The distinctly contemporary proliferation of pornography and hate speech poses a challenge to liberalism's traditional ideal of a 'marketplace of ideas' facilitated by state neutrality about the content of speech. This new study argues that the liberal state ought to depart from neutrality to meet this challenge.

In many spheres, the law takes the legal concept of causation to correspond to the folk concept (the correspondence assumption). Courts, including the US Supreme Court, tend to insist on the "common understanding" and that which is "natural to say" (Burrage v. United States) when it comes to expressions relating to causation, and frequently refuse to clarify the expression to juries. As recent work in psychology and experimental philosophy has uncovered, lay attributions of causation are susceptible to a great number (...) of unexpected factors, some of which seem rather peripheral to causation. One of those is the norm effect (Knobe & Fraser, 2008): Agents who, in acting as they do, break a salient norm, are more likely to be considered as having caused a certain consequence than when they do not violate a norm. According to some (e.g., Alicke, 1992) this constitutes a bias. According to others (e.g., Sytsma, 2020), the folk concept of causation is sensitive to normative factors, and there’s nothing wrong with that. In this paper, we explore the question whether the norm effect should be considered a bias from the legal perspective on the one hand, and from the psychological perspective on the other. To do this, we test whether norms which are nonpertinent to the consequences or outright silly also impact causation judgements. The data from two preregistered experiments (total N=593) clearly show they do. This, we argue, makes the bias interpretation plausible from the psychological perspective, and both plausible and problematic from the legal perspective. It also shows that the law should abstain from unreflectively assuming conceptual correspondence between legal and ordinary language concepts. (shrink)

Extant research has shown that ordinary causal judgments are sensitive to normative factors. For instance, agents who violate a norm are standardly deemed more causal than norm-conforming agents in identical situations. In this paper, we explore two competing explanations for the Norm Effect: the Responsibility View and the Bias View. According to the former, the Norm Effect arises because ordinary causal judgment is intimately intertwined with moral responsibility. According to the alternative view, the Norm Effect is the result of a (...) blame-driven bias. In a series of five preregistered experiments (N = 2688), we present evidence that predominantly favours the Bias View. In particular, and against predictions made by the Responsibility View, we show that participants deem agents who violate nonpertinent or silly norms – norms that do not relate to the outcome at hand – as more causal, and that this effect cannot be explained in terms of plausible mediators such as the agent’s foreknowledge and desire, or the foreseeability of harm. We close with a discussion regarding the implications of these findings, in as regards the just assessment of proximate cause in the law. (shrink)

The article deals with the relationship between faith and rational knowledge in modern Gaudiya Vaishnavism. It is shown that the position of modern Vaishnavas regarding revelation and critical knowledge is defined in the books of the reformer of Gaudiya Vaishnavism Bhaktivinoda Thakur. The positions of modern teachers of Gaudiya Vaishnavism – Bhaktivendanta Sadhu Swami and Dandi Maharaja are explained, the importance of their position for the development of interreligious dialogue in modern conditions is shown. The co-evolutionary concept of tri-modal stable evolutionary strategy (SESH) of Homo sapiens is developed. The concept based on the principle of evolutionary complementarity of anthropogenesis: value of evolutionary risk and evolutionary path of human evolution are defined by descriptive (evolutionary efficiency) and creative-teleological (evolutionary correctness) parameters simultaneously, that cannot be instrumental reduced to others ones. Resulting volume of both parameters define the vectors of human evolution by two gear mechanism ˗ genetic and cultural co-evolution and techno-humanitarian balance. Explanatory model and (...) methodology of evaluation of creatively teleological evolutionary risk component of NBIC technological complex is proposed. The mechanism of influence of each module on the evolution of the two remaining modules of SESH a priori can be twofold: (1) informational co-evolution (direct selective pressure); (2) semantic co-evolution (time-varying semantic code, the compliance of the biological, socio- cultural and techno-rationalist adaptive modules of human stable evolutionary strategy). More rapidly evolving autonomous element of the co-evolutionary pair becomes making sense factor for the partner. Semantic co-evolution is the discrete acquisition of adaptive significance of individual alleles by changing socio-cultural types, manifested as an increase in the genetic variability of populations of Homo sapiens, and domesticated species parallel to socio-culturogenesis. The socio- cultural landscape leads to drastically difference of direction in biological evolution of Atlantic and East-Slavic ethnicities/civilizations. (shrink)

A growing body of literature has revealed ordinary causal judgement to be sensitive to normative factors, such that a norm-violating agent is regarded more causal than their non-norm-violating counterpart. In this paper, we explore two competing explanations for this phenomenon: the Responsibility View and the Bias View. The Bias View, but not the Responsibility View, predicts features peripheral to the agent’s responsibility to impact causal attributions. In a series of three preregistered experiments (N = 1162), we present new evidence that (...) the Norm Effect arises from such peripheral features, namely from nonpertinent or entirely silly norm violations. Furthermore, we show that this effect cannot be explained by recourse to the agent’s foreknowledge or desire of the outcome, nor by its foreseeability: the Norm Effect arises even when participants judge the norm-violating agent’s doing as equally foreseeable. In a study that goes beyond the ego affirmed by Freudian psychology, David Levin offers an account of personal growth and self-fulfillment based on the development of our capacity for listening. Drawing on the work of Dewey, Piaget, Erikson, and Kohlberg, he uses the vocabulary of phenomenological psychology to distinguish four stages in this developmental process and brings us the significance of these stages for music, psychotherapy, ethics, politics, and ecology. This analysis substantiates his claim that the development of (...) our listening capacity is a process that fits Foucault's conception of a practice of the self, forming our character as social beings and moral agents. When do two sentences say the same thing, that is, express the same content? We defend two-component (2C) semantics: the view that propositional contents comprise (at least) two irreducibly distinct constituents: (1) truth-conditions and (2) subject-matter. We contrast 2C with one-component (1C) semantics, focusing on the view that subject-matter is reducible to truth-conditions. We identify exponents of this view and argue in favor of 2C. An appendix proposes a general formal template for propositional 2C semantics.

Rapid technological advancements such as fMRI have led to the rise of neuroscientific discoveries. Coupled with findings from cognitive psychology, they are claiming to have solved the millennia-old puzzle of moral cognition. If true, our societal structures – and with that the criminal law – would be gravely impacted. This thesis concerns itself with four distinct theories stemming from the disciplines above as to what mechanisms constitute moral judgement: the Stage Model by KOHLBERG, the Universal Moral Grammar Theory by MIKHAIL, (...) the Social Intuitionist Model by HAIDT, and the Dual-Process Theory by GREENE – comparing the findings of the latter to the consequentialist and retributivist theories of punishment present in the American Criminal Law Doctrine. Analysing both a direct (link to deontology) and indirect (link to incompatibilism) approach to discrediting retributivism, I come to the conclusion that while science can have an impact on our morals and thus on the law, the current state of neuroscientific findings are not capable of shattering foundational notions of the criminal law. Contemporary egalitarian liberals—unlike their classical counterparts—have lived through many contentious events where the right to freedom of expression has been tested to its limits—the Skokie, Illinois, skinhead marches, hate speech incidents on college campuses, Internet pornography and hate speech sites, Holocaust deniers, and cross-burners, to name just a few. Despite this contemporary tumult, freedom of expression has been nearly unanimously affirmed in both the U.S. jurisprudence and philosophical discourse. In what follows, I will examine Ronald Dworkin's influential contemporary justification for (...) freedom of expression, which claims that a thoroughgoing right to freedom of expression is justified by the fact that it guarantees and preserves liberalism's commitment to equality by offering everyone an opportunity to speak, whereas any other policy, such as state regulation, would fail to offer this equal opportunity. This justification has been challenged by feminists and critical race theorists, who find the cases of pornography and hate speech to be sufficient threats to the freedom of expression and equality of their targets—women and minorities—to warrant limiting freedom of expression in these cases. I will argue that if Dworkin is to take equality as seriously as he claims to, then, by his own lights, he must back away from an unrestricted freedom of expression, in light of these distinctly contemporary challenges of the harms of systemic racism and sexism, which underlie hate speech and pornography. Exploring the history of our experience, Hannah Arendt reveals not only a radical transformation of its structure, but also the loss of experience as such and its replacement with technology. In order to identify the place of law in this process, we are trying to clarify the legal aspect of experience in terms of phenomenological hermeneutics and to trace its transformation in the digital age. The experience of law is thought of as one of the aspects of our mode of (...) being-in-the-world, which is based on openness to the world and consists in the mutual recognition of people in their dignity. Digital technologies, in turn, contribute to replacing fundamental openness with illusory freedom in cyberspace. The latter, unlike the public realm as a realm of action of many, and in this sense legal realm, is based primarily on productive activities of one and no longer requires law. (shrink)

The notion is pervasive (Sect. 1 ), but elusive: it is bound to be hyperintensional (Sect. 2 ), but excessive fine-graining would trivialize it and there are reasons for some coarse-graining (Sect. 2.1 ). Conceptual limitations stand in the way of a natural algebra (Sect. 2.2 ), and it should be sensitive to subject matters (Sect. 2.3 ). A cognitively adequate individuation (...) of content may be intransitive (Sect. 3 ) due to ‘dead parrot’ series: sequences of sentences \(\varphi _1, \ldots, \varphi _n\) where adjacent \(\varphi _i\) and \(\varphi _{i+1}\) are cognitive synonyms while \(\varphi _1\) and \(\varphi _n\) are not (Sect. 3.1 ). Finding an intransitive account is hard: Fregean equipollence won’t do (Sect. 3.2 ) and a result by Leitgeb shows that it wouldn’t satisfy a minimal compositionality principle (Sect. 3.3 )._Sed contra_, there are reasons for transitivity, too (Sect. 3.4 ). I offer a new interpretation of Heidegger’s analysis of anxiety in Being and Time as an account of the relationship between individual agents and the public normative practices of their communities. According to a prominent recent interpretation, Heidegger’s discussions of anxiety, death and the “call of conscience” together explain how we can respond to the norms of our practices as reasons and subject them to critical reflection. I argue that this is only part of the story. Anxiety is an occasion (...) for Dasein to take responsibility for its ongoing activity of interpreting the possibilities for living and acting made available by the normative practices of its community, which is presupposed and overlooked from the perspective of everyday Dasein. Public normativity underdetermines Dasein’s conception of what it would mean to take up any of the possibilities available in its world as a way of living its own life. (shrink)

In this essay we argue for the Janus-faced nature of hope. We show that attempts to sanitise the concept of hope either by separating it conceptually from other phenomena such as wishful thinking, or, more generally, by seeking to minimise the negative aspects of hope, do not help us to understand the nature of hope and its functions as regards religion. Drawing on functional accounts of religion from Clifford Geertz and Tamas Pataki, who both—in their different ways—see the function of (...) religion in terms of its capacity to satisfy deep psychological needs, we demonstrate that religion uniquely positions itself with regard to hope’s two faces, simultaneously exploiting positive and negative aspects of hope. The international protest surrounding the Copenhagen Zoo’s recent decision to kill a healthy giraffe in the name of population management reveals a deep moral tension between contemporary zoological display practices—which induce zoo-goers to view certain animals as individuals, quasi-persons, or friends—and the traditional objectives of zoos, which ask us only to view animals as specimens. I argue that these zoological display practices give rise to moral obligations on the part of zoos to their visitors, and thus ground indirect duties on (...) behalf of zoos to their animals. I conclude that zoos might take on interspecies friendship as a new zoological objective. (shrink)

It has been demonstrated that parental involvement in a student's academic life improves the student's performance. Assisting with schoolwork, joining in extracurriculars, and talking to teachers are all examples of ways to get involved in the classroom. Parents who are actively interested in their children's education have been linked to improved academic performance, improved school attendance, and increased participation in advanced courses. Increased parental participation has been linked to improved school attitudes and increased academic motivation in children. A student's academic (...) performance may be hindered by socioeconomic or familial problems, yet parental participation can act as a buffer against these influences. Efforts to engage and assist parents in their child's education can have a long-lasting, beneficial effect on a student's academic and personal development, and parents' involvement plays a substantial role in students' academic outcomes. The practice of using the term “electronic governance” does not differentiate the concepts of the subject of management, that is, the three branches of government, with forms, processes and technologies of governance, which is not correct, since the use of information technology in state activities is not a top priority. On the other hand, electronic governance technologies cannot be considered separately from the automated governance processes as well as electronic governance technologies are not a supplement or an analogue of the (...) traditional state, as intended to communicate by means of electronic governance technologies to increase the efficiency of the entire system of public administration, in particular in the system of administrative services. According to the most prominent principle of early modern rationalists, the Principle of Sufficient Reason [PSR], there are no brute facts, hence, there are no facts without any explanation. Contrary to the PSR, some philosophers have argued that divine ideas are brute facts within Leibniz’s metaphysics. In this paper, I argue against brute-fact-theories of divine ideas, especially represented by Samuel Newlands in Leibniz and the Ground of Possibility, and elaborate an alternative Leibnizian theory of divine ideas.

Respect for victims requires that we have social systems for punishing and condemning (reproving) serious crimes. But, the conditions of social marginalization and political subordination of the communities from which an overwhelming number of prisoners in the United States come place serious barriers in the face of effective reprobation. Mass incarceration makes this problem worse by disrupting and disrespecting entire communities. While humanities education in the prisons is far from a total solution, it is one way to make reprobation meaningful, (...) so long as the prison classroom is a place where the educators’ values are also put at risk. We investigate the causal uncertainty surrounding the flash crash in the U.S. Treasury bond market on October 15, 2014, and the unresolved concern that no clear link has been identified between the start of the flash crash at 9:33 and the opening of the U.S. equity market at 9:30. We consider the contributory effect of mini flash crashes in equity markets, and find that the number of equity mini flash crashes in the three-minute window between market open and the Treasury (...) Flash Crash was 2.6 times larger than the number experienced in any other three-minute window in the prior ten weekdays. We argue that (a) this statistically significant finding suggests that mini flash crashes in equity markets both predicted and contributed to the October 2014 U.S. Treasury Bond Flash Crash, and (b) mini-flash crashes are important phenomena with negative externalities that deserve much greater scholarly attention. The utopian character of modern scientific theories, with the human nature as a subject, is an inevitable consequence of the presence of an imperative component of transdisciplinary human dimensional scientific knowledge. Its social function is the adaptation of the descriptive component of the theory to the given socio-cultural type that simplifies the passage of the process of social verification of the theory. The genesis of bioethics can be seen as one of the basic premises for the actualization of the anthropic (...) principle of ontology, which thus acquires the axiological and epistemological sense. This article reintroduces Fr. Zeferino González, OP (1831-1894) to scholars of Church history, philosophy, and cultural heritage. He was an alumnus of the University of Santo Tomás in Manila, a Cardinal, and a champion of the revival of Catholic Philosophy that led to the promulgation of Leo XIII’s encyclical Aeterni Patris. Specifically, this essay presents, firstly, the Cardinal’s biography in the context of his experience as a missionary in the Far East; secondly, the intellectual tradition in Santo Tomás in Manila, (...) which he carried with him until his death; and lastly, some reasons for his once-radiant memory to slip into an undeserved forgetfulness. 24 undergraduates were blindfolded and walked through paths laid out on a floor to investigate whether the orientation of Ss' cognitive maps (CMs) could be determined after they had learned a path by walking through it. Given the assumption that the CM is picturelike, it was predicted that it has a specific orientation, which implies that tests in which the CM is assumed to be aligned with the path should be less difficult than tests in which the CM is hypothesized (...) to be contraligned. In Exp I (8 Ss), Ss were required to draw a picture of the path they had walked through; in Exp II (14 Ss), Ss were required to locate targets in the path under conditions in which their presumed CMs were either aligned or contraligned with the path. Results show that, in Exp I, all Ss drew the 1st line segment of the path upward, suggesting that this part of the path was fixed in an upward direction in memory. In Exp II, Ss were more accurate and faster in locating points on the path when the CM was hypothesized to be aligned with the path than when it was hypothesized to be contraligned. (shrink)

This research aims to explore the influence of electronic word of mouth (e-WOM) on purchasing decisions using a case study of Richeese Factory consumers. The research uses a qualitative approach to uncover the factors that contribute to and strengthen consumer attitudes toward related products. Through in-depth interviews and analysis, this research aims to gain a comprehensive understanding of how e-WOM influences consumer perceptions and shapes the purchasing decision process. The results of this research suggest that Richeese Factory Kisamaun Tangerang has (...) been relatively successful in implementing e-WOM strategies to influence consumer purchasing decisions, driven by considerations such as the quantity and quality of reviews, credibility-reliability, and usefulness of reviews. The theory of evolution of complex and comprising of human systems and algorithm for its constructing are the synthesis of evolutionary epistemology, philosophical anthropology and concrete scientific empirical basis in modern (transdisciplinary) science. «Trans-disciplinary» in the context is interpreted as a completely new epistemological situation, which is fraught with the initiation of a civilizational crisis. Philosophy and ideology of technogenic civilization is based on the possibility of unambiguous demarcation of public value and descriptive scientific discourses (1), and the object and (...) subject of the cognitive process (2). Both of these attributes are no longer valid. For mass, everyday consciousness and institutional philosophical tradition it is intuitively obvious that having the ability to control the evolutionary process, Homo sapiens came close to the borders of their own biological and cultural identity. The spontaneous coevolutionary process of interaction between the «subject» (rational living organisms) and the «object» (material world), is the teleological trend of the movement towards the complete rationalization of the World as It Is, its merger with the World of Due. The stratification of the global evolutionary process into selective and semantic (teleological) coevolutionary and therefore ontologically inseparable components follows. With the entry of anthropogenic civilization into the stage of the information society, firsty, the post-academic phase of the historical evolution of scientific rationality began, the attributes of which are the specific methodology of scientific knowledge, scientific ethos and ontology. Bioethics as a phenomenon of intellectual culture represents a natural philosophical core of modern post- academic (human-dimensional) science, in which the ethical neutrality of scientific theory principle is inapplicable, and elements of public-axiological and scientific-descriptive discourses are integrated into a single logic construction. As result, hermeneutics precedes epistemology not only methodologically, but also meaningfully, and natural philosophy is regaining the status of the backbone of the theory of evolution – in an explicit form. Stable evolutionary strategy of Homo sapiens (SESH) is built in accordance with the modular and hierarchical principle and consists of the same type of self-replicating elements, i.e. is a system of systems. On the top level of the organization of SESH is the superposition of genetic, social, cultural and techno-rationalistic complexes. The components of this triad differ in the mechanism of cycles of generation - replication - transmission - fixing/elimination of adoptively relevant information. This mechanism is implemented either in accordance (...) with the Darwin-Weismann modus, or according to the Lamarck modus, the difference between them is clear from the title. The integral attribute of the system of systems including ESSH is the production of evolutionary risks. The sources of evolutionary risk for stable adaptive strategy of Homo sapiens are the imbalance of (1) the intra-genomic co-evolution (intragenomic conflicts); (2) the gene-cultural co- evolution; (3) the inter-cultural co-evolution; (4) techno-humanitarian balance; (5) inter- technological conflicts (technological traps). At least phenomenologically the components of the evolutionary risk are reversible, but in the aggregate they are in potentio irreversible destructive ones for bio-social, and cultural self-identity of Homo sapiens. When the actual evolution is the subject of a rationalist control and/or manipulation, the magnitude of the 4th and 5th components of the evolutionary risk reaches the level of existential significance. The choice of this topic is a curious one, perhaps, for art seems to be such a personal creation that even its appreciation may be relative and most of the time considered as subjective or reliant on impressions. Whether this idea is rightfully founded or not is reviewed in this paper: Is art’s meaning simply an impression? Does it come to exist merely because of whims and ecstasies? Is the experience of art such that it cannot but be dominated by (...) personal ideas? In answering these questions, I present a synthesis of some of the works of Jacques Maritain (1882–1973), a Thomist who has important insights concerning aesthetic experience. -/- Since the experience of art starts from its causes to the work’s appreciation by other people, the progression of this discussion is presented as follows: first, the concept of inspiration, to which artists usually attribute their creations, is assessed; then the aesthetic experience is reviewed to understand art’s qualities; and finally, the purpose and meaning of the artwork are examined. Levins and Lewontin have contributed significantly to our philosophical understanding of the structures, processes, and purposes of biological mathematical theorizing and modeling. Here I explore their separate and joint pleas to avoid making abstract and ideal scientific models ontologically independent by confusing or conflating our scientific models and the world. I differentiate two views of theorizing and modeling, orthodox and dialectical, in order to examine Levins and Lewontin’s, among others, advocacy of the latter view. I compare the positions of these (...) two views with respect to four points regarding ontological assumptions: (1) the origin of ontological assumptions, (2) the relation of such assumptions to the formal models of the same theory, (3) their use in integrating and negotiating different formal models of distinct theories, and (4) their employment in explanatory activity. Dialectical is here used in both its Hegelian–Marxist sense of opposition and tension between alternative positions and in its Platonic sense of dialogue between advocates of distinct theories. I investigate three case studies, from Levins and Lewontin as well as from a recent paper of mine, that show the relevance and power of the dialectical understanding of theorizing and modeling. Though there is much else in Levine's book that is also worthy of discussion, this critical study focuses exclusively on his central positive thesis that phenomenal consciousness exhibits two features that “both resist explanatory reduction to the physical: subjectivity and qualitative character” (p. 175).

This paper examines a paradigm case of allegedly successful reductive explanation, viz. the explanation of the fact that water boils at 100°C based on facts about H2O. The case figures prominently in Joseph Levine’s explanatory gap argument against physicalism. The paper studies the way the argument evolved in the writings of Levine, focusing especially on the question how the reductive explanation of boiling water figures in the argument. It will turn out that there are two versions of the explanatory gap (...) argument to be found in Levine’s writings. The earlier version relies heavily on conceptual analysis and construes reductive explanation as a process of deduction. The later version makes do without conceptual analysis and understands reductive explanations as based on theoretic reductions that are justified by explanatory power. Along the way will be shown that the bridge principles — which are being neglected in the explanatory gap literature — play a crucial role in the explanatory gap argument. (shrink)

En el contexto en el cual la ideología de género e implícito lo femenino se ha vuelto un tema que preocupa, nos proponemos una reflexión sobre cómo deberíamos entender el papel de lo femenino en nuestra sociedad contemporánea, en relación al estudio de las vidas y las ideas de dos mujeres importantes para la cultura alemana de final de siglo XVIII e inicio del siglo XIX: Caroline Schlegel y Rahel Levin Varnhagen. Cuando hablamos de pensamiento femenino, tenemos que tener (...) una mirada retrospectiva y comprender muy bien cuál ha sido el aporte de las mujeres para nuestra cultura para así saber cuál tiene que ser la dirección de nuestros debates actuales sobre el mismo. El artículo se enfoca en resaltar la importancia de la formación y el cultivo de las capacidades espirituales de estas dos mujeres que lograron en su época volverse figuras muy respetadas y apreciadas por los grandes filósofos románticos, con la intención de transmitir que la “cuestión femenina” no se puede reducir a un asunto de meros derechos y política, sino que tiene que ver con la labor y la tarea que la mujer tiene de asumir las potencias de sus cualidades y usar su inteligencia para edificar nuestra cultura. In a work recently published as part of the Cambridge Elements series, Janet Levin brings together the most important contemporary theories that attempt to answer the question of the mental. In her book, The Metaphysics of Mind (2022), she acknowledges that the metaphysical questions surrounding the mind should be distinguished from the epistemological and moral ones. While taking into consideration the implications of the epistemological and moral questions for the metaphysics of mind, Levin focuses primarily on the metaphysical (...) questions. To accomplish the task at hand, she analyzes Dualism, Type-Identity Theory, Role Functionalism, Russellian Monism, and Eliminativism (or Illusionism). As she makes clear at the outset of her book, the aim of her text is not to argue for or against a certain metaphysical theory of mind, but rather to assess the merits and demerits of each theory objectively. A good metaphysics of mind should account for certain elements that are taken to be key to the controversy over the mental. These elements range from the qualitative character of sensations and perceptual experiences, the outer-directedness of intentional states (beliefs, desires, etc.) to — basically— the space the mind occupies in nature as a whole. In this piece, I review each theory of mind separately, as approached by Levin. Then I conclude my review with some critical remarks about the book. (shrink)

The Vienna Circle was a group of scientifically-minded philosophers, many physicists by training, who in the 1920s and 30s developed the cluster of philosophical doctrines known as Logical Positivism. Among the Circle’s most distinguished members were Rudolf Carnap and Herbert Feigl, each of whom emigrated to America during the Nazi era. It is said that Feigl, the author of an important 1958 monograph defending a materialist approach to the mind-body problem, once gave a visiting lecture on the problem of consciousness (...) at UCLA, where Carnap was teaching. Feigl argued that although there were good reasons for believing that the mind is fundamentally physical, the physical explanation of the ‘qualia’ of sensory experience – the ineffable sensory qualities involved in, say, smelling coffee – was still a mystery to science. Now the story becomes apocryphal. Carnap is supposed to have interrupted, ‘But Feigl, there is something missing from your lecture. Science is beginning to explain qualia in terms of the alpha factor!’. We can imagine Feigl somewhat alarmed by this interjection from the great Carnap: ‘But Carnap, please tell me: what is the alpha factor?’. ‘Well, Feigl’ Carnap replied ‘if you tell me what qualia are, I’ll tell you what the alpha factor is’. William Whewell’s 19th century philosophy of science is sometimes glossed over as a footnote to Kant. There is however a key feature of Whewell’s account worth noting. This is his appeal to Aristotle’s form/matter hylomorphism as a metaphor to explain how mind and world merge in successful scientific inquiry. Whewell’s hylomorphism suggests a middle way between rationalism and empiricism reminiscent of experience pragmatists like Steven Levine’s view that mind and world are entwined in experience. I argue however that Levine does (...) not adequately explain exactly how mind and world entwine. He could nonetheless do so if he appealed to Whewell’s hylomorphic metaphor. We may prefer a reductive metaphysical explanation, but I suggest that pragmatists only have recourse to metaphor in this case. Both reductive and metaphorical explanations can enjoy great explanatory power if they exhibit a suitable measure of what I will call sematic distance. Semantic distance measures how close or how far apart explanandum and explanans are from each other in meaning. Metaphorical explanation - as evident in Whewell’s hylomorphism and as detailed via the notion of semantic distance - presents a valuable new explanatory tool to those who hold that mind and world are entwined sans recourse to metaphysics. James Levine has recently argued that there is a tension between Russell’s Moorean semantical framework and Russell’s Peano-inspired analytical practice. According to Levine, this discrepancy runs deep in Russell’s thought from 1900 to 1918, and underlies many of the doctrinal changes occurring during this period. In this paper, I suggest that, contrary to what Levine claims, there is no incompatibility between Moore’s theory of meaning and the idea of informative conceptual analysis. I show this by relating Moore’s view of meaning (...) to his Sidgwick-inspired criticism of the so-called naturalistic fallacy. I maintain that Moore’s semantical framework has a methodological intent: following Sidgwick, Moore wants to block any attempt to justify ethical principles through setting ad hoc conditions on the meaning of the terms involved. Thus, far from grounding philosophical knowledge on subjective intuitions, as Levine suggests, Moore’s framework would provide us with the means to make room for a discursive and dialectic conception of philosophical inquiry. Punishment involves the intentional infliction of harm and suffering. Both of the most prominent families of justifications of punishment – retributivism and consequentialism – face several moral concerns that are hard to overcome. Moreover, the effectiveness of current criminal punishment methods in ensuring society’s safety is seriously undermined by empirical research. Thus, it appears to be a moral imperative for a modern and humane society to seek alternative means of administering justice. The special issue of Diametros “The Abolition of Punishment: (...) Is a Non-Punitive Criminal Justice System Ethically Justified?” was brought into life precisely to give the authors a platform for such progressive inquiries. And it is now safe to say that this platform has been put to excellent use, since Valerij Zisman, Alexander Stachurski, Giorgia Brucato, Perica Jovchevski, Sofia M. I. Jeppsson, Stephen G. Morris, Benjamin Vilhauer, John Lemos, Saul Smilansky, Elizabeth Shaw, Mirko Farina, Andrea Lavazza and Sergei Levin have presented such thought-provoking texts that they are bound to set the stage for debate in the years to come. This article is an introduction to this special issue and to the authors’ papers. (shrink)

The economist David K. Levine claims that if a government of a country makes torture legal, the inevitable result will be torture that is out of control. I point out an inconsistency in his approach to torture. I then argue that we should be open to rare counterexamples to his claim and describe a kind of counterexample.

This paper is an essay in what Austin (_Proc Aristotel Soc_ 57: 1–30, 1956–1957) called "linguistic phenomenology". Its focus is on showing how the grammatical features of ordinary causal verbs, as revealed in the kinds of linguistic constructions they can figure in, can shed light on the nature of the processes that these verbs are used to describe. Specifically, drawing on the comprehensive classification of English verbs founds in Levin (_English verb classes and alternations: a preliminary investigation_, University of (...) Chicago Press, Chicago, 1993), I divide the forms of productive causal processes into five classes, corresponding to Aristotle's ontological categories: there are processes that cause change in location, in state, and in quantity; and that lead to the creation and destruction of substances. These broader categories are then subdivided into other ones, corresponding to different Levin classes, according to further differences in the causal processes they involve. I conclude by discussing the relevance of this argument to research in metaphysics and experimental philosophy. (shrink)
