Background Consent policies for post-mortem organ procurement (OP) vary throughout Europe, and yet no studies have empirically evaluated the ethical implications of contrasting consent models. To fill this gap, we introduce a novel indicator of governance quality based on the ideal of informed support, and examine national differences on this measure through a quantitative survey of OP policy informedness and preferences in seven European countries. -/- Methods Between 2017–2019, we conducted a convenience sample survey of students (n = 2006) in (...) Austria (AT), Belgium (BE), Denmark (DK), Germany (DE), Greece (GR), Slovenia (SI) and Spain (ES), asking participants about their donation preferences, as well as their beliefs and views about the policy in place. From these measures, we computed indices of informedness, policy support, and fulfilment of unexpressed preferences, which we compared across countries and consent systems. -/- Results Our study introduces a tool for analyzing policy governance in the context of OP. Wide variation in policy awareness was observed: Most respondents in DK, DE, AT and BE correctly identified the policy in place, while those in SI, GR and ES did not. Respondents in opt-out countries (AT, BE, ES and GR) tended to support the policy in place (with one exception, i.e., SI), whereas those in opt-in countries (DE and DK) overwhelmingly opposed it. These results reveal stark differences in governance quality across countries and consent policies: We found a preponderance of informed opposition in opt-in countries and a general tendency towards support–either informed or uninformed–in opt-out countries. We also found informed divergence in opt-in countries and a tendency for convergence–either informed or uninformed–among opt-out countries. -/- Conclusion Our study offers a novel tool for analyzing governance quality and illustrates, in the context of OP, how the strengths and weaknesses of different policy implementations can be estimated and compared using quantitative survey data. En la literatura sobre las emociones una de las teorías con mayor fuerza es la llamada “teoría James-Lange”. En esta obra se intenta hacer una crítica a dicha teoría a partir de algunas observaciones de Wittgenstein sobre el uso de conceptos psicológicos, sacando a la luz dos confusiones gramaticales que surgen en ella. Para ello, se construye primero la categoría de “programa de naturalización de las emociones” que recoge las teorías del Descartes, James y Prinz, siguiendo la metodología de Lakatos. (...) Luego, se identifica como problema central el de la naturalización de la intencionalidad. Para luego exponer algunas herramientas de Wittgenstein para estudiar la gramática de la pregunta por el objeto y la intencionalidad las emociones, mostrando que las respuestas del programa de naturalización no son satisfactorias y no respetan las reglas de ciertos usos del lenguaje. Moral subjectivism is commonly associated with out-of-favour theories like, e.g., Alfred Ayer’s emotivism or John Mackie’s error theory. This paper approaches the field against the background of the attitudinal character of morality and religion. The possibility of a brand of moral subjectivism is established which is common to Ayer’s and Mackie’s theories in name only yet still has significant merits. The perspective from action theory and the philosophy of mind suggests that the problem of moral obligation, central to moral philosophy, (...) is more convincingly dealt with by subjectivism than by its rivals: In contrast to realism or even relativism (with which subjectivism is often confused), subjectivism can help to explain the peculiarities of obligation without forcing us to disregard the parallel problem in the field of religion. This finding calls into question the rationale for, as well as the success of, central assumptions in ontology and semantics which the realist so freely hands out in order to make his point: If religious facts and the truth-aptness of religious judgements will not explain religious obligation, moral facts and the truth-aptness of moral judgements will not help the moral realist either. So unless we do not wish to simply cast the problem of moral obligation aside, in future, moral subjectivism must be seriously considered as a worthwhile position in its own right. Philosophers now seem to agree that frequentism is an untenable strategy to explain the meaning of probabilities. Nevertheless, I want to revive frequentism, and I will do so by grounding probabilities on typicality in the same way as the thermodynamic arrow of time can be grounded on typicality within statistical mechanics. This account, which I will call typicality frequentism, will evade the major criticisms raised against previous forms of frequentism. In this theory, probabilities arise within a physical theory from statistical (...) behavior of almost all initial conditions. The main advantage of typicality frequentism is that it shows which kinds of probabilities (that also have empirical relevance) can be derived from physics. Although one cannot recover all probability talk in this account, this is rather a virtue than a vice, because it shows which types of probabilities can in fact arise from physics and which types need to be explained in different ways, thereby opening the path for a pluralistic account of probabilities. I want to combine two hitherto largely independent research projects, scientific understanding and mechanistic explanations. Understanding is not only achieved by answering why-questions, that is, by providing scientific explanations, but also by answering what-questions, that is, by providing what I call scientific descriptions. Based on this distinction, I develop three forms of understanding: understanding-what, understanding-why, and understanding-how. I argue that understanding-how is a particularly deep form of understanding, because it is based on mechanistic explanations, which answer why something happens in (...) virtue of what it is made of. I apply the three forms of understanding to two case studies: first, to the historical development of thermodynamics and, second, to the differences between the Clausius and the Boltzmann entropy in explaining thermodynamic processes. In this issue of the Report, James L. Bernat proposes an innovative and sophisticated distinction to justify the introduction of permanent cessation as a valid substitute standard for irreversible cessation in death determination. He differentiates two approaches to conceptualizing and determining death: the biological concept and the prevailing medical practice standard. While irreversibility is required by the biological concept, the weaker criterion of permanence, he claims, has always sufficed in the accepted standard medical practice to declare death. Bernat argues that (...) the medical practice standard may be acceptable on the ground that proving circulatory or brain permanence is sufficient to assure complete accuracy for death diagnosis. -/- The topic requires public deliberation: processes to survey people's opinions and mechanisms to channel their opinions into policy-making. What is at stake is the nature of our society. Do we want an expertocracy, in which an enlightened few design policies for the greater good of the majority and exploit the lack of public knowledge to achieve compliance? (shrink)

Among the many ways to evaluate the rationality and adequacy of belief, the relationship between two dimensions is of particular interest: the epistemic dimension and the moral dimension. A belief is epistemically rationalwhen it is supported by the evidence and it is morally adequatewhen its formation and holding is sensitive to moral features of the situation. According to the traditional view, known as purism, the moral domain does not directly impact the epistemic domain. However, there is debate in the literature (...) about the existence of immoral beliefs that seem, at first sight, epistemically rational. These beliefs that contain apparent normative conflict raise the challenge of explaining how different forms of normativity are related. Non-traditional theories hold that there is an encroachment of moral factors in epistemic rationality. Moral encroachment is the view that moral features can affect the epistemic status of a belief, for example, influencingthe threshold of sufficient evidence for rational belief. This idea produces a natural answer to the conflict problem: it wouldn’t exist because moral contexts make immoral beliefs also epistemically irrational. In this paper, I’ll argue that immoral beliefs can’t be epistemically rational, so there is no conflict. This, however, is not due to moral encroachment. It happens because immoral beliefs are never actually supported by the evidence. They are immoral because they are insensitive to moral contexts andepistemically irrational because they are insensitive to available evidence. This account is compatible with purism and, since it is the most parsimonious theory, we should adopt purism. (shrink)

What is discrimination and what makes wrongful discrimination wrong? Even after an ever-rising tide of research over the course of the past twenty-five or so years these questions still remain hard to answer. Exercising candid and self-critical hindsight, Larry Alexander, who contributed his fair share to this tide, thus remarked: “All cases of discrimination, if wrongful, are wrongful either because of their quite contingent consequences or perhaps because they are breaches of promises or fiduciary duties.” If this is true it (...) raises serious doubts as to how wrongful discrimination can be a moral wrong in itself. Also, the question comes up as to who it is who breaches a promise or a fiduciary duty. This paper defends the view that the substance of these remarks is better understood by couching them in a political approach towards discrimination. Against this background, they give rise to real and pressing concerns. Once we conceptualise the realm political along Hobbesian lines as the battleground comprising both the private sphere of the individual and the public sphere of the commonwealth it emerges that discrimination has different significance with regard to these respective spheres. In order to illustrate this, I adopt Kasper Lippert-Rasmussen’s descriptive account of discrimination as „differential treatment on the basis of membership of a socially salient group“ and the common view that wrongful discrimination is wrong because it is harmful, disrespectful, or both. In the private sphere the case can be made for morally permissible cases of discrimination. Sexual discrimination due to sexual self-determination with consequently freely choosing your sexual or romantic partner is the central case in point. Where somebody feels unfairly rejected and consequently hurt neither the charge of harm inflicted nor that of disrespect endured need be justified. No “breach of promises or fiduciary duties” is involved. The case is different, however, when it comes to the fiduciary of power. In discriminating, he who exercises the power of the commonwealth necessarily breaches a promise and a fiduciary duty. Discrimination thus appears to be more of a problem of political philosophy than one of applied ethics. Since 1968, the irreversible loss of functioning of the whole brain, called brain death, is assimilated to individual’s death. The almost universal acceptance of this neurological criterion of death had decisive consequences for the contemporary medicine, such as the withdrawal of mechanical ventilation in these patients and organ retrieval for transplantation. The new criterion was successfully accepted in part because the assimilation of brain death state to death was presented by medicine --and acritically assumed by most of societies-- as a (...) scientific and objective fact. Nevertheless, many people do not think that the patients suffering brain death are actually dead. We show here that those people are not necessarily wrong. It can be argued that, in fact, the justification of the neurological criterion is not scientific but moral. We outline the thesis that the problem surrounding the vital status of brain dead patients is due to a confusion between factual and normative questions. Furthermore, we claim that the donation of organs and the withdrawal of life-support could be ethically acceptable even if the patients suffering brain death are considered as alive. As an alternative to the dead donor rule, we propose a justification for organ donation of brain-dead patients based on the (moral) concepts of harm and consent : what truly justifies the procurement of organs on those patients is not that they are dead, but that they wish to donate their organs and that, since they have irreversibly lost their brain, they cannot be harmed. We put forth an account for when to believe causal and evidential conditionals. The basic idea is to embed a causal model in an agent’s belief state. For the evaluation of conditionals seems to be relative to beliefs about both particular facts and causal relations. Unlike other attempts using causal models, we show that ours can account rather well not only for various causal but also evidential conditionals.

The ontological models framework distinguishes ψ-ontic from ψ-epistemic wave- functions. It is, in general, quite straightforward to categorize the wave-function of a certain quantum theory. Nevertheless, there has been a debate about the ontological status of the wave-function in the statistical interpretation of quantum mechanics: is it ψ-epistemic and incomplete or ψ-ontic and complete? I will argue that the wave- function in this interpretation is best regarded as ψ-ontic and incomplete.

What does it take to understand a phenomenon ideally, or to the highest conceivable extent? In this paper, we answer this question by arguing for five necessary conditions for ideal understanding: (i) representational accuracy, (ii) intelligibility, (iii) truth, (iv) reasonable endorsement, and (v) fitting. Even if one disagrees that there is some form of ideal understanding, these five conditions can be regarded as sufficient conditions for a particularly deep level of understanding. We then argue that grasping, novel predictions, and transparency (...) are not reasonable conditions for ideal understanding. (shrink)

It is generally argued that if the wave-function in the de Broglie–Bohm theory is a physical field, it must be a field in configuration space. Nevertheless, it is possible to interpret the wave-function as a multi-field in three-dimensional space. This approach hasn’t received the attention yet it really deserves. The aim of this paper is threefold: first, we show that the wave-function is naturally and straightforwardly construed as a multi-field; second, we show why this interpretation is superior to other interpretations (...) discussed in the literature; third, we clarify common misconceptions. Deployment Realism resists Laudan’s and Lyons’ objections to the “No Miracle Argument” by arguing that a hypothesis is most probably true when it is deployed essentially in a novel prediction. However, Lyons criticized Psillos’ criterion of essentiality, maintaining that Deployment Realism should be committed to all the actually deployed assumptions. But since many actually deployed assumptions proved false, he concludes that the No Miracle Argument and Deployment Realism fail. I reply that the essentiality condition is required by Occam’s razor. In (...) fact, there is a simpler formulation of essentiality which escapes Lyons’ criticisms and rescues the No Miracle Argument and Deployment Realism from their purported historical counterexamples: a hypothesis is essential when it has no proper parts (in Yablo’s sense) sufficient to derive the same prediction. Although essentiality so conceived cannot be detected prospectively, this is just natural, and it is not a problem but an advantage for Deployment Realism. (shrink)

Much of what has been discussed in the theory of reference in the last twenty-five years is strongly influenced by considerations centring on the business of devising a semantics for quantified modal logic. In this context, discussion of the property of rigidity plays an important role. This property is conceived of as a semantic modal property that distinguishes proper names from descriptions. It is argued that there is a semantic modal asym- metry between expressions of these types. In this talk (...) I shall challenge this assumption. By examining the intuitive Kripkean argument or test employed I arrive at two rather nonconformist results: Firstly, it seems that the test does not establish a genuine semantic asymmetry: Rigidity appears to be a pragmatic property. Secondly, the test does not seem to demonstrate an asymmetry at all: When applied correctly it suggests that both proper names and descriptions (even discounting notorious cases like “the even prime”) can be used rigidly—or so I shall argue. In this dissertation, I address the question of how to construct scientific theories of emotions that are both conceptually sound and empirically fruitful. To do this, I offer an analysis of the main challenges scientific theories of emotions face, and I propose a meta-theoretical framework to construct scientific concepts of emotions as explications of folk emotion concepts. Part I discusses the main challenges theories of emotions in psychology and neuroscience encounter. The first states that a proper scientific theory of emotions (...) must explain all and only the phenomena under the vernacular term ‘emotion’ with a common set of conceptual resources and under an overarching generic concept of emotion. The second demands that each emotion category corresponds to well-coordinated sets of neural, physiological, and behavioral patterns of responses. I argue that none of the best contemporary theories of emotions in psychology and neuroscience overcomes these challenges. As a result, a new theory of emotions is required. In Part II, I develop the meta-theoretical framework to construct a theory of emotions that overcomes the challenges above. First, I propose a pluralistic account of scientific kinds based on different patterns of projection that various disciplines may take to justify inductive inferences. These are essentialist, historical, and social patterns. Each of these patterns provides a framework to construct different types of scientific concepts. I argue that among the frameworks for scientific kinds available, the one that is best suited to explicate emotion concepts is a functional framework. Consequently, I conclude by recommending scientists pursue functionalist theories of emotions over essentialist, historical, or social theories. (shrink)

In the scientific communities most criticisms are constructive, while they are destructive in the humanistic circles. Indeed, scientists circulate their drafts among colleagues and students, hoping to elicit their comments and suggestions before submitting their work to publication. In contrast, philosophers and political thinkers attack their rivals, without sparing arguments ad hominem or even insults. The reason for this difference is that scientists are after the truth, whereas most humanists fight for more or less noble causes, from swelling their own (...) curricula to joining crusades for or against rationality, realism, justice, or what have you. Against certain positivistic and neopositivistic strictures still rooted in our society, Agazzi argues that knowing the invisible is possible, not just in science, but also in metaphysics, in morals, in aesthetics, and in other areas, including, in a sense, religion. The book also examines many examples of such knowledge, surveying not only the great classics of philosophy, but various immortal masterpieces of art, music and literature. It is not just a treatise in epistemology, but a book of philosophy in the (...) most complete and traditional sense, for it discusses knowledge not only for its own sake, but also as a guide to culture, morality, happiness and to the sense of life. Thus, it also provides some important suggestions on how to face our time of crisis and an uncertain future. Despite Agazzi’s proverbial rigor and clarity, his project is so momentous and demanding that I discuss certain points which might deserve further explication and argumentation. (shrink)

When adopting a sound logical system, reasonings made within this system are correct. The situation with reasonings expressed, at least in part, with natural language is much more ambiguous. One way to be certain of the correctness of these reasonings is to provide a logical model of them. To conclude that a reasoning process is correct we need the logical model to be faithful to the reasoning. In this case, the reasoning inherits, so to speak, the correctness of the logical (...) model. There is a weak link in this procedure, which we call the faithfulness problem: how do we decide that the logical model is faithful to the reasoning that it is supposed to model? That is an issue external to logic, and we do not have rigorous formal methods to make the decision. The purpose of this paper is to expose the faithfulness problem (not to solve it). For that purpose, we will consider two examples, one from the geometrical reasoning in Euclid’s Elements and the other from a study on deductive reasoning in the psychology of reasoning. (shrink)

In this paper we will demonstrate that a computational system can meet the criteria for autonomy laid down by classical enactivism. The two criteria that we will focus on are operational closure and structural determinism, and we will show that both can be applied to a basic example of a physically instantiated Turing machine. We will also address the question of precariousness, and briefly suggest that a precarious Turing machine could be designed. Our aim in this paper is to challenge (...) the assumption that computational systems are necessarily heteronomous systems, to try and motivate in enactivism a more nuanced and less rigid conception of computational systems, and to demonstrate to computational theorists that they might find some interesting material within the enactivist tradition, despite its historical hostility towards computationalism. Dicho de un modo directo: si el miedo se presenta como una referencia constitutiva del orden, de su constitución como de su mantenimiento, el pánico parece, en cambio, cargado de un signo contrario; (...) nos habla de la disolución de un agregado dado por supuesto y es inclusivo en el perimetrar los límites y las condiciones de posibilidad. El objetivo es aquel de repasar algunos momentos de la historia del pánico buscando argumentar que el pánico es una pasión política, en el sentido de que se refiere a aquello de lo que la político está hecha, y al mismo tiempo es expresión de un límite "pasional" de la política, en tanto que define políticamente un límite interno. Respecto a tal objetivo, esta aportación no reivindica más que los caracteres de un hilvanado necesitante de un desarrollo ulterior por lo que se refiere no solo a aquello que no se incluye (y es obviamente mucho), sino también a los nudos que de forma conscientemente provisional se indican. Además, se limita a una periodizacion histórica que es de alguna manera preliminar, deteniéndose en el umbral de la fase en la cual el pánico es una palabra de un discurso disciplinar, es parte del objeto de un saber codificado (psicología, sociología, ciencia política), incluso si no desempeña necesariamente un rol apaciguador. Se explora cómo la ciencia ciudadana promueve una mejora epistémica tanto en las instituciones científicas como en la sociedad a gran escala. En este sentido, se ofrece una caracterización de la ciencia ciudadana y a partir de ella se muestra cómo la participación de no especialistas contribuye al fortalecimiento epistémico a través de la pluralidad. Además, se examina cómo la inclusión de miembros de la sociedad en la investigación científica es capaz de promover la mejora epistémica de individuos mediante la (...) formación de pensadores críticos. Las conclusiones indican que la ciencia ciudadana puede optimizar estos dos tipos de mejora epistémica por medio del diseño de proyectos que, aunado a la persecución de objetivos propiamente científicos, se dirijan a la obtención de estos bienes. In this paper we explore Ronald N. Giere’s contributions to the scientific realism debate. After outlining some of his general views on the philosophy of science, we locate his contributions within the traditional scientific realism debate. We argue that Giere’s scientific perspectivism is best seen as a form of carte blanche realism, that is: a view according to which science is a practice aiming at truth, and can warrantably claim to have attained it, to a certain degree; however, it does (...) not place our confidence invariably in some specific feature of scientific representations. En las últimas décadas, las sociedades de cualquier parte del mundo han mostrado una madurez significativa en cuanto a la conciencia del valor de la vida en cualquiera de sus manifestaciones. Sin embargo, las diferentes conductas que nos acercan a dicha conciencia se pueden orientar a un bien común a través de la reflexión, nos aproximan a lo más íntimo de nuestra propia y casi exclusiva naturaleza, el humanismo. Las reflexiones que nos brinda este libro, La medicina en vivo. Cuestiones (...) filosóficas sobre la salud y la enfermedad, son una señal de madurez social que se dirige a uno de los factores clave donde el analista puede ser objeto de su propia experiencia. Favorecer la vida ya sea en su concepción, preservación o en su calidad, son competencia de principios que pueden ser arropados desde la perspectiva de la ética. El binomio salud-enfermedad está íntimamente ligado a la toma de decisiones donde lo correcto o lo incorrecto son conceptos que se vuelcan hacia lo tangible, pero que en ciertas condiciones los límites son muy sutiles y que por tanto son necesario fortalecerlos y definirlos. El análisis profundo presentado en los 13 capítulos que comprende este libro ayuda a definir posturas en un amplio abanico temático de reflexiones muy representativas que van de la mano tanto con normativas actuales, así como con lo más fresco de las ciencias biomédicas. La velocidad tan vertiginosa con que los avances científicos se proyectan rebasa en gran medida sus consideraciones éticas. El perfil de los autores garantiza una calidad y rigurosidad académica en este texto que genera la confianza en la validez de sus análisis. Igualmente, las distintas procedencias geográficas de los colaboradores reflejan las mismas preocupaciones más allá de nuestras fronteras dado su carácter universal. Este libro será de gran utilidad para apoyo en la formación de profesionistas en ciencias de la salud o estudiosos de la filosofía de las ciencias o los cuerpos colegiados como comités de ética o bioética y seguramente se llegará a considerar un buen referente bibliográfico. The aim of this paper is to analyze time-asymmetric quantum mechanics with respect to the problems of irreversibility and of time's arrow. We begin with arguing that both problems are conceptually different. Then, we show that, contrary to a common opinion, the theory's ability to describe irreversible quantum processes is not a consequence of the semigroup evolution laws expressing the non-time-reversal invariance of the theory. Finally, we argue that time-asymmetric quantum mechanics, either in Prigogine's version or in Bohm's version, does (...) not solve the problem of the arrow of time because it does not supply a substantial and theoretically founded criterion for distinguishing between the two directions of time. Background: Several countries have recently changed their model of consent for organ donation from opt-in to opt-out. We undertook a systematic review to determine public knowledge and attitudes towards these models in Europe. Methods: Six databases were explored between 1 January 2008 and 15 December 2017. We selected empirical studies addressing either knowledge or attitudes towards the systems of consent for deceased organ donation by lay people in Europe, including students. Study selection, data extraction, and quality assessment were conducted by (...) two or more reviewers independently. Findings: Awareness of the consent model was lower in opt-out countries than in opt-in countries. A majority of the public agrees with opt-in, regardless of the law in their own country. There are ambivalent attitudes regarding the opt-out system. The public tend to prefer opt-in and mandatory choice over opt-out when several options are offered. Interpretation: The assumption that people in opt-out countries are aware of the legal requirements to be excluded from the pool of potential donors is not supported by the results of this review. This is a concern, since ignorance hinders people's autonomy regarding organ donation decision-making. Higher awareness of consent model in opt-in countries may reflect greater efforts to inform the public through campaigns to motivate donation. Legal moves towards opt-out are at odds with people's expressed preferences. Main limitations of this review are the lack of data from some countries, study population heterogeneity, and methodological shortcomings. (shrink)

This paper investigates the historical origin and ancestors of typicality, which is now a central concept in Boltzmannian Statistical Mechanics and Bohmian Mechanics. Although Ludwig Boltzmann did not use the word typicality, its main idea, namely, that something happens almost always or is valid for almost all cases, plays a crucial role for his explanation of how thermodynamic systems approach equilibrium. At the beginning of the 20th century, the focus on almost always or almost everywhere was fruitful for developing measure (...) theory and probability theory. It was apparently Hugh Everett III who first mentioned typicality in physics in 1957 while searching for a justification of the Born rule in his interpretation of quantum mechanics. The historically closest concept before these developments is moral certainty, which was invented by the medieval French theologian Jean Gerson, and it became a standard concept at least until the Age of Enlightenment, when Jakob Bernoulli proved the Law of Large numbers. This paper explores some aspects of the scientific study of creativity by focusing on intentional attempts to create instances of linguistic humour. We argue that this sort of creativity can be accounted for within an influential cognitive approach but that said framework is not a recipe for producing novel instances of humour and may even preclude them. We start by identifying three great puzzles that arise when trying to pin down the core traits of creativity, and some of the ways (...) taken by Cognitive Studies in this quest. We then consider what we call 'creative humour', which exhibits the core features of the aforesaid creativity. We then explore how a key cognitive approach to human communication can account for creative humour. We end by drawing lessons and highlighting limitations to cognitive approaches to creativity. Philosophy is sometimes perceived as an abstract and nerdy discipline dealing with problems of its own creation in an isolated chamber of the Ivory Tower. And there is some truth to this view. But philosophy can help us deal with common problems, such as the disagreements we have in our everyday lives.

We argue that the asymmetry between diverging and converging electromagnetic waves is just one of many asymmetries in observed phenomena that can be explained by a past hypothesis and statistical postulate (together assigning probabilities to different states of matter and field in the early universe). The arrow of electromagnetic radiation is thus absorbed into a broader account of temporal asymmetries in nature. We give an accessible introduction to the problem of explaining the arrow of radiation and compare our preferred strategy (...) for explaining the arrow to three alternatives: (i) modifying the laws of electromagnetism by adding a radiation condition requiring that electromagnetic fields always be attributable to past sources, (ii) removing electromagnetic fields and having particles interact directly with one another through retarded action-at-a-distance, (iii) adopting the Wheeler-Feynman approach and having particles interact directly through half-retarded half-advanced action-at-a-distance. In addition to the asymmetry between diverging and converging waves, we also consider the related asymmetry of radiation reaction. (shrink)

In legal proceedings, a fact-finder needs to decide whether a defendant is guilty or not based on probabilistic evidence. We defend the thesis that the defendant should be found guilty just in case it is rational for the fact-finder to believe that the defendant is guilty. We draw on Leitgeb’s stability theory for an appropriate notion of rational belief and show how our thesis solves the problem of statistical evidence. Finally, we defend our account of legal proof against challenges from (...) Staffel and compare it to a recent competitor put forth by Moss. (shrink)

I confront Feyerabend's position and critical rationalism in order to have a foundation or starting point for my (historical) investigation. The main difference of his position towards falsificationism is the belief that different theories cannot be discussed rationally. Feyerabend is convinced that Galilei's observations with the telescope in the historical context of the Copernican revolution supports his criticism. In particular, he argues that the Copernican theory was supported by deficient hypotheses, and falsifications were disposed by ad hoc hypotheses and propaganda. (...) Furthermore, he claims that his philosophy of science reconstructs Galilei's defence of the Copernican theory. He introduces a central principle of his position (the principle of tenacity) in order to justify a research strategy of not eliminating falsified theories. He tries to show that the tenacious defence of a theory corresponds to Galilei's defence of the Copernican theory. Remarkably, Feyerabend's approach to explain the development of science earns an important support from his interpretation of Galilei's observations. On this basis I give a falsificationist interpretation of Galilei's observations with the telescope, and oppose this interpretation to Feyerabend's. From a falsificationist perspective, auxiliary hypotheses compete during the Copernican revolution which can (with some effort) be critically discussed. Then I analyse the historical case in order to test Feyerabend's interpretation of the Copernican revolution. Inter alias I investigate thoroughly whether Galilei, as Feyerabend claims, immunised falsifications of the Copernican theory by the introduction of ad hoc hypotheses. The investigation considers Galilei's explanation of Venus' phases, his establishment of the irradiation hypothesis, the explanation of the telescope's functionality, and the role of the reproducibility of the observations with the telescope. Finally I provide a rational reconstruction of Galilei's falsification of the Ptolemaic theory. The formalisation shows that Galilei was not a cautious critical rationalist, but a very confident scientist using the method of falsification. (shrink)

Sostenim que aquest tipus de creativitat pot explicar-se dins d'un enfocament cognitiu influent, però que aquest marc no és una recepta per a produir exemples nous d'humor i fins i tot pot evitar-los. Començarem identificant tres grans (...) problemes que sorgeixen en tractar de precisar els trets centrals de la creativitat i algunes de les formes adoptades pels estudis cognitius en aquesta cerca. Després considerarem què anomenem «humor creatiu», que exhibeix les característiques centrals de la creativitat abans esmentada. Després investigarem com un enfocament cognitiu clau per a la comunicació humana pot explicar l'humor creatiu. Alireza Bagheri supports a policy on organ procurement where individuals could choose their own definition of death between two or more socially accepted alternatives. First, we claim that such a policy, without any criterion to distinguish accepted from acceptable definitions, easily leads to the slippery slope that Bagheri tries to avoid. Second, we suggest that a public discussion about the circumstances under which the dead donor rule could be violated is more productive of social trust than constantly moving the line (...) between life and death. There is not much of a consensus on almost anything about quantum mechanics. I take it, however, that the minimum consensus is that "although quantum mechanics is empirically successful, quantum mechanics is hard to understand." Quantum mechanics, in the way it is presented in most textbooks, does indeed not provide a clear picture of reality that would make it a theory to be understood. In her new book, "The World in the Wave Function: A Metaphysics for Quantum Physics," Alyssa Ney (...) tries to make this blurry picture of reality more precise, even if this picture will turn out to be heterodox and unfamiliar. This article deals with the most relevant philosophical side of Albert the Great’s analysis of alchemy, aimed at clarifying what alchemical transmutation consists in and whether this process can ultimately be accomplished by men. The Dominican master handles the problem differently in the earlier commentary on Lombardus’ Libri Sententiarum and in works like the De mineralibus, in which a more mature idea of the connection between art and nature is developed. In this respect, Albert’s interpretation intersects with Avicenna’s De congelatione, (...) a fundamental text for the Latin medieval debate on alchemy, whose reception has shaped his understanding of the alchemical art. The Dominican master gradually assumes a more lenient position towards the claims of the alchemical process of transmutation, which he explains by resorting to the similitudes between alchemy and medicine and the comparison of artificial transmutation with natural processes such as the generatio ex putrefactione and the natural formation of minerals. A re-evaluation of the notion of vacuum in quantum electrodynamics is presented, focusing on the vacuum of the quantized electromagnetic field. In contrast to the ‘nothingness’ associated to the idea of classical vacuum, subtle aspects are found in relation to the vacuum of the quantized electromagnetic field both at theoretical and experimental levels. These are not the usually called vacuum effects. The view defended here is that the so-called vacuum effects are not due to the ground state of the quantized (...) electromagnetic field. Nevertheless it is possible to maintain an empirically demonstrable notion of vacuum state that is consistent with the interpretation of the formalism of the theory. (shrink)

Abstract We examine the construction of electromagnetism in its current form, and in an alternative form, from a point of view that combines a minimal realism with strict rational demands. We begin by discussing the requests of reason when constructing a theory and next, we follow the historical development as presented in the record of original publications, the underlying epistemology (often explained by the authors) and the mathematical constructions. The historical construction develops along socio-political disputes (mainly, the reunification of Germany (...) and the second industrial revolution), epistemic disputes (at least two demarcations of science in conflict) and several theories of electromagnetism. Such disputes resulted in the militant adoption of the ether by some, a position that expanded in parallel with the expansion of Prussia. This way of thinking was facilitated by the earlier adoption of a standpoint that required, as a condition for understanding, the use of physical hypothesis in the form of analogies; an attitude that is antithetic to Newton's “hypotheses non fingo”. While the material ether was finally abandoned, the epistemology survived in the form of “substantialism” and a metaphysical ether: the space. The militants of the ether attributed certainties regarding the ether to Faraday and Maxwell, when they only expressed doubts and curiosity. Thus, the official story is not the real history. This was achieved by the operation of detaching Maxwell's electromagnetism from its construction and introducing a new game of formulae and interpretations. Large and important parts of Maxwell work are today not known, as for example, the rules for the transformation of the electromagnetic potentials between moving systems. When experiments showed that all the theories based in the material ether were incorrect, a new interpretation was offered: Special Relativity (SR). At the end of the transformation period a pragmatic view of science, well adapted to the industrial society, had emerged, as well as a new protagonist: the theoretical physicist. The rival theory of delayed action at distance initiated under the influence of Gauss was forgotten in the midst of the intellectual warfare. The theory is indistinguishable in formulae from Maxwell's and its earlier versions are the departing point of Maxwell for the construction of his equations. We show in a mathematical appendix that such (relational) theory can incorporate Lorentz' contributions as well as Maxwell's transformations and C. Neumann's action, without resource to the ether. Demarcation criteria was further changed at the end of the period making room for habits and intuitions. When these intuited criteria are examined by critical reason (seeking for the fundaments) they can be sharpened with the use of the Non Arbitrariness Principle, which throws light over the arbitrariness in the construction of SR. Under a fully rational view SR is not acceptable, it requires to adopt a less demanding epistemology that detaches the concept from the conception, such as Einstein's own view in this respect, inherited from Hertz. In conclusion: we have shown in this relevant exercise how the reality we accept depends on earlier, irrational, decisions that are not offered for examination but rather are inherited from the culture. Objectives To increase postmortem organ donation rates, several countries are adopting an opt-out (presumed consent) policy, meaning that individuals are deemed donors unless they expressly refused so. Although opt-out countries tend to have higher donation rates, there is no conclusive evidence that this is caused by the policy itself. The main objective of this study is to better assess the direct impact of consent policy defaults per se on deceased organ recovery rates when considering the role of the family in (...) the decision-making process. This study does not take into account any indirect effects of defaults, such as potential psychological and behavioural effects on individuals and their relatives. -/- Design Based on previous work regarding consent policies, we created a conceptual model of the decision-making process for deceased organ recovery that included any scenario that could be directly influenced by opt-in or opt-out policies. We then applied this model to internationally published data of the consent process to determine how frequently policy defaults could apply. -/- Main outcome measures We measure the direct impact that opt-in and opt-out policies have per se on deceased organ recovery. -/- Results Our analysis shows that opt-in and opt-out have strictly identical outcomes in eight out of nine situations. They only differ when neither the deceased nor the family have expressed a preference and defaults therefore apply. The direct impact of consent policy defaults is typically circumscribed to a range of 0%–5% of all opportunities for organ recovery. Our study also shows that the intervention of the family improves organ retrieval under opt-in but hinders it under opt-out. -/- Conclusions This study may warn policy makers that, by emphasising the need to introduce presumed consent to increase organ recovery rates, they might be overestimating the influence of the default and underestimating the power granted to families. The reception of the translations of Aristotelian and pseudo-Aristotelian works at the University of Paris in the thirteenth century promoted a new understanding of the sciences as specialized fields of knowledge. The huge amount of translations required a new organization of knowledge, which included novel subjects and categories. Among these there is a very special case, namely the pseudo-Aristotelian De plantis, translated from Arabic into Latin and then back into Greek to be re-translated into Latin again. De plantis was included (...) in the new curriculum in Ripoll 109, and constituted the main source for botanical studies until the sixteenth century. Throughout this paper we will explore the reception and impact of De plantis in both the Arabic and the Latin traditions. We aim to show its foundational role in the development of botany as a theoretical discipline within the natural sciences. (shrink)

In this paper, we propose a regularity theory of causation. The theory aims to be reductive and to align with our pre‐theoretic understanding of the causal relation. We show that our theory can account for a wide range of causal scenarios, including isomorphic scenarios, omissions, and scenarios which suggest that causation is not transitive.

This paper analyses the arguments for and against what we have called automatic organ procurement model in relation to the organs of the deceased. For this purpose, this work provides empirical evidence to assess the potential impact of this model on donation rates and on public opinion. Specifically, we examine first the reasons supporting this model, with special reference to utilitarian and justice arguments. On the other hand, we analyse both the approaches based on the violation of pre mortem and (...) post mortem interests opposing this theoretical model and the rejection the model would generate in the population. Finally, we point out the aspects that, in our opinion, should be exhaustively regulated if this model were implemented. In particular, we refer to the legal status of the human body, the treatments for end-of-life patients, the incentives for health professionals and the recognition of the right to conscientious objection. This paper has a twofold aim. On the one hand, we will discuss the much debated question of the source of normativity (which traditionally has nature and practical reason as the two main contenders to this role) and propose a new answer to it. Second, in answering this question, we will present a new account of practical wisdom, which conceives of the ethical virtues as ultimately unified in the chief virtue of phronesis, understood as ethical expertise. To do so, we (...) will first criticize the main current view of phronesis and its bearer (the phronimos), then offer another view of the nature of phronesis and of its relation to the other ethical virtues. Our proposal should not be intended as an interpretation of Aristotle’s own view; rather, it should be seen as a broadly Aristotelian theoretical proposal, which we believe can satisfyingly address most of the problems that afflict the more traditional accounts of practical wisdom. In section 2 of this paper, after criticizing first-nature naturalistic views of moral virtue, we take practical reason to be the cornerstone of second-nature naturalistic views; in section 3, we will outline criticisms to which, in our view, the traditional views of phronesis are ill-suited to respond, and, in section 4, we will outline our view of phronesis as ethical expertise – a view which in our view is immune to the above-mentioned criticisms – by spelling out the three main tenets of phronesis as ethical expertise: a conceptual thesis, an epistemic thesis, and the educational implications of the two. Finally, we will support our proposal with some empirical evidence taken from cognitive science. (shrink)
