Background Consent policies for post-mortem organ procurement (OP) vary throughout Europe, and yet no studies have empirically evaluated the ethical implications of contrasting consent models. To fill this gap, we introduce a novel indicator of governance quality based on the ideal of informed support, and examine national differences on this measure through a quantitative survey of OP policy informedness and preferences in seven European countries. -/- Methods Between 2017–2019, we conducted a convenience sample survey of students (n = 2006) in (...) Austria (AT), Belgium (BE), Denmark (DK), Germany (DE), Greece (GR), Slovenia (SI) and Spain (ES), asking participants about their donation preferences, as well as their beliefs and views about the policy in place. From these measures, we computed indices of informedness, policy support, and fulfilment of unexpressed preferences, which we compared across countries and consent systems. -/- Results Our study introduces a tool for analyzing policy governance in the context of OP. Wide variation in policy awareness was observed: Most respondents in DK, DE, AT and BE correctly identified the policy in place, while those in SI, GR and ES did not. Respondents in opt-out countries (AT, BE, ES and GR) tended to support the policy in place (with one exception, i.e., SI), whereas those in opt-in countries (DE and DK) overwhelmingly opposed it. These results reveal stark differences in governance quality across countries and consent policies: We found a preponderance of informed opposition in opt-in countries and a general tendency towards support–either informed or uninformed–in opt-out countries. We also found informed divergence in opt-in countries and a tendency for convergence–either informed or uninformed–among opt-out countries. -/- Conclusion Our study offers a novel tool for analyzing governance quality and illustrates, in the context of OP, how the strengths and weaknesses of different policy implementations can be estimated and compared using quantitative survey data. In this chapter I shall reply to a pair of articles in which the main contention of my “Why truthmakers” – namely, that an important class of synthetic true propositions have entities as truth-makers – is rejected. In §§1–5 I reply to Jennifer Hornsby’s “Truth without Truthmaking Entities” (2005) and in §§6–7 I reply to Julian Dodd’s “Negative Truths and Truthmaker Principles” (2007).

En el presente artículo se abordarán los aportes realizados por Gramsci en la construcción de la figura del intelectual. Para ello, se caracterizarán los rasgos distintivos del determinismo histórico marxista, para luego enfocarnos en el pensamiento gramsciano. A partir de allí nos centraremos de manera expresa en los argumentos desplegados por Gramsci al procurarle una función activa a la figura del intelectual, en tanto intelectual colectivo que se va conformando encarnado en el partido revolucionario de la clase obrera. De esta (...) manera, plantearemos que esta disposición del intelectual colectivo se enlaza con los problemas de la vida social en la búsqueda de unificar teoría y praxis, y pretende crear así una nueva hegemonía, puesto que admite la indeterminabilidad de la historia según leyes. Marx says of alienated labor that it does not “belong” to the worker, that it issues in a product that does not belong to her, and that it is unfulfilling, unfree, egoistically motivated, and inhuman. He seems to think, moreover, that the first of these features grounds all the others. All of these features seem quite independent, however: they can come apart; they share no obvious common cause or explanation; and if they often occur together, this seems accidental. It is (...) not clear, then, how Marx’s concept of alienated labor could possess the strong unity that he takes it to have. This article defends a reinterpretation of the concept that explains this unity. The various features of alienated labor, the article argues, all follow from a single, hitherto underappreciated feature of its formal motivational structure: the fact that such labor is motivated not by its product but by an incentive. In the 1750s Optimism, the Leibnizian doctrine that the actual world is the best possible world, popularised by Pope in 1733 in his Essay on Man, was a hot topic. In 1759 Kant wrote and published a brief essay defending Optimism, Attempt at some Reflections on Optimism. Kant’s aim in this essay is to establish that there is one and only one best possible world. In particular, he argues against the claim that, for every possible world, there is a possible (...) world better than it and against the claim that there are two or more equally good possible worlds that are better than all the rest. Although it is not clear why, Kant was later dissatisfied with his essay. In this article I shall reconstruct, discuss, and evaluate Kant’s arguments. My evaluation will be negative, and so I think Kant had reasons to be dissatisfied with his essay. (shrink)

Dialogamos con Cintia Rodríguez Garat, quien obtuvo el Primer Premio Bioética 2023 de la Fundación Jaime Roca por su trabajo “Resiliencia y salud pública de las mujeres mapuce ante el cambio climático. Un análisis desde una perspectiva intercultural, participativa y de derechos humanos”.

Este trabajo se propone documentar y reflexionar sobre la utilización de herramientas pedagógico-didácticas en tiempos de SAR-COV-2 desde el espacio de la Práctica Docente de los Institutos de Formación Docente del Distrito 040-General Madariaga, provincia de Buenos Aires (ISFD N°169; ISFDyT N°59). Motiva la investigación que existen pocos trabajos empíricos que documenten las experiencias de la práctica docente en esta zona y en este contexto sanitario. Desde una perspectiva crítica se dará cuenta de las concepciones, utilización de herramientas y estrategias (...) que se ponen en juego desde las prácticas y residencia de los Profesorados de Inicial y Primaria, durante la pandemia mencionada. Se trata de una investigación cualitativa, exploratoria. Como resultados principales se abordarán la resignificación de distintas herramientas pedagógico-didácticas, como las videollamadas; la organización de contenidos mediante Classroom, Plataformas digitales y el dictado de clases por canales de YouTube. La finalidad es subrayar como común denominador la búsqueda de alternativas de interacción gratuitas, por parte de las docentes que, en casi la totalidad de los casos, tuvieron que garantizar la continuidad pedagógica mediante la propia construcción de dichos canales de comunicación. Consider a certain red rose. The proposition that the rose is red is true because the rose is red. One might say as well that the proposition that the rose is red is made true by the rose’s being red. This, it has been thought, does not commit one to a truthmaker of the proposition that the rose is red. For there is no entity that makes the proposition true. What makes it true is how the rose is, and how (...) the rose is is not an entity over and above the rose. It is against this view that I shall argue in this paper. I shall argue that a significant class of true propositions, including inessential predications like the proposition that the rose is red, are made true by entities. "No truthmaking without truthmakers" is my slogan. Although I have my view about what kinds of entities are truthmakers, I shall not argue for or presuppose that view here. All I shall argue for here is that if a proposition is made true by something, it is made true by some thing, but my argument will leave it open what kind of thing that thing is: it could be a fact or state of affairs, a trope, or any other sort of entity. 1. The Bundle Theory I shall discuss is a theory about the nature of substances or concrete particulars, like apples, chairs, atoms, stars and people. The point of the Bundle Theory is to avoid undesirable entities like substrata that allegedly constitute particulars. The version of the Bundle Theory I shall discuss takes particulars to be entirely constituted by the universals they instantiate.' Thus particulars are said to be just bundles of universals. Together with the claim that it is necessary that (...) particulars have constituents, the fundamental claim of the Bundle Theory is: (BT) Necessarily, for every particular x and every entity y, y constitutes x if and only ify is a universal and x instantiates y. 2 The standard and supposedly devastating objection to the Bundle Theory is that it entails or is committed to a false version of the Principle of Identity of Indiscernibles (Armstrong 1978: 91, Loux 1998: 107), namely: (Pll) Necessarily, for all particulars x and y and every universal z, if z is instantiated by x if and only if z is instantiated byy, then x is numerically identical with y. The most famous counterexample to the Identity of Indiscernibles is that put forward by Max Black, consisting of a world where there are only two iron spheres two miles apart from each other, having the same diameter, temperature, colour, shape, size, etc (Black 1952: 156). Let us from now on think of the properties of the spheres in this world as universals. The possibility of this world, which I shall hereafter refer to as 'Black's world', makes (Pll) false.' And according to common philosophical opinion this means that the Bundle Theory is false.. (shrink)

Thick terms and concepts, such as honesty and cruelty, are at the heart of a variety of debates in philosophy of language and metaethics. Central to these debates is the question of how the descriptive and evaluative components of thick concepts are related and whether they can be separated from each other. So far, no empirical data on how thick terms are used in ordinary language has been collected to inform these debates. In this paper, we present the first empirical (...) study, designed to investigate whether the evaluative component of thick concepts is communicated as part of the semantic meaning or by means of conversational implicatures. While neither the semantic nor the pragmatic view can fully account for the use of thick terms in ordinary language, our results do favour the semanticist interpretation: the evaluation of a thick concept is only slightly easier to cancel than semantically entailed content. We further discovered a polarity effect, demonstrating that how easily an evaluation can be cancelled depends on whether the thick term is of positive or negative polarity. (shrink)

En el presente artículo se abordarán los aportes de Nietzsche, Freud y Marx, como fundadores de discurso, desde la perspectiva foucaultiana. Para ello, se trabajará con la ponencia "Nietzsche, Freud y Marx" realizada por Foucault en 1964. Foucault condensa en esta ponencia una obra que resulta muy rica, debido a que sintetiza de manera clara los aportes realizados por los "maestros de la sospecha". La riqueza de la obra radica en que expone un giro en las técnicas de la interpretación (...) que permite comprender a la hermenéutica, lejos del descifrado oculto de signos, como una estrategia de producción de nuevos símbolos, en la creación de nuevos imaginarios que construyen diversos y variados sentidos (Grüner, 1995: 11). De esta manera, en el presente escrito se planteará un acercamiento al empleo de las técnicas interpretativas que han llevado a cabo Nietzsche, Freud y Marx, como una forma de acceder a la hermenéutica de la sospecha propuesta por este trío. Para el desarrollo de esta propuesta partiremos de la caracterización general de los tres fundadores de discurso, para puntualizar en la impronta propia de la hermenéutica de cada uno. (shrink)

I argue that rather than dismiss Foucault’s first book, Mental Illness and Personality, as an “apologetic exposition of Pavlov’s reflexology,” we ought see it as a valuable source documenting Foucault’s change of attitude towards psychology and the history of science in the early 1950s. I argue that there are two distinguishable strands that make up the text. The ‘frame’ of the book—the introduction, first chapter of the second part and conclusion of the book—is expressive of a critical attitude towards psychology, (...) and indicative of rather sophisticated conception of the history of science as a critical history aimed at bringing into view the unscientific forces that shape scientific labor. The ‘main body’ of the text—the first part and the second chapter of the second part—by contrast, reads as the history of the steady dialectical progress of the psychological sciences towards an ever more accurate understanding of mental illness. It is thus indicative to a naïve approach to psychology and to its history. The tension between the two strands of the book thus documents the starting point of Foucault’s then shifting attitudes toward the psychological sciences and the history of science, and the set of questions and sources that lead him to problematize his understanding of and approach to the latter. Bertrand Russell argued that any attempt to get rid of universals in favor of resemblances fails. He argued that no resemblance theory could avoid postulating a universal of resemblance without falling prey to a vicious infinite regress. He added that admitting such a universal of resemblance made it pointless to avoid other universals. In this paper I defend resemblance nominalism from both of Russell's points by arguing that (a) resemblance nominalism can avoid the postulation of a universal of resemblance without (...) falling into a vicious infinite regress, and (b) even if resemblance nominalism had to admit a universal of resemblance, this would not make it pointless to avoid postulating other universals. ¿Cómo es posible encontrar una constante en una obra que tiene en la ruptura su principal argumento? Una primera línea se puede percibir en el trabajo de Žižek sobre una política del goce cuya trayectoria circula desde el deseo a la pulsión. Desde una investigación muy orientada en el problema del sujeto, en el carácter sintomático del mismo, Žižek se ha desplazado hacia un análisis de la relación entre el objeto a y la pulsión en el marco del capitalismo actual. (...) En conexión con esta problemática se encuentra una segunda línea que tiene como punto central el trabajo crítico sobre las relaciones entre economía y política; frente al desafío que supone hoy en día la circulación espontánea del capital y el abandono del ámbito económico por parte de la teoría política. Por un lado nos encontramos con los dos sentidos del término escatología, el económico y el teológico-político, que convergen en la noción de exceso, sea de la pulsión o sea del objeto a. Al mismo tiempo, Žižek considera que no es posible traducir la atención sobre el exceso capitalista y su propia revolución inmanente en términos de dominación política.Ambas secuencias se encuentran, en definitiva, íntimamente vinculadas en la crítica de la economía política del discurso que Žižek lleva a cabo. La introducción del término paralaje puede servir como alternativa para entender la oscilación permanente que se produce en su obra entre síntoma y escatología. Una opción para leer a Žižek en función de sus incesantes desplazamientos, comenzando por el más fundamental: la paralaje entre lectura y escritura. (shrink)

Is it tautological to call an action "wrongful discrimination?" Some philosophers and political theorists answer this question in the affirmative and claim that the term "discrimination" is intrinsically evaluative. Others agree that "discrimination" usually conveys the action’s moral wrongness but claim that the term can be used in a purely descriptive way. In this paper, we present two corpus studies and two experiments designed to test whether the folk concept of discrimination is evaluative. We demonstrate that the term has undergone (...) a historical development and is nowadays no longer used purely descriptively. Further, we show that this evaluation cannot be cancelled without yielding a contradiction. We conclude that the descriptive use of "discriminatory" is a thing of the past. (shrink)

El artículo analiza el papel del resentimiento en la Teoría de los sentimientos morales de Adam Smith y su conexión con el proceso de la simpatía mutua por medio del cual el “espectador imparcial” asume plenamente el resentimiento de la víctima, al considerar que su pasión se rige por los principios de la propiedad y la justicia. Se sostiene que el resentimiento no solo cumple un rol central en la teoría del castigo de Adam Smith, en la medida en que (...) permite retribuir, disuadir y rehabilitar al victimario sino que, además, aporta a la discusión contemporánea sobre el perdón y la reconciliación, pues convoca la posibilidad de superar el resentimiento y restablecer las relaciones sociales entre el agresor y la víctima. Resemblance Nominalism is the view that denies universals and tropes and claims that what makes F-things F is their resemblances. A famous argument against Resemblance Nominalism is Russell's regress of resemblances, according to which the resemblance nominalist falls into a vicious infinite regress. Aristocratic Resemblance Nominalism, as opposed to Egalitarian Resemblance Nominalism, is the version of Resemblance Nominalism that claims that what makes F-things F is that they resemble the F-paradigms. Since 1968, the irreversible loss of functioning of the whole brain, called brain death, is assimilated to individual’s death. The almost universal acceptance of this neurological criterion of death had decisive consequences for the contemporary medicine, such as the withdrawal of mechanical ventilation in these patients and organ retrieval for transplantation. The new criterion was successfully accepted in part because the assimilation of brain death state to death was presented by medicine --and acritically assumed by most of societies-- as a (...) scientific and objective fact. Nevertheless, many people do not think that the patients suffering brain death are actually dead. We show here that those people are not necessarily wrong. It can be argued that, in fact, the justification of the neurological criterion is not scientific but moral. We outline the thesis that the problem surrounding the vital status of brain dead patients is due to a confusion between factual and normative questions. Furthermore, we claim that the donation of organs and the withdrawal of life-support could be ethically acceptable even if the patients suffering brain death are considered as alive. As an alternative to the dead donor rule, we propose a justification for organ donation of brain-dead patients based on the (moral) concepts of harm and consent : what truly justifies the procurement of organs on those patients is not that they are dead, but that they wish to donate their organs and that, since they have irreversibly lost their brain, they cannot be harmed. In der Kritik der Urteilskraft vertritt Kant noch die analogische Beziehung zwischen Schönheit und Sittlichkeit (KU, AA 05: 351–354). Aber wir befinden uns hier in einem ganz anderen Zusammenhang. Und dies nicht nur, weil die Erörterung dieser analogischen Beziehung eine Lösung für das Problem der Verknüpfung zwischen theoretischer und praktischer Vernunft beansprucht. Die Reflexionen in den Vorlesungen über Anthropologie über die pragmatische Dimension des Geschmacks setzten die Möglichkeit dieser Verknüpfung bereits voraus, bevor Kant eine kritische Begründung derselben erreichte. Wir dürfen (...) aber diese Reflexionen nicht als das Ergebnis unreifer Versuche zur Lösung dieses kritischen Problems der Rationalitätstheorie Kants deuten. Während der Paragraph 59 der Kritik der Urteilskraft Teil der spekulativen Philosophie ist, wird die Kritik des Geschmacks in den Vorlesungen über Anthropologie vielmehr insofern sinnvoll, da sie zu einem pragmatischen, populären und aufgeklärten Bildungsprogramm der Anthropologie Kants gehört. Mellor´s theory of causation has two components, one according to which causes raise their effects´ chances, and one according to which causation links facts. I argue that these two components are not independent from each other and, in particular, that Mellor´s thesis that causation links facts requires his thesis that causes raise their effects´ chances, since without the latter thesis Mellor cannot stop the slingshot argument, an argument that is a threat to any theory postulating facts as the relata of (...) causation. La Inteligencia Artificial (IA) ha supuesto un gran avance para la humanidad en diversos campos; sin embargo, eso no implica que su actividad esté exenta de reflexión ética. La humanidad está enfrentado, y va a enfrentar en el futuro, numerosos desafíos que van a obligar a elaborar nuevas ideas para poder vivir a la altura de los tiempos. Entre esos desafíos encontramos el laboral y económico, el de mejoramiento humano, el militar y de seguridad y el político y jurídico, entre (...) otros. Así pues, una vez considerados los desafíos en el terreno de la IA, una referencia ética que puede servir para enfrentar dichos desafíos, puede ser el principio de responsabilidad de Hans Jonas. La lectura de este aporte ético puede facilitarnos unas primeras coordenadas para la orientación en medio de un horizonte de posibilidades nuevo para la humanidad y, adicionalmente, servir como punto de partida en el compromiso que deben asumir los diferentes saberes implicados en este novedoso campo. In this paper I present what I call the 'Metaphysical Problem of Truth', which consists in explaining in virtue of what all true sentences are true, and argue that a version of the Correspondence Theory of Truth is the most plausible solution to this problem.

This contribution aims to give an overview of the historical context of neutrino physics. I will present the strong social trends that shaped physics and the way physicists worked, along the 20th century. First, we will see the background of the birth of nuclear physics in the interwar period. Then, we will examine the deep implications the Second World War had, to conclude with the specificities of post-war years for nuclear and particle physics.

Aunque no es posible ofrecer aquí un análisis detallado de las diferentes cues tionesimplicadas en la teoría de las representaciones en la Modernidad, sí pode mos atender auno de sus aspectos más relevantes, presente en la exposición de Leibniz, Wolff,Baumgarten y Kant, a saber: el reconocimiento progresivo y la vin dicación de unconocimiento específicamente sensible como un tipo específico de conocimiento en lafilosofía escolar alemana del siglo XVIII. A pesar de que Leibniz atribuye al conocimiento claro y confuso el grado (...) más bajo en su esquema de los niveles del conocimiento, tambiénes cierto que su exposición apunta ya a la irre ductibilidad de este ámbito en unconocimiento finito como el humano. Por lo demás, lo confuso aquí adquiere sentido en elsistema del saber en la medida en que Leibniz considera que todos los conocimientos obre cuestiones de hecho, si bien falibles, se encuentran en conexión con la verdad en lamedida en que parti cipan de la misma, al expresar el fundamento último de lo real y sersusceptibles de perfectibilidad en el seno de una subjetividad dinámica que comienza aser entendida como unidad vital. En Wolff y Baumgarten se profundiza en la vía que esabierta ya por Leibniz: la exposición de los niveles de conocimiento en el marco de unaimbricación de la lógica de la representación con una psicología vitalista, en la que sereconocerá la experiencia del sentimiento como expresión subjetiva de la perfectibilidaddel conocimiento humano. Aunque la filosofía de Kant supondrá una ruptura con laexposición escolar de esta teoría de los niveles de conocimiento o los tipos derepresentación, lo cierto es que el nacimiento de su teoría de la sensi bilidad tiene lugar enel marco histórico de esta concepción tradicional. This article will address the considerations that must be examined in the design of public policies and government programs to achieve an intercultural approach to the health of the Pu Mapuce Zomo (Mapuce women). In this sense, the proposed objective is to formulate three essential aspects that serve as a basis to promote adequate frameworks for public health policies oriented towards an intercultural approach. For this, methodologically, from a qualitative approach, the ethical, gender(s) and epistemic aspects that must be considered (...) in the configuration of health programs that favor the health care of indigenous women will be investigated. With this purpose, it begins by delimiting the unavoidable ethical-normative and gender approach to highlight the basic needs of Mapuce women. This approach seeks to establish a parameter about the obligations that States have in relation to the development of human capabilities. Finally, three aspects will be presented that the State must replicate in its health proposals to guarantee the construction of an intercultural approach to health, appropriate to the basic needs of Mapuce women in Argentina. Evolutionary adaptation has been suggested as the hallmark of life that best accounts for life’s creativity. However, current evolutionary approaches still fail to give an adequate account of it, even if they are able to explain both the origin of novelties and the proliferation of certain traits in a population. Although modern-synthesis Darwinism is today usually appraised as too narrow a position to cope with all the complexities of developmental and structural biology—not to say biosemiotic phenomena—, Darwinism need not be (...) if we separate metaphor from reality in natural selection in order to show the axiological complexity of this concept. This can shed light on the relationship between biosemiotics and biological evolution. (shrink)

According to one of Leibniz's theories of contingency a proposition is contingent if and only if it cannot be proved in a finite number of steps. It has been argued that this faces the Problem of Lucky Proof , namely that we could begin by analysing the concept ‘Peter’ by saying that ‘Peter is a denier of Christ and …’, thereby having proved the proposition ‘Peter denies Christ’ in a finite number of steps. It also faces a more general but (...) related problem that we dub the Problem of Guaranteed Proof . We argue that Leibniz has an answer to these problems since for him one has not proved that ‘Peter denies Christ’ unless one has also proved that ‘Peter’ is a consistent concept, an impossible task since it requires the full decomposition of the infinite concept ‘Peter’. We defend this view from objections found in the literature and maintain that for Leibniz all truths about created individual beings are contingent. (shrink)

En el presente trabajo reflexionamos en torno a una serie de textos en los que Michel Foucault se pregunta por estatuto de la crítica. La cuestión nos parece volverse reflexivamente sobre el propio Foucualt y por ello intentaremos evaluar de qué manera, con sus propios recursos conceptuales, se puede determinar el estatuto de su propio discurso. Para ello recorreremos dos caminos: (i) su rechazo de la noción de ideología que lo pone en tensión con algunas de las tradiciones mayores del (...) pensamiento crítico. La cuestión es aquí: ¿cómo es posible la crítica sin la ideología y sin la verdad?; (ii) la recuperación foucaultiana de la actitud crítica (en los textos sobre Kant y la pregunta Was ist Aufklärung?). A partir de allí Foucault recupera la problemática de la modernidad en términos de una “ontología histórica del presente”. Ambos caminos se cruzan, ya que las observaciones sobre una “política de la verdad” (lo otro de la crítica de la ideología comprometida con una verdad aséptica) se refuerzan con las de la cuestión del gobierno en términos de una “inservidumbre voluntaria”. En ambos casos, la práctica de la crítica, que subjetiviza desujetando, plantea la cuestión de la libertad. -/- We analyze Michel Foucault’s question for the status of critique and its reflexive return over Foucault himself: How Foucault’s discourse, qua critique, should be understood? We will drive two paths: (i) the refusal of the notion of ideology, where the question is: How to think of critique without ideology and truth?; (ii) the Foucauldian recovery of the “critical attitude” (in the texts on Kant’s answer to the question Was ist Aufklärung?) and of the problem of modernity, along the lines of a “historical ontology of the present”. There is a crossroad of (i) and (ii), since the remarks on a “politics of truth” (as opposite to an “ideology critique” committed with an aseptic truth) reinforces mutually with the problem of the government, faced along the lines of an art of the “voluntary inservitude”. Ageing brings together biological, personal, and social horizons. Attempts to reduce it or to privilege one of these dimensions over the others fail to fully capture the phenomenon. The temporality of ageing presents an irreducible complexity. It is the inextricable intertwinement of three temporalities, three rhythms on different scales: biological time, personal-narrative time, and historical time. In all these dimensions something is of crucial concern: time and temporality. Yet, many philosophers who have thought about time (even those who take seriously (...) the lived experience of temporality) have paid little attention to ageing. Drawing from Heidegger, Scheler, and Schutz, this paper argues that ageing is an irreducible complex of different temporalities where one encounters the historicity of the world through a process of losing touch with it. En The paradox of Addition and its dissolution (1969), Mario Bunge presenta algunos argumentos para mostrar que la Regla de Adición puede ocasionar paradojas o problemas semánticos. Posteriormente, Margáin (1972) y Robles (1976) mostraron que las afirmaciones de Bunge son insostenibles, al menos desde el punto de vista de la lógica clásica. Aunque estamos de acuerdo con las críticas de Margáin y Robles, no estamos de acuerdo en el diagnóstico del origen del problema y tampoco con la manera en la (...) que se proponen solucionarlo. En esta medida, en este texto mostraremos cómo la Regla de Adición sí trae problemas semánticos que pueden ser planteados desde diferentes perspectivas contemporáneas, como la extensionalidad del condicional, los principios proscriptivos y la validez conexiva. This essay is concerned with two interrelated questions. First, a broad question: in what sense is Skepticism a philosophy− or in what sense is it “philosophy” (as we will see, these are not identical questions)? Second, a narrow one: how should we understand the process whereby ataraxia (freedom from disturbance) emerges out of epochē (suspension of judgment)? The first question arises because Skepticism is often portrayed as anti-philosophy. This depiction, I contend, surreptitiously turns a Skeptical method into a so-called Skeptical (...) doctrine which is then either condemned for being self-refuting or salvaged as a plausible (albeit odd) epistemological theory. Instead, philosophy, for the Skeptics, is a matter of practice. Skepticism is not so much a philosophy that has a worldview to proclaim as it is a philosophy that invites us to perform something. En el presente artículo abordaremos el marco político y jurídico de la atención sanitaria intercultural de mujeres indígenas en Argentina, en particular, en la provincia de Neuquén. El objetivo es realizar una revisión sistemática del marco jurídico normativo producido en los distintos programas sanitarios que propician la atención de salud con un enfoque intercultural, centrada concretamente en las mujeres mapuce de Neuquén. Finalmente, nos enfocaremos en la contradicción que se produce cuando, por un lado, se defiende un enfoque sanitario intercultural (...) desde los marcos político-discursivo y jurídico, y, por el otro, se aplica un modelo sanitario biomédico, con tintes patriarcalistas. El derecho internacional surgió para regular las relaciones entre Estados, dejando por fuera a otro tipo de organizaciones, comunidades y personas. Con el paso del tiempo, se fue ampliando la posibilidad de hacer parte en esos escenarios restringidos cuando surgieron las organizaciones internacionales que son creadas por los Estaos, que tienen la capacidad de participar en las relaciones internacionales de manera limitada. Posteriormente el derecho internacional ha dejado participar con ciertas restricciones, a las Organizaciones no Gubernamentales - ONG y a (...) las personas. Los pueblos indígenas, a pesar de contar con más de 300 millones de personas alrededor del mundo y de contribuir con la diversidad cultural y la protección de la biodiversidad, han sido ignorados y excluidos de los escenarios internacionales. Sin embargo después de un largo y lento proceso de reivindicación han logrado hacer sentir su voz y hoy en día han empezado a ser considerados en algunos de estos escenarios internacionales. En este documento se presentará un breve recuento de algunos de esos espacios en el ámbito de los organismos internacionales, en donde se han desarrollado temas relativos al medio ambiento en los cuales tienen interés los pueblos indígenas. *El mismo se encuentra dividido en dos partes, la primera corresponde a los organismos internacionales universales que involucran la Organización de Naciones Unidad ONU y sus diferentes órganos y organismos especializados en temáticas ambientales. ** Además hace referencia a las declaraciones y los principales convenios internacionales sobre medio ambiente y conocimiento tradicional, adicionalmente se incluyen las organizaciones y acuerdos conexos que corresponden a la Organización Mundial del Comercio y a los tratados de libre comercio. La segunda parte corresponde a los escenarios de protección del medio ambiente a nivel regional que son relevantes para los pueblos indígenas, entre ellos, la Organización de Estados Americanos OEA, el Bando Interamericano de Desarrollo BID, la Organización Panamericana de la Salud OPS, la Comunidad Andina de Naciones CAN y se incluyen adicionalmente los tratados y declaraciones importantes en la materia. El objetivo al realizar este documento es ofrecer un panorama sobre las funciones de estos organismos y mencionar la manera como puede darse la participación de los pueblos indígenas en los mismos, mediante una obra de divulgación que sirva como material de consulta para líderes, autoridades de pueblos y organizaciones indígenas, funcionarios de organizaciones internacionales y sociales que apoyan a los pueblos indígenas. While every health care system stakeholder would seem to be concerned with obtaining the greatest value from a given technology, there is often a disconnect in the perception of value between a technology’s promoters and those responsible for the ultimate decision as to whether or not to pay for it. Adopting an empirical ethics approach, this paper examines how five Canadian medical device manufacturers, via their websites, frame the corporate “value proposition” of their innovation and seek to respond to what (...) they consider the key expectations of their customers. Our analysis shows that the manufacturers’ framing strategies combine claims that relate to valuable socio-technical goals and features such as prevention, efficiency, sense of security, real-time feedback, ease of use and flexibility, all elements that likely resonate with a large spectrum of health care system stakeholders. The websites do not describe, however, how the innovations may impact health care delivery and tend to obfuscate the decisional trade-offs these innovations represent from a health care system perspective. Such framing strategies, we argue, tend to bolster physicians’ and patients’ expectations and provide a large set of stakeholders with powerful rhetorical tools that may influence the health policy arena. Because these strategies are difficult to counter given the paucity of evidence and its limited use in policymaking, establishing sound collective health care priorities will require solid critiques of how certain kinds of medical devices may provide a better (i.e., more valuable) response to health care needs when compared to others. Debido a la importancia de establecer mecanismos para proteger la biodiversidad y posibilitar la preservación de los conocimientos asociados especialmente al uso de la flora medicinal, la Línea de Investigación en Política y Legislación, del Grupo de Estudios en Sistemas Tradicionales de Salud de la Facultad de Medicina, y la Línea de Derecho Ambiental (...) y Grupos Étnicos, del Grupo de Derechos Humanos de Jurisprudencia de la Universidad del Rosario, desarrollaron este libro a través del cual la Universidad se propone profundizar en el panorama actual de la reglamentación y política –Internacional, nacional y local—respecto a la flora medicinal y al patrimonio cultural inmaterial asociado a ésta. Objectives To increase postmortem organ donation rates, several countries are adopting an opt-out (presumed consent) policy, meaning that individuals are deemed donors unless they expressly refused so. Although opt-out countries tend to have higher donation rates, there is no conclusive evidence that this is caused by the policy itself. The main objective of this study is to better assess the direct impact of consent policy defaults per se on deceased organ recovery rates when considering the role of the family in (...) the decision-making process. This study does not take into account any indirect effects of defaults, such as potential psychological and behavioural effects on individuals and their relatives. -/- Design Based on previous work regarding consent policies, we created a conceptual model of the decision-making process for deceased organ recovery that included any scenario that could be directly influenced by opt-in or opt-out policies. We then applied this model to internationally published data of the consent process to determine how frequently policy defaults could apply. -/- Main outcome measures We measure the direct impact that opt-in and opt-out policies have per se on deceased organ recovery. -/- Results Our analysis shows that opt-in and opt-out have strictly identical outcomes in eight out of nine situations. They only differ when neither the deceased nor the family have expressed a preference and defaults therefore apply. The direct impact of consent policy defaults is typically circumscribed to a range of 0%–5% of all opportunities for organ recovery. Our study also shows that the intervention of the family improves organ retrieval under opt-in but hinders it under opt-out. -/- Conclusions This study may warn policy makers that, by emphasising the need to introduce presumed consent to increase organ recovery rates, they might be overestimating the influence of the default and underestimating the power granted to families. En este artículo se plantean las bases del marco ético-normativo que intervienen en la atención sanitaria de las mujeres en general, y de las mujeres mapuce, en particular. Posteriormente, se realiza un abordaje de las mujeres indígenas analizando su situación concreta, a partir de considerar de manera crítica la confluencia intersectorial de distintos sistemas opresivos que articulan las relaciones de género, clase y etnia. Para ello, el planteo se centrará en el estudio de esta problemática desde la perspectiva feminista latinoamericana, (...) que será, seguidamente, retomada y contrastada desde la voz propia de mujeres que se autoidentifican como mapuce. El objetivo del artículo se centra en poner de manifiesto las múltiples dificultades que presentan las mujeres indígenas en el acceso a la salud, con el propósito de justificar la necesidad de articular políticas públicas que promuevan la democratización del acceso sanitario, en tanto derecho humano. Para ello, realizaremos un abordaje teórico-normativo que ponga en evidencia las responsabilidades éticas y políticas del Estado, como ente garante del acceso a la salud de sus ciudadanos, en particular de los más vulnerados, como lo son las mujeres de comunidades indígenas en nuestro país. Desde un esquema epistemológico sujeto-sujeto y desde un planteo feminista decolonial, nos acercará narrativas de mujeres mapuce que versan sobre la precarización de sus vidas y salud como parte de las violencias instituidas por la cultura hegemónica, poniendo sobre relieve la resiliencia de las culturas subalternizadas a partir de la lucha y re-existencia de estas mujeres.
