The purpose of this work is to investigate the main philosophical underpinnings of major research paradigms using Positivism and Interpretivism as examples. It would also explain and give crucial interrelationships with ontology, epistemology, methodology, and method. The study followed a literature review approach and was mostly supported by secondary research, which included the incorporation and consideration of many peer-reviewed academic papers relevant to the issue as well as other sources such as books. Researchers might examine the fitness of every model (...) based on the nature and context of their study. This work will assist scholars in developing a better grasp of both positivist and interpretivist perspectives. The interpretivist paradigm might allow researchers to go deeper by seeking perceptions and experiences of a specific social context. The positivist paradigm, on the other hand, will allow researchers to rely more on statistics and generalization, resulting in the formation of universal rules and discoveries. -/- . (shrink)

It emphasizes the importance of interdisciplinary collaboration between philosophers, economists, and social scientists to gain a comprehensive understanding of narratives' influence on economic decision-making, market dynamics, and (...) class='Hi'>consumer behaviour. The research suggests that narratives offer a means to challenge the notion of a single, objective truth and contribute to a more inclusive and robust framework for analyzing economic phenomena. The implications extend beyond economics, urging a broader perspective on epistemology by embracing narrative perspectives and engaging in interdisciplinary collaboration across disciplines. The notion of intelligence is relevant to several fields of research, including cognitive and comparative psychology, neuroscience, artificial intelligence, and philosophy, among others. However, there is little agreement within and across these fields on how to characterise and explain intelligence. I put forward a behavioural, operational characterisation of intelligence that can play an integrative role in the sciences of intelligence, as well as preserve the distinctive explanatory value of the notion, setting it apart from the related concepts of cognition and (...) rationality. Finally, I examine a popular hypothesis about the underpinnings of intelligence: the capacity to manipulate internal representations of the environment. I argue that the hypothesis needs refinement, and that so refined, it applies only to some forms of intelligence. (shrink)

Both biosemiotics and evolutionary epistemology are concerned with how knowledge evolves. (Applied) Evolutionary Epistemology thereby focuses on identifying the units, levels, and mechanisms or processes that underlie the evolutionary development of knowing and knowledge, while biosemiotics places emphasis on the study of how signs underlie the development of meaning. We compare the two schools of thought and analyze how in delineating their research program, biosemiotics runs into several problems that are overcome by evolutionary epistemologists. For one, by emphasizing signs, biosemiotics (...) needs to delineate a semiotic threshold, which is a problem not encountered by evolutionary epistemologists. Instead, the latter recognizes that all organisms are knowers that evolve knowledge, which they recognize to extend toward phenomena produced by organisms such as behavior, cognition, language, culture, science, and technology. Secondly, biosemiotics attempts at continuing adaptationist notions on how organisms relate to their environment, while especially Applied Evolutionary Epistemology comes to redefine the nature of the organism–environment relationship in such a way that it recognizes the spatiotemporal boundedness of existence, which in turn makes adaptationist accounts obsolete. This paper studies the problem of the arrow of time from the scientific and philosophical perspective. The scientific section (Castagnino) poses the topic according to the instruments of measuring employed in physical theories, specially when they are applied to dynamic chaotic systems in which a temporal asymmetry is shown. From the analysis of “two schools” (epistemological and ontological), the conclusion is favorable to the reality (both ontological and epistemological) of the difference between past and future, with the recourse to Reichenbach’s (...) notion of global system. In the philosophical section (Sanguineti) the content of the scientific part of the article is presented in a qualitative way. The role of some philosophical choices in the scientific field is stressed, taking into account the diversity of a positivistic and realistic view. (shrink)

This paper has three main objectives: (a) Discuss the formal analogy between some important symmetry-invariance arguments used in physics, probability and statistics. Specifically, we will focus on Noether’s theorem in physics, the maximum entropy principle in probability theory, and de Finetti-type theorems in Bayesian statistics; (b) Discuss the epistemological and ontological implications of these theorems, as they are interpreted in physics and statistics. Specifically, we will focus on the positivist (in physics) or subjective (in statistics) interpretations vs. objective interpretations that (...) are suggested by symmetry and invariance arguments; (c) Introduce the cognitive constructivism epistemological framework as a solution that overcomes the realism-subjectivism dilemma and its pitfalls. If it is new, it is not in a radical sense since Mario Bunge practiced it in an exemplary way, since logical positivists were accused of practicing only a mere metascience, since scientists have always practiced it implicitly, and since some philosophers no longer practice philosophy but rather metascience, but without characterizing it (...) or theorizing it, that is, without realizing that they have abandoned one general discourse for another. The novelty therefore lies in this awareness that a general discourse without philosophy is possible: a scientific general discourse. -/- The ten contributions gathered in this volume illustrate the metascientific approach to knowledge of the world as well as to knowledge of knowledge of the world, that is, science. And like Bunge’s project, they are neither part of the analytical movement nor the continental movement in philosophy. We will read here studies about the Bungean system, some applications of Bungean thought, some metascientific contributions, and some reflections around metascience. -/- Among metascientific disciplines, epistemology occupies a prominent place in this issue of Mεtascience. Metascience differs from philosophy in its rejection of the fundamental philosophical distinction between appearance and reality. Metascientific epistemology therefore does not postulate the existence of any metaphysical reality. But metascientific epistemology, no more than philosophical ontology, is a factual science. Nobody doubts that culture plays a decisive role in understanding human forms of life. But it is unclear how this decisive role should be integrated into a comprehensive explanatory model of human behaviour that brings together naturalistic and social-scientific perspectives. Cultural difference, cultural learning, cultural determination do not mix well with the factors that are normally given full explanatory value in the more naturalistic approaches to the study of human behaviour. My purpose in this paper is to alert to some (...) of the theoretical vulnerabilities or concerns that the cross-cultural study of mind and behaviour might entail. I classify these theoretical concerns into three, loosely defined, categories: epistemological, ontological and ethical. The first have to do with what in anthropology was once labelled as ‘butterfly collecting’. What kind of supplementary, or additional, general theoretical knowledge do we produce when we add to the research different, particularistic, culturally determined, ways of knowing? Ontological concerns refer to the underlying reality that those ways of knowing are meant to disclose. If there are so many ways of knowing the world, where is the reality to be known? Ethical concerns are those entailed in the forms of ‘othering’ that unqualified cross-cultural research is likely to produce in research participants. (shrink)

His adherents have highlighted the "relativization of inertia" and the concept of simultaneity, Kantians and Neo-Kantians have underlined the approach of certain synthetic "intellectual forms" (especially the principle of general covariance, and logical empirics have emphasized the philosophical methodological significance of the theory. Reichenbach approached the GR through the "relativity of geometry" thesis, trying to build a "constructive axiomatization" of relativity based on "elementary matters of fact" (Elementartatbestande) for the observable behavior of (...) light rays, rods and clocks. The mathematician Hermann Weyl attempted a reconstruction of Einstein's theory based on the epistemology of a "pure infinitesimal geometry", an extended geometry with additional terms that formally identified with the potential of the electromagnetic field. Approaches to the naturalization of phenomenology usually understand naturalization as a matter of rendering continuous the methods, epistemologies, and ontologies of phenomenological and natural scientific inquiry. Presupposed in this statement of the problematic, however, is that there is an original discontinuity, a rupture between phenomenology and the natural sciences that must be remedied. I propose that this way of thinking about the issue is rooted in a simplistic understanding of the phenomenological reduction that entails certain assumptions about the subject matter (...) of phenomenology and its relationship to the natural sciences. By contrast, Merleau‐Ponty's first work, The Structure of Behavior, presents a radically different approach to the phenomenological reduction, one that traverses the natural sciences and integrates them into phenomenology from the outset. I outline the argument for this position in The Structure of Behavior and then discuss consequences for current methodological issues surrounding the naturalization of phenomenology, focusing on the relationship between empirical sciences of mind, phenomenological psychology, and transcendental phenomenology. This novel exegesis of Merleau‐Ponty's view on the reduction offers new insight into his oft‐quoted remark that the phenomenological reduction is impossible to complete. (shrink)

Arthur Kaufmann is one of the most prominent figures among the contemporary philosophers of law in German speaking countries. For many years he was a director of the Institute of Philosophy of Law and Computer Sciences for Law at the University in Munich. Presently, he is a retired professor of this university. Rare in the contemporary legal thought, Arthur Kaufmann's philosophy of law is one with the highest ambitions — it aspires to pinpoint the ultimate foundations of law by explicitly (...) proposing an ontology, a general theory of knowledge and concept of a person. Kaufmann's work derives, first of all, from the thinking of Gustav Radburch, his teacher, and then from ideas of Karl Engish and Hans-Georg Gadamer. The philosophy undertakes to pursue the ultimate foundation of law, law which is understood by Kaufmann, first of all, as a "concrete judgement" that is, what is right in a concrete situation. Justice belongs to the essence of law and "unjust law" is contradictio in adiectio. Kaufmann opposes all those theories, which as the only foundation for establishing just law (Recht) adopt legal norms (Gesetz). In Kaufmann's opinion , such theories are powerless in the face of all types of distortions of law rendered by political forces. He suggests that the basic phenomenon which needs to be explained and which cannot be disregarded by a philosopher of law is so-called "legal lawlessness" ("Gestzliches Unrecht"). "Legal lawlessness" which forms a part of life experience for the people of twentieth century totalitarian states. It proved "with the accuracy of scientific experiment" that the reality of law consists of something more than bare conformity with legal norms. The existence of lex corrupta indicates that law contains something "non-dispositive" which requires acknowledgment of both law-maker and judge. Kaufmann, accepting the convergent concept of truth and cognition, assumes that "non-dispositive" content, emerging as the conformity of a number of cognitive acts of different subjects (inter-subjective communicativeness and verifiability), indicates the presence of being in this cognition. The questions "What is law?" and "What are the principles of a just solution?" lead straight to the ontology of law, to the question about the ontological foundations of law. Kaufmann discerns the ontological foundations of law in the specifically understood "nature of things" and, ultimately, in a "person". He proposes a procedural theory of justice, founded on a "person". In my work, I undertake to reconstruct the train of thought which led Kaufmann to the recognition of a "person" as the ontological foundation of law. In the first part, the conception of philosophy adopted by Kaufmann, initial characteristics of law — of reality which is the subject of analysis, as well as, the requirements for proper philosophical explanation of law posed by Kaufmann are introduced. In the second, Kaufmann's reconstruction of the process of the realisation of law is presented. Next, the conception of analogy which Kaufmann uses when explaining law is analyzed. In the fourth part, Kaufmann's conception of ontological foundations of law is discussed. A critical analysis is carried out in which I demonstrate that the theory of the ontological foundation of law proposed by Kaufmann and the concept of a person included in it do not allow a satisfac¬tory explanation of the phenomenon of "legal lawlessness" and lead to a number of difficulties in the philosophical explanation of law. Finally, the perspectives of a proper formulation of the issue of the ontological foundations of law are drafted in the context of the analyzed theory. My interest is centered on the conception of philosophy adopted by Kaufmann, according to which the existence of the reality is inferred on the basis of a certain configuration of the content of consciousness, whereas at the point of departure of philosophy of law, the data to be explained is a certain process, which is, basically, a process of cognition, while the reality appears only as a condition for the possibility of the occurrence of the process. I wish to argue that the difficulties which appear in the explanation of law are a consequence of the assumed fundamental philosophical solu¬tions, which seem to be characteristic, though usually not assumed explicitly, in philoso¬phy and theory of law dominant at present in continental Europe. Thereby, I wish to show the significance of ontological and epistemological solutions to the possibility of a proper formulation of the problems posed by philosophy and theory of law. Kaufmann proclaims himself in favour of a philosophy which poses questions about the ultimate foundations of understanding of the reality. In epistemology, he assumes that answers to the questions "What is reality like?" and ultimately "What is real?" are inferred on the basis of uniformity of a cognitive acts of different subjects. Cognition of the reality is accomplished exclusively through the content of conceptual material. The two fundamental questions posed by philosophy of law are "What is just law?" and "How is the just law enacted?" The latter is a question about the process of achieving a solution to a concrete case. Since, in Kaufmann's opinion, law does not exist apart from the process of its realisation, an answer to the question about the manner of realisation of law is of fundamental significance to answering the question: "What is law?" and to the explanation of the question about the ontological grounding of law, which is, as well, the foundation of justice. The proper solution has to take into account the moment of "non-dispositive" content of law; its positiveness understood as the reality and, at the same time, it has to point to the principles of the historical transformation of the content. Law, in the primary meaning of the word, always pertains, in Kaufmann's opinion, to a concrete case. A legal norm is solely the "possibility" of law and the entirely real law is ipsa res iusta, that which is just in a given situation. Determination of what is just takes place in a certain type of process performed by a judge (or by man confronted with a choice). Kaufmann aims to reconstruct this process. A question about the ontological foundation of law is a question about the ontological foundations of this process. In the analyzed theory it is formulated as a question about the transcendental conditions, necessary for the possibility of the occurrence of the process: how the reality should be thought to make possible the reconstructed process of the realisation of law. Kaufmann rejects the model for finding a concrete solution based on simple subsump¬tion and proposes a model in which concrete law ensues, based on inference by analogy, through the process of "bringing to conformity" that which is normative with that which is factual. Kaufmann distinguishes three levels in the process of the realisation of law. On the highest level, there are the fundamental legal principles, on the second legal norms, on the third — concrete solutions. The fundamental principles of law are general inasmuch as they cannot be "applied" directly to concrete conditions of life, however, they play an important part in establishing norms. A judge encounters a concrete situation and a system of legal norms. A life situation and norms are situated on inherently different levels of factuality and normativeness. In order to acquire a definite law both a norm (system of norms) and a life situation (Lebenssachverhalt) should undergo a kind of "treatment" which would allow a mutual conformity to be brought to them. Legal norms and definite conditions of life come together in the process of analogical inference in which the "factual state" ("Tatbestand") — which represents a norm, and in the "state of things" ("Sachverhalt") — which represents a specific situation are constructed. A "factual state" is a sense interpreted from a norm with respect to specific conditions of life. The "state of things" is a sense constructed on the basis of concrete conditions of life with respect to norms (system of norms). Legal norms and concrete conditions of life meet in one common sense established during the process of realisation of law. Mutatis mutandis the same refers to the process of composition of legal norms: as the acquisition of concrete law consists in a mutual "synchronization" of norms and concrete conditions of life, so acquisition of legal norms consists of bringing to conformity fundamental principles and possible conditions of life. According to Kaufmann, both of these processes are based on inference through analogy. As this inference is the heart of these processes it is simultaneously a foundation finding just law and justice. How does Kaufmann understand such an inference? As the basis for all justice he assumes a specifically interpreted distributive justice grounded on proportionality. Equality of relations is required between life conditions and their normative qualification. Concrete conditions of life are ascribed normative qualification not through simple application of a general norm. More likely, when we look for a solution we go from one concrete normative qualified case to another, through already known "applications" of norms to a new "application". The relation between life conditions and their normative qualifica¬tion has to be proportional to other, earlier or possible (thought of) assignments of that which is factual to that which is normative. Law as a whole does not consist of a set of norms, but only of a unity of relations. Since law is a, based on proportion, relative unity of a norm and conditions of life, in order to explain law in philosophical manner, the question about ontological base of this unity has to be asked. What is it that makes the relation between a norm and conditions of life "non-dispositive"? What is the basis for such an interpretation of a norm and case which makes it possible to bring a norm and conditions of life into mutual "conformity"? This is a question about a third thing (next to norms and conditions of life), with respect to which the relative identity between a norm and conditions of life occurs, about the intermediary between that which is normative and that which is factual and which provides for the process of establishing of norms, as well as, finding solutions. It is the "sense" in which the idea of law or legal norm and conditions of life have to be identical to be brought to mutual "conformity". In Kaufmann's opinion such a sense is nothing else but the "nature of things" which determines the normative qualification of the reality. Since establishment of this "sense" appears to be "non-dispositive" and controlled inter-subjectively (namely, other subjects will reach a similar result) so, in conformity with the convergent concept of truth, the "nature of things" must be assigned a certain ontological status. According to Kaufmann this is a real relation which occurs between being and obligation, between the conditions of life and normative quality. However, it should be underlined that from the point of view of the analyzed system the "nature of things" is a correlate of constructed sense, a result of a construction which is based on the principle of consistent understanding of senses ("non-normative" and "normative") and is not a reality which is transcendent against the arrangement of senses. In Kaufmann's theory, inference from analogy appears to be a process of reshaping the concepts (senses) governed by tendency to understand the contents appearing in relations between that which is factual and that which is normative in a consistent way. The analogical structure of language (concepts) and recognition of being as composed of an essence and existence is an indispensable requirement for the possibility of the realisation of law, based on specifically understood inference from analogy. It is necessary to assume a moment of existence without content which ensures unity of cognition. Existence emerges thus as a condition of the possibility of cognition. According to Kaufmann, the "nature of things" is the heart of inference through analogy and the basis for establishment of finding of law. Inference from the "state of things" to a norm or from a norm to the "state of things" always means inference through the "nature of things". The "nature of things" is the proper medium of objective legal sense sought in every cognition of law. In Kaufmann's view, the question whether the "nature of things" is ultima ratio of interpretation of law or is only a means of supplement gaps in law or whether it is one of the sources of law, is posed wrongly. The "nature of things" serves neither to supplement the gaps nor is it a source of law as, for example, a legal norm may be. It is a certain kind of "catalyst" necessary in every act of making law and solving a concrete case. Owing to "nature of things" it is possible to bring to a mutual conformity the idea of law and possible conditions of life or legal norms and concrete conditions of life. In Kaufmann's conception the "nature of things" is not yet the ultimate basis for understanding the "non-dispositiveness" of law. The relation between obligation and being is determined in the process of the realisation of law. Both the process itself and that which is transformed in this process are given. A question about the ontological bases of "material" contents undergoing "treatment" in the process of the realisation of law and about being which is the basis of regularity of the occurrence of the process arises. Only this will allow an explanation that the result of the process is not optional. Thus, a question about reality to which law refers and about the subject realising the law has to be formed. To this, Kaufmann gives the following answer: that which is missing is man but not "empirical man" but man as a "person". A "person" understood as a set of relations between man and other people and things. A "person" is the intermediary between those things which are different — norm and case are brought to conformity. A "person" is that which is given and permanent in the process of the realisation of law. It determines the content of law, is "subject" of law; this aspect is described by Kaufmann as the "what" of the process of realisation of law. A "person" consists of precisely just these relations which undergo "treatment" in the process. On the other hand, a "person" is "a place" in which the processes of realisation of law occur, it is the "how" of normative discourse, a "person" is that which determines the procedure of the process, being "outside" of it. This aspect of a "person" is connected with the formal moment of law. A "person" being, at the same time, the "how" and the "what" of the process of the realisation of law, is also, to put it differently, a structural unity of relation and that which constitutes this relation (unity of relatio and relata). According to this approach a "person" is neither an object nor a subject. It exists only "in between". It is not substance. Law is the relation between being and obligation. That which is obligatory is connected with that which is general. That which is general does not exist on its own, it is not completely real. Accordingly, a "person" as such is also not real. It is relational, dynamic and historical. A "person" is not a state but an event. In Kaufmann's opinion, such a concept of a "person" helps to avoid the difficulties connected with the fungibility of law in classical legal positivism. A "person" is that which is given, which is not at free disposal and secures the moment of "non-dispositiveness" of law. Kaufmann concludes: "The idea (»nature«) of law is either the idea of a personal man or is nothing". Theory points at the structure of realising law and explains the process of adoption of general legal norms for a concrete situation. The analysis has shown however, that in this theory a satisfactory answer to the question about the ultimate foundations of law is not given. It seems that in the analyzed theory the understanding of human being takes place through understanding of law. What is good for man as a "person", what is just, what a "person" deserves may be determined only against the existing system of law. A "per¬son" adopted as a basis of law is the reality postulated in the analysis of the process of the realisation of law. It is a condition of possibility of this process ( explaining, on one hand, its unity and, on the other hand, the non-dispositive moments stated in this process). A "person" in the discussed theory is entirely defined by the structure of law, it can be nothing more than that which is given in law, what law refers to, what law is about. Being, which is a "person", is constituted by relations between people and objects, the relations which are based on fundamental links between norms and conditions of life established in a process of bringing them to conformity. It has to be assumed that man as a "person" is a subject of law only as far as realising law "treats" given senses according to their current configuration. The system of law is a starting point and it describes in content what man is as a "person". Moreover, being a "person" is the condition for entering legal relations. Consistently, Kaufmann writes that "empirical man" is not the subject of law, man is not "out of nature" a "person". People become "persons" due to the fact that they acknowledge each other as "persons" — acknowledging, at the same time, law. This acknowledgement is a con¬dition of existence, of the possibility of the occurrence of process of realisation of law and of constituting legal relations which ultimately constitute a "person". Kaufmann assumes, that law tends towards a moral aim: it may and must create an external freedom, without which the internal freedom to fulfil moral obligations cannot develop. However, this postulate is not based on the necessary structure of human being. From the point of view of his system, it is nothing more than only a condition for the possibility of the occurrence of the process of the realisation of law — lack of freedom would destroy the "how" of this process. Thus, the postulate to protect the freedom of personal acts has to be interpreted, in accordance with the analyzed theory, as a postulate, the fulfilment of which aims ultimately at the accomplishment of the very same process of realisation of law itself and not the realisation of a given man. Kaufmann considers a "person" to be an element which unites the system of law as a whole. Law is a structure of relations, which are interdependent and inter-contingent. Consequently, a "person" which is to form the ontological basis of law has to be entity consisting of all relations. Being also the "how" of the process of realisation of law, if a "person" is to warrant its unity, it has to be a common source for all procedures. Hence, a single "person" would constitute a subject of law. Man appears to be only a moment of a certain entirety, realisation of which should be an aim of his actions. Law, creating a "person" as an object and subject of law becomes a primary entity. In the analyzed theory, the basis for determination of aims which law sets to man is not the allocation of man-subject to something which improves him but rather, such relation is only just constituted by law. A question appears, why should aims set in law also be the aims of "empirical man"? Why is this "empirical man" to be punished in the name of a "person" understood in such a way? If, however, it is assumed that what is man is determined by a system which is superior to him, then man has to be understood only as a part of a whole and there are no grounds to prohibit istrumental treatment of man and so the road to all aspects of totalitarianism might be opened. A problem of the application of created theory to the reality arises, the reality which the theory pretends to explain. Ultimately in his theory Kaufmann does not give any systemic grounds for a radical questioning of the validity of any legal norms. Every new norm becomes an equal part of system of norms. It is only its interpretation and application to given conditions of life that may be disputable, however, this refers to all norms without exception. Cohesive inter-pretation of norms and applications is necessary and sufficient for the acquisition of just law. New norms have to be interpreted in the light of others, correspondingly, the other norms require reinterpretation in the light of the new ones. Contradiction in interpretation of a norm does not form a basis for questioning norms but may serve only to question the manner of their interpretation (understanding). Therefore, no grounds exist to assume any legal norm as criminal or unjust, and in consequence, to question any consistently realised system based on formally, properly established norms, as "legal lawlessness". As law and a "person" do not exist without the process of realisation of law, the role of legal safety becomes crucial as the condition for the possibility of the occurrence of the process of realisation of law. Denying legal safety would be tantamount to negation of law in general (also of moral law) as negation of safety takes away, at the same time, the basis for occurrence of the process of realisation of law. Moreover, any lack of legal safety would also mean lack of a basis for the existence of man as a "person". Kaufmann's thesis, that civil disobedience is legalized only when it has a chance to lead to success, consistent with his concept of the foundations of law, seems to point directly to conclusions which deny the facts taken under consideration and doubtlessly Kaufmann's own intentions, since it would have to be assumed that accordingly there are no grounds to question a legal system in force based on violence which secures its operation. Force finally seems to determine which one of the mutually irreconcilable normative systems constitute law and which does not. A legitimate position is one which leads to success, it is the weaker system which is negated. If so, then basically violent imposition of law is not an act directed against the law in force but, to the contrary, realisation of law. In the context of the new system the former system of law may be talked about as unjust solely in the sense of being incapable of being consistently united with the new. However, at the base, ultimately, lies force which reaffirms differences and excludes from the process of realisation of law certain norms and their interpretations. Kaufmann was aiming at grounding of that which is "non-dispositive" in a certain given framework of interpretation. Nevertheless, he does not provide foundations for the understanding of phenomena, which he undertakes to explain at a point of departure. Instead of explaining them the theory negates the possibility of their existence. The reality postulated in regard to "non-dispositive" moments of the reconstructed process of acquiring law consist of a specifically understood "person", which appears in Kaufmann's conceptions as a condition of the possibility of the realisation of law. According to this approach understanding of a "person" may be only a function of law. To understand "legal lawlessness" and foundations of justice it is necessary to look for such theory of law in which understanding of man as a "person" and being is not a function of understanding of law (in which a "person" is not only a condition for possibility of reconstructed process of realisation of law; for possibility of cognition processes). It seems necessary to start from theory of being and a "person" based on broader experience than the one assumed by Kaufmann and reconstruct the ontological foundations of the process of realisation of law only in such perspective. Kaufmann points out that that to which law refers is ipsa res iusta a concrete relation of man to other people and things. This relation, in his theory, appears to be basically only just constituted by law (normative senses "applied" to conditions of life). Therefore, understanding the relation between a given man and other people and things which constitute the aim of his actions, that is understanding of good, is enacted against the background of constitution of senses; constitution which is a result of a process aiming towards consistent understanding of particular contents (of nor¬mative and non-normative senses). "Being" is secondary towards constructed senses it is only their correlate. The primary relation consists of relation of a man to law (system of norms), while the secondary relation is one of man to something which is the aim of his action (relation between man and good). Considering such approach it is difficult to envision a satisfying answer to the fundamental question: why does law put concrete man under any obligation to obey it? The source of this problem can be seen in reduction of the base for understanding good to content of obligation formulated in auto-reflection. Such reduction seems to be a consequence of Kaufmann's adoption of "convergent concept of truth" and in con¬sequence his recognition of indirect, essentialistic grasp of reality formulated in concepts as the basic and only foundation of theory of being and of law. In view of such an approach, analogy of law, concepts and being is the condition for the possibility of the process of transformation of senses which aims at consistent interpretation of all law. Existence is postulated with respect to the possibility of unity of experience and cognition. However, also a different approach to understanding of the problem of being and good is possible. In spontaneous cognition being is affirmed, first of all, not as a certain, non-contradictory, determined content, but as something existing. Together with a cer¬tain content (passed indirectly through notions) existence of being is co-given. The basis for unity of being is not formed by the consistence of content, as it is in the case of the theories departing from the analysis of cognition processes, but by an act of existence realising content (essence). Such an approach makes it also possible to go beyond the convergent concept of truth. It is worth mentioning that allocation of an agent to good is realised not only by the content of duty. A statement that something is good is primary with respect to determination of this good in content. The recognised good always bears some content, however, there are no reasons to base the concept of good exclusively on indirect, formulated in concepts cognition. As primary, can be adopted the relation of man to good and not of man to law. Determination in content appears to be only an articulation of aspectual cognition of being, as an object of action. In such a case the basis for relative unity of norm and conditions of life is not the "nature of things" understood as correlate of sense but it is relation to good based on internal constitution of man as potential, not self-sufficient being. It does not mean, that the moments of the process of realisation of law singled out by Kaufmann are not important to determination of what is just. He, quite rightly, points to significant role played by norms in the evaluation of concrete situations, in man's search for closer specification in content of good innate to him. The structure of process of determining law for a concrete situation, to a great degree corresponds to the processes of determining law which take place not only in the legal sciences. Kaufmann's analyses of the process of realisation of law show the complexity of the structure of these processes and point towards important moments allowing a better understanding of law and man. Nevertheless, these analyses cannot be a basis for construction of philosophical theory of law, theory which hopes to point out the ultimate, ontological foundations for understanding law. Kaufmann's results may become fully valid only in a more general perspective including broader experience at the point of departure. (shrink)

Robert Batterman’s ontological insights (2002, 2004, 2005) are apt: Nature abhors singularities. “So should we,” responds the physicist. However, the epistemic assessments of Batterman concerning the matter prove to be less clear, for in the same vein he write that singularities play an essential role in certain classes of physical theories referring to certain types of critical phenomena. I devise a procedure (“methodological fundamentalism”) which exhibits how singularities, at least in principle, may be avoided within the same classes of formalisms (...) discussed by Batterman. I show that we need not accept some divergence between explanation and reduction (Batterman 2002), or between epistemological and ontological fundamentalism (Batterman 2004, 2005). Though I remain sympathetic to the ‘principle of charity’ (Frisch (2005)), which appears to favor a pluralist outlook, I nevertheless call into question some of the forms such pluralist implications take in Robert Batterman’s conclusions. It is difficult to reconcile some of the pluralist assessments that he and some of his contemporaries advocate with what appears to be a countervailing trend in a burgeoning research tradition known as Clifford (or geometric) algebra. In my critical chapters (2 and 3) I use some of the demonstrated formal unity of Clifford algebra to argue that Batterman (2002) equivocates a physical theory’s ontology with its purely mathematical content. Carefully distinguishing the two, and employing Clifford algebraic methods reveals a symmetry between reduction and explanation that Batterman overlooks. I refine this point by indicating that geometric algebraic methods are an active area of research in computational fluid dynamics, and applied in modeling the behavior of droplet-formation appear to instantiate a “methodologically fundamental” approach. I argue in my introductory and concluding chapters that the model of inter-theoretic reduction and explanation offered by Fritz Rohrlich (1988, 1994) provides the best framework for accommodating the burgeoning pluralism in philosophical studies of physics, with the presumed claims of formal unification demonstrated by physicists choices of mathematical formalisms such as Clifford algebra. I show how Batterman’s insights can be reconstructed in Rohrlich’s framework, preserving Batterman’s important philosophical work, minus what I consider are his incorrect conclusions. (shrink)

Nobody doubts that culture plays a decisive role in understanding human forms of life. But it is unclear how this decisive role should be integrated into a comprehensive explanatory model of human behaviour that brings together naturalistic and social-scientific perspectives. Cultural difference, cultural learning, cultural determination do not mix well with the factors that are normally given full explanatory value in the more naturalistic approaches to the study of human behaviour. My purpose in this paper is to alert to some (...) of the theoretical vulnerabilities or concerns that the cross-cultural study of mind and behaviour might entail. I classify these theoretical concerns into three, loosely defined, categories: epistemological, ontological and ethical. The first have to do with what in anthropology was once labelled as ‘butterfly collecting’. What kind of supplementary, or additional, general theoretical knowledge do we produce when we add to the research different, particularistic, culturally determined, ways of knowing? Ontological concerns refer to the underlying reality that those ways of knowing are meant to disclose. If there are so many ways of knowing the world, where is the reality to be known? Ethical concerns are those entailed in the forms of ‘othering’ that unqualified cross-cultural research is likely to produce in research participants. (shrink)

The debates on the scientificity of social sciences in general, and sociology in particular, are recurring. From the original methodenstreitat the end the 19th Century to the contemporary controversy on the legitimacy of “regional epistemologies”, a same set of interrogations reappears. Are social sciences really scientific? And if so, are they sciences like other sciences? How should we conceive “research programs” Lakatos (1978) or “research traditions” for Laudan (1977) able to produce advancement of knowledge in the field of social and (...) human phenomena? Is the progress of knowledge in social sciences similar to the one generally observed in natural sciences? Is it possible to evaluate the relative merits of each one of these research programs? -/- These debates are important vectors of social and intellectual polarization. The historical divide between the positivist and the hermeneutics poles precedes the structure of the contemporary debate around the epistemic space of social sciences, It is not only a question of renewing the opposition between a monist view of sciences (e.g. McIntyre, 1996) and a dualistic one (e.g. Geertz, 1973) or even a trialist view of sciences (e.g. Lepenies, 1985). It is also a question of asserting dichotomies transformed into framework (including when it is a question of exceeding them): nature-culture, nomothetic-idiographic, models-narrative, structure-history, cause-reason, explanation-comprehension. -/- In this short introduction, we provide, in section 2, a first overview of this epistemological debate in social science. Section 3 proposes a different standpoint on the same questions, by introducing both ontological and methodological aspects in this basic epistemological debate. Namely, following (Hollis, 1994) oppositions of the explanation - understanding, causes - meaning, etc., types discussed in the firsts ection are comparatively examined together with oppositions of the structure - action, holism - individualism types. This allows us to discus show multi-agent design, by integrating various dimensions and standpoints in the same framework (Phan, Amblard, 2007, Chapters 1, 5, 14) can help us to shift these boundaries, and to bypass these oppositions. As model building and ontology design are at the core of this process (Phan, Amblard, 2007, Chapter 12), Section4 discusses various issues of the art of modelling, starting both from economists’ and sociologists’ current standpoints. A fake news story can travel half way across the world as the truth puts on its socks. There are myriads of challenges facing journalists in spotting fake news hence its wide proliferation. Fake news has become a prominent subject of enquiry especially following its alleged influence of the 2016 general elections in US. Unfortunately, research on fake news has focused on social media, politics, elections, and economies. Few studies have focused on the challenges that TV journalists face in spotting (...) fake news prompting this study. The specific research question was; what are the challenges facing television journalists in spotting fake news in Kenya? The study adapted a relativist-constructivist/interpretivist ontology and epistemology, qualitative approach and multiple case study methodology. Data was generated through in-depth interviews, direct observation and documents review. The study used purposive sampling to generate data from 16 journalists. Data was then analysed in themes and presented in narrative form. Key findings were that in spotting fake news, journalists faced challenges like; loss of viewers, lack of authoritative contacts, sources who gave fake news for personal, business, political, and economic benefits, ability of fake news to camouflage real news, speed of fake news, typologies of fake news, live reporting, inexperienced correspondents and interns, and social media. The study concludes that the challenges facing journalists in spotting fake news were majorly based on sources, technology, education, skills and training, and its typology. The study therefore recommends that editorial boards invest in experts to train journalists on styles, architecture, propagation and use of fake news, inoculation of journalists and audiences, raising fake news literacy levels, and use of technology based approaches like reverse search and fact checking sites. The importance of corporate social responsibility is shaping investment decisions and entrepreneurial actions in diverse perspectives. The rapid growth of SMEs has tremendous impacts on the environment. Nonetheless, the economic emergence plan of Cameroon has prompted government support of SMEs through diverse projects. This saw economic growth increased to 3.8% and unemployment dropped to 4.3% caused by the expansion of private sector investments. The dilemma that necessitated this study is the response strategy of SMEs operators towards environmental sustainability. This study, (...) thus seeks to examine the effects of entrepreneurial intentions and actions on environmental sustainability. The research is a conclusive case study design supported by the philosophical underpins of objectivism ontology and positivism epistemology. Data was sourced from four hundred (400) SMEs operators purposively sampled from the Centre and Littoral regions of Cameroon using structured questionnaire. Data was analysed using the Structural Equation Modelling technique with the aid of statistical packages including: SPSS 24 and AMOS 23. The study revealed that entrepreneurial action has weak positive statistical significant impacts on environmental sustainability; whereas entrepreneurial intention has strong positive statistical significant effects on environmental sustainability. Entrepreneurial intention comprised of self-efficacy and perceived control whereas, entrepreneurial actions involved entrepreneurial alertness and uncertainty. This study concludes that entrepreneurs in Cameroon have sustainable intentions to protect the environment but; the current actions taken are inadequate. This research recommends that entrepreneurs should enhance efforts toward attaining the state of genuine sustainability. (shrink)

Medical terminology collects and organizes the many different kinds of terms employed in the biomedical domain both by practitioners and also in the course of biomedical research. In addition to serving as labels for biomedical classes, these names reflect the organizational principles of biomedical vocabularies and ontologies. Some names represent invariant features (classes, universals) of biomedical reality (i.e., they are a matter for ontology). Other names, however, convey also how this reality is perceived, measured, and understood by health professionals (i.e., (...) they belong to the domain of epistemology). We analyze terms from several biomedical vocabularies in order to throw light on the interactions between ontological and epistemological components of these terminologies. We identify four cases: 1) terms containing classification criteria, 2) terms reflecting detectability, modality, uncertainty, and vagueness, 3) terms created in order to obtain a complete partition of a given domain, and 4) terms reflecting mere fiat boundaries. We show that epistemology-loaded terms are pervasive in biomedical vocabularies, that the “classes” they name often do not comply with sound classification principles, and that they are therefore likely to cause problems in the evolution and alignment of terminologies and associated ontologies. People see five kinds of views in epistemology and ontology as hinging on there being words a person can learn only by private ostensive definitions, through direct acquaintance with his own sensations: skepticism about other minds, 2. skepticism about an external world, 3. foundationalism, 4. dualism, and 5. phenomenalism. People think Wittgenstein refuted these views by showing, they believe, no word is learnable only by private ostensive definition. I defend these five views from Wittgenstein’s attack.

The editor's introduction discusses Clarence I. Lewis's conceptual pragmatism when compared with post-empiricist epistemology and argues that several Cartesian assumptions play a major role in the work, not unlike those of Logical Positivism. The suggestion is made that the Cartesian legacy still hidden in Logical Positivism turns out to be a rather heavy ballast for Lewis’s project of restructuring epistemology in a pragmatist key. More in detail, the sore point is the nature of inter-subjectivity. For Lewis, no less than for (...) the Logical Positivists at the time of the Protocols Controversy and Husserl in the Cartesian Meditations, this is a problem without a solution. The reason is that all these philosophers are apparently unable to realize that the existence of a plurality of knowing subjects cannot be treated at once both as a speculative problem and a methodological one. Lewis, thanks to his pragmatist approach both comes closer to the right answer and offers an even more naïve unsatisfactory solution to the pseudo-problem under discussion. The fact that he has clear in mind that inter-subjectivity means not only a plurality of linguistic utterances but also a co-existence of different kinds of practical behaviour. Eventually, the very idea of mind, the key-idea in the book, suffers from the above mentioned tension. In fact, if inter-subjective communication and action is considered at a methodological level, the very idea of mind would not need an analysis, and no kind of ‘reflexive’ analysis. Methodology might be limited to a ‘naïve’ level where the existence of the world and a plurality of subjects be taken as a bedrock of uncritically accepted evidence. Philosophical reflection on ultimate evidence, instead, would take a different approach, maybe the one Wittgenstein was putting into practice in the same years when Mind and the world order was written, namely it would be bound to question the very meaning of the idea of ‘mind’ as an undue fiction – the same carried out by Descartes – when he assumed the Cogito to be at once a body of self-evident truths and a thing or substance, the familiar Platonic idea of psyche or soul. Ex Machina is a 2014 science-fiction film written and directed by Alex Garland, centered around the creation of a human-like artificial intelligence (AI) named Ava. The plot focuses on testing Ava for consciousness by offering a unique reinterpretation of the Turing Test. The film offers an excellent thought experiment demonstrating the consequences of various approaches to a potentially conscious AI. In this paper, I will argue that intelligence testing has significant epistemological shortcomings that necessitate an ethical approach not reliant on (...) ontological commitments. As such, we should be prepared to treat AI as though it is a living being that is deserving of corresponding moral obligations. For a sufficiently human-like AI, such as Ava, I will argue that socio-relational ethics is the best starting point in order to nurture the machine towards ethical proclivities, as evident by the consequences of the characters’ behavior throughout the film. I conclude that intelligence testing is an insufficient determinant of machine ethics, that the project of machine ethics should focus as much on how we treat AI as how AI treats us, and that from a consequentialist perspective it is better to treat machines ethically before they gain consciousness rather than after. As Bhaskar (1989:1) argues, we need to take philosophy seriously because it underwrites both what constitutes science and knowledge and which political practices are deemed legitimate. At present, the field of educational research internationally is witnessing a pragmatist trend, whereby practical education research is carried out without reference to ontological and epistemological concerns. For David Reynolds, a leading UK school effectiveness academic, '[p]recisely because we did not waste time on philosophical discussion or on values debates, we made rapid progress' (1998:20). (...) Equally, for Teddlie, '[t]he orientation of many in the US is to do rather than to reflect […] In reality many practitioners are currently interested in what could work at their school […rather…] than in ruminations about social inequalities associated with different socioeconomic classes' (Teddlie and Reynolds 2000:27). The purpose of this chapter is not only to reclaim critical realist social philosophy for educational research, but also to reclaim reality from the positivist and statistical methodology that underpins School Effectiveness Research (SER) and to make clear the difference that realism makes by virtue of its critical explanatory power in unmasking the ideological nature of SER and its adoption by New Labour. This essay introduces the philosophy of legal information (PLI), which is a response to the radical changes brought about in philosophy by the information revolution. It reviews in some detail the work of Luciano Floridi, who is an influential advocate for an information turn in philosophy that he calls the philosophy of information (PI). Floridi proposes that philosophers investigate the conceptual nature of information as it currently exists across multiple disciplines. He shows how a focus on the informational nature of (...) traditional philosophical questions can be transformative for philosophy and for human self-understanding. The philosophy of legal information (PLI) proposed here views laws as a body of information that is stored, manipulated, and analyzed through multiple methods, including the computational methodologies. PLI offers resources for evaluating the ethical and political implications of legal infomatics (also known as "legal information systems"). -/- This essay introduces PLI. Parts I and II describe Floridi's philosophy of information. First, Part I introduces the transformation in the concept of information that occurred in the twentieth century through the work of Alan Turning and Claude Shannon. Part II describes Floridi's approaches to traditional questions in epistemology, ontology, and ethics. Part III applies PI to the analysis of legal positivism. The identity "relation" is misconceived since the syntax of "=" is misconceived as a relative term. Actually, "=" is syncategorematic; it forms (true) sentences with a nonpredicative syntax from pairs of (coreferring) flanking names, much as "&" forms (true) conjunctive sentences from pairs of (true) flanking sentences. In the conaming structure, nothing is predicated of the subject, other than, implicitly, its being so conamed. An identity sentence has both an objectual reading as a necessity about what is named, and also (...) a metalinguistic reading as a contingency about the names. Either way the claim about the subject referent has no extralinguistic content. The necessity of alteridentity (non-self-identity) statements is "lexical", due to contingencies of the names' reference, much like the necessity of analytic statements, due to contingencies of the predicates' sense, and unlike the necessity of logical truths (e.g., self-identities) whose truth is secured by syntax alone. Both alter-identity and analytic sentences are readable as objectual necessities and metalinguistic contingencies. Epistemically, alter-identity statements are not essentially unlike analyticities. "Greece is Hellas"/"g=h" and "Greeks are Hellenes"/"(x)(Gx<=>Hx)" are equally (un)informative; so too for "Azure is cobalt"/"a=c" and "Everything azure is cobalt"/"(x)(Ax<=>Cx)". The real epistemic contrast is between proper names (terms without predicative sense) and terms with a predicative sense (names and predicates of properties). Proper names refer to concrete objects, property names refer to abstract objects. That contrast is metaphysical and thus epistemic. (shrink)

This work presents a post-positivist research framework to explain any surprising fact in the evolutionary path of a complex, dynamic and contingent social phenomenon. Primarily, it reconciles the ontological and epistemological assumptions of Critical Realism with the principles of American Pragmatism. Then, the research approach is presented: theoretical propositions about a social structure are translated into a set of grammar rules that acknowledges a pattern of sequences of events of either individual action or social interaction between actors within a real (...) social system. The result is a discrete mathematical model for a concrete category of social process based on these rules. Finally, data-grounded refinement of the theory is possible by the comparison between cases belonging to the same category, but differing about some contingent pattern of sequences of event outcomes. Consequently, their grammars differ in some pairs of context-sensitive rules that can explain this surprising fact, such that the derivation of this alternative historical trajectory of event outcomes becomes an extension to the early category of social process. In this sense, the proposed framework suggests there is a hierarchy of classes of grammars for middle-range explanations based upon the ontological assumption of the generative nature of social reality. In this paper, building on these previous works, we propose to go deeper into the understanding of crowd behavior by proposing an approach which integrates ontologi- cal models of crowd behavior and dedicated computer vision algorithms, with the aim of recognizing some targeted complex events happening in the playground from the observation of the spectator crowd behavior. In order to do that, we first propose an ontology encoding available knowledge on spectator crowd behavior, built as a (...) spe- cialization of the DOLCE foundational ontology, which allows the representation of categories belonging both to the physical and to the social realms. We then propose a simplified and tractable version of such ontology in a new temporal extension of a description logic, which is used for temporally coupling events happening on the play- ground and spectator crowd behavior. At last, computer vision algorithms provide the input information concerning what is observed on the stands and ontological reasoning delivers the output necessary to perform complex event recognition. Notwithstanding diverse opinions and debates about mixing methods, mixed methods research (MMR) is increasingly being used in sport and exercise psychology. In this paper, we describe MMR trends within leading sport and exercise psychology journals and explore critical realism as a possible underpinning framework for conducting MMR. Our meta-study of recent empirical mixed methods studies published in 2017–2019 indicates that eight (36%) of the 22 MMR studies explicitly stated a paradigmatic position (five drew on pragmatism, two switched paradigms between qualitative (...) and quantitative elements of the study, and one was situated in relativist-interpretivism). The remaining 14 (64%) studies did not report their underpinning research philosophical assumptions. Evaluating the merits and limitations of these positions against critical realist assumptions suggests that several paradigmatic disagreements are potentially reconcilable. These include (a) maintaining that ontological and epistemological concerns are important for methodological integrity of a mixed methods study; (b) switching between paradigms in the same study is problematic; and (c) refuting the qualitative-quantitative incommensurability thesis, therefore allowing mixed methods research without compromising philosophical coherence. From a critical realist position, we suggest that both quantitative and qualitative designs are justifiable in a mixed methods study because (1) they help corroborate, refine, or refute plausible explanations of phenomena (epistemological), but (2) with different methodologies utilised to perform different tasks in the same research design related to different psycho-social system features (ontological). We call for a collaborative engagement by researchers across paradigmatic positions to work towards the advancement of methodological pluralism in our research community. (shrink)

An aesthetic and epistemological departure from ocular centrism has occurred in the wake of current technological evolutions and the posthuman turn. The sonic exploration of the more-than-human takes artists and philosophers beyond anthropomorphism to reveal the hidden patterning of life forms and yet-unfathomed universes. The conflation of nature with culture is one shift that takes place when thinking with sounds and rhythm and studying our environments. On an ontological level, a reordering of subject and object occurs when encountering the reciprocal (...) relationship of sounding. What if culture is actually nature? How does technology connect with botany, and what does it mean to engage the environment with the expanded tactility of the ear? This essay observes current inter-species practices in sound art by revisiting philosopher Susanne Langer’s theory of an embodied and embedded mind. Her “new key” in philosophy emphasizes music as a dynamic sound-pattern to conceptualize a semiology of artistic forms that renders human feeling in regard to non-human antecedents. This serves as a tool to trace the preconceptual substrata of mind, leading us through process-oriented studies of nature and psychophysical affect. Thinking with Langer involves the interconnection of natural systems, behavioural patterns, and human expression, which emerges in art. (shrink)

This paper introduces the philosophy of Grace Andrus de Laguna in order to renew interest in it. I show that, in the 1910s and 1920s, she develops ideas and arguments that are also found playing key roles in the development of analytic philosophy decades later. Further, I describe her sympathetic, but acute, criticism of pragmatism and Heideggerian ontology, and situate her work in the tradition of American, speculative philosophy. Before 1920, we will see, de Laguna appeals to multiple realizability to (...) undermine reductionism in science, to support perspectival, scientific realism and, with help from a private language argument, to favour the view that mental states are classified by behavioural, teleological roles over what came to be called ‘type physicalism’. Her view of speech, mostly developed in the 1920s, tells us that its primary role is coordinating group behaviour rather than expressing thoughts. Belief is understood in terms of its causal role, including its causal relations to other kinds of mental states, when coordinating group behaviour. Thought is similarly understood. In developing her theory of mind, de Laguna rejects the pragmatist claims that belief can be reduced to dispositions to behaviour and that thought’s function is to address specific, rather than general, problems. She also favours meaning holism and rejects the analytic–synthetic distinction. In later work, de Laguna argues that individuals’ activity of self-maintenance brings universals, conceived of as irreducible potentialities, into being and makes them increasingly determinate. Further, she identifies the existence of all individuals with forms of self-maintenance and takes the existence of people to include maintenance of the cultural world. Such a unified treatment of existence, she holds, permits making its evolution intelligible. Heidegger’s view of being is rejected for not permitting this. All de Laguna’s work, we will see, fits a vision of philosophy as the systematic, imaginative and naturalistic examination of being as well as a source of criticism of science. (shrink)

Purpose: A retraction is the removal of a published article from the scientific record. It is an admission of failure. Yet, every retraction, regardless of its cause(s), is instructive. Using the oxymoron/concept of celebrating failure, this study investigates retractions in the Journal of Consumer Research (JCR). -/- Method: The content of each JCR retraction notice was examined to determine the initiator(s) of the retraction, retractors, reason(s) for retraction, and time-to-retraction. -/- Findings: According to the findings, JCR issued ten retraction (...) notices between June 2012 and October 2020. During the Transfiguration, the apostles on Tabor, “indeed saw the same grace of the Spirit which would later dwell in them”. The light of grace “illuminates from outside on those who worthily approached it and sent the illumination to the soul through the sensitive eyes; but today, because it is confounded with us and exists in us, it illuminates the soul from inward ”. The opposition between knowledge, which comes from outside - a human and purely symbolic knowledge - and (...) “intellectual” knowledge, which comes from within, Meyendorff says what it already exists at Pseudo-Dionysius: “For it is not from without that God stirs them toward the divine. Rather he does so via the intellect and from within and he willingly enlightens them with a ray that is pure and immaterial”. The assertions of the Calabrian philosopher about an “unique knowledge”, common both to the Christians and the Hellenes and pursuing the same goal, the hesychast theologian opposes the reality of the two knowledge, having two distinct purposes and based on two different instruments of perception: “Palamas admitted the authenticity of natural knowledge, however the latter is opposed to the revealed wisdom, that is why it does not provide, by itself, salvation”. Therefore, in the purified human intellect begins to shine of the Trinity light. Purity also depends on the return of the intellect to itself. In this way, we see how the true knowledge of God is an internal meeting or “inner retrieval” of the whole being of man. As well as in the Syrian mystic, on several occasions we have to make the distinction between the contemplative ways of knowledge: intellection illuminated by grace and spiritual vision without any conceptual or symbolic meaning. The central aim of this thesis is to confront the world-view of positivistic materialism with its nihilistic implications and to develop an alternative world-view based on process philosophy, showing how in terms of this, science and ethics can be reconciled. The thesis begins with an account of the rise of positivism and materialism, or ‘scientism’, to its dominant position in the culture of Western civilization and shows what effect this has had on the image of man and consequently on ethical (...) views. After having shown the basic weaknesses of this world-view, the positivist account of science is criticised and an alternative epistemology is developed in which the aim of disciplined inquiry is seen to be understanding. It is argued on the basis of this epistemology that science and metaphysics are indissociable, and that the materialist conception of being is open to challenge from a different ontology. Having reviewed the various conceptions of being which have been developed in the past, a version of process philosophy is outlined and it is argued that this promises to be far more effective than materialism as a foundation for the natural sciences. In particular it is shown how in terms of process philosophy it is possible to conceive of living, sentient organisms as having emerged from inanimate being. This provides the basis for the development of a conception of humanity as an emergent form of life. The human order is then seen as a process of becoming within nature with its own unique dynamics, irreducible to any other processes, involving both intentional and unintentional processes. It is shown how on the basis of this conception of humanity it is possible to develop an ethical theory and a critical social science, and in this way, to transcend the disjunction between science and ethics. -/- . In recent decades, theories of representation have undergone a constructivist turn, as many theorists no longer view the represented subject as prior to but rather as an effect of representation. Whereas some critics have claimed that lacking an ontologically pre-given subject undermines the theory of representation, many democratic theorists have sought to reconceptualize representation and its democratic possibilities by turning away from ontological questions altogether. By focusing instead on how representatives come to know the public interest, many scholars now contend (...) that an epistemological account best explains how political representation can foster democratic participation. Yet, theorists of representation have not assessed whether this turn to epistemology has overcome the ontological problems that initially motivated it. This article tracks epistemological defenses of representation to outline two models of political representation that attempt to tackle the epistemological problem of constituent interest without positing a foundational ontology of the subject. I argue that both theoretical tendencies ultimately remain caught in the problems of ontology, thereby undercutting their normative aspirations to foster political participation. Turning to Hannah Arendt’s comments on public interest and her writings on council democracy, the article retheorizes the concept of political representation to avoid the ontological problems that beset current accounts. This book tells the story of modern ethics, namely the story of a discourse that, after the Renaissance, went through a methodological revolution giving birth to Grotius’s and Pufendorf’s new science of natural law, leaving room for two centuries of explorations of the possible developments and implications of this new paradigm, up to the crisis of the Eighties of the eighteenth century, a crisis that carried a kind of mitosis, the act of birth of both basic paradigms of the two (...) following centuries: Kantian ethics and utilitarianism. The new science of natural law carried a fresh start for ethics, resulting from a mixture of the Old and the New. It was, as suggested by Schneewind, an attempt at rescuing the content of Scholastic and Stoic doctrines on a new methodological basis. The former was the claim of existence of objective and universal moral laws; the latter was the self-aware attempt at justifying a minimal kernel of such laws facing skeptical doubt. What Bentham and Kant did was precisely carrying this strategy further on, even if restructuring it each of them around one out of two alternative basic claims. The nineteenth- and twentieth-century critics of the Enlightenment attacked both not on their alleged failure in carrying out their own projects, but precisely on having adopted Grotius’s and Pufendorf’s project. Decision-making regarding healthcare expenditure hinges heavily on an individual's health status and the certainty about the future. This study uses data on propensity of general health exam (GHE) spending to show that despite the debate on the necessity of GHE, its objective is clear—to obtain more information and certainty about one’s health so as to minimise future risks. Most studies on this topic, however, focus only on factors associated with GHE uptake and overlook the shifts in behaviours and attitudes regarding (...) different levels of cost. To fill the gap, this study analyses a dataset of 2068 subjects collected from Hanoi (Vietnam) and its vicinities using the baseline-category logit method. We evaluate the sensitivity of Vietnamese healthcare consumers against two groups of factors (demographic and socioeconomic-cognitive) regarding payment for periodic GHE, which is not covered by insurance. Our study shows that uninsured, married and employed individuals are less sensitive to cost than their counterparts because they value the information in reducing future health uncertainty. The empirical results challenge the objections to periodic health screening by highlighting its utility. The relevance of behavioural economics is further highlighted through a look at the bounded rationality of healthcare consumers and private insurance companies in using and providing the service, respectively. Arnošt Kolman (1892–1979) was a Czech mathematician, philosopher and Communist official. In this paper, we would like to look at Kolman’s arguments against logical positivism which revolve around the notion of the fetishization of mathematics. Kolman derives his notion of fetishism from Marx’s conception of commodity fetishism. Kolman is aiming to show the fact that an entity (system, structure, logical construction) acquires besides its real existence another formal existence. Fetishism means the fantastic detachment of the physical characteristics of real things (...) or phenomena from these things. We identify Kolman’s two main arguments against logical positivism. In the first argument, Kolman applied Lenin’s arguments against Mach’s empiricism-criticism onto Russell’s neutral monism, i.e. mathematical fetishism is internally related to political conservativism. Kolman’s second main argument is that logical and mathematical fetishes are epistemologically deprived of any historical and dynamic dimension. In the final parts of our paper we place Kolman’s thinking into the context of his time, and furthermore we identify some tenets of mathematical fetishism appearing in Alain Badiou’s mathematical ontology today. The core of Zimmerman’s picture posits an inverse correlation between an action’s automaticity and belief’s role in the action’s execution. This proposal faces serious problems. First, high-attention, high-control actions don’t seem to heighten awareness of one’s beliefs. Second, low-attention, low-control actions are caused by the same states at play when executing high-attention, high-control actions, in which case there is no ontological difference in the states involved in these behaviors. Third, on Zimmerman’s view it is unclear what it is for a (...) state to be involved in behaviors at all, as the basic realist response—that beliefs cause behavior—is unavailable to a Zimmerman-style pragmatist. Lastly, if Zimmerman's view were right and low-level behaviors weren't caused by beliefs, then we should turn our attention to those states instead, as most of our behavior isn’t executed under conditions of high control and attention. The hermeneutical tradition represented by Yorck, Heidegger, and Gadamer has distrusted Dilthey as suffering from the two sins of modernism: scientific “positivism” and individualistic and aesthetic “romanticism.” On the one hand, Dilthey’s epistemology is deemed scientistic in accepting the priority of the empirical, the ontic, and consequently scientific inquiry into the physical, biological, and human worlds; on the other hand, his personalist ethos and Goethean humanism, and his pluralistic life- and worldview philosophy are considered excessively aesthetic, culturally liberal, relativistic, and (...) subjective. This essay involves two tasks in response to this negative evaluation of Dilthey that has shaped our current understanding of his philosophical project; first, an interpretation of the issues at stake in Heidegger’s reception of and struggles with Dilthey. These issues touch upon language, historicity, and the nature of hermeneutics. Second, by pursuing this task in light of Guignon’s interpretation of Dilthey and Heidegger, I hope to question and challenge the “overcoming” of Dilthey’s epistemic and life-philosophical hermeneutics in the “ontological” or “philosophical” hermeneutics of Heidegger. An academic division of labor resulted from the distinction between sex and gender. Sex remained a productive topic (excuse the pun) for biologists, who are interested in the genetic, developmental, and chemical pathways of male/female dimorphism. People in the social sciences and humanities, by contrast, made gender, not sex, the subject of their work. In gender studies, we learn about the ways that men and women “perform” their respective roles—people of male sex can perform as female gender, and vice versa, (...) by adopting modes of speech, dress, behavior, and even values. There is no talk of innate instincts or brain differences in gender studies. The French philosopher Michel Foucault set the agenda when he lamented, as early as 1976, that “the notion of sex made it possible to group together, in an artificial unity, anatomical elements, biological functions, conducts, sensations, and pleasures, and it enabled one to make use of this fictitious unity as a causal principle.” Following this approach, more-recent theorists like Anne Fausto-Sterling and Judith Butler have argued that even the biological categories of sex are just artificial inventions, designed to keep women and intersexed peoples down. Society, they suggest, decides which of us are males and which are females—pushing everyone into rigid binary categories. -/- There are two main arguments that are usually offered in defense of this controversial thesis that sexual dimorphism is political rather than ontological. One is based on a general critique of knowledge (an epistemological argument), and the other on a specific picture of reality (a metaphysical argument). I will offer counterarguments to both. Universal Darwinism provides a methodology to study the evolution of anatomical form and sociocultural behavior that centers on defining the units and levels of selection, and it identifies the conditions whereby natural selection operates. In previous work, I have examined how this selection-focused evolutionary epistemology may be universalized to include theories that associate with an extended synthesis. Applied evolutionary epistemology is a metatheoretical framework that understands any and all kinds of evolution as phenomena where units evolve by mechanisms at (...) levels of an ontological hierarchy; and it provides three heuristics to search for these units, levels and mechanisms. The heuristics are applicable to language and sociocultural evolution, and here, we give an in-depth analysis of how the unit-heuristic can be implemented into language origin and evolution studies. According to a widespread view, Einstein’s definition of time in his special relativity is founded on the positivist verification principle. The present paper challenges this received outlook. It shall be argued that Einstein’s position on the concept of time, to wit, simultaneity, is best understood as a mitigated version of concept empiricism. He contrasts his position to Newton’s absolutist and Kant’s transcendental arguments, and in part sides with Hume’s and Mach’s empiricist arguments. Nevertheless, Einstein worked out a concept empiricism that (...) is considerably more moderate than what we find in the preceding empiricist tradition and early logical positivism. He did not think that the origin of concepts is in observations, but in conventions, and he also maintained a realist ontology of physical events, which he thought is necessary for his theory. Consequently, his philosophy of time in special relativity is not couched in terms of an anti-metaphysical verificationism. (shrink)

As the international momentum of the school effectiveness movement continues, its exponents remain largely impervious to criticism. This paper argues that while they may not readily align themselves with the individualistic aspects of Conservative social philosophy, their methodology necessarily secretes an atomised social ontology. The charge of ideological commitment rests on the fact that the essentially positivist epistemology employed by school effectiveness researchers presupposes an ontology of closed systems and atomistic events. Thus any notion of the structuring of life-chances is (...) automatically ruled out of court. The reciprocity of social ontology and methodology is explored in order to account for the myopia of the school effectiveness movement. (shrink)

The Logic of Causation: Definition, Induction and Deduction of Deterministic Causality is a treatise of formal logic and of aetiology. It is an original and wide-ranging investigation of the definition of causation (deterministic causality) in all its forms, and of the deduction and induction of such forms. The work was carried out in three phases over a dozen years (1998-2010), each phase introducing more sophisticated methods than the previous to solve outstanding problems. This study was intended as part of a (...) larger work on causal logic, which additionally treats volition and allied cause-effect relations (2004). The Logic of Causation deals with the main technicalities relating to reasoning about causation. Once all the deductive characteristics of causation in all its forms have been treated, and we have gained an understanding as to how it is induced, we are able to discuss more intelligently its epistemological and ontological status. In this context, past theories of causation are reviewed and evaluated (although some of the issues involved here can only be fully dealt with in a larger perspective, taking volition and other aspects of causality into consideration, as done in Volition and Allied Causal Concepts). Phase I: Macroanalysis. Starting with the paradigm of causation, its most obvious and strongest form, we can by abstraction of its defining components distinguish four genera of causation, or generic determinations, namely: complete, partial, necessary and contingent causation. When these genera and their negations are combined together in every which way, and tested for consistency, it is found that only four species of causation, or specific determinations, remain conceivable. The concept of causation thus gives rise to a number of positive and negative propositional forms, which can be studied in detail with relative ease because they are compounds of conjunctive and conditional propositions whose properties are already well known to logicians. The logical relations (oppositions) between the various determinations (and their negations) are investigated, as well as their respective implications (eductions). Thereafter, their interactions (in syllogistic reasoning) are treated in the most rigorous manner. The main question we try to answer here is: is (or when is) the cause of a cause of something itself a cause of that thing, and if so to what degree? The figures and moods of positive causative syllogism are listed exhaustively; and the resulting arguments validated or invalidated, as the case may be. In this context, a general and sure method of evaluation called ‘matricial analysis’ (macroanalysis) is introduced. Because this (initial) method is cumbersome, it is used as little as possible – the remaining cases being evaluated by means of reduction. Phase II: Microanalysis. Seeing various difficulties encountered in the first phase, and the fact that some issues were left unresolved in it, a more precise method is developed in the second phase, capable of systematically answering most outstanding questions. This improved matricial analysis (microanalysis) is based on tabular prediction of all logically conceivable combinations and permutations of conjunctions between two or more items and their negations (grand matrices). Each such possible combination is called a ‘modus’ and is assigned a permanent number within the framework concerned (for 2, 3, or more items). This allows us to identify each distinct (causative or other, positive or negative) propositional form with a number of alternative moduses. This technique greatly facilitates all work with causative and related forms, allowing us to systematically consider their eductions, oppositions, and syllogistic combinations. In fact, it constitutes a most radical approach not only to causative propositions and their derivatives, but perhaps more importantly to their constituent conditional propositions. Moreover, it is not limited to logical conditioning and causation, but is equally applicable to other modes of modality, including extensional, natural, temporal and spatial conditioning and causation. From the results obtained, we are able to settle with formal certainty most of the historically controversial issues relating to causation. Phase III: Software Assisted Analysis. The approach in the second phase was very ‘manual’ and time consuming; the third phase is intended to ‘mechanize’ much of the work involved by means of spreadsheets (to begin with). This increases reliability of calculations (though no errors were found, in fact) – but also allows for a wider scope. Indeed, we are now able to produce a larger, 4-item grand matrix, and on its basis find the moduses of causative and other forms needed to investigate 4-item syllogism. As well, now each modus can be interpreted with greater precision and causation can be more precisely defined and treated. In this latest phase, the research is brought to a successful finish! Its main ambition, to obtain a complete and reliable listing of all 3-item and 4-item causative syllogisms, being truly fulfilled. This was made technically feasible, in spite of limitations in computer software and hardware, by cutting up problems into smaller pieces. For every mood of the syllogism, it was thus possible to scan for conclusions ‘mechanically’ (using spreadsheets), testing all forms of causative and preventive conclusions. Until now, this job could only be done ‘manually’, and therefore not exhaustively and with certainty. It took over 72’000 pages of spreadsheets to generate the sought for conclusions. This is a historic breakthrough for causal logic and logic in general. Of course, not all conceivable issues are resolved. There is still some work that needs doing, notably with regard to 5-item causative syllogism. But what has been achieved solves the core problem. The method for the resolution of all outstanding issues has definitely now been found and proven. The only obstacle to solving most of them is the amount of labor needed to produce the remaining (less important) tables. As for 5-item syllogism, bigger computer resources are also needed. (shrink)

Sigmund Freud (1856–1939), one of the most influential figures of the 20th century, is also one of its most controversial. Far from being an outmoded icon of the early formation of modern psychology's historical development, the Freudian doctrine of the "talking cure" has irrevocably shaped the ways in which human beings and human behavior are understood today. Freudian thought has infiltrated the inner recesses of the collective consciousness and the lexicon of psychology. Psychoanalysis has waged an assault on traditional (...) conceptions of the human experience by eclipsing everything of a transcendent order and branding religion itself as a kind of psychopathology. The corrosion of religion and spirituality in the lives of the human collectivity has left an epistemological and ontological vacuum which has been largely filled by psychoanalysis and its off-shoots. Psychoanalysis, like behavioristic psychology, has not died or disappeared, as is often assumed, for the shibboleths of psychoanalysis and behaviorism form the very substratum upon which all contemporary therapies are formulated. The consequences for Western civilization have been destructive and far-reaching. (shrink)

In “Ontologies Relevant to behaviour change interventions: A Method for their Development” Wright, et al. outline a step by step process for building ontologies of behaviour modification – what the authors call the Refined Ontology Developmental Method (RODM) – and demonstrate its use in the development of the Behaviour Change Intervention Ontology (BCIO). RODM is based on the principles of good ontology building used by the Open Biomedical Ontology (OBO) Foundry in addition to those outlined in (Arp, Smith, and Spear (...) 2015). BCIO uses as its top-level ontology Basic Formal Ontology (BFO). The methods outlined in Wright, et al. are a valuable contribution to the field, especially the use of formal mechanisms for literature annotation and expert stakeholder review, and the BCIO will certainly play an important role in the extension of OBO Foundry ontologies into the behavioural domain. Clearly neither I nor anyone will ever read any substantial part of this massive tome so I will discuss the one article that interests me most and which I think provides the framework necessary for the understanding of all the rest. I refer to the one on Ludwig Wittgenstein (W). Even were I to try to discuss others, we would not get past the first page as all the issues here arise immediately in any discussion of behavior. The differentiation (...) of pragmatics and semantics is largely meaningless. It is defensible that one might subtitle this work ‘Developments of Wittgenstein’s Contextualism’, but of course this term has inevitably been corrupted by philosophers. One might then say that pragmatics and semantics are parts of or coextensive with epistemology and ontology and the descriptive psychology of higher order thought (Searle’s Logical Structure of Rationality) or that they describe how we use noises in specific contexts to give them meaning --i.e., a true or false (propositional) use which Searle calls their Conditions of Satisfaction. In a recent article in this journal, Krzysztof Poslajko reconstructs—and endorses as probative—a dilemma for interpretivism first posed by Alex Byrne. On the first horn of the dilemma, the interpretivist takes attitudes to emerge in relation to an ideal interpreter (and thus loses any connection with actual folk psychological practices). On the second horn, the interpretivist takes attitudes to emerge in relation to individuals’ judgements (and thus denies the possibility of error). I show that this is a false dilemma. By (...) taking a model-theoretic approach to folk psychology, and marrying interpretivism with dispositionalism, interpretivists can viably reject the notion of an ideal (or canonical) interpreter—and relativize attitudes to actual lay interpreters—without taking on board the unacceptable epistemological consequences of allowing that attitudes are judgement-dependent. The question, “What is intelligence?” is deceptively simple. However, scholars have engaged in series of research in order to answer it. Till date there is no simple answer accepted by experts in the relevant disciplines. Attempt to identify a standard definition has been very challenging. This failure is connected with the fact that defining intelligence requires the application of problematic and abstract concepts. Consequently, some researchers decided to put forward theories as an attempt to capture the nature of intelligence. However, (...) this option, as reflected in this paper, further deepens the problem it purports to resolve. The paper is an inquest into the intellectual travails of scholars who fruitlessly attempted to grasp the nature of intelligence. The paper avers that these travails are caused by scholar’s reliance on ontological proof of intelligence which stipulates the possession of brain and mind as evidence of intelligence. The epistemological proof which relies on overt behaviour as index of interpreting intelligence is projected by the paper as a plausible means of overcoming the nebulous nature of the concept. -/- . Recent trends in psychiatry involve a transition from categorical to dimensional frameworks, in which the boundary between health and pathology is understood as a difference in degree rather than as a difference in kind. A major tenet of dimensional approaches is that no qualitative distinction can be made between health and pathology. As a consequence, these approaches tend to characterize such a threshold as pragmatic or conventional in nature. However, dimensional approaches to psychopathology raise several epistemological and ontological issues. First, (...) we review major sources of evidence usually recruited in support of the dimensional trend (focusing on clinical observation and biological data), and we show that these are connected to different conceptualizations of how dimensional traits extend across health and pathology. Second, we criticize two unquestioned assumptions that stand at the core of the dimensional trend: a) that there is continuity from health to pathology at the symptomatic level; b) that such continuity reflects an underlying continuity in the genetic liability for pathological conditions. Third, we argue against the idea of a conventional threshold by showing that such a view implies a linear relationship between the genotype and the phenotype. Fourth, drawing on epigenetics and developmental biology, we offer a characterization of mental disorders as stable and dynamic constellations of multi-level variables that differ qualitatively from ‘healthy states’. We conclude by showing that our account has several theoretical advantages over both categorical and dimensional approaches. Notably, it provides crucial insights into psychological development over time and individual differences, with major implications in terms of intervention and clinical decision-making. (shrink)
