The article focuses on the cartographic enactment of the topos of Ukraine as a lost homeland in contemporary German literary discourse on migration, and in particular in the body of work that conveys the voices of the “second generation” — children of the German (post-)war migration. The article analyses by way of an illustrative example Hans-Ulrich Treichel’s poem “Flight into Kyiv,” in which we find reflected the autobiographical theme of the (re)construction of the lost homeland of his father, a Volyn (...) German who fled to Germany during the Second World War to escape reprisals of the Soviet army. The main object of research are the mental maps of Ukrainian space, which largely define the way Ukraine is represented both in contemporary German social discourse and in modern German literature. A textual analysis of the poem allows us to discern how the resource of the Western European construct of Eastern Europe is instrumentalized and aesthetically arranged by German (post)migration perception to institutionalize the image of Ukraine as a “lost homeland.”. Many countries in Eastern Europe, during the 1960–1970s, as well as Albania responded to the growing demand for new houses utilizing the emerging trends for industrialization of the construction process and mass construction of prefabricated residential buildings based on large-panel prefabricated RC elements. During the 1970s large-panel buildings spread throughout the country and became the main type of construction in the Albanian cities such as Shkodër, Tirana, Durrës, Elbasan, Berat, etc. Most of these buildings have five or six (...) stories and comprise different modules, the number of which depends on the urban and architectonic projects. The construction technology of these types of buildings included only the construction of prefabricated reinforced concrete material and did not take into account the energy performance of these structures. Since the moment of construction, only in the last year, several interventions have been made in different cities where a layer of polystyrene has been placed on the external walls of these buildings in order to enhance their thermal insulation. The aim of this paper is to improve the thermal performance of these buildings by introducing a comparison of their initial situation as they are today and how their performance would be if innovative technologies and materials were applied. The study is going to analyse the thermal performance of the existing buildings, by means of the thermal camera in the city of Kamez, located in Tirana, which has been chosen as a key study. Furthermore, the data obtained from the MEEC application are gathered, in order to compare the previous, the existing situation and the proposed intervention. The results may be used by municipalities of different cities, not only in the Albanian context, either where interventions have been made to improve their performance, or for municipalities where thermal regulation policies have not been yet implemented for these types of buildings. The existing situation of the buildings according to the calculations, showed a poor thermal performance, regardless of the fact that they are already equipped with thermal insulation building envelope. They have to be requalified in order to be categorized as a building with high thermal performance. (shrink)

The chapter aims to introduce an integrated approach to concepts of smart cities and age-friendly cities and communities. Although these ideas are widely promoted by the European Union and the World Health Organisation, they are perceived as separate. Meanwhile, these concepts are closely intermingled in theory and practise concerning the promotion of healthy and active ageing, a universal design, usability and accessibility of age-friendly environments, reducing of the digital divide and robotic divide, and reducing of older adults’ social isolation. The (...) conclusion underlines the need for participatory creation of ambient assisted living technologies and applications with older adults and the need for advocacy to promote AAL in the context of the silver economy especially in the Central and Eastern Europe. Publication ethics is an important aspect of both the research and publication enterprises. It is particularly important in the field of biomedical science because published data may directly affect human health. In this article, we examine publication ethics policies in biomedical journals published in Central and Eastern Europe. We were interested in possible differences between East European countries that are members of the European Union (Eastern EU) and South-East European countries (South-East Europe) that are not members (...) of the European Union.The most common ethical issues addressed by all journals in the region were redundant publication, peer review process, and copyright or licensing details. Image manipulation, editors’ conflicts of interest and registration of clinical trialswere the least common ethical policies. Three aspects were significantly morecommon in journals published outside the EU: statements on the endorsement of international editorial standards, contributorship policy, and image manipulation.On the other hand, copyright or licensing information were more prevalent in journals published in the Eastern EU. The existence of significant differences amongbiomedical journals’ ethical policies calls for further research and active measuresto harmonize policies across journals. Populism in Central-Eastern Europe and South-Eastern Europe has been framed through theoretical ideas and expectations based on West European experience. However, the region’s experience of populist politics has diverged from that of Western Europe in important ways. In older West European democracies, the most typical vehicle for populism are, for the moment, new or previously marginal illiberal challenger parties which confront an essentially liberal, non-populist mainstream. In Central-Eastern Europe and South-Eastern Europe, (...) it is the “mainstream” which is or has become populist. Therefore, it is important to elaborate which of these universal indicators of populism can be applied to the countries of Central and Eastern Europe and Western Balkans, and what kind of particularities will crystallize as a consequence of the socialist background. The main aim of the conference is to gather scholars that are researching different aspects and manifestations of populism in the region. This conference is organized in the framework of POPREBEL project, which has received funding from the European Union’s Horizon 2020 research and innovation programme under grant agreement No 822682. The most important voices concerning the changes now occurring in Central and Eastem Europe are those that come from within, for those voices are informed not only by indifferent data and objective reports, but by personal hopes, fears, desires and needs. Without careful consideration of what such voices say, judgment can only be sterile. Furthermore, policy decisions made without the benefit of the intemal perspective are likely to be flawed, and ineffectual. Policies won’t work if they do not take (...) into account the point of view of those who are supposed to be affected by them. There nevertheless remains an important role for outsiders to play in the discussion of the impact of political change on the future of philosophical thought, especially if the outside perspective can serve as a test of the internal view. The idea of Europe has already a long history and beyond its ethical attractiveness it became victorious in the political praxis of the 2nd half of the 20th century first of all as a motive force serving the aim of a long-term restoration of peace in the post-war Western Europe and then as a unifying principle for the whole continent after the collapse (implosion) of “really existing socialism”. A little later, in the course of the expansion of the (...) free market economy towards the previously centralized economies of Eastern Europe it soon became obvious that the idea of Europe was not everywhere interpreted the same way and that in some cases it seemed to cause more problems than the ones it should have solved. Especially the current refugee crisis that has initially emerged in the so-called developing world outside of Europe but nevertheless significantly affects the Old Continent can be seen as a major theoretical and practical challenge around the fundamental sustaining (and in itself sustainable) concept of European openness: i.e. in order to remain open in its internal function the liberally organized Europe has to close its outer borders and to decisively limit the access of many humans to its single common market, thus imposing obstacles to the generalization of prosperity and liberty that once were felt as its core values. We will try to show that apart from the immediate cultural, ideological and strategic aspects of such phenomena and the often unavoidable pitfalls of short-term decision making it is important to study and explore the necessity of the current processes. The idea of Europe became, at least partly, synonymous with the overall economical and social globalization of our times whereas such a major process cannot unfold its inherent dynamic without the constitutive role of certain crises that eventually pose existential challenges or otherwise enable the stabilization of the newly emerging system(s). The journey of Byzantine scholar Manuel Chrysoloras and his stay in Florence at the turn of the fourteenth and fifteenth centuries has been celebrated as an event that decisively shaped the course of European humanism. The later return of Enlightenment humanism to Ottoman lands in the eighteenth to early twentieth centuries can be described as the return of Chrysoloras. This return is generally known in a fragmentary form as a regional phenomenon: the story of Greek, Arab, Turkish and Jewish nationalisms (...) and of the Ottoman reforms. It is also framed historically as the evolution from a traditional and theological society to new forms of epistemic, literary, civic and national communities, while often leaving aside failures and later contradictory transformations. The present essay offers an integrative study of modern humanism in late Ottoman and post-Ottoman contexts. The migration of Enlightenment humanism to the Middle East raised a wide range of expectations, projecting a new national or imperial organization within a harmonious diplomatic relationship with Christian Europe and the Americas. Yet, the more the revivalist and reformist projects evolved, the more they involved ethnic and religious conflicts and colonial intervention. This article illuminates the rise and fall of humanism in Middle Eastern contexts. (shrink)

Three concrete instances of modern and contemporary art development in the former Soviet bloc are addressed in the study. Comparing three particular cases of post-socialist countries (Czechoslovakia, Poland and Lithuania), three distinctive situations are identified in order to establish a link between modern and contemporary art and the emergence of canonized stories of their development. Although these concrete cases turned out to represent a certain range of situations-models that have taken place, the study indicates a variety of omissions and unrecognized (...) vital moments in the currently prevailing canons, which puts the connection of the shifting point of 1989 and the transition from modern to contemporary art into a new light. ‘Justice’ is spoken of in two ways: the lawful and the fair. The law is a human construct that is devoted to the advantage of all, or to the advantage of the best, or to the advantage of those in power or to the advantage of those representing it – let it be the politician, the media, the TV presenter, the filmmaker. Thus, the law serves the production or the preservation of happiness within politics and business. The law commands (...) us to act according to the mean. A well-written law follows the mean well and a poorly written law does not. On the other hand, fairness is a principle sometimes materialised through the law and the given justice system. Fairness is the ultimate value pursued by both the common law and civil law traditions. However, its distribution through the law and the representation of this delivery varies. Does this mean that a different kind of justice is distributed? Through the teachings of Aristotle, this essay aims to deconstruct the notion of justice, by breaking down its two ingredients, the lawful and the fair, and by analysing the effect of their representation in modern European society. The relativity attached to the notion of justice is not a modern phenomenon, but a philosophical matter that can be analysed and indeed explained through the teachings of Aristotle and its contemporary students. The analysis will be developed in the context of convergent Europe, focusing on the role of the media and courts especially in relation to criminal justice. (shrink)

Lisa Zunshine stayed at Hotel Laxmi Park at Bishnupur, I do not know whether that hotel exists now or not. I sparred with Rukmani Bhaya Nair at an international literary meet at Dehradun in 2017 and I have that video. In this hurriedly written essay for an FDP conducted by a Central University in India in collaboration with a College in New Delhi, I point out the need to distinguish between philosophy and darśana while accessing the corpus of Raja Rao. (...) Zunshine in her work on literature and cognitive studies and, Bhaya Nair in her mimetic mode disregards Eastern hermeneutics to read all Indian authors in English. This essay which is not proofread, nor intended for publication shows the sorry state of Indian letters in English today. Indian scholars of Indian literatures in English do not refer to Indian thinkers but rush into aping their Western dole-givers. Therefore, I turn to Arif Dirlik's work on Third world scholars in the First world and make a case for rethinking the methodologies in approaching Indian letters in English. This author hopes that others in the future will not simply quote Plato to understand Raja Rao. (And, he was awarded an A+ for this work.) Both Zunshine and Nair effect an elision of everything Indic from world and Indian letters respectively. (shrink)

The article discloses the problem of distributing state financial support based on an integrated approach. The study has proved the urgency and necessity of state support for the lowest priority territorial units (regions). It answers the research question of what components need to be included in the methodology for determining state financial support. A comprehensive method for estimating the share of public funds is proposed, taking into account the investment attractiveness of a region (oblast) and the risk of the corresponding (...) region (oblast). To achieve this goal, the following general scientific and special methods and research techniques were used in the work, such as comparative analysis of scientific literature and information sources based on methods of comparison, systematization, and generalization; generalization of the analysis results, as well as logical generation of conclusions and integral assessment. -/- Since the problem of financing the construction and reconstruction of bridges is relevant for a number of countries, this technique was tested using an example of bridge construction. -/- According to the obtained results, territorial units (regions) that are not leaders in priority for the investor and have a high level of riskiness of investing financial resources become eligible for state financial support. The problem of financing such regions can be solved only through state support. The results of calculations show that the distribution of financial resources with the available volume of public finances K=1 allocated for support is carried out proportionally. An integrated approach made it possible to identify 10 territorial units (oblasts) for funding, with the oblasts with the worst priority factors receiving the largest share of state financial support. -/- This study is of practical interest to government agencies in the distribution of public funds, and it is of theoretical importance to researchers dealing with issues of financial security and public administration. Our sense in editing this book is that the years since 2014 have shown that, however unpalatable, incoherent, and internally contradictory illiberal democracy may be, it is a political choice that is available at the ballot box in many countries. As critical scholars committed to democracy we have an obligation to understand its socio-historical construction, its emotional appeal, and its rhetorical force, to more effectively combat it. Ultimately, we believe that the difficulty many have had of admitting the political efficacy (...) of illiberal democracy as a term is due to an underlying crisis within liberalism itself: this is the fissured terrain that the phenomenon exploits. Examining illiberalism, liberalism, or democracy as static concepts is just as barren an approach as examining them in one country in isolation from their interactions with others. It is above all to the dynamic, comparative, and interdisciplinary approach to the study of liberalism and its alternatives that this collection aims to contribute. (shrink)

Academic freedom is under attack, both in authoritarian democracies, such as Hungary and Turkey, and in liberal Western democracies, such as the United States, the UK, France and Germany. For example, Gender Studies are being targeted by right-wing governments in Eastern Europe, and in France President Emmanuel Macron has attacked post-colonial and critical theories as “Islamo-gauchisme“, portraying them as a danger to the Republic. However, dominant discourses about academic freedom and free speech in the global north, lately especially (...) in France and Germany, focus on an alleged threat to academic freedom through “political correctness” and “cancel culture”, that, under scrutiny, often turn out to be exactly the opposite, namely defences of plurality and critical voices. One of the purposes of the Bologna Process was to facilitate the construction of a Europe of Knowledge through educational governance, yet it fails to reach its purpose because of several unexplained assumptions that undermine the conceptual standing of the whole project; it is the purpose of this paper to bring these assumptions to light. -/- A knowledge economy cannot exist without the knowledge workers which were previously formed in educational institutions, therefore the project for a Europe of (...) Knowledge is usually linked with the educational policies especially those affecting the higher education institutions. -/- One such policy area is the Bologna Process which explicitly traces its purpose to the construction of an educational system that will facilitate the smooth delivery of employable graduates to the European labor market. This presentation has two purposes. First to show through a textual analysis of the Bologna ministerial declarations how the subject of higher education is constructed to single out the European citizen, understood in a narrow sense as the employable, mobile and skilled graduate. Second, to show that the notion of citizenship used in the Bologna declarations is ill-construed. -/- Starting from T. H. Marshall’s classical distinction between the three understandings of citizenship (civic, political, and social), this paper will show that the Bologna discourse on citizenship borrows and mixes illegitimately from the three notions, without making it explicit why such a hybrid notion of citizenship is used in the first place. The East European region has always created a space of interaction between the great powers of the Eastern and Western Europe of the different epochs in European history. Not just a contact and an interaction region between Europe, Asia and the Middle East (Africa), but also a pivot of the European security environment, most often forming a real axis on which this scene of confrontation between powers can bend into one or the other part. We can say (...) that the Eastern European region has formed hundreds of years ago (with the emergence of Ottoman power and its pressure on the Western powers, the emergence of the Tsarist and later Soviet power) a pivotal axis which determined the geopolitical configuration of the world and led successively to the advancement or decay of an empire or another. Indeed, the balance between Western powers and the Ottoman Empire, and later between the Austro-Hungarian Empire and the Eastern Powers, such as the Ottoman Empire and the Tsarist Empire, has been established for several hundred years right in this pivotal axis of Eastern Europe. For this reason, the political and military situation of the territories covered by the pivotal axis have always been a special one. This pivotal axis of Europe started from the Baltic Sea and was generally disposed over the continental strip where today are countries like Estonia, Latvia and Lithuania, a part of Poland (Pomerania and a part of Silesia), the Czech Republic, the western part of today Romania and a part of Serbia. This geographical positioning of the pivotal axis has led to a permanent political turmoil and change of borders in the mentioned regions. Referring exclusively to the manner in which this pivot axis intersected the current territory of Romania, we observe that in its passage from north to south it included Satu Mare, Oradea, Arad, Timişoara and Reşita. Oradea has always played an important role in Central-Eastern Europe, NATO recognizing the NATO HUMINT Centre of Excellence (HCOE) as a strategical organization with a remarkable contribution to the development of the Human Intelligence capability within the Alliance. When Neil MacCormick, in the wake of the launch of the Maastricht Treaty on European Union, went “beyond the Sovereign State” in 1993, he fundamentally challenged the heretofore dominant paradigm of legal ordering in the European context which considered law to be singular, unified and confined within sovereign nation states. The original insight of MacCormick might, however, be pushed even further, as a historical re-construction reveals that legal pluralism is not only a trademark of recent historical times, marked by the (...) European integration process, but has also been at the very core of legal evolution in Europe throughout its modern history. The introduction of modern law in Europe can be traced back to the eleventh and twelfth century Investiture Conflict between the Church and the Emperor, a conflict which solidified the existence of two parallel universes of law, one Church-based and one empire-based, both of which rested, in principle, upon mutually exclusive claims to superiority, but which nonetheless became institutionally stabilized in a manner which allowed for mutual co-existence between them. The existence of such parallel universes of law has throughout, also in the “Westphalian world”, been a central characteristic of European law. It is suggested that the current constellation between the EU and its Member States should be viewed in this light. (shrink)

The founding fathers of neoliberalism are usually imagined as very rational neoclassical economists uninterested in cultural and religious issues. The aim of this paper is to paint a different picture by discussing the ideas of (neo)liberal economists regarding spiritual heritage, with an emphasis on eastern religions. Starting from the existing historiographical debate on the role of Daoist notions in the birth of political economy in 18th-century Europe, as an example of cultural transfer par excellence, argumentation develops into a (...) comparative analysis of philosophical underpinnings of modern laissez-faire liberalism and neoliberalism. The main thesis of the paper is that important epistemological differences between analysed doctrines imply the differences in the attitude of modern economic liberalism towards religion, which is demonstrated via examples of appropriations and translations of eastern heritage. This is a preliminary analysis but with the potential to shed new light on the political theology of contemporary culture and neoliberalism itself. (shrink)

The human attempts to access, measure and organize physical phenomena have led to a manifold construction of mathematical and physical spaces. We will survey the evolution of geometries from Euclid to the Algebraic Geometry of the 20th century. The role of Persian/Arabic Algebra in this transition and its Western symbolic development is emphasized. In this relation, we will also discuss changes in the ontological attitudes toward mathematics and its applications. Historically, the encounter of geometric and algebraic perspectives enriched the mathematical (...) practices and their foundations. Yet, the collapse of Euclidean certitudes, of over 2300 years, and the crisis in the mathematical analysis of the 19th century, led to the exclusion of “geometric judgments” from the foundations of Mathematics. After the success and the limits of the logico-formal analysis, it is necessary to broaden our foundational tools and re-examine the interactions with natural sciences. In particular, the way the geometric and algebraic approaches organize knowledge is analyzed as a cross-disciplinary and cross-cultural issue and will be examined in Mathematical Physics and Biology. We finally discuss how the current notions of mathematical (phase) “space” should be revisited for the purposes of life sciences. (shrink)

some years, the German public has been debating the case of migrant workers receiving German benefits for children living abroad, which has been scandalised as a case of “benefit tourism.” This points to a failure to recognise a striking imbalance between the output of the German welfare state to migrants and the input it receives from migrant domestic workers. In this article I discuss how this input is being rendered invisible or at least underappreciated by sexist, racist, and classist practices (...) of othering. To illustrate the point, I will use examples from two empirical research projects that looked into how families in Germany outsource various forms of reproductive work to both female and male migrants from Eastern Europe. Drawing on the concept of othering developed in feminist and postcolonial literature and their ideas of how priv‐ ileges and disadvantages are interconnected, I will put this example into the context of literature on racism, gender, and care work migration. I show how migrant workers fail to live up to the normative standards of work, family life, and gender relations and norms set by a sedentary society. A complex interaction of supposedly “natural” and “objective” differences between “us” and “them” are at work to justify everyday discrimination against migrants and their institutional exclusion. These processes are also reflected in current political and public debates on the commodification and transnationalisation of care. (shrink)

This article suggests theoretical and methodological approach to corporate control system formation in Eastern Europe (case study of Ukraine). It considers historical and controversial aspects of corporate control implementation and suggests the systematization of subjects and objects in terms of corrective actions and outlines of corporate relations. Existing types of corporate control in Ukraine have been investigated on the basis of legal and regulatory framework and corporate practice. The purpose of the article is to develop a methodology for alternative substantiation of financial support for bridge construction. To achieve the purpose, the following general scientific and special methods and techniques of research were used: “golden ratio” rule; systematization and generalization; generalization of the results of the analysis and the logical generation of conclusions. Initially, the article analyzed the state of bridge structures in Europe and Ukraine. Based on the analysis, a disappointing situation has been identified, namely that (...) a significant ratio of bridges number require major overhaul or are in critical condition. During the research, the following tasks were solved, namely: physical wear of the bridge as a failure was considered; the feasibility of investing in reconstruction or new bridge construction was determined. For the purpose of rational use of financial resources, which are limited in the age of economic challenges, and on the basis of the rule of “golden proportion”, the maximum percentage of investment in reconstruction is determined. If the limit is exceeded, it is decided to build a new bridge. This result allows making an economically sound decision and evaluating the effectiveness of the invested resources. It is proved that if the wear index of the overhaul bridge construction is higher than the wear rate of the new bridge construction by λ2 / λ1, and the amount of funds for overhaul reaches 70% of the funds needed to build a new one, it is better to build a new bridge. Theoretically grounded in queer death studies and environmental humanities, this article has a twofold aim. Firstly, it explores the somatechnics of environmental violence in the context of Northern and Eastern Europe, while paying attention to ongoing ecocide inflicted by Russia on Ukraine, and to the post-WW2 chemical weapon dumps in the Baltic Sea. Secondly, the article examines the concept of eco-grief in its close relation to artistic narratives on ecocide. By bridging the discussion on environmental violence and artistic (...) renderings of eco-grief, the article hopes to contribute to a better understanding of the socio-cultural responses to more-than-human death and loss, and their accompanying ethical imaginaries and affordances. Structuralism can be defined as an important concept of using “units” as elements of form and space-giving, where the whole form is made not only up of a “texture”, a certain flexible grid, or an algorithm of shape-giving, but it depends also on the relationships created and how people use it. The hypothesis of this study is that “Modular Construction” can also have an aesthetically pleasing outlook and that modular housing can definitely have increasing importance in the future. Modular housing (...) due to its cheap, and manufactural way of construction can be replicable in various locations. Structuralism and Modular Construction have been at the core of the Modernist movement. Although postmodernism marked the decline of modular construction adopting methods known for a more close sense of place, vernacular, and locality, which differs from the ubiquitous model of modernism, it is the universality of space and habitation seen since the times of Hippodamus Grid, Japanese Tattami systems, and rational universal space in housing known in Europe that make grid and modular design an excellent system in obtaining, rationality, functionality, flexibility, and energy efficiency, including quick construction and possibility for replication. Arthur Kaufmann is one of the most prominent figures among the contemporary philosophers of law in German speaking countries. For many years he was a director of the Institute of Philosophy of Law and Computer Sciences for Law at the University in Munich. Presently, he is a retired professor of this university. Rare in the contemporary legal thought, Arthur Kaufmann's philosophy of law is one with the highest ambitions — it aspires to pinpoint the ultimate foundations of law by explicitly (...) proposing an ontology, a general theory of knowledge and concept of a person. Kaufmann's work derives, first of all, from the thinking of Gustav Radburch, his teacher, and then from ideas of Karl Engish and Hans-Georg Gadamer. The philosophy undertakes to pursue the ultimate foundation of law, law which is understood by Kaufmann, first of all, as a "concrete judgement" that is, what is right in a concrete situation. Justice belongs to the essence of law and "unjust law" is contradictio in adiectio. Kaufmann opposes all those theories, which as the only foundation for establishing just law (Recht) adopt legal norms (Gesetz). In Kaufmann's opinion , such theories are powerless in the face of all types of distortions of law rendered by political forces. He suggests that the basic phenomenon which needs to be explained and which cannot be disregarded by a philosopher of law is so-called "legal lawlessness" ("Gestzliches Unrecht"). "Legal lawlessness" which forms a part of life experience for the people of twentieth century totalitarian states. It proved "with the accuracy of scientific experiment" that the reality of law consists of something more than bare conformity with legal norms. The existence of lex corrupta indicates that law contains something "non-dispositive" which requires acknowledgment of both law-maker and judge. Kaufmann, accepting the convergent concept of truth and cognition, assumes that "non-dispositive" content, emerging as the conformity of a number of cognitive acts of different subjects (inter-subjective communicativeness and verifiability), indicates the presence of being in this cognition. The questions "What is law?" and "What are the principles of a just solution?" lead straight to the ontology of law, to the question about the ontological foundations of law. Kaufmann discerns the ontological foundations of law in the specifically understood "nature of things" and, ultimately, in a "person". He proposes a procedural theory of justice, founded on a "person". In my work, I undertake to reconstruct the train of thought which led Kaufmann to the recognition of a "person" as the ontological foundation of law. In the first part, the conception of philosophy adopted by Kaufmann, initial characteristics of law — of reality which is the subject of analysis, as well as, the requirements for proper philosophical explanation of law posed by Kaufmann are introduced. In the second, Kaufmann's reconstruction of the process of the realisation of law is presented. Next, the conception of analogy which Kaufmann uses when explaining law is analyzed. In the fourth part, Kaufmann's conception of ontological foundations of law is discussed. A critical analysis is carried out in which I demonstrate that the theory of the ontological foundation of law proposed by Kaufmann and the concept of a person included in it do not allow a satisfac¬tory explanation of the phenomenon of "legal lawlessness" and lead to a number of difficulties in the philosophical explanation of law. Finally, the perspectives of a proper formulation of the issue of the ontological foundations of law are drafted in the context of the analyzed theory. My interest is centered on the conception of philosophy adopted by Kaufmann, according to which the existence of the reality is inferred on the basis of a certain configuration of the content of consciousness, whereas at the point of departure of philosophy of law, the data to be explained is a certain process, which is, basically, a process of cognition, while the reality appears only as a condition for the possibility of the occurrence of the process. I wish to argue that the difficulties which appear in the explanation of law are a consequence of the assumed fundamental philosophical solu¬tions, which seem to be characteristic, though usually not assumed explicitly, in philoso¬phy and theory of law dominant at present in continental Europe. Thereby, I wish to show the significance of ontological and epistemological solutions to the possibility of a proper formulation of the problems posed by philosophy and theory of law. Kaufmann proclaims himself in favour of a philosophy which poses questions about the ultimate foundations of understanding of the reality. In epistemology, he assumes that answers to the questions "What is reality like?" and ultimately "What is real?" are inferred on the basis of uniformity of a cognitive acts of different subjects. Cognition of the reality is accomplished exclusively through the content of conceptual material. The two fundamental questions posed by philosophy of law are "What is just law?" and "How is the just law enacted?" The latter is a question about the process of achieving a solution to a concrete case. Since, in Kaufmann's opinion, law does not exist apart from the process of its realisation, an answer to the question about the manner of realisation of law is of fundamental significance to answering the question: "What is law?" and to the explanation of the question about the ontological grounding of law, which is, as well, the foundation of justice. The proper solution has to take into account the moment of "non-dispositive" content of law; its positiveness understood as the reality and, at the same time, it has to point to the principles of the historical transformation of the content. Law, in the primary meaning of the word, always pertains, in Kaufmann's opinion, to a concrete case. A legal norm is solely the "possibility" of law and the entirely real law is ipsa res iusta, that which is just in a given situation. Determination of what is just takes place in a certain type of process performed by a judge (or by man confronted with a choice). Kaufmann aims to reconstruct this process. A question about the ontological foundation of law is a question about the ontological foundations of this process. In the analyzed theory it is formulated as a question about the transcendental conditions, necessary for the possibility of the occurrence of the process: how the reality should be thought to make possible the reconstructed process of the realisation of law. Kaufmann rejects the model for finding a concrete solution based on simple subsump¬tion and proposes a model in which concrete law ensues, based on inference by analogy, through the process of "bringing to conformity" that which is normative with that which is factual. Kaufmann distinguishes three levels in the process of the realisation of law. On the highest level, there are the fundamental legal principles, on the second legal norms, on the third — concrete solutions. The fundamental principles of law are general inasmuch as they cannot be "applied" directly to concrete conditions of life, however, they play an important part in establishing norms. A judge encounters a concrete situation and a system of legal norms. A life situation and norms are situated on inherently different levels of factuality and normativeness. In order to acquire a definite law both a norm (system of norms) and a life situation (Lebenssachverhalt) should undergo a kind of "treatment" which would allow a mutual conformity to be brought to them. Legal norms and definite conditions of life come together in the process of analogical inference in which the "factual state" ("Tatbestand") — which represents a norm, and in the "state of things" ("Sachverhalt") — which represents a specific situation are constructed. A "factual state" is a sense interpreted from a norm with respect to specific conditions of life. The "state of things" is a sense constructed on the basis of concrete conditions of life with respect to norms (system of norms). Legal norms and concrete conditions of life meet in one common sense established during the process of realisation of law. Mutatis mutandis the same refers to the process of composition of legal norms: as the acquisition of concrete law consists in a mutual "synchronization" of norms and concrete conditions of life, so acquisition of legal norms consists of bringing to conformity fundamental principles and possible conditions of life. According to Kaufmann, both of these processes are based on inference through analogy. As this inference is the heart of these processes it is simultaneously a foundation finding just law and justice. How does Kaufmann understand such an inference? As the basis for all justice he assumes a specifically interpreted distributive justice grounded on proportionality. Equality of relations is required between life conditions and their normative qualification. Concrete conditions of life are ascribed normative qualification not through simple application of a general norm. More likely, when we look for a solution we go from one concrete normative qualified case to another, through already known "applications" of norms to a new "application". The relation between life conditions and their normative qualifica¬tion has to be proportional to other, earlier or possible (thought of) assignments of that which is factual to that which is normative. Law as a whole does not consist of a set of norms, but only of a unity of relations. Since law is a, based on proportion, relative unity of a norm and conditions of life, in order to explain law in philosophical manner, the question about ontological base of this unity has to be asked. What is it that makes the relation between a norm and conditions of life "non-dispositive"? What is the basis for such an interpretation of a norm and case which makes it possible to bring a norm and conditions of life into mutual "conformity"? This is a question about a third thing (next to norms and conditions of life), with respect to which the relative identity between a norm and conditions of life occurs, about the intermediary between that which is normative and that which is factual and which provides for the process of establishing of norms, as well as, finding solutions. It is the "sense" in which the idea of law or legal norm and conditions of life have to be identical to be brought to mutual "conformity". In Kaufmann's opinion such a sense is nothing else but the "nature of things" which determines the normative qualification of the reality. Since establishment of this "sense" appears to be "non-dispositive" and controlled inter-subjectively (namely, other subjects will reach a similar result) so, in conformity with the convergent concept of truth, the "nature of things" must be assigned a certain ontological status. According to Kaufmann this is a real relation which occurs between being and obligation, between the conditions of life and normative quality. However, it should be underlined that from the point of view of the analyzed system the "nature of things" is a correlate of constructed sense, a result of a construction which is based on the principle of consistent understanding of senses ("non-normative" and "normative") and is not a reality which is transcendent against the arrangement of senses. In Kaufmann's theory, inference from analogy appears to be a process of reshaping the concepts (senses) governed by tendency to understand the contents appearing in relations between that which is factual and that which is normative in a consistent way. The analogical structure of language (concepts) and recognition of being as composed of an essence and existence is an indispensable requirement for the possibility of the realisation of law, based on specifically understood inference from analogy. It is necessary to assume a moment of existence without content which ensures unity of cognition. Existence emerges thus as a condition of the possibility of cognition. According to Kaufmann, the "nature of things" is the heart of inference through analogy and the basis for establishment of finding of law. Inference from the "state of things" to a norm or from a norm to the "state of things" always means inference through the "nature of things". The "nature of things" is the proper medium of objective legal sense sought in every cognition of law. In Kaufmann's view, the question whether the "nature of things" is ultima ratio of interpretation of law or is only a means of supplement gaps in law or whether it is one of the sources of law, is posed wrongly. The "nature of things" serves neither to supplement the gaps nor is it a source of law as, for example, a legal norm may be. It is a certain kind of "catalyst" necessary in every act of making law and solving a concrete case. Owing to "nature of things" it is possible to bring to a mutual conformity the idea of law and possible conditions of life or legal norms and concrete conditions of life. In Kaufmann's conception the "nature of things" is not yet the ultimate basis for understanding the "non-dispositiveness" of law. The relation between obligation and being is determined in the process of the realisation of law. Both the process itself and that which is transformed in this process are given. A question about the ontological bases of "material" contents undergoing "treatment" in the process of the realisation of law and about being which is the basis of regularity of the occurrence of the process arises. Only this will allow an explanation that the result of the process is not optional. Thus, a question about reality to which law refers and about the subject realising the law has to be formed. To this, Kaufmann gives the following answer: that which is missing is man but not "empirical man" but man as a "person". A "person" understood as a set of relations between man and other people and things. A "person" is the intermediary between those things which are different — norm and case are brought to conformity. A "person" is that which is given and permanent in the process of the realisation of law. It determines the content of law, is "subject" of law; this aspect is described by Kaufmann as the "what" of the process of realisation of law. A "person" consists of precisely just these relations which undergo "treatment" in the process. On the other hand, a "person" is "a place" in which the processes of realisation of law occur, it is the "how" of normative discourse, a "person" is that which determines the procedure of the process, being "outside" of it. This aspect of a "person" is connected with the formal moment of law. A "person" being, at the same time, the "how" and the "what" of the process of the realisation of law, is also, to put it differently, a structural unity of relation and that which constitutes this relation (unity of relatio and relata). According to this approach a "person" is neither an object nor a subject. It exists only "in between". It is not substance. Law is the relation between being and obligation. That which is obligatory is connected with that which is general. That which is general does not exist on its own, it is not completely real. Accordingly, a "person" as such is also not real. It is relational, dynamic and historical. A "person" is not a state but an event. In Kaufmann's opinion, such a concept of a "person" helps to avoid the difficulties connected with the fungibility of law in classical legal positivism. A "person" is that which is given, which is not at free disposal and secures the moment of "non-dispositiveness" of law. Kaufmann concludes: "The idea (»nature«) of law is either the idea of a personal man or is nothing". Theory points at the structure of realising law and explains the process of adoption of general legal norms for a concrete situation. The analysis has shown however, that in this theory a satisfactory answer to the question about the ultimate foundations of law is not given. It seems that in the analyzed theory the understanding of human being takes place through understanding of law. What is good for man as a "person", what is just, what a "person" deserves may be determined only against the existing system of law. A "per¬son" adopted as a basis of law is the reality postulated in the analysis of the process of the realisation of law. It is a condition of possibility of this process ( explaining, on one hand, its unity and, on the other hand, the non-dispositive moments stated in this process). A "person" in the discussed theory is entirely defined by the structure of law, it can be nothing more than that which is given in law, what law refers to, what law is about. Being, which is a "person", is constituted by relations between people and objects, the relations which are based on fundamental links between norms and conditions of life established in a process of bringing them to conformity. It has to be assumed that man as a "person" is a subject of law only as far as realising law "treats" given senses according to their current configuration. The system of law is a starting point and it describes in content what man is as a "person". Moreover, being a "person" is the condition for entering legal relations. Consistently, Kaufmann writes that "empirical man" is not the subject of law, man is not "out of nature" a "person". People become "persons" due to the fact that they acknowledge each other as "persons" — acknowledging, at the same time, law. This acknowledgement is a con¬dition of existence, of the possibility of the occurrence of process of realisation of law and of constituting legal relations which ultimately constitute a "person". Kaufmann assumes, that law tends towards a moral aim: it may and must create an external freedom, without which the internal freedom to fulfil moral obligations cannot develop. However, this postulate is not based on the necessary structure of human being. From the point of view of his system, it is nothing more than only a condition for the possibility of the occurrence of the process of the realisation of law — lack of freedom would destroy the "how" of this process. Thus, the postulate to protect the freedom of personal acts has to be interpreted, in accordance with the analyzed theory, as a postulate, the fulfilment of which aims ultimately at the accomplishment of the very same process of realisation of law itself and not the realisation of a given man. Kaufmann considers a "person" to be an element which unites the system of law as a whole. Law is a structure of relations, which are interdependent and inter-contingent. Consequently, a "person" which is to form the ontological basis of law has to be entity consisting of all relations. Being also the "how" of the process of realisation of law, if a "person" is to warrant its unity, it has to be a common source for all procedures. Hence, a single "person" would constitute a subject of law. Man appears to be only a moment of a certain entirety, realisation of which should be an aim of his actions. Law, creating a "person" as an object and subject of law becomes a primary entity. In the analyzed theory, the basis for determination of aims which law sets to man is not the allocation of man-subject to something which improves him but rather, such relation is only just constituted by law. A question appears, why should aims set in law also be the aims of "empirical man"? Why is this "empirical man" to be punished in the name of a "person" understood in such a way? If, however, it is assumed that what is man is determined by a system which is superior to him, then man has to be understood only as a part of a whole and there are no grounds to prohibit istrumental treatment of man and so the road to all aspects of totalitarianism might be opened. A problem of the application of created theory to the reality arises, the reality which the theory pretends to explain. Ultimately in his theory Kaufmann does not give any systemic grounds for a radical questioning of the validity of any legal norms. Every new norm becomes an equal part of system of norms. It is only its interpretation and application to given conditions of life that may be disputable, however, this refers to all norms without exception. Cohesive inter-pretation of norms and applications is necessary and sufficient for the acquisition of just law. New norms have to be interpreted in the light of others, correspondingly, the other norms require reinterpretation in the light of the new ones. Contradiction in interpretation of a norm does not form a basis for questioning norms but may serve only to question the manner of their interpretation (understanding). Therefore, no grounds exist to assume any legal norm as criminal or unjust, and in consequence, to question any consistently realised system based on formally, properly established norms, as "legal lawlessness". As law and a "person" do not exist without the process of realisation of law, the role of legal safety becomes crucial as the condition for the possibility of the occurrence of the process of realisation of law. Denying legal safety would be tantamount to negation of law in general (also of moral law) as negation of safety takes away, at the same time, the basis for occurrence of the process of realisation of law. Moreover, any lack of legal safety would also mean lack of a basis for the existence of man as a "person". Kaufmann's thesis, that civil disobedience is legalized only when it has a chance to lead to success, consistent with his concept of the foundations of law, seems to point directly to conclusions which deny the facts taken under consideration and doubtlessly Kaufmann's own intentions, since it would have to be assumed that accordingly there are no grounds to question a legal system in force based on violence which secures its operation. Force finally seems to determine which one of the mutually irreconcilable normative systems constitute law and which does not. A legitimate position is one which leads to success, it is the weaker system which is negated. If so, then basically violent imposition of law is not an act directed against the law in force but, to the contrary, realisation of law. In the context of the new system the former system of law may be talked about as unjust solely in the sense of being incapable of being consistently united with the new. However, at the base, ultimately, lies force which reaffirms differences and excludes from the process of realisation of law certain norms and their interpretations. Kaufmann was aiming at grounding of that which is "non-dispositive" in a certain given framework of interpretation. Nevertheless, he does not provide foundations for the understanding of phenomena, which he undertakes to explain at a point of departure. Instead of explaining them the theory negates the possibility of their existence. The reality postulated in regard to "non-dispositive" moments of the reconstructed process of acquiring law consist of a specifically understood "person", which appears in Kaufmann's conceptions as a condition of the possibility of the realisation of law. According to this approach understanding of a "person" may be only a function of law. To understand "legal lawlessness" and foundations of justice it is necessary to look for such theory of law in which understanding of man as a "person" and being is not a function of understanding of law (in which a "person" is not only a condition for possibility of reconstructed process of realisation of law; for possibility of cognition processes). It seems necessary to start from theory of being and a "person" based on broader experience than the one assumed by Kaufmann and reconstruct the ontological foundations of the process of realisation of law only in such perspective. Kaufmann points out that that to which law refers is ipsa res iusta a concrete relation of man to other people and things. This relation, in his theory, appears to be basically only just constituted by law (normative senses "applied" to conditions of life). Therefore, understanding the relation between a given man and other people and things which constitute the aim of his actions, that is understanding of good, is enacted against the background of constitution of senses; constitution which is a result of a process aiming towards consistent understanding of particular contents (of nor¬mative and non-normative senses). "Being" is secondary towards constructed senses it is only their correlate. The primary relation consists of relation of a man to law (system of norms), while the secondary relation is one of man to something which is the aim of his action (relation between man and good). Considering such approach it is difficult to envision a satisfying answer to the fundamental question: why does law put concrete man under any obligation to obey it? The source of this problem can be seen in reduction of the base for understanding good to content of obligation formulated in auto-reflection. Such reduction seems to be a consequence of Kaufmann's adoption of "convergent concept of truth" and in con¬sequence his recognition of indirect, essentialistic grasp of reality formulated in concepts as the basic and only foundation of theory of being and of law. In view of such an approach, analogy of law, concepts and being is the condition for the possibility of the process of transformation of senses which aims at consistent interpretation of all law. Existence is postulated with respect to the possibility of unity of experience and cognition. However, also a different approach to understanding of the problem of being and good is possible. In spontaneous cognition being is affirmed, first of all, not as a certain, non-contradictory, determined content, but as something existing. Together with a cer¬tain content (passed indirectly through notions) existence of being is co-given. The basis for unity of being is not formed by the consistence of content, as it is in the case of the theories departing from the analysis of cognition processes, but by an act of existence realising content (essence). Such an approach makes it also possible to go beyond the convergent concept of truth. It is worth mentioning that allocation of an agent to good is realised not only by the content of duty. A statement that something is good is primary with respect to determination of this good in content. The recognised good always bears some content, however, there are no reasons to base the concept of good exclusively on indirect, formulated in concepts cognition. As primary, can be adopted the relation of man to good and not of man to law. Determination in content appears to be only an articulation of aspectual cognition of being, as an object of action. In such a case the basis for relative unity of norm and conditions of life is not the "nature of things" understood as correlate of sense but it is relation to good based on internal constitution of man as potential, not self-sufficient being. It does not mean, that the moments of the process of realisation of law singled out by Kaufmann are not important to determination of what is just. He, quite rightly, points to significant role played by norms in the evaluation of concrete situations, in man's search for closer specification in content of good innate to him. The structure of process of determining law for a concrete situation, to a great degree corresponds to the processes of determining law which take place not only in the legal sciences. Kaufmann's analyses of the process of realisation of law show the complexity of the structure of these processes and point towards important moments allowing a better understanding of law and man. Nevertheless, these analyses cannot be a basis for construction of philosophical theory of law, theory which hopes to point out the ultimate, ontological foundations for understanding law. Kaufmann's results may become fully valid only in a more general perspective including broader experience at the point of departure. (shrink)

Scholastics were a group of Christian theologians mainly active in Europe during the 12th to 17th centuries. One of the notable teachings in scholastic literature is the theory of just price, which can be considered one of the most frequent theories in the history of economic ideas. This study tries to reassess the theory of just price in the economic thought of scholastic thinkers by referring to classical scholastic texts, through which it examines the general experiences of scholastic theology (...) in confrontation with economic phenomena. For this purpose, the theory of just price is examined from the roots of its formation in scholastic practical wisdom to its most superficial form as an economic institution. Through this investigation, the question of how theology can play a role in its practical field, up to the most superficial economic institutions can be answered. The results of this study show that scholastic thinkers in the theoretical field of practical theology had significant achievements in promoting theology through their writings and teachings in schools. In its practical field, they tried to implement theology in the human foundations of society by building various divine institutions such as a just price. In this regard, the theory of dual human happiness in scholastic theology has significantly impacted the formation of economic issues as part of scholastic practical wisdom. Despite these achievements, their thought is wanting from two aspects: (1) systematic lack of understanding of modern phenomena such as capitalism and (2) no effort to implement their teachings in the social and economic construction of society. -/- . The language of phenomenology includes terms such as intentionality, phenom- enon, insight, analysis, sense, not to mention the key term of Edmund Husserl’s manifesto, “the things themselves” to return to . But what does the “things them- selves” properly mean? How come the term is replaced by the “findings” over time? And what are the findings for? The investigation begins by looking at the tricky legacy of the modern turn, trying to clarify ties to past masters, including Francis- co Suárez (...) and Augustine of Hippo . The former, because his influence goes beyond René Descartes reaching undoubtedly Franz Brentano and his students, as well as Martin Heidegger . The latter, because Augustine gives a personal component to the Greek inheritance, marked by the “inward turn .” However, it would not be possible to review the history of thought without the help offered by Jan Patočka's analyses . Patočka discloses the “care” of the Greek philosophers, Plato and Dem- ocritus among others, “for the soul”, we would say with Patočka for “being,” whose sense “does not leave us indifferent” as the leitmotiv of Ancient Philosophy . Nev- ertheless, in his lectures on Plato and Europe, Patočka points out that you must be careful not to confuse the phenomena of things, of existens, with the phenomena of being . Finally, Patočka’s legacy is found in the efforts to reconcile the life-feeling with the modern construction of reality, which means “a radical reconstruction of the naive and natural world of common sense .” In some ways, intentionality is to be revised . In the bread and bakery products market, consumer preferences are constantly changing. Consumers prefer products that contain less fat and sugar. The market is in demand for bakery products that are healthy, while taste remains an important success factor. Manufacturers include popular healthy additives (grains, seeds and legumes) in their products. Particularly popular at present are ingredients from Eastern Europe and Asia: yuzu, sesame, matcha, shiso. Tropical fruits (passion fruit, mango, bergamot) and fragrances (dried hibiscus, lavender and rose) are predicted to become popular. This causes the complexity of demand segmentation, features of merchandising and pricing policy, features of consumer behavior and consumption psychology, etc. An assessment is given of the dynamics of production and consumption of bread and exports of products, and a forecast is made for the development of the world market for bread and bakery products. The results of the analysis are necessary to assess the level of food safety and to develop a strategy that takes into account the current trends in the global bread and bakery products market. The conceptual model of United Nations reform - "UN 3.0" includes the General Program of Action on UN Reform, consisting of two stages. The first stage for 2020-2025 envisages the transformation of the main organs of the UN - the General Assembly and the Security Council with measures to improve the effectiveness of the management system, address the "veto problem", problem of financing, improve staff work and administrative and financial control, strengthen UN media, improvement of work with the global civil (...) society. The General Assembly is converted into the General All-Parliamentary Assembly of the UN. In the structure of the Assembly, the Council for Law is being established, which coordinates the activities of UN structures in the field of law. To coordinate the activities of the UN in the field of human rights and civil society, ethical issues, the General all-parliamentary Assembly creates the Council on ethics, human rights and civil society and transforms the Committee on information into the Council on public information and communication with civil society. The structure of the Council includes all UN media. The reform of the UN Security Council is carried out in three sub-stages. At the 1st sub-stage (2020-2021) the Security Council is transformed into the Council of Existential Security (CES). The membership of the CES is increased to 25 member countries, of which five countries have the right of the unconditional (absolute, eternal) veto: Great Britain, France, China, Russian Federation, USA. The General All-Parliamentary Assembly elects 15 new permanent members of the Council of Existential Security with the right of the conditional (limited) veto: Argentina, Australia, Brazil, Canada, Egypt, Germany, India, Indonesia, Italy, Mexico, South Africa, Nigeria, Pakistan , Turkey, Japan (if they fulfill the mandatory restrictive conditions). At this sub-stage, the CES elects also five non-permanent members with the right of a conditional (limited) veto when they meet the mandatory restrictive conditions, with a rotation period of 2 years from geographical regions (or regional unions): Africa, Latin America and the Caribbean, Asia and the Pacific Ocean (2 places), Eastern Europe. On the second sub-stage (2022-2023), subject to the effective activity of the CES of the enlarged composition and compliance with mandatory restrictive conditions, new permanent members of the "Existential Security Council" are elected with the right of a conditional (limited) veto: Iran, Spain, Poland, Saudi Arabia. Members of the CES may be regional unions, whose member countries are not represented in the CES, but still have one vote with the right of a conditional (limited) veto. -/- Two essential levels of the veto: 1. Unconditional (absolute, eternal) veto is the historical right of veto of the five permanent members of the Council of Existential Security - Great Britain, China, Russia, USA, France; 2. Сonditional (limited) veto is the veto of other permanent and non-permanent members of the Council of Existential Security. The right of veto is a unique international school for the achievement of consensus, a school of high democracy for Humanity, a reliable guarantee of the viability of the UN structure. The Council for Existential Security centralises the management of the UN subsidiary bodies with the expansion of their security functions: the Military Staff Committee, the Counter-Terrorism Committee, the Committee for the Prevention of the Spread of Nuclear, Chemical and Biological Weapons, the Sanctions Committees and other committees. On the basis of the decision of the Council of Existential Security, the General All-Parliamentary Assembly creates permanent contingents of UN peacekeeping and counter-terrorism forces. In addition, two Centers are being created in the structure of the Council for Existential Security: the World Center for the Elimination of the Effects of Technogenic and Natural Disasters with branches on all continents and the World Center for the Analysis of Existential Risks and the Overall Security Strategy. The Center is developing the Programs of research and monitoring of global existential threats and risks. In order to increase the level of legitimacy and authority of the Secretary General of the United Nations, the Rules of procedure for elections to this post are changing. Each member country of the Council for Existential Security represents one of the most authoritative candidates for election to the post of Secretary General at the session of the General All-Parliamentary Assembly, with the possibility of nominating candidates from other countries, including those not members of the Council for Existential Security. Elections are held in two rounds during one day of the session of the Assembly. The Legal Committee of the UN General Assembly is developing a Program for the Reform of the Judicial System of the United Nations, which takes into account the proposals of the previous international discussion and determines the scope and terms of the reform of the courts. In accordance with the Program of Action on UN Reform for 2020-2025, reforms are under way in the structure of the Economic and Social Council. The central task of the reform is to strengthen the coordinating role of ECOSOC in the entire system of UN-related specialized agencies, funds and programs related to the Council. The key task of the UN reform is the solution of the financing problem. A unified "UN Open Budget "Solidarity XXI" is being created, including the financing of peacekeeping operations and other expenses. Each country, a member of the United Nations, lists in an established period, once a year, an Existential contribution - the Earth Tax. The Earth Tax for each UN member state is established on the basis of four scales of calculation: Scale I - for 5 permanent members of the Council of Existential Security, who have the right of absolute (absolute) veto; Scale II - for the permanent members of the SEB, who have the right to a conditional (limited) veto; Scale III - for non-permanent members of the SEB, who have the right to a conditional (limited) veto; Scale IV - for all other UN member countries. The program of action on UN reform includes a set of measures to ensure transparent work of the International Civil Service Commission with the involvement of the UN media. To strengthen control functions in the sphere of personnel policy, administrative and financial management, the General All-Parliamentary Assembly of the United Nations establishes the Permanent Commission on Ethics and Administrative and Financial Control. All members of the Commission, members of the Committees and auditors are independent in their activities from the leadership of the United Nations, its funds and programs. The General All-Parliamentary Assembly completes the first stage of the Program of Action on UN Reform in 2025 and, following an open discussion, introduces a single language of international communication - Esperanto and approves it as the official language of the United Nations. With a view to more effective work of the central UN governing bodies in the face of increasing existential threats and risks, reducing the current expenses for the maintenance of the central bodies of the UN, the Council for Existential Security and the General All-Parliamentary Assembly decide on the relocation of the UN headquarters to Iceland. The UN building complex in New York is transferred to preferential use of non-governmental organizations, which contribute to the implementation of the goals of the United Nations. At the second stage of the UN reform in the period 2026-2028, additional necessary transformations are being made in the UN system. At the end of the first stage of the reform, taking into account the reforms carried out by the main organs of the United Nations and the internal improvement of the work of all its structures, the United Nations Program of Action for the years 2026-2028 is being developed. Modern science originated in Western Europe, but its astonishing successes have forced every other civilization in the world to acknowledge and embrace its achievements. It is at the core of modernity and of the globalization of civilization. Consequently, efforts to show that non-Western traditions of thought should be taken seriously within the paradigm of science itself will inevitably provoke skepticism. However, science itself is riven not only by major problems and rival research programs, but by different conceptions about what (...) is science and what are its goals. These have generated such confusion, even within such advanced fields of science as physics, that more and more scientists are examining non-Western traditions of thought to provide a sufficiently broad perspective to overcome this confusion, to identify the core problems within science and to redefine it and its goals. ABSTRACT -/- A propositional attitude (PA) is a belief, desire, fear, etc., that x is the case. This dissertation addresses the question of the semantic content of a specific kind of PA-instance: an instance of a belief of the form all Fs are Gs. The belief that all bachelors are sports fans has this form, while the belief that Spain is a country in Eastern Europe do not. Unlike a state of viewing the color of an orange, a (...) belief-instance is semantically contentful because it has reference, a meaning, logical implications, or a truth-value. While the intrinsic semantics view holds that either concepts or abstract objects are the source of content for PAs, the extrinsic semantics view holds that symbols of a mental language provide this content. I argue that a successful theory of intentionality must explain: (1) the truth-preserving causal powers of PAs, (2) the failure of the deductive principle Substitutivity to preserve truth over sentences that ascribe PAs, and (3) the truth-evaluability of PAs. As an internalist version of the extrinsic semantics view, I first evaluate Fodor’s Computational Theory of Mind, which says the semantic ingredients of mental states are symbols governed by rules of a mental syntax. I argue that in order to meet (1), CTM would have to associate the causal patterns of each thought-type with the inferential relations of some proposition – in an arbitrary or question-begging way. I also evaluate Fodor’s causal theory, as an externalist version of the extrinsic semantics view. This view is that lawlike causal relations between mental symbols and objects determine the reference, and thus the truth-value, of a thought. I argue that Brian Loar’s circularity objection refutes the ability of this theory to meet (3); and I endorse the intrinsic semantics perspective. I evaluate Frege’s theory of abstract, mind-external, and intrinsically semantic objects (senses), as an attempt to meet condition (2). I conclude that mind-external universals are the source of the intrinsically semantic features of concepts. Finally, I put forth a theory called ‘Bare Property Intentionality’, which describes the features of intrinsically representative and semantic concepts that connect them to these universals. Background: The internationalization of clinical studies requires a shared understanding of the fundamental ethical values guiding clinical studies. It is important that these values are not only embraced at the legal level but also adopted by clinicians themselves during clinical studies. Objective: Our goal is to provide an insight on how clinicians in Germany and Poland perceive and identify the different ethical issues regarding informed consent in clinical studies. Methods: To gain an understanding of how clinicians view clinical studies in (...) the countries they work in, we carried out semi-structured problem-centered interviews per telephone in Poland (n = 6) and Germany (n = 6). Our interviewees concentrated on three main topics: an appraisal of the normative framework, challenges in the information process and the protection of all participants in clinical studies. Results: Clinicians generally supported the normative framework, even though they considered it quite complex. In the two study countries, a widely noted dilemma in the information process was whether to overburden participants with extensive information or risking leaving out important facts. Clinicians were ready to exclude larger population groups from participating in clinical studies when the information process could not be carried out with standard procedures or when their inclusion was ethically sensitive. Conclusion: Clinicians need to gain a better understanding of the consequences of excluding larger population groups form participating in clinical studies. They should seek assistance in improving the information process for the inclusion of underrepresented groups in clinical studies. (shrink)

Feminist decolonial scholars have called for disengaging from the current system built on a hierarchical logic of race and gender central to modern, colonial thinking. They have looked to worlds outside the modern system to lead us out of current unjust practices harming both humans and the environment. Although policymaking may be seen as the stronghold of the current political agenda and of the structures that have led to the climate crisis, we argue that climate policies too, are also crucial (...) for rethinking and transforming societies. Our examination of climate adaptation policies in Sweden and the literature from Europe shows how policy documents ignore and unknow the oppressive intersections of gender and power despite the knowledge that exists on these issues in the public domain. Drawing on the tools of agnotology, we examine how this is achieved by strategies of ‘denial, dismissal, diversion and displacement.’ Building on feminist post and decolonial scholarship, we make explicit the gendered and racial hierarchies and dichotomies underpinning these policy documents. At the same time, we bring attention to the nuances in the policy documents we study and look for the openings that might be used to bring about transformation by making these hierarchies explicit and calling them into question. We argue that a transformation is possible through a feminist post and decolonial intervention, even in policymaking otherwise ignorant of culture, values and the colonial histories that have produced contemporary society. The intersection between virtue and care ethics is underexplored in contemporary moral philosophy. This thesis approaches care ethics from a neo-Aristotelian virtue ethical perspective, comparing the two frameworks and drawing on recent work on care to develop a theory thereof. It is split into seven substantive chapters serving three major argumentative purposes, namely the establishment of significant intertheoretical agreement, the compilation and analysis of extant and new distinctions between the two theories, and the synthesis of care ethical insights with neo-Aristotelianism (...) to generate a virtue ethical theory of care. In the first two chapters, I outline virtue ethics and care ethics, and argue for considerable agreement over central premises. Chapter 2 summarises the foundational commitments of care ethics, focusing particularly on their relational ontology and its links to the other ethical claims care ethicists universally ascribe to, namely particularism, partialism, the moral salience of emotions, and the rejection of hard public/private distinctions. Chapter 3 lays out the central concepts in neo-Aristotelian virtue ethics, including eudaimonism, virtue, and character traits, and drawing a number of comparisons between virtue and care ethics specifically with regard to relational ontology and the meta-ethical commitments it underpins. In addition to doing the necessary expository work for the remainder of the thesis, Chapters 2 and 3 also argue that care ethics and virtue ethics have much more in common than is typically acknowledged – the first major contribution of this thesis to the literature. Chapters 2 and 3 to provide at least a prima facie justification for pursuit of the questions I confront in the remainder of the thesis. In Chapter 4, I ask what differentiates these two ethical theories. I survey some of the differences which philosophers in either camp have identified and offer some of my own. I suggest that several of those differences either rest on misunderstandings of one ethic or the other, or that in erecting a divide between virtue and care ethics they also disunify ethics of care. I do, however, identify two differences which seem defensible. Specifically, they are that virtue ethics seems to lack an account of care, which I define minimally as a response or responsiveness to need, and that virtue and care ethics organise their meta-ethical and normative concepts differently. This chapter thus presents a second contribution to the literature: a study of the differences between virtue ethics and care ethics. It also serves to set the trajectory for the remaining chapters, where I respond to the claim that virtue ethics lack an account of care. I spend the remainder of the thesis constructing what I take to be a satisfying foundation for a virtue ethical theory of care. In Chapter 5, I offer three initially viable means of incorporating care into virtue ethics, all of which treat care as a virtue. These are the analogical approach, according to which care is analogous to an existing virtue; the additive approach, according to which care is a novel virtue; and the bundling approach, according to which care is a bundle of virtues. I also offer and evaluate reasons to reject the claim that care is a virtue, concluding that the claim is indeed a viable one so long as the concept of care is sufficiently thick, and I contend that analogical approaches, and particularly analogies with charity, outperform the others. Chapter 5 therefore serves two ends. First, it proffers a novel meta-analysis of concepts of care as a virtue, and thus makes a third contribution to the literature. In doing so, it makes an inroad into the second: the development of a neo-Aristotelian theory of care. Chapter 6 continues this project. I attempt to show how care can be construed as an act-type and a practice. I argue in this chapter that practices are a subcategory of actions, and that care qualifies as an Anscombean act-type which aims at the meeting of needs relating to the care-recipient’s flourishing. I go on to consider the implications of this account for ethics which deploy care as a moral concept, maintaining that it not only offers a better account of consequences than theories of care which include success criteria, but also that it affords us interesting insights into the distinction between ‘caring about’ and ‘caring for’ which allow us to make sense of certain tenets of neo-Aristotelianism. This represents a contribution to both discourses, since neither care nor virtue ethicists working at the intersection of their respective normative theories have delved very deeply into the philosophy of action. Chapter 7 discusses caring relations, suggesting that a virtue ethical theory of caring relations can lean on the work care ethicists have done, and adding some necessary refinements, such as a distinction between ideal and non-ideal caring relations, and a theory of caring relations as reasons for action. This final chapter also draws these three concepts of care together by arguing that virtuous caregivers who are invested in the flourishing of those for whom they care are also sensitive to the relations those care-recipients bear to their institutional environment. I argue that because they are caring participants in caring relations, virtuous agents are characteristically motivated by states of need and dependency to engage in certain sorts of conventionally political practices. In other words, the virtue or virtues of caring characteristically manifest in certain sorts of political or social practices, relating specifically to those areas of moral life. This allows us to build upon recent work in feminist virtue ethics of the sort offered by Tessman and Friedman. I also offer a novel analysis of migration, suggesting that the account of care presenting here is analytically useful both when it comes to historical cases of migration such as the underground railroads and escapes from Nazi-occupied Europe, but also for contemporary issues such as the migrations occurring in the Southern United States and in much of Europe. I thus conclude not only that virtue ethicists ought to incorporate care into their normative framework, and that the theory of care presented here is a coherent one, but that this leads us naturally into applied topics such as virtue politics. I conclude the thesis by considering some its implications and by identifying some further avenues for research. (shrink)

The concept of Tabula Rasa, as a desire for sweeping renewal and creating a potential site for the construction of utopian dreams, is presupposition of Modern Architecture. Starting from the middle of the 19th century to the first half of the 20th century, Iranian urban and architectural history has been integrated with modernization, and western-influenced modernity. The case of Tehran as the Middle Eastern political capital is the main scene for the manifestation of modernity within it’s urban projects that (...) was associated with several changes to the social, political and spatial structure of the city. In this regard, the strategy of Tabula Rasa as a utopian blank slate upon which a new Iran could be conceived “over again” – was the dominant strategy of modernization during First Pahlavi era (1925–1941). This article explores the very concept of constructing a new image of Tehran through the processes of autocratic modernism and orientalist historicism that also influenced the discourse of national identity during First Pahlavi era. The aim of this paper is to have a better architectonic insight over the museum of Gjergj Kastriot Skanderbeg in the city of Kruja. The history for which Albanians are proud will be the focus of this paper from its genesis until now, always seeing its architectural perspective. The castle as the last resistance of Albanians at the time of Turkish occupation will be analyzed; together with the mode of implementation of the new Museum Gjergj Kastriot Skenderbeu at the time (...) of socialism. Who were the ideas of the ideologies of the time? What were the secrets of the building design? What were the secrets of the construction of the building? What were the motivations and inspirations of the architects and the design group? The paper will contain historical dating, direct interviews with architects of the building, and authentic architectural analysis of the building. Museum of Kruja is a work that belongs not only to Albanians but all of Europe and Balkan. Today it is one of the most visited works throughout the country. (shrink)

This chapter aims at describing the role of housing in the ageing population, on the example of Poland, which is one the fastest ageing country in the world. This issue is significant because housing well suited to the needs of older people means lower expenses in medical and social care. Seniors living in proper conditions remain not only longer healthy, but they may also stay longer active in the labor market. Housing adoption to the needs of an older population means (...) a particular challenge for Poland, where the majority of the housing stock was created in socialism and is inhabited by large by older people. It is crucial to raise awareness of age-friendly housing among the seniors, their relatives, architects, and policymakers. This purpose serves the first model apartment for seniors in Poland, which was created by the chapter's authors. (shrink)

This essay examines theoretical arguments surrounding the use of post-colonial theory as a way to fill in the epistemological lacuna in the studies of post-socialism. It reviews the various streams of this theoretical development and employs Edward Said’s notion of “traveling theory” to demonstrate that theoretical claims made by proponents and opponents of this particular comparative perspective are historically, socially, and geographically situated, although not fixed. Disciplinary, national, and institutional affiliations, instead of theoretical justifications, are identified as important factors in (...) the propensity to accept or resist the introduction of post-colonial perspective on Central and Eastern Europe and the former Soviet Union. The essay concludes by acknowledging the potential usefulness as well as the limits of post-colonialism in the conceptualization of the post- socialist space. (shrink)

This article has been written about the explanation of the scientific affair. There are the philosophical circles that a philosopher must consider their approaches. Postmodern thinkers generally refuse the universality of the rational affair. They believe that the experience cannot reach general knowledge. They emphasize on the partial and plural knowledge. Any human being has his knowledge and interpretation. The world is always becoming. Diversity is an inclusive epistemological principle. Naturally, in such a state, the scientific activity is a non-sense (...) process. The postmodern world is a post-scientific world. Another collection of approaches to science belongs to the analytical philosophy. The main part of analytical philosophy context centers around language. Language is the center of the world. We can study the world through language. Language is the possibility of knowledge. If we overcome the language games, we can study the world accurately. Generally, at present, it seems that the rational thoughts are marginal points in the sea of irrationality. We can probably talk about an anarchistic epistemological situation. Another issue is the role of observation to form a scientific activity. In this situation, the question is whether the observation is the technique of gathering information or the final reference of original scientific analysis. In relation to this issue, the confrontation of science with the families and the categories of the objects is the main problem. For more than two thousand years, the totalitarian heritage of the Aristotelian logic has been the guideline of categorizations for the human being. In order to reach an inclusive and applicable result, we should categorize everything; but it is not really known that if the method of the world categorization is the same or not. The accordance of the conceptual categories with their extensions in the world is one of the main problems which has malfunctioned the scientific system. It is better to say that it has deactivated science. Moreover, there are many interpretations for each event based on its occurrence conditions. For example, consider a fever; In order to diagnose its cause, the most significant factor is the role of a physician. There is no sense in saying that the observation has diagnosed the cause of the fever. This is the observer that plays a determinative role. Another problem is the disputes between realism and instrumentalism. Instrumentalists believe that to form a theory, the concepts are just the tools of scientific researches. Based on realism, but we confront the concepts in the original way. This chaos causes the scientific system to collapse. Now the question is what the solution is. I would like to propose my scheme that is constructed based on a main principle: there is no occurrence in the world unless we can trace the effect of consciousness back in that occurrence. In other words, there is no accident in the world. One can argue that it is the main problem that the effects of consciousness ---if there is such a concept--- is not traceable in the world. An immediate response to this problem is an inefficient technique . The observation is a technique . It is not the method of interpretation. Some people argue that the empirical approach cannot lead us to an authentic criterion to know the world. Because there is no criterion for truth, and if there is probably such a criterion, we can obtain it via several ways. The solution to the first problem is simple. Any occurrence is a truth; even we suppose it as a partial truth. Therefore we can say we face a multi-facial world. It can be the solution of the second problem: if consciousness is essentially the origin of the world and all occurrences, we face consciousness as a unique truth; even its creations contradict each other. If there is no consciousness as a creator of the world and we cannot trace it back in all existents, then what should we do? If there is consciousness, why its creations contradict each other. Since consciousness is a will, it is able to decide in any situation it intends. The issue of contradictory consciousness intentions has a teleological aspect. We cannot judge its teleological substance at present. If we are able to believe that there is no consciousness at all, it will contradict the main practical principle in our lives. Every action that we take in our lives is conjoined with consciousness. We learn many things from many sources. The substance of our instincts and emotions can be questioned. It is true that, infact we cannot analyze our instincts and emotions, but we can discuss explicitly about the rational elements of the instincts. What are these elements? These elements are the quality of their appearance. The quality of instinct appearance is different among beings. The strength and the depth and length of these irrational qualities are different in all beings. What factors or factor cause the differences among these aspects? There is certainly a determinative factor. The same factor which determines the occurrence of any event. Even if we believe in partial knowledge, we must accept the confrontation of the occurrences. Thus it is not possible to refuse the occurrences as the reference unit of knowledge. In spite of the difference, every occurrence, even as a single occurrence, happens and we can regard it as the reference unit of knowledge. Then we can consider every occurrence as an occurred object. When an occurrence happens, then it is a determined object. Everywhere there is a determination, there is certainly a determiner. Why do not we encounter a multi-determinative consciousness? Because there are a few aspects of the unique super-consciousness. These aspects are motion and growth and the amount of constituent material in every being. In all over the world, the difference in these factors creates all differences. Thus we do not encounter the plural consciousness. Is the world birth accidental? Infact, there is no accident. The accident has no meaning in the world. As explained above, the constructing element of the world is the occurrence. An occurrence can be analyzed. Therefore, we should not talk about the accident until we are not able to analyze all phenomena. We can look at every subject from different points of view at present. Thus there is theoretically no possibility to say that a certain matter is the consequence of the accident. The accident is a popular and inexact concept that has no philosophical content. Moreover, the definition of consciousness versus its contradiction causes the collapse of all epistemological axioms. We can ask why we must not define other logical principles against their contradictions. Thinkers who deny the role of logic usually ignore the role of logic. They have not been able to deny the logical function to form an epistemological system because it is not an easy task. In this article some other issues were discussed, such as the consideration of restriction as a stable and firm foundation of knowledge instead of the Descartes cogito. In addition to these philosophical points some other issues were propounded such as the role of instrumental mechanism to form the new science and the great alterations in philosophy and history of Europe. Many issues threaten human civilization. The only way to deal with such threats is certainly to use scientific facilities. The scientific possibilities undoubtedly come from a complete and inclusive scientific theory. The present article is an attempt to explain the scientific affair in order to develop human achievement, however small. -/- . (shrink)

The historiographical narrative describing early modern European philosophy as the confrontation between rationalism and empiricism and its overcoming through the Kantian synthesis had a huge spread in Argentina. This article investigates the genesis of this traditional account in the universities of Córdoba, Buenos Aires and La Plata between 1780 and 1920. It offers an introduction concerning the formation of this narrative in Europe and a survey of the teaching of early modern philosophy in Argentina during that period. It concludes (...) that, although some of its components are found during the nineteenth century, it was only in the second decade of the twentieth century that the traditional narrative was formulated in its entirety, in parallel with the introduction of Kantianism in Argentine. However, the construction of this narrative is not merely explained by this fact but also by the weight that the history of philosophy gained in the syllabus as part of the demands involved in the shaping of the academic philosophical field. Finally, this paper suggests ways to reconfigure and renew the canon. (shrink)

The paper seeks to indicate ways in which the crude distinction between Anglo-Saxon and Continental philosophy may have to be amended in light of recent developments in Eastern Europe. As is well known, the philosophy of science is to no small part a product of the universities of the Habsburg Empire (in Vienna, Prague, Lemberg/Lwow, etc.). Logic, too, has played a more significant role in Eastern Europe (not least in Poland) than in the philosophical cultures of (...) Germany or France. For these and other reasons, a shift in the center of gravity of Continental philosophy is currently being realized, as younger Eastern European philosophers in newly liberalized institutions begin to return to their roots in their native pre-Communist intellectual traditions. Is the shape of the Earth really a globe? Reading closely, the author of this voluminous paperback (first published as hardcover in 2015), historian David Wootton, does not take for granted the fact that the Earth is round or spherical. However, this does not mean that he is a relativist. And it is interesting to consider why he regards science as progress against any relativist view of the history of science. -/- On the whole, the book is an extraordinary contribution (...) to the studies of the history of early modern science and philosophy. Through the seventeen chapters with rich notes and illustrations, Wootton elaborates on epistemological problems in observing the heavens and the earth, or how openly and clearly people at the time constructed scientific knowledge. For instance, convincingly, Wootton re-interprets Butterfield’s and Kuhn’s conceptions of ‘scientific revolution’ in early modern Europe, and re-examines the idea of ‘eureka’, ‘discovery’, or ‘invention’ (p. 67) as a necessary precondition for science. For he positively defends the view that the scientific revolution ‘has been so astonishingly successful’ (p. 571), that the unique fact of science is ‘progress’ in its history (p. 513). In this progressive sense, he is philosophically neither committed to Kuhn’s (and Rorty’s) subdued relativism that science evolves within a set of its terms, nor to strong relativism that progress in science is illusory and thus falsifiable. Also, in some longer notes, he explicates why the relativism of a number of historians is undermined (pp. 580–92). (shrink)

The development of modern science has depended strongly on specific features of the cultures involved; however, its results are widely and trans-culturally accepted and applied. The science and technology of electricity provides a particularly interesting example. It emerged as a specific product of post-Renaissance Europe, rooted in the Greek philosophical tradition that encourages explanations of nature in theoretical terms. It did not evolve in China presumably because such encouragement was missing. The trans-cultural acceptance of modern science and technology is (...) postulated to be due, in part, to the common biological dispositions underlying human cognition, with generalizable capabilities of abstract, symbolic and strategic thought. These faculties of the human mind are main prerequisites for dynamic cultural development and differentiation. They appear to have evolved up to a stage of hunters and gatherers perhaps some 100 000 years ago. However, the extent of the correspondence between some constructions of the human mind and the order of nature, as revealed by science, is a late insight of the last centuries. Quantum physics and relativity are particularly impressive examples. (shrink)

What, then, is the significance of the psychoactive mushrooms hiding in plain sight in the artwork and icons of many European and Middle-Eastern churches? Does Christianity have a psychedelic history? -/- Providing stunning visual evidence from their anthropological journey throughout Europe and the Middle East, including visits to Roslyn Chapel and Chartres Cathedral, authors Julie and Jerry Brown document (...) the role of visionary plants in Christianity. They retrace the pioneering research of R. Gordon Wasson, the famous “sacred mushroom seeker,” on psychedelics in ancient Greece and India, and among the present-day reindeer herders of Siberia and the Mazatecs of Mexico. Challenging Wasson’s legacy, the authors reveal his secret relationship with the Vatican that led to Wasson’s refusal to pursue his hallucinogen theory into the hallowed halls of Christianity. -/- Examining the Bible and the Gnostic Gospels, the authors provide scriptural support to show that sacred mushrooms were the inspiration for Jesus’ revelation of the Kingdom of Heaven and that he was initiated into these mystical practices in Egypt during the Missing Years. They contend that the Trees of Knowledge and of Immortality in Eden were sacred mushrooms. -/- Uncovering the role played by visionary plants in the origins of Judeo-Christianity, the authors invite us to rethink what we know about the life of Jesus and to consider a controversial theory that challenges us to explore these sacred pathways to the divine.
