This chapter discusses the Ganser syndrome and gives a brief account on its clinical features. A significant number of clinicians in Europe continued accepting Ganser's basic postulates that the patients showed significant memory disorder and 'answers towards the question' within the framework of traumatic or reactive hysteria. In elderly patients, Ganser type symptoms may be indicative of the onset of dementia. Ganser syndrome raises the question of the interaction between concepts, ideology and clinical observation. The clinician must be aware that (...) a misdiagnosed case of Ganser-type hysteria may result in lawsuits, unnecessary surgical interventions, inappropriate use of minor and major tranquillizers, and social consequences that may be destabilizing for the patient and family. Positive results in the organic investigation should lead to a firm diagnosis and disconfirmation of Ganser syndrome. Persistent negative results and dramatic improvement should tend to confirm the diagnosis. (shrink)

Theology used to be the discipline that arbitrated and ‘said’ the truth. Some argued that its methodical engagement had to make it a search-driven experimentation with an inductive outlook intended at tracking truth through practice and praise, in short conversion. The empirico-formal sciences have sought canonical norms of knowledge away from any regimentation. Neopositivism had for a time entertained a fact-derived language and, as such, it banned metaphor as mingling problems by perpetuating the belief in entirely theoretical knowledge-terms. Here we (...) aim at putting together an examination of some of the reasons why a pluralistic epistemology has come to be adopted, and an attempt at finding pluralistic responses to that very idea through interdisciplinary comparison. This is the editors' (M. Fuller & A. Runehov) introduction: Philippe Gagnon asks the interesting question: Does pluralism itself need to be plural? He argues that neo-positivism has for some time now focused on using a fact-derived language, banning metaphoricity. He explores the reasons pluralistic epistemology came to be adopted, and leads us through some important philosophical problems and how they were tackled by different philosophers and in various times. Such philosophical problems or questions concern theories, truth and knowledge. If a theory is considered to be the best one, on which criteria is this judgement made? Might it be better to have several theories that are ex æquo? Gagnon argues that even though ‘pluralism’ is a better term compared to ‘the many’, it does not entirely escape relativism. Hence, he proposes to use ‘plurality’ instead, which does not threaten the unity of truth. After this philosophical exploration, he turns to theology, specifically Trinitarian theology, to implement his findings there. (shrink)

This volume aims to develop a philosophical diagnostic of the present, focussing on contemporary technoscience. psychoanalysis submits contemporary technoscientific discourse to a symptomatic reading, analysing it with evenly-poised attention and from an oblique perspective. Psychoanalysis is not primarily interested in protons, genes or galaxies, but rather in the ways in which they are disclosed and discussed, focussing on the symptomatic terms, the metaphors and paradoxes at work in technoscientific discourse. This monograph presents a psychoanalytical assessment of technoscience. The first four (...) chapters provide a short introduction into the psychoanalysis of technoscience, its basic concepts and methods, as developed Sigmund Freud, Carl Gustav Jung, Gaston Bachelard and Jacques Lacan. In subsequent chapters, this approach is fleshed out with the help of case histories (palaeoanthropology, classical conditioning and virology). Psychoanalysis reveals that, rather than by disinterested curiosity, technoscience is driven by desire, resistance and the will to control. Moreover, the focus is on primal scenes, such as Dubois’ quixotic quest for the missing link and Pavlov’s discovery of the conditioned reflex. In addition, psychoanalysis opts for triangulation: understanding technoscientific research by comparing it to “different scenes”: to genres of the imagination, notably novels, so that, in this volume, the discovery of a Homo erectus skull by Dubois is compared to missing link novels by Jules Verne and Jack London (dating from the same period), Pavlov’s discovery of the conditioned reflex is compared with B.F. Skinner’s novel Walden Two and virology as a research field is considered through the lens of viral fiction. (shrink)

This paper investigates the significance of filmic analysis in the contemporary theoretical paradigm inspired by Slavoj Žižek, which we term ‘Transcendental Materialism’. After characterising its distinct peculiarities within the history of psychoanalysis and film theory, we demonstrate the limitations of previous (possible) answers, arguing they are partly formulated in response to confrontations with other paradigms. Our own approach is then informed by a study of another popular object of analysis in Transcendental Materialism – the joke. We show how Freud’s understanding (...) of the joke was adapted by the paradigm and supported further by certain philosophical insights by (among others) G.W.F. Hegel. Finally, we demonstrate how parallels can be drawn between this adaptation and the significance of the filmic form within Transcendental Materialism, inspired in part by Alain Badiou’s reading of Hegel. La teoría de la intentio hoy conocida como “intencionalidad” había pasado desapercibida en la filosofía moderna y fue recuperada por Brentano, pero sobre todo fue puesta de relieve por Husserl, quien se apoyó en ella como uno de los elementos básicos de su fenomenología. Sin embargo, en esta corriente la intencionalidad perdió su sentido clásico. Así lo pone de manifiesto Jacques Maritain en su gnoseología. ¿Por qué Husserl cambia el sentido del concepto?, ¿cuál es la crítica principal de Maritain (...) a este hecho? Parece pertinente esclarecer ambas visiones a fin de comprender el sentido que ha prevalecido en la Filosofía de la Mente contemporánea y las Neurociencias. Lo que se halla en juego es nuevamente la antigua confrontación entre inmanentismo y realismo gnoseológico: admitir en qué consiste la intencionalidad es el punto de inflexión entre estas posiciones. En este trabajo pongo de manifiesto que la forma de asumir un legítimo realismo es mediante una metafísica del ser que reclama una intencionalidad radicada no solamente en el sujeto cognoscente sino además en su relación con la cosa conocida y no sólo con los meros objetos mentales. -/- El propósito de esta publicación es mostrar el punto de quiebre que se lleva a cabo en la teoría del conocimiento y en la psicología racional con respecto al concepto “intencionalidad” del realismo metafísico. La teoría de la intentio en F. Brentano recoge la idea original de los medievales pero sin ser muy explícito en los términos gnoseológicos ya que su objetivo primario consistió sobre todo en superar el psicologismo de su época. En cambio, esa teoría heredada por Husserl se ve alterada completamente con respecto a su sentido primigenio cuando aplica su método trascendental. Esto se puede apreciar en varias partes de su obra "Ideas relativas a una fenomenología pura y una filosofía fenomenológica" (1913). (shrink)

Em meados do século XVI, surgiu a ideia de autonomia do indivíduo, que deu origem ao individualismo e ao liberalismo político. A concepção de democracia que se desenvolveu com base nesses princípios assumiu um perfil bastante diferente daquele utilizado na Grécia antiga. Se antes a democracia estava diretamente ligada à ideia de igualdade, em sua nova versão passou a ser relacionar primordialmente com a ideia de liberdade. Em decorrência dos ideais desenvolvidos naquele momento histórico, o principal dilema político fundamentava-se na (...) limitação de poder do soberano (que às vezes se confundia com o próprio Estado) e na ampliação das liberdades individuais, como o direito a dispor da propriedade material e a defender-se judicialmente. Até hoje, grande parte do debate político tem como tema a defesa dos ideias liberais ou a crítica a eles. Na perspectiva do filósofo inglês Thomas Hobbes, a constituição e o funcionamento de uma sociedade pressupõem que os indivíduos cedam, por transferência, seus direitos naturais (mantendo somente o direito de conservarem sua vida) ao soberano. O autor entendia que os seres humanos, em estado de natureza (isto é, compartilhando do direito a tudo o que existe, em razão de não haver limitação legal), tendem a agir pela força e pela violência para conseguir o que desejam, o que acabaria provocando uma guerra contínua entre todos. Para Hobbes, a justificativa para o poder absoluto dos reis residia na compreensão de que os homens em estado de natureza se encontrariam em constante conflito. Na foto, palácio na Arábia Saudita, em 2012, uma das poucas monarquias absolutas da atualidade. Por isso, para disciplinarem a si mesmos e garantirem o bem-estar físico e material, seria necessário que os indivíduos firmassem um contrato social regulado por uma autoridade soberana. Hobbes manifestou preferência pela monarquia absolutista, pois acreditava que as assembleias e os Parlamentos estimulam os conflitos graças às disputas entre diferentes facções e partidos. O poder absoluto defendido por Hobbes se justificava pela transferência dos direitos dos indivíduos ao soberano. É um nome desse contrato social que o poder deve ser exercido, e não para a realização da vontade pessoal do soberano. Por conta dessa perspectiva, Hobbes não pode ser considerado defensor da democracia. Entretanto, seu pensamento é importante, pois serve de parâmetro para as reflexões sobre a organização do poder construídas posteriormente. No século XVII, John Locke, também filósofo inglês, propôs uma reflexão bem diferente das de Hobbes. Para ele, o poder soberano deve permanecer nas mãos dos cidadãos, que são os melhores juízes dos próprios interesses. Cabe ao governante retribuir a delegação de poderes ao garantir as prerrogativas individuais: segurança jurídica e propriedade privada. Assim, o contrato social teve como função garantir os direitos naturais para todos. Esse pensamento é uma das bases do liberalismo político. Entretanto, deve ser ressaltado que sua implantação não permitiu a construção da igualdade propagada por Locke, mas foi uma das estruturas de consolidação do poder da burguesia. As ideias de Locke são uma das referências para o desenvolvimento da democracia representativa. Na imagem, vemos o palácio de Westminster, em Londres, onde estão situadas as casas do Parlamento e ocorrem as principais decisões políticas do Reino Unido. Para Locke, o princípio da maioria é fundamental para o funcionamento das instituições políticas democráticas, assim como as leis, que devem valer para todos. Por isso, segundo o filósofo, a elaboração das leis precisa estar a cargo de representantes escolhidos pelo povo, que exerceriam o papel de legisladores no interesse da maioria: o regime político proposto por Locke é, portanto, uma democracia representativa. O escritor e filósofo político suíço Jean-Jacques Rousseau se preocupou com o problema da legitimidade da ordem política. Para ele, a desigualdade ocasionada pelo advento da propriedade privada é a causa de todos os sentimentos de ruins do ser humano. No contrato social, é preciso definir a questão da igualdade e do comprometimento de todos com o bem comum. Se a vontade individual é particular, a do cidadão, que vive em sociedade e tem consciência disso, deve ser coletiva e voltada para o bem comum. A participação política é, portanto, ato de deliberação pública que organiza a vontade geral, ou seja, traduz os elementos comuns a todas as vontades individuais. Esse seria, portanto, o núcleo do conceito de democracia. Em seu livro Do Contrato Social2 , Rousseau afirma que a democracia só pode existir se for diretamente exercida pelos cidadãos, sem representação política, pois a vontade geral não poderia ser representada, apenas exercida diretamente. Para Rousseau, a democracia direta é o único sistema legítimo de autoridade e de ato político.3 Em O espírito das leis, o filósofo e político Montesquieu, afirmou que igualdade na democracia é algo muito difícil de garantir plenamente. Partindo do princípio de que é necessário um controle externo para que os sistemas políticos funcionem bem, esse pensador defende a criação de regras que estabeleçam limites aos detentores do poder a fim de manter a liberdade dos indivíduos. Por isso, propôs a divisão da esfera administrativa em três poderes ou funções independentes entre si: o Legislativo, o Executivo e o Judiciário. De maneira resumida, cabem ao poder Legislativo as funções de fiscalizar o poder Executivo, votar leis de interesse público nas instâncias relativas (municipal, estadual e federal) e, em situações específicas, julgar autoridades como o presidente da República ou os próprios membros do Parlamento. O Executivo é o poder do Estado que, nos moldes da Constituição de um país, tem por atribuição governar a nação e administrar os interesses públicos, colocando em prática políticas públicas e leis, e garantindo o acesso aos direitos. Por fim, o poder Judiciário é exercido pelos juízes, que têm a capacidade e a prerrogativa de julgar com base nas regras constitucionais e nas leis criadas pelo poder legislativo. A democracia, na perspectiva de Montesquieu, seria garantida pelo equilíbrio entre os três poderes, assegurando assim maior liberdade aos indivíduos. A liberdade, porém, só existiria com moderação, o que equivaleria a fazer tudo o que as leis permitissem (pois, se um cidadão pudesse fazer tudo o que as leis proibissem, não teria mais liberdade, por que todos poderiam fazer o mesmo). Karl Marx e Friedrich Engels acreditavam que um governo democrático seria inviável numa sociedade capitalista, pois a regulação democrática da vida não poderia se realizar com as limitações impostas pelas relações capitalistas de produção. Seria necessário, portanto, mudar as bases da sociedade para criar possibilidade de uma política democrática. Para entender a posição desses autores com relação à democracia, é necessário entender como eles percebem a função do Estado na sociedade capitalista. Para Marx e Engels, os princípios que protegem a liberdade dos indivíduos e defendem o direito à propriedade tratam as pessoas como iguais apenas formalmente. O movimento em favor do sufrágio universal e de igualdade política é reconhecido por Marx como um passo importante, mas, segundo esse autor, seu potencial emancipador está limitado pelas desigualdades de classe. Desse modo, as democracias liberais seriam cerceadas pelo capital privado, que restringiria sistematicamente as opções políticas. De acordo com esse olhar, a liberdade nas democracias capitalistas é, portanto, puramente formal, pois a desigualdade de classe prevalece. O ensino da Sociologia no Ensino Médio, ao considerar as indicações dos Parâmetros Curriculares Nacionais (PCN), tem como objetivo introduzir o aluno nos principais saberes referentes às questões conceituais e metodológicas que fundamentam a Sociologia, a Antropologia e a Ciência Política2 O contexto de transformação social inaugurado nos séculos XVIII e XIX e a busca pela compreensão científica deste processo vieram estruturar as grandes questões que permeiam este campo do saber. Os paradigmas fundantes da Sociologia, em seus esforços de interpretar (...) o curso das transformações sociais advindas das revoluções industriais e político-sociais, são, portanto, produtos culturais deste processo. Radicado, sobretudo, na busca por estruturar um saber que pudesse oferecer respostas conscientes para dotar a práxis de um sentido capaz de se impor sobre as questões da nova dinâmica social, o campo do conhecimento sociológico, ao chegar às escolas do século XXI, deve ser capaz de promover a reflexão sobre suas próprias bases operacionais. Isso significa que seus parâmetros teóricos e metodológicos fundantes necessitam ser postos a prova constantemente, sendo confrontados com a complexidade do mundo atual. A tradição da Sociologia jamais negou a importância de seu desenvolvimento enquanto ciência crítica de si mesma. Devido a este incessante processo de autocrítica, a reflexão sociológica avalia constantemente de que modo as questões colocadas pelas teorias fundantes de seu saber – as chamadas sociologias clássicas – se comportam diante de um mundo em constante transformação. A inserção da Sociologia como disciplina na grade curricular do Ensino Médio – que veio a realizar-se a partir do Parecer 38/2006, que alterou as Diretrizes Curriculares Nacionais do Ensino Médio tornando a Filosofia e a Sociologia disciplinas obrigatórias, o que efetivou-se com a Lei nº 11 684/08 – vai ao encontro dos objetivos das mudanças propostas pela Lei de Diretrizes e Bases da Educação Nacional (LDBEN) de 1996. Tais mudanças procuraram vincular os pilares do Ensino Médio ao mundo do trabalho e à prática social e objetivaram orientar o papel da educação para capacitar o aprendizado contínuo e autônomo e para o exercício da cidadania. Tais reformas, inclusive, atenderam as propostas da Unesco, que visavam estrutrar a educação em torno de quatro princípios: aprender a conhecer, aprender a fazer, aprender a conviver e aprender a ser.3 Ao postular que as atribuições básicas do conhecimento sociológico são a investigação, a identificação, a descrição e a interpretação/explicação de todos os fatos relacionados à vida social, os PCN enfatizam o papel desse saber para proporcionar ao aluno os instrumentos necessários para decodificar a complexidade da realidade social. Assim, a Sociologia se apresenta, na grade curricular do Ensino Médio, como instrumento necessário à construção da cidadania. Tal compreensão fortalece os laços da Sociologia com as finalidades do Ensino Médio, defnidas pelas mudanças da LDB, sendo respaldada especialmente pela Lei 9 394/96, que estabelece como meta da educação a construção da cidadania. O ensino da Sociologia, desta forma, ocupa relevan-te papel na construção de uma consciência crítica e reflexiva diante das questões do mundo contemporâneo. Rompendo com as barreiras do senso comum, espera-se que o conjunto sistematizado do conhecimento próprio da Sociologia forneça um aparato teórico que torne o estudante capaz de compreender a dinâmica e as contradições da sociedade em que vive. Voltada à realização do exercício pleno da cidadania, a Sociologia esclarece que a construção de uma sociedade mais justa e solidária é tarefa que exige tanto compreender a complexidade social como as formas de responder e agir em sociedade. Para alcançar esse objetivo em sala de aula, segundo as Orientações Curriculares para o Ensino Médio – Conhecimentos de Sociologia4 , o ensino da Sociologia deve se basear em dois princípios epistemológicos fundamentais: estranhamento e desnaturalização. O estranhamento é posto como uma forma de duvidar, que a nada outorga normalidade e nem se conforma diante dos fatos, exercício necessário à problematização dos fenômenos sociais. No momento em que nada se torna óbvio, nem pressuposto, nem simplesmente aceito, se abre o caminho para o educando romper com as amarras do senso comum e construir uma reflexão sistematizada da realidade. Já o momento de desnaturalização é aquele que procura romper com toda e qualquer forma de compreensão das relações sociais como “imutáveis no tempo e no espaço”. Os fenômenos sociais que vivenciamos no presente são, em geral, apreendidos pelo senso comum como simplesmente preestabelecidos, causando o entendimento de uma origem natural das relações sociais. Cabe ao ensino da Sociologia superar esse entendimento e promover a dessacralização e a desnaturalização da realidade, rompendo com seu imediatismo ao submetê- la a critérios científicos de análise. Desta forma, seja qual for o conteúdo trabalhado pela Sociologia, a Antropologia e a Ciência Política, mais do que oferecer um conhecimento dos fatos, o que se privilegia é o desenvolvimento das perspectivas sociológicas, antropológicas e políticas; a história e o contexto de suas produções e as relações estabelecidas com as realidades que contemplam e com as quais dialogam continuamente. A contribuição das Ciências Sociais reside, pois, justamente na formação humana, ao promover constantemente a problematização da realidade, sempre confrontada pelo olhar inquieto e crítico, não apenas do que se encontra ao redor, mas de si próprio e de sua própria perspectiva. This chapter engages with Roger Cotterrell's characterisation of the trust as 'ideological.' However, rather than agreeing with Cotterrell that the trust disguises the true ownership of the beneficiary, it shows that the family trust subverts this idea of a one-sided ownership relation altogether by effecting a reversal in the hierarchical distinction between persons and things. Under the appearance of wealth, beneficial owners are serving the very things they own by ensuring their protection and continuous reproduction.

Causal finitism claims nothing can have an infinite causal history. An influential defense of this position uses infinity paradoxes to argue that, if causal finitism is false, several impossible scenarios would be possible. In this paper, I defend that theists should not be persuaded by this argument. If true, this is an important development, since causal finitism is often argued for by theists as a core premise in Kalam-style cosmological arguments for theism. I extend the same analysis to an argument (...) in favor of temporal finitism and conclude that my point may generalize to any reasoning of a similar structure. (shrink)

Spinoza, le spinozisme et les fondements de la sécularisation est un ouvrage dédié à la mémoire d’Emmanuel Levinas, dont l’auteur a été l’élève durant plusieurs années. Il vise, à travers une analyse d’ordre philosophique, historique, épistémologique et théologique, à mettre au jour les conditions d’émergence interrelatées du spinozisme et de la sécularisation. Pour ce faire, il souligne, entre autres, l’importance des polémiques anti-maimonidiennes, des débats sur les attributs divins, la substance, l’infini, du marranisme et de la Kabbale sur la formation (...) du spinozisme, ainsi que son rapport à la pensée contemporaine. Il mène une recherche interdisciplinaire devant permettre d’éclairer l’origine des difficultés théoriques que ce système philosophique présente. (shrink)

This article aims to shed light on the possible influence of the Kabbalah on Spinoza. To do this, I will analyze the role that the Kabbalist theoretical model may have had on the development of Spinozist philosophy, in order to understand both their convergences and their divergences. I will then clarify Spinoza's relationship to this theory, especially the Lurianic Kabbalah, and emphasize the importance of the notion of Tsimtsum (contraction of the Divine light).

Carl Schmitt's notion of nomos is commonly regarded as the international equivalent to the national sovereign's decision on the exception. But can concrete spatial order alone turn a constellation of forces into an international order? This article looks at Schmitt's work The Nomos of the Earth and proposes that it is the process of bracketing war called Hegung which takes the place of the sovereign in the international order Schmitt describes. Beginning from an analysis of nomos, the ordering function of (...) the presocratic concept moira is explored. It is argued that the process of Hegung, like moira, does not just achieve the containment of war, but constitutes the condition of possibility for plural order. (shrink)

Pascal Engel défend explicitement le purisme (ou l’intellectualisme). Selon la version générale de cette thèse, les facteurs qui déterminent si une croyance est justifiée, ou si elle est une connaissance, ne concernent que la vérité. Ils sont totalement indépendants des désirs ou des préférences du sujet, ainsi que des conséquences pratiques potentielles du fait de posséder ces croyances. Dans son article « Pragmatic Encroachment and Epistemic Value » (2009), P. Engel concède que des facteurs pratiques peuvent déterminer la quantité de (...) données (ou la justification) dont on a besoin pour savoir ou croire, tout en maintenant que cela n’affecte pas le purisme épistémique (dans sa version évidentialiste) sur les notions de donnée ou de degré de justification. Mais cela ne revient-il pas tout simplement à concéder l’impurisme épistémique au moins à propos de la connaissance ou de la justification simpliciter des croyances ? Dans cet article, j’examine en détails la position de P. Engel. Je montre que, correctement comprise, elle est intégralement puriste. En considérant le principe connaissance-action, je soulève néanmoins un dilemme pour son approche, jetant ainsi un doute sur le potentiel qu’elle aurait à fournir une réponse puriste satisfaisante à l’argument fondamental motivant l’impurisme épistémique. Under the title 'Truth', Strawson and Evans discuss the question as to whether the distinction between genuinely fact-stating uses of language and other uses can be grounded on a theory of truth, especially a 'thin' notion of truth in the tradition of F P Ramsey.

The aim of this article is to bring to light some of the factors that allowed the emergence of secularization, and to understand to what extent and in what ways these factors contributed to the formation of the main lines of Spinozism. I will first examine the issues of secularization, emphasizing the importance of the transformations in the status of the Hebrew language during the Renaissance. I will then analyze the role that the Tractatus theologico-politicus may have had in European (...) culture. Finally, I will clarify Spinoza’s relationship to deism and atheism, specifying the nature of the controversies related to his religious attitude. (shrink)

Some commentators consider Spinoza to be profoundly immoralist, while for others he upholds the set of human values. Spinoza sought to go beyond the utilitarianism proper to the conatus of each person, in order to establish a rational altruism. He emphasizes that the good to which man aspires when he follows virtue, he will also desire for all other men. However, the means used to demonstrate this thesis seem problematic. This article analyzes Spinoza's logic of interhuman cooperation, as well as his ideal of the free man, showing that, in fact, he failed to overcome the profoundly egoistic nature of conatus. -/- . This article provides a property analysis of electronic money, showing that the issuance of electronic money cannot involve a trust. The analysis is also applicable to other digital assets that may be said to involve a trust, and as such provides a timely contribution to current discussions on the legal nature and categorisation of digital assets both in the UK and internationally.

It is widely held that assertions are partially governed by an epistemic norm. But what is the epistemic condition set out in the norm? Is it knowledge, truth, belief, or something else? In this paper, I defend a view similar to that of Stanley (2008), according to which the relevant epistemic condition is epistemic certainty, where epistemic certainty (but not knowledge) is context-sensitive. I start by distinguishing epistemic certainty, subjective certainty, and knowledge. Then, I explain why it's much more plausible (...) to think that "certain", rather than "know", is context-sensitive. After that, I respond to an important worry raised by Pritchard, according to which the proposed view is too strong to accommodate our current practice of assertion. I then show that the main linguistic and conversational data advanced in the recent literature in favour of the knowledge condition are best explained by the certainty view. Finally, I offer two principled considerations: the certainty view is the only one compatible with three independently plausible claims and it fits very well with the common thought that knowledge does not entail certainty. During the Second World War, more than 60,000 Jewish members of the American, British and French armed forces became prisoners of war in Germany. Against all expectations, these prisoners were treated in accordance with the 1929 Geneva Convention, and the majority made it home alive. This article seeks to explain this most astonishing circumstance. It begins by collating the references to the experiences of Western Jewish POWs from the historical literature to provide a hitherto-unseen overview of their treatment in captivity. (...) It then asks what made their protection from persecution possible. To this end, it explores Germany’s wider motivations for its selective application of the Geneva Convention and highlights the role that military identity played in making its application seem necessary for all POWs from the Western front, including Jewish POWs. What does it mean to act politically? This paper contributes an answer to this question by looking at the role that necessity plays in the political theory of Carl Schmitt. It argues that necessity, whether in the form of existential danger or absolute values, does not affect the sovereign decision, which must be free from normative determinations if it is to be a decision in Schmitt’s sense at all. The paper then provides a reading of Schmitt in line with Weber’s (...) ethics of responsibility, according to which the political actor decides not arbitrarily and irresponsibly, but actively assumes responsibility for the decisions he takes. This article takes as its subject matter the juridico-political space of the prisoner of war (POW) camp. It sets out to determine the nature of this space by looking at the experience of war captivity by Jewish members of the Western forces in World War II, focusing on the experience of Emmanuel Levinas, who spent 5 years in German war captivity. On the basis of a historical analysis of the conditions in which Levinas spent his time in captivity, it argues (...) that the POW camp was a space of indifference that was determined by the legal exclusion of prisoners from both war and persecution. Held behind the stage of world events, prisoners were neither able to exercise their legal agency nor released from law into a realm of extra-legal violence. Through a close reading of Levinas’s early concept of the ‘there is’ [il y a], the article seeks to establish the impact on prisoners of prolonged confinement in such a space. It sets out how prisoners’ subjectivity dissolved in the absence of meaningful relations with others and identifies the POW camp as a space in which existence was reduced to indeterminate, impersonal being. The question of Spinozist determinism and necessitarianism have been extensively studied by commentators, while the relationship between the notions of divine will and free will still requires elaborate studies. Our article seeks to contribute to such research, by clarifying the analyses of these questions by authors that Spinoza has confronted: Maimonides, as well as other Jewish philosophers, and Leibniz who criticized Spinozist determinism. It presents interdisciplinary research to shed light on the origin of the theoretical difficulties that this philosophical system presents. The paper presents the notion of “Spirit of Nature” in Henry More and describes its position within More’s philosophical system. Through a thorough analysis, it tries to show in what respects it can be considered a scientific object and in what respects it cannot. In the second part of this paper, More’s “Spirit of Nature” is compared to Newton’s various attempts at presenting a metaphysical cause of the force of gravity, using the similarities between the two to see this notorious (...) problem of Newton scholarship in a new light. One thus sees that if Newton drew from Stoic and Neo-Platonic theories of aether or soul of the world, we need to fully acknowledge the fact that these substances were traditionally of a non-dualistic, half-corporeal, half-spiritual nature. Both More’s “Spirit of Nature” and Newton’s aether can thus be understood as different attempts at incorporating such a pneumatic theory into the framework of modern physics, as it was then being formed. A certain number of cases suggest that our willingness to ascribe “knowledge” can be influenced by practical factors. For revisionary proposals, they indicate that the truth‐values of “knowledge” ascriptions vary with practical factors. For conservative proposals, on the contrary, nothing surprising is happening. Standard pragmatic approaches appeal to pragmatic implicatures and psychological approaches to the idea that belief formation is influenced by practical factors. Conservative proposals have not yet offered a fully satisfactory explanation, though. In this article, I introduce and (...) defend a third conservative proposal which I call “Refined Invariantism”. The two main claims of this proposal are that (1) we should distinguish between high stakes cases in which the subject does not believe (that he knows) the target proposition and those in which he believes (that he knows) the target proposition and that (2) we should adopt a psychological treatment for the first kind of case and a pragmatic treatment based on the epistemic standards for appropriate assertion and action for the second kind of case. I argue that this new combined approach avoids the main pitfalls of its two conservative rivals and that it gives new life to the generality objection levelled against revisionary views. (shrink)

Logic and psychology overlap in judgment, inference and proof. The problems raised by this commonality are notoriously difficult, both from a historical and from a philosophical point of view. Sundholm has for a long time addressed these issues. His beautiful piece of work [A Century of Inference: 1837-1936] begins by summarizing the main difficulty in the usual provocative manner of the author: one can start, he says, by the act of knowledge to go to the object, as the Idealist does; (...) one can also start by the object to go to the act, in the Realist mood; never the two shall meet. He is himself inclined to accept the first perspective as the right one and he has eventually developed an original version of antirealism which starts, not from considerations about the publicity of meaning, in the manner of Dummett, but from an epistemic standpoint, trying to search in a non-Fregean tradition of analysis of judgement and cognate notions a way of founding constructivist semantics. The present paper ploughes the same field. Standard epistemic logic actually formalizes folk-psychology. The problem of logical omniscience shows that this logic is not adequate in a cognitivist setting. In order to describe realistic information-processing believers, we need both an ontology of particulars and a hyper-intensional taxonomy of representations. From this point of view, sub-structural logics, which do not overlook the syntaxic details of the processing of information, are an interesting alternative to possible worlds semantics.

Neuroscience has studied deductive reasoning over the last 20 years under the assumption that deductive inferences are not only de jure but also de facto distinct from other forms of inference. The objective of this research is to verify if logically valid deductions leave any cerebral electrical trait that is distinct from the trait left by non-valid deductions. 23 subjects with an average age of 20.35 years were registered with MEG and placed into a two conditions paradigm (100 trials for (...) each condition) which each presented the exact same relational complexity (same variables and content) but had distinct logical complexity. Both conditions show the same electromagnetic components (P3, N4) in the early temporal window (250–525 ms) and P6 in the late temporal window (500–775 ms). The significant activity in both valid and invalid conditions is found in sensors from medial prefrontal regions, probably corresponding to the ACC or to the medial prefrontal cortex. The amplitude and intensity of valid deductions is significantly lower in both temporal windows (p = 0.0003). The reaction time was 54.37% slower in the valid condition. Validity leaves a minimal but measurable hypoactive electrical trait in brain processing. The minor electrical demand is attributable to the recursive and automatable character of valid deductions, suggesting a physical indicator of computational deductive properties. It is hypothesized that all valid deductions are recursive and hypoactive. (shrink)

My concern is with the minimal suggestion that an adequate philosophical theory of scientific explanation can limit its attention to the format or structure with which theories are represented. The representational subsumption view is a plausible hypothesis about the psychology of understanding. It is also a plausible claim about how scientists present their knowledge to the world. However, one cannot address the central questions for a philosophical theory of scientific explanation without turning one’s attention from the structure of representations to the basic commitments about the worldly structures that plausibly count as explanatory. A philosophical theory of scientific explanation should achieve two goals. The first is explanatory demarcation. It should show how explanation relates with other scientific achievements, such as control, description, measurement, prediction, and taxonomy. The second is explanatory normativity. It should say when putative explanations succeed and fail. One cannot achieve these goals without undertaking commitments about the kinds of ontic structures that plausibly count as explanatory. Representations convey explanatory information about a phenomenon when and only when they describe the ontic explanations for those phenomena. (shrink)

Many philosophers agree that there is an epistemic norm governing action. However, they disagree on what this norm is. It has been observed that the word ‘know’ is prominent in ordinary epistemic evaluations of actions. Any opponent of the knowledge norm must provide an explanation of this fact. Gerken has recently proposed the most developed explanation. It invokes the hypothesis that, in normal contexts, knowledge-level warrant is frequently necessary and very frequently sufficient (Normal Coincidence), so that knowledge-based assessments would be (...) a good heuristic for practical reasoning and epistemic evaluations of action. In this paper, I raise three problems for this approach. First, I argue that Normal Coincidence is ad hoc: it relies on an unsupported frequency hypothesis that we should expect to be false given the warrant account that Gerken also endorses. Second, I argue that, in any case, Normal Coincidence is insufficient to support the hypothesis that knowledge-based evaluation of action constitutes a good heuristic. Third, I consider three other hypotheses close to Normal Coincidence apparently more likely to support the heuristic hypothesis, but I argue that they seem even more ad hoc than Normal Coincidence. Within a liberal, ‘law of things’ understanding of property, the donative trust is seen as a species of gift. Control over trust property passes from the hands of settlors to beneficiaries, from owners to owners. Trust property, like all other property, is silent and passive, its fate determined by its owners. This article questions this understanding of the trust by showing how beneath the facade of ownership, the trust inverts the relation between owner and owned, person and thing. It analyses (...) the relation that trustees, beneficiaries and settlors have to the trust property and argues that the role of each of these parties can be shown to consist in furthering the interests of the trust property rather than their own. It claims that this protects things from their owners at the same time as it ensures these owners’ ongoing care towards the things they own. This raises questions about the trust’s status within the institution of private property, justified as it is by the human autonomy it is said to enable. (shrink)

Whereas his earlier writings on religion focus on Jewish and Christian authors who blur the boundaries of religious belonging, this essay directly questions the categories of religion and secularization. Against this background, Derrida revisits the work of Kant, Voltaire, Nietzsche, and Heidegger, and he reflects on his own engagement with messianism, negative theology, and the khôra.

En este artículo abordo críticamente la aseveración de David Papineau según la cual la evidencia fisiológica acumulada es suficiente para adoptar razonablemente el Principio del Cierre Causal de lo Físico y la vía negativa, viz. entender físico como no mental, como solución al dilema de Hempel. Comenzaremos restando fuerza a tal afirmación revisando el trabajo de W. Penfield y J. Eccles, dos importantes neurocientíficos y declarados dualistas. No obstante, luego nos centraremos en el trabajo de B. Libet en el que (...) se demostraría que los movimientos voluntarios están realmente determinados por causas enteramente fisiológicas, lo cual constituiría una pieza fundamental de evidencia a favor de Papineau. Nuestro análisis mostrará que no se siguen tales conclusiones. Esto tendrá consecuencias negativas para el Cierre Causal de lo Físico y con ello para el Argumento Causal para el Fisicalismo del cual el mencionado principio es premisa clave. (shrink)

Bolzano fut le premier philosophe à établir une distinction explicite entre les procédés déductifs qui nous permettent de parvenir à la certitude d’une vérité et ceux qui fournissent son fondement objectif. La conception que Bolzano se fait du rapport entre ce que nous appelons ici, d’une part, « conséquence subjective », à savoir la relation de raison à conséquence épistémique et, d’autre part, la « conséquence objective », c’est-à-dire la fondation , suggère toutefois que Bolzano défendait une conception « explicativiste (...) » de la preuve : les preuves par excellence sont celles qui reflètent l’ordre de la fondation objective. The present article focuses on the idea that divine nature is prior to being. This idea was first articulated in John of Scythopolis’s commentary on Pseudo-Dionysius. It was adopted by Maximus Confessor and re-used in Meister Eckhart’s first Quaestio Parisiensis. The main tenet of this idea is that, if God is the origin of being, he must be more fundamental than being. Thus, being cannot be identical to divine nature. The conclusion that can be drawn from the discussion of this (...) idea is that the importance that has been traditionally attached to the "Exodusmetaphysik" must be reconsidered, and that the pro-ontological conception of divine nature constitutes an autonomous tradition in Christian thought. Lawrence Kohlberg's Approach to Moral Education presents what the late Lawrence Kohlberg regarded as the definitive statement of his educational theory. Addressing the sociology and social psychology of schooling, the authors propose that school culture become the center of moral education and research. They discuss how schools can develop as just and cohesive communities by involving students in democracy, and they focus on the moral decisions teachers and students face as they democratically resolve problems. As the authors put it: "...we (...) propose an educational renewal of our democratic society.... We have attempted to establish schools that do more than just teach about democratic citizenship, that are themselves democratic societies.". (shrink)

Abortion bans have been characterized as cruel especially in not allowing exceptions for rape or incest. The article first examines one approach to morally justifying bans based on the Doctrine of Double Effect (DDE) which distinguishes morally between killing or letting die intending death versus doing so only foreseeing death. It then presents some criticisms of the implications of the DDE but also argues that what the doctrine permits helps provide a ground for the permissibility of abortions even if the (...) fetus is a person. Whether there are limits on applying this argument is also considered. In conclusion, the article considers whether and why not permitting exceptions to bans for rape and incest is cruel and whether cruelty is a ground for opposition to bans. (shrink)

I present a possible worlds semantics for a hyperintensional belief revision operator, which reduces the logical idealization of cognitive agents affecting similar operators in doxastic and epistemic logics, as well as in standard AGM belief revision theory. (Revised) belief states are not closed under classical logical consequence; revising by inconsistent information does not perforce lead to trivialization; and revision can be subject to ‘framing effects’: logically or necessarily equivalent contents can lead to different revisions. Such results are obtained without resorting (...) to non-classical logics, or to non-normal or impossible worlds semantics. The framework combines, instead, a standard semantics for propositional S5 with a simple mereology of contents. (shrink)

According to buck-passers about art, such as Dominic Lopes, every work of art belongs to some art. I distinguish two versions of the buck-passing theory of art—what I call the double-buck-passers’ (DBP) view and the single-buck-passers’ (SBP) view—and point out that Lopes’s view is an instance of the latter. Then I argue the SBP view faces a dilemma, each horn of which leads to trouble. In doing so, I explore uncharted territory: the implications of vagueness for theories of art.
