Sorensen (1992) has provided two modal-logical schemas to reconstruct the logical structure of two types of destructive thought experiments: the Necessity Refuter and the Possibility Refuter. The schemas consist of five propositions which Sorensen claims but does not prove to be inconsistent.We show that the five propositions, as presented by Sorensen, are not inconsistent, but by adding a premise (and a logical truth), we prove that the resulting sextet of premises is inconsistent. Häggqvist (2009) has provided a different modal-logical schema (...) (Counterfactual Refuter), which is equivalent to four premises, again claimed to be inconsistent. We show that this schema also is not inconsistent, for similar reasons. Again, we add another premise to achieve inconsistency. The conclusion is that all three modal-logical reconstructions of the arguments that accompany thought experiments, two by Sorensen and one by Häggqvist, have now been made rigorously correct. This may inaugurate new avenues to respond to destructive thought experiments. (shrink)

Companies committed to corporate social responsibility should ensure that their managers possess the appropriate competencies to effectively manage the CSR adaptation process. The literature provides insights into the individual competencies these managers need but fails to prioritize them and adequately contextualize them in a manner that makes them meaningful in practice. In this study, we contextualized the competencies within the different job roles CSR managers have in the CSR adaptation process. We interviewed 28 CSR managers, followed by a survey to (...) explore the relative importance of the competencies within each job role. Based on our analysis, we identified six distinct managerial roles, including strategic, coordinating, and stimulating roles. Next, we identified per role key individual CSR-related competencies as prioritized by the respondents. Our results show that the context, as indicated in this study by CSR managers’ job roles, indeed influenced the importance of particular CSR-related competencies, because each role seems to require a different combination and prioritization of these competencies. Moreover, the results suggest that the relative importance of these competencies within each role may be driven by business logic rather than an idealistic logic. The results are presented as a competence profile which can serve as a reflection tool and as a frame of reference to further develop the competence profile for CSR managers. (shrink)

Vaccination can protect vaccinated individuals and often also prevent them from spreading disease to other people. This opens up the possibility of getting vaccinated for the sake of others. In fact, altruistic vaccination has recently been conceptualized as a kind of vaccination that is undertaken primary for the benefit of others. In order to better understand the potential role of altruistic motives in people’s vaccination decisions, we conducted two focus group studies with a total of 37 participants. Study 1 included (...) three focus groups on the subject of HPV vaccination for boys. Study 2 included three focus groups on the subject of pertussis and measles vaccination for childcare workers. We found substantial evidence of other-regarding motives across all focus groups, which suggests that altruistic motives could be an important factor when it comes to people’s vaccination decisions. We address the significance of these findings for vaccination policy surrounding HPV vaccination for boys and vaccination for childcare workers. We also extend the findings to normative work on vaccination for the sake of others more generally. (shrink)

It is surprisingly hard to define presentism. Traditional definitions of the view, in terms of tensed existence statements, have turned out not to to be capable of convincingly distinguishing presentism from eternalism. Picking up on a recent proposal by Tallant, I suggest that we need to locate the break between eternalism and presentism on a much more fundamental level. The problem is that presentists have tried to express their view within a framework that is inherently eternalist. I call that framework (...) the Fregean nexus, as it is defined by Frege’s atemporal understanding of predication. In particular, I show that the tense-logical understanding of tense which is treated as common ground in the debate rests on this very same Fregean nexus, and is thus inadequate for a proper definition of presentism. I contrast the Fregean nexus with what I call the original temporal nexus, which is based on an alternative, inherently temporal form of predication. Finally, I propose to define presentism in terms of the original temporal nexus, yielding original presentism. According to original presentism, temporal propositions are distinguished from atemporal ones not by aspects of their content, as they are on views based on the Fregean nexus, but by their form—in particular, by their form of predication. Unquestionably, Restorative Justice (hereafter RJ) has finally gathered some real momentum. It has become a sine qua non topic in many national and international policy and statutory agendas. However, as the restorative practice expands to deal with crimes, ages and situations it has never addressed before (at least in its contemporary version), and as its application starts to make sense not only to national but also to regional and international bodies and fora, new theoretical problems are posed. In the fast-growing (...) literature many theories and Schools have been evoked to support RJ's claims. This paper will take the discussion a step back by looking at questions of meta-theoretical character. In particular, the paper will ask: Does RJ have a place in the “world of theories,” and if it does, then what kind of theory is it, and on what level should it be placed? Second, does RJ theory need a philosophy, and why? Finally, how can restorative practices be morally justified? (shrink)

Although community cohesion and human rights are currently two of the most discussed political discourses in the UK, their links for policy are underplayed. This article presents the findings of a nine-month research project that included interviews with a selected expert sample, and which aimed to explore whether human rights values and legislation can be used as tools for community cohesion. Available levers within human rights and the 1998 Human Rights Act are identified, and evidence-based policy recommendations are posited. This book takes bold steps in forming much-needed philosophical foundations for restorative justice through deconstructing and reconstructing various models of thinking. It challenges current debates through the consideration and integration of various disciplines such as law, criminology, philosophy and human rights into restorative justice theory, resulting in the development of new and stimulating arguments. Philosophical work on explanation has focused on the following two topics: theories of explanation, intended to enumerate necessary and sufficient conditions for explanation, and inference to the best explanation as the strongest form of justification for ontological or metaphysical claims. I critically examine the most important philosophical work in both of these areas and defend my own conclusions about the connections between explanation and ontology. I argue that all of our inferences about the nature of the world, in ontology or (...) metaphysics, presuppose criteria for acceptable explanation. I first examine the metaphysics of Plato, Aristotle, and Leibniz, arguing that their metaphysical reasoning was guided by assumptions about the nature of explanation. I also survey some recent work in ontology and find inference to the best explanation offered as the strongest available method of defending existence claims. To conclude this discussion, I offer an original argument for the thesis that all reasoning about existence claims, being nondeductive, presupposes some criteria for acceptable explanations, or a theory of explanation. Carl Hempel and Wesley Salmon have been two of the most influential philosophers offering theories of explanation, and I examine their work with the intention of discovering ontological or metaphysical assumptions shaping their theories of explanation. I argue that Hempel's theory rests on deterministic assumptions, and I argue the Salmon's theory of causality, which he admits supports his theory of explanation, is subject to empiricist criticisms. Theories of explanation typically rest on assumptions about the nature of the world, I argue, and I explain why this is so with an original theory of explanation connecting it to the psychological phenomenon of understanding. We rely on understanding in the identification of explanations, and understanding requires establishing a metaphysical context for an explanandum-event. I end by indicating the possibility of generating vicious justificatory circles through the reciprocal relationship of support between explanation and ontology, and I argue that vicious circles can be avoided only by grounding all ontological reasoning in a fundamental explanatory task of giving order to experience through a system of categories. Although the fast-growing literature on restorative justice is extensive, and in some regards repetitive, there is still no consensus as to the nature and extent of applicability of the restorative notion. This article claims that the restorative movement is experiencing a tension between normative abolitionist and pragmatic visions of restorative justice. It proceeds to identify six conceptual fault-lines that characterize this tension. These do not only refer to various definitional positions, but also disagreements that negatively affect both the theoretical and (...) practical development of restorative justice. These tensions also encourage a power-interest battle between different stakeholders within the restorative movement including practitioners, theoreticians, researchers and policy makers. To approach these controversies, there needs to be an acknowledgment of the multidimensional nature of the conceptual problem of restorative justice and the impact it has on its application. The chapter revisits the relationship between restorative justice and punishment through the eyes of Classical Greek philosophy and tragedy, the School of Collectivists, and contemporary thinkers. The extant literature sees restorative justice either as alternative punishment or an alternative to punishment. This chapter puts forward the notion of restorative punishment by deconstructing the concept of pain, and by reconstructing a new vision through the notion of catharsis. The purpose of this article is to continue the discussion on Europe’s converging criminal justice systems. In particular, I test a hypothesis that has recently appeared in the literature, which sees the jurisprudence of the European Court of Human Rights as one of the most significant factors that encourage a harmonization process between the adversarial and inquisitorial criminal justice systems of Europe. This claim is supported by examining the Court’s jurisprudence to identify decisions that led to legislative and policy amendments (...) in the domestic legal orders of the 46 member states of the Council of Europe. This account shows how an interplay currently taking place between judicial, policy, and statutory powers is marking the end of the adversarial-inquisitorial era. Finally, the conclusion identifies the three most important impediments that are likely to hamper this harmonization process. (shrink)

Notoriously, the Einstein equations of general relativity have solutions in which closed timelike curves occur. On these curves time loops back onto itself, which has exotic consequences: for example, traveling back into one's own past becomes possible. However, in order to make time travel stories consistent constraints have to be satisfied, which prevents seemingly ordinary and plausible processes from occurring. This, and several other "unphysical" features, have motivated many authors to exclude solutions with CTCs from consideration, e.g. by conjecturing a (...) chronology protection law. In this contribution we shall investigate the nature of one particular class of exotic consequences of CTCs, namely those involving unexpected cases of indeterminism or determinism. Indeterminism arises even against the backdrop of the usual deterministic physical theories when CTCs do not cross spacelike hypersurfaces outside of a limited CTC-region|such hypersurfaces fail to be Cauchy surfaces. We shall compare this CTC-indeterminism with four other types of indeterminism that have been discussed in the philosophy of physics literature: quantum indeterminism, the indeterminism of the hole argument, non-uniqueness of solutions of differential equations and lack of predictability due to insuffcient data. By contrast, a certain kind of determinism appears to arise when an indeterministic theory is applied on a CTC: things cannot be different from what they already were. Again we shall make comparisons, this time with other cases of determination in physics. We shall argue that on further consideration both this indeterminism and determinism on CTCs turn out to possess analogues in other, familiar areas of physics. CTC- indeterminism is close to the epistemological indeterminism we know from statistical physics, while the "fixedness" typical of CTC-determinism is pervasive in physics. CTC- determinism and CTC-indeterminism therefore do not provide incontrovertible grounds for rejecting CTCs as conceptually inadmissible. (shrink)

Restorative justice (RJ) in the secure estate is widespread internationally, although piecemeal and inconsistent in its application. It exists in the form of many practices such as mediation, conferencing, circles, and panels. As the interest in RJ continues to grow, this research takes a step back to ask how reconcilable RJ is with incapacitation. Through a combination of normative thinking, literature review, and primary research that applied qualitative methodologies over a 3-year period, the article examines where the two notions meet (...) in their intentions and expected outcomes. ‘Justice’ is spoken of in two ways: the lawful and the fair. The law is a human construct that is devoted to the advantage of all, or to the advantage of the best, or to the advantage of those in power or to the advantage of those representing it – let it be the politician, the media, the TV presenter, the filmmaker. Thus, the law serves the production or the preservation of happiness within politics and business. The law commands us (...) to act according to the mean. A well-written law follows the mean well and a poorly written law does not. On the other hand, fairness is a principle sometimes materialised through the law and the given justice system. Fairness is the ultimate value pursued by both the common law and civil law traditions. However, its distribution through the law and the representation of this delivery varies. Does this mean that a different kind of justice is distributed? Through the teachings of Aristotle, this essay aims to deconstruct the notion of justice, by breaking down its two ingredients, the lawful and the fair, and by analysing the effect of their representation in modern European society. The relativity attached to the notion of justice is not a modern phenomenon, but a philosophical matter that can be analysed and indeed explained through the teachings of Aristotle and its contemporary students. The analysis will be developed in the context of convergent Europe, focusing on the role of the media and courts especially in relation to criminal justice. (shrink)

Abstract: In this paper we argue that Robert Kane’s theory of free will cannot accommodate the possibility of a sinless individual who faces morally significant choices because a sinless agent cannot voluntarily accord value to an immoral desire, and we argue that Kane’s theory requires this. Since the Jesus of the historic Christian tradition is held to be sinless, we think Christians should reject Kane’s theory because it seems irreconcilable with historic Christian Christology. The author considers that the Penal Sciences face a wide range of human pathogenic issues, ranging from terrorism and human trafficking to corruption and the use of substances and are, thus, the ideal discipline for investigating the various scientific issues and the implementation of the scientific findings arising from such investigations. He also believes that the Penal Sciences, being inextricably linked to human values and constitutional rights, are, by their nature, beneficial towards the promotion and consolidation of values, such as (...) freedom, solidarity and, especially, Social Justice. The latter concept is perceived by the author not only as a form of justice, which provides everyone with their due of proportion to their value, according to the famous saying of Ulpian “suum cuique tribuere”, but rather as a form of restitution from social injustices and as a treatment for social needs, particularly for our fellow human beings who are marginalized by society in conditions of poverty and degradation. It is interesting, at this point, to emphasize that the United Nations, in an important report from 2006 entitled “Social Justice in an Open World. The Role of the United Nations”, defines Social Justice as the fair and compassionate distribution of the fruits of economic growth (“Social Justice in an Open World. The Role of the United Nations”, edited by the International Forum for Social Development, New York: United Nations, 2006, p. 7, available online). The vision, therefore, of a society focused on goals such as combating socio-economic disparities and providing effective assistance for the weaker members of society signifies, especially in this period of Crisis, is a primary objective worthy, according to the author, of captivating us. Perhaps, indeed, the new target for Criminal Policy, following that of Restorative Justice, should now be that of Social Justice and, in fact, with a double project and aim: first for a fairer distribution of social goods and, also, for greater solidarity towards the weaker members of society. Indeed, it is a known fact to those involved with the Penal Sciences, that a dominant contemporaneous trend is that of Restorative Justice, in the sense that Criminal Law and Criminology finally have to address the needs of the victim of a criminal act and to advocate for relevant methods for extrajudicial settlements and for the conciliation of the offender and the victim. Restorative Justice is, hence, based on the triptych of the perpetrator assuming responsibilities for their actions, of restoring, as far as possible, the effects of the injurious actions against the victim and, also, of actively expressing the desire for conciliation with the victim. Certainly it would be greatly desirable if these ideas were to be consolidated within Greek legislation, albeit within the, always progressive, Greek Law for Minors there is a provision for the reformatory conciliation measure, pursuant to article 122 case e of the Greek Penal Code. However, the author believes that in this period of time, a time of profound crisis at all levels, there is need for more than simple offender-victim conciliation. There is a need for this spirit of reconciliation and solidarity to be extended to benefit all those who are experiencing hard times and may, therefore, in their deprivation and frustration, are led to committing crime. The author, at this point, refers to all the socially weak and often marginalized groups of people, who are scientifically characterized as "weak" or "vulnerable" and who try, with great courage, to survive without breaching the threshold of breaking the law. It is apparent here, according to the author, that if Criminal Policy actually aims to provide solutions to the problems of crime, it should not solely be limited to repairing the damage and conciliating the victim and perpetrator, but it should strike against the causative factors of crime and the primarily socio-economic inequalities and other forms of injustice which cause, according to Aristotle in his "Politics" (V. 1301b27, 1301a32 et seq., 1266b40), social reactions, attitudes and – Ι would add - a sequence of serious criminal acts. In other words, another kind of Justice is required in addition to Restorative, so that it may become the mission of our Criminal Policy to eliminate the injustices and inequalities that lead to crime. Because corporate social responsibility can be beneficial to both companies and its stakeholders, interest in factors that support CSR performance has grown in recent years. A thorough integration of CSR in core business processes is particularly important for achieving effective long-term CSR practices. Here, we explored the individual CSR-related competencies that support CSR implementation in a corporate context. First, a systematic literature review was performed in which relevant scientific articles were identified and analyzed. Next, 28 CSR directors and managers were (...) interviewed. The literature review complemented with interview data resulted in the following eight distinct CSR-related competencies: Anticipating CSR challenges; Understanding CSR-relevant systems and subsystems; Understanding CSR-relevant standards; CSR management competencies, including Leading CSR programs, Managing CSR programs, and Identifying and realizing CSR-related business opportunities; Realizing CSR-supportive interpersonal processes; Employing CSR-supportive personal characteristics and attitudes; Personal value-driven competencies, including Ethical normative competencies, Balancing personal ethical values and business objectives, and Realizing self-regulated CSR-related behaviors and active involvement; and Reflecting on personal CSR views and experiences. Based on these results, implications for further research on this topic, as well as implications for practitioners, are discussed. (shrink)

Human rights and restorative justice are rarely brought under the same spotlight despite their normative similarities. In fact, this gap becomes even more apparent when put in the context of policy and practice internationally. Firstly, there is a developing gap between public perception and evidence-based depiction of crime. Secondly, scholarly debates are rarely reflected in criminal justice policy and legislation. (Expected) adverse effects of the ‘ICT Revolution’ on work and opportunities for individuals to use and develop their capacities give a new impetus to the debate on the societal implications of technology and raise questions regarding the ‘responsibility’ of research and innovation (RRI) and the possibility of achieving ‘inclusive and sustainable society’. However, missing in this debate is an examination of a possible conflict between the quest for ‘inclusive and sustainable society’ and conventional economic principles guiding capital allocation (including the (...) funding of research and innovation). We propose that such conflict can be resolved by re-examining the nature and purpose of capital, and by recognising mainstream economics’ utilitarian foundations as an unduly restrictive subset of a wider Aristotelian understanding of choice. Exploring online criticisms of the ‘take the knee’ protest during ‘Euro 2020’, this article examines how alt- and far-right conspiracies were both constructed and communicated via the social media platform, Twitter. By providing a novel exploration of alt-right conspiracies during an international football tournament, a qualitative thematic analysis of 1,388 original tweets relating to Euro 2020 was undertaken. The findings reveal how, in criticisms levelled at both ‘wokeism’ and the Black Lives Matter movement, antiwhite criticisms of the ‘take the knee’ (...) protest were embroiled in alt-right conspiracies that exposed an assumed Cultural Marxist, ‘woke agenda’ in the tournament’s organization and mainstream media coverage. In conclusion, it is argued that conspiratorial discourses, associated with the alt-right, provided a framework through which the protest could be understood. This emphasises how the significance of conspiracy functions to promote the wider dissemination of alt-right ideology across popular cultural contexts, such as sport. (shrink)

This text proposes an analysis of the phenomenon of faith in the tradition and spirituality of the Eastern Church. Starting from the relationship between phenomenology and theology, the article uses a theo-phenomenological method to depict the phenomenon of faith both theologically and phenomenologically. This article also argues that non-religious faith—either natural or philosophical—is the foundation of religious faith. According to Orthodox spirituality, faith is not reduced to a set of theoretical teachings and dogmas; they constitute only the first type (...) of faith, “simple faith”. At the same time, faith is also a form of experience, which has ascetical, ethical, and mystical dimensions; they characterize the second type of faith, faith as contemplative sight and knowledge. Historical Cognitive Science I am lucky to strike three reviewers who extract so clearly my book's spirit as well as its substance. They all both accept and act on my central methodological assumption; that detailed historical research, and consideration of difficult contemporary questions about cognition and culture, can be mutually illuminating. It's gratifying to find many themes which recur in different contexts throughout _Philosophy and Memory_ _Traces_ so well articulated here. The reviews catch my desires to interweave discussion of cognitive (...) theories of memory with moral questions of psychological control and self-mastery, to evoke the virtues and the pleasures of strange, baroque beliefs about fickle 'animal spirits' coursing through the nerves and the brain, to demonstrate that mechanistic explanation (even in its blunt old Cartesian form) can acknowledge complexity, and to develop scientific conceptions of dynamic memory traces and representations which can survive uncharitable philosophical criticism. The book's insistent interdisciplinarity is just an inchoate quest to acknowledge the daunting variety of the phenomena: remembering is both natural and cultural, and is studied by narrative theorists as well as neurobiologists, by physicists as well as psychologists. By fusing the rangy detail of a history of early modern neurophysiology with the committed, even gullible fervor of a defence of 'new connectionist' cognitive science, I wanted to pull out the carpet from all those who are happy to let 'scientific' and 'cultural' approaches to the mind run along independently. This article aims to serve as an accessible introduction to the idea of "ontotheology" and to the so-called "ontotheological critique of Western metaphysics" for which the twentieth-century German philosopher Martin Heidegger is especially well known. I begin by distinguishing two uses of "ontotheology" employed respectively by Kant and Heidegger, and go on to develop the Heideggerian interpretation and critique of ontotheology under three main headings: The Onto-theo-logical Constitution of Western Metaphysics; Ontotheology's Problematic Legacy: Anxiety, Calculation, Oblivion; and Ontotheology and (...) God. The article concludes with an annotated bibliography of helpful resources for learning more about ontotheology, the critique of ontotheology, and directions the critique has taken after Heidegger. According to David Rosenthal’s higher-order thought (HOT) theory of consciousness, a mental state is conscious just in case one is aware of being in that state via a suitable HOT. Jesse Mulder (2016) recently objects: though HOT theory holds that conscious states are states that it seems to one that one is in, the view seems unable to explain how HOTs engender such seemings. I clarify here how HOT theory can adequately explain the relevant mental appearances, illustrating the explanatory (...) power of HOT theory. (shrink)

Reshaping the neo-Aristotelian doctrines about the human soul was Descartes’s most spectacular enterprise, which gave birth to some of the sharpest debates in the Republic of Letters. Neverthe- less, it was certainly Descartes’s intention, as already expressed in the Discours de la méthode, to show that his new metaphysics could be supplemented with experimental research in the field of medicine and the conservation of life. It is no surprise then that several natural philosophers and doctors, such as Henricus Regius from (...) Utrecht, who had studied in Padua with William Harvey, rallied in support, in order to gain a more substantial theoretical basis for their research. Taking as his ground some general metaphysical assumptions, such as the existence of God, the immortality of the soul, and perhaps the separability of the pure understanding, Regius intended to secure a new philosophy of man, which was able to reflect his medical interests and complement his account of human nature. This is the story that is now gaining currency, and it is surely accurate, at least in part. Desmond Clarke has recently defended the same view1, based on the remarkable studies of the Utrecht scholars Theo Verbeek and Erik-Jan Bos. Here I would like to challenge some aspects of this view and ask how Regius, who was perceived as the philosopher most closely associated with Descartes, became a betrayer of his mentor. (shrink)

From his earliest publications until his last, Francis Bacon displayed an intense interest in theo- logical and religious issues, and expressed this interest in both public and private. On the other hand, he has long been recognized for his proposals for a grand reform and reconstruction of natural philosophy, in which experience, observation, experiment, and technological implementation of abstract claims all took center stage. This practical bent has often neatly been encapsu- lated in the slogan derived from Bacon himself, (...) ‘knowledge is power.’ The many and interesting connections between these two sets of interests – the theological and the natural philosophical – have not gone unnoticed by scholars; however, one central component of Bacon’s pragmatic approach to natural philosophy that was deeply influenced by his theological concerns has remained unexplored. The equation between knowledge and power, so well known, in fact developed out of Bacon’s conception of the Christian Trinity, and out of the rela- tionship between the Trinity and humanity’s pursuit of knowledge about nature. It is the task of this essay to trace the development of this connection from the beginnings of Bacon’s literary career until its end. (shrink)

The aim of this paper is to address a longstanding concern about the linguistic ‘relativ- ity’ of ontological categories, and resulting limitations in the scope of ontological theo- ries. Given recent evidence on the influence of language on cognitive dispositions, do we have empirical reasons to doubt that there are ontological categories that have uni- versal scope across languages? I argue that this is the case, at least if we retain the stan- dard ‘inferential’ approach within analytical ontology, i.e., (...) if we evaluate ontological interpretations of L-sentences relative to certain material inferences in L. Research in linguistic typology suggests that types of entities postulated for the domain of Indo- European languages cannot capture the ontological commitments of the (much larger group of) non-Indo-European languages. Ontological category theory thus seems to have three options. The first option is to abandon the standard ‘inferential’ approach to ontological category theory. Alternatively, if we stay with the inferential approach, we face the following choice. Either ontology must let go of its ambitions to provide general domain descriptions for any language and settle for the more modest project of reconstructing the ontological commitments of a group of natural languages. Or else analytical ontologists should turn to linguistic typology in order to accommodate the diversity of inferential structures embedded in natural languages. I recommend and ex- plore this third option, illustrating a strategy for how to construct a domain theory that can be used across languages. In a first step I show how linguistic research on the se- mantics of verbs and nouns (studies on so-called “Aktionsarten” and “Seinsarten”) can be used to identify the inferential patterns of ten basic concepts of modes of existence in time and space. In a second step I show how these inferential data can be inter- preted ontologically within General Process Theory, an ontological framework based on nonparticular individuals (“dynamics”). -/- .
