For a transitional market with a short history like that of Vietnam, corporate governance is a critical area of improvement. The issuance of Circular 121 in 2012 marked an important milestone of corporate governance reform in Vietnam as it includes stricter and more well-defined regulations learned from international best practices. Among them is the requirement that independent directors should make up at least one-third of the board of directors. Although improving financial reporting is not at the heart of Circular (...) 121, this Circular is expected to reduce earnings management through the mandatory requirement of board independence. Using data collected from a sample of 523 non-financial listed firms from 2009 – 2016, this study finds no significant relationship between earnings management and the proportion of independent directors, and Circular 121 has no impact on this relationship. These results are consistent across different regression approaches and various robustness tests, suggesting that board independence and corporate governance reform are not effective tools in mitigating earnings management. This paper is the first major and a thorough study on the Merger & Acquisition (M&A) activities in Vietnam’s emerging market economy, covering almost entirely the M&A history after the launch of Doi Moi. The surge in these activities since mid-2000s by no means incidentally coincides with the jump in FDI and FPI inflows into the nation. M&A industry in Vietnam has its socio-cultural traits that could help explain economic happenings, with anomalies and transitional characteristics, far better than even (...) the most complete set of empirical data. Proceeds from the sales of existing assets and firms have mainly flowed into the highly speculative industries of securities, banking, non-bank financials, portfolio investments and real estates. The impact of M&A on Vietnam’s long-term prosperity is thus highly questionable. An observable high degree of volatility in the M&A processes would likely blow out the high ex ante expectations by many speculators, when ex post realizations finally arrive. The effect of the past M&A evolution in Vietnam has been indecisively positive or negative, with significant presence of rent-seeking and likelihood of causing destructive entrepreneurship. From a socio-economic and cultural view, the degree of positive impacts may result in domestic entrepreneurship which will perhaps be the single most important indicator. (shrink)

The writings and speeches of the Mexican president Andrés Manuel López Obrador (2018-2024) have been characterized by a constant reference to a teleological history. Using Karl Löwith’s proposals, I analyse the president’s liberal-progressive idea of history and I propose that in this respect he has followed a certain speculative philosophy of history, which I call philosophy of Trans-Historic-History.

In recent years, an array of critical emotion theorists have emerged who call for change with respect to how emotion theory is done, how emotions are understood, and how we do emotion. In this chapter, I draw on the work that some of these authors have produced to analyze how emotional marginalization of trans and disabled identities is experienced, considering in particular how this emotional marginalization results from the long history of pathologization of trans and disabled people. The past and current pathologization of trans and disabled people is produced through normative assumptions, values, and beliefs that uphold systems of normalcy, including assumptions, values, and beliefs about how we feel and express emotions. In order to examine these issues, I identify three different stages at which emotional marginalization may take place: emotion experience, emotional display, and emotion recognition. In other words, emotional marginalization of trans and disabled people can occur at any of these stages. The central concern of my chapter is thus to show how emotional marginalization, at each of these stages, affects trans and disabled people. (shrink)

The relationship between art and time is one of pre-figuration–transfiguration, a continuous exchange between the art of the present and that of the past and it is in this sense that we can understand how the works of art are have almost their entire life before them. It is in this sense also that the real meaning of metamorphosis should be understood: The works of art are not permanent acquisitions. They offer themselves the ways through which they appear in another (...) light, gathering up at the same time a series of antecedent expressions in an eternity ever to be recreated. Hence, art’s time is neither a-historical nor exclusively history embedded (in history’s empirical sense). Art’s time is trans-historical: artworks, initiating themselves the process of their metamorphosis, ‘transcend’ time being into time and, thus, they ‘traverse’ history. (shrink)

This essay discusses short-circuited trans care by focusing on failures of t4t as an ethos both interpersonally and within particular trans scenes. The author begins by recounting an experience working at a bar/restaurant that appealed to its identity as a caring trans community space as part of its exploitation of trans workers. This dynamic inspires the main argument, that t4t can become an ethos of scenes and institutions beyond the interpersonal while short-circuiting practices of trans (...) care. Short-circuited trans care is then traced to t4t by drawing from Hil Malatino's work on trans care and t4t, Kai Cheng Thom's work on community dynamics, and trans literature to argue that practices of t4t often include abuse, expulsion, and assumptive care. This short-circuited trans care is linked to trans scenes by discussing the ethos of t4t in the history of Topside Press and trans cultural production. The author does not condemn t4t and to this effect offers a critique of tethering trans cultural production to prestige instead of care. Rather, the goal of this essay is to openly discuss aspects of t4t and trans care that are often obscured through the projection of a highly questionable “we” or universalized “trans community.”. In 2011, a 5,000-year-old “male” skeleton buried in a “female” way was discovered by an archaeological team just outside of modern-day Prague. This article queries the impulse to name such a discovery as evidence of transgender identity, and bodies, in an increasingly ancient past. To do so, it takes up the work of Denise Ferreira da Silva, Sylvia Wynter, and Hortense Spillers as a means to push back against the impetus to name such discoveries “transgender” in order to shore up (...) the legitimacy of contemporary trans identity. Each of these three thinkers offers a different vantage point for rethinking such naming practices that push the reader to consider how desires to name and place “transgender” in a distant past papers over the violence of plantation slavery, global imperialism, and the Enlightenment's shift toward scientific reason. This article argues not that such anthropological discoveries should not be considered transgender, but rather that the desire for them to be, or become, transgender does not legitimate contemporary transgender identity, and may instead treat certain iterations of transness as spatially and temporally universal. This paper explores trans poetics as a way of doing trans philosophy. I begin by giving an overview of the current state of trans philosophy. I then give examples of other literatures wherein poetics is taken to be philosophically robust. After giving a brief history of trans poetics, I turn to the poetics statements and poetry of three trans poets—D'Lo, Ching-In Chen, and micha cárdenas—featured in the 2013 anthology Troubling the Line. I show how (...) poetry is often uniquely able to capture the ambiguity of the WTF of trans experience in ways that differ from philosophical argumentation. I conclude by suggesting that poetics might move us away from a potential politics of suffering in trans philosophy to a politics of liberation. (shrink)

Cornelius Castoriadis seemed to retreat from the edge of its significance within his work, a significance that is capable of opening up another turn in the labyrinth of his thought. A clear interrogation into the presence of the chora in his thought has, still, yet to be elucidated. A History of Intelligence and “Intellectual Disability” examines how the concepts of intellectual ability and disability became part of psychology, medicine and biology. Focusing on the period between the Protestant Reform and 1700, this book shows that in many cases it has been accepted without scientific and psychological foundations that intelligence and disability describe natural or trans-historical realities.

In this essay Ernst Cassirer addresses two currents of the philosophical reflection about man and culture that emerged at the end of the 18th century. Th e naturalistic one, conceives of man and culture as an outcome of the processes that takes place beyond the reach of human will and consciousness. Among such naturalistically oriented philosophies Cassirer includes Hegel’s idealism, Taine’s positivism and Spengler’s psychologism. All of them imply a characteristic kind of historical fatalism. In opposition to such a deterministic (...) vision of human development stands a philosophy that emphasizes the importance of individual decision and responsibility for the course of history. Cassirer names it “humanistic” as it places man in the very middle of its research. The initiators of this tradition were Johann Gottfried Herder and Wilhelm von Humboldt, foremost representatives of the German romantic movement. The philosopher who took up their humanistic thought and elevated it to the importance of a distinct knowledge was Wilhelm Dilthey. While bearing in mind who is the real creator of culture all these thinkers pay special attention to the question of man’s responsibility for culture as well as for himself. The problem of human responsibility that totally escaped the attention of naturalistically oriented philosophers is somehow a distinguishing characteristic of all humanistic philosophies of culture. Bakla signals “effeminacy” and “homosexuality,” which stigma signifies being “weak,” “fake woman,” and “unreal man.” This historical research interrogates the etymology of bakla, which etymology claims that bakla only became a label for gay identity since the 1960s. A newfound evidence, the Bienvenido N. Santos’ “Recollections” (1932), challenges this etymology; as the document used bakla to signify “effeminate” decades before the 1960s. -/- Mobilizing this newfound evidence alongside theoretical, historiographic, and archival data, this thesis asks: (1) How can the 1932 (...) “Recollections” help explain the crystallization of bakla into a label for “effeminate homosexual male” identity since the 1960s? (2) What can socio-historical processes further reveal about the etymology of bakla, and why the word bears so much stigma? (3) How did “effeminacy” and male “homosexuality” become semantically linked with bakla’s historic senses? At its core, the study argues that sexism and political instability coincide in the social history of the bakla. -/- Contextualizing bakla’s semantic shifts reveals that the word’s stigma comes from its earliest meaning; besides “fearful and weak,” it was bakla as “deceptive.” While tracking bakla’s semantic links with the pre-existing terms for gay identity shows that bakla was forged alongside historical biases against women. These biases rendered gay men and trans women undesirable. And archival data uncover five (5) factors explaining why bakla crystallized into a gender label, which also offer insights on how bakla has been reclaimed and reworked, despite its persisting stigma, in more recent years. -/- The thesis exposes bakla’s status as a “keyword” in the Philippine conceptual, sexual, and social history. It undresses bakla, opens it to critique, and recognizes the importance its etymology can play in undoing bakla’s stigma, and its potential in rethinking Philippine history itself. (shrink)

This essay develops a concept of curiotization, through which people are reduced to a curio for the fascination of others. I argue that trans people as they have appeared in media, philosophy, and narratives of history are curiotized as forever fascinating, new, titillating, and controversial. In contrast to the narrative of momentous trans progress in the mid-2010s, I point out that frameworks such as the "Transgender Tipping Point" worked to position its "trans moment" as unprecedented and (...) always on the threshold of arrival. To work through a specific example, I point to decades of renewed fascination over trans women being capable of breastfeeding and the long history of trans fascination in popular music. I conclude by emphasizing the obscured world-historical presence of transsexuality as it coincides with the history of pharmaceuticals, hormone technologies, and birth control. In contrast to a "goldfish memory optics" through which trans people become eternally new, fascinating, and debatable, I stress the importance of restoring the complexity of "trans" and its histories back into an understanding of the present. Trans theory is characterized in part by the apparent tension between discursive analyses of cisgender society and phenomenological descriptions of trans experiences. While traditional inquiry into the history of philosophy proposes an interminable opposition between phenomenology and discourse analysis, Rubin’s alternative suggestion is that within the domain of trans studies that they fulfill complimentary dimensions of investigation. Discourse analysis and phenomenology converge in trans studies because they are submitted to the same ethical and political imperative: (...) the systematic development of the trans archive. Both discourse analysis and phenomenology as methods in trans studies are directed toward the development of a genuinely trans history, perspective, and theory, with special methodological consideration toward the way that this perspective is misunderstood or obscured by dominant frameworks within cisgender society. In what follows, I provide a brief reconstruction of two major interventions in trans phenomenology, demonstrating that each is carefully concerned with distinctly archival considerations, but I further argue that each project remains incomplete because of an incomplete bracketing of medicalized cisgender concepts. I then propose a brief alternative program aimed at the full suspension of cisgender categories that I call transgender existentialism. (shrink)

In this short essay I connect Perry Zurn’s work on curiosity with trans history, activism, and art to bridge trans curiosity with eco curiosity in the form of transecological curiosity. I discuss examples from trans art, literature, music, and ecopoetics.

Recently, the concept of "gender identity" has enjoyed a great deal of attention in gender metaphysics. This seems to be motivated by the goal of creating trans-inclusive theory, by explaining trans people's genders. In this paper, we aim to unmotivate this project. Notions of "gender identity" serve important pragmatic purposes for trans people, such as satisfying the curiosity of non-trans people, and, relatedly, securing our access to important goods like legal rights and medical care. However, we (...) argue that this does not mean that "gender identity" is a metaphysically substantial thing that deserves extensive theoretical attention. There are reasons to be skeptical of such a concept. We trace the history of "gender identity," primarily to identify its roots in trans-antagonistic medical theory and its connections to the problematic "wrong-body" model--a legacy that has pathologized and flattened trans experience. Moreover, we argue that trans people primarily use "gender identity" to explain ourselves to non-trans people, rather than to discuss ourselves among ourselves. Thus, we urge theorists to resist the urge to substantiate gender identity. Instead, we encourage the development of new and better concepts, ones that attend to the lived realities of trans community and the flourishing gender terms and practices that are constructed there. If these lived realities are taken seriously, there is no need to “explain” trans people’s genders; we can simply see them as they are. (shrink)

Utilizing the metaphor of the palimpsest, this paper looks at layering processes at work in the natural world and human perceptions of it, paying particular attention to the manifestations of the past visible in constructions in and of the landscape. History is made of constant reformations, in which pieces of the past make up the present. The palimpsest offers a useful tool for discussing a trans-temporal landscape. The layers of landscape construction go beyond the literal geological construction, encompassing (...) human pasts and presents as well. Engaging the palimpsestuous layers at work in physical and textual landscape construction allows us to place human endeavours into more expansive notions of temporality. (shrink)

The development of modern science has depended strongly on specific features of the cultures involved; however, its results are widely and trans-culturally accepted and applied. The science and technology of electricity provides a particularly interesting example. It emerged as a specific product of post-Renaissance Europe, rooted in the Greek philosophical tradition that encourages explanations of nature in theoretical terms. It did not evolve in China presumably because such encouragement was missing. The trans-cultural acceptance of modern science and technology (...) is postulated to be due, in part, to the common biological dispositions underlying human cognition, with generalizable capabilities of abstract, symbolic and strategic thought. These faculties of the human mind are main prerequisites for dynamic cultural development and differentiation. They appear to have evolved up to a stage of hunters and gatherers perhaps some 100 000 years ago. However, the extent of the correspondence between some constructions of the human mind and the order of nature, as revealed by science, is a late insight of the last centuries. Quantum physics and relativity are particularly impressive examples. (shrink)

I examine the epistemological debate on scientific realism in the context of quantum physics, focusing on the empirical underdetermin- ation of different formulations and interpretations of QM. I will argue that much of the interpretational, metaphysical work on QM tran- scends the kinds of realist commitments that are well-motivated in the light of the history of science. I sketch a way of demarcating empirically well-confirmed aspects of QM from speculative quantum metaphysics in a way that coheres with anti-realist evidence (...) from the history of science. The minimal realist attitude sketched withholds realist com- mitment to what quantum state |Ψ⟩ represents. I argue that such commitment is not required for fulfilling the ultimate realist motiva- tion: accounting for the empirical success of quantum mechanics in a way that is in tune with a broader understanding of how theoretical science progresses and latches onto reality. The ideal of “freedom-as-omnipotence” pointed out by Daya Krishna in his interpretation of the Yogasūtra is undoubtedly present throughout the history of yoga. This ideal of omnipotence is also at the basis of the contemporary transhumanist program through the ideal of human perfection, and there are already transhumanist versions that defend the use of meditative techniques from India as complements to a program of human enhancement. In this essay I argue that transhumanism and bioliberalism seek to free us from (...) biological conditioning at the cost of making us more and more dependent on science and technology, presenting a sort of “derivative freedom” that many premodern yogas would never accept. Instead, contemporary yogas, which no longer contemplate the ideal of yogic powers, are much more amenable to the idea of human enhancement through external devices, partly because they have adopted diluted versions of the models of freedom advocated in premodern yogas. We are already witnessing the evolution of a trans-human yoga in which technological devices are incorporated into the practice and virtual practice communities are created, some even made up of avatar-practitioners, in which the human factor is progressively lost. This collection addresses two different audiences: 1) historians and philosophers of the life sciences reflecting on collaborations across disciplines, especially as regards defining and addressing Grand Challenges; 2) researchers and other stakeholders involved in cross-disciplinary collaborations aimed at tackling Grand Challenges in the life and medical sciences. The essays collected here offer ideas and resources both for the study and for the practice of goal-driven cross-disciplinary research in the life and medical sciences. We organise this introduction in three sections. The (...) first section provides some background and context. The second motivates our take on this topic and then outlines the central ideas of each paper. The third section highlights the specificity and significance of this approach by considering: a) how this collection departs from existing literature on inter- and trans-disciplinarity, b) what is characteristic about this approach, and c) what role this suggests for the history and philosophy of the life sciences in addressing Grand Challenges. There is already a long history of conversation between feminism and deconstruction, feminist theorists and Derrida or Derrideans. That conversation has been by turns fraught and constructive. While some of these interactions have occurred in queer feminism, to date little has been done to stage an engagement between deconstruction and transfeminism. Naysayers might think that transfeminism is too recent and too identitarian a discourse to meaningfully interact with Derrida’s legacy. On the other hand, perhaps Derrida’s work was too embedded (...) in second wave feminism, and in some cases implicit misogyny and transphobia, to meet transfeminism on its own playing field. And yet, I think both suspicions shortchange these discourses. In this article, I stage a conversation between Derrida and two writers working in the area of trans feminism: Paisley Currah and Julia Serano. I explore, in particular, how their conceptions of gender neutrality or gender pluralism are complementary and together change the so-called “question of woman,” from a philosophical and political perspective. This paper focuses on a crucial question of social ontology addressed by Gerda Walther, namely, whether a social community has its own reality over and above that of its members and its cultural “products”, such as language, religion, infrastructure, and works of art. Walther has a nuanced answer which combines elements of phenomenology and Marxism. She praises Marxists for drawing our attention to the “community as such”, taken as an object distinct from its members and their relations. She maintains the (...) thesis, defended according to her by “certain socialists and Hegelians” (which presumably includes Marxists), that communities have their own reality. However, she develops it one step further, arguing that these social structures are “higher-order” unitary realities that exist over and above their members and cultural products. In addition, she enriches this realist position from a phenomenological point of view by identifying with precision the kinds of mental act on which communities are founded, namely, “unifications” and “we-experiences”. As such, Walther’s theory is an early encounter between phenomenology and Marxism, prior to Trần Đức Thảo and Jean-Paul Sartre, and thus deserves much more attention than it has received in the history of philosophy. This essay explores the complex relationship between gender and aesthetics, namely through the lens of the transgender movement. After a brief study of the challenges related to the history of gender variance and normativity, the essay will follow the trajectory of Kant’s Critique of Judgment, focusing primarily on the conception of the sublime, and move to explore connections with the work of gender theorist and public health advocate Benjamin T. Singer, whose work develops a rhizomatic model of the transgender (...) sublime. Utilising this framework, the discussion will then examine connections and parallels with the work of Rancière and later Gianni Vattimo. The final section will then explore the concept of aesthetic emergencies from Santiago Zabala, Vattimo’s pupil, who associates both Rancière and Vattimo with this concept while at the same time drawing from Heidegger’s writings. Through a re-examination of the sublime and the work of these theorists, this paper will illuminate potential new connections, pathways, and possibilities for the transgender movement, aesthetic theory, and political engagement. Writers endorsing a general account of meaning as non-recuperable or non-coincidental from one instantiation to the next may nonetheless treat the heterogeneous contacts between instants of experience as transformations of fleeting forms, states, logics, structures, outlines, surfaces, presences, organizations, patterns, procedures, frames, standpoints. When thought as pattern, the structural- ranscendental moment of eventness upholds a certain logic of internal relation; the elements of the configuration mutually signify each other and the structure presents itself as a fleeting identity, a gathered field. (...) The particularity of eventness is not allowed to split the presumed (temporary) identity of the internal configuration that defines the structure as structure. History would be the endless reframing of a frame, the infinite shifting from paradigm to paradigm. Heidegger and Derrida argue instead that In their essence, Beings don’t HAVE structure or constitution. There is no such THING as a form, a structure, a state. There is no trans-formation but rather a trans-differentiation, (transformation without form, articulation as dislocation) What is being transcended is not form but difference. (shrink)

1 Introduction1 In the 1980s, hermeneutics was often incorporated into deconstructionism and literary theory. Rather than focus on authorial intentions, the nature of writing itself including codes used to construct meaning, socio-economic contexts and inequalities of power,2 Gadamer introduced a different perspective; the interplay between effects of history on a reader’s understanding and the tradition(s) handed down in writing. This interplay in which a reader’s prejudices are called into question and modified by the text in a fusion of understanding (...) and topic revitalized the study of the printed word. Gadamer’s turn to language for understanding the meaning of Being also appealed to the post-modern antipathy toward modernity and metaphysics.3 If the truth and validity of interpretations are limited to communities of language, then our mode of being in history cannot but be historical. This point of view rendered Gadamer’s phenomenological hermeneutics vulnerable to the critique of moral and epistemological relativism. However, Gadamer’s theory of interpretation also stems from re-examination of the beginning of knowledge in the Pre-Socratics and Plato, and on this basis, is receptive to another dimension of inquiry than that which was trending in North America. -/- At the East-West Center, University of Hawai’i at Manoa in 1982, Chung-ying Cheng for the first time introduced onto-hermeneutics to an audience of esteemed philosophers including Li Zehou, Ren Jiyu, Feng Youlan, and Zhang Liwen.4 In contrast to schools of deconstruction and literary theory that had disengaged the interpreter from trans-historical sources of meaning and truth, Cheng explained that interpreters exist within a cosmological order inextricable from responsibility to harmonize Heaven and Earth in creative acts of interpretation. By integrating Chinese cosmology into hermeneutics through ontology, he tacitly challenged philosophers in the West to re-examine assumptions about humanity’s place in nature and by implication, Gadamer’s recovery of the beginnings of knowledge in Western philosophy. -/- Cheng’s Neo-Confucianism is inspired by the method and goals of Thomé H. Fang. The following words by Fang seem to prefigure, although in an indistinct and bundled way, aspects of Cheng’s philosophy including a Mencian theory of human nature, comprehensive observation, and creativity: “In the very process of living in concord with creative Nature, Man is charged with an ideal to be fully realized in the light of the principle of comprehensive harmony.”5 Like Fang, Cheng reinvigorates Chinese culture and language, but not solely in order to vindicate the insights of Neo-Confucianism. He has studied Western thought, from pragmatism and the analytic school to German idealism and phenomenology, to unlock and clarify philosophical concepts within the Yijing tradition and thereby render them intelligible to Anglophones. The result has been an awakening of Western scholars to the moral and cultural consequences of decoupling their thought from metaphysical foundations that are neither dogmatic nor doctrinal. -/- Not unlike the dialectic of Gadamer’s dialogue form, onto-generative hermeneutics integrates contrary positions on the same topic in order to blend both sides into a world philosophy, or as Cheng says, a “totalizing or integrative theory,”6 not to be confused with a theoretical rewording of a theory. On the contrary, the universal scope and relevance of hermeneutics stems from personal experience. Just as Gadamer, in response to faction and strife, immersed himself in Plato during the war years, and developed a method with which to harmonize opposites, so too, according to On-cho Ng, was Cheng moved by faction, strife and political persecution to develop a path toward unity.7 Gadamer taught at McMaster University in Hamilton, Ontario, and Cheng at the University of Hawai’i at Manoa among other institutions in North America. They facilitated trans-continental educational and cultural ties. Similar experiences yield similar insights irrespective of differences of time and place. Hence, authors in this issue who reside in Europe, China and North America, delineate the differences between Gadamer and Cheng, yet also, in light of Cheng’s onto-generative method and cosmology, develop integrative theories. Due to the page-budget restriction of the publisher, certain articles of this special theme will be subsequently published in the next issue. -/- 2 Integrative Theory This special issue of The Journal of Chinese Philosophy confirms a dimension of hermeneutics that Cheng has both motivated and inspired. The contributors do not abide by the conviction that since thought is mediated by language, interpretations cannot transcend culture. On the contrary, their research exemplifies the fruits of trans-historical onto-dialogical hermeneutics within limits defined by their field inquiry, organized into Parts I and II, around three themes: language, the philosophy of history and ethics. -/- Andrew Fuyarchuk introduces the theme of ontology in relation to Gadamer’s turn to language. Fuyarchuk argues that Chung-ying Cheng’s criticism of Gadamer’s hermeneutics is informed by Heidegger’s concept of Dasein and thereby overlooks how Gadamer’s Platonic-Pythagorean problem of the division between the One and Many is harmonized in the event of language, which in turn positions Gadamer in proximity to the presupposed grounds of receptivity in Cheng’s onto-generative hermeneutics. Lauren Pfister’s contributing article addresses the year 2000 meeting between Cheng and Gadamer in Heidelberg and expands the transhistorical grounds of meaning in Gadamer to matters of theology. Pfister’s summary of the written Chinese record of their conversation indicates that Cheng does not address the role of Christian philosophy and hence, the role of the inner word in Gadamer’s hermeneutics. This is important not only for detecting changes in Cheng’s philosophical development, but also for modifying his hermeneutics along the lines of a living conversation, possibilities explored by Pfister in a sequel to the article submitted to this issue. Nevertheless, by raising the issue of how Gadamer’s turn to language for understanding the meaning of Being extends possibilities in Cheng’s thought, Pfister anticipates the article by Katarina Gajdosova. She returns to the roots of Chinese thought during the Warring States period and broadens the meaning of names in recently excavated texts. Contrary to the conventions about how to understand terms, she appeals to both Heidegger’s ontology and Cheng’s notion of receptivity and creativity to reinterpret naming in relation to cosmology. Along the same lines, insofar as the event of Being is lingual, Jay Goulding captures its emergent structure in an evolving community of scholars and scholarship. He recalls his philosophical journey toward Cheng’s philosophy that begins in conversations with Gadamer at McMaster University in Hamilton, leads to Heidegger and Asian thought, expands into turning points with teachers and colleagues from various backgrounds that by increments contributed to Goulding’s formulation of “Daoist phenomenology.” -/- Although differing traditions guide their inquiries and research, Cheng and Gadamer recall the wisdom of the past to ameliorate the fragmentation in contemporary life. This leads them to re-examine the origins of philosophy; historical roots and thus sources of creative re-interpretations East and West whose affinities are developed in contributions by Hyun Höchsmann and Friederike Assandri. Höchsmann assesses convergences and divergences in the origins of Chinese and Western philosophy (Confucius and Socrates, the Yijing and Pre-Socratics) that culminates in pairing Gadamer’s understanding of paideia in the context of Plato’s political cosmology in the Timaeus with moral and social cultivation in The Western Inscription. She delineates the limits of this comparison which in turn justifies introducing Vattimo’s notion of locality. Assandri’s comparative analysis moves between India and China, Buddhism and Tang Daoism. Based on Gadamer’s argument that writing detaches concepts from their cultural moorings, she defines and applies three levels of understanding in onto-generative hermeneutics to Buddhist terms that were assimilated into the Benji Jing and in so doing clarifies essential dimensions of Daoism. -/- Contributions by Stephen Palmquist and Nicholas Brasovan position Cheng in relation to Kant and Gadamer by way of Aristotle’s ethics respectively. On the one hand, Palmquist plots Cheng’s evolving criticism of Kant’s moral philosophy and draws on crucial dimensions of Gadamer’s hermeneutics to reposition that criticism in a constructive relation to Kant’s emphasis on the philosophical conditions of morality while also indicating how religious dimensions of his thought answer Cheng’s concerns for lived moral action. For Palmquist, Gadamer enables a constructive criticism of Cheng. On the other hand, Brasovan compares Cheng’s Yijing-based account of moral deliberation with Gadamer’s Aristotelian-based ethics and reasons that in contrast to Cheng, Gadamer’s hermeneutical consciousness is disengaged from practical knowledge. For Brasovan, Cheng is a constructive critic of Gadamer. Palmquist and Brasovan’s divergent angles on Gadamer and Cheng map onto a dialectic of contrast and complementarity that constitutes the inner logic of Cheng’s philosophy. In other words, Gadamer and Cheng ought to be read alongside one another for the sake of removing discrepancies and contradictions, which constitutes the organic structure of their thinking. -/- 3 Our Mode of Being in History Is Not Historical The conversations between Cheng and Gadamer in this issue of The Journal of Chinese Philosophy pivot on language, philosophy of history and ethics within a comparative framework of analysis, but also explore the grounds that make the comparisons possible. Those grounds are informed by Chinese cosmology, and function to wrest Gadamer from the shadow of Heideggerian facticity and reposition him within the range of Cheng’s ideas about our place in nature that is embedded in his question about how mind emerges from inorganic matter.8 -/- For Gadamer scholars of Heidegger, human finitude, our ownmost individuating death ensures that hermeneutics is always open to the other as other, always on the way toward understanding the meaning of Being. To arrest the process in a concept of “the Absolute” cannot but represent someone’s point of view, and thereby render hermeneutics indistinguishable from ideology. However, insofar as finitude is defined by them in terms of an onto-theological concept of immorality, finitude is a metaphysical concept consistent with epistemologies and confuse beings with the meaning of Being. As a result, the celebrated political value of hermeneutics to always be on the way toward an understanding of the meaning of Being admits subtle variations on the same worldview that are insufficiently self-critical. -/- Gadamer scholars of Heidegger are right. A transformation in ethos and opening to the meaning of Being depends on awareness of finitude. Yet this awareness does not yield openness to more of the same, i.e., discourse structurally incapable of coming to unity but instead, for both Gadamer and Cheng, openness to a distinctly different ontological dimension of reality. As Sandra Wawrytko and So-Seong Park indicate,9 this ontological dimension is prefigured in the experience of being-as-a-whole or the totality of all possible relations in both Chinese totemic shamanistic rituals,10 and Greek Dionysian festivals.11 Through these religious experiences human ethos and therefore consciousness is expanded and elevated from being centered on one’s ownmost concerns toward an affinity with all sentient beings from insects and plants to animals. The channel for this affinity is an auditory disposition and hence, the emotions, compassion, and feeling response. -/- The capacity for an auditory disposition, or as Gadamer calls it, listening consciousness to respond to the inter-relationality and therefore inherent balance of nature is developed through music, song and dance of the religious rituals and festivals. They facilitate the unity of mind with nature. This use of music, that transforms ordinary consciousness, explains Cheng’s emphasis on the receptivity of feeling response in comprehensive observation, and Gadamer’s emphasis on openness to the other in attunement. However, an auditory disposition characteristic of pre-literate oral cultures that reveals the “All” need not rely on religion. As theorists about the evolution of language have explained,12 modern languages preserve their pre-historical past in music or prosody. That is to say, the song and dance that revealed the totality of inter-related beings to an ethos of comprehensive observation and attunement toward beings in classical civilizations is retained in the back-and-forth movement or rhythm of the dialogue form. Our mode of being in history is a mode of being in nature – through the music of language. -/- While alerting the reader to the limits of a nominalist interpretation, Gadamer expresses the inner law of the nature as follows: “in perishing there is always becoming, and in becoming there is always perishing.”13 Considered in process, opposites generate and blend into each other. This law of nature applies to everything.14 Hence, in a manner comparable to Pfister’s concluding insights, onto-dialogical hermeneutics is not only open to discrete events of otherness but moreover, to the moving structure of reality expressed, as Gajdosova suggests, in the existential moment of naming. Considered as interplay of tension and resolution with a life of its own, the dialectic of a dialogue is self-similar to the way in which an organism grows (by instinct). There is, therefore, a sense in which the art of interpretation extends the human mind into the eternal cycles of nature such that we participate in the articulation of the inner telos/homeostasis toward which all beings strive and importantly for Gadamer scholars of Heidegger, within the material limits of energy to which our embodied minds are self-evidently subject. Popper's account of refutation is the linchpin of his famous view that the method of science is the method of conjecture and refutation. This thesis critically examines his account of refutation, and in particular the practice he deprecates as avoiding a refutation. I try to explain how he comes to hold the views that he does about these matters; how he seeks to make them plausible; how he has influenced others to accept his mistakes, and how some of the ideas (...) or responses to Popper of such people are thus similarly mistaken. I draw some distinctions necessary to the provision of an adequate account of the so-called practice of avoiding a refutation, and try to rid the debate about this practice of at least one red herring. I analyse one case of 'avoiding' a refutation in detail to show how the rationality of scientific practice eludes both Popper and many of his commentators. Popper's skepticism about contingent knowledge prevents him from providing an acceptable account of contingent refutation, and so his method is really the method of conjecture and conjecture. He cannot do without the concepts of knowledge and refutation, however, if his account of science is to be plausible or persuasive, and so he equivocates between, amongst other things, refutation as disproof and refutation as the weaker notion of discorroboration. I criticise David Stove's account of this matter, in particular to show how he misses this point. An additional advantage Popper would secure from this equivocation is that if refutations were mere discorroborations they would be easier to achieve, and hence more common in science, than is the case. On Popper's weak notion of refutation, it would be possible to refute true theories since corroboration does not entail truth. There are two other related doctrines Popper holds about refutation which, if accepted, make some refutations seem easier to obtain than is the case. I call these doctrines 'Strong Popperian Falsificationism' (SPF) and 'Weak Popperian Falsificationism' (WPF). SPF is the false doctrine that if a prediction from some theory is refuted then that theory is refuted. Popper does not always endorse SPF. In particular, when confronted with a counterexample to it, he retreats to WPF, which is the false doctrine that if a prediction from some theory is refuted then that theory is prima facie refuted. WPF , or even SPF, can seem plausible if one has in mind predictions derived from theories in strong or conclusive tests of those theories, which I suggest Popper characteristically does. v Popper is disposed to describe any such case of predictive failure which does not lead to the refutation of the theory concerned as one in which that refutation has been avoided. To reinforce his portrayal of the refutation, or the attempted refutation, of major scientific theories as the rational core of scientific practice, Popper treats the so-called practice of avoiding a refutation as untypical of science, and much so-called avoidance he dismisses as unscientific or pseudo-scientific. I argue that his notion of avoiding a refutation is incoherent. Popper is further driven to believe that such avoidance is possible, however, because he conflates sentences with propositions and propositions with propositional beliefs. Also, he wishes to avoid being saddled with the relativisim that is a consequence of his weak account of refutation as discorroboration. Popper believes that ad hoc hypotheses are the most important of the unscientific means of avoiding a refutation. I argue that his account of such hypotheses is also incoherent, and that several hypotheses thought to be ad hoc in his sense are not. Such hypotheses appear to be so largely because of Popper's use of rhetoric and partly because these hypotheses are unacceptable for other reasons. I conclude that to know that a hypothesis is ad hoc in Popper's sense does not illuminate scientific practice. Popper has also attempted to explicate ad hocness in terms of some undesirable, or allegedly undesirable, properties of hypotheses or the explanations they would provide. The first such property is circularity, which is undesirable; the second such property is reduction in empirical content, which is not. In the former case I argue that non-circularity is clearly preferable to non-ad hocness as a criterion for a satisfactory explanation or explanans, as the case may be, and in the latter case that Popper is barking up the wrong tree. Some cases of so-called avoidance are obviously not unscientific. The discovery of Neptune from a prediction based on the reasonable belief that there were residual perturbations in the motion of Uranus is an important case in point, and one that is much discussed in the literature. The manifest failure of astronomers to account for Uranus's motion did not lead to the refutation of Newton's law of gravitiation, yet significant scientific progress obviously did result. Retreating to WPF, Popper claims that Newton's law was prima facie refuted. In general, astronomers have never shared this view, and they are correct in not doing so. I argue that the law of gravitation would have been prima facie refuted only if there had been good reason at the time to believe as false what is true, namely, that an unknown trans-Uranian planet was the cause of those Uranian residuals. Knowledge of the trans-Uranian region was then so slight that it was merely a convenient assumption, one which there was little reason to believe was false, that the known influences on Uranus's motion were the only such influences. I conclude that in believing vi or supposing that it was this assumption that was false, rather than the law of gravitation, Leverrier and Adams, the co-predictors of Neptune, were acting rationally and intelligently. Popper's commentators offer a variety of accounts of the alleged practice of avoiding a refutation, and of this case in particular. I analyse a sample of their accounts to show how common is the acceptance of some of Popper's basic mistakes, even amongst those who claim to reject his falsificationism, and to display the effects on their accounts of this acceptance of his mistakes. Many commentators recognize that anomalies are typically dealt with by changes in the boundary conditions or in other of the auxiliary propositions employed. Where many still go wrong, however, is in retaining the presupposition of WPF which encouraged Popper to hold the contradictory view about anomalies in the first place. Thus Imre Lakatos and others, for example, have developed a 'siege mentality' about major scientific theories; they see them as under continual threat of refutation from anomalies, and so come to believe that dogmatism is essential in science if such theories are to survive as they do. I examine various such doomed attempts to reconcile Popper with the history of science. It is a common failure in this literature to conflate or to fail to see the need to distinguish a belief from a supposition, and an epistemic reason from a pragmatic reason. I argue that only if one does draw these distinctions can one give an adequate account of how anomalies are rationally dealt with in science. The other important strand in Popper's thinking about 'avoidance' of refutation which has seriously misled some of his commentators is his unfounded belief in the dangers of ad hoc hypotheses. I examine the accounts that a sample of such commentators provide of the trans-Uranian planet hypotheses of Leverrier and Adams. These commentators imply or assert what Popper only hints at, namely, that there is something fishy about this hypothesis. I provide a further defence of the rationality of entertaining this hypothesis at the time. I conclude with a few remarks about Popper's dilemma in respect of scientific practice and his long standing emphasis on refutations. (shrink)

This is not a mathematics book, but a book about mathematics, which addresses both student and teacher, with a goal as practical as possible, namely to initiate and smooth the way toward the student’s full understanding of the mathematics taught in school. The customary procedural-formal approach to teaching mathematics has resulted in students’ distorted vision of mathematics as a merely formal, instrumental, and computational discipline. Without the conceptual base of mathematics, students develop over time a “mathematical anxiety” and abandon any (...) effort to understand mathematics, which becomes their “traditional enemy” in school. This work materializes the results of the inter- and trans-disciplinary research aimed toward the understanding of mathematics, which concluded that the fields with the potential to contribute to mathematics education in this respect, by unifying the procedural and conceptual approaches, are epistemology and philosophy of mathematics and science, as well as fundamentals and history of mathematics. These results argue that students’ fear of mathematics can be annulled through a conceptual approach, and a student with a good conceptual understanding will be a better problem solver. The author has identified those zones and concepts from the above disciplines that can be adapted and processed for familiarizing the student with this type of knowledge, which should accompany the traditional content of school mathematics. The work was organized so as to create for the reader a unificatory image of the complex nature of mathematics, as well as a conceptual perspective ultimately necessary to the holistic understanding of school mathematics. The author talks about mathematics to convince readers that to understand mathematics means first to understand it as a whole, but also as part of a whole. The nature of mathematics, its primary concepts (like numbers and sets), its structures, language, methods, roles, and applicability, are all presented in their essential content, and the explanation of non-mathematical concepts is done in an accessible language and with many relevant examples. For decades, the question of whether dialectics applies to nature has been a hotly debated topic in the Marxian literature. A number of authors have claimed that the Marxist outlook on nature and natural sciences has been for-mulated by Engels alone. According to this view, Marx, unlike Engels, was concerned not with trans-historical laws governing the universe but with some particular laws of society. This anti-Engels camp, so to speak, mainly tended to draw bold lines between Marx and Engels, (...) and charged Engels with dis-torting Marxʼs original ideas of dialectics by some kind of reductionism, sci-entism and positivism that might also end up in an obsolete idealism. Engels was „following Hegelʼs mistaken lead“ by extending „the method to apply also to nature“. However, dialectics was „limited ... to the realms of history and society“.2 Some others objected to this view, and characterized any at-tempt to sharply contrast Engels with Marx as concealed mysticism and idealism. For the pro-Engels camp, Engelsʼs conception of nature was „in full conformity“ with Marxʼs materialist philosophy.4 Dialectics of nature was „no invention of Engels“. On the contrary, „it was worked out in collaboration with Marx and had his full agreement. (shrink)

This dissertation re-examines the principal philosophical thrusts of the German Enlightenment period, from the perspective of their totalizing-mythological function, and investigates how this function is criticized by the non-totalizing function of myth found within the primary mythical images in the work of Goethe, Nietzsche, Rilke, and Walter Benjamin. ;Utilizing the revolutionary book by Hans Blumenberg on the function of myth in German Idealism and Romanticism, I instigate a discourse between Blumenberg's totalizing work on myth and the negative-dialectical work on myth (...) as proposed by Theodor Adorno. I locate the German origins of this negative-dialectical myth-making in the work of Goethe, specifically his non-totalizing image, Wilhelm Meister. I locate the development of this use of myth in Nietzsche's Zarathustra, and, finally, trace a similar function at work in Rilke's Malte and Walter Benjamin's historical materialist. ;Contrary to Habermas, who argues that Nietzsche opened up two roads to postmodernity, one leading to the "ontologization of aesthetics" and the other to the "totalizing critique" of reason , I put forth the argument that the Nietzschean "two roads" metaphor is useful but needs to be re-shaped, configuring one road toward the mythological history and historical mythology of Rilke and Walter Benjamin, and another road the Theodor Adorno's "thorough critique" of reason. ;The need to revise Habermas's "two roads to post-modernity" theory mythographically, rests on the primary investigation of this dissertation: to trace by de-scription the practical incarnation of the word on German soil . I define this process of "practical incarnation" as that word which subversively desires to de-scribe and trans-figure the neurotic -psychotic structure that has defined the parameters of Western discourse, at least since neo-Platonic Christianity influenced cultural codifications of the West. Finally, I maintain that the primary image of criticism which emerges from the dialectical work of the writers herein, is the image of man-child, a classless, non-totalizing image implicit in Goethe's Wilhelm Meister, and developed in the Kind-Mensch constellation in the work of Nietzsche, Rilke, and Walter Benjamin. Rapid urbanization in Vietnam significantly impacts the environment and human well-being. Public parks are crucial for enhancing social and environmental sustainability in urban areas, yet their establishment and expansion require substantial funding. This study investigates the factors influencing Vietnamese urban residents’ willingness to donate to planting projects in public parks, utilizing the Bayesian Mindsponge Framework (BMF), which combines Mindsponge Theory’s informational entropy-based notion of value with Bayesian analysis. Analyzing data from 535 residents in major Vietnamese cities, we found that while (...) men visit public parks more frequently, they are less willing to donate to planting projects. Older residents visit parks more often and are more willing to donate, while higher-income individuals show greater willingness to donate. Most motivations—such as relaxation, physical activities, nature enjoyment, socializing, and family time—are positively linked to park visit frequency and indirectly to donation willingness. However, only relaxation and enjoyment of nature are directly associated with willingness to donate. Interestingly, higher education levels and visiting parks for children’s educational activities are associated with lower donation willingness. These findings hint at the possible existence of the free-riding problem, gender inequality, ineffective environmental education, and lack of awareness of public parks’ natural value, as well as opportunities to cultivate an eco-surplus culture through nature interactions in public parks. Like other books of Dr. Vuong, I always had a good laugh and an intellectually stimulating time after reading his book. -/- As someone who has experienced the frustrations of government procedures, the “culture” of doing research, or the poor and crowded streets in Vietnam, I found Dr. Vuong’s observation both hilarious and poignant. This ability to tackle these everyday annoyances with humor and turn them into opportunities for reflection is truly masterful.

As a generation of ‘digital natives,’ secondary students who were born from 2002 to 2010 have various approaches to acquiring digital knowledge. Digital literacy and resilience are crucial for them to navigate the digital world as much as the real world; however, these remain under-researched subjects, especially in developing countries. In Vietnam, the education system has put considerable effort into teaching students these skills to promote quality education as part of the United Nations-defined Sustainable Development Goal 4 (SDG4). This issue (...) has proven especially salient amid the COVID−19 pandemic lockdowns, which had obliged most schools to switch to online forms of teaching. This study, which utilizes a dataset of 1061 Vietnamese students taken from the United Nations Educational, Scientific, and Cultural Organization (UNESCO)’s “Digital Kids Asia Pacific (DKAP)” project, employs Bayesian statistics to explore the relationship between the students’ background and their digital abilities. Results show that economic status and parents’ level of education are positively correlated with digital literacy. Students from urban schools have only a slightly higher level of digital literacy than their rural counterparts, suggesting that school location may not be a defining explanatory element in the variation of digital literacy and resilience among Vietnamese students. Students’ digital literacy and, especially resilience, also have associations with their gender. Moreover, as students are digitally literate, they are more likely to be digitally resilient. Following SDG4, i.e., Quality Education, it is advisable for schools, and especially parents, to seriously invest in creating a safe, educational environment to enhance digital literacy among students. Corporate bond appeared in 1992-1994 in Vietnamese capital markets. However, it is still not popular to both business sectors and academic circles. This paper explores different dimensions of Vietnamese corporate bond market using a unique and perhaps, most complete data set. State not only intervenes in the bond markets with its powerful budget and policies but also competes directly with enterprises. The dominance of state-owned enterprises and large corporations also prevents small and medium enterprises from this debt financing vehicle. Whenever (...) a convertible term is available, bondholders are more willing to accept lower fixed income payoff. But they would not likely stick to it. On the one hand, prospective bondholders could value the holdings of equity when realized favourably ex ante. On the other hand, the applicable coupon rate for such bonds could turn out negative inflation-adjusted payoff when tight monetary policy is exercised and the corresponding equity holding turns out valueless, ex post. Given the weak primary market and virtually non-existent secondary market, the corporate bond market in Vietnam reflects our perception of the relationship-based and rent-seeking behaviour in the financial markets. For the corporate bonds to really work, they critically need a higher level of liquidity to become truly tradeable financial assets. Updated entries in 2010 affirm the findings and conclusions. Some astronomers believe that we have discovered that Pluto is not a planet. I contest this assessment. Recent discoveries of trans-Neptunian Pluto-sized objects do not require that we exclude Pluto from the planets. But the obvious alternative, that classificatory revision is a matter of arbitrary choice, is also unpalatable. I argue that this classificatory controversy — which I compare to the controversy about the classification of the platypus — illustrates how our classificatory practices are laden with normative commitments of (...) a distinctive kind. I argue that the “norm-ladenness” of classification has philosophically significant ramifications for how we think about scientific disputes and debates in the metaphysics of classification such as the monism/pluralism debate. Thông qua kết quả khảo sát đối với 315 sinh viên (SV) Khoa Quản trị kinh doanh, Trường Đại học Nguyễn Tất Thành, bài viết sử dụng thuyết Hành vi dự định (TPB) của Ajzen (1991) để xác định các nhân tố thuộc Vai trò của phương thức tư vấn học tập định hướng tác động đến Ý định định hướng nghề nghiệp của SV. Kết quả nghiên cứu cho thấy, có sự khác biệt về ý định định hướng nghề (...) nghiệp của SV bước vào giai đoạn quyết định lựa chọn ngành/nghề so với khóa còn lại và cả 3 nhân tố thuộc Vai trò của phương thức tư vấn học tập định hướng: Thái độ, Chuẩn chủ quan và Nhận thức kiểm soát hành vi tác động tích cực đến Ý định định hướng nghề nghiệp của SV. Nghiên cứu này sử dụng mô hình hồi quy đa biến để phân tích mối quan hệ giữa niềm tin của người tiêu dùng, khuyến mãi, giao hàng chặng cuối và quyết định mua hàng của người tiêu dùng tại TP. Hồ Chí Minh trên các sàn thương mại điện tử (TMĐT). Kết quả cho thấy, Niềm tin, Khuyến mãi và Giao hàng chặng cuối là những yếu tố có tác động đáng kể đến Quyết định mua hàng. Central conceptual terms, such as ‘culture’, ‘environment’, ‘nature’ and‘landscape’, are far from being neutral scientific objects. They are academic constructions which need to be understood in their emergence across their historic contexts. -/- Moral it is a cultural expression determined by social dominance and historical context, who gives them a sectary character. We need a moral theory that can be universal, trans-temporal and available to light human individual conduct and the human science and their political ideologies, but not considering (...) the man in the zenith of the Life. The Life, with their biodiversity it is in the pinnacle of the complex cosmos evolution but we don’t know if our specie, born in the Earth, is the end of cosmos evolution. For demanding that answer, was born a new ethical perspective, theory built with the meta-ethics principles and applicable to all human activities. -/- Environmental ethics supported by the two principles_ the critical against anthropocentrism and the critical against ethnocentrism, gives a universal answer to the macro moral problems of our era_ environmental, social, economical and political crises, war and mass destructive weapons…and contributes to rebuilt the human activities in all domains of individual and social life; that’s is the cultural landscape, for instance. This thesis was shaped from Action 13 of the recent Base Erosion and Profit Shifting (BEPS) project adopted by the Organisation for Economic Co-operation and Development (OECD) and G20 countries to prevent profit shifting by multinational enterprises (MNEs). In response to the BEPS Action 13, New Zealand and Vietnam have recently introduced new transfer pricing rules. As little research has been done to examine the effects of the BEPS Action 13 on the transfer pricing landscape of respective countries, the main (...) objective of this study is to understand how the New Zealand and Vietnamese governments have reacted to and adapted the BEPS Action 13 and what tax consultants and taxpayers in both countries think about the new transfer pricing regulations. This study is exploratory in nature. As such, a qualitative case study approach has been adopted using institutional theory as a theoretical framework. Semi-structured interviews were conducted with two tax officers and ten transfer pricing consultants in both countries to identify the differences and similarities, and to draw conclusions.
