A philosophical analysis of the future of art must explicate art’s nature, as well as discuss the historical nature of art practice. Only so can one explain those contemporary developments in art which have led many people to doubt whether art even has a future. Arguably, art practice as we know it started with the installing of the modern system of the fine arts. I explain the pragmatics of art so understood, and suggest that we can define art, internally. We (...)

This article addresses the fiduciary issues raised by the current practice of plan fiduciaries of not only disclaiming any fiduciary responsibility for brokerage window investments, but also abdicating any role (fiduciary or otherwise) in assessing even the general suitability of those investments for a retirement plan, and concludes that the practice is in plain and notorious violation of what ERISA requires of fiduciaries.

Iconic photographs are visual arguments depicting an, often dramatic, particular situation showing victims of disasters. Spectators watching the photo of the particular situation, empathise with it, and project the feelings evoked onto the events that form the context for the scene in the picture. This mobilises them into political action. In the process, however, the depicted personal misery is perused to exemplify the larger events. The tragedy of iconic photographs is analysed not as the misery experienced by the depicted persons, (...)

People don’t just act randomly in moral situations nor do they argue internally about which ethical principle to follow before deciding what to do. We built our moral sensitivity whilst living our lives, adhering to aesthetic norms of interaction. Regular engagement with works of art educates our moral sensitivity.

While many accept this principle in some form, it also has its share of critics, and thus it seems desirable if an argument can be offered in its support. The aim of this paper is to examine a particular way in which the principle has been defended, namely, by appeal to considerations of fairness. In a nutshell, the idea (...)

Some moral theories, such as objective forms of consequentialism, seem to fail to be practically useful: they are of little to no help in trying to decide what to do. Even if we do not think this constitutes a fatal flaw in such theories, we may nonetheless agree that being practically useful does make a moral theory a better theory, or so some have suggested. In this paper, I assess whether the uncontroversial respect in which a moral theory can be (...)

In its recent opinion in Intel v. Sulyma, the U.S. Supreme Court clarified what qualifies as the “actual knowledge” required to trigger ERISA’s three-year statutory period. The Court’s opinion, however, left open whether establishing “actual knowledge” by a plaintiff in one case serves to time-bar otherwise timely suits that challenge subsequent breaches of the same character. This article argues that, under the continuing fiduciary duty analysis that the Court set forth in Tibble v. Edison, such suits should not be deemed (...)

There are two distinct views on how to formulate an objective consequentialist account of the deontic status of actions, actualism and possibilism. On an actualist account, what matters to the deontic status of actions is only the value of the outcome an action would have, if performed. By contrast, a possibilist account also takes into account the value of the outcomes that an action could have. These two views come apart in their deontic verdicts when an agent is imperfect in (...)

A naturalistic theory of intentionality is proposed that differs from previous evolutionary and tracking theories. Full-blown intentionality is constructed through a series of evolvable refinements. A first, minimal version of intentionality originates from a conjectured internal process that estimates an organism’s own fitness and that continually modifies the organism. This process produces the directedness of intentionality. The internal estimator can be parsed into intentional components that point to components of the process that produces fitness. It is argued that such intentional (...)

The causal efficacy of a material system is usually thought to be produced by the law-like actions and interactions of its constituents. Here, a specific system is constructed and explained that produces a cause that cannot be understood in this way, but instead has novel and autonomous efficacy. The construction establishes a proof-of-feasibility of strong emergence. The system works by utilizing randomness in a targeted and cyclical way, and by relying on sustained evolution by natural selection. It is not vulnerable (...)

A new theory that naturalizes biological function is explained and compared with earlier etiological and causal role theories. Etiological theories explain functions from how they are caused over their evolutionary history. Causal role theories analyze how functional mechanisms serve the current capacities of their containing system. The new proposal unifies the key notions of both kinds of theories, but goes beyond them by explaining how functions in an organism can exist as factors with autonomous causal efficacy. The goal-directedness and normativity (...)

Metaphors for describing the introduction, impacts, and management of non-native species are numerous and often quite outspoken. Policy-makers have adopted increasingly disputed metaphorical terms from scientific discourse. We performed a critical analysis of the use of strong metaphors in reporting scientific findings to policy-makers. Our analysis shows that perceptions of harm, invasiveness or nativeness are dynamic and inevitably display multiple narratives in science, policy or management. In this paper, we entirely do one completely destructive thing and partly do one not entirely constructive thing. A basic mechanism that can generate life's agency and goal-directedness is combined with mechanisms that can account for awareness by and of the self, and for the social characteristics of humans. The new theory is largely consistent with major existing theories of the self, in particular theories centred on self-esteem, self-determination theory, and terror management theory. It can therefore be regarded (...)

This is a concise book and reflects much study. It has many virtues along with some flaws. Ramberg assembles themes and puzzles from Davidson into a more or less coherent viewpoint. In this article I propose to understand inertia in art as a “disposition to meaning”. I compare inertia in art with that of a face of a person recently deceased. The origin and development of consciousness is poorly understood. Although it is clearly a naturalistic phenomenon evolved through Darwinian evolution, explaining it in terms of physicochemical, neural, or symbolic mechanisms remains elusive. Here I propose that two steps had to be taken in its evolution. First, living systems evolved an intrinsic goal-directedness by internalizing Darwinian fitness as a self-estimated fitness. The self-estimated fitness participates in a feedback loop that effectively produces intrinsic meaning in the organism. Second, animals with advanced nervous (...)

The scalar magnetic field B_l mediates a longitudinal Ampère force that balances the transverse Ampère force (aka the magnetic field force), such that the sum of the two forces agrees with N3LM for all stationary current distributions. Adam Elga takes the Sleeping Beauty example to provide a counter-example to Reflection, since on Sunday Beauty assigns probability 1/2 to H, and she is certain that on Monday she will assign probability 1/3. I will show that there is a natural way for Bas van Fraassen to defend Reflection in the case of Sleeping Beauty, building on van Fraassen’s treatment of forgetting. This will allow me to identify a lacuna in Elga’s argument for 1/3. I will then argue, however, (...)

  47. Actual Guidance Is Enough.Stefan Fischer - 2023 - Journal of Ethics and Social Philosophy 24 (1).
In a recent paper, Nate Sharadin and Rob van Someren Greve pull into doubt a seemingly platitudinous idea: deontic evaluation is capable of guiding action (“Capable”). After discussing several arguments for it, the authors conclude that, to the extent to which Capable can be defended, it cannot produce interesting results about the nature of the deontic. My goal is to argue that the authors’ skeptical endeavors are unconvincing. I aim to show that they rely on an implausibly broad understanding of (...)

  50. Quantum Considerations in the Metaphysics of Levels.Ryan Miller - 2025 - Dissertation, Université de Genève
Amie Thomasson challenges advocates of layered conceptions of reality to explain “how layers are distinguished” and “what holds them together” by “examining the world” (2014). One strategy for answering such questions is mereological, treating inter-layer relations as parthood relations, where layers exist whenever composition does, and the number of layers will be equivalent to the number of answers to Peter Van Inwagen’s Special Composition Question, while answers to his General Composition Question explain what holds the layers together (1987). Various answers (...)
