Desde la certidumbre del sentido necesariamente inacabado, nómada y abierto de sus propuestas, el presente volumen de la Colección La Fuente da cuentas del esfuerzo de un grupo de investigadores del Instituto de Filosofía de La Habana (IF) y de la Universidad Autónoma de Puebla (BUAP) por esbozar, más que respuestas, aquellas interrogantes sociales, culturales y artísticas que, desde constelaciones cambiantes de conceptos y reflexiones estéticas, puedan ser emplazadas en sus respectivas realidades. El presente libro es el tercero de la (...) serie Redes, dedicada a plasmar los principales resultados del trabajo de colaboración del Cuerpo Académico de Estética y Arte de la BUAP con otros grupos de investigación. La coordinación de esta entrega contó con la sapiencia y laboriosidad académica de la doctora Alicia Pino Rodríguez (1954-2017), investigadora del IF, integrante del Consejo de la Colección, coordinadora de su segundo volumen y parte esencial de este, dedicado a su memoria. En los últimos tiempos el derecho ambiental ha ganado un puesto importante en el ámbito jurídico, hecho que refleja la preocupación que hoy se tiene por la relación del hombre con su entorno. Desde hace quince años, la Universidad Colegio Mayor de Nuestra señora del Rosario, por intermedio de su Facultad de Jurisprudencia y concretamente de la Especialización y la línea de investigación en Derecho Ambiental, ha propuesto a través de diversos proyectos avanzar en el conocimiento y análisis del ordenamiento (...) jurídico ambiental, aportando así al desarrollo, estructura y consolidación de esta rama jurídica. Bajo estos parámetros, el objetivo de esta publicación es hacer algunas reflexiones en torno a distintos temas que dentro del derecho público impactan o influyen al derecho ambiental y responder a los enormes desafíos que se presentan en la materia. Por tanto, el programa quiere contribuir desde la academia al diálogo crítico y propositivo que permita dar solución a los problemas encontrados en la aplicación del derecho ambiental. En el primer capítulo, Gloria Amparo Rodriguez describe los ordenamientos jurídicos constitucionales de Colombia, Ecuador y Bolivia a fin de analizar la forma en que cada uno de ellos consagra el derecho a un ambiente sano. A continuación, Martha Ovalle y Zelba Nidia Castro de Perez realizan un estudio de los principios de precaución y prevención, exponiendo su alcance, su fundamento desde el derecho internacional y cómo vienen siendo entendidos por nuestro ordenamiento jurídico, tanto jurisprudencial como legal. Luis Adolfo Diazgranados se ocupa de la responsabilidad de los funcionarios públicos en materia ambiental, para lo cual realiza un análisis de los deberes consagrados en la normatividad vigente. Continuando con esta temática, el profesor Jorge Agudo Gonzalez, de la Universidad Autónoma de Madrid, explora la incidencia del ambiente y los recursos naturales en los procesos contractuales, a fin de mostrar cómo estas materias se han constituido en variable fundamental en el devenir de la formación, celebración y ejecución de los contratos, desde un punto de vista crítico, los aspectos importantes del proceso sancionatorio ambiental, evidenciando las falencias y vacios del a Ley 1333 de 2009. Jairo Cabrera plantea algunas reflexiones sobre la responsabilidad, valiéndose de la doctrina internacional, sobre la problemática de la reparación por daño ambiental. Por su parte, Leonardo Güiza Suárez explica el régimen general de la responsabilidad ambiental en el ordenamiento jurídico a partir del daño de los bosques naturales y su incidencia sobre los derechos humanos. Andres Gomez Rey, desde la teoría del acto administrativo, desarrolla el análisis crítico del régimen jurídico de las aguas superficiales en el derecho ambiental. Giovani J. Herrera Carrascal realiza una disertación sobre los recursos naturales y el ambiente como elementos del espacio público que a su vez constituye en un componente del medio ambiente urbano a partir de la jurisprudencia y de las competencias respectivas. Por último, Marybell Ochoa Miranda trate el tema de los residuos hospitalarios en Colombia, exponiendo su régimen jurídico, las competencias de las autoridades ambientales, los deberes que en estos asuntos tienen los ciudadanos, proponiendo lineamientos para avanzar en la consolidación de la gestión integral de residuos hospitalarios y similares. This case study describes the coexistence of Capgras and Fregoli-type delusions in a 51-year-old woman. The patient reported that her children were kidnapped and replaced with doubles. She claims that several customers at her shop are her real children. Neuropsychological assessment revealed severe defects in social cognition and an increased number of perseveration responses in the self-directed signaling task. We propose that the latter finding is a measure of the familiarity phenomenon and may be associated with hypofunction in the left (...) retrosplenial region. SPECT-CT confirmed a pattern of hypoperfusion in the retrosplenial, posterior cingulate, and prefrontal cortex. (shrink)

1. The Bundle Theory I shall discuss is a theory about the nature of substances or concrete particulars, like apples, chairs, atoms, stars and people. The point of the Bundle Theory is to avoid undesirable entities like substrata that allegedly constitute particulars. The version of the Bundle Theory I shall discuss takes particulars to be entirely constituted by the universals they instantiate.' Thus particulars are said to be just bundles of universals. Together with the claim that it is necessary that (...) particulars have constituents, the fundamental claim of the Bundle Theory is: (BT) Necessarily, for every particular x and every entity y, y constitutes x if and only ify is a universal and x instantiates y. 2 The standard and supposedly devastating objection to the Bundle Theory is that it entails or is committed to a false version of the Principle of Identity of Indiscernibles (Armstrong 1978: 91, Loux 1998: 107), namely: (Pll) Necessarily, for all particulars x and y and every universal z, if z is instantiated by x if and only if z is instantiated byy, then x is numerically identical with y. The most famous counterexample to the Identity of Indiscernibles is that put forward by Max Black, consisting of a world where there are only two iron spheres two miles apart from each other, having the same diameter, temperature, colour, shape, size, etc (Black 1952: 156). Let us from now on think of the properties of the spheres in this world as universals. The possibility of this world, which I shall hereafter refer to as 'Black's world', makes (Pll) false.' The concept of modes of existence of semiotic entities underlies (post)Greimasian semiotics, yet it seems to have received little attention. Modes of existence can be used in different senses. For Greimas, from the perspective of narrative semiotics, when Michelangelo first receives a block of marble and decides to sculpt the David, his intention is in a virtual mode; as Michelangelo progresses he ends up bringing the David into existence, and his intention comes to the realized mode. In Fontanille’s tensive semiotics, (...) however, modes of existence can have to do with how one can narrow or broaden the scope of our apprehension of the David as our eyes look at it in order to produce a meaningful experience. In this work, the perspectives of narrative and tensive semiotics are contrasted both theoretically and practically applying both to a number of examples. In order to identify all possible modes of existence and all the possibilities of transitioning from one to the other in the examples presented, we resort to the method of finite-state automata from computer science. In the end, we propose a robust narrative account of modes of existence that relies on narrative semiotics for its definition, but into which intent and apprehension from tensive semiotics can be integrated. This work calls for the need of establishing a syntax of modes of existence, since both Greimas and Fontanille construe them as being necessary to account for the production of signification. The Dark Side of Colors is a Pereirano short film made by director Mónica Moreno, in the framework of the investigation "The Color as a character within the audiovisual production: The Dark Side of Colors", whose end is to see the color as a leading element in the story and how it affects the psyche of the main character, called Franz, around the creation of an Altrego named Christopher, who see in the color, personalities and behaviors of people from The (...) negative point of view is like this, as the art director from a particular aesthetic proposes a color palette focused on the triggers, atmospheres, objects and characters, but related to color as a character. I offer a close reading of the first part of Sartre's The Transcendence of the Ego, arguing that contrary to widely held interpretation, one of Sartre's main goals in that text is to defend the view that consciousness does not necessitate self-awareness, that not all conscious states need be, ipso facto, states of self-awareness. In addition, I explain that this view about the conceptual relationship between consciousness and self-awareness has important methodological implications. One of the standard strategies for accounting for (...) the possibility of the type of capacity to have I* thoughts and attitudes is based on the assumption that being conscious necessarily entails being self-aware in at least a minimal sense, and then proceeds to explain how it I*-thoughts and attitudes are possible on the basis of those minimal states of self-awareness. Yet if Sartre's account of self-awareness is so much as plausible, this kind of strategy is bound to be incomplete. By helping itself to a notion of minimal self-awareness that is purportedly constitutive of consciousness, it fails to account for what is, by its own lights, the most fundamental form of self-awareness. First, I argue that the contestability of the term “terrorism” is insufficient to justify the targeting of those who are innocent noncombatants beyond reasonable doubt; second, that states could be as vicious, if not even more so, than nonstate actors could be in perpetrating acts that might be described as terrorism, and, third, that an adequate definition of international terrorism must focus on the actual victims of such despicable acts.

In this paper, it is argued that terrorism undermines the justification of perspective relativism. The cliché, “one person’s terrorist is another person’s freedom fighter,” is offered as an example of perspective relativism. Perspective relativists argue that moral principles and judgments have no universal moral import. Those who defend the cliché expression presuppose that the evaluation of terrorism is necessarily perspectival. For them, there are no morally objective differences, e.g., between deliberately killing combatants and deliberately killing innocent noncombatants. Yet there are (...) morally objective differences between these two acts. While the first act might be justified, the second act is considered murder. Hence, the evaluation of terrorism is not necessarily perspectival. Therefore, in the face of the evil that terrorists bring about, it is argued that perspective relativists have a substantive burden of proof to show that there are no transcultural moral values. En este artículo sostengo que los tres filósofos/pedagogos cubanos del siglo XIX, Félix Varela y Morales, José de la Luz y Caballero y Enrique José Varona, fueron responsables de superar la enseñanza de la escolástica tardía en la Real y Pontificia Universidad de San Jerónimo de La Habana. Contra los filósofos y pedagogos escolásticos tardíos que preferían la lógica silogística y la autoridad de la tradición sobre la inducción, argumentaron a favor de esta última sobre la primera. Puesto que defendían (...) las ideas liberales y republicanas, también argumentaban en contra de aquellos que apelan a la autoridad de la tradición en lugar de a nuestras experiencias cotidianas. Su espíritu liberal desafió no sólo al régimen tiránico impuesto por España, sino a cualquier otro régimen cuya autoridad dependiera de la fuerza más que de la libre voluntad del pueblo a escoger sus gobernantes. In my replies to some of my critics I argue that while the practice of terrorism is never justified, I concede that it is rarely but sometimes excused. As result, those who engage in excusable terrorism has a substantial burden of proof. They need to offer a compelling argument to show that the harm caused by their terrorist violence is actually excused by the extenuating circumstances and the goal that they are trying to achieve, so they will not be morally (...) or legally blameworthy for bringing about such harm. I am assuming that they will need to demonstrate that the alleged harm is excusable because it is necessary to accomplish a worthy goal and there is no other reasonable way to obtain such a worthy goal without deliberately harming those who can be reasonably conceived of as impeccably or objectively innocent. That is, those who are innocent beyond reasonable doubt. (shrink)

A fundamental tension exists between Rawls's ideal Kantian conception of justice as fairness (JAF), which requires respecting people as ends, and his realistic non-Kantian consequentialist conception of a supreme emergency in a just war. By justifying the targeting of objectively innocent noncombatants during a supreme emergency exception, Rawls allows for treating them as means only. Hence, his appeal to a supreme emergency is insufficient to avoid this tension. First, since for him JAF is ideal but also practical, one might argue (...) that his fictional people in the original position must reflect on the justification for using force on behalf of JAF. And second, since Rawls justifies targeting objectively innocent people during a supreme emergency exemption, he justifies what one might conceive of as emergency terrorism. Emergency terrorism, however, treats people as means only. Therefore, Rawls's Kantian conception of JAF is in tension with his consequentialist justification of a supreme emergency in a just war and hence with emergency terrorism. (shrink)

Since 1968, the irreversible loss of functioning of the whole brain, called brain death, is assimilated to individual’s death. The almost universal acceptance of this neurological criterion of death had decisive consequences for the contemporary medicine, such as the withdrawal of mechanical ventilation in these patients and organ retrieval for transplantation. The new criterion was successfully accepted in part because the assimilation of brain death state to death was presented by medicine --and acritically assumed by most of societies-- as a (...) scientific and objective fact. Nevertheless, many people do not think that the patients suffering brain death are actually dead. We show here that those people are not necessarily wrong. It can be argued that, in fact, the justification of the neurological criterion is not scientific but moral. We outline the thesis that the problem surrounding the vital status of brain dead patients is due to a confusion between factual and normative questions. Furthermore, we claim that the donation of organs and the withdrawal of life-support could be ethically acceptable even if the patients suffering brain death are considered as alive. As an alternative to the dead donor rule, we propose a justification for organ donation of brain-dead patients based on the (moral) concepts of harm and consent : what truly justifies the procurement of organs on those patients is not that they are dead, but that they wish to donate their organs and that, since they have irreversibly lost their brain, they cannot be harmed. At a crucial juncture in Plato’s Sophist, when the interlocutors have reached their deepest confusion about being and not-being, the Eleatic Visitor proclaims that there is yet hope. Insofar as they clarify one, he maintains, they will equally clarify the other. But what justifies the Visitor’s seemingly oracular prediction? A new interpretation explains how the Visitor’s hope is in fact warranted by the peculiar aporia they find themselves in. According to one of Leibniz's theories of contingency a proposition is contingent if and only if it cannot be proved in a finite number of steps. It has been argued that this faces the Problem of Lucky Proof , namely that we could begin by analysing the concept ‘Peter’ by saying that ‘Peter is a denier of Christ and …’, thereby having proved the proposition ‘Peter denies Christ’ in a finite number of steps. It also faces a more general but (...) related problem that we dub the Problem of Guaranteed Proof . We argue that Leibniz has an answer to these problems since for him one has not proved that ‘Peter denies Christ’ unless one has also proved that ‘Peter’ is a consistent concept, an impossible task since it requires the full decomposition of the infinite concept ‘Peter’. We defend this view from objections found in the literature and maintain that for Leibniz all truths about created individual beings are contingent. (shrink)

Aristotle recognizes a series of difficulties when it comes to understanding the starting points of a scientific or philosophical system, and contemporary scholars have encountered their own difficulties in understanding his response. I will argue that Aristotle was aware of a Platonic solution that can help us uncover his own attitude toward the problem.Aristotle's central problem with first principles arises from the (...) fact that they cannot be demonstrated in the same way as other propositions. This monograph offers a fresh perspective on the applicability of mathematics in science. It explores what mathematics must be so that its applications to the empirical world do not constitute a mystery. In the process, readers are presented with a new version of mathematical structuralism. The author details a philosophy of mathematics in which the problem of its applicability, particularly in physics, in all its forms can be explained and justified. Chapters cover: mathematics as a formal science, mathematical ontology: what (...) does it mean to exist, mathematical structures: what are they and how do we know them, how different layers of mathematical structuring relate to each other and to perceptual structures, and how to use mathematics to find out how the world is. The book simultaneously develops along two lines, both inspired and enlightened by Edmund Husserl’s phenomenological philosophy. One line leads to the establishment of a particular version of mathematical structuralism, free of “naturalist” and empiricist bias. The other leads to a logical-epistemological explanation and justification of the applicability of mathematics carried out within a unique structuralist perspective. This second line points to the “unreasonable” effectiveness of mathematics in physics as a means of representation, a tool, and a source of not always logically justified but useful and effective heuristic strategies. The polemic was an important cultural event in 19th-century Cuba. From 1838 to 1840, issues of metaphysics, epistemology, ethics, pedagogy, and the influence of Victor Cousin’s eclecticism were discussed in the island’s leading newspapers. A brief historical account preceding the polemic is offered. It is argued that the predominant view of the polemic as motivated by a widespread desire for Cuba’s independence from Spain is misleading — promoting an emancipatory myth. Lastly, it is argued that José de la Luz y (...) Caballero’s appeal to patriotism during the polemic unwittingly established a dangerous precedent for self-appointed guardians of patriotism to condition public debates. (shrink)

The goal of this piece is to put some pressure on Brian O’Shaughnessy’s claim that perceptual experiences are necessarily mental processes. The author targets two motivations behind the development of that view. First, O’Shaughnessy resorts to pure conceptual analysis to argue that perceptual experiences are processes. The author argues that this line of reasoning is inconclusive. Secondly, he repeatedly invokes a thought experiment concerning the total freeze of a subject’s experiential life. Even if this case is coherent, however, it does (...) not show that perceptual experiences are processes. (shrink)

I will argue that President Biden has not only the right to nominate an African American woman for SCOTUS, but, if he chooses a suitable candidate, he will be doing a great service to our country.

Consider a certain red rose. The proposition that the rose is red is true because the rose is red. One might say as well that the proposition that the rose is red is made true by the rose’s being red. This, it has been thought, does not commit one to a truthmaker of the proposition that the rose is red. For there is no entity that makes the proposition true. What makes it true is how the rose is, and how (...) the rose is is not an entity over and above the rose. It is against this view that I shall argue in this paper. I shall argue that a significant class of true propositions, including inessential predications like the proposition that the rose is red, are made true by entities. "No truthmaking without truthmakers" is my slogan. Although I have my view about what kinds of entities are truthmakers, I shall not argue for or presuppose that view here. All I shall argue for here is that if a proposition is made true by something, it is made true by some thing, but my argument will leave it open what kind of thing that thing is: it could be a fact or state of affairs, a trope, or any other sort of entity. Gorgias’ On Not-Being survives only in two divergent summaries. Diels–Kranz's classic edition prints the better-preserved version that appears in Sextus’ Aduersus Mathematicos. Yet, in recent years there has been rising interest in a second summary that survives as part of the anonymous De Melisso, Xenophane, Gorgia. The text of MXG is more difficult; it contains substantial lacunae that often make it much harder to make grammatical let alone philosophical sense of. As Alexander Mourelatos reports, one manuscript has a scribal note (...) that reads: "The original contains many errors; no one should blame me; I just copy what I see.". The treatise's state of preservation has aptly prompted Michael Gagarin to liken it to a black hole: "something we cannot see directly but know must exist because of certain effects it has on other objects.". La polémica fue un importante evento cultural durante el siglo XIX en Cuba. De 1838 a 1840 se debatieron en los principales periódicos de la isla temas en torno a la metafísica, la epistemología, la ética, la pedagogía y la influencia del eclecticismo de Víctor Cousin. Exploro en esta investigación brevemente algunos de los hechos históricos que antecedieron a esta polémica. Arguyo que es inexacta la interpretación predominante que esta polémica fue motivada por el deseo de independizar a Cuba de (...) España. Tal interpretación promueve un mito de emancipación. Según mi análisis, cuando en su intervención en la polémica José de la Luz y Caballero apela al patriotismo, establece sin saberlo un precedente peligroso que usarán los autodenominados protectores del patriotismo para restringir los debates públicos. -/- La polémica filosófica en la Habana se refiere a una serie de debates públicos que acaecieron en el siglo XIX en Cuba principalmente entre jóvenes intelectuales de la época. In der Kritik der Urteilskraft vertritt Kant noch die analogische Beziehung zwischen Schönheit und Sittlichkeit (KU, AA 05: 351–354). Aber wir befinden uns hier in einem ganz anderen Zusammenhang. Und dies nicht nur, weil die Erörterung dieser analogischen Beziehung eine Lösung für das Problem der Verknüpfung zwischen theoretischer und praktischer Vernunft beansprucht. Die Reflexionen in den Vorlesungen über Anthropologie über die pragmatische Dimension des Geschmacks setzten die Möglichkeit dieser Verknüpfung bereits voraus, bevor Kant eine kritische Begründung derselben erreichte. Wir dürfen (...) aber diese Reflexionen nicht als das Ergebnis unreifer Versuche zur Lösung dieses kritischen Problems der Rationalitätstheorie Kants deuten. Während der Paragraph 59 der Kritik der Urteilskraft Teil der spekulativen Philosophie ist, wird die Kritik des Geschmacks in den Vorlesungen über Anthropologie vielmehr insofern sinnvoll, da sie zu einem pragmatischen, populären und aufgeklärten Bildungsprogramm der Anthropologie Kants gehört. Aunque no es posible ofrecer aquí un análisis detallado de las diferentes cues tionesimplicadas en la teoría de las representaciones en la Modernidad, sí pode mos atender auno de sus aspectos más relevantes, presente en la exposición de Leibniz, Wolff,Baumgarten y Kant, a saber: el reconocimiento progresivo y la vin dicación de unconocimiento específicamente sensible como un tipo específico de conocimiento en lafilosofía escolar alemana del siglo XVIII. A pesar de que Leibniz atribuye al conocimiento claro y confuso el grado (...) más bajo en su esquema de los niveles del conocimiento, tambiénes cierto que su exposición apunta ya a la irre ductibilidad de este ámbito en unconocimiento finito como el humano. Por lo demás, lo confuso aquí adquiere sentido en elsistema del saber en la medida en que Leibniz considera que todos los conocimientos obre cuestiones de hecho, si bien falibles, se encuentran en conexión con la verdad en lamedida en que parti cipan de la misma, al expresar el fundamento último de lo real y sersusceptibles de perfectibilidad en el seno de una subjetividad dinámica que comienza aser entendida como unidad vital. En Wolff y Baumgarten se profundiza en la vía que esabierta ya por Leibniz: la exposición de los niveles de conocimiento en el marco de unaimbricación de la lógica de la representación con una psicología vitalista, en la que sereconocerá la experiencia del sentimiento como expresión subjetiva de la perfectibilidaddel conocimiento humano. Aunque la filosofía de Kant supondrá una ruptura con laexposición escolar de esta teoría de los niveles de conocimiento o los tipos derepresentación, lo cierto es que el nacimiento de su teoría de la sensi bilidad tiene lugar enel marco histórico de esta concepción tradicional. El artículo consta de cuatro partes. En la primera parte, la introducción, señalo algunos aspectos de la importancia del proyecto. Segundo, describo y evalúo como Varela interpreta la filosofía. Tercero, exploro su eclecticismo dentro de su filosofía. Por último, explico el concepto de utilidad en el quehacer filosófico de Varela. Estos tres conceptos: filosofía, eclecticismo y utilidad están correlacionados en su obra. La filosofía con la recta razón. El eclecticismo, o lo que Varela llama la “verdadera filosofía,” con la sabia (...) selección de argumentos, incluyendo diversos métodos para explorar nuestras experiencias cotidianas, y la utilidad con la mesurada evaluación de nuestra conducta, incluyendo el bien común. Dado que estos tres conceptos son polisémicos, ellos pueden ser manipulados, y de hecho han sido tergiversados, por pensadores que han tratado de explicar el pensamiento filosófico vareliano con fines partidistas, ya sea con buenas intenciones o con fines ideológicos tendenciosos. “Terrorism” is a polysemic, emotionally laden term. Belligerent groups could be labeled “terrorist” by some and “freedom” or “guerrilla” fighters by others. Similarly, the same organization or group could be labeled “terrorist” by some and “humanitarian organization” by others. Hence, depending on which perspective people take in a given conflict, and how the international community reacts to the conflict in question, members of different organizations or groups might end up being classified in a negative sense as terrorists or in a (...) positive sense as freedom fighters. Such perspectivism partly explains why so much disagreement exists on the meaning, justification, or excuse of terrorism. (shrink)

Emancipatory social movement solidarities are prefigurative associations. While pursuing broad-based social transformations, solidaristic agents attempt to model—in an incomplete and provisional way—the social relations they wish to bring into existence. Existing structures of domination, deep-set and overlapping as they are, pose an abiding challenge to the prefiguration of just relations, however. This article considers the challenge of prefiguration by developing a diachronic, goal-oriented, and epistemic account of solidarity. The author argues that solidarity is a collaborative process whereby agents prefigure relationships (...) of nondomination while working together to reach shared understandings about the political task at hand. The author examines two epistemologies that have not been traditionally connected to philosophical discussions of solidarity, philosophical hermeneutics and creolization, to elaborate the account. While both frameworks enable an understanding of solidarity as a properly transformative relation, creolization illuminates the possibilities and difficulties of collaborating under conditions of domination. Hamas’s deliberate attack on October 7th against innocent civilians is absolutely wrong. Therefore, it should be universally condemned. And yet, I wonder how a universal recognition of an absolute duty of respect for human dignity can help solving the existential conflict confronting Israelis and Palestinians. Ideally, a two-state solution proposed by the international community can be seen as a reasonable and fair compromise. Nevertheless, the reality on the ground is different. Thus far the existence of one state has precluded the (...) existence of another with no end in sight to their mutually destructive violence. Their conflict demands that people who are reasonable and fair-minded try to understand it holistically and to offer an impartial assessment of this intractable conflict without relativizing the undeserved human suffering of all those involved and affected by it. Consider a certain red rose. The proposition that the rose is red is true because the rose is red. One might say as well that the proposition that the rose is red is made true by the rose’s being red. This, it has been thought, does not commit one to a truthmaker of the proposition that the rose is red. For there is no entity that makes the proposition true. What makes it true is how the rose is, and how (...) the rose is is not an entity over and above the rose. It is against this view that I shall argue in this paper. I shall argue that a significant class of true propositions, including inessential predications like the proposition that the rose is red, are made true by entities. "No truthmaking without truthmakers" is my slogan. Although I have my view about what kinds of entities are truthmakers, I shall not argue for or presuppose that view here. All I shall argue for here is that if a proposition is made true by something, it is made true by some thing, but my argument will leave it open what kind of thing that thing is: it could be a fact or state of affairs, a trope, or any other sort of entity. El ataque deliberado de Hamás el 7 de octubre contra civiles inocentes es absolutamente inicuo. Por lo tanto, debe ser condenado universalmente. Y, sin embargo, me pregunto cómo un reconocimiento universal de un deber absoluto de respeto por la dignidad humana puede ayudar a resolver el conflicto existencial al que se enfrentan israelíes y palestinos. Idealmente, una solución de dos Estados propuesta por la comunidad internacional puede ser vista como un compromiso razonable y justo. Sin embargo, la realidad sobre el (...) terreno es diferente. Hasta ahora, la existencia de un Estado ha impedido la existencia de otro, sin que se vislumbre el final de su violencia mutuamente destructiva. Su conflicto exige que las personas razonables e imparciales traten de entenderlo de manera holística y de ofrecer una evaluación justa de este conflicto insoluble sin relativizar el sufrimiento humano inmerecido de todos los involucrados y afectados por él. In this article, it is argued that a significant internal tension exists in John Rawls' political liberalism. He holds the following positions that might plausibly be considered incongruous: (1) a commitment to tolerating a broad right of freedom of political speech, including a right of subversive advocacy; (2) a commitment to restricting this broad right if it is intended to incite and likely to bring about imminent violence; and (3) a commitment to curbing this broad right only if there is (...) a constitutional crisis. By supporting a broad right of freedom of political speech in Political Liberalism, he allows militant intolerant people such as Jihadists, White Supremacists and Neo-Nazis to advocate publicly their dangerously intolerant beliefs. Public advocacy of dangerously intolerant beliefs can be construed as subversive advocacy. As demonstrated by the historical examples of the Weimar Republic and the Second Spanish Republic, militant intolerant groups could use a right of subversive advocacy to threaten the stability of liberal democracies. Hence, by allowing them to exercise a broad right of freedom of political speech, Rawls could jeopardize that which he intends to defend, namely the actual political stability of a liberal democratic order. Lastly, Rawls' conception of ideal constitutional interpretation, which privileges a broad right of freedom of political speech, might be insufficient to deal effectively with the threat posed by militant intolerant groups. Yet a tradition of American constitutional interpretation that balances freedom of speech with other important constitutional and/or political values has overcome a civil war, two world wars, the Cold War and the 9/11 terrorist attacks without abandoning democracy or permanently renouncing those values. Still, Rawls' ideal approach to constitutional interpretation might, in hindsight, help us to understand some of the excesses and deficiencies of American jurisprudence in times of emergency.<br><br><br><br>. In this article, I contend that the three Cuban philosophers/pedagogues of the nineteenth century – Félix Varela y Morales, José de la Luz y Caballero, and Enrique José Varona were responsible for overcoming the teaching of late scholastic at the Royal and Pontifical University of St. Jerome of Havana. Against late scholastic philosophers and pedagogues who preferred syllogistic logic and the authority of tradition over induction, they argued in favor of the latter over the first. Since they defended liberal and (...) republican ideas, they also argued against those who appeal to the authority of tradition rather than to our ordinary experiences. Of course, their liberal spirit challenged not only the tyrannical regime imposed by Spain at the time but any other regime whose authority depends on force rather than on the will of the people. El artículo analiza el papel del resentimiento en la Teoría de los sentimientos morales de Adam Smith y su conexión con el proceso de la simpatía mutua por medio del cual el “espectador imparcial” asume plenamente el resentimiento de la víctima, al considerar que su pasión se rige por los principios de la propiedad y la justicia. Se sostiene que el resentimiento no solo cumple un rol central en la teoría del castigo de Adam Smith, en la medida en que (...) permite retribuir, disuadir y rehabilitar al victimario sino que, además, aporta a la discusión contemporánea sobre el perdón y la reconciliación, pues convoca la posibilidad de superar el resentimiento y restablecer las relaciones sociales entre el agresor y la víctima. The adage, “one person’s terrorist is another person’s freedom fighter,” is offered as a plausible example of evoking moral relativism. Moral relativists recognize no transcultural moral facts. So, for them, even the concept of harm would be subjective or context-sensitive. Yet one can appeal to cogent transcultural moral reasons to distinguish between deliberately and unjustifiably harming impeccably innocent people and those who might engage in justifiably harming those guilty of grave crimes. In the face of the preventable evil acts that (...) terrorists frequently perpetrate against impeccably innocent people, it is argued that moral relativists have a substantive burden of proof to demonstrate that no cogent transcultural moral reasons exist against the practice of terrorism. In the absence of such a demonstration, it is reasonable to believe that the practice of terrorism, while not totally defeating moral relativism, seems to undermine its credibility. (shrink)

The resemblance nominalist says that the truthmaker of 〈Socrates is white〉 ultimately involves only concrete particulars that resemble each other. Furthermore he also says that Socrates and Plato are the truthmakers of 〈Socrates resembles Plato〉, and Socrates and Aristotle those of 〈Socrates resembles Aristotle〉. But this, combined with a principle about the truthmakers of conjunctions, leads to the apparently implausible conclusion that 〈Socrates resembles Plato and Socrates resembles Aristotle〉 and 〈Socrates resembles Plato and Plato resembles Aristotle〉 have the same truthmakers, (...) namely, Socrates, Plato and Aristotle. I shall argue that the resemblance nominalist can say that those conjunctions have the same truthmakers but these truthmakers make them true in different ways. I shall also use this view to account for the truthmakers of propositions like 〈Socrates is white〉, and respond to previous objections by Cian Dorr and Jessica Wilson. (shrink)

Una primera línea se puede percibir en el trabajo de Žižek sobre una política del goce cuya trayectoria circula desde el deseo a la pulsión. Desde una investigación muy orientada en el problema del sujeto, en el carácter sintomático del mismo, Žižek se ha desplazado hacia un análisis de la relación entre el objeto a y la pulsión en el marco del capitalismo actual. En conexión con esta problemática se encuentra una segunda línea que tiene como punto central el trabajo crítico sobre las relaciones entre economía y política; frente al desafío que supone hoy en día la circulación espontánea del capital y el abandono del ámbito económico por parte de la teoría política. Por un lado nos encontramos con los dos sentidos del término escatología, el económico y el teológico-político, que convergen en la noción de exceso, sea de la pulsión o sea del objeto a. Al mismo tiempo, Žižek considera que no es posible traducir la atención sobre el exceso capitalista y su propia revolución inmanente en términos de dominación política.Ambas secuencias se encuentran, en definitiva, íntimamente vinculadas en la crítica de la economía política del discurso que Žižek lleva a cabo. La introducción del término paralaje puede servir como alternativa para entender la oscilación permanente que se produce en su obra entre síntoma y escatología. This bulletin contains a summary of the main topics of discussion in truthmaker theory, namely: the definition of truthmakers, problems with Truthmaker Necessitarianism and Truthmaker Maximalism, the ontological burden of truthmakers and the recalcitrant topic of truthmakers for negative truths.

This paper explores whether terrorist violence could be morally justified or excused. It defends the absolute immunity of innocent people against those who might want to sacrifice them for other goals. The defense is based on recognizing people’s stringent natural duty of nonmaleficence, which entails an obligation on moral agents to refrain from intentionally bringing about harm or significant risk of it to the innocent. The paper is divided into two parts. The first part distinguishes between unconditional and conditional critics’ (...) arguments regarding the use of terrorist violence, and between a narrow and a broad definition of terrorism. While unconditional critics accept the narrow definition or one akin to it because they equate terrorism with murder, conditional critics accept the broad definition or one akin to it because they attempt to justify or excuse the use of terrorism based, e.g., on an analogy with a just war approach, consequentialism, moral relativism, supreme emergency or last resort. Exception is taken with the latter arguments since they attempt to justify or excuse morally unjustifiable and inexcusable actions such as the deliberate use of violence against the innocent. The second part explores plausible conditional critics’ reasons for justifying or excusing the 9/11/01 attacks and find them wanting. If the argument works, then, with minor modifications, it could also apply to the 3/11/04 attacks in Madrid, the 7/7/05 attacks in London, and similar attacks elsewhere. (shrink)

Vitoria and Suárez defend the categorical immunity of the innocent not to be intentionally killed. But they allow for inflicting collective punishment on the innocent and the noninnocent alike during and after a just war. So they allow for deliberately harming them. Inflicting harm on the innocent can often result in their death. Hence, holding both claims seems incoherent. First, the objections against using the term “innocent” are explained. Second, their views on just war are explored. And third, by appealing (...) to Aquinas' double-effect reasoning, it is shown how they try to avoid the above-mentioned incoherence. Still, their appeal might be insufficient to palliate the tension between the above-mentioned claims. If just wars are possible, the deliberate harming of the innocent is reasonably unavoidable for defeating and punishing those who wage them. Hence, defenders of just wars, whether from a religious or a secular perspective, must live with such a tension. (shrink)
