “get oneself bored”, and “it is boring”) we will get to the depth where emotions lie, trying to rouse them and to keep them awake. Although it surfaces with the force and energy of the present, every emotion has its past and future constitution. How can we understand the future of a present emotion along with its past? (shrink)

This dissertation concerns the methodology Kant employs in the first two sections of the Groundwork of the Metaphysics of Morals (Groundwork I-II) with particular attention to how the execution of the method of analysis in these sections contributes to the establishment of moral metaphysics as a science. My thesis is that Kant had a detailed strategy for the Groundwork, that this strategy and Kant’s reasons for adopting it can be ascertained from the Critique of Pure Reason (first Critique) and his (...) lectures on logic, and that understanding this strategy gains us interpretive insight into Kant’s moral metaphysics. At the most general level of methodology, Kant says there are four steps for the establishment of any science: 1) make distinct the idea of the natural unity of its material 2) determine the special content of the science 3) articulate the systematic unity of the science 4) critique the science to determine its boundaries The first two of these steps are accomplished by the genetically scholastic method of analysis, paradigmatically the method whereby confused and obscure ideas are made clear and distinct, thereby logically perfecting them and transforming them into possible grounds of cognitive insight that are potentially complete and adequate to philosophical purposes. The analysis of Groundwork I is a paradigmatic analysis that makes distinct what is contained in common understanding, i.e. its Inhalt or intension, making distinct the higher partial concepts that together define the concept of morality. The analysis of Groundwork II is an employment more specifically of the method of logical division, which makes distinct what is contained under the concept, i.e. its Umfang, by which the extension or object of morality is determined. Part I introduces Kant’s conception of moral metaphysical science and why he took it to be in need of establishment, explains the general method for establishing science and the scholastic method of analysis by which its first two steps are to be accomplished, then provides an interpretation of Groundwork I as an execution of this method. Part II details Kant’s determination of the special content of moral science in Groundwork II in relation to the central problem for moral metaphysics – how synthetic a priori practical cognition is possible. Psychometrics firms such as Cambridge Analytica (CA) and troll factories such as the Internet Research Agency (IRA) have had a significant effect on democratic politics, through narrow targeting of political advertising (CA) and concerted disinformation campaigns on social media (IRA) (U.S. Department of Justice 2019; Select Committee on Intelligence, United States Senate 2019; DiResta et al. 2019). It is natural to think that such activities manipulate individuals and, hence, are wrong. Yet, as some recent cases illustrate, the moral concerns with (...) these activities cannot be reduced simply to the effects they have on individuals. Rather, we will argue, the wrongness of these activities relates to the threats they present to the legitimacy of political orders. This occurs primarily through a mechanism we call “emergent manipulation,” rather than through the sort of manipulation that involves specific individuals. (shrink)

Inspired by the work of Sellars, Cumpa (2014, 2018) and Buonomo (2021) have argued that we can evaluate our metaphysical proposals on fundamental categories in terms of their capacity for reconciling the scientific and the manifest image of the world. This criterion of fundamentality would allow us to settle the question of which categories among those proposed in the debate—e.g., substance, structure or facts—have a better explanatory value. The aim of this essay is to argue against a central assumption of (...) the criterion: semantic descriptivism. Specifically, I aim at showing that the criterion rests on the idea that the manifest picture is mostly a description of the world, and thus, it commits us with certain realism. Instead, I argue that at least some of the vocabulary we use to construct our manifest picture of the world, mental vocabulary, is evaluative rather than descriptive and thus creates problems in reconcile the manifest picture with scientific psychology and neurosciences. I conclude with some remarks on alternatives that could provide a way out of the fundamentality criterion. (shrink)

Prediction-based decisions, which are often made by utilizing the tools of machine learning, influence nearly all facets of modern life. Ethical concerns about this widespread practice have given rise to the field of fair machine learning and a number of fairness measures, mathematically precise definitions of fairness that purport to determine whether a given prediction-based decision system is fair. Following Reuben Binns (2017), we take ‘fairness’ in this context to be a placeholder for a variety of normative egalitarian considerations. We (...) explore a few fairness measures to suss out their egalitarian roots and evaluate them, both as formalizations of egalitarian ideas and as assertions of what fairness demands of predictive systems. We pay special attention to a recent and popular fairness measure, counterfactual fairness, which holds that a prediction about an individual is fair if it is the same in the actual world and any counterfactual world where the individual belongs to a different demographic group (cf. The attention economy — the market where consumers’ attention is exchanged for goods and services — poses a variety of threats to individuals’ autonomy, which, at minimum, involves the ability to set and pursue ends for oneself. It has been argued that the threat wireless mobile devices pose to autonomy gives rise to a duty to oneself to be a digital minimalist, one whose interactions with digital technologies are intentional such that they do not conflict with their ends. In this (...) paper, we argue that there is a corresponding duty to others to be an attention ecologist, one who promotes digital minimalism in others. Although the moral reasons for being an attention ecologist are similar to those that motivate the duty to oneself, the arguments diverge in important ways. We explore the application of this duty in various domains where we have special obligations to promote autonomy in virtue of the different roles we play in the lives of others, such as parents and teachers. We also discuss the consequences of our arguments for employers, software developers, and policy makers. (shrink)

The harms associated with wireless mobile devices (e.g. smartphones) are well documented. They have been linked to anxiety, depression, diminished attention span, sleep disturbance, and decreased relationship satisfaction. Perhaps what is most worrying from a moral perspective, however, is the effect these devices can have on our autonomy. In this article, we argue that there is an obligation to foster and safeguard autonomy in ourselves, and we suggest that wireless mobile devices pose a serious threat to our capacity to fulfill (...) this obligation. We defend the existence of an imperfect duty to be a ‘digital minimalist’. That is, we have a moral obligation to be intentional about how and to what extent we use these devices. The empirical findings already justify prudential reasons in favor of digital minimalism, but the moral duty is distinct from and independent of prudential considerations. (shrink)

Some recent literature [Hicks, M. T. and van Elswyk. P., (2015) pp. 433-443, 2015; Bhogal, H. (2017), pp. 447-460] has argued that the non-Humean conceptions of laws of nature have a same weakness as the Humean conceptions of laws of nature. That is, both conceptions face an explanatory circularity problem. The argument is as follows: the Humean and the non-Humean conceptions of laws of nature agree that the law statements are universal generalisations; thus, both conceptions are vulnerable to an explanatory (...) circularity problem between the laws of nature and their instances. In this paper, I argue that Armstrong’s necessitarian view of laws of nature is invulnerable to this explanatory circularity problem. (shrink)

Holm (2022) argues that a class of algorithmic fairness measures, that he refers to as the ‘performance parity criteria’, can be understood as applications of John Broome’s Fairness Principle. We argue that the performance parity criteria cannot be read this way. This is because in the relevant context, the Fairness Principle requires the equalization of actual individuals’ individual-level chances of obtaining some good (such as an accurate prediction from a predictive system), but the performance parity criteria do not guarantee any (...) such thing: the measures merely ensure that certain population-level ratios hold. Esta tesis estudia el pensamiento del conservador español Juan Donoso Cortés (1809- 1853). Más precisamente, se ocupa de responder cómo resuelve el problema de la decadencia de la autoridad monárquica en Europa a partir de las revoluciones de 1848. Para abordar este objetivo general elaboramos dos objetivos específicos. El primero busca señalar las continuidades y discontinuidades de la obra donosiana, escindida generalmente en dos períodos: el juvenil, con un Donoso Cortés liberal, y el maduro, que luego de una “conversión religiosa” (...) se vuelca hacia el catolicismo reaccionario. El segundo objetivo hace foco en el concepto de dictadura, bajo la sospecha de que en esta noción reside la clave de su proyecto conservador. Con esto en mente construimos dos hipótesis. La primera afirma que nuestro autor es consciente de la imposibilidad de restituir el proyecto monárquico. La segunda, sugiere la presencia de una fórmula parcialmente decisionista como alternativa a dicho proyecto. Luego de un trabajo de lectura de primera mano de los textos donosianos, las conclusiones confirman las hipótesis y observan que existe una continuidad estructural en las ideas del español, pero también que hay discontinuidades, de las cuales la más importante es su particular noción de dictadura, que denominamos dictadura catolizante. L'articolo esamina la complessa strutturazione/dinamica dell'anima e del corpo nei vari dialoghi platonici.

This paper begins with the examination of some premises of Mary Shelley's novel, Frankenstein or the Modern Prometheus, and briefly revisits some of the concepts or ideas that she had adapted and that will allow to determine the premises that characterize what we named as Frankenstein Paradigm. Such a paradigm, as we suggested, allows us to perceive, on the one hand, the avant-garde vision of Mary Shelley about human condition (regardless of literary immersion in gothic subjects), and on the other (...) hand, the complexity of themes that would mark what is termed by post-human, that we will give some examples whether in contemporary art or in the framework of figures and representations of daily life (some illustrations on movies will be given). In this regard, we will notice the prosthetic transformations that have already occurred and, therefore, to verify the practical application of the premises contained in the Frankenstein paradigm. Next, it is necessary to carry out a reflection on the ethical and social implications posed by post-humanism as the well-known paradox of the ship of Theseus (which, as we all know, illustrates the problem of identity). Grice in pragmatics and Levelt in psycholinguistics have proposed models of human communication where the starting point of communicative action is an individual intention. This assumption, though, has to face serious objections with regard to the alleged existence of explicit representations of the communicative goals to be pursued. Here evidence is surveyed which shows that in fact speaking may ordinarily be a quite automatic activity prompted by contextual cues and driven by behavioural schemata abstracted away from social regularities. On the (...) one hand, this means that there could exist no intentions in the sense of explicit representations of communicative goals, following from deliberate reasoning and triggering the communicative action. On the other hand, however, there are reasons to allow for a weaker notion of intention than this, according to which communication is an intentional affair, after all. Communicative action is said to be intentional in this weaker sense to the extent that it is subject to a double mechanism of control, with respect both to present-directed and future-directed intentions. El objetivo del presente ensayo es el de examinar las características de los tipos de análisis conceptual propuestos por Jackson en From Metaphysics to Ethics y de Strawson en Análisis y Metafísica. Se quieren confrontar dos tipos de análisis conceptual: Por una parte, se pretende aclarar algunos aspectos característicos del tipo de análisis conceptual propuesto por cada autor, desde el punto de vista metodológico, y, por otra, caracterizar la naturaleza de lo que cada uno considera como conceptos básicos del análisis.

In 1988, three laboratories performed a radiocarbon analysis of the Turin Shroud. The results, which were centralized by the British Museum and published in Nature in 1989, provided ‘conclusive evidence’ of the medieval origin of the artefact. However, the raw data were never released by the institutions. In 2017, in response to a legal request, all raw data kept by the British Museum were made accessible. A statistical analysis of the Nature article and the raw data strongly suggests that homogeneity (...) is lacking in the data and that the procedure should be reconsidered. (shrink)

Algorithmic systems and predictive analytics play an increasingly important role in various aspects of modern life. Scholarship on the moral ramifications of such systems is in its early stages, and much of it focuses on bias and harm. This paper argues that in understanding the moral salience of algorithmic systems it is essential to understand the relation between algorithms, autonomy, and agency. We draw on several recent cases in criminal sentencing and K–12 teacher evaluation to outline four key ways in (...) which issues of agency, autonomy, and respect for persons can conflict with algorithmic decision-making. Three of these involve failures to treat individual agents with the respect they deserve. The fourth involves distancing oneself from a morally suspect action by attributing one’s decision to take that action to an algorithm, thereby laundering one’s agency. (shrink)

ABSTRACT: So far in this book, we have examined algorithmic decision systems from three autonomy-based perspectives: in terms of what we owe autonomous agents (chapters 3 and 4), in terms of the conditions required for people to act autonomously (chapters 5 and 6), and in terms of the responsibilities of agents (chapter 7). -/- In this chapter we turn to the ways in which autonomy underwrites democratic governance. Political authority, which is to say the ability of a government to exercise (...) power, may be justifiable or not. Whether it is justified and how it can come to be justified is a question of political legitimacy. Political legitimacy is another way in which autonomy and responsibility are linked. This relationship is the basis of the current chapter, and it is important in understanding the moral salience of algorithmic systems. We will draw the connection as follows. We begin, in section 8.1, by describing two uses of technology: crime predicting technology used to drive policing practices and social media technology used to influence elections (including by Cambridge Analytica and by the Internet Research Agency). In section 8.2 we consider several views of legitimacy and argue for a hybrid version of normative legitimacy based on one recently offered by Fabienne Peter. In section 8.3 we will explain that the connection between political legitimacy and autonomy is that legitimacy is grounded in legitimating processes, which are in turn based on autonomy. Algorithmic systems—among them PredPol and the Cambridge Analytica-Facebook-Internet Research Agency amalgam—can hinder that legitimation process and conflict with democratic legitimacy, as we argue in section 8.4.
