The ongoing debates about what rationality consists in remain unsettled and leave plenty of interpretation for what is rational in belief formation and action. Hinman risks a large step in seeming to assume that it is rational not to contravene scientific theories and findings and irrational to disallow this openness. These -- possibilities lending a potential for deistic beliefs not to be inconsistent with rationality. The presumed scientific approach to allowing a rationality in such belief revolves around the (...) development of the so-called "M-scale" in the psychology of belief. The other, even more intense, global debate here is whether such an approach to rationality and rational belief is indeed valid, that is, the ongoing concen of whether such belief is consistent or not with scientific practice, understanding, and method. My aim in this paper is to develop a unified solution to two paradoxes of bounded rationality. The first is the regress problem that incorporating cognitive bounds into models of rational decisionmaking generates a regress of higher-order decision problems. The second is the problem of rational irrationality: it sometimes seems rational for bounded agents to act irrationally on the basis of rational deliberation. I review two strategies which have been brought to bear on these (...) problems: the way of weakening which responds by weakening rational norms, and the way of indirection which responds by letting the rationality of behavior be determined by the rationality of the deliberative processes which produced it. Then I propose and defend a third way to confront the paradoxes: the way of level separation. (shrink)

The essays here are mostly already published during the last decade (though some have been updated), along with one unpublished item, and nothing here will come as a surprise to those who have kept up with his work. Like W, he is regarded as the best standup philosopher of his time and his written work is solid as a rock and groundbreaking throughout. (...) However his failure to take the later W seriously enough leads to some mistakes and confusions. Just a few examples: on p7 he twice notes that our certainty about basic facts is due to the overwhelming weight of reason supporting our claims, but W showed definitively in ‘On Certainty’ that there is no possibility of doubting the true-only axiomatic structure of our System 1 perceptions, memories and thoughts, since it is itself the basis for judgment and cannot itself be judged. In the first sentence on p8 he tells us that certainty is revisable, but this kind of ‘certainty’, which we might call Certainty2, is the result of extending our axiomatic and nonrevisable certainty (Certainty1) via experience and is utterly different as it is propositional (true or false). This is of course a classic example of the “battle against the bewitchment of our intelligence by language” which W demonstrated over and over again. One word- two (or many) distinct uses. -/- His last chapter “The Unity of the Proposition” (previously unpublished) would also benefit greatly from reading W’s “On Certainty” or DMS’s two books on OC (see my reviews) as they make clear the difference between true only sentences describing S1 and true or false propositions describing S2. This strikes me as a far superior approach to S’s taking S1 perceptions as propositional since they only become T or F after one begins thinking about them in S2. However, his point that propositions permit statements of actual or potential truth and falsity, of past and future and fantasy, and thus provide a huge advance over pre or protolinguistic society, is cogent. As he states it “A proposition is anything at all that can determine a condition of satisfaction…and a condition of satisfaction… is that such and such is the case.” Or, one needs to add, that might be or might have been or might be imagined to be the case. -/- Overall, PNC is a good summary of the many substantial advances over Wittgenstein resulting from S’s half century of work, but in my view, W still is unequaled once you grasp what he is saying. Ideally they should be read together: Searle for the clear coherent prose and generalizations, illustrated with W’s perspicacious examples and brilliant aphorisms. You can get a quick summary of this book on p 135 or 326. If you are not up to speed on evolutionary psychology you should first read one of the numerous recent texts with this term in the title. One of the best is " The Handbook of Evolutionary Psychology " by Buss, but it is big and expensive. Until about 15 years ago, ´explanations´´of behavior have not really been explanations of mental processes at all, but rather vague and (...) largely useless descriptions of what people did and what they said, with no insight into why. We might say that people gather to commemorate an event, praise god, receive his (or her or their) blessings, etc, but none of this describes the relevant mental processes so we might say they are explanations in much the same way that it explains why an apple drops to the ground if we say its because we released it and it's heavy-there is no mechanism and no explanatory or predictive power. This book continues the elucidation of the genetic basis of human behavior which has been almost univerally ignored and denied by academia, religion, politics and the public(see Pinker´s excellent book``The BlankSlatè`). His statement (p3) that it is meaningless to ask if religion is genetic is mistaken as the percentage of variation due to genes and environment can be studied, just as they are for all other behaviors (see eg. Pinker). The title should be "Preliminary Attempts to Explain Some Aspects of Primitive Religion" since he does not treat higher consciousness at all (e.g., satori, enlightenment etc.) which are by far the most interesting phenomena and the only part of religion of personal interest to intelligent, educated people in the 21st century. Reading this entire book, you would never guess such things exist. Likewise for the immense field of drugs and religion. It lacks a framework for rationality and does not mention the dual systems of thought view which is now so productive. For these I suggest my own recent papers. John Rawls’s political liberalism and its ideal of public reason are tremendously influential in contemporary political philosophy and in constitutional law as well. Many, perhaps even most, liberals are Rawlsians of one stripe or another. This is problematic, because most liberals also support the redefinition of civil marriage to include same-sex unions, and as I show, Rawls’s political liberalism actually prohibits same- sex marriage. Recently in Perry v. Schwarzenegger, however, California’s northern federal district court reinterpreted the traditional rational (...) class='Hi'>basis review in terms of liberal neutrality akin to Rawls’s “public reason,” and overturned Proposition 8 and established same-sex marriage. (This reinterpretation was amplified in the 9th Circuit Court’s decision upholding the district court on appeal in Perry v. Brown.) But on its own grounds Perry should have drawn the opposite conclusion. This is because all the available arguments for recognizing same-sex unions as civil marriages stem from controversial comprehensive doctrines about the good, and this violates the ideal of public reason; yet there remains a publicly reasonable argument for traditional marriage, which I sketch here. In the course of my argument I develop Rawls’s politically liberal account of the family by drawing upon work by J. David Velleman and H. L. A. Hart, and discuss the implications of this account for political theory and constitutional law. (shrink)

Although now over 25 years old, many of the essays are quite contemporary. As expected, none of the authors grasp the full relevance of W for the description of behavior, missing most of the points made in my comments above, his many examples of how S1 becomes S2, his role as a pioneer in EP, and his attempts to separate nature from nurture. Brose has many good points and is aware of the foundational nature of On Certainty, but is too (...) scattered and does not clearly describe W’s analysis of how our innate automatic unconscious S1 is the axiomatic basis for all behavior (but with a few exceptions nobody else to this day has either). Russell’s article is excellent, especially the first part dealing with Kripke’s famously distorted view of W. For a more recent and superb deconstruction of Kripke’s W that is of very general application, see ‘Kripke’s conjuring Trick’ by Read and Sharrock. I also found Coulter’s article quite good, and like Margolis and Harre, he has continued his work to the present day and published widely. Margolis is very bright and well-read but his precious prose and attempt to include as many references as possible results in a lack of clarity and focus. Rosch makes the best effort to apply W to real research but also lacks the broad understanding of him that could transform his view of higher order thought. Harre has since become a major W scholar but has little to say here, so those interested should see my review of his ‘Wittgenstein and Psychology’. Experience clearly suggests that most legal philosophers and ethicists are not surprised to be told that liberal states cannot permissibly prohibit same-sex marriage (henceforth: SSM). It is somewhat less clear just what the appropriate liberal strategy is and should be in defense of this thesis. Rather than try to defend SSM directly, I shall proceed indirectly by arguing that SSM prohibitions are indefensible on liberal grounds. Initially, I shall consider what I take to be the most powerful liberal argument against (...) SSM prohibitions and account for my reservations about it. Then, I shall propose an alternative argument with roots in constitutional law that since SSM prohibitions do not survive liberal scrutiny, they must be rejected. (shrink)

On the Rational Basis of Revelation in Rosenzweig’s Star of Redemption -/- Abraham Mounitz Zefat Academic College Israel -/- Abstract The present study focuses on ‘revelation,’ one of the three constitutive concepts, and possibly the most central such concept, in Rosenzweig’s philosophy. As opposed to its ostensibly religious meaning, the article offers a view of the rational element enfolded within this concept in Rosenzweig’s Star of Redemption. By employing a textual exegesis based on a close reading of (...) Rosenzweig’s language, the article seeks to show that Rosenzweig’s conception of revelation does not refer to an intuitive, Kabbalistic-mystical or esoteric concept. As a central pillar of Rosenzweig’s star-shaped method, revelation is the mediator between God’s love of people to a person’s love of others – which, in turn, is the basis for global redemption. The exposure of the rational-intellectual aspect of revelation thus advances the desired objective of Rosenzweig’s method, and accords with Rosenzweig’s own words when he suggested that “neither does it make the claim to be a philosophy of religion – how could it do that when the word ‘religion’ does not occur in it at all! Rather, it is merely a system of philosophy.” (see Franz Rosenzweig’s The New Thinking (1998), A. Udoff and B.E. Galli, eds., New York: Syracuse University Press, p. 69). (shrink)

Evolution Science and Ethics in the Third Millennium is one of the most lucid academic texts on the subject of evolutionary morality to be published in the last decade. While the book does have some problematic aspects, discussed below, it nonetheless provides what is none other than a comprehensive and rational basis to substantiate the notion that evolutionary science can provide a foundation for the understanding of morality. Cliquet and Avramov take a wholly interdisciplinary approach, encroaching within and (...) forming connections between philosophy, biology, anthropology and sociology among others in their exploration of a rationalized and humanistic approach to moral universalism. They not only take a meta-ethical approach to the investigation of morality in evolutionary science, but they provide a thorough speculative project on potential beneficial future pathways that thinkers and policymakers can employ in making decisions; which is something that is typically sidelined in a topic text such as this. PHILOSOPHY OF HUMAN RIGHTS: HUMAN RIGHTS IN LIGHT OF THEIR INTERNATIONAL PROTECTION Summary The book consists of two main parts: in the first, on the basis of an analysis of international law, elements of the contemporary conception of human rights and its positive legal protection are identified; in the second - in light of the first part -a philosophical theory of law based on the tradition leading from Plato, Aristotle, and St. Thomas Aquinas is constructed. The conclusion contains an (...) application of the results of the analysis conducted in the second part. The first part comprises four chapters. The first aims at revealing characteristics of human rights on the basis of an analysis of historical conditioning of the inter-national law of human rights and its development. The historical context displays the practical, vindicative, and critical character of the positive legal protection of human rights. Moreover, the process of change of positive human rights law is distinguished from the process of change of human rights as such. In the second chapter the content of human rights - a topic which is only auxiliary to the conducted analysis - is discussed. Basic typology and catalogues of rights proclaimed in the Universal Declaration of Human Rights and protected in the International Covenants of Human Rights are presented. The review of the content of rights aims at a more precise limitation of the field of research. The examination shows a diversity of rights which poses a serious challenge to the coherence of every philosophical theory of human rights. In the third chapter, central in the first part, international law is analyzed with regard to the characteristics of rights and the foundations of them. The analysis of documents shows a number of solutions referring to the anthropological foundations of rights. The inherent dignity of the human person is the source of all human rights. Each human being is recognized as free, and endowed with both reason and conscience. In the propounded conception of man individuals are not rivals but create a community which is a condition for their development. International law characterizes the rights as universal, inherent, inalienable and inviolable. The reconstructed conception also comprises the following basic elements: on the level of the structure of rights, a recognition of their equality, interdependence, and comprehensiveness; in the grounding of these rights, a recognition of the anthropological foundations of law; in the conception of positive law, a recognition of the secondariness of the positive law of human rights to human rights themselves, and a recognition of human rights and justice as the basis for legal order; in the conception of state, a recognition of the well-being of the individual as the fundamental aim of actions undertaken by political institutions, and recogni¬tion of rights which form an impassable boundary to the power of the state, includ¬ing its legislative actions. The characterization of the international legal paradigm serving for the under¬standing of human rights is supplemented by analyses of the structure of their posi¬tive legal protection. Various meanings of the terms "right" and "freedom" are distinguished. Subjective right, as basic structure of the positive legal protection of human rights, is understood as a complex relation formed by various legal situations of the subject of a right which create a functional whole in respect of the subordi-nation of human person to its good. Subordinating person to a good proper for it, expressed usually in a proclamatory norm, is the central element of particular rights around which further elements aiming at the realization of this good are built. In the second part of the book a philosophical theory is developed which allows for the location of a coherent foundation for the presented characterization of human rights and their positive legal protection. This part consists of two chapters. The first includes a review of some - not entirely satisfactory - means of founding of human rights; the second presents philosophical conceptions of law and man which may form a basis for the constructed theory. The review of arguments contained in the first chapter does not aim at a detailed analysis of various specific ways of argumentation encountered in works on this subject but rather at a concise presentation of the main possible lines of argumentation. These analyses also serve to emphasize the positive solutions which are pro¬posed later and to underscore the explanatory power of the elaborated theory. This theory, retaining accurate intuitions contained in the presented types of argumenta¬tion, helps in avoiding their consequences which are difficult to reconcile with the reconstructed paradigm of human rights. Efforts to base human rights on the norms of international law rightly take into account the necessity of determining the content of the rights and their positive legal protection as a means for the realization of man's good. These attempts, how¬ever, do not properly take into account the inherent character of human rights, which are independent of positive law and provide grounds for applying specific legislative measures and not others. Founding human rights on freedom accurately points at the freedom of an indi¬vidual as a constitutive element of some rights; however, absolutization of freedom leads, to a loss of an important element of the contemporary paradigm of under¬standing human rights. This foundation undermines recognition of the fact that human rights may set limits to both the freedom of others and the freedom of the subject of rights itself. Additionally, attempts at the so-called axiological justification of human rights are discussed. This type of justification has a few variants depending on the as¬sumed conception of value. Subjectivistic conceptions have similar advantages and disadvantages to the conceptions basing human rights on freedom; objectivistic conceptions while providing for the universality of human rights place, the fundamental aim of human rights protection beyond the individual human being - in the idealistically existing world of values; finally, conceptions rooting values and human rights in culture, while accurately noting that human rights are learned through the medium of culture, place the source of human rights beyond a concrete individual - in culture and processes which take place in it - which leads to difficulties in finding a basis for the universality of rights. Furthermore, attempts to ground human rights in specific characteristics of the human being are presented. This type of approach points to an important problem of dependence of the content of rights on what man is. However, recognition of specific characteristics of a human being as an ontic foundation of the existence of rights poses a danger to their universality since one has to accept that it is not enough to be a man to be a subject of rights, but a man possessing specific charac¬teristics. The second chapter aims at outlining solutions worked out by Saint Thomas Aquinas. For a fuller understanding of his propositions selected elements of Plato's and Aristotle's philosophy are presented. It was them who formulated the founda¬tions for reflection on law and justice in the ontological context. A qualification is made that Stoicism is not be analysed in depth. Although Thomas' concept of law was undoubtedly developed under the influence of the Stoic doctrine as well, it is not in this that one should look for the tools to understand the ontic foundations of human rights and law in general since the Stoic moral philosophy and philosophy of law were developed in the context of a theory of being which assumed monistic and pantheistic premises as foundations, leading to the recognition of a total subor¬dination of the human individual to a larger unity of which man is only a part. The analysis of Plato's and Aristotle's texts concentrates on problems of justice. Plato seems to be the first philosopher who reflected on the formula basic in the history of European thought: to render to each his due. It appears that justice as both a characteristic of man and his acts is understood in the perspective of that which is just, that which is a good for another man - the recipient of the act. The basis for determining what is just is the relation of correspondence between some¬one and something. While in the case of Plato this relation is based on something beyond its terms, namely on ideas, in the case of Aristotle the relation occurs on account of the elements of the relation itself. Something is just when it contributes to the develop¬ment of the recipient of an act realizing that which is just. At the same time, the realization of that which is just is a good for the agent. In the analysis of the just two types of relation are revealed: the relation of due-to-recipient occurring on account of the compatibility of that which is due, with the recipient of the act; and - a "superstructure" - a relation of obligation-of-subject occurring on account of the compatibility of the acting subject with the thing which should be done. The basis for being that which is due is formed by various potentialities of development of man - the recipient of agency; the basis of being that which is an obligation is the possibility of development of the subject of action. Aristotle distinguishes various types of freedom and points to the necessity of taking them into account in the discussion of justice. Among other things, as the core of man's freedom, he considers life for its own sake, which can be seen as his expression of the basic indices of the autotelic character of man - which is funda¬mental for later conceptions of dignity. The freedom which is described by him is not, however, inherent and inalienable; being free is conditioned by a factual possi¬bility of undertaking actions, which are not solely means to the realization of aims set by others. Thomas Aquinas takes over the Aristotelian research perspective both in his conception of man and of law. At the same time, however, he significantly enriches it. In anthropology he develops a conception of personal being. Drawing upon his distinction between existence ("that something is") and essence ("what something is"), he sees the basis for being a person in the dignity of personal being which is a certain way of existence of a rational being more perfect than that of non-personal beings. The person is a being which, by virtue of its act of existence, is individual¬ized in a specific way. It is an aim in itself. Expressing it in a negative way, one may say that it does not exist as a means for the realization of the aims of others and, in this sense, that it is free. As distinct from Aristotelian conclusions, being a person is not conditioned by the specific actions of a being. Dignity is inherent, based on that which is the foundation of the factual existence of every rational being. Although freedom requires that a being is rational, dignity still encompasses all being, all its properties and potentialities. Thus an act conforming with dignity has to take into account a whole human being. Among different types of that which is just, ius, the first place, from the point of view of understanding law, falls to "the just thing itself ("ipsa res justa"), which is right in the full meaning of the word. On the one hand, it is that which is due; on the other hand, it determines the way of acting in the utmost degree, since the course of every act is determined in the fullest extent by its aim. The content of ius may be determined both by elements independent of free decisions - ius naturale - and by free decisions taking into account the state of things - ius positivum. Recognition of the objective structure of being as the basis of law does not entail that it is possible or desirable to determine unequivocally "the only right" patterns of conduct. This concept is very well justified within the system proposed by Saint Thomas. Individualization of being is a significant element of the develop¬ment of a person as a person. It is attained by the realization of individual aims which are not unequivocally determined by circumstances and the nature common to all people. By virtue of free choices made in the sphere of that which is not by its nature unjust, the object of action becomes ius. Since in the realization of the person the individualization of human being is central, Aquinas clearly sees the need for the protection of the sphere of "dominion of will". This sphere itself constitutes ius naturale, something which is due to man independently of the acts of will. Therefore "law should forbid nothing which is not unjust" ("nihil debet lege prohiberi quod licite fieri potest", In 3 Sent., dist. 40, q. I, a. 1, 3). Besides the relation of due-to-recipient, ius also includes the relation of obligation-of-subject which is superimposed on the relation of due-to-recipient. As far as the ontic foundations of obligation are concerned, in explaining why man is subordinated to realization of the good of others, Aquinas generally follows Aristotle in accepting that this basis is the subordination to moral good - to actions conforming with the learned truth about reality. Aquinas' systemic solutions allow, however, to reach deeper and understand why moral development is also a development of the whole human being. This was difficult within Aristotle's system, since he was reluc¬tant to decide whether precedence should be given to intellectual or moral develop¬ment. The inclination to realise good of another appears to be a transcendental characteristic of being, based on its very existence. Morality understood as rational and free subordination to realize the good of another is a specifically personal way of the realization of this inclination. Thus just actions contribute to the actualization of being in the aspect of its existence and therefore to the actualization of being as a whole. Thomas' conception of natural law (lex naturalis) as participation in eternal law (lex aeterna), offers possibilities for grasping that which is just as something which is basically accessible cognition, independently of Revelation and independently of faith in God, and at the same time as something based in eternal law, understood as a design of God's wisdom. Eternal law, embracing all particular actions, is not, from the human perspective, accessible cognition directly. It is enacted in the struc-ture of the created being and - in case of human beings - in free choices taking this structure into account. In the concluding remarks, the results obtained earlier are applied directly to the contemporary conception of human rights. Human rights are understood in the first place as "just things" - concrete goods of man; as that which is due because of subordination, based on dignity, to the personal development of man. That which is just is understood as a relational - actual or potential - state of things, which exists by virtue of existing relations. Evaluations referring to that which is right are true when respective relations of due-to-recipient take place; norms of conduct are true when respective relations of obligation-of-subject take place. Examples of the application of the sketched theory outside the field of human rights are also presented. Procedural consequences of the developed theory are shown, such as the discrimination of two types of legislative procedures which differ significantly in the structure of argumentation: the first aims at recognition of that which is just independently of the will of the legislator, and the second, at making individual or collective "projects" of development compatible. Finally the possibilities of applying the theory to the increasingly important problems of the protection of the environment and the "rights" of animals are mentioned. The central issue is a philosophical conception of man and his freedom and a conception of law. It is also indispensable to turn to a general theory of being. The search for a comprehensive theory of human rights requires attention to the Abso¬lute Being - God - as well. This is important for at least two reasons. First, a conception of the Absolute Being is integral to philosophy of the systemic type -of which the present book is a piece. A conception of the Absolute Being is signifi¬cant for understanding all being, including, first of all, man as a personal being. Second, every theory of human rights which does not comprise the problem of the Absolute may be questioned as to whether solutions adopted in it do not lead, in consequence, to eliminating God from the perspective of the understanding of law. It is desirable that a philosophical theory should deal with this problem directly. A theory which eliminates God from the perspective of the understanding of rights will be unacceptable for all those who, for philosophical reasons or relying on faith, consider God as the author of inherent rights. Nevertheless, a theoretical approach to rights from the perspective of the Absolute Being should only be a possible extension of a philosophical approach which bases rights on something which is cognizable independently of the acceptance of the existence of God so that the theory is also acceptable for those who reject the existence of God or suspend their judgment on this subject. The pursued theory should therefore contain, on the one hand, reference to natural, faith-independent foundations of human rights, but on the other hand, point to a possible extension accounting for the Absolute Being. The analyses contained in this chapter have undoubtedly some historical value since they are based on source texts. Nevertheless, the use of these texts and not critical works was dictated, first of all, by a conviction that analyses embrace a given theory in the aspect selected by the interests of the researcher. Therefore to find out what past thinkers say on the subject characterized in the first part it is simpler to reach to the sources than to adopt the existing critical works. The pre¬sented reconstruction of Aquinas' views on philosophy of law incorporates proposi¬tions of supplementing and developing some of the ideas undertaken by him. Obligation to act in this and not an other way arises because human actions are subordinated to the conformity, on the one hand, of aims realized by these actions and, on the one hand, the order of being determining that which is favourable to man or destroys him. The content of the order of being is, on the one hand, determined by the structure of being independent from man's will and, on the other, by free decisions of man. (shrink)

At a time when professional art criticism is on the wane, the ancient quarrel between art and philosophy demands fresh answers. Professional art criticism provided a basis upon which to distinguish apt experiences of art from the idiosyncratic. However, currently the kind of narratives from which critics once drew are underplayed or discarded in contemporary exhibition design where the visual arts are concerned. This leaves open the possibility that art operates either as mere stimulant to private reverie or, in (...) the more contentful cases, as propaganda. The ancient quarrel between art and philosophy is that art influences surreptitiously while philosophy presents reasons that invite rational scrutiny. As such, in contrast to philosophy, art would undermine our agency. In July 2017, a group of philosophers gathered at the Art Gallery of NSW (AGNSW), in Sydney, Australia, in the presence of two AGNSW curators to explore the basis of their own experiences of selected artworks. Here, those commentaries are reproduced. Each reveal that objective grounds for an experience of art can be based in the community from which one draws one’s terms of reference. In our commentaries we see the expertise of the respective philosophical communities but other communities of culture or expertise might serve the same purpose and hence resolve the ancient quarrel. Before hearing these commentaries, I explain what is at stake when the ancient quarrel between art and philosophy is understood in contemporary terms. This Issue of the Curator also includes an article on the community-based art criticism that emerges from these commentaries followed by an exhibition review which reveals the incorrigible impulse (also demonstrated in the commentaries) to find the basis for the most apt experience of an artwork. This dissertation is a contribution to the field of empirically informed metaethics, which combines the rigorous conceptual clarity of traditional metaethics with a careful review of empirical evidence. More specifically, this work stands at the intersection of moral psychology, moral epistemology, and philosophy of action. The study comprises six chapters on three distinct (although related) topics. Each chapter is structured as an independent paper and addresses a specific open question in the literature. The first part concerns the psychological features (...) and cognitive function of moral intuition. Chapter 1 (“Moral intuition, strength, and metacognition”) is focused on the concept of intuitive strength, which is one of the defining features of moral intuition. I provide a metacognitive account of intuitive strength and show why such a view is preferable to emotional or quasi-perceptual accounts. Then, in Chapter 2 (“Dual process reflective equilibrium”), I will discuss the interplay between intuition and reflection in moral reasoning. I will contend that the influential “default-interventionist” model of reasoning, theorized by Greene, is insufficiently supported by the evidence. In light of some recent studies, I outline an account of moral reasoning in which intuition and reflection are not in conflict but cooperate to reach a reflective goal. I call this model dual process reflective equilibrium. The aim of the first part is descriptive, i.e., it argues for an accurate understanding of moral intuition and reasoning in light of the available empirical evidence. In contrast, the second part addresses a normative question: is a subject epistemically justified in forming a belief on the basis of a moral intuition? Skeptics of moral intuition argue that accepting moral intuitions should be the exception rather than the rule to the extent that epistemically defective processes determine the content of moral intuitions. Chapter 3 (“Moral intuitionism and the reliability challenge”) introduces the recent empirical challenges to the reliability of moral intuitions and elaborates a promising strategy for defending intuitionism. In short, I consider whether subjects can track the reliability of their intuitions with their confidence. In Chapter 4 (“The argument from limited cognitive resources”), I evaluate a different strategy to defend moral intuitionism. Specifically, I develop an argument according to which accepting moral intuitions is legitimate because it is the most rational option that a subject has, given her limited resources. The third and final part of the dissertation concerns the role of moral intuitions in action. The influence of automatic processes on moral conduct raises different challenges to moral philosophy. The first challenge is to explain how a subject can be motivated by certain values without the mental effort of deliberation. Chapter 5 (“Caring, moral motivation, and automatic conduct”) tackles this issue. Chapter 6 (“Moral sensitivity as skillful automaticity”) aims to explain how moral agents can be sensitive to good reasons through automatic mental processes. (shrink)

Neoclassical economists use expected utility theory to explain, predict, and prescribe choices under risk, that is, choices where the decision-maker knows---or at least deems suitable to act as if she knew---the relevant probabilities. Expected utility theory has been subject to both empirical and conceptual criticism. This chapter reviews expected utility theory and the main criticism it has faced. It ends with a brief discussion of subjective expected utility theory, which is the theory neoclassical economists use to explain, predict, and prescribe (...) choices under uncertainty, that is, choices where the decision-maker cannot act on the basis of objective probabilities but must instead consult her own subjective probabilities. This text provides an introduction to the topic of rational decision making as well as a brief overview of the most common biases in judgment and decision making. "Decision Making" is relatively short (300 pages) and richly illustrated with approximately 100 figures. It is suitable for both self-study and as the basis for an upper-division undergraduate course in judgment and decision making. The book is written to be accessible to anybody with minimum knowledge of mathematics (high-school level algebra (...) and some elementary notions of set theory and probability, which are reviewed in the book). At the end of each chapter there is a collection of exercises that are grouped according to that chapter’s sections. This paper is an attempt to provide an adequate theoretical framework to understand the biological basis of human rights. We argue that the skepticism about human rights is increasing especially among the most rational, innovative and productive community of intellectuals belonging to the applied sciences. By using examples of embryonic stem cell research, a clash between applied scientists and legal scientists cum human rights activists has been highlighted. After an extensive literature review, this paper concludes that the (...) advances in applied sciences proven by empirical evidence should not be restricted by normative theories and philosophies of the social sciences. If we agree on these premises that Human Rights are biological, then biology can provide a framework of cooperation for social and applied scientists. (shrink)

A theory of rationality is a theory that evaluates instances of reasoning as rational, irrational, or (ir)rational to some degree. Theories can be categorized as rule-based or consequentialist. Rule-based theories say that rational reasoning accords with certain rules (e.g., of logic or probability). Consequentialist theories say that rational reasoning tends to produce good consequences. For instance, the reliabilist takes rationality to be reasoning that tends to produce mostly true beliefs. The pragmatist takes it to be reasoning (...) that tends to produce mostly useful beliefs. Suppose that two competing norms, N1 and N2, can be identified such that a given person’s response can be interpreted as correct according to N1 but incorrect according to N2. Which of these two norms, if any, should one use to interpret such a response? In this paper we seek to address this fundamental problem by studying individual variation in the interpretation of conditionals by establishing individual profiles of the participants based on their case judgments and reflective attitudes. To investigate (...) the participants’ reflective attitudes we introduce a new experimental paradigm called the Scorekeeping Task. As a case study, we identify the participants who follow the Suppositional Theory of conditionals (N1) versus Inferentialism (N2) and investigate to what extent internally consistent competence models can be reconstructed for the participants on this basis. After extensive empirical investigations, an apparent reasoning error with and-to-if inferences was found in one of these two groups. The implications of this case study for debates on the proper role of normative considerations in psychology are discussed. (shrink)

After the discoveries of such scholars as J. H. Poincaré, E. N. Lorenz, I. Prigogine, etc. the term ‘chaos’ is used actively by representatives of various scientific fields; however, one important aspect remains uninvestigated: which attitude one should have toward chaotic phenomena. This is a philosophical question and my dissertation aims to find the answer in the history of philosophy, where chaos theme has had its investigators from ancient philosophy to the philosophical theories of the 21st century. My dissertation is (...) based on the idea that sciences and philosophy can achieve significant success in exploring chaos theme when their efforts are combined. This dissertation research is designed to help in the planning of conscious, rational actions towards chaotic phenomena, since it is aimed at exploration and systematic presentation, as well as comprehension of possible systems of such actions – philosophical strategies for interacting with chaos. -/- Results of the dissertation are the following. I reveal, reconstruct, and explain the content of six possible strategies for interacting with chaos that were worked out in history of philosophical thought: ordering, avoiding, transfiguring, preventing, controlling, and integrating. I argue that the first philosophical strategies for interacting with chaos were worked out in the 19th century by German philosophers K. W. F. Schlegel and F. W. Nietzsche on the basis of their rethinking the ideas which were expressed by different thinkers during classical antiquity, the Middle Ages, and the modern period. I show that ideas of strategic views towards chaos were also elaborated by such 20th-century thinkers as H. Rickert, N. Berdyaev, I. Prigogine, H. Haken, G. Deleuze, Q. Meillassoux, and others. I outline the main stages of the evolution of philosophical strategies for interacting with chaos as well as its regularities. The dissertation shows perspectives of further development of each one of the six strategies for interacting with chaos. -/- In contemporary scientific and philosophical research on chaos, my exploration contributes to the new approach to improving the understanding of aims of acts towards chaotic phenomena. I think that knowing a range of different strategic views of chaos help researchers of chaotic phenomena to choose the most appropriate and rational reactions. In the area of history of philosophy, my research contributes detailed data about development and conceptual transformations of the notion of ‘chaos’ through all periods of Western philosophy. -/- The dissertation consists of five chapters: 1) Literature Review, Methodology and Key Research Terms, 2) Ancient and Medieval Philosophical Ideas about Chaos, 3) Genesis of the First Strategies for Interacting with Chaos, 4) Strategies for Interacting with Chaos in the 20th and 21st Centuries, 5) Regularities and Prospects of the Development of Philosophical Strategies for Interacting with Chaos. In the first chapter I analyze more than five hundred books, articles, and other philosophical and scientific sources in which the chaos theme is raised. I also argue the necessity of applying methods such as analysis, the structural method, the hermeneutic method of interpretation, and the comparative method in my dissertation research. Moreover, in this chapter, I define key terms for my dissertation – ‘chaos’ and ‘philosophical strategies for interacting with chaos.’ -/- Then, in the next chapter, I analyze the appearance and development of Ancient and Medieval philosophical ideas about chaotic phenomena and order. Particularly, I explore thoughts of philosophers such as Anaxagoras, Anaximander, Heraclitus, Empedocles, Plato, Aristotle, Augustine of Hippo, Bernard Silvestris, Ramon Llull, etc. In this chapter I also compare the first Western ideas about chaos with similar thoughts from Eastern philosophy, analyzing Indian and Chinese philosophical ideas about disorder. -/- In the third chapter I explore transformations in understanding the meaning of the term ‘chaos’ in philosophy from the 15th to the end of the 19th century. I analyze ideas about chaos and order from thinkers such as M. Ficino, Paracelsus, F. Bacon, P. Bayle, Voltaire, J. G. Herder, I. Kant, F. W. J. Schelling and other philosophers from the Renaissance, the Age of Enlightenment, and the German idealist period, showing that these thinkers’ new approaches to interpreting the notion of ‘chaos’ were the background for K. W. F. Schlegel’s and F. W. Nietzsche’s creations of the first strategies for interacting with chaos in the 19th century. I finish the chapter with detailed analysis of K. W. F. Schlegel’s strategy for transfiguring chaos and F. W. Nietzsche’s strategy for ordering chaos. -/- The development of philosophical strategies for interacting with chaos in the 20th and the beginning of the 21st century is the topic of the fourth chapter. I research new ideas about ordering chaos (H. Rickert) and transfiguring chaos (N. Berdyaev). Also, I reveal thoughts about avoiding chaos (A. Camus), preventing chaos (J. Ortega y Gasset), integrating chaos (G. Deleuze, Q. Meillassoux). Moreover, I analyze a philosophical component of the strategy for chaos control (I. Prigogine, H. Haken). In the final fifth chapter of the dissertation I trace the major features of philosophical strategies for interacting with chaos and find out the main conditions and periods of their development. Then I outline the prospects for the development of the philosophical strategies for interacting with chaos and show the most productive ways of their progress. (shrink)

Ethics for Rational Animals brings to light a novel account of akrasia, practical wisdom, and character virtue through an original and comprehensive study of the moral psychology at the basis of Aristotle's ethics. It argues that practical wisdom is a persuasive rational excellence, that virtue is a listening excellence, and that the ignorance involved in akrasia is in fact a failure of persuasion. Aristotle's moral psychology emerges from this reconstruction as a qualified intellectualism. The view is intellectualistic (...) because it describes practical wisdom as the sort of knowledge that can govern desire and action and akrasia as involving a form of ignorance. However, Aristotle's intellectualism is qualified because practical wisdom goes beyond grasping the truth about the human good, for it must also be able to convey the truth persuasively to non-rational cognition and desires. Do they prefer implicit bedside rationing that allows the physician–patient relationship broad leeway in individual decisions? Or do physicians prefer strategies that apply explicit criteria and rules?

It is widely thought that chance should be understood in reductionist terms: claims about chance should be understood as claims that certain patterns of events are instantiated. There are many possible reductionist theories of chance, differing as to which possible pattern of events they take to be chance-making. It is also widely taken to be a norm of rationality that credence should defer to chance: special cases aside, rationality requires that one’s credence function, when conditionalized on the chance-making facts, should (...) coincide with the objective chance function. It is a shortcoming of a theory of chance if it implies that this norm of rationality is unsatisfiable. The primary goal of this paper is to show, on the basis of considerations concerning computability and inductive learning, that this shortcoming is more common than one would have hoped. (shrink)

a review of John Pollock's *Thinking about Acting* with a focus on his aim of describing psychological mechanisms which are humanly feasible.

This paper discusses the validity of nudges to tackle time-inconsistent behaviours. I show that libertarian paternalism is grounded on a peculiar model of personal identity, and that the argument according to which nudges may improve one’s self-assessed well-being can be seriously questioned. I show that time inconsistencies do not necessarily reveal that the decision maker is irrational: they can also be the result of discounting over the degree of psychological connectedness between our successive selves rather than over time. Time inconsistency (...) can call for paternalism if and only if we accept that an individual is characterised by stable “true” preferences over time-dependent outcomes, and that she is rationally required to make time-consistent choices. This model is descriptively and normatively questionable. I then argue that behavioural findings may still justify paternalistic interventions, but on a non-welfarist basis. (shrink)

This book is written so as to be ‘accessible to philosophers without a mathematical background’. The reviewer can assure the reader that this aim is achieved, even if only by focusing throughout on just one example of an arithmetical truth, namely ‘7+5=12’. This example’s familiarity will be reassuring; but its loneliness in this regard will not. Quantified propositions — even propositions of Goldbach type — are below the author’s radar.The author offers ‘a new kind of arithmetical epistemology’, one which ‘respects (...) certain important intuitions’ 1 : apriorism, realism, and empiricism. The book contains some clarification of these ‘isms’, and some thoughtful critiques of major positions regarding them, as espoused by such representative figures as Boghossian, Bealer, Peacocke, Field, Bostock, Maddy, Locke, Kant, C.I. Lewis, Ayer, Quine, Fodor, and McDowell. The philosophical reader will find some interest and value in these wider-ranging discussions. Our concern in this review, however, is to examine closely the original positive proposal on offer.Arithmetical truths, the author maintains, are conceptual truths. Knowing truths like 7+5=12 involves no ‘epistemic reliance on any empirical evidence’; but that, she says, is not to claim ‘epistemic independence of the senses altogether’. She wants to show that "experience grounds our concepts … and then mere conceptual examination enables us to learn arithmetical truths ." Concepts that are ‘appropriately sensitive’ to ‘the nature of [an independent] reality’ she calls grounded. Because of the role of grounded concepts, ‘arithmetical truths explain our arithmetical beliefs in the right sort of way for those beliefs to count as knowledge’ .In the context of her concentration on the special nature of arithmetical knowledge, the author offers what could strike some bystanders as an unnecessarily over-ambitious account of knowledge tout court. This is an excellent book that deserves careful attention from anyone whose work touches on issues in the philosophy of mind and action. In it, Marcus challenges the dominant philosophical conception of the mind’s place in nature, according to which mentalistic explanations hold true only when mental states or events cause things to happen in the same way as physical states and events do. Against this conception, Marcus argues that mental causation is utterly dissimilar to most of the causation we (...) find in the physical realm, and that psychological achievements like believing and acting for reasons should be understood as manifestations of the rational ability self-consciously to represent good-making relations as holding between propositions and actions. Over the past several decades, we devoted much energy to generating, reviewing and summarizing evidence. We have given far less attention to the issue of how to thoughtfully apply the evidence once we have it. That’s fine if all we care about is that our clinical decisions are evidence-based, but not so good if we also want them to be well-reasoned. Let us not forget that evidence based medicine (EBM) grew out of an interest in making medicine ‘rational’, with (...) the idea that rational clinical evaluations should be evidence-based. I agree with the uncontroversial statement that the best decision is supported, at least in part, by the best available evidence. Rationality, however, is constituted by reasoning, not evidence. Complete arguments are necessary for rational evaluations, arguments that begin with general evidence and end in a conclusion about a particular patient. In order to traverse these inferential gaps, medicine must address the issue of how to establish, as an intermediate premise, what the evidence has to say about the efficacy of an intervention for particular patients in a particular practice setting. I intend to dismantle a piece of historiographic mythology created by self-styled ‘Revisionists’ (Hill, Alvey, Oslington, etc.). According to the myth, Adam Smith endorsed several of the traditional proofs of God’s existence; he believed that the order existing in the world is a morally good order implemented by Divine Providence; he believed that evil in the world is part of an all-encompassing Divine Plan; and that the ‘invisible hand’ is the hand of the Christian God who leads the rich to (...) employ their wealth for the greater benefit of the greatest number. I argue instead that there is a remarkable analogy between Smith’s and Kant’s theory of religion. Smith’s philosophy is a third way between Rationalism and Phyrronism, arguing that doctrines confirmed by reason in every field, from natural science to theology, are nothing more than combinations of ideas agreeable to the imagination; if we try, on the basis of both Smithian texts and their context and co-text, to reconstruct his lectures on natural theology, all kind of evidence converge in indicating that he reduced proofs of God´s existence to ‘inventions of the imagination’ and argued that philosophical theism is not different in status from primitive belief in invisible beings, or that it is as unwarranted as any system is, and besides that it generates a moral conundrum; he argued also that teleological explanations are no more and no less imaginary than those based on efficient causes, that the teleological order we may imagine in the world is not too bad from a ‘consequentialist’ point of view, and yet it is far below any moral standard; I argued that this is by no means a proof of Smith’s ‘irreligion’ and also that no convincing proof of any turn from religion to irreligion on his part has been provided so far, and finally that the two viable options he left open were either dismal unbelief or Theism on a moral basis. I defend this third way by proving that what Smith’s lost lectures on natural religion said can be reconstruct with some plausibility and what they did not say with absolute certainty; I argue that he developed a sharp criticism of natural theology, that he argued that at the root of religion there are a number of principles of the mind that make religious belief a ‘natural belief’; I do so by reconstructing, first, the context of the missing lectures (sect. 2); then the contents of their first part, considering the proofs of God’s existence and his attributes (sects 3-4); the ‘principles of the mind’ lying at the root of polytheism (sect. 5), of philosophical monotheism (par. 6), and of pure and rational religion (par.7); I contend, then, that his vindication of toleration is consistent with ‘pure and rational religion’ (par. 8) and that attempts to prove a phantom conversion to ‘natural religion’ or ‘irreligion’ result from misreading (par.9). My conclusions are the following: i) Adam Smith claimed that any natural theology is impossible; ii) There is in fact some kind of order in the world, and it proves useful to a point in allowing for humankind’s survival, but it doesn’t meet any minimal moral criterion; iii) the world is not teleologically ordered; we may indeed imagine such order for mental economy, but the world abounds in misery and depravity; iv) consequences of human wickedness and insanity do, happily enough, deviate from intended outcomes; we may feign invisible mechanisms at work behind, but to mistake them for a hidden mechanism is as childish as the primitive’s belief in ‘invisible beings’. v) there are indeed themes from theological doctrines in Smithian economic theory, but they not the kind of rational theology ‘discovered’ by the ‘New View’; they are instead Augustinian and Jansenist themes. vi) Smith’s theological doctrines did – as suggested by Waterman – have a bearing on his economic theory not by ‘doctrinal dependence’ but – as suggested by Harrison – in the more modest role of source of blueprints for economic explanation. Philip Woodward's review of The Phenomenal Basis of Intentionality (PBI) raises objections to the specific version of the phenomenal intentionality theory proposed in PBI, especially to identity PIT, representationalism, the picture of derived mental representation, some tentative proposals regarding intentional structure, and the matching theory of truth and reference. In this reply, I argue that the version of PIT defended in PBI can withstand these objections.

Objective: To examine the current ethical review process of ethics committees in a non-pharmacological trial from the perspective of a clinical investigator.Design: Prospective collection of data at the Study Centre of the German Surgical Society on the duration, costs and administrative effort of the ERP of a randomised controlled multicentre surgical INSECT Trial between November 2003 and May 2005.Setting: Germany.Participants: 18 ethics committees, including the ethics committee handling the primary approval, responsible overall for 32 clinical sites throughout Germany. 8 (...) ethics committees were located at university medical schools and 10 at medical chambers. Duration was measured as days between submission and receipt of final approval, costs in euros and administrative effort by calculation of the product of the total number of different types of documents and the mean number of copies required .Results: The duration of the ERP ranged from 1 to 176 days. The median duration was 26 days at MSUs compared with 34 days at medical chambers. The total cost was €2947. 1 of 8 ethics committees at universities and 8 of 10 at medical chambers charged a median fee of €162 . The administrative effort for primary approval was 30. Four ethics committees required a higher administrative effort for secondary approval .Conclusion: The ERP for non-pharmacological multicentre trials in Germany needs improvement. The administrative process has to be standardised: the application forms and the number and content of the documents required should be identical or at least similar. The fees charged vary considerably and are obviously too high for committees located at medical chambers. However, the duration of the ERP was, with some exceptions, excellent. A centralised ethics committee in Germany for multicentre trials such as the INSECT Trial can simplify the ERP for clinical investigators in and outside the country. (shrink)

In her book Extended Rationality: A Hinge Epistemology (2015), Annalisa Coliva puts forward an anti-sceptical proposal based on the idea that the notion of rationality extends to the unwarrantable presuppositions “that make the acquisition of perceptual warrants possible” (2015: 150). These presuppositions are commonly the target of sceptical arguments, and by showing that they are on the one hand unwarrantable, but on the other are constitutive components of rationality itself, she reveals that they are beyond rational doubt and thus (...) avoids scepticism. Part of Coliva’s defence of using extended rationality in this way involves distancing it from relativist interpretations, which she describes as “devastating” (2015: 120). She proposes two ways that someone might attempt to formulate epistemic relativism from her extended rationality view, and argues that both would be unsuccessful because they require describing alternative conceptions of rationality which are “unintelligible” (in the first case), or “inconceivable” (in the second). The superficial claim of this chapter is that Coliva’s arguments, as they stand, are insufficient to dismiss relativism. She fails to show that the conception of rationality needed for the first formulation of relativism is unintelligible, and overestimates the significance of the second formulation’s conception turning out to be inconceivable. But I also highlight a deeper problem: neither formulation follows a realistic blueprint for relativism, and so these were the wrong possibilities to consider in the first place. To address this issue, I propose a third, more plausible, way in which someone might attempt to formulate relativism on the basis of Coliva’s account. I leave open whether this strategy is successful, or whether a version of Coliva’s criticisms apply to it too. (shrink)

The purpose of the article is to develop a methodology for alternative substantiation of financial support for bridge construction. To achieve the purpose, the following general scientific and special methods and techniques of research were used: “golden ratio” rule; systematization and generalization; generalization of the results of the analysis and the logical generation of conclusions. Initially, the article analyzed the state of bridge structures in Europe and Ukraine. Based on the analysis, a disappointing situation has been identified, namely that a (...) significant ratio of bridges number require major overhaul or are in critical condition. During the research, the following tasks were solved, namely: physical wear of the bridge as a failure was considered; the feasibility of investing in reconstruction or new bridge construction was determined. For the purpose of rational use of financial resources, which are limited in the age of economic challenges, and on the basis of the rule of “golden proportion”, the maximum percentage of investment in reconstruction is determined. If the limit is exceeded, it is decided to build a new bridge. This result allows making an economically sound decision and evaluating the effectiveness of the invested resources. It is proved that if the wear index of the overhaul bridge construction is higher than the wear rate of the new bridge construction by λ2 / λ1, and the amount of funds for overhaul reaches 70% of the funds needed to build a new one, it is better to build a new bridge.
