  1. Moral Parenthood: Not Gestational.Benjamin Lange - forthcoming - Journal of Medical Ethics.
Parenting our biological children is a centrally important matter, but how, if it all, can it be justified? According to a contemporary influential line of thinking, the acquisition by parents of a moral right to parent their biological children should be grounded by appeal to the value of the intimate emotional relationship that gestation facilitates between a newborn and a gestational procreator. I evaluate two arguments in defence of this proposal and argue that both are unconvincing.

  2. The Ethics of Partiality.Benjamin Lange - 2022 - Philosophy Compass 1 (8):1-15.
Partiality is the special concern that we display for ourselves and other people with whom we stand in some special personal relationship. It is a central theme in moral philosophy, both ancient and modern. Questions about the justification of partiality arise in the context of enquiry into several moral topics, including the good life and the role in it of our personal commitments; the demands of impartial morality, equality, and other moral ideals; and commonsense ideas about supererogation. This paper provides (...)

  3. A Concausal Approach to the Mind-Body Problem.Marga Vega - 2022 - Journal of Polian Studies 5:31-74.
This paper tests Leonardo Polo’s concausality against the challenges of epiphenomenalism, overdetermination, and reductionism that the contemporary mind-body problem presents. Analysis of Jaegwon Kim’s criticism of John Searle’s Biological Naturalism exemplifies the aporias of the mind-body relation generated by dualism and physicalism. In contrast with these ontologies, Aristotle’s notion of matter as potentiality requires a plurality of causal senses and is a viable alternative to both dualism and monism. Polo’s reprisal of Aristotle’s substance as concausality provides a revision of our (...)

Posing qualia as the mark of the mental presents problems for both reductionist and non-reductionist views of the mind. An alternative platform to understand the ontology of mental states is presented using Polo's retrieval of Aristotle's notion of energeia. I propose that mental states are characterized in terms of temporal integration, a feature of mental states that happen in time but do not require duration in time. Other features like simultaneity, commensurability, and non-failure are derived from this 'zero-time' that characterizes (...)

The question of what art is and why certain objects and events are considered art is examined. In the light of John Searle’s Social Philosophy, a hybrid Institutionalist-Functionalist explanation of what counts as art is presented. However, Searle’s apparatus applied to the ontology of the work of art is not enough to answer the question of why art has the status it exhibits. The proposal is to trace back the ontology of art to the origins of the dichotomy between freedom (...)

This paper explores Polo's proposal of an anthropological access to God's existence in addition to the traditional metaphysical Five Ways. More specifically, it focuses on the role of intellectual habits, in particular the habit of wisdom and the habit of personal intellect, in acquiring knowledge of God as the creator of the person. Habitual knowledge, according to Polo, is possible because the agent intellect illuminates intelligible contents, may that be the phantasm, to operations of the intellectual faculty or any other (...)

  7. What Follows from Defensive Non-Liaibility?Gerald Lang - 2017 - Proceedings of the Aristotelian Society 117 (3):231-252.
Theories of self-defence tend to invest heavily in ‘liability justifications’: if the Attacker is liable to have defensive violence deployed against him by the Defender, then he will not be wronged by such violence, and selfdefence becomes, as a result, morally unproblematic. This paper contends that liability justifications are overrated. The deeper contribution to an explanation of why defensive permissions exist is made by the Defender’s non-liability. Drawing on both canonical cases of self-defence, featuring Culpable Attackers, and more penumbral cases (...)

The institution of the family and its importance have recently received considerable attention from political theorists. Leading views maintain that the institution’s justification is grounded, at least in part, in the non-instrumental value of the parent-child relationship itself. Such views face the challenge of identifying a specific good in the parent-child relationship that can account for how adults acquire parental rights over a particular child—as opposed to general parental rights, which need not warrant a claim to parent one’s biological progeny. This chapter focusses on Martin Lang's ongoing practiced-based research project "The Truth in Painting 1993", which employs painting, photography and digital manipulation brought together in pictures that depict events from 1993. Each painting in the series contains an amalgamation of analogue painterly marks, printed scans of paintings and digital painting. The projects anticipates that both the lack of certainty around the mediums used, and the occasions depicted in the works, will spur viewers to question notions of socially constructed and (...)

I argue that you can be permitted to discount the interests of your adversaries even though doing so would be impartially suboptimal. This means that, in addition to the kinds of moral options that the literature traditionally recognises, there exist what I call other-sacrificing options. I explore the idea that you cannot discount the interests of your adversaries as much as you can favour the interests of your intimates; if this is correct, then there is an asymmetry between negative partiality (...)

I here settle a recent dispute between two rival theories in distributive ethics: Restricted Prioritarianism and the Competing Claims View. Both views mandate that the distribution of benefits and burdens between individuals should be justifiable to each affected party in a way that depends on the strength of each individual’s separately assessed claim to receive a benefit. However, they disagree about what elements constitute the strength of those individuals’ claims. According to restricted prioritarianism, the strength of a claim is determined (...)

Why do relationships of friendship and love support partiality, but not relationships of hatred or commitments of racism? Where does partiality end and why? I take the intuitive starting point that important cases of partiality are meaningful. I develop a view whereby meaning is understood in terms of transcending self-limitations in order to connect with things of external value. I then show how this view can be used to distinguish central cases of legitimate partiality from cases of illegitimate partiality and (...)

Despite some converging norms around various forms of AI auditing, auditing for the purpose of compliance and assurance currently have little to no agreed upon practices, procedures, taxonomies, and standards. We propose the ‘criterion audit’ as an operationalizable compliance and assurance external audit framework. We model elements of this approach after financial auditing practices, and argue (...)

Existing discussions of partiality have primarily examined special personal relationships between family, friends, or co-nationals. The negative analogue of such relationships – for example, the relationship of enmity – has, by contrast, been largely neglected. This chapter explores this adverse relation in more detail and considers the special reasons generated by it. We suggest that enmity can involve justified negative partiality, allowing members to give less consideration to each other’s interests. We then consider whether the negative partiality of enmity can (...)

We argue that these asymmetries point to a more fundamental moral principle, which we call (...)

Overcoming this state requires an interdisciplinary collaboration of psychologists and philosophers. That is, broad empirical evidence regarding the nature of envy generated in psychological studies must inform judgments about the value of envy according to sophisticated philosophical standards. This essay asks how Hazlitt’s notion of artistic genius stands up today, where connoisseurs are unfashionable, expertise is distrusted and popular opinion is often courted and highly valued in the generation and reception of art. It does this by analysing Hazlitt’s concepts of gusto and “aesthetic democracy”. First, Hazlitt’s concept of aesthetic democracy is applied to the painting of Thomas Kinkade, the reassessment of ‘slaver’ statues and a conceptual project by Komar and Melamid to highlight some problems with popular opinion (...)

Many proposed accounts of lawhood (primitivist accounts, universals accounts, the Best System Account, the Package Deal Account, essentialist accounts) inappropriately permit worlds with laws but no accidents. Objective correlates—behavioral, functional, and neural—provide essential tools for the scientific study of consciousness. But reliance on these correlates should not lead to the ‘fallacy of misplaced objectivity’: the assumption that only objective properties should and can be accounted for objectively through science. Instead, what needs to be explained scientifically is what experience is intrinsically— its subjective properties—not just what we can do with it extrinsically.
