  1. Modal-Logical Reconstructions of Thought Experiments.Ruward Mulder & F. A. Muller - 2023 - Erkenntnis 2023.
Sorensen (1992) has provided two modal-logical schemas to reconstruct the logical structure of two types of destructive thought experiments: the Necessity Refuter and the Possibility Refuter. The schemas consist of five propositions which Sorensen claims but does not prove to be inconsistent. We show that the five propositions, as presented by Sorensen, are not inconsistent, but by adding a premise (and a logical truth), we prove that the resulting sextet of premises is inconsistent. Häggqvist (2009) has provided a different modal-logical schema (...)

Companies committed to corporate social responsibility should ensure that their managers possess the appropriate competencies to effectively manage the CSR adaptation process. The literature provides insights into the individual competencies these managers need but fails to prioritize them and adequately contextualize them in a manner that makes them meaningful in practice. In this study, we contextualized the competencies within the different job roles CSR managers have in the CSR adaptation process. We interviewed 28 CSR managers, followed by a survey to (...)

Vaccination can protect vaccinated individuals and often also prevent them from spreading disease to other people. This opens up the possibility of getting vaccinated for the sake of others. In fact, altruistic vaccination has recently been conceptualized as a kind of vaccination that is undertaken primary for the benefit of others. In order to better understand the potential role of altruistic motives in people’s vaccination decisions, we conducted two focus group studies with a total of 37 participants. Study 1 included (...)

It is surprisingly hard to define presentism. Traditional definitions of the view, in terms of tensed existence statements, have turned out not to to be capable of convincingly distinguishing presentism from eternalism. Picking up on a recent proposal by Tallant, I suggest that we need to locate the break between eternalism and presentism on a much more fundamental level. The problem is that presentists have tried to express their view within a framework that is inherently eternalist. I call that framework (...)

  5. Some Meta-Theoretical Questions for Restorative Justice.Theo Gavrielides - 2005 - Ratio Juris 18 (1):84-106.
Unquestionably, Restorative Justice (hereafter RJ) has finally gathered some real momentum. It has become a sine qua non topic in many national and international policy and statutory agendas. However, as the restorative practice expands to deal with crimes, ages and situations it has never addressed before (at least in its contemporary version), and as its application starts to make sense not only to national but also to regional and international bodies and fora, new theoretical problems are posed. In the fast-growing (...)

The new politics of community cohesion: making use of human rights policy and legislation.Theo Gavrielides - 2010 - The Policy Press 38 (3):427–44.
Although community cohesion and human rights are currently two of the most discussed political discourses in the UK, their links for policy are underplayed. This article presents the findings of a nine-month research project that included interviews with a selected expert sample, and which aimed to explore whether human rights values and legislation can be used as tools for community cohesion. Available levers within human rights and the 1998 Human Rights Act are identified, and evidence-based policy recommendations are posited. The (...)

It challenges current debates through the consideration and integration of various disciplines such as law, criminology, philosophy and human rights into restorative justice theory, resulting in the development of new and stimulating arguments. Topics covered include the close relationship and convergence of restorative justice and human rights, some of the challenges of engagement with human rights, the need for the (...)

  8. Explanation and Ontological Reasoning.Dwayne Hudson Mulder - 1997 - Dissertation, Loyola University of Chicago
Philosophical work on explanation has focused on the following two topics: theories of explanation, intended to enumerate necessary and sufficient conditions for explanation, and inference to the best explanation as the strongest form of justification for ontological or metaphysical claims. I critically examine the most important philosophical work in both of these areas and defend my own conclusions about the connections between explanation and ontology. I argue that all of our inferences about the nature of the world, in ontology or (...)

Although the fast-growing literature on restorative justice is extensive, and in some regards repetitive, there is still no consensus as to the nature and extent of applicability of the restorative notion. This article claims that the restorative movement is experiencing a tension between normative abolitionist and pragmatic visions of restorative justice. It proceeds to identify six conceptual fault-lines that characterize this tension. These do not only refer to various definitional positions, but also disagreements that negatively affect both the theoretical and (...)

The chapter revisits the relationship between restorative justice and punishment through the eyes of Classical Greek philosophy and tragedy, the School of Collectivists, and contemporary thinkers. The extant literature sees restorative justice either as alternative punishment or an alternative to punishment. This chapter puts forward the notion of restorative punishment by deconstructing the concept of pain, and by reconstructing a new vision through the notion of catharsis. The chapter then takes a bold step in proposing a philosophical framework to justify (...)

The purpose of this article is to continue the discussion on Europe’s converging criminal justice systems. In particular, I test a hypothesis that has recently appeared in the literature, which sees the jurisprudence of the European Court of Human Rights as one of the most significant factors that encourage a harmonization process between the adversarial and inquisitorial criminal justice systems of Europe. This claim is supported by examining the Court’s jurisprudence to identify decisions that led to legislative and policy amendments (...)

Notoriously, the Einstein equations of general relativity have solutions in which closed timelike curves occur. On these curves time loops back onto itself, which has exotic consequences: for example, traveling back into one's own past becomes possible. However, in order to make time travel stories consistent constraints have to be satisfied, which prevents seemingly ordinary and plausible processes from occurring. This, and several other "unphysical" features, have motivated many authors to exclude solutions with CTCs from consideration, e.g. by conjecturing a (...)

Since the Jesus of the historic Christian tradition is held to be sinless, we think Christians should reject Kane’s theory because it seems irreconcilable with historic Christian Christology. Human rights and restorative justice are rarely brought under the same spotlight despite their normative similarities. In fact, this gap becomes even more apparent when put in the context of policy and practice internationally. Firstly, there is a developing gap between public perception and evidence-based depiction of crime. Secondly, scholarly debates are rarely reflected in criminal justice policy and legislation. This failure has an impact on recidivism, the spiralling costs of penal interventions, but most importantly on how we view our (...)

  46. Trinitarian Roots of Francis Bacon’s Pragmatism.Aderemi Artis - 2019 - Heythrop Journal 60 (2):197-204.
From his earliest publications until his last, Francis Bacon displayed an intense interest in theo- logical and religious issues, and expressed this interest in both public and private. On the other hand, he has long been recognized for his proposals for a grand reform and reconstruction of natural philosophy, in which experience, observation, experiment, and technological implementation of abstract claims all took center stage. This practical bent has often neatly been encapsu- lated in the slogan derived from Bacon himself, (...)

I argue that this is the case, at least if we retain the stan- dard ‘inferential’ approach within analytical ontology, i.e., (...)

Тhе question which animates Heidegger's paper (''Die onto-theo-logische Verfassung der Metaphysik:) is: "How are God coming in phi1osophy?"; and it is only а sharpening of "th.e question of the onto-theologic character of philosophy". Hegel and Heidegger are bothunited and opposed as identity and difference. Both being and existing descend from difference. Equilibrium (Aпstrag) arranges the unit of being and existing.
